Bolla sull'amministrazione delle finanze pubbliche nello Stato Pontificio

Bolla di papa Clemente VIII ·

eliam alia continentur.

A nessuno dunque, ecc.

44 Dato a Roma in Monte Quirinale, nell'anno dell'Incarnazione del Signore millecinquecentonovantadue, il 18 agosto, dell'anno primo del nostro pontificato.

45 Dat. il 15 agosto 1592, anno pontificale 1.

other matters are contained.
Clement, bishop, servant of the servants of God, for perpetual remembrance of the matter.

1 For the holy cause of this Roman Church committed to us by the Lord, and likewise for the protection of the cities and peoples subject to it in temporal matters, and with paternal charity toward our subjects, we are held by special care to provide that the goods pertaining to them be administered usefully and prudently with the faith and diligence that is fitting; and especially that wicked abuses be removed, which creep in gradually to public and common harm; from which we have discovered even until now that the common goods of those cities have been oppressed by grave debt, or from the very beginning of our pontificate, and we see this evil, unless speedy remedies are applied, falling daily into worse condition. For while a few seek their private advantages and gains, and by illicit means strive to obtain what they wickedly desire or covet, and court the favor of the more powerful or the common people with vain flatteries, and finally endeavor to satisfy their cupidities, having no regard for public utility, they exhaust the public treasury of the cities and places themselves, involve them in grave debt, and squander it in empty pomp and ostentation.

2 1. Wishing to remedy these evils and inconveniences (as much as our vigilance and the diligence of each one is able), we by this our constitution, to endure perpetually, decree and ordain that in every city, land, town, castle and place of the said temporal State of the Church, so that also our cities of Bologna and Benevento are comprehended under this constitution, a table or booklet shall be drawn up each year at the beginning of the year, in which all ordinary and extraordinary expenses publicly useful or necessary shall be described. And indeed for those expenses which are certain and ordinary, a certain tax and sum shall also be expressed; but those which shall appear uncertain and extraordinary, a certain annual sum shall be taxed for all of them, which in no way may be exceeded in the course of the whole year; but specifically for the need of the matter, from the whole sum thus taxed, by the whole Council, with the intervention of the president, governor or magistrate, the necessary portions shall be drawn within the year.

3 2. And that table or booklet by the governor or president of the province, or of the city and of any land, town and castle, the praetor or magistrate, each year.

4 3. But on this first occasion, not only by them, but also after them, within thirty days then immediately following, by our beloved sons, the camerlengo and general treasurer of the Apostolic Chamber of the Holy Roman Church, let it be carefully and diligently inspected, corrected and approved, with all those expenses expunged from it which were accustomed to be made beyond or against this our constitution, even from ancient statute or custom, and with a copy or register of the same table or booklet retained by the Apostolic Chamber without cost and without any expense to the said communities or universities, immediately within ten days, to be reckoned from the day of its reception, thus revised, approved and corrected, let it be sent back to the aforesaid communities or universities.

5 4. But we strictly forbid, under our displeasure and other most grave penalties to be imposed at the discretion of us and our successors, that for seal or writing, paper, ink, wax, capsule, cords or other things pertaining to such expedition, or for labor or fees, anything, not even the smallest coin, for this reason the aforesaid camerlengo or treasurer, or their notaries, notaries public, secretaries, familiars or any official or minister, presume to exact or even willingly receive; rather we will that all things be done without any delay, freely and, as is accustomed to be done in the Apostolic Penitentiary, without any payment, and be expedited and sent. And in this let the aforesaid camerlengo and treasurer watch with the greatest care, and if they discover or learn that any of their own, or other notaries, notaries public, secretaries, familiars, officials or ministers has received even the smallest thing, let them proceed against them also to deprivation of the offices and duties which they hold, and to disqualification from holding those or others in the future, perpetual exile from the City and its district, and other graver penalties, knowing that if by conniving or tolerating or in any other way they shall have been conscious or participants in such receptions and exactions through themselves or another, they too shall undergo our and our successors' judgment in this matter severe, as aforesaid.

6 And this in the first year before the camerlengo and treasurer of the Pope. And let all these things be done freely by all officials, etc.

