Vat. t. 07, ep. 57, apud Wadd. 1. c. ad a. 1317, n. 18. | a Incip.

Raimondo di Fronsac) quella definizione parve «gloriosa e a lungo desiderata» (cfr. i suoi atti sopra citati not. 1. c.)

6 GIOVANNI XXII (An. II - 1317)

A nessuno dunque ecc. Dato ad Avignone, l'8 novembre, anno secondo. 3 291. Paris. 4350, cui f. 44-47 instrumentum publicum super hac inquisitione confectum inest). Quelli certamente le pene dalle leggi dell'ordine previste pagavano, questi al frate Michele Monaco inquisitore dell'eresia sono stati consegnati (cfr. infra n. 293). — In Chart. Univ. Paris., ed. Denifle-Chatelain, t. Vitale tit. s. Martino in montibus presb. card. (dell'ord. Min.), Berengario di Landorra eletto Compostelano (già maestro gen. dell'ord. Pred.), Guglielmo di Lauduno ord. Pred. (poi arciep. Viennese), Deodato ep. Castrense, Raimondo (di Mostajouls) ep. s. Fiore (poi tit. s. Eusebio presb. card.), Guido Terreni ord. Carm. Lucano (dell'ord. Min.), Michele di Cesena ministro gen. dell'ord. Min., Arnaldo Royardi (ord. Min.), Durando (di s. Porziano, ord. Pred.) ep. Anicien se (poi Meldense), Lorenzo (Anglico ord. s. Ben.), Giacomo (di Thermes) abate di Pontinaco (ord. Cist.), Raimondo (Robaudi) ep. Massiliese (poi arciep. Ebrodunense). 1 Reg. Cfr. supra n. 107 e not. ad n. 203 e 207.

Nel quale ufficio fungeva in Gerusalemme e in Antiochia patriarca e a Rodi e a Cipro e in altre parti ultramarine.

A nessuno dunque ecc. Dato ad Avignone, il 26 ottobre, anno secondo.

especially regarding the form and quality of habit and the use of granaries. 1 7 October 1317, Avignon.
To the perpetual memory of the matter.

1 The blind scrupulosity of certain persons demands, with their ambiguous and in some way unlearned knowledge (lest we say that their vain religion in this matter is irreligious or superstitious), that, while they prefer rashly to their own concepts under the guise of conscience rather than to adhere providently with the merit of obedience to the judgments of the prelates of their order, we, following the declarations salutarily issued by our predecessors and especially the blessed memory of Nicholas III and the pious memory of Clement V, Roman Pontiffs, concerning the understanding and observance of the rule of the order of the Friars Minor,2 declarations indeed solid, clear and lucid and digested with much maturity, should, God favoring, add our own indubitable declarations to those of their predecessors; and thus "day unto day uttereth speech, and night unto night sheweth knowledge," lest perchance the ignorance of a few friars of the said order (which God forbid), converting the correct words of those declarations into a devious path and accommodating them to their own (indeed contrary to them) senses, should bring forth something ungrateful to God, contumacious to superiors, detracting from the aforesaid order, hateful to the brethren, rending the union, if it could, and believed to bring grave scandal to the peoples; but rather, as our intention burns most vehemently, with these aforementioned inconveniences overcome, this holy religion of the Friars Minor (to which, when we held a lesser rank, the fervor of love and devotion burned brightly, but now after we have taken upon ourselves the yoke of apostolic service, the solicitude of pastoral care for the governance, protection, and defense of that religion inwardly and outwardly constrains us, compels us to the duty of paternal providence, and kindles the zeal of internal charity) should rejoice in quiet peace, advance in holy leisure, be increased greatly in number and merit, and moreover sweetly run into the embraces of its returning sons of its holy profession, slay the fatted calf, and willingly and diligently fall into their embraces. Truly, since the odor of that religion itself draws, charity attracts, knowledge shines, prayer merits, which in the valley of tears, namely in the misery of this world, or in the contrition and purest humiliation of heart, has "made ascensions in its heart," so that it not only advances from virtue to virtue, but also remaining in those same virtues, as if by certain wings tending toward perfection, by steps ascending day by day made better into what is higher, despises earthly things, and embraces heavenly things, and thus finally placed by divine gift in the homeland, may then know God according to such grades of its holy ascension more openly, as much as now in the straits of this pilgrimage it has ascended those higher ones; for according to David the excellent prophet, while God thus "receiveth the holy church, in its grades shall it be known." Wherefore, turning the study of our solicitude to remove such inconveniences and such perils of the same order excited, and to apply salutary and opportune remedies through the circumspect providence of that see, to the praise of God, the renown of blessed Francis, and the peace and consolation of that order and of the faithful, and no less to remove from the cautious and from those having less occasion for disobedience or wandering, and to wipe away the scrupulous darkness of "those trembling where fear was not," and to bring them back sweetly as sons to the bosom of that religion as a mother, having had diligent investigation and mature deliberation on these matters, by the counsel of our brethren, we have deemed it fitting to add the declarations, commissions, ordinances and precepts inscribed below.

