4 Decretum I. § 1.

Il cardinale Albani protettore « monsignor Albani primicerio » Giuseppe Janaeconi guardiano « Tommaso Borghesi guardiano » Sante Pascoli guardiano « Crescenzo Capanna guardiano » Domenico Rigioni camerlengo « Giuseppe Trivellini segretario. m §. 28. Quamquam vero hae leges a praedecessoribus Nostris confirmatae vigere omnino debeant. Musicorum congregatio non levi cum animi moerore jamdiu videt hic in urbo inductos fuisse abusus, plures enim privilegia fingentes, vel sacrificii preces, vel psalmos, atque hymnos musicis numeris ordinatos, ac varietate sonorum temperatos, saepenumero domo orationis indignos, moderari audent, eosque illius artis amatoribus exequendos committere, quod profecto dum eorum sodalibus musicen exercentibus maximo est damno, veri ecclesiastici cantus exilium affert, et quodammodo templum sanctum Dei profanum facit.

26 §. 30. Nos ergo rerum adjunctis idcirco perspectis, audiloque dilecto filio Nostro Josepho S. R. E. diacono cardinali Albano nuncupato, quem negotiis status praefecimus, ejusdem congregationis jure, meritoque patrono, eorum postulationibus, ac votis benigne annuere statuimus.

1 and to sing praise to the name of the Most High to proclaim His mercy in the morning, and His truth by night on the ten-stringed psaltery, with a song on the harp. This pious custom of the old law, therefore, when it was brought into the Catholic Church, is sung to God not only in the appointed churches on fixed days and hours, but also at other times when some heavenly memorial is solemnly celebrated, with great incitement of piety, on the timbrel and in the choir, on strings and organ.

2 § 2. Since, however, the harmony of voices and sweet musical modes ought to accord with the dignity of the house of God, the Roman Pontiffs have indeed devoted all care to this matter as well, among whom We are pleased to commemorate Gregory XIII, who, adhering to the decree of the sacred Council of Trent concerning what is to be observed and avoided in the celebration of Mass, where among other things it was prescribed that churches exclude those Masses in which something lascivious or impure is mixed in either by organ or by singing, gave his authority so that in this city a society or congregation of Musicians would be instituted, which was afterwards placed under the patronage of St. Cecilia and took her name. Furthermore, Gregory XV and Urban VIII, by whom the same congregation was confirmed, and likewise Innocent XI, who by his apostolic letters sealed with the fisherman's ring and given on the eighteenth day of May in the year one thousand six hundred thirty-four approved its laws; to which certain other laws were added by Clement XI by other such letters given on the ninth day of September in the year one thousand seven hundred fifty-six. Yet such is the condition of human nature that nothing can be so skillfully and prudently established that with the progress of time something does not appear to require either change or correction. § 3. Hence, after many controversies arose concerning the observance and keeping of the precepts and decrees about which the matter is concerned, and after certain of these same laws or decrees had been declared, some moderated and explained, and some substituted, in the presence of the whole congregation and with the approval of John Francis, Bishop of Ostia and Velletri, Cardinal of the Holy Roman Church, called its patron, our predecessor of happy memory, Pius VI, confirmed these same matters by other similar letters given on the sixteenth day of September in the year one thousand seven hundred ninety-four with benignity, and permitted them to be published in print, which indeed are of the following example, namely:

3 Chapter I. § 1. Whoever, whether an ecclesiastical or secular person, at present exercises and in the future shall exercise the profession of music, both in the chapels of continuous service and in every other church of Rome, ought to observe the statutes of our congregation and to obey not only the present decrees but all other orders and decrees to be made in the future by the use of these, under the penalties which shall be stated hereafter, We willing that the present decree comprehend indifferently the masters of the chapel, organists, singers and instrumentalists.

