GREGORIO XI PAPA

2 Gregory, bishop, servant of the servants of God, for a perpetual record of the matter.

3 The most holy wisdom of both laws, by which both the militant Church is ruled and the civil commonwealth is governed, must be so presented to minds to be instructed that it is not neglected by the weariness of negligent provision, but is sought after by the zeal of timely care. But because there are some to whom nature has bestowed the benefit of talent for acquiring knowledge, yet the gift of wisdom itself is either destroyed by the omission of the proper way, that is, of continued study, or cut off by the scarcity of necessary means, it should not undeservedly be the case that those who are naturally apt for the exercise of study should have the beginning of negligence removed through places disposed by provident ordinance, and the offense of poverty should be taken away through the supply of temporal things, so that thus both the suitability of place may invite to study of exquisite learning, and the provision of necessaries may strengthen the powers of minds, the stimulus of want being absent, through willing effort.1

4 § 1. Indeed, considering that those things which are offered as acceptable sacrifices to the supreme Creator of all through the hands of the faithful are believed to please the Divine Majesty most especially through which, in order to dispel the darkness of ignorance, those to whom their own resources do not suffice for the pursuit of the study of sciences, and any place which furnishes matter to be charged with harmful idleness or vagrancy, are relieved by opportune remedies and auxiliary conveniences. Considering also that great spiritual and temporal, public and private benefits proceed from the very wisdom of law to the world, by which the worship of God is increased, the Catholic faith is strengthened, the salvation of souls is provided for, peace and tranquility are procured by cutting off lawsuits, which are often occasions of crimes; the lawful is distinguished from the unlawful, the equitable from the inequitable; rewards are decreed for the good, punishments for the wicked; the souls of the unlearned are instructed, and those of the advanced grow unto greater things, justice written, 1

Proosinium.

5 Which things moved the Pontiff to construct this college.

6 To the honor and glory of the Holy and Undivided Trinity, in praise of the most exalted Virgin and of the whole Church triumphant, and for the remission of our own sins, and so that in the garden of thy holy Mother 2, with the Lord as author, though unworthy, we preside over the Church, by a rod from the generous faculties of the same laws, which, whether through the dullness of men, or the malice of souls, or the lack of necessaries, which is the stepmother of discipline, are seen to fail sufficiently to produce fruits abundant and pleasing to God, in our city of Bologna, the principal nursling of laws, which heavenly Justice, as it were a most brilliant light of laws, illuminates with a distinguished Studio, and which, imbued with unfailing faith serving the Church of God, has drawn us to the highest love, glory and exaltation of itself—in our name we establish 4 in the street or lane called the Place of the College of Castilioni, situated in the parishes of the Holy Mary and Agatha and of St. Stephen, which was of the heirs of the late John of Pepulis, knight of Bologna, one college to endure in perpetual times, a school nourishing thirty poor scholars, six chaplains and fifteen servants, and we constitute and ordain it; and the said house or palace with all rights, appurtenances and moveable things existing there we now freely assign to the aforesaid college, and in perpetuity, and from certain knowledge we give and also set apart for the uses of the scholars from now on, knowing that of the same thirty scholars fifteen are to be students in canon law, and as many 2 to be imbued in civil law; nor shall any faculty of these laws be disturbed or destroyed by any hand or chance, but when a canonist shall depart, another canonist shall be substituted in his place, and the same concerning legalists, lest it happen in the future that all students be of the same faculty.3

7 § 2. We further will and command that, as often as it is necessary in receiving those to be admitted to the said college, the number be completed.

8 to be sufficiently instructed in the preliminary arts, especially in grammar, and at least competently in logic: declaring that no one who has completed his twentieth year of age shall be received in the aforesaid college unless he has first heard the laws for at least a year, nor shall anyone, even if he has otherwise heard them and made progress, who has completed his thirtieth year, be received in the aforesaid college.

9 § 3. We have wished that the aforesaid scholars be received, selected and admitted into the college subscribed to in the manner following: namely, that successively there shall be assumed so many from Limoges, from the dioceses, that is, of Limoges and Toul: that there shall be perpetually twenty in number in the said house, but others shall be received indifferently from the lands of the Church of Rome, situated in Italy, except that they shall not be received from Bologna.

10 § 4. Provided that the said number shall in no way be varied beyond what is stated, but as regards faculties, nations and other matters it shall be fully observed. If it should happen that the number of scholars be increased in the future, we will that the excess also be assumed from Limoges and from the lands of the Church, as aforesaid, in such manner, namely, that always two parts shall be received and instituted from those of Limoges, but the third part from the lands of the Church, as above: saving, however, that if it should happen hereafter that we expressly increase the number of scholars, we will that those to be instituted be assumed from anywhere beyond the aforesaid number, and be instituted by the Roman Pontiff, our successor, who shall be at that time; whom we constitute as patron over these matters, as is more fully contained in the apostolic letters made out concerning this.

11 § 5. To the aforesaid scholars thus received at the time we have granted, that nine canonists, who can remain in the college, and ten legists during a continuous time of grave infirmity, or also at a time when they shall have been absent, by the mandate of the rector and the greater part of the college aforesaid, conducting the business of the house, or also if before their reception they shall have heard the laws for a period of three years only, not deducted, can remain in the said college: commanding them, in so far as within that time they dispose themselves to receive at least the degree of licence to teach, and expressly forbidding them, lest they in any way transgress the form or disposition of the statutes of the university of scholars of Bologna concerning private examination limited. When the course is completed or even the licence degree is received before, within one month they are bound to leave the aforesaid college, unless within six months immediately following they should wish to receive the degree of doctorate: in which case they would be tolerated for that time only, or unless examined in their faculty and licensed to pass to another such faculty of laws: in which case, in order that he may grow further in knowledge, we will that such a one be tolerated there for another three years only.

12 § 6. Moreover, since it is our intention that the aforesaid college be instituted and endowed for scholars from the patrimony of the Church for poor persons, who, lacking the resources of parents or the sufficiency of ecclesiastical income, are not able to sustain themselves in the pursuit of study, or do not have their own means to prosecute their studies, we ordain: that if it should happen hereafter that any one of the scholars of the said college obtain an ecclesiastical benefice or benefices of the annual value of fifty pounds of small Tours currency according to the assessment of the tithe, or seventy gold ducats carried at Bologna, or in a patrimony prepared for him an equal amount, and from which or which as soon as they come to him, he is bound to make known to the rector and college within a month from the day of notice, within the space of one year from the day on which he shall have obtained peaceful possession of such benefice or patrimony, unless perhaps in the six months immediately following he should wish to receive the degree of licence or doctorate, as is premitted above, he is bound to withdraw from the said college and to yield to another, and another suitable person shall be substituted in his place.

