1 Ruteni.
BENEDETTO PAPA XIV.
2 Venerabile Fratello e Diletti Figli, salute e Benedizione Apostolica.
An vero praecedentia Abbatibus competat supra ipsum Proto-Archimandritam, vel contra, in iudicio Apostolicae Sedis specialiter a Vobis reservatum fuisse conspicimus. § 16.

POPE BENEDICT XIV.
2 Venerable Brother and Beloved Sons, greetings and Apostolic Blessing.
3 Among the many fruits of joy abundantly perceived by Us, while We have resumed the custom of several illustrious Predecessors of Ours, who were accustomed to convene before themselves the Congregation of the Cardinals of the Holy Roman Church, placed in charge of the affairs of the Propagation of the Faith, repeatedly for the transaction of business, We have received no small joy in our mind, when We have examined and discussed the affairs of the Ruthenian Nation, and of the Order of Monks of St. Basil of the same Nation, together with our Venerable Brothers constituting the aforesaid Congregation. § 1. And indeed the illustrious merits of the Ruthenian Nation have been made known to Us from sacred histories, in which We have found it recorded that from the year 1046 the Ruthenian Bishops held a National Council at Kiev, by which they might oppose the schism excited through Michael Cerularius, Patriarch of Constantinople; thereafter some Metropolitans of the same Nation rendered obedience to the Apostolic See, which likewise the entire Nation professed through its Legates to Pope Innocent IV in the first General Council of Lyons: Furthermore, We have learned that Isidore, a Cardinal of the Holy Roman Church and a Ruthenian, labored greatly in the Council of Florence for establishing a firm union between the Western and Eastern Church; Finally, Michael III, Metropolitan of Kiev, with the consent of the other Ruthenian Bishops, convened a Council in the City of Brest, in which the public union of the Ruthenian Nation with the Apostolic See was again decreed, and for the purpose of perfecting it two Bishops were sent to our predecessor of happy memory, Pope Clement VIII, to whom it was given to receive the aforesaid Nation into communion with the Roman Church, and to confirm its Union through Apostolic letters.
4 § 2. To these distinguished merits of the entire Nation must be joined those things which are peculiar to the Monastic Order of St. Basil, whose notable assembly is among the Ruthenian Nation itself, and which concern most of all those things which were brought forward and established in the Congregations held before Us. Hypatius, namely, Metropolitan, one of the Legates sent to Pope Clement VIII, when he understood that no more suitable means would be for fostering and propagating the Holy Union than if he should join to himself the Basilian Monks, whose monastic order among the Ruthenians is one, acquired their distinguished Monastery under the invocation of the Most Holy Trinity established in Vilna, and in it he took care that the collected young Monks should be instructed. His successor Joseph Velaminus, having brought back to Union several monasteries of the same Order, which previously lived separated, formed one Congregation of Monks from them, which he named by the name of the aforesaid Monastery the Congregation of the Most Holy Trinity of the Union: and since he did not wish this Union, or Congregation, to be in any way uncanonical, or to be able to be held as such, without the authority and good pleasure of the Apostolic See, he had recourse to the necessary petition, and obtained from it the approbation of the year 1624 under the Pontificate of the blessed memory Urban Pope VIII, with the preceding year 1623, when that great Archbishop of Polotsk, Josaphat, Monk of St. Basil, whom the same Urban in the year 1646 enrolled in the number of the Blessed, had borne glorious martyrdom, inflicted upon him by schismatics in hatred of the Catholic Faith and Union. § 3. By the Union of Monasteries, as aforesaid, in the year 1624 a single Congregation was thus constituted and confirmed, having obtained Apostolic Confirmation, all Monasteries were united under one Proto-Archimandrite in the direction and governance of the same. But although for establishing the Congregation more firmly and enlarging it, suitable faculties were afterwards also granted for uniting to itself other Monasteries, which if they should wish to join to the same; nevertheless certain Monasteries of the same Order in the Dioceses of Vladimir, Luceria, Chelm, Leopolis, and Premysl still remained, which were also entirely separated from that Congregation, and each lived separately without any union. For which reason in the year 1720, by the mandate of the blessed memory Pope Clement XI, a National Ruthenian Synod was convoked in the City of Zamość, presiding over it the venerable Jerome, Archbishop of Edelsa, then Nuncio of the Apostolic See in the Kingdom of Poland, afterwards Cardinal of the Holy Roman Church, called Grimaldi, in the same it was decreed that the aforesaid Monasteries should also be united into one Congregation; and that after a certain time a General Chapter should be held under the presidency of the Metropolitan, and with the assistance of the Proto-Archimandrite of the Congregation of the Most Holy Trinity, in which all things should be arranged and established which pertained to the deliberate Union; since it was sufficiently understood that it would greatly profit ecclesiastical Discipline, if all Monasteries, not subject to General Superiors, nor having ordinary Visitors, should be reduced into one Body, or into one Congregation.