7 The table thus approved shall be sent to its places and publicly preserved.

8 And nothing beyond what is expressed in the table shall be done without permission.

9 ster exact, or even willingly receive; rather we will that all things be done without any delay, freely and, as is accustomed to be done in the Apostolic Penitentiary, without any payment, be expedited and sent.

10 § 5. Moreover, the same table or booklet, or a copy thereof, once corrected, approved and returned within ten days, shall not only be kept in the archive of the said communities or universities, but shall be affixed and perpetually retained in some public place open and visible to all, before the doors of the hall where public council is held, or where justice is administered, and where there is frequent concourse of people.

11 § 6. In future it shall not be lawful, unless by express permission of the Apostolic Camera, or if urgent necessity does not permit delay, of the governor or president of cities and places (who shall immediately thereafter be bound to render account thereof to the aforesaid camerlengo and general treasurer), with the intervention of the fiscal procurator of the same place, the cause being known and likewise granted freely, to change or alter the tenor of the said table or booklet, even in subsequent years, nor without the aforesaid permission, even in cases unforeseen, unexpected or unusual, to expend anything beyond what is contained in such table or booklet. Whatever, however, shall have been expended beyond the prescribed sums, we will that it shall in no way be ratified by those to whom the care of examining and settling accounts and statements of expenditure, or as it is said, of auditing, falls, nor shall it be charged to the common treasuries of the said places or funds, but to the individual persons who shall have made such expenditures, who shall also be bound to make restitution of the same, as having been unjustly taken from them.

12 § 7. That this may be more accurately observed, and the utility of the said cities, lands and peoples may be more fully consulted, we command that each present or for the time being existing governor, president or potentate, both from now or at the very first entry, and then immediately after the term of magistracy is finished, through whatever priors, massarii, camerarii or officials have administered, within ten days, from the said priors, massarii, camerarii or officials who are performing or have ceased to perform the magistracy, respectively, shall have full information of matters pertaining to public government and common administration of goods delivered to him, and especially an index and names of individual debtors of any community or university, both from the aforesaid and from any other causes whatsoever, accurately and item by item described, and these afterwards, as soon as the day of payment arrives, or if it has already arrived, within three or at most four months, through the officials and magistrates of the said communities or universities to be exacted, and to be brought into the treasury of the community or university.

13 § 8. And if anything at the end of the year, the expenses described in the table or booklet being deducted, shall remain over, the officials, having laid down their offices, shall have it audited for the extinction of the debt of the community, and shall deliver an index of debtors to the governors, and through the ministers of the community it shall be exacted in due time.

14 What remains at the end of the year, the expenses of the table being deducted, in Art. C. 1591 for the payment of the debt or, etc.

15 shall be expended.

16 The fiscal of any place shall compel the officials of the community to render accounts before the governor.

17 The governor and fiscal negligent in the aforesaid matters shall be punished.

CLEMENT

18 publicly contracted; or if there be no debt, or for the relief of provisions, or for the Monte Pietatis, or for the recovery and redemption of goods and things or rights alienated by the said communities or universities, or finally for the purchase of other immovable goods, with the intervention nevertheless of the governor or potentate and the fiscal procurator of the place, he shall cause to be converted. But if it should happen that the aforesaid monies are deposited in the Monte Pietatis, this shall be done on the condition that the said communities and universities may afterwards withdraw them whenever they wish and, if it seem good to them, expend them in the uses permitted by this constitution.

19 § 9. Moreover, the fiscal procurator of any place shall demand absolutely before the syndics and governor or president or potentate, within ten days, from those who have performed the magistracy, both concerning the administration according to the rate prescribed in the table or booklet, and concerning the other aforesaid matters, especially the names of debtors exacted, that accounts be rendered. And if anything either in expenses has been exceeded, or concerning exaction has been neglected, or through negligence has been delayed beyond the aforesaid time, against the same defendants who have performed the magistracy, as aforesaid, proceedings shall be taken for restitution of the expenses owed, as well as for payment from their own property of debtors through negligence not exacted, and further, also for the execution of the penalties contained in this constitution, of which the fourth part shall be applied to the fiscal procurator himself.

