XXXVII.

1 The college of apostolic secretaries, instituted by Callixtus III and other Roman Pontiffs, is suppressed. Innocent, Pope XI, Roman Pontiff, directing the vigilance of his care, not only to those matters which regard the salvation of the souls of the universal Christian flock, but also to those which pertain to the needs, protection and relief of the Apostolic See and Chamber, upon which various burdens fall, and which are continually pressing, has been accustomed, after the matters have been carefully and maturely discussed and examined, and1 as the necessity of affairs and the change of times require, to alter those things which were ordained and instituted by his predecessors for certain compelling reasons in the erection of offices of the Roman Curia, and sometimes to reduce them to their former state or even to suppress them entirely, as he perceives it to be salutarily expedient in the Lord.

2 § 1. For indeed from ancient times the Roman Pontiffs have been accustomed to choose the origin of their secretaries from among the apostolic ones.

3 Our predecessors, in order to have at hand industrious men whose labors they might employ in the great and difficult affairs of the Apostolic See, and also for the more speedy dispatch of those same affairs, chose and appointed a considerable number of secretaries; whom our predecessors of happy memory Calixlus III and Pius II reduced to the number of six for certain reasons; afterwards our predecessor of happy memory Innocent VIII, likewise, in order that he might fittingly provide for the dignity and completeness of that same See and Curia, and for the easier, speedier, more diligent and more accurate dispatch of Briefs and other apostolic letters, and also in order that he might meet certain very pressing needs of the Apostolic Camera, chose or took up and appointed eighteen others, so that together with the aforesaid six already existing they constituted a college of twenty-four secretaries, assigning and applying to that same college and secretaries various annual revenues and emoluments to be divided and distributed among the individual secretaries existing at the time in equal portions, and also creating them true prelates of the apostolic palace and familiars and continuous table-companions, and granting them also many other prerogatives and pre-eminences more fully contained in his constitution under the date given at Rome at St. Peter's in the year of the Lord's Incarnation 1487, on the day before the Kalends of January, in the fourth year of his pontificate, their privilege—2

4 § 2. And since, in consideration of the aforesaid emoluments applied to the same college, a sum of sixty-two thousand and four hundred florins, or gold ducats of the Camera, had been paid by it for the relief of the said urgent necessities of the Camera and the Apostolic See; for this reason the same Innocent, our predecessor, established and decreed that, in the event that the revocation or alteration of the aforesaid office should follow, the entire said sum of sixty-two thousand and four hundred ducats of the Camera should be restored, in which 3 in no way could the emoluments received in the meantime be imputed, with the faculty reserved to him of appointing another as domestic secretary, as is likewise contained more fully in the same constitution. But since some desired in various ways to ascend to the aforesaid office of secretariat contrary to the desire and will of the same Pontiff, which was that none should be admitted to it except persons qualified both in age and in learning, as the office itself requires; for this reason the same Innocent by other letters of his in the form of a Brief, under date given at Rome, at St. Peter's, on 1 February 1488, in the fourth year likewise of his pontificate, established that no one should be assumed to the same office unless he had first been approved and accepted by the same college after a previous examination. Which privileges and prerogatives the same college was confirmed in by other Roman Pontiffs, successors and likewise predecessors of ours. Then, certain controversies having arisen, for the composition and termination of those, Pius V of happy memory, likewise our predecessor, by his motu proprio, under date given at Rome, at St. Peter's, on the day before the Nones of May, in the sixth year, established and decreed many things in favor of the same college, especially that these offices could never at any time be revoked, reduced, altered or moderated by the Roman Pontiffs existing for the time being, or the college itself suppressed or extinguished, unless first restitution had been made really and with effect to each of the secretaries then living in full and without any diminution of the monies for which it is established that they purchased or held the offices. Finally, other controversies having arisen between the same college and the aforesaid domestic secretary, Sixtus V of happy memory, with a prior narrative that in the said college men distinguished in virtues, experience and use of matters and business flowing to the Roman Curia pertaining to the said office were numbered, suppressed and extinguished the aforesaid office of domestic secretary, and united and incorporated it with the college along with its emoluments, in consideration of which twenty-five thousand gold scudi in gold were paid by the same college to our Apostolic Camera, establishing further many things, and also granting many prerogatives to these secretaries, and especially that they should be prelates of both the Signatura as referendaries, and should have a place in the pontifical chapel, as is contained more fully in the letters of the same Sixtus in the form of a Brief, under date given at Rome, at St. Peter's, on 1 April 1586, in the first year of his pontificate.