5 That which 4. According to the norm of this Conciliar Resolution, it can be said to have been confirmed by Pope Innocent XIII, when, with the prior counsel both of the Congregation of the Cardinals of the Holy Roman Church, interpreters of the Council of Trent, to which We then applied ourselves from the secretariat, and of another, presiding over the affairs of the Propagation of the Faith, he approved the Synod of Zamość, which afterwards Pope Benedict XIII likewise did by his special Letters in the form of a Brief; it was convoked in the year 1729 in the City of Iaropolis a General Chapter, presiding over the Archbishop Metropolitan, and attending the aforesaid Proto-Archimandrite of the Congregation of the Most Holy Trinity; and the Union of Monasteries was effected; and the entire Order of St. Basil of the Ruthenians remained divided into two Congregations; since besides the ancient Congregation of the Province of Lithuania, called the Most Holy Trinity, this new Province was formed of Ruthenia, or Poland, under the invocation of the Patronage of the Most Blessed Virgin.
6 From the matters of § 5. When the affairs of those things conducted were reported to Us, and a Congregation was held before Us of the Venerable Brothers, Cardinals of the Holy Roman Church, placed in charge of the business of the Propagation of the Faith, under the date of May of the Year 1742, We easily perceived that dissensions of no light moment could arise between the old and new Congregation, unless they were met in good time with suitable remedies; since the question had already been raised, namely whether the new Polish Congregation ought to have its own distinct Proto-Archimandrite, or rather ought to be united to the Lithuanian Congregation, and be subject to its Proto-Archimandrite, as to the General Superior of the whole Basilian Order. Therefore, in order to remove all controversy, it was resolved that from all the monasteries of both Provinces a single Congregation should be formed, and a General Chapter should be convoked for the election of a new Proto-Archimandrite of the whole Order: the Metropolitan of Ruthenia should preside over this Chapter, and the Apostolic Nuncio should attend it, either in person, or if he himself could not, through another to be substituted by him; and many other things were established, which can be read in the Decrees emanating from the aforesaid day. And among other things, the aforesaid Nuncio of the Apostolic See in the Kingdom of Poland was entrusted with the task of seeing that an Alternation for the election of Proto-Archimandrite should be established between the two aforesaid Provinces, the beginning of which Alternation should be taken from the Lithuanian Province.
7 § 6. And when the aforesaid Nuncio convoked the General Chapter in the City of Dubno, in the month of May of the Year 1742, with the Metropolitan of Ruthenia presiding, and with the Bishop of Zenopol intervening, subdelegated by the Nuncio himself, in the same Chapter, God favoring, the Congregation was established, composed of the two aforesaid Provinces, under the rule of one Proto-Archimandrite; the aforesaid Alternation was likewise proposed and established, according to which the Proto-Archimandrite was elected, and from the Lithuanian Province likewise the inferior Officials were elected, namely Consultors and Secretaries, in equal number from both one and the other Province; and many other Constitutions and Resolutions emanated for the happy governance of this new Congregation composed of two Provinces.