20 § 10. But if, after the aforesaid ten days have elapsed, the governor or magistrate shall have been negligent in exacting accounts or in compelling payment or restitution, or in executing penalties or otherwise in the aforesaid matters, he shall be held entirely responsible from his own property for the restitution and reparation of damage inflicted upon the common treasury of any place through undue expenses or delayed collection. Moreover, the fiscal procurator of his territory, town or city shall inform the general fiscal procurator of the Apostolic Camera of such negligence, or it shall also be permitted to any of the people to denounce it, and proceedings shall be taken both in the syndicature by those to whom it pertains, and afterwards by the general fiscal procurator of the Apostolic Camera against the same governors and magistrates, or even against persons who shall have stood surety for them in the syndicature, so that the damage inflicted, uncollected debts, undue expenses, and the penalties contained in this constitution, with similar profit being applied to the aforesaid persons, shall be exacted from both them and the principal defendants themselves; and for this reason both the governors, presidents, magistrates, and fiscal procurators culpable in the aforesaid matters shall be deprived of their offices by that very fact, and shall be and are deemed perpetually unfit and incapable of obtaining those and other similar offices hereafter.

21 § 11. But prelates, governors and magistrates, their chancellors, secretaries, notaries or ministers or household members, shall receive absolutely nothing, not even the least amount, on the occasion of such syndicature, or for rendering judgment, or for drawing up, reviewing, or granting license as aforesaid, subscribing, or fixing a tax as emolument or fees, nor even for reward or labor or otherwise as aforesaid; and if they shall have received anything, they shall incur, even as violators of this constitution, the penalties which are described in it by that very fact.

22 § 12. Moreover, to all and singular communities, universities and peoples of whatever provinces, cities, territories, towns, castles, and places of our temporal ecclesiastical state, and to their senates, councils, assemblies and congregations, magistrates and administrators, and to their individual persons, we strictly forbid and prohibit that any of them or theirs, under whatever pretext or cause, even urgent and necessary, against the constitution of Sixtus, Pope of happy memory, our predecessor, which begins: Inter multiplices, which we by this series approve, renew and enlarge, shall sell, alienate, hypothecate their goods or rights, or impose annuities upon them, or for themselves, except only from the cause of leasing for a short time, and with payments not anticipated, but not by title of lease, nor in any way for others obligate themselves or bind themselves by debt.

24 13. Neither let them send legates or orators to the Apostolic See at the expense of public or even private and personal funds, nor let anyone receive this office, nor even if they themselves willingly undertake this office and wish to bear the expenses from their own resources, ever send them, nor under the name of agent or negotiator or procurator, otherwise than for the necessary prosecution of business in the Roman Curia, likewise at the expense of all or private persons, retain or send, nor let anyone dare to undertake or perform this office, unless having first obtained, as regards obligations and alienations, permission, according to the tenor of the aforesaid constitution of Sixtus our predecessor; but as to sending legates or orators by us or by the Roman Pontiff existing for the time being, or by him who presides over the consultations of the affairs of the Ecclesiastical State for the time being, permission obtained only in writing, without which, if anyone shall have dared to undertake this office, besides other penalties inflicted by Sixtus our predecessor, he shall also be deprived by that very fact of offices obtained by him, and to obtain those and any other offices perpetually unable and incapable, and moreover infamous and marked with ignominy and infamy. § 14. To these matters we likewise prohibit that the aforesaid communities, universalities, persons in no way presume to give anything, nor their colleges, senates, assemblies, for them anything from the community, congregations, magistrates, officials or individual persons in any way presume from the fruits, revenues and proceeds, collected or contributions, certain or uncertain, ordinary or extraordinary, of their treasury or common fund, or from monies even private and particular of individual citizens by way of voluntary collection or contribution gathered in common, even under the pretext of any statute or custom, or rather corruption, from whatever cause, even customary and reasonable, to send, deliver or bestow any gifts or donations whatsoever to a legate, vice-legate, governor, protector, vice-protector, president, official or person, even any, whether ecclesiastical, even pontifical, or other greater, even shining with the cardinalate of the holy Roman Church, or mundane dignity, or his relatives, affines, familiars or ministers, or in honor of any legate, vice-legate, governor, president, benefactor or protector, even on the occasion of lodging or passage or first entrance or benefits received, in memory of gratitude and testimony of grateful mind, for constructing, adorning or erecting perpetually or for a time gates, arches, trophies, porticoes, walls or other monuments, or for receiving honorably, sumptuously, lavishly the aforesaid persons, whatever dignity or authority they exercise, or for any banquets or lodgings, even moderate, to the same or to any other, whatever occasion or cause, to be exhibited, or for persons who accompany them or minister to them or go to meet them, to be clothed in precious garments, to expend any monies.