5 § 3. The aforesaid College, in order to gather the sum of twenty-five thousand scudi of gold, or its equivalent, for the purpose of paying it to the aforesaid Camera on account of the said application and assignment of the emoluments of the said domestic secretary, by virtue of the licence and faculty granted by the same Sixtus, and of which mention is made in his letters in the form of a Brief issued under the date of 17 February of the said year 1586, erected a monte upon the property and gross or mass of the same College, with the obligation and promise to extinguish it within six years; and furthermore (since the same College had also obtained from the same Sixtus a similar suppression of another domestic secretary of the Briefs which are written to princes, and the concession and assignment of his emoluments to the favour and benefit of the same College, with twelve thousand scudi of gold paid to our Camera) by licence and faculty of the same Sixtus erected or increased 4 a monte in the sum of the said twelve thousand scudi of gold (the aforesaid six-year period, as it were, being extended to another six years, which the said Pontiff wished the first monte to be extinguished within), so that the first monte erected and respectively increased was in two hundred and seventy-eight places at the rate of one hundred scudi of currency for each place, and in other one hundred and twenty places at the rate of one hundred scudi of gold in gold for each of the places; and afterwards, by virtue of another faculty and licence granted by Clement IX of blessed memory, likewise our predecessor, for the purpose of extinguishing the aforesaid monte, erected and constituted another new monte of four hundred and fifty-eight places at the rate of the price of one hundred and the annual fruit of four scudi of Roman currency for each place, with the addition however of a similar law to extinguish the aforesaid new monte within twelve years to be reckoned from its erection, as is more fully contained in the letters in the form of a Brief of the said Clement our predecessor under the date given at Rome on 4 January 1669, and respectively in the instrument of the said erection of 16 May of the said year drawn up by Peter Gentile Catalan then notary of our said Camera.

§ 4. Since, however, among very many matters pertaining to both the spiritual and temporal government, of which we took care to have exact knowledge and information at the beginning of our pontificate, as was fitting, that matter concerning this College of secretaries was brought before us, and thereupon a particular congregation of certain prelates of the Roman Curia was appointed by us with the intervention of our venerable brother Alderan, Cardinal of the Holy Roman Church called Cybo, by the same

6 it was reported by the aforesaid college that in no way were the ends and effects achieved for which, as has been stated above, it was erected and instituted and confirmed, while the administration, care and dispatch of the business entrusted to it as aforesaid are incumbent upon and respectively exercised and fulfilled by two prelates of the same Roman Curia outside the said college, accustomed to be appointed by the Roman Pontiff existing from time to time, of whom one is called secretary of briefs, the other secretary of briefs to princes, so that the aforesaid college has become altogether useless and superfluous and remains so; on the other hand, however, between that college and its secretaries on the one hand and the said Camera on the other hand, many controversies have arisen both in ancient and in modern times, and likewise such offices are known to bring very considerable prejudice and detriment to the same Camera and to cause it, and therefore it is altogether expedient and opportune to suppress and extinguish the said college and its offices, with restitution to the possessors of the same offices of that price which the reason of justice requires and demands should be restored: for which reason5 we enjoined and commanded the same congregation and other prelates added and appointed by us that they should discuss and examine, and afterwards report to us what, according to the limits and reason of the aforesaid justice, so that to each what is his own and is owed may be given, should be restored; and when, together with the said venerable brother our Alderano, they had gathered repeatedly, the parties also being heard with their interests present, they were not unanimous and concordant in their votes and sufferings, so that the total conclusion and resolution could be greatly deferred to the detriment of the said our Camera; and now, the reasons and causes for the existence and continuance of the same college, as stated above, ceasing, and thus in no way being just and reasonable that the restitution of uncertain and unliquidated price should impede the substance and effect of the already concluded and determined suppression and extinguishment: we decreed thence to proceed to the same suppression and extinguishment, having committed for now the restitution to be made promptly and immediately of those monies which shall be established to have been truly and really paid to our aforesaid Camera on account of the individual offices of this kind, and to have come into its hands or those of its officials, but the cognition and determination, whether and what also beyond the aforesaid monies ought legitimately and according to the limits and reason of the same justice to be restored or paid, to our general treasurer with the vote of our Rota, so that thus, on account of the peculiar style of this tribunal and the burden of issuing and promulgating decisions, all the causes and reasons of justice and resolutions may be evident, all appeal removed, and otherwise, as below, we commit and command, etc.