13 § 7. But because on account of the sterility of the year or the passage of time, or some fortuitous case, which cannot be provided for by human counsel, it may perhaps happen in the future that in some years the income and revenues of the said house, deducted from the charges, would not suffice for the sustenance of so many persons aforesaid, we ordain that in that year or years in which such a computation or event of cases should occur, in no way on that account shall the possessions, revenues, books, income or other moveable or immoveable goods of the said college be alienated or sold, but this order shall be observed. First, namely, from the common monies of the treasury, if there be any, let him sustain himself; which if there be not or do not suffice, let there be deducted the collections of doctors and beadles and other extraordinary expenses, and let each one pay these from his own means; then let the number of the household and other pensioners be diminished, then the clothing of the scholars; which if even this does not suffice, nor on that account let the number of scholars be diminished, nor let any one of them depart, but let each one contribute from his own means, as much as shall be possible for him, and let them dwell together so long as they can live together without want. Which if the want be so great that the number cannot be tolerated or maintained, first the beneficed, then the graduates, then others less poor, during such want, are bound to leave the college itself, to be admitted afterwards to their former place, if means shall be available.

14 § 8. If indeed, as often happens with the varying circumstances of times, the revenues and income of the said college, after all deductions have been made, should exceed the expenses, we will that they be applied and converted to the increase of the common possessions and revenues of the said college; but if at length, divine clemency favoring, at some time such revenues and income should so increase that from them the number of scholars could be augmented, we will and ordain that such excess of revenues, according to the form of provision by us noted above and disposed, be converted to the increase in the number of scholars: provided always that, after first careful deliberation with the whole college and its visitors, of whom it shall be determined below, the house be first enlarged, and be so fitted out that all may dwell together within the same house and under the same governance: it being always provided that the revenues remain greater and the income exceed the expenses.

15 § 9. Moreover, as long as we live by the grace of Christ, we reserve to ourselves the provision and disposition of the said house, and the establishment and institution of the scholars, and also the power of supplying, amending, adding and at our pleasure commuting, removing and increasing the aforesaid number and all the foregoing and subscribed matters in every way. But we, according to the good pleasure of divine permission, being withdrawn from the present light, will that the cardinals of the Roman Church, if any there be, of our kindred, be successively and gradually substituted one after another according to the nearer degree of affinity in the presentation of the said scholars of the Limousin nation: which not existing or being deficient, to the Count of Bellfort our father, and after him to the Viscount of Turin our brother, then to the sons of the same viscount, and also his natural and legitimate nephews males descending by the right line only, and these not existing, to him who shall be Count of Bellfort by the male line descending from our progenitors, by the authority of the Most High, and up to his children and nephews natural and legitimate descending by the right line only, and these being deficient, through Nicholas Roger our brother and his children and nephews natural and legitimate descending by the right and male line only: and finally, these not existing or being deficient, to the nearest of our kindred descending from our progenitors by the male line, we will that the presentation of the said Limousin scholars pertain in perpetual times.

16 § 10. And the institution and examination of those presented by them we determine to pertain perpetually to the Bishop of Limoges, who shall be for the time, or, the see of Limoges being vacant, to the Bishop of Tulle. But the presentation of Italian scholars we will to be perpetually and irrevocably devolved after our death to four doctors from the lands of the Church, or, these being deficient, from other places, who shall be for the time the more senior, namely with respect to teaching and not age, actually teaching at Bologna, of whom two shall be doctors of canon law, the rest of civil law, and to the Bishop of Bologna, who shall also be for the time, their examination and institution. But if the aforesaid doctors within a month shall in any way delay to present or shall not be able to agree, they shall not be admitted to present on that occasion, but it shall be devolved to the rector and counselors of the said college for that occasion. Admonishing and earnestly beseeching in the Lord all and each of the aforesaid according to the trust and full hope which we undoubtedly bear of them, that, setting aside all fear, love, price or hatred, having only God before their eyes, they present and institute in the same college scholars advanced, docile and well fitted for study, of laudable life and conversation, and commended by good morals, upon which we burden their souls. Declaring that if he to whom it shall pertain to present or institute in Limoges shall within six months have designated no one, that the rector and counselors, who shall be for the time in the said college, may receive in the same college for that occasion a man advanced and suitable, as aforesaid, from anywhere; who indeed, when another is designated, shall then by him or those to whom it shall pertain to institute, forthwith yield, otherwise he shall be expelled in fact, no delay of times notwithstanding.

Concerning the chapel to be constructed and the name of the college.

Concerning the divine offices to be performed in the same chapel.

17 Prayers to be said for himself in the same chapel by priests. Gregory directs.

18 §11. But because every pious work must draw its foundation from spiritual nourishment, by which it may be refreshed, especially for clergy working toward the heavenly homeland, we decree that in a suitable place of the aforesaid house, which shall seem more apt for divine worship, a chapel with a bell tower be constructed, with two bells, which may be rung in the manner of a class bell at opportune times, and an altar be consecrated under the name and feast of the Assumption of the glorious Virgin Mary, and let the whole aforesaid house assume the name and title of the Lord Pope Gregory, and be called perpetually the Gregorian College.

19 § 12. For the sacred mysteries to be duly performed in the said chapel at appropriate times, we will that there be perpetually six priests, decreeing that on each day at least two masses be celebrated, one of which without singing in the morning before the entrance of the scholars, and also, if it shall be expedient, at dawn, the other with the singing of the Church at the proper hour, and let each scholar hear one of them.