25 15. Or for gratuities, gifts or the salaries of officials, sustenance of students, dowries of girls to increase, or under any other pretext to expend anything beyond the schedule they are not able to.

26 Litigants with communities or their debtors or occupiers of goods and those who have not rendered an account of their administration shall not be admitted to public offices.

CLEMENT

27 public offices, or even in foods, eatables and drinkables, feasts, carousings or drinking bouts, to the people or magistrates or officials beyond their salaries and emoluments, due by law or from laudable custom, or for providing sustenance to boys or adolescents for the sake of studies, or for increasing the dowries of girls not in need, or for exhibiting spectacles, even pious, and within churches or outside them in any public or private, sacred or profane places, even where the lives of Saints and holy deeds done piously are set before the people to be seen, or even under the pretext of pious works and charity or almsgiving, or otherwise in the aforesaid or other superfluous matters not contained in the said booklet or schedule, but pertaining in any way to pomp and ostentation or to the pleasure or gain and private advantages of a few, to make any expenditure or expense, unless in fact for divine worship and the true relief of the indigences of the poor of Christ, by the counsel and consent of the local Ordinary, or for those pious games only which are permitted from long-standing use, and are expressed in the aforesaid schedule or booklet, a limit to be fixed by the governor or president or authority of his province, city or place to which they are subject, which shall be comprehended in the aforesaid schedule or booklet, not exceeding, such expenditures shall be made.

28 16. We further prohibit that any citizens, townspeople or inhabitants who are holders, usurpers, or occupiers of the honors of their community or university, or who have had any suit or controversy against the same communities, which for this purpose is deemed to have been begun and commenced by a single summons alone, while the same suit or controversy is pending, as well as those who have been debtors of the same community or university for whatever cause, or who have administered their goods or monies, before they have fully repaid what they owe, or have rendered accounts of their administration, with the care of that remainder in which the debtors remain, by real restitution, shall be chosen or admitted in any way to obtain, hold or exercise any magistracies, duties whatsoever or public offices in that city, province, town, land, castle or place; and if they have been elected or admitted in fact, the election and admission shall be null and void, and both they themselves and those electing or admitting them, as well as the governors, presidents and potentates who shall have permitted this, or who shall not have exercised the exact diligence in inquiring into and prohibiting these matters, as we will and decree they are bound to do, shall be punished with the penalties inflicted against transgressors of this constitution.

29 17. Moreover, we establish and command that leases or rents both of revenues and of all duties or taxes which are farmed out or let, whether with sureties or without, and of all other whatsoever revenues, incomes, profits and emoluments of whatever kind belonging in any way to the common treasury of the same cities and places, shall be made and contracted, with all things being duly observed and the solemnities required by law or by the statute or custom of any place being employed, with persons suitable in faith and means, who shall likewise provide suitable sureties approved in public Council. In which leases or rents, moreover, this condition and agreement shall always be added, that the same communities or universities shall be altogether immune from any deduction or remission whatsoever, and, as is commonly said, abatement, from whatever unexpected and most unusual cause of war, incursion of soldiers, depopulation of fields, plunder or drought, flood, hail, storm, fire or any other most fortuitous event, and from any cause, and also from legitimate and urgent loss or diminution of fruits, even of all or the greater part, or sterility or any other cause whatsoever, thought of or unforeseen, conceivable or inconceivable, and they cannot be compelled to it, even if they were bound to it by law, but the full annual payments and prestations or pensions shall always be paid to them by the lessees without any diminution, and although such an agreement perhaps was omitted in the contracts, nevertheless by virtue of these present letters it ought to be tacitly present and understood, just as if the same thing had been expressly stipulated and agreed between the contracting parties; all judges being deprived, even the cardinals of the holy Roman Church and the auditors of the Sacred Apostolic Palace, of the faculty of judging and interpreting otherwise.