§ 5. We therefore, attending to the aforesaid, the college being suppressed and extinguished from the causes aforesaid and other reasons moving our mind,

7 wishing to provide with opportune remedy as stated above, and having the apostolic letters of the erection of the college of secretaries of this kind, and of any other whatsoever concessions, favours and prerogatives emanating to them from the aforesaid and any other Roman Pontiffs our predecessors in any manner whatsoever, even if they should require special and individual mention, the whole and entire tenors of which we have present for expressed and inserted, by similar motion, and from certain knowledge and mature deliberation of ours, and evident prejudice and consideration, and from the fullness of apostolic power, the aforesaid college, and all and singular offices of the beloved sons secretaries of this kind possessed by any whatsoever, however worthy of express and special note (even those three which were conceded and assigned in perpetuity, namely one through the hospital of St. Saviour at the Holy of Holies, and another through the hospital of the Holy Spirit in Saxia, or their officials and administrators existing from time to time, and the remaining offices of this kind possessed respectively by the chapter and canons of the secular and collegiate church of St. Eustace of the City, beloved sons), by apostolic authority, by the tenor of these presents, we perpetually suppress, extinguish and abolish, together with their college's rights, prerogatives and privileges, so that such a college of secretaries of this kind shall altogether cease, and no longer exist in the nature of things; but all the emoluments, rights, revenues and any other whatsoever income of the same offices of secretaries and of this college hereby suppressed, which we will and intend always to remain safe and unharmed and to remain safe and unharmed, for the benefit of the Apostolic See, so that by those who have hitherto paid them they are still owed and paid, and nothing whatsoever shall be deemed and be as to them and them changed, just as if the present motu proprio had in no way emanated, and not otherwise, etc., from this day, by full right, nothing whatsoever excepted, we appropriate, apply and incorporate to our aforesaid Camera, and we will them to be held for appropriated, applied and incorporated.

10 said to our treasurer legitimately established truly and really and with effect by the holders of the same offices now suppressed or their authors, or those to whom the faculty of disposing of the aforesaid offices or any part thereof has been granted by apostolic authority as aforesaid, to the same Camera or Apostolic Datary, and their ministers and officials, both as cause and under the name of price, as for expedition to have been paid, so that not even in the least, with respect to the same monies paid to the Camera or Datary of this kind from their own, they remain damaged, and, until they have received them, we decree that they ought to be inscribed for their heirs and free disposition at our Mount of Piety of the City. We also will and command that the said modern treasurer of ours and existing for the time being general treasurer by the vote of our Rota, as above, to all its auditors giving suffrage and bearing upon the aforesaid articles, namely whether and what also beyond the said monies with respect to all possessors of the same offices and those having interest is to be restored and paid, and other incidental, emerging, annexed, connected and dependent matters, and the whole business, the commissioner general of our Camera cited and heard, hear, know and administer justice and dispense, all appeal, restitution in full, recourse and reclamation entirely removed and taken away. And because also it may be doubted whether, by such suppression and abolition of the aforesaid college, the burden of the aforesaid extinction of the said new Mount, by the same college, as above, erected in the last place, and the payment of its fruits until the actual and effective extinction of the same Mount, remains and is with the secretaries themselves of the same college; therefore, for greater caution both of our said Camera and of the same college and its secretaries by these presents of the suppressed, we declare and decree, by suppression and abolition of this kind to neither party of ours nor to our Camera any prejudice nor the least to be brought or inflicted, and the rights of each, even as to the repetition of what was paid, to be entire and in whole reserved, as we reserve, and that they may be tried, and to our said general treasurer, who also in this article by the vote of the said our Rota shall proceed, hear and know and administer justice, appeal removed, and in all things and throughout all things as above concerning other articles we have decreed and commanded. In the meantime, however, lest the holders of the said Mount be deprived of the due payment and obtaining of the fruits of the places of the Mounts pertaining and belonging to each in their place and time, we will and decree for now and by way of provision and without prejudice to the rights as above, by our said treasurer those to be paid from the emoluments and proceeds of the same college to our said Camera as above applied and appropriated. Moreover, because, as we have premised, among the possessors of the said offices are the aforesaid pious places, namely the chapter of the church of St. Eustachius and the hospital of the Holy Spirit in Saxia, which same offices hold in perpetuity from a burdensome cause and corresponding apostolic authority; therefore we command and order the same our treasurer, that to the aforesaid chapter of St. Eustachius and its canons he cause to be paid, to the effect of reinvesting, that price which in case of suppression or extinction was agreed to be restored and paid, and the same price and in the same sum to be paid likewise and restored to the said hospital of the Holy Spirit, saving the rights of each before the same our treasurer of the same vote of the Rota to be known and decided as to that more or other greater sum which or which ought to be paid and restored for their part to be claimed. But as to the aforesaid other hospital of St. Saviour at the Holy of Holies, which from the grace of the Apostolic See holds another similar office as above, by way of provision, and until by the same treasurer of the same vote as above it be decided and determined whether and what is to be restored or paid, and by our liberality and munificence and the relief of poor sick persons, from the same mass or gross of the said emoluments and proceeds each month a sum to be declared by us in special order and mandate to be given and paid we command and will.

§ 7. These present also, even from this

11 that each of the aforesaid named persons did not consent to the foregoing matters, nor were they called and heard regarding them, at no time ever on account of subreptiousness or obreption or nullity of any kind, or of our intention or any other defect whatsoever, however great and unforeseen and substantial, even from the fact that concerning the foregoing solemnities and all other things whatsoever to be observed and fulfilled, they were not observed and fulfilled, or from any other ground arising from law or fact or statute or any custom, or even from enormous, most enormous and total injury, or under any other pretext, even one closed off in the body of law, or on occasion or for any cause whatsoever however just, reasonable and privileged, even such as ought to be expressed specially and individually for the effect of the validity of the aforesaid, or that nothing of our will in this matter or of the other things expressed or implied above might appear anywhere or could be proved otherwise,

12 Rather let the letter appear (r. t.). The present grant removes the power to note, impugn, invalidate, retract, call into question or controversy, or reduce to the terms of law, or against it to obtain restitution in full, opening of the mouth, reduction to the way and terms of law, or any other whatsoever remedy of law, fact, grace or justice, or even by motu proprio and fullness of power to grant similar remedies, or that anyone be able to use or avail himself of what has been thus obtained or granted in judgment and outside of judgment; nor are the present letters to be comprehended under any revocations, suspensions, limitations or other contrary dispositions of similar or dissimilar grants, to be made in any manner whatsoever for the time being, but are always to be excepted from them, and to exist and be perpetually valid and efficacious and to obtain and secure their full and complete effects, and to be inviolably and firmly observed by those to whom it pertains and shall pertain for the time being; and thus and not otherwise in the foregoing matters by whatsoever judges and delegates, even auditors of causes of the apostolic palace, and cardinals of the Holy Roman Church, even legates a latere and nuncios of the Apostolic See, and any others whatsoever exercising any preeminence and power, the faculty and authority of judging and interpreting otherwise being taken away from them and from each of them, judgment and definition ought to be made, and we decree and declare by apostolic authority, by the tenor of these present letters, to be null and void if otherwise anything be attempted herein by anyone whatsoever, by any authority, knowingly or unknowingly.

§ 8.

13 Notwithstanding the constitutions and indults of the aforesaid predecessors of blessed memory, Callixtus III, Pius II, Innocent VIII, Pius V, Sixtus V likewise, Gregory XV and Clement IX and other Roman Pontiffs, our predecessors, privileges granted in any manner to the aforesaid college and its individual persons, as well as the graces of Pius, Pope of pious memory, also our predecessor, concerning the aforesaid Chamber, which he disposed ought to be registered entirely in the same Chamber, and our and the apostolic Chancery's rule of not taking away acquired right, and other constitutions and apostolic ordinances, even consistorial, issued thereupon in general or in particular, even by our motion, knowledge and fullness of power in like manner, and by whatsoever also most efficacious clauses and decrees even with irritant clauses strengthened, and otherwise granted, confirmed and above renewed in contravention of the aforesaid in any manner; all of which, even if for their sufficient derogation special, specific, express and individual mention of them and their whole tenors, and word for word, and not by general clauses importing the same, or any other exquisite form to be observed for this purpose were required, we, having these tenors as if word for word, nothing whatsoever omitted and the form transmitted in them observed, inserted in these present letters for fully and sufficiently expressed and inserted word for word, which would otherwise remain in their force, by our motion and fullness of power in like manner on this occasion only do derogate and will and decree to be derogated; and to all other things whatsoever to the contrary.

§ 9.

14 And that the tenors of the concessions and titles of each of the aforesaid offices, even the more authentic ones, and their dates shall be held as expressed, or may be expressed in whole or in part in the letters, and concerning perpetual suppression, abolition, extinction, restitution, application, incorporation, concession, will, and each decree, derogation, and other aforesaid matters, which here shall be held as sufficiently and in part repeated as above, in the letters, and with the clause ad perpetuam. The value of these present letters.

We will, however, that the signature alone of this motion of Our own be sufficient, and have faith everywhere in judgment and outside it, any contrary clause notwithstanding, and all other things as above not withstanding, or if it shall seem that they can be expedited through Our Brief or the office of the Curia.

16 Remission so- 8 40. By these presents, however, we do not intend that those to whom it is permitted...

17 dimus, under the aforesaid restitution of these offices to be freely made to the possessors, to comprehend him or those who, by reason of grave age according to the custom and observance of Our Dataria, would by no means be admitted to the resignation of office; to whom or to which there remain safe their rights likewise to be examined and decided by the aforesaid treasurer by the vote of the Rota.