20 § 13. Although we have not wished to bind the aforesaid six chaplains to celebrate beyond two masses on each day; nevertheless we exhort them and the scholars, if any shall be in the priesthood, in the Lord, that especially on Sundays and feast days they apply themselves to the celebration of masses; and in each mass, unless the solemnity of the day prevent it, according to our direction, so long as we shall live among men, let the prayer be said daily: O God of all the faithful...., thy servant Gregory, etc., and also twice each week let two masses of the Holy Spirit be celebrated. After we shall have paid the debt owed by our nature, in like manner let the prayer be said for our soul: O God, who among the apostolic priests thy servant

21 Gregory, and each and every week two special masses for the dead. Beyond this also we command that each year on the day of our death with solemn vespers, matins and mass for the dead, which, provided that a just and evident (1) cause does not prevent, all both scholars and priests ought to attend, an anniversary for our soul be celebrated, and nevertheless each priest even a scholar of the said house on that day a mass of Requiescat aeternam either by himself or through another; but the other scholars who are not priests shall be bound to say the office of the dead in a low voice.

22 §14. Furthermore we decree and ordain that on Paschal days and other solemn feast days and festivals, namely, on the feast of the Nativity of the Lord with the two following days, the Circumcision, the Epiphany, the Ascension, Pentecost and Corpus Christi, the four principal festivals of the glorious Virgin Mary and the Nativity of St. John the Baptist, the blessed apostles Peter and Paul, St. Michael, St. Benedict and St. Martial, All Saints and the following day, and the feast of St. Catherine, the divine office be celebrated as is customary to be done in collegiate churches, and also on the three days of Holy Week let matins be chanted: on which days and festivals let all scholars, unless a just impediment prevent, be present and assist: and let those absent be punished at the rector's discretion.

23 §15. Moreover we permit that on the feast of the Assumption of the glorious Virgin any bishop or prelate in pontificals with the vestments which he would use in his own church when celebrating, being requested for the part of the said college, may without anyone's permission solemnly celebrate in the aforesaid chapel, and the word of God may be preached to all present there on that day, and to attend the divine offices in the said chapel then and at other times, besides those of the college, any males whatsoever may come, without prejudice to the rights of others. The offering both 5 of the scholars and servants of the said house, as well as of any others, we will to be applied to the parish churches within whose bounds the said house is situated.

24 scholars and servants of the said house, as well as of any others, we will to be applied to the parish churches within whose bounds the said house is situated.

25 § 16. Moreover we decree and will that on each day evening office with music, and nevertheless on Saturdays and vigils of Apostles, Evangelists and the four Doctors of the Church let compline with music be chanted in the aforesaid chapel by the priests of the same house. But we do not wish scholars to be bound to attend on those days.

26 § 17. Finally each scholar, so long as he shall remain in the aforesaid college, shall be bound to say for Gregory daily, while we live, the verse Save thy servant, O my God, with the prayer, O God of all the faithful, etc., and after our death the psalm Out of the depths have I cried unto thee, etc., with the prayer, O God, who among the apostolic, etc. Likewise each non-priest shall recite each week the seven penitential psalms with the litanies once, priests however each month one special mass of the Holy Spirit while we live, or of Requiescat in pace after we have departed life, and finally all the aforesaid scholars shall be bound to recite the entire psalter each year, so long as they shall be there.

27 § 18. And because wisdom does not enter into a malevolent soul by God's decision, nor into a body enslaved to sin, and wishing that their works be acceptable to God, we will that the aforesaid scholars be confessed at least three times in the year, and communicate twice, or more often at suitable times, as divine grace shall suffice for them; to which, if it be necessary, they shall be compelled by the rector of the same college.

28 § 19. But because it is fitting that the ministers of God, namely the Chaplains, be irreproachable and without blemish, we establish and ordain the office as follows: that the aforesaid six priests, approved in life and morals, having first given arbitrary security to the rector and counsellors for indemnity, and also having first taken an oath that they will faithfully preserve the rights, honour and goods of the said college, and likewise the statutes issued and to be issued, showing charity in all things,

29 pertaining to their office and will observe obedience, may be assumed by the aforesaid rector and counsellors, and also may be removed when the cause requires it; and these men shall be bound not only to administer spiritual things, but also temporal things to the scholars and also to perform daily duties at the command of the rector. Provided, however, that the chapel shall not be deprived of divine office. That all these things may be executed more diligently and effectively, we forbid that they be able to attend any lectures, except only at certain suitable hours of the scholars within the house at a decent hour. Furthermore, we will that the books, vestments, chalices and whatever ornaments assigned by us to the said chapel, and also the lights, be guarded by the said priests or some of them or another, concerning whom or which the rector or the aforesaid college shall have deemed it right to ordain, and be handed over and prepared, as the ministries of divine offices to be performed shall have suggested, and as it shall seem fitting to them for the dignity of solemn or ferial days.

30 § 20. Furthermore, because any society without a rector, just as a ship without a governor easily perishes, we establish and ordain that for the prosperous government of the same college, each year on the first Sunday or feast day of the month of May after the elections of the rector of the University of the Studio of Bologna have been celebrated, the rector of the University of the Studio of Bologna, having first convoked and assembled all the scholars by the ancient rector of the same college in a suitable place; and these men are bound to come and proceed to the election under penalty of perjury, and having first taken an oath in the hands of the ancient rector, that, setting aside all love, fear, price or hatred, they will proceed to the election; they shall elect together with the aforesaid rector, who shall have two votes, him whom they believe sufficient and suitable for exercising the office and government of the college. He who shall have attained his twenty-fourth year of age, and shall have spent two years in the college, and be of the body of the college and of Ultramontane nation, that is of the French nation, and he, all exception being repelled, shall be held as rector, who shall have been elected by the greater part, even by comparison of the smaller part; nor do we wish to bind the electors to any form of ours; but it shall suffice that the consent of each be expressed by written ballots, as is customarily observed in the election of the same Studio; if the electors are equally divided in number, we permit that throughout the day of election the dissenters may go over to one of the elected, otherwise the visitors or the greater part of them shall be bound to certify within two days which of the elected they prefer. The office having been assumed in the manner aforesaid or otherwise by the greater part, cannot be refused under penalty of deprivation of the grace of the said college for the whole of that year.