30 § 18. We also will that the depositaries of the monies and revenues of the common treasury of any community or university shall not be chosen, appointed or admitted otherwise than if, before they assume that office, they provide suitable surety at the discretion of the governor, president or potentate. Otherwise, both the leases, rents or contracts, and the appointments or elections or admissions of depositaries, together with all that follows from them, even obligations in the form of the Apostolic Camera, secured by oath or public instrument, shall be deemed null and void. And nevertheless we decree and declare that the magistrates or officials who shall have made those contracts, admitted the depositaries, or given assent in public Council, together with the others consenting likewise shall be held to the penalties expressed in this constitution.

32 § 19. By apostolic authority, by the tenor of these present letters, we revoke, render void and annul all and every exemptions, immunities, remissions, condonations of rights and the lightening of burdens of real and personal or mixed property, owed to the Apostolic Camera or to their common treasury, or of tolls, taxes, duties, tariffs, customs, collections, subsidies, contributions, touching in any manner whatsoever any particular person for their share, whether by lands or goods possessed by them, through whatever communities or universities, from whatever cause, even legitimate and by right due or permitted (such as on account of the number of twelve children, and on whatever occasion, even under the pretext of a title of burden and of a contract mutually binding, even by public Council and the common consent of all) granted perpetually or for a time, even if this was done without any damage or prejudice to the Apostolic Camera, and the same communities and universities have ratified the same in themselves.

33 § 20. Strictly forbidding lest anyone presume henceforth to grant or attempt anything of such a kind contrary to this Decree, and revoking from now as void whatever concerning all and each of the aforesaid matters, beyond or against these our interdicts, prohibitions, statutes, ordinances, commands, wills, decrees, mandates or precepts, whether knowingly or unknowingly, shall have been attempted.

34 § 21. But if anyone, together with the contraveners in the aforesaid matters or separately, shall be a violator or transgressor of our prohibitions, statutes, ordinances, commands, decrees, mandates, wills or precepts described here, we establish that, besides the express restitution or payment or compensation mentioned above, those who shall have been superior to others in precedence or rank, unless they shall have endeavored with all their strength to prevent what has been attempted or done against this constitution, and shall have altogether constantly denied their assent, shall be deprived by that very fact of all and every dignities, ranks, offices, positions and magistracies obtained by them, and both they themselves and others inferior, who shall have advised it, procured it, sought it, proposed it, or themselves done it or ordered it to be done by others, shall be perpetually unable and incapable of obtaining those and other similar or dissimilar positions in the future, and shall be marked with perpetual infamy and ignominy; and each of them, if solvent, shall be obliged to make good from their own resources, beyond the aforesaid restitution, double the damage which shall have been inflicted on the common fund or table; but if not, let them be punished with the penalty of exile or imprisonment for at least three years. But others, who shall have given only tacit or express consent, if solvent, shall pay from their own resources as much money as shall have been expended; but if they shall not be able to do this on account of poverty, let them be punished with some corporal affliction at the discretion of superiors. A fourth part of such fines shall be divided among those who, insofar as in them lay, shall have contradicted and opposed, or after consent given, repenting of their error, shall have first denounced it to superiors.

35 § 22. But also the pious constitutions of Boniface VIII and Gregory XIII, Roman Pontiffs, our predecessors, against those covenanting, promising, giving or receiving anything small or great for obtaining grace or justice for themselves or others, and against accomplices or those giving aid, counsel or favor in the aforesaid matters, with all the penalties, censures and extensions contained in them, which are aggravated and added to the aforesaid, and not diminished or changed by them, we by this series approve 1 and renew, and extend and amplify to all the persons expressed above, even those worthy of special consideration, who against the lastly mentioned constitutions in whatever cases expressed therein, by giving, receiving, promising, covenanting, consenting or permitting, not only before the Apostolic See, but in whatever tribunals and before whatever judges, even lay judges, of the holy City, and both in the Roman Curia and outside it, in whatever places subject to our temporal dominion mediately or immediately, provinces, cities, towns, lands and places shall have offended, by these present letters we extend and enlarge, with other penalties from law, or through other apostolic constitutions, or the proper statutes or customs of places, against persons committing or omitting anything of the aforesaid, perhaps decreed or inflicted, nevertheless remaining in their force.

36 § 23. Wherefore to all and each of the present and future camerlengo of the same Holy Roman Church, general treasurer, as well as legates, vice-legates, presidents, governors, potentates and priors, massarii, magistrals and other officials and all others to whom it pertains, by apostolic writings we command that they and each of them, insofar as it concerns them, take care with all study, diligence, authority and vigilance that this present constitution be firmly and inviolably observed, and that those disobedient or transgressing it be punished with condign penalties.

37 § 24. Especially indeed the same legates, vice-legates, presidents, governors and potentates, against any debtors whatsoever of communities or universities, for the exaction of the entire sum and amount which is owed to their common treasuries and shall be owed in time, summarily, simply and plainly, with only the truth of the matter examined, without the formality and appearance of judicial proceedings, shall proceed by royal hand to compel satisfaction, notwithstanding any inhibitions whatsoever. And the debtors of communities shall be compelled by royal hand to satisfy, in virtue of this present constitution, even by any inhibition, both from the aforesaid camerlengo or general auditor of causes of the Apostolic Camera, and from any other judge, ordinary or delegated, exercising any authority whatsoever, even perhaps by virtue of special commission, decree notwithstanding, by appropriate remedies of law and fact; and they shall execute all things with every and any appeal removed, restraining the same disobedient and any contradictors and rebels whatsoever by appropriate remedies of law and fact, appeal being set aside, invoking also to this end, if need be, the aid of the secular arm.

38 § 25. Notwithstanding constitutions, clauses and apostolic ordinances of the provinces, cities, lands, towns and castles to the contrary, which have been strengthened by oath, apostolic confirmation or any other firmness, statutes and customs; also notwithstanding privileges, indults and apostolic letters of whatsoever tenor they may be, by which, not being expressed in these presents or not inserted word for word, the effect of this our constitution might be hindered in any way or deferred. All of which, insofar as they are in any way contrary to the foregoing, we utterly abolish and abrogate, and all other things contrary whatsoever.

39 § 26. We will moreover that these present letters be published on the doors of St. John Lateran and of the Basilica of the Prince of the Apostles in the City, and in the square of the Campus Florae, with copies of them affixed there and distributed.

40 § 27. And that copies or summaries of the same, written in Latin or in the vernacular language, be inserted in the books of statutes of the aforesaid communities and universities, and at least twice each year be read aloud in a clear and intelligible voice in the public and greater councils or assemblies of each community or university, and be retained perpetually affixed in some public place open to all, where citizens or townspeople are accustomed to gather frequently, so that if it should happen that copies of this kind be removed from there or torn or consumed by the length of time, the priors, massarii, chancellors or other officials of the same communities or universities ought entirely, under penalty of deprivation of offices obtained and incapacity to obtain them or others thereafter, and also other graver corporeal afflictive penalties to be incurred by the fact itself, to take care that the same copies be immediately renewed and affixed again; and if it can conveniently be done, be engraved on some marble stone for perpetual memory.

41 § 28. Finally, from each of the legates, vice-legates, presidents, governors, potentates, and any officials whatsoever, as well as from the priors, massarii, chancellors or by whatsoever name called officials of communities or universities, at the beginning of their magistracy, before they are admitted to exercise it, a solemn public oath shall be taken upon the observance of these present letters.

42 § 29. And nevertheless after thirty days from the date of publication, as aforesaid, in the Roman Curia to be made, all these things shall bind and affect each one, as if they had been intimated to each personally and sworn to by them.

43 § 30.