4 M. I- §. A. Any person whatsoever, whether ecclesiastical or secular, who at present exercises and in the future shall exercise the profession of music, whether in chapels of continuous service, as in any other church of Rome, must observe the statutes of our congregation and obey not only the present decrees, but all other orders and decrees to be made in the future by the same congregation, under the penalties which shall be stated hereafter, wishing that the present decree comprehend indifferently the masters of the chapel, organists, singers and instrumentalists.

5 IV. § 5. That for a general congregation to be valid, the number must exceed forty, and among these there must be present at least two guardians; it is established and added that it shall be in the faculty of the most eminent protector, or primicerius, to supply also for the number of the aforesaid forty professors, when two, or three, or even four should be lacking, but not more, so that with the dispensation or approval of one of the aforesaid superiors, the attendance of the two guardians and of thirty-six professors shall suffice to make the aforesaid general congregation valid. § 6. That in the secret congregation there shall be admitted none other than the guardians, camerlengo, secretary, syndics, infirmarians, examiners, and other counsellors to be chosen by ballot from the general congregation, which in all make the number of twenty, and for the secret congregation to be valid, there must be present more than fifteen, and among these at least two guardians, and to obviate the confusions that could arise in the general congregation, the secret congregation may elect beforehand for each office two brothers, as for example for guardians, two masters of chapel, two singers, two instrumentalists, for secretary two others, for camerlengo two others, and so for all the other offices, to propose them in the general congregation, so that by ballot may be chosen which of the two shall have the most favorable votes, and every year the officials must be renewed. The secret congregation may make the decrees that shall be necessary for the good government of the congregation both in spiritual and in temporal matters, and these decrees must be proposed in the general congregation, and being approved by the same, or by the greater part of it, and having obtained the consent of the most eminent protector, or of monsignor primicerius, shall oblige all the brothers to rigorous observance under arbitrary penalties by the most eminent protector or monsignor primicerius aforesaid, and by the aforesaid congregation.

6 IV. § 7. That the secret congregation, having to celebrate the feast of St. Cecilia, must elect the masters of chapel, who shall make the music in the manner that it shall elect the officials, that is, if they are to make three services it shall elect six masters of chapel at the discretion of the same, two for the first vespers, two for the mass, and two for the second vespers, and then in the general congregation lots shall be drawn to determine which of the two shall have each service, which in case of death, or infirmity, or other legitimate impediment of one of those drawn, the guardian of the masters of chapel shall be obliged to supply in place of that one without other election or drawing.

7 V. § 8. That every year there must be four guardians, that is one master of chapel, another organist, another singer, another instrumentalist, and it is determined that of the four guardians, two must remain confirmed in the following year for better instruction of the two new ones who shall be elected, and so in the future, and therefore, having been confirmed in the present year the master of chapel and the musician, in the following year the organist and the instrumentalist shall be confirmed, and so in the future.

8 VI. § 9. That all the professors of music aggregated to the same congregation must be described in a table, and the table must remain exposed perpetually in the room of the archive of the said congregation.

9 VII. § 10. That each brother be obliged to accept the office that shall be conferred upon him by the congregation, and refusing, without just cause to be approved by the same, if it be an office of festaiuoli, he shall be penalized with one scudo, if of guardian, he shall be penalized with one piastra, and if of another office, he shall be penalized with two pounds of wax, the said penalties to be applied to works customarily done by the congregation.

10 VIII. § 11. That all be obliged to attend the general congregations, and those who shall be of the secret congregation be bound to both the one and the other, and if anyone be absent without legitimate cause to be alleged in time, at least before one of the said guardians, he must each time pay one pound of wax to the congregation.

11 IX. § 12. That all the masters of chapel of Rome, following also the other decrees made heretofore concerning the observance of the payment of the soul alms, must pay one grosso per month, and all the others of the general congregation and professors must pay half a grosso per month, excepting none, whether instrumentalist of harp, as of lute, organ, and of whatever other kind, this money being to serve for pious works and other obligations of the congregation, appointing for this the camerlengo pro tempore to the collection of the same, who shall be audited every year.