31 § 21. Provided, however, that the same elected person cannot in a second year be assumed in the immediately following year, unless consenting thereto of their mere liberality two parts of the same college: but he who, under whatever pretext sought, shall have procured himself to be elected in the second immediately following year, shall be perpetually unfit to obtain any office in the said college, and nevertheless the election shall be null by that very fact: in like manner let the election otherwise suitable of the same person for the third year be null; but if it happen by chance that the elected person must absent himself for a just cause, having set forth to the said college by him for eight days before his departure a legitimate cause of absence, and having first rendered an account of what has been administered by him, we permit that he may with the counsellors substitute one suitable person, who shall have the same power, for two months only in his place, which elapsed, or even from the beginning if a longer absence be set forth, let a new election be made for the remainder of that year, in the manner and form aforesaid.

32 § 22. As for the election mentioned above, we do not wish to admit to the offices of the college those who have not attained the fourteenth year of their age, so that their voice may carry some weight in voting; nevertheless we wish each one to be called and admitted with the others, so that they may learn and have knowledge of the affairs of the house: but if there be a question concerning age, reliance shall be placed on the oath of those asserting that they have attained the fourteenth year, and the same shall apply in other cases in which a question concerning age shall arise.

33 § 23. But because what is sought by many counsellors is more easily found; we have also established and ordained that each year, once the election of the rector is completed, on the same day or the immediately following day, by the new rector himself, who shall have two votes, and other scholars, four counsellors shall be elected by means of ballots secretly placed in the hands of the rector, sufficient and prudent, of whatever nation they may be, and those shall be assumed who have received more votes, with no observance of legal form or admission of any exception, even by comparison of smaller portions. These same shall have careful attention and faithful care of the college in both spiritual and temporal matters together with the rector throughout that year, nor shall a new election be made for their absence, but only simple substitution by the rector and the remaining counsellors; provided, however, that none of these can be assumed to the same office in the two immediately following years, nor can one once elected refuse the office under penalty of deprivation of the entire year's allowance.

34 § 24. After this, an oath having first been taken by the scholars in the hands of the rector, that they will assume a faithful and suitable treasurer, on the same day or the following, one treasurer from beyond the Alps, that is, of the French nation, faithful and experienced from among the scholars, shall be elected in the same manner as the counsellors, who shall most faithfully guard and distribute the monies of the college in the manner limited below.

35 § 25. The aforesaid rector thus elected, together with the counsellors and the treasurer in the hands of the new rector before any administration, in the presence of the whole college or the greater part, touching the most holy Gospels, shall swear that they will exercise their office well and faithfully, seeking the utility, advantage and honour of the college; likewise that they will observe to the best of their ability the statutes made and to be made concerning their office, and will also render a legitimate and faithful account to the successor rector and to the college. The rector shall likewise swear that he will cause the reasonable statutes made and to be made to be inviolably observed by each one according to his ability. By this oath, however, we do not wish the rector, his office ending, to be bound to the penalty of perjury, except only as to the statutes which are known to concern his office in particular.

36 § 26. To the office of the rector thus assumed pertains the disposition of both the spiritual and temporal affairs of the college, having, when necessary, the counsel and consent of all or most of the counsellors, or even in difficult matters the consent of the whole or greater part of the college, and in cases expressed in the statutes, the consent of at least two visitors. Likewise the exaction of an oath to be taken each year after his election immediately by each scholar to obey the same rector. Likewise the exaction of an oath to be taken by each scholar newly received.

37 § 27. The form of which oath or the oath itself is as follows. Each scholar, before he is incorporated in the college, in the presence of the rector or counsellors, shall swear touching the most holy Gospels: first, to observe the present statutes issued and to be issued as reasonable; likewise to obey his rector in lawful and honest matters; likewise that he will defend and preserve to the best of his ability the rights and goods of the college; likewise that he will in good faith reveal to the rector all things which he shall know to be notably harmful to the same college; likewise that he will never give aid, counsel or favour against the college by word or deed through himself or through another under whatever pretext sought; likewise that he will in no way procure the revocation of the reasonable statutes of the college, and in these three last cases the one acting contrary shall incur the guilt of perjury by that very fact, and we wish that three Bolognese scholars to be assumed as pensioners according to the form written below be also bound to these three last chapters to be sworn and their penalty.

38 § 28. Wishing, however, to provide for the salvation of the souls of the aforesaid scholars, we do not wish them by this oath to incur the guilt of these statutes by virtue or occasion thereof, except only in cases which inflict the penalty of perjury, or unless the rector of the college expressly commanded that something be observed or done according to the form of the statutes under penalty of perjury.

39 § 29. But lest anyone be able to excuse himself on the pretext of ignorance, we command that these same statutes be read word for word twice in the year, namely on the feast of St. Michael and in Holy Week, in the presence of the whole college, and nevertheless to each person newly received the statutes shall be handed over to be read, so that he may decide what he ought to observe, and from what things also he ought to beware.

40 § 30. Moreover, we command that the aforesaid oath and the reception of each person be faithfully described by the rector in the register to be kept in the common chest, so that by this means knowledge of the time of residence of each one and of their fidelity may be had. Likewise to him it pertains to correct gravely and lightly all scholars and priests according to the quality of the excess and the power attributed to him by the force of these statutes. Likewise to the rector alone it pertains to expel, receive and punish even with wooden shackles each of the servants, unless they be among those managing the common administration: in whose reception and administration we wish the counsel of some of the college to be employed. We command that the rooms of each and all other places of the college be visited by him at least once in the month. He, if it shall seem to him expedient, shall cause the chests of each to be opened, compelling those who resist with grave penalty according to his judgment. Furthermore, the care of the college concerning the daily refectory is known to pertain to the rector himself.

Concerning precedence at table, and the giving of thanks after it.

Concerning conferences.

GREGORY

41 Wherefore we establish that at whatever time, both at dinner and at supper and at collations, at opportune times and in becoming places customarily held, both on days of fasting and on others according to the statute of the country and the custom and manner customary of the University of Bologna, the hour shall be regulated by the rector and by no other, nor shall anyone without his command or, he being absent, his who holds the first place after him at table, and his successively dare to change the limited and customary hour: those acting contrary shall for each time once use bread and water in the refectory 6 before the others then reclining: adding that on each day, a signal having been made first with a bell, and the blessing of the table having been premised, there shall be read from the Bible or the Lives of the Saints according to the custom, by the younger scholars appointed at the rector's discretion.

