Erection of the church, or episcopal see of Bragança.
Clement PP. XIV, To perpetual memory of the matter.
1 § 1. As shepherd of the eternal flock, though unworthy, We hold the place of vicar on earth, and since We have learned that in some part of the Lord's field there is much harvest, yet few workers exist therein, among the manifold cares which We understand to be incumbent upon Us from the apostolic office, that care is especially close to Our heart, that this harvest being multiplied, the tillers of the Lord's field may be multiplied, by whose assiduous labors the spiritual progress of Christ's faithful may be increased, and eternal salvation may be obtained by them, the Lord blessing it: wherefore in these matters We gladly fulfill the role of the most pious father of the household, and We have willingly acceded to the pious wishes of the most sublime kings, well-deserving of the orthodox faith.
2 § 2. Recently indeed, in the name of that most rare son of Ours in Christ, Joseph, King of Portugal and the Algarves, most faithful to Us, the beloved son Francis of Almada and Mendo, knight commander of the militia of Our Lord Jesus Christ, and plenipotentiary minister of the same Joseph the king with Us and this holy See, set forth that the diocese of Miranda is of very great extent, which stretches in the province beyond the Mountains over a space of twenty-two great leagues, and likewise contains three hundred and fourteen parish churches, or places, for which one pastor alone is found to be altogether unequal to bearing so grave a burden; and it would be of the greatest utility, if this diocese of Miranda were divided into two dioceses by apostolic authority, in such manner, namely, that the first diocese should remain firm in the city of Miranda, in which the cathedral church exists, long since at the instance of John III of blessed memory, King of Portugal and the Algarves, separated from the archbishopric of Braga by the same authority, and should have for its territory an archpresbyteriate, or vicariat called the district of the same city of Miranda, and another archpresbyteriate, or vicariat likewise called of Mirandella, which together comprise one hundred and sixteen parish churches, or places, the goods called of Mosteiró, of Castro, of Avolans nevertheless remaining in the mass of the aforesaid church of Miranda, which had otherwise been united to the cathedral of Miranda by the prayers of the same King John by the same authority: but the other diocese should be constituted in the town called the city of Bragança; and assigning for its territory the archpresbyteriate, or district of the same town called the city of Bragança, as aforesaid, of Monfort, of Mirandella, and of Lampaça, together with one hundred and ninety-eight parish churches, or places respectively comprehended in them.
3 § 3. Wherefore the same King Joseph humbly caused supplication to be made to Us, that We should deign to dismember the aforesaid town called the city of Bragança with the district of the same city of Monfort, of Mirandella, of Lampaça, and the aforesaid parish churches, or places respectively comprehended in them, from the aforesaid diocese of Miranda, and to erect and institute in the town or city of Bragança an episcopal see, and otherwise to provide opportunely with apostolic benignity.
4 4. We therefore, greatly commending in the Lord the outstanding piety of King Joseph himself and his zeal for the increase of divine worship and the spiritual good of souls, and being willing to accede willingly to his wishes, by our own motion, and from certain knowledge, and mature deliberation of Ours, and from the fullness of apostolic power (with the consent of our venerable brother Alexius, the present bishop of Miranda, being added thereto), do erect the aforesaid town called the city of Bragantia, with its territory, archpresbyterate, or district of the said city of Monfort, of Mirandella, as well as of Lampanas, together with one hundred ninety-eight parochial churches, or places respectively contained in them, whose territories and boundaries respectively we wish to be held as expressed in these presents, with all and singular other churches, monasteries, chapels, and other ecclesiastical and pious places, as well as the people, inhabitants, dwellers, and other ecclesiastical and secular persons, things also and goods of the same in the said town called city, and its territory, archpresbyterate, or district of the aforesaid city of Monfort, of Mirandella, and of Lampanas, and in the aforesaid places consisting, entirely from the episcopal jurisdiction, superiority, subjection, visitation, correction, and power of the said Alexius and of the bishop of Miranda existing for the time being, we exempt and perpetually dismember, and the town of Bragantia we erect into the city to be called Brigantian, and we decree that it is and ought to be called a city in perpetual future times. 5. And also one of the churches existing there, which the executor of these our letters to be appointed by us shall judge more suitable and more worthy for the better and more convenient divine service to be rendered in it by future canons, under the same title which it now has, or under another title to be designated at the pleasure of the said King Joseph, we likewise erect into a cathedral church with all the preeminences and prerogatives befitting a cathedral church, and we distinguish it with the honor and title of episcopal dignity; and inasmuch as such a church, which is erected into a cathedral as aforesaid, is collative and has a legitimate possessor, for the purpose of the aforesaid erection, we from now, as from then, and conversely, as soon as it shall happen that it becomes vacant by cession, or death, or otherwise in any way from the person now holding it, without however any prejudice to such a possessor, with all fruits in his favor reserved during the natural life of the same, or until he shall be provided with another suitable benefice, we likewise perpetually suppress and extinguish.