2 First, since it is said in the rule, that "those who have promised obedience shall have one tunic with a hood and another without a hood, for those who wish to have it"; likewise, that "all the brothers shall be clothed in vile garments"; and concerning the meaning of the aforesaid words, clear declarations have emanated from our aforesaid predecessors Nicholas and Clement, as is aforesaid, and the said Clement has seen fit to commit the judgment of this vileness to the ministers, custodians or guardians of the aforesaid order, burdening their consciences thereupon: and yet on account of this, in certain of the brothers of the aforesaid order, wishing "to be wise beyond what it behooveth to be wise," very many new inventions of ambiguities have not ceased, or not altogether the repetition of old questions, namely both concerning the length and breadth as well as the thickness and thinness, form and figure of their garments themselves; nay, so much have such inventions and questions grown by their own license, that from among those same brothers some have assumed habits on this account short, tight, unusual and squalid, full of novelty and not ignorant of dissension, since they differed from the community of the order, and when required by the command of the ministers, custodians and guardians of the same, they have not laid them aside nor taken up again other habits, as the community of the same order bore, according to the judgment of the same ministers, custodians and guardians (saying, in this

4 of their own prelates was not to be obeyed according to their judgment, since they asserted their own habit to be thus despised and regular and cross-bearing, but the habit of others to be superfluous and irregular, nor did the often-repeated declaration of the aforesaid Clement stand in the way of this their opinion — for, although judgment concerning the vileness of garments is given in that declaration to the aforesaid ministers, custodians and guardians, nevertheless it is consequently added therein: "yet so that they observe vileness in garments," especially since in the declaration of the aforesaid Nicholas it is also said that "always in these same brothers and their deeds holy poverty may shine forth," as is found prescribed to them from their rule, and as is provided in the general constitutions of the same order, as they assert, that in all things which pertain to the habit of the brothers, roughness, vileness and poverty may always shine forth: whence, since neither the garments offered through the ministers and custodians and guardians possessed poverty, roughness or vileness, nor were they bound in any way to follow the judgment of their own superiors of their order in putting off the garments which they wore, nor in assuming those which they gave — the general minister and the other brothers, who were present for the community of the same order, asserting the contrary on their part with their reasons, which we omit for the sake of brevity, as these and other matters were thus and thus proposed before us and the same brothers of ours both in writing and by word, and also before some of our aforesaid brothers deputed by us on this matter, especially by some of the brothers of the said order, who opposed the aforesaid community, the same matters were repeated many times). Wherefore we, having heard the aforesaid reasons more seriously and having understood the other matters more fully, wishing to put an end perpetually to the aforesaid business, by the counsel of the aforesaid brothers of ours declare and say, that, since (as is touched upon above) it is said in the rule, that "all brothers shall be clothed in vile garments," and since the vileness of such garments both of the habit and of the inner tunics the aforesaid Clement decreed ought to be understood as that which according to the custom or condition of the country ought to be rightly reckoned as vileness with respect to the color of the cloth and price, and consequently he deemed it fitting to commit the judgment of such vileness to the aforesaid ministers, custodians or guardians, burdening their consciences thereupon, as is more fully contained in the letters of the same Clement made on this matter, the judgment of the same ministers, custodians or guardians has been left in the same manner; and we nevertheless by the authority of these presents commit to the judgment of the aforesaid ministers, custodians and guardians to determine, namely to judge and prescribe, of what length, width, thickness, and fineness, form or figure and similar accidents the habit itself and the hoods and the inner tunics ought to be, in which all brothers of the said Order of Minors shall be clothed, and moreover, of what quantity and degree of vileness they ought to be clothed in such garments, and whether in such garments according to the rule and the declarations of the same predecessors of ours and the aforesaid constitutions of the order roughness, vileness and poverty may shine forth: whether and to what extent with respect to color, price, vileness, poverty also and the other accidental matters aforesaid the brothers shall be clothed in garments, as they ought; concerning which we burden the consciences of the same ministers, custodians and guardians, decreeing and strictly commanding by mandate, that in the aforesaid matters and similar ones their judgment, determination or decision — indeed the general minister's in the administration of the whole, the provincial ministers' in the administrations of provinces, and the custodians and guardians' in the custodies and guardianships or convents of the aforesaid order committed to the same — all and each of the brothers shall be bound to follow in every way and to obey in all things; and moreover that by following their judgment, determination or decision and obeying them they are not and cannot be said or ought to be, nor do they themselves assume themselves to be, transgressors of their rule or of the constitutions of their order: especially since neither expressly nor determinately is it said in the aforesaid rule of the brothers of Minors or in the aforesaid declarations, of what length and of what width, of what thickness or fineness, of what form or what figure such garments ought to be: just as neither is it expressed in the same what quality and what degree of vileness they ought to have; and thus (in a certain way, the same necessity urging, with not unequal equity, and with the true sense and true understanding of the rule persuading it) adhering to the footsteps of the same Clement, we are compelled to declare that the judgment of the aforesaid ministers, custodians and guardians in the aforesaid matters and similar ones shall be, and we are invited to commit it to them, as is aforesaid. For certain knowledge cannot be given of all particulars, nor, since these are infinite, can discipline be made of them; neither art, nor rule, nor regulation embraces all individual circumstances and accidents: the lesser have to be subject to the greater, to obey them, and to attend to them, not only in certain matters, but also in doubtful and uncertain ones; they preside over acts, to which they obey; they preside over rules, to which they comply; over disciplines; so that the excellent end of those may follow by the due ministries of those who follow. Thus judging, one examines and discusses all things, applies laws to cases, distinguishes the decrees of canons; thus the aggravating disease demands the physician, thus virtue constant in the middle demands the wise and prudent one: lest, if each one be governed as he desires, he forthwith fall, as he does not seek, nor thus is it fitting: not order but horror shall dwell, discord shall be present (which God forbid), binding religion, religion shall be relegated; for sentences vary as heads do, and fantasy grows in the foolish opinions. Bullarii Franciscani t. V.