42 § 31. And lest there be contention among them as to who of them appears greater, we establish that at table and elsewhere this order be observed. Namely, the rector shall always hold the first place, then the graduate, if any be in the concourse, the first graduate, then scholars placed in dignity, if any be, finally individual scholars according to the time and order of reception, no partiality being shown. Saving that if anyone shall come to table with others already reclining, let him sit last at that table in which he was accustomed to sit, and nevertheless if he shall be lacking in the blessing, let him lack a course, unless a just cause excuse him. But priests shall serve or sit, as the rector shall have deemed fit to ordain. After the giving of thanks continuously, as long as we live, let the prayer, O God, shepherd of all the faithful, etc., be said, with the verse, Save thy servant; but after our death let the psalm De profundis be said, with the prayer, O God who among the apostolic, etc.

43 § 32. Finally, because the mind is sharpened by frequent exercise, we establish that, the giving of thanks being finished, on each day of summer in the morning, but in winter on those days on which ordinary lectures shall cease, there be held a conference or disputation by the canonists and legists separately in that form and order which the rector shall have deemed fit to command, according as it shall seem fitting to the disposition of the time, the custom of the university and the cases occurring: permitting that whoever wishes to exercise himself, whether within the house or without, may at suitable times and hours according to the rite of the general university read and dispute, having first, however, sought permission from the rector. He, having first taken counsel with some sufficient members of the college, may grant or deny it.

44 § 33. Moreover we establish and ordain that through the said rector, or another suitable person appointed by him and the counsellors, from the revenues and profits assigned and to be assigned to us to the said college, there shall be made each year provisions in common sufficient for the scholars, priests and servants in grain, wine, salt, oil, salted meats and the like: and besides this on each day for meats or fish and other customary items forty solidi of Bologna may be spent only: unless perchance it should happen that the number of scholars be increased, in which case the expense may be increased proportionally in this case as well, or unless the quality of the season or other evident necessity should advise more to be spent. We permit however on the days of Easter and the three days of meat before the private day that this sum may be doubled: from which sum the aforesaid college shall be provided, as it shall seem fitting for living well and honestly. But if perchance something should remain at the head of the year, we will that it be applied to the common uses and necessities of the college, provided that scholars absent even with permission receive nothing, unless it should happen that they are absent for the utility of the college alone, but the whole shall be converted to a fitting use.

45 § 34. Besides the aforesaid food, we will that to each scholar for clothing the customary cloth of the statute be given, unless in other matters, namely in the same place by scholars for two lapsed things, etc. or sleeves, one namely in the month of April, the other in the month of October by the rector to be assigned, provided that each and every scholar wear cloth in the upper garment of the same colour. But if anyone should be so presumptuous as to attempt to wear cloth of the statute in the upper garment of a different colour than others wear, by that very fact he shall be expelled for the whole year. For the remaining necessary garments we will that to each scholar by the rector or treasurer be given at fitting times and assigned, namely half at the feast of St. Michael and the other half at the feast of Easter eight gold ducats, and for candles for study two ducats. Yet so that the rector, who shall be at that time, shall have double in the wardrobe and daily portion and candles. Likewise each counsellor beyond the ordinary shall have each year four ducats, the treasurer moreover six ducats for their labour and distraction: establishing and declaring that a scholar received by the grace of the college, if he shall come before the feast of Blessed John the Baptist, shall have the wardrobe and cape, which are given to others for the time of summer, otherwise if he shall come after the aforesaid feast, let him expect the portion of winter wardrobe. Likewise we establish concerning him who shall come before the feast of Epiphany, that he may gain his winter portion, otherwise let him expect the next. Likewise the expense for the collections of doctors and beadles to be paid, as well as for the torches 7 customary in the aforesaid general Studio on certain festivities to be borne, we will be given to the scholars at their times. But whoever shall have committed fraud by not paying the collection, or by not bearing the oblation or candle, what he shall have received, he shall be compelled to restore, and nevertheless shall be gravely punished: declaring that twenty solidi to be paid to the University by each one newly coming to the Studio, let each pay from his own. But if he shall refuse, let the rector of the college pay for him immediately,

Concerning chambers and their furnishings.

Concerning the choice of chamber.

46 and let him deduct from and recover from the first payment of his wardrobe.

47 § 35. Moreover to each scholar newly received a chamber furnished in the manner of scholars with three benches, one desk with a wheel of four books and a bed with a mattress, pillow and sheet shall be assigned, and these shall be perpetually maintained at the expenses of the college. Concerning the other things let him provide for himself at his pleasure: provided that the chamber of the rector, who shall be at that time, perpetually to be appointed at the expenses of the college shall be decently furnished with all necessary and fitting things: establishing that each one of the things assigned to him shall deliver to the rector a note written in his own hand: which all things in his departure even by the subtraction of his own goods, if it shall be necessary, he shall be compelled to restore entirely.

48 § 56. And lest discord arise among the scholars concerning chambers, we establish that the graduates in their first order, then the more senior in the reception of grace, no other exception of persons being had, may gradually within three days choose the better vacant chamber, so that finally to the last received or about to be received it shall be left assigned.

49 § 37. Moreover, considering it fitting and pious that the sick should be provided with necessary things, so that they may be restored to sound health, we establish and also ordain that the rector and the college shall diligently provide themselves with a good, experienced and approved physician at the expense of the college, who shall be required to visit with the utmost diligence each of the scholars individually, especially those gravely afflicted with illness, and also the priests and servants of the said college: commanding and charging the rector that whatever the physician shall legitimately have ordered for a sick scholar shall be administered at the expense of the college with exact diligence: provided always that, if necessity requires, a good and diligent spiritual minister shall be assigned at the expense of the college and also the best room to the sick person, or, if he prefer, in a place appointed for this purpose, which shall be called an infirmary, which we now command to be established in the college itself. Concerning the physician and diligent care of the sick.

50 during the illness, and we also command all the scholars that before all else they invoke the physician of the soul and of salvation, confessing frequently and repeatedly: to which they may be compelled by the rector of the college, as is stated above: so that after spiritual health has been provided for them, they may proceed more healthily to the remedy of bodily medicine, and may be restored to sound health more quickly.

51 § 38. As for the salary of the physician, if it be necessary, of the surgeon and also of the barber-surgeon, the rector and the college shall agree with them, weighing their circumstances, according as the disposition of the times shall seem fitting, and the same shall be done concerning priests and any others whatsoever who are pensioned or salaried in the said college, provided however that the house itself shall not be burdened excessively beyond what is proper by the employment or services of such persons. Concerning the pensions of physicians and others.