5 6. And we erect this cathedral church for one bishop to be called of Brigantia, who may be able to preside over it and to benefit it, and may be able to use, enjoy, and possess all the insignia and honors competent to bishops by law; and to the same church thus erected of Brigantia, and to the town itself erected into a city as aforesaid, for a city in which the bishop existing for the time being shall reside, and for this purpose houses existing there and more suitable for establishing an episcopal palace shall be purchased, as well as the aforesaid archpresbyterate, or district of the same city of Brigantia, of Monfort, of Mirandella, and of Lampanas with the aforesaid parochial churches or places, as aforesaid dismembered, and all and singular other churches, vicariates, parishes, benefices, monasteries, convents, clergy, secular and regular persons existing and dwelling in them respectively, by motion, knowledge, and equal fullness of power, we likewise perpetually grant, bestow, and assign, and all that which was dismembered from the diocese of Miranda as aforesaid, to the bishop of Brigantia as regards episcopal, and to the archbishop of Braga existing for the time being as regards metropolitan jurisdiction and superiority (the favor remaining to the bishop of Miranda existing for the time being as regards jurisdiction, as the same bishop of Miranda previously held over the aforesaid archpresbyterate, vicariates, and also over the aforesaid parishes or places under the dismemberment of these presents).

We decree that the church of Brigantia ought to be suffraganean to the archbishop of Braga existing for the time being in the same manner and form in which the church of Miranda at present suffrages. 12 1. 7. And moreover, that the aforesaid church of Braga shall have its own proper chapter, that number of dignities, canonicates, half-canonicates, and chaplaincies under their own fitting and convenient and by law approved respective denominations, titles, and invocations, which the revenues to be applied hereinafter shall permit, we also erect and institute. 8. For the endowment truly of the same episcopal church of Braga, and of its capitular table, and thus, as is aforesaid, of the erected dignities, canonicates, and half-canonicates, and chaplaincies, revenues proceeding from the effects, as above dismembered, and from now, as from then, revenues also of the said suppressed church, and erected into a cathedral, provided however that it be collative, to be respectively assigned by the same executor, we grant. And to Joseph himself, and to his successors, the most faithful kings of Portugal and the Algarves, we reserve and concede the royal right of patronage as much over the new cathedral aforesaid of Braga, as over the dignities, canonicates, half-canonicates, and chaplaincies, as is aforesaid, erected even for this first time, and perpetually. 9. And moreover to the future chapter of the same new cathedral, we grant and impart full and every faculty, whatsoever necessary and opportune, to enact statutes, ordinances, and decrees, lawful however and honest, and not contrary to the sacred canons, especially the decrees and constitutions of the Council of Trent and apostolic constitutions, and to enact and issue those enacted and issued, to change, limit, correct, declare, interpret, and reduce to better form according to the variety and quality of times and things, or to enact and issue others anew even in their entirety. Nor to those holding dignities in the aforesaid church of Braga, and to the chapter and canons of the same church, and to other persons and ministers of such chapter and church for the time being existing, that all and each of the preeminences, prerogatives, faculties, indults, favors, graces, and privileges, by which the dignity-holders of other cathedral churches of the kingdom of Portugal, chapters, and canons enjoy, possess, and are gladdened (excepting privileges acquired by onerous title), may use, enjoy, possess, and be gladdened, and shall be able to in the future, in like manner to use, enjoy, possess, and be gladdened freely and lawfully, we concede and indulge. 