5 In the same manner, invited by the same reasons in a certain way, with the aforesaid ministers and custodians under a certain form (namely both together and separately in their administrations and custodies) with the guardian and two discreet priests of the convent of the place and elders in the order of brothers in council and consent, the aforesaid Clement judged it fitting to leave to their judgment, whether it is very credible from those already tested, that the brothers themselves cannot find the necessaries of life without granaries and cellars (in which case granaries and cellars, congregations and conservations of this kind he himself granted to them, as is more fully contained in the aforesaid letters of the same Clement): we, by the counsel of the aforesaid brothers of ours and of the same ministers and custodians under the same form, by the authority of the present do commit to their judgment to determine, namely to arbitrate and to prescribe in that case, how, where, when, in what manner and how often grain, bread and wine for the necessaries of the brothers' life the brothers themselves ought to seek, preserve, or store, even if they are to be stored in the aforesaid granaries and cellars to be preserved; and we establish and strictly command and mandate, that in the aforesaid and in similar matters the arbitrium, determination or judgment of the same, namely of the general in the administration of the whole, of the provincial ministers in the administrations of the provinces and of the custodians (both together and separately) in the custodies of the aforesaid order committed to them, with the guardian only (as is said above) and two discreet priests of the convent of the place and elders in the order of brothers in council and consent, all and each of the brothers are bound to follow in every way and to obey them in all things; and moreover, that in following their arbitrium, determination or judgment and in obeying them they are not and cannot be said or ought to be nor do they themselves assume themselves to be transgressors of their rule or of the constitutions of their order. Wherefore all and each of the brothers of the aforesaid order of Minors who have brought or bring before us and our brothers or otherwise in the Roman curia strict, short and deformed habits different from those of the said general minister and other brothers of the said community, we admonish and exhort in the Lord, and nevertheless by virtue of obedience and under the penalty of excommunication by apostolic writ we command them, that at the mandate of the said general they lay down the habits which they bring and put on others according to the judgment, determination or arbitrium of the said general, and let them humbly obey, comply and attend to the said general in all these and other matters in all things, according to the rule of blessed Francis and the aforesaid declarations, concessions and commissions of our predecessors comprehended in the said declarations and ours contained in the present, not withstanding any privileges whatsoever, indulgences, letters, liberties, immunities or exemptions granted to them or any of them by the aforesaid Clement, or appeals interposed by them or any of them to the apostolic see, which, insofar as they could be derogated by the present, we vacate the rights. For religion is destroyed if the meritorious obedience of subjects is withdrawn. Great indeed is poverty, but greater is integrity; obedience is the greatest good, if it be kept unimpaired. For the first rules over things, the second over the flesh, the third truly over the mind and soul, which as it were unbridled and free it binds to the dominion of another by the humble yoke of its own will. To this therefore let the aforesaid brothers return not unwilling but willingly, let them will and desire this, let them long for this with great desires, and let them repeat that in the vows of canticles: "Let him kiss me with the kiss of his mouth," namely of charity and love, religion of this kind obedience holy purifying; for "thy breasts are better (namely of precepts and counsels, as it were certain nourishing draughts) than wine, fragrant with the best ointments (namely of good fame) with the sweetness of odour." Nor let these fear, as they return to obedience of the order by God the author; for they shall find their prelates (as we firmly hope and enjoin upon them) benign and mild to them, the others sweet and gentle, since all and each of the brothers are and ought to be in Christ; let them cry out: "Who will give me my brother (namely born of the same common father blessed Francis) sucking the breasts of our mother (namely of religion and profession of the same as it were the mother of contemplation and reading sweet and gentle draughts), that I may find thee without (somewhat unlike from the observances of the same) and may embrace thee (namely gently within the breasts of charity embracing thee), and now let no one despise me": truly, those whom many perhaps despised as placed without and as it were divided and at variance, now placed within, namely within the inner heart of love and the cloister of conformable observance, let no one despise, but receiving them with sweetness let each one worthily extol them in praises and received. Let no one therefore at all of mankind presume to infringe this page of our declaration, commission and constitution, mandate, admonition and vacation, or to act against it with rash daring. If anyone however, etc. Given at Avignon, on the nones of October, in the second year.

6 JOHN XXII (Year II - 1317)

7 290. He grants to Cardinal Vitalis, priest, the faculty of making a will. 1 1317, 25 October, Avignon.

8 To our beloved son Vitalis 2 priest cardinal of the title of St. Martin in the Mountains.

9 Since nothing is owed to men more than that the pen of the supreme will be free and untrammeled, and that the choice, which does not return again, be free: we, inclined by your supplications, grant to you by the tenor of these presents full and free faculty to testify, to ordain and to dispose freely of all goods pertaining to you, of whatever quantity or value they may be, even if those have come to you from the revenues of churches or from churches committed to you or to another person by reason of your office or contemplation, and shall come also in the future. Let no one therefore etc. Given at Avignon, on 26 October, in the second year. 3 291. He absolved Peter, patriarch of Jerusalem (of the Order of Minors), from all things administered by him in the office of legate, [and] inquired "whether they would wish to obey the precepts contained in the aforesaid letter and whether they believed that the lord pope could have ordained or commanded in the manner in which in the same letter they are contained." To both questions some of them responded affirmatively, but others however (numbering 25) [responded] the very opposite (cfr. cod. bibl. nation. Paris. 4350, in which on f. 44-47 is contained the public instrument drawn up concerning this inquisition). Those indeed paid the penalties provided by the laws of the order, but these were delivered to brother Michael Monachi, inquisitor of heretical depravity (cfr. infra n. 293). — In Chart. Univ. Paris., ed. Denifle-Chatelain, t. II, p. 215, n. 700 are related the votes of certain masters of theology against three articles of the part of the brothers of the Order of Minors (Spirituals), namely: "1. that obedience is not owed to any prelate commanding certain professors of the rule of the Order of blessed Francis to lay aside certain short and tight habits, deformed from the habit of the community of other professors of the said rule, which they had assumed of their own accord, and that no mortal can compel them to lay aside these habits from the fact that that which is against the observance of the aforesaid rule of blessed Francis and its understanding is consequently against the Gospel and faith, and conversely, otherwise it would not be held as a rule for the Gospel; but to impugn such habits and to compel them [the brothers] to lay them aside is against the truth of the said rule and consequently against the Gospel and faith, and is to impugn the Gospel of Christ and its truth in word and deed; and that from this it would follow the destruction of the life of Christ and is to cast Christ out of the synagogue, and that those who proceed against the brothers wearing the said short and tight habits are in error against the truth of the evangelical rule and consequently against the truth of the Gospel and faith; 2. that the lord pope neither had nor has any power or authority to make a constitution, which he made by the counsel of cardinals, which begins: Quorundam (in which he commits to the judgment of the prelates of the said order to determine and to judge of what length and width, form or figure and similar accidents the habits of the professors of the said rule ought to be, and in what quantity and degree of cheapness the brothers ought to be clothed with garments, and moreover to determine, to judge and to command, in what case, in what manner, where and when and how often grain, bread and wine for the necessities of the brothers' life the brothers themselves ought to seek, to preserve or to store; and strictly commanding he mandated that in the aforesaid and similar things the judgment, determination or decision of the same prelates they are bound to follow and to obey in all things; and by virtue of obedience and under penalty of excommunication he mandated that the said brothers, who had assumed the said short and tight habits, at the command of the general minister of the order lay them aside and be clothed with others according to the judgment or decision of the same general minister, and that they obey the same general in all these and other things in all respects according to the rule of blessed Francis and the declarations issued upon it and to the aforesaid ordinance humbly); 3. that neither the pope nor the prelates of the said order are to be obeyed in those things which are contained in the aforesaid constitution, from the fact that the aforesaid things contained in the said constitution are against the counsel of Christ and the said rule, against which the pope cannot [act]." These articles individually the masters in the theological faculty at Paris judged before the middle of the year 1319 to be heretical, limiting and destroying the Roman Church, false and new in the Catholic faith and contrary to evangelical truth, disapprovable and superstitious: fr. Vitalis, titular of St. Martin in the Mountains, presbyter cardinal (of the Order of Minors), Berengarius of Landorra, elect of Compostela (formerly general master of the Order of Preachers), William of Laudun, of the Order of Preachers (afterwards archbishop of Vienne), Deodatus, bishop of Castrum, Raymond (of Mostajouls), bishop of St. Florent (afterwards titular of St. Eusebius, presbyter cardinal), Guido Terreni, of the Order of Carmelites (shortly after prior general of the same order and then bishop of Majorca, finally of Elne), Henry (of Carreto), bishop of Lucca (of the Order of Minors), Michael of Caesena, general minister of the Order of Minors, Arnold Royardi (of the Order of Minors), Durandus (of St. Porcian, of the Order of Preachers), bishop of Anicy (afterwards of Meaux), Lawrence (the Englishman, of the Order of St. Benedict), James (of Thermes), abbot of Pontiniaci (of the Order of Cistercians), Raymond (Robaudi), bishop of Marseille (afterwards archbishop of Embrun). 1 Reg. Vat. t. 67, f. 306, ep. 13, de curia. 2 De Furno, of the Order of Minors, formerly minister provincial of Aquitaine, afterwards bishop of Albano, who died on 16 August 1327. Cfr. supra n. 107 and note to n. 203 and 207.

10 8 John XXII at various times conferred certain ecclesiastical benefices in commendam upon him, "so that he might more conveniently bear the burdens of necessary expenses incumbent upon him", namely: 3 January 1317 canonries and prebends, which John Fernandi, elect of León, formerly held in the churches of León, Astorga, and Córdoba together with the deanery of León; likewise 25 February 1317 one ecclesiastical benefice subject to the collation of the abbot and convent of the monastery of St. Victor of Marseille, and another subject to the collation of the bishop and chapter of Rutes; likewise 1 July 1317 the priory of Lichfield in the diocese of Arras; likewise 23 July 1317 a canonry and prebend in the church of London and the parochial churches of Boyle in the diocese of Canterbury and of Ruselfeld in the diocese of Chichester, which Thomas, bishop of Worcester, formerly held; likewise 25 July 1317 the priory of Elizona of the Cluniac order in the diocese of Auxerre, pertaining to the monastery of Cluny, which was formerly commended to the blessed martyr Raymond, titular of St. Pudentiana, cardinal priest; likewise 1 July 1318 the parochial church of St. Mary of Óbidos in the diocese of Lisbon; likewise 15 October 1318 the priory of St. Mont in the diocese of Auxerre; likewise 5 November 1319 the church of St. Mary Rotunda of Naples, and finally on 24 May 1321 the faculty of exchanging the priory of Arles in the diocese of Nîmes with the priory of Melins in the diocese of Arles, O.S.B. In order to retain these benefices, when he was promoted to the episcopate of Albano, he obtained the grace on 6 June 1321 from the same supreme pontiff, who moreover on 23 February 1320 had constituted certain prelates as conservators of his rights. At that time indeed almost every cardinal held several ecclesiastical benefices in commendam, which he exercised in Jerusalem and Antioch as patriarch and in Rhodes and Cyprus and certain other overseas regions. 1 26 October 1317, Avignon.

11 To our venerable brother Peter, patriarch of Jerusalem and bishop of Rutes.

12 It has recently been brought to our attention by the insinuation of certain persons that you, having formerly exercised the office of legate by apostolic authority in the regions of Jerusalem, Antioch, and Rhodes and Cyprus and certain other overseas parts, had returned from that legation without having obtained permission from that same see, nor had you rendered a legitimate account of those things administered, done, and acquired by you by reason of that same legation: we, wishing to have certainty of the truth concerning these matters from you standing in our presence, since you have rendered a sufficient and suitable account, which we caused to be diligently exacted from you, of all things done, administered, and received by you by reason of that same legation, and you asserted that you had returned, although without the said permission, yet from just and reasonable causes, we, wishing to provide for your status and honor on account of this, and lest you be henceforth able to be challenged or impugned concerning these matters, inclined to your supplications, do by apostolic authority absolve you from the impeachment of all the aforesaid matters and all other things denounced and inquired into against you in the Roman curia, because you had returned from the said legation without having obtained the permission of the apostolic see, or for any other reason or cause whatsoever, and by the tenor of these presents we set you free, decreeing by the aforesaid authority that you have rendered a sufficient and full account of all things done, administered, and received by you by virtue or reason of that same legation, as is aforesaid, and that you cannot be impugned or molested in any way by anyone on account of all the aforesaid matters in judgment or outside of judgment. Let no one therefore etc. Given at Avignon, on the 7th day before the Kalends of November, in the second year.