52 § 39. Furthermore we establish and ordain that if any scholar should happen to depart from this world within the college, he shall be buried at his own expense, according as shall be ordered in his final disposition. But if, which God forbid, he should die without such final disposition, the same shall be done according as befits the person and as his own means allow. But if he have not at that time the means whereby a fitting expense can be made, let the rector borrow from the goods of the college, and within six months, having informed the parents of this, let him recover from them what shall have been borrowed. But if within the said time they shall not have satisfied the debt, let the rector recover up to the amount owed from the books of the scholar. But if he be so poor that he have nothing at all in goods, we will that he be buried at the expense of the college and that expense be made for the burial according as the rector and the greater part of the college shall determine: commanding all the scholars and priests that they shall be bound to accompany the funeral and carry it to the church, nor shall they be able to depart thence until it shall have been committed to ecclesiastical burial: and nevertheless on the day of his death or the following day, and also on the ninth day, we command two solemn Requiem Masses to be celebrated within the college, at which all the scholars and priests shall be bound to be present. Commanding moreover, in virtue of holy obedience, that each scholar, even if a priest, shall say two Masses for his soul and the entire office of the dead; but others who are not priests shall say forty-seven penitential psalms within a month. Concerning the funeral and burial of the dead.

53 § 40. Moreover, since among works of charity it is pious to instruct young men in good morals, and to recall those who err at least by fear of punishment from their errors; commanding we enjoin upon all the said scholars and priests that they humbly obey their rector in things lawful and honest, nor shall they inflict upon him or upon one another even verbal annoyances, and those acting contrary shall be punished severely, after first making satisfaction to the injured party.

54 § 41. But if any scholar shall lay violent hands upon a scholar or priest or a servant administering the common administration in his office, or otherwise, by reason of his office, for the first time he shall be fed on bread and water that day, for the second time he shall be fed similarly for two days: but if he fall into the same offense a third time, by the rector and counselors he shall be expelled for a time, according to the nature of the excess, from the company of others from the goods of the college, or otherwise meanwhile by the rector's command under certain penalties. Concerning obedience to the rector to be rendered.

55 shall be compelled to make satisfaction from his own means; but if priests shall lay violent hands upon a scholar or upon one another, they may be immediately expelled, or otherwise punished, according as it shall seem fitting to the rector and counselors.

56 § 42. Furthermore we expressly forbid the scholars the game of dice. Likewise we expressly forbid that any scholar in any case presume to lodge or spend the night in public or private with women, or in winter time to take supper at night without express permission of the rector outside the house, or within the town, especially at night, in a common or private place without first having obtained the rector's permission, as is aforesaid, we expressly forbid. Likewise no one shall presume to occupy a room. Certain things are forbidden to the scholars.

57 assigned to him or any other place in some part of it without the consent of the rector to perforate or alter: whoever shall attempt to do the contrary, shall be deprived of his place in the college, or otherwise punished at the discretion of the rector. Furthermore, in no way shall a feast of the king be held within the house even with the rector's permission, nor shall anyone in his room, at any time by night or by day, gather scholars for dancing, singing or playing any instruments whatsoever, unless this should happen to be done for the sake of recreation, for example, for a newly licensed or newly promoted scholar or for a sick companion, and then only with the permission of the rector; by this, however, we do not forbid that individual scholars may use their instruments moderately without prejudice or hindrance to anyone. Furthermore, we prohibit that anyone dine or sup in his room, unless illness prevents it, unless he has first obtained permission from the rector. Likewise, no one may enter the pantry or kitchen for the purpose of disturbing the officials, or otherwise, unless a just cause requires it: those acting contrary shall be punished at the discretion of the rector. Adding that outside the common dining hall nothing of the common provisions shall be served to anyone, except as the rector shall see fit to limit, or unless some legitimate cause should require otherwise.

58 § 43. Furthermore, we command the rector that he diligently order the common door to be closed at a fitting hour, namely at the third bell of the night, and to be opened in the morning at the bell of day and not before, keeping the keys continuously with himself at night, nor shall anyone of whatever status, after the door is closed, be able to enter the house without the express command of the rector. But nevertheless, he whom a just cause has not excused to the knowledge of the rector shall do penance on the following day on bread and water once, as above. But if anyone, especially at night, should enter or leave the house through a window or another suspicious place, he shall be deprived for a month of every comfort and favor of the college; which if he should incur a second time, he shall be deprived similarly for six months; but if he should transgress a third time, he shall be punished more severely.

59 BULLARIUM ROMANUM

60 § 44. Moreover, lest audacity grow without punishment for violence committed, and lest anything be found that would bring a stain upon the glory of scholastic honesty, we establish and irrevocably ordain that scholars may be excluded from the fellowship of the college for the crimes explained below, this form being fully observed. For he against whom infamy weighs shall be first admonished by the rector and others prudent in the college, and a penalty shall be imposed upon him according to the exigency of his deserts: which if he should attempt the same thing a second time, the whole college being called or the greater part and one of the visitors, and after diligent deliberation whether he should be tolerated or expelled, if it shall have been deliberated that he ought to be, he shall be expelled, and deprived of the favor of the college perpetually or for a time. But if he should transgress a third time, because against such a one frequently offending there is a strong presumption of incorrigibility, lest the diseased sheep infect the whole flock, by the rector and two visitors and also the whole college he shall be expelled in fact without any mercy, nor shall he be tolerated there or received anew thereafter, once expelled for the crimes written below.

61 § 45. But the crimes, on account of which expulsion may be carried out, are these: blasphemy of God and the glorious Virgin; vituperative and frequent laying of hands with a sword or equivalent instrument upon a scholar, priest or servant performing office in common service. Which if it shall have been enormous, for the first time he shall be expelled. Likewise atrocious injuries even verbal inflicted against the rector, yet so that if anyone shall have struck him violently, for the first time he shall be expelled, and in no way shall he be able to be reconciled. Likewise the holding of offensive and defensive weapons within the house. Likewise the breaking of any chest or door within the college with intent to harm. Likewise theft of things common to the college, up to the value of thirty solidi; likewise theft of private things up to the value of three pounds Bolognese. In these two cases, however, if even up to one solido someone shall have taken by himself or through another, according to the greater and lesser quantity he shall be punished gravely and more gravely, satisfaction always being made first. Likewise the defloration of sacred virgins and virgins, and in this case for the first time. Likewise adultery. Likewise the keeping of a concubine outside the house, likewise the introduction of any suspicious woman within the house: but he who shall have introduced a woman not suspicious for any reason shall be perjured by that very fact and nevertheless shall be punished gravely. Likewise sowing sedition or discord in the college, by which scandal or conspiracy should come about. Likewise scandal brought into the college with the breaking of doors or dissipation of goods for daily sustenance.