12 X. § 13. That the alms be paid indispensably by all those who exercise the profession of music in any manner whatsoever, and should it happen that there be someone so poor who could not contribute this small amount, in such case he shall not be obliged to pay from his own means, but it shall be deducted from the alms which is distributed to poor professors by the guardians, and not otherwise, etc.

13 XI. § 14. That all those of the secret congregation may neither reveal nor discuss the treatises which have been made and the resolutions which have been taken, except with those who shall have been present, and contravening this, let him be punished at the discretion of the secret congregation.

14 XII. § 15. That the camerlengo for the time being ought to keep a book in good form, in which he shall note all the names and surnames of the masters of the chapel, singers, instrumentalists, and professors as above; in which he shall diligently register all the monies which shall be collected for the aforesaid alms in such manner that, the said book being brought to the congregation, each one may be able to see who shall have paid and satisfied; and thus it seems he ought to keep the account separately of the penalties which shall have been collected and exacted throughout the whole year, with rendering after the time is ended the account of the aforesaid monies.

15 XIII. § 16. That the rotation of officials shall be made in the general congregation nearest before the feast of St. Cecilia, and in such form let it be observed in the future in the manner which the statutes of the said congregation prescribe.

16 XIV. § 17. That the music of their church shall be established with a fixed number both of musicians and of instrumentalists in the manner of a rotation, dividing equally the parts, and all shall be notified with a ticket or bulletin, which ticket each one ought to carry with him when coming to the service of the church, and deliver it to the camerlengo, who shall be appointed for such purpose, so that it may be possible to ascertain who shall have been absent, and if anyone wishes to send another in his place, he shall write on the other side of the same bulletin the name of whom he sends, so that it may be recognized whether he shall have been equivalent, and no one may depart from the service without permission of the master of the chapel, and whoever transgresses shall be penalized with one pound of wax.

17 XV. § 18. That the masters of the chapel be obliged to collect every month from their subordinate musicians the monies of the taxes, contributions, and other charges imposed by the congregation, and deliver them to the camerlengo, withdrawing a receipt.

18 XVI. § 19. That the masters may not remove the musicians from the professors already accustomed to serve in the churches, when there be no demerit, and in case of incapacity, or for being abandoned by advanced age, then the master shall be obliged to receive another professor in his place at his discretion, giving him half the money, and the other half to the proprietor, who ought always to be recognized, and in case the master's music be diminished, then the master wishing to deprive himself of any professor ought to remove the newest or least necessary until the music...

XVII. §. 20. That if it should happen that some instrumental professor should take the liberty of having himself placed through obligation, or recommendation in some music, and that the master of the chapel should be forced by superiors of that music to have to place that instrumental professor, and should respectively for such recommendation exclude some of the usual professors, the said instrumental professor placed by force shall be obliged, and it shall be decreed, to pay twelve paoli to that usual professor going to that music, until such time as he shall be restored to his place, which for his cause, and obligation shall have been struck out, and for such effect it shall be lawful to him, and he may sequester that money from the masters of the chapel in those functions which that instrumental professor shall perform, and also may bring him to judgment. XVIII. §. 31. That in consequence of the ancient decree with brief conceded by the Holiness of Our Lord Pope Clement XI, at part 9, that in the musics which were made at St. Charles at Catinari five paoli per service were paid to those of the first choir, and four paoli to those of the second choir, and since moreover many musics have deteriorated in part, it has been established, that the said masters of the chapel cannot reduce the payment of three paoli per service, without however removing all those musics, which for so many years have been customary, that is of eight, ten, twelve, and fifteen paoli for three services, as also, that in the new musics of titles, or tridua they should pay four paoli per service, and in default it shall be decided at the discretion of the secret congregation.

20 XIX. §. 23. That the said masters cannot take musics from another master, excepting those of title and sacristy, which are moveable, and in case that a master with obligation takes them from another, the master who shall see the music, shall be decreed by the congregation to pay six scudi, and if some master should use artifice, or fraud to take some music from some other master, who was accustomed to it, beyond the aforesaid penalty, the instrumental professors and singers shall be removed, and also penalized at the discretion of the same secret congregation.

21 XX. §. 23. That no professor can be admitted to ecclesiastical musics without having had himself enrolled in that congregation as a brother, and without having paid at entrance the customary alms of three paoli, or else one pound of wax, under penalty to the master of the chapel, who shall invite him and receive him to said musics of paying three scudi to be applied to pious works to be done by that congregation.

22 XXI. §. 24. That having been established in the ancient memorials, statutes, and respectively in the aforesaid chapters the alms of one grosso per month to the masters, and half a grosso to the singers, and instrumental professors for each professor, and thus also having been established diverse pecuniary penalties against those who refuse the offices, or fail in the destined functions, or in another way contravene the ancient and new decrees, which alms and penalties are the greater and almost the only income of the congregation for the maintenance of their altar of St. Cecilia, and for the solemnities, functions and expenses which occur, it must be declared, as it is declared, that everyone must pay punctually the aforesaid alms decreed, and penalties incurred as above, without any exception, or delay whatsoever, otherwise after eight days after the end of the month, and after the penalty has been incurred, one shall proceed to execution without citation, or intimation whatsoever, but only the note of the contraveners shall be brought to the office of the notary, signed by two guardians, subscribed by the camerlengo, and according to the said note exhibited in said office without other citation the mandate shall be dispatched, and executed for the sums against the persons contained in said note irremissibly, and this, because it is a matter of alms of a pious cause, and if some professor in order to dwell in some distinguished court, or in order to have familiarity with some great personage, or out of respect, which in another manner he might exact from the executors, should wish with this to exempt himself from the aforesaid alms and penalties in hatred of this his obstinate contumacy of not wishing to do what the others do, he shall be struck out from the congregation, nor can any master of the chapel call him in future to any music under penalty of six scudi, and if the contumacious one should be a master of the chapel, no musician, or instrumental professor can go to serve him under penalty of three scudi to be applied for the benefit of their altar.

23 XXII. §. 25. That it is not intended by the present addition to derogate in any way from what is disposed and has been disposed in the statutes approved by his Holiness Clement XI, and from all the decrees made on the 10th day of the month of September 1767, but that those are to be observed entirely, particularly in all those matters in which in these present chapters there is no renewal or derogation, under the penalties therein and in these present chapters threatened. XXIII. §. 26. That whenever any fact or case should occur which is not comprised in the statutes, in the decrees, and in the present chapters, the said case shall be heard by the secret congregation so that it may be judged thereafter, either by the Most Eminent Cardinal Protector, or by his most reverend excellency Monsignor the Primicerius for the time being, who shall have all the faculties to decide and to derogate as much as may be necessary in said particular cases to avoid any controversy or litigation which might arise concerning the same, and everyone ought to abide by what shall be established by said superiors.

24 XXIV. §. 27. That against the contraveners recourse shall be had to the execution of royal hand in the manner of the Camera. Which chapters, as above read and maturely considered by the said assembled gentlemen, for greater validity and for their approval the ballot was conducted with the specification that the white ball should denote approval and the black ball the disapproval of all the said chapters, and the votes being collected, there were found white votes numbering seventy-nine, and black votes numbering twenty, so that by the majority of white votes all and entirely the said chapters were approved. This done, and prayers recited, and thanks rendered to the Most High, they departed, etc. The Cardinal Albani Protector and Monsignor Albani Primicerius, Joseph Janaeconi Guardian, Thomas Borghesi Guardian, Sante Pascoli Guardian, Crescenzo Capanna Guardian, Domenico Rigioni Camerlengo, Joseph Trivellini Secretary. m §. 28. Although indeed these laws confirmed by Our predecessors ought to be in force entirely, the Congregation of Musicians sees not without considerable sorrow of heart that abuses have long been introduced in this city; for many, feigning privileges, either of the sacrifice prayers, or of psalms and hymns arranged in musical numbers and tempered with variety of sounds, frequently dare to moderate them in a manner unworthy of the house of prayer, and commit them to be performed by lovers of that art, which indeed while it is of the greatest harm to their fellow members exercising music, brings about the exile of true ecclesiastical chant, and in a certain way makes the holy temple of God profane.

25 §. 29. In order therefore that some remedy might be provided for these inconveniences, the members of the aforesaid congregation humbly petitioned Us that We ourselves from Our indulgence confirm those laws, and at the same time add to them a new one, namely that a fine of three Roman coins, which the congregation demands from its members who violate the laws, shall be imposed on all who in Rome in sacred buildings either moderate a musical concert, or sing with modulation of voice, or with strings and lyres, unless they have been approved by the congregation.

26 §. 30. We therefore, having thus considered the circumstances of the matter and having heard our beloved son Joseph, deacon cardinal of the Holy Roman Church, called Albano, whom We have placed in charge of affairs of state, the rightful and deserving patron of the same congregation, benignly determine to accede to their petitions and wishes. Wherefore, wishing to pursue the petitioners with special beneficence, and seriously absolving them and declaring them absolved from any excommunication and interdict and other ecclesiastical sentences, censures and penalties imposed by law or by man for any occasion or cause whatsoever, if they are bound by them in any way, to the effect of the present only—so that in the sanctuary of God and the court of heaven all things may bear sanctity and majesty; and so that in the singing of divine praises those hearing may be moved to sorrow for their admitted faults and to a sense of piety—by the full authority of Our apostolic office We approve and confirm the aforesaid laws for the Congregation of Musicians here in the city, which takes its name from St. Cecilia; and We add to them the perpetual strength of apostolic firmness, and We supply and heal any defects of law or fact which may perchance have crept into them. Furthermore, by the same apostolic authority of Ours We command that the fine imposed against its members who violate the laws shall also be inflicted on those who, not approved by the same congregation, dare to exercise singing and sound in any churches of the city, whether as masters of music, or as singers, or as string players. We declare, however, to be exempt from this fine those who have been endowed with some special privilege by this apostolic See, which indeed either is openly evident or is shown to exist.

27 §. 31. We will this, and command it, decreeing that these present letters and the statutes prescribed above shall be firm, valid and efficacious, and shall produce and obtain their full and complete effects, and shall be inviolably observed by all to whom it pertains and shall pertain in any manner whatsoever in the future; and that in the foregoing matters by whatever ordinary judges and delegates, even auditors of causes of the apostolic palace, with faculty and authority of judging and interpreting otherwise taken away from them and from each of them, judgment and definition ought to be made, and if anything contrary to these things shall happen to be attempted by anyone whatsoever with any authority, knowingly or unknowingly, it shall be null and void.

28 §. 32. Notwithstanding the letters of Innocent, Clement and Pius of former times, and other apostolic constitutions and ordinances, as well as those of the congregation of which mention has been made, even statutes strengthened by oath, apostolic confirmation, or any other firmness whatsoever, and customs, and privileges also granted, and apostolic letters granted, confirmed and renewed in any manner contrary to the foregoing; all and each of which, having their tenor sufficiently expressed in full in these presents, and not inserted word for word, remaining otherwise in their force, we specially and expressly derogate from these presents for the purpose of the foregoing, and from all other things contrary whatsoever.

29 §. 33. We will moreover that to copies of these letters, even printed ones, subscribed by the hand of a public notary and furnished with the seal of a man constituted in ecclesiastical dignity, the same faith shall be given as would be given to the signification of Our will shown in this very document. Given at Rome at St. Mary Major under the Fisherman's Ring, on the twenty-fourth day of the month of August in the year one thousand eight hundred and thirty, in the second year of Our pontificate.