10. Wherefore to our beloved son Anthony Boniface Coelho, counselor of the same King Joseph, doctor of canon law for the University of Coimbra, and deputy of the Holy Office from the Inquisition of Lisbon, and provisor and vicar general of the patriarchate of Lisbon, whom we deputize as executor of these Our letters, full, free, ample, and unlimited faculty and authority for the spiritual direction and governance of such dignities, chapter, and canons, and the bearing of burdens incumbent upon them, the saying of masses, the hours of the canonical office, the divine services both diurnal and nocturnal, the celebration of processions, funerals, and anniversaries, and other divine services in the same cathedral church pertaining, which shall seem to him necessary and opportune to establish and decree, and the number of such capitular members, according to applied revenues to be constituted, and the fruits both of the future new cathedral church aforesaid, and of future chapters of this sort proportionably, and according to the degree of each difference, as he himself shall judge most justly, to be assigned, and all other things, and whatsoever both in the aforesaid matters and concerning the execution and effect of these same presents in any way necessary and opportune to do, to make, and whatever shall seem to him expedient and consonant (with the counsel however and consent of the same King Joseph in all things), we grant, assign, and impart with the same motion, knowledge, and fullness of power. 13 § 2. Since it is unknown what kind of church ought to be erected in the cathedral, as aforesaid, and whether it is collative and to be suppressed, and since such exists, who, and how great are the certain fruits of the same church, by reason of which it would be subject to the payment of half annates in the apostolic chancery, and also by reason of the perpetual application of the said fruits to the payment of quinquennials. The Apostolic See, meriting no suffrage from any, thus the Father of lights disposing, having been placed over the universal flock of the Lord committed to Our care, with solicitous and watchful attention we look upon those things which we recognize will serve to the greater fruitfulness of that same flock, and we most willingly extend Our aid and labour in those matters; and therefore we establish new sees and new pastors, so that the sheep themselves may more easily advance in spiritual growth, especially when the desires of sublime and exalted kings demand it, and having considered the qualities of places, persons, and times, we perceive this to be expedient. 20 Exposition. Recently indeed in the name of our most beloved son in Christ Joseph, King of Portugal, and most faithful to Us, our beloved son Francis of Almada and Mendoza, commander of the military order of Our Lord Jesus Christ, and minister plenipotentiary of the same Joseph the King with Us and this holy See, set forth to Us that whereas the bishopric of Lamego, existing in the province of Beira, from the city of Lamego as far as the land of Feira bordering it with the bishopric of Portugal, extends over a distance of thirty great leagues, and from the same city on the upper part of the Douro extends over another similar distance of leagues as far as the new town of Foscoa, and from this comprehending the individual lands of Riba Coa, which is called the new bishopric, and extending beyond sixteen leagues, reaches as far as Alfavdes and Sabtigal, and on the eastern part is contiguous with the kingdom of León, but on the southern part has boundaries with the bishopric of Viseu, and the town called Our Lady of Lapa serves as the limits: in such an extension there are comprehended two hundred eighty-six, or two hundred ninety-one parishes, or places under the name of parishes in four visitations called divided, or divided, namely one of Riba Coa with fifty parishes, another within Coa and Tavora with eighty-three parishes, a third of Serra of Our Lady of Lapa with eighty-seven parishes, and a fourth in the lands of Riba Douro with sixty-six parishes. 21 § 3. But the other bishopric of Viseu in the same province existing, and likewise bordering the bishopric of Lamego, has an ample extension containing eight archpresbyterates, or archdeaconates, which are comarchies or districts, comprehending two hundred eighty-seven, or two hundred ninety parishes, or places under the same name of parishes, namely one of the city of Viseu with its district forty-six parishes, another of Besteiros thirty-three parishes, a third of La Foons forty-three parishes, a fourth of Moens sixty-four parishes, a fifth of Retiaverdo forty-nine parishes, a sixth of Trancoxn forty-four parishes, a seventh of Dinhei thirty parishes, and an eighth of Castello Mendo eighteen parishes: the same Joseph, therefore, having adduced six just causes, especially on account of the notable amplitude and extent of both the bishoprics of Lamego and Viseu, by which each bishop is unable to discharge his office, humbly besought Us that we deign to erect and establish a new episcopal see in the town of Pinhel, and otherwise to provide thereupon with fitting remedy from apostolic benignity. 22 4. We therefore, most earnestly commending in the Lord the pious desire of King Joseph himself, and being willing to accede to his wishes with a ready mind, by our own motion, from certain knowledge, and mature deliberation of ours, and by the fullness of apostolic power, proceeding to this with the consent of King Joseph himself, and of the modern bishop of Lamego, to be given by the same bishop, or otherwise before the executor hereinafter written of these our letters, and if unreasonably denied, supplying it, from the dioceses of both the church of Lamego and respectively Viseu, each of which is of right under the patronage of King Joseph himself, namely from the diocese of Lamego places or lands, and whatsoever benefices which are comprehended in the aforesaid two visitations of Riba Coa and within Coa and Tavora containing together one hundred thirty-three parishes or places; from the diocese of Viseu moreover the same town of Pinhel, and also three from the said eight archpresbyterates or archdeaconries or comarchies or districts, one namely or one of the same town of Pinhel with thirty parishes or places, another or another of Trancoso with parishes forty-four, and third or third of Castelo Mendo with parishes eighteen, in total parishes or places two hundred twenty-five situated or situated in their or their greater part in territory of lesser fertility and greater poverty, whose or whose respective territories and boundaries, being present we wish to be held as expressed, with all and singular churches, monasteries, chapels, and other ecclesiastical and pious places, as well as the people, inhabitants, dwellers, and other ecclesiastical and secular persons, things moreover and goods of theirs or of theirs there existing (remaining firm to the episcopate of Lamego parishes or places one hundred fifty-three or one hundred fifty-eight situated in fertile and richer territories of the same province; to the episcopate of Viseu moreover parishes or places one hundred ninety-five or one hundred ninety-eight in other fertile, fruitful moreover and abundant territories) from episcopal jurisdiction, superiority, subjection, visitation, correction, and power of our venerable brothers Felician and Francis, modern and for the time being existing bishops of Lamego and Viseu, we entirely exempt and perpetually dismember; and the same town of Pinhel replete with people, the same name however hitherto held being preserved, in which six parishes are numbered, and several noble families, we erect into a city, and decree it to be a city and to be called such in perpetual future times; and also one of the aforesaid six parishes existing in the same town in the city erected of Pinhel, which the same executor of these our letters shall deem more suitable and more fitting for better divine service in it from the future capitulars thereof hereinafter written, from now, as from then, and as soon as it shall be vacant, without however any prejudice to the modern rector thereof, to whom, and his natural life lasting, or until and as long as the same modern rector shall be canonically provided from other ecclesiastical revenues compatible or incompatible with the same parish, there shall remain entire all its fruits, by motion, knowledge, and fullness of power equal we suppress, and the same thus suppressed, into the cathedral church under the same title which the said parish church, as aforesaid, suppressed at present has, or under another to be designated by the choice of King Joseph himself, with all preeminences and prerogatives befitting the cathedral church, we likewise erect and invest with the honor and title of episcopal dignity. 23 1. 5.