62 §46. Moreover, in order that occasion be taken away from individual scholars to withdraw from the said college or to evade the discipline of any superior by similar punishment, whereby the course of due perfection might be hindered or even retarded, we will that if any of the scholars, even if they be graduates, undertake offices or procuratorships of any kind by which they might be drawn away from study, which we leave to the judgment of the rector and counsellors to determine, unless, being admonished as aforesaid, they altogether cease from them, they shall by that very fact be expelled. And we have established the same concerning him who, without obtaining permission from the rector, shall remain outside the city or college for six days, and the same concerning him who, even with permission obtained, being absent for his own affairs, shall not return within four months, a just cause ceasing, concerning which he shall be bound to give proof to the rector and counsellors: unless perhaps he had been sent for the college's business to the Curia or elsewhere: adding that no scholar shall presume to absent himself for a natural day without the rector's permission; whoever acts contrary to this shall do penance on the morrow at the hour of dinner with bread and water.

63 § 47. In the cases aforesaid, however, the rector with the counsellors and two visitors of the faculties may now by our authority proceed to expulsion simply and plainly, without noise and judicial form, all appeal being removed; and the rector himself with the counsellors may, beyond these cases, as their misdeeds shall have required, punish and condemn them in like manner, and also concerning their morals and life, and concerning the daily governance of the said house dispose, and do other things which he shall see to be expedient for the preservation of the college itself, provided that the present ordinance of ours be not violated: provided however that whenever expulsion of any scholar in a case not expressly stated shall be treated of hereafter, or concerning any difficult matter, which indeed whether it be difficult or not, the rector and counsellors and four scholars assumed by them shall discuss and determine, the rector shall be bound to convoke and give notice two days beforehand to the two overseers and the whole college, and by the consent of them or the greater part of the college, and not otherwise, shall that be carried out. Adding that all scholars, when summoned by the rector for conferring degrees, licensing, accompanying the dead, or otherwise for reasonable cause, may follow him: but the disobedient shall be punished at his discretion.

64 § 48. But because concerning the administration of temporal goods, careful attention must be given lest through the insolence or injury of a president something of the college's goods be lost, we decree that through the rector and the whole college, at their expense, there shall be assumed one or more prudent and discreet men, useful and experienced, who in the presence of the college, having first taken an oath upon the most holy Gospels that they will faithfully exercise their office, shall assign to the college in their entirety all and singular fruits and revenues consisting in whatever goods or things, and shall render faithful and legitimate account; having power to apprehend whatever goods, to govern, to receive, to visit possessions frequently and repeatedly, to make provisions at the mandate of the rector at suitable times and to give acquittance of receipts, and likewise with the consent of the rector and college to make whatever acts and contracts, both temporal and perpetual, to celebrate and exercise them in judgment and outside with full power. But at the end of the year or more frequently, if it shall seem expedient to the rector and the greater part of the scholars, they shall be bound to render full account and computation of all things received, done, given and administered. If such assumed men shall seem useful and expedient to the rector and college, they may be tolerated longer in said office, or if the rector and college prefer, they may at their pleasure substitute others in their place, and also the priests of the said college, one or more, may join them to them whenever it shall be expedient. We will, however, that scholars, lest the various business committed to them be able to distract them from the fruit of study, wishing to make progress, if perchance urgent necessity presses, and then by the express mandate of the rector and not otherwise, be involved in this. We command, however, that each scholar within a year from the day of his reception shall be bound to visit all possessions and individual places applied to the college, whether they be within the city or without, so that each of the scholars may have full knowledge of them. Which indeed the procurator of the college shall be bound faithfully to make known to individuals in the manner aforesaid. § 49. But the goods or revenues, as is transmitted, collected and stored within or outside the college, let him guard, preserve and expend, and according to the disposition of the time let him dispense for the necessities of the college to him whom the rector and college shall have deemed fit to commit. Who indeed can alienate nothing whatsoever unless by the consent of the rector and the greater part of the college, unless they were goods which could not be preserved by keeping, and then he might do this by the license of the rector. If they exist in monies, we will that their custody be consigned to the treasurer, to whose office it pertains to guard said monies carefully in the manner written below, and to describe faithfully in a book of accounts the sum, expense and correct reckoning; who also on individual days or weeks, according to the counsel of the rector and the form of the statutes, shall distribute them for the daily uses of the college, and also whenever he shall have been required, shall render full and faithful account: and he shall be bound to sufficiently reckon and exhibit in the presence of the rector and counsellors the quantity remaining or exceeding of all monies to be placed in the common chest.

65 § 50. For the custody and preservation of which monies and other goods of the college we constitute and ordain that within the college, in some safe place, one chest or box shall be retained, and shall be locked with four different keys, of which let the rector hold one, the treasurer another, a third one of the counsellors, and the fourth Bernardus Guidonus, so long as he shall be there, and, he being absent, some faithful scholar deputed for this, hold. In which indeed chest or box on one side shall be all the monies of the college, forty ducats only remaining with the treasurer for daily uses. Likewise the common seal, with which nothing may be sealed unless by the consent of the whole or greater part of the college, and the writing having been read first in common, in which, whenever it shall be expedient, the rector in the name of the college shall subscribe himself. Likewise therein all privileges and originals of these statutes and also all instruments and other transcribed rights of the said college, this form being observed, shall be faithfully preserved. The rector indeed, at the expense of the college, lest it happen that in any respect his rights perish, shall cause all privileges and public and authentic instruments to be transcribed with the subscription and authority of two notaries, and from the transcript let there be made two authentic copies, of which one shall remain with the rector himself, to be exhibited in judgment and outside, whenever it shall be opportune; the other shall remain perpetually in said chest. But the originals of all the aforesaid shall be placed in custody in the sacristy of the Friars Preachers or Minors or elsewhere, according as the rector and college shall have deemed it to be ordained, and nevertheless all the aforesaid without authentication in one book or in diverse places. Each year an inventory of the things of the college is to be made.