8 § 7. Since, however, for the confirmation of all the aforesaid matters, Our Apostolic approval, as was fitting, was reserved; We, with the counsel of the Venerable Brothers Our own, placed in charge of the business of the Propagation of the Faith, proceeded as We are accustomed, convoked the same before Us on the thirtieth day of the month of March of the current Year 1744, and with all things in the same Congregation weighed, which pertained to the aforesaid General Chapter held at Dubno, to the Union of the two Congregations, to the Alternation established between them, and to the Election of the Proto-Archimandrite of the whole Order there carried out, We were induced with a most willing mind to approve, as by these present Our Apostolic Letters We do approve and confirm, both the General Chapter and the Union, the Alternation, and the Election of the Proto-Archimandrite and of the other Officials, decreed and respectively carried out in the same Chapter; all which things We have judged, and do judge, to conduce salutarily to the utility of the Order of St. Basil itself, which We follow with the affection of paternal charity.
9 § 7. Since, however, for the confirmation of all the aforesaid matters, Our Apostolic approval was rightly reserved; We, having taken counsel with the Venerable Brethren of Ours who are placed over the affairs of the Propagation of the Faith, have deemed it necessary to proceed in this manner. Having convoked these same before Us on the thirtieth day of the month of March of the current year 1744, and having weighed all things in the same Congregation which pertained to the aforesaid General Chapter held at Dublin, to the Union of the two Congregations, to the Alternation established between them, and to the Election of the Proto-Archimandrite of the whole Order performed there, We have been most willingly induced to approve, as by these present Our Apostolic Letters We do approve and confirm, both the General Chapter and the Union, the Alternation, and the Election of the Proto-Archimandrite and of other Officials decreed in the same Chapter and respectively permitted; all which things We have judged and do judge to have been salutarily expedient for the utility of the Order of St. Basil itself, which We follow with the affection of paternal charity.
10 § 8. From the approbation of the General Chapter, as well as of the Union, Election, Alternation, and other aforementioned provisions, we proceed to certain Resolutions which were proposed in the aforesaid Chapter and which both Provinces have submitted to our judgment. 9. The first that occurs is that which pertains to the Title of the Congregation composed of two Provinces, inasmuch as the Province of Lithuania for the preservation of the Title of the Most Holy Trinity of the United, and the Province of Poland for a new denomination of the Province, have signified their respective wishes. We, however, considering that the Province of Lithuania has long since obtained the Title of the Most Holy Trinity, just as the Province of Poland has another of the Protection of the Most Blessed Virgin; and that acts of a twofold kind can be exercised by the same Provinces, namely some common to the entire Order, others proper to individual Provinces; we judge it opportune to decree that common acts be conducted under the Title of the Order of St. Basil the Great of the Ruthenians: but in the particular acts of the Province of Lithuania let the Title of the Most Holy Trinity of the United be added; and likewise in those which are proper to the Province of Poland, let the other of the Protection of the Most Blessed Virgin Mary be joined; and thus to each Province its former Title shall be preserved. § 10. The other arises from the fact that the Province of Lithuania ceded the Monastery of Lublin to the Province of Poland with certain conditions, and particularly with this, that such cession or relinquishment ought to be valid only insofar as it shall be decided by the Holy See, whether the other twelve Monasteries, which are said to be situated within the boundaries of the Province of Poland, and whose possession is with the Province of Lithuania, ought to be assigned to the aforesaid Province of Poland. But in the present state of affairs we have not wished to respond otherwise than that the aforesaid cession of the Monastery of Lublin be approved by us. Concerning other matters, further appropriate information shall be furnished by you, so that we may be able to form our judgment concerning the possession of the other twelve Monasteries. Indeed, in the mass of documents which have been communicated to us, there is no doubt concerning their possession by the Province of Lithuania. It is also asserted that some of them were founded for the Lithuanians. These matters indeed must be clarified, the foundations recognized, the reasons explained on account of which the Province of Poland now contends that their cession is owed to itself; which all things, if it please, can be accomplished within a brief time and without great expense; namely by agreeing upon the matter with our Nuncio residing in the Kingdom of Poland, or before his Auditor, or another Minister appointed by him, to the end that thereafter a truthful report be sent to us, both of the matter and also of all the reasons which shall be adduced before him on both sides; which being completed, we shall not hesitate to bring forth an appropriate resolution.
11 II. § 11. The third concerns the Hospice of the Procurator General of the Order itself, who must reside in this City, as well as the Scholarships which the Ruthenians enjoy in several Colleges. Now it is established that Pope Urban VIII in the year 1641, at the instance of the Congregation of the Propaganda of the Faith itself, granted to the Ruthenian Monks the Church of Saints Sergius and Bacchus; and that Anthony Cardinal Barberini, called of St. Onuphrius, the brother of Urban himself, purchased the adjoining area for founding a Hospice, and there erected a building for the Procurator General, to whose support he also assigned an annual bequest left by himself. Nor is there doubt that the aforesaid original concession of the Church, as also the Hospice and the Bequest, pertained to the Ruthenian Basilian Monks alone, who from that time had coalesced into the Congregation of the Most Holy Trinity of the United. But since recently also the Monasteries of Poland have been united into one body, and thereafter from the entire Order of St. Basil of the Ruthenians a single Congregation has been formed, which is composed of two Provinces, Lithuania and Poland; and since, according to the laws of alternation established between them, the Procurator General ought to be elected now from the Province of Lithuania, now from the Province of Poland; the reason of equity demands that in the aforesaid Hospice the Procurator General should reside also when he is assumed from the Province of Poland; inasmuch as the Procurator General, whether elected from the Province of Lithuania or from the Province of Poland, is always the Procurator General of the entire Order and Congregation composed of both Provinces.
12 (f. 1a. Since indeed for the aforesaid works to be carried out in that dwelling, both a considerable sum of money has been expended, and also much debt has been contracted, which still remains to be paid; We distinguish entirely that which was expended from that which is to be paid in the future; and We judge that no account of expenditure is to be taken, either because it was collected from the largesses of predecessors, or because that dwelling was partly uninhabited, and partly also let out by the Procurator dwelling there, who has always been from the Province of Lithuania; but as to the remainder of the debt, after it shall have been exactly liquidated, We decree that it is to be paid for one half by one of the said Provinces, and for the other half by the other.
13 But as to the Alumnates; since two of them are constituted in the Collegium Urbanum de Propaganda Fide and one in the Collegium Graecum of the City granted by Urban Papa VIII, but others are found assigned in other Colleges outside the City, We have decreed that such Alumnates are henceforth to belong to both Provinces, and the Alumni are to be divided equally between them.
14 The fourth origin was derived from this, that the Abbots of both Provinces renounced their own right of patronage, which they had in the election of the Proto-Archimandrite; which gave occasion to such a Resolution; namely that in the election of Proto-Archimandrite there ought to be elected a simple professed Monk, marked by no canonical defect; and it opened the way for the exercise of Our discretion, and of this Apostolic See's judgment, whether that which was done in the present instance ought always henceforth to be observed, which is the same as to inquire, whether a simple Monk ought always in the future to be elected Proto-Archimandrite, or rather whether someone even from among the Abbots might be elected to the same dignity. We, however, greatly commend the religious moderation of souls, of which the Abbots gave an illustrious example on this occasion. We have also deemed it fitting for the utility of the Order itself, that no one should preside over its governance except one who has made true profession of its observance; since We know that he rules well chiefly who has learned to obey well. But, since it is not yet sufficiently clear what We shall speak of below, namely whether the Abbots ought to be exempt from the jurisdiction of the Proto-Archimandrite, and ought to be immediately subject to the Metropolitan, We judge that We cannot yet likewise pronounce judgment on this question. For from the decision of one article prejudice to another arises. For where the Abbots are subject to the immediate jurisdiction of the Metropolitan, it is fitting that they be excluded from the dignity of Proto-Archimandrite; but where the same are subject to the jurisdiction of the Proto-Archimandrite, it would truly seem too harsh to exclude them in perpetuity from all passive right, which they might have to that dignity; since indeed in the preceding Decrees We find excluded from such an office, not indeed Abbots, but Bishops, and the Metropolitan. § 15. Here therefore the occasion presents itself to discuss what We hinted at a little before; namely whether the Abbots ought to be subject to the Metropolitan, or rather to the Proto-Archimandrite, immediately. In your Congregations moreover We found it proposed, and it was determined, that the Proto-Archimandrite ought to visit all Monasteries either by himself, or through another; but where Monasteries are Abbatial, he ought not exercise jurisdiction, except in the persons of the Monks, never however in the Abbots themselves, who ought to be subject to the Metropolitan; so that, if any Abbot in the governance of his Monastery should be found to have inflicted some burden either on the Monastery, or on the Monks, it shall be the duty of the Proto-Archimandrite to refer all matters to the Metropolitan. But whether precedence ought to belong to the Abbots over the Proto-Archimandrite himself, or the contrary, We perceive has been specially reserved to your judgment in the judgment of the Apostolic See. § 16. A twofold question therefore, as you see, is proposed to be decided; one namely concerning the immediate subjection of the Abbots, either to the Proto-Archimandrite, or to the Metropolitan; the other concerning the precedence of the same Abbots over the Proto-Archimandrite. Taking therefore the beginning from that which involved less difficulty, We decree, that in all acts of the Monastery the Proto-Archimandrite shall take precedence over the Abbots; since it is by no means to be borne, that in such acts of the Monastery, a Religious should go before the Head of his own Religion; but outside the monastic acts, We command that the customary practice be observed; so that, if outside the aforesaid acts, a usage has prevailed, that an Abbot takes precedence over the Proto-Archimandrite, in the future also precedence shall belong to the Abbot; but if in the past it has obtained, that the Proto-Archimandrite takes precedence over the Abbot, the same shall henceforth be observed. Nor ought it to seem absurd to you, that one should take precedence over another in some circumstances, and in others the same should grant precedence to the other. For indeed We see this happening commonly before Our eyes. For among the Canons of the Basilicas of the City, when some are distinguished by Episcopal, and Archiepiscopal dignity, these indeed take precedence over all the other Canons; but the Vicar representing the person of the Cardinal Archpriest, who is the Head of the Basilica, although he himself be a simple Prelate without Episcopal Order, nevertheless in the Choir, and in all acts of the Chapter, takes precedence over the aforesaid Bishops; but outside the Choir, and outside the Chapter acts, he sits within it. Likewise in the College of Consistorial Advocates, someone is sometimes found excelling in Episcopal rank; he sits in the collegiate acts above all the other Advocates; but never above the Dean, although he be for the most part a Cleric: because namely he is the Head of the whole College; who nevertheless outside the College, and outside collegiate acts, yields in all things to the Bishop, an Advocate of the Consistorial Hall.
15 § 17. Now turning to the other question proposed, which concerns the immediate jurisdiction over Abbots to be assigned either to the Proto-Archimandrite or to the Metropolitan; We think it proper to remind you that in the Congregation held before Us on the first day of May in the year 1742, the jurisdiction of the Metropolitan over Monks was admitted; nevertheless restricted to the limits of the Apostolic Constitutions and the Sacred Council of Trent, where the rights of the Metropolitan over exempt Monks are defined; and from this it follows without doubt that Abbots ought to be subject immediately not to the Metropolitan, but to the Proto-Archimandrite. It seemed that the proper order of governing the Religion could by no means subsist where Abbots depended on the Metropolitan and not immediately on the Proto-Archimandrite; since neither an imaginary nor an exceedingly rare occasion should be thought to exist in which an Abbot in the governance of his Monastery is said to have inflicted or has actually inflicted a burden on some or several Monks. Which burden indeed can be easily and speedily corrected if its cognizance be referred to the Proto-Archimandrite; but not so where the controversy in Monasteries is reserved to the judgment and sentence of the Metropolitan.
16 § 18. We have likewise found it not at all consonant with the practice of the Western Church to exercise Metropolitan Jurisdiction in those Monastic monasteries which are found situated in the Dioceses of Suffragan Bishops; inasmuch as Monasteries which do not have the privilege of exemption and immediate subjection to the Apostolic See are commanded to be subject not indeed to the Metropolitan, but to the Bishops of the locality. But the Council of Trent was so solicitous that the Metropolitan should not exercise Jurisdiction in the Dioceses of the Suffragans, that, beyond the visitation of their own particular Diocese, it permitted the Churches Cathedral and Dioceses of the Bishops of the same Province to be visited by them only where this was mandated to them by the Provincial Council.