66 Each year an account of things administered is to be rendered by the rector and the other officials.

67 of guilty officials shall be transcribed. Which indeed book or books shall be kept in the common library, under lock and key.

68 § 51. Moreover, by the rector and counsellors each year let an inventory be made by public hand written of all goods and things both movable and immovable, namely possessions, territories and whatever other things applied to the said college. Which indeed shall be enclosed in the said common chest, and also a copy shall be transcribed in a parchment book, so that thus, concerning the goods of the college present and future to be diligently preserved, notice may be able to be given.

69 § 52. But, in order that the aforesaid goods may be able to be changed and preserved from good to better, we decree that in every year, within eight days after the creation of a new rector, counsellors and treasurer, the old rector and treasurer with the old counsellors shall render their written account to the new rector and treasurer, with the new counsellors present and three scholars, whom the whole college shall have deemed fit to elect. Which indeed written account or book of accounts, so that by it the quantity of annual expenses of the college may be clear in the future, we wish to be reserved in the common chest with exact diligence. After this moreover immediately to the new officials by the old ones with a public instrument all monies, which have remained over, and all the things described above placed in the common chest, as well as the inventory of all goods with the keys of the said chest upon the aforesaid matters shall be manually and entirely consigned: and we command the aforesaid inventory to be renewed in the person of the new officials, with all things added in the same which shall have been newly acquired, and with those deleted which by age or otherwise shall have been legitimately consumed.

70 § 53. Finally, sufficient and legitimate reason having been exhibited, and faithful and complete assignment having been made, as is aforesaid, as well as a report having been made, at least summarily, in the presence of the whole college or the greater part of it, concerning the surplus, the officials cannot absolve the old ones, and give letters of acquittance concerning all things done and administered by the same, and if, which God forbid, the aforesaid old officials shall have been found guilty in anything, debtors or liable, by withholding of books or other goods and other legal remedies, before that absolution, they shall be compelled to make satisfaction and keep the college unharmed through the new rector: and then at length absolved, in no way shall they be assumed to any office further in the said college.

71 § 54. Furthermore, concerning the useful, careful and diligent care to be applied around books in the cupboard or common library to be appointed by us, we decree and command all books to be placed in the said library, of whatever faculty or value they may be, under good keys to be chained in perpetual times, nor from thence on any occasion or pretext, even for the briefest time, by anyone or any persons or for any persons, of whatever condition, status or eminence they may be, by whatever colour sought, may be able to be extracted or unchained, unless only for binding or repairing cause, or also with a more useful book to be exchanged, and then let this be done by the consent of the rector and the whole college of two parts of it. Provided that a book bound or repaired, or, as is aforesaid, exchanged with a more useful one, all fraud ceasing, as quickly as it can be done, ought to be placed back under lock in its former place. Those acting contrary and consenting, and knowing and not revealing, for the first time shall be expelled perpetually from the fellowship of the college itself, and nevertheless the damage, if any shall have been, by subtraction of all goods and other legal remedies they shall be bound to make good: decreeing also that any contract whatsoever of alienation of any common book celebrated, apart from the case of exchange aforesaid, shall be of no force: we decree moreover that the door of the library shall have two different keys, one strong with strong lock, the other fitting: let the scholars guard the first singly in turn each month faithfully. Concerning the library, and the custody of books.

72 and diligently, according as the rector and college shall deem them to be appointed: to whose custody it shall pertain on each day, at suitable and appointed hours, to open the library and close it, and once a day diligently to investigate, and if expedient, to report to the rector whether concerning the books or their fastenings there be anything new, which may require repair. Let each scholar, however, have another key unlike the others, by which, at suitable and opportune times, free access to the library shall be open to them. Provided nevertheless that no outsider shall enter there, unless in the presence of one or more scholars of the college: which all things, in order that they may be effectively observed, and that more secure custody may be employed, we command that all scholars, before they receive the key from the hands of the rector, shall swear in his hands, specially with the holy Gospels touched, concerning all indemnity and faithful custody to be employed in preserving the library and each of its books: finally commanding the priests and other servants that, especially in the absence of scholars, they shall diligently watch over the library and other goods of the house to be preserved, and expressly forbidding that the rector even with the college be able to lend the vestments or ornaments of the said college to any person, or to deliver them on loan or in any other case or manner, under penalty of perjury.

73 § 55. Moreover, unwilling that the fruit of the generous faculties of canonical and civil science, as is customary in progress, be retarded on account of reprobate acts or negligence of the president, but rather that, the sleep of negligence shaken off and careful diligence interposed, the aforesaid scholars, with divine grace cooperating with them, may be able in their times to produce the desired fruits, for the continuous reformation of the aforesaid college, three visitors, namely the bishop and archdeacon of Bologna and the senior doctor in the reading, not of age, in canon law reading at Bologna, we have deemed from now to be appointed to the said college for perpetual times, beseeching them in the Lord that at least once in every year, in the month of September, or more often, if it should happen that they be summoned by the greater part of the college, coming personally to the same college, they may favorably supply the negligence, unskilfulness, negligence or even incompetence of the rector, and may correct, punish and condemn the same and unruly, wanton and vagrant scholars, without noise and form of judgment, according to their deserts: and likewise to subject each scholar, if expedient, once in a year to examination, and the unteachable and wholly unfit for acquiring the fruit of knowledge, by the consent of the rector and counsellors, lest the place of the fit be occupied in vain, may expel, the form limited in the title De expulsione being observed: and finally, concerning the life, morals and daily regime of the same house to be reformed, supplied and other things to be done, which for the utility, convenience and preservation of the said college, provided they do not contradict the present our ordinance, we grant full faculty. But if they or any of them should be unwilling or unable, hindered by other occupations, to attend to this visitation, in place of the bishop of Bologna, his vicar in spiritual matters; in place of the archdeacon, the rector of the university beyond the mountains, namely of Gaul; in place of the doctor reading in canon law, the senior in civil law reading, we will to be substituted. Who indeed in like manner shall be bound to visit, and faithfully to supply the absence or will of the aforesaid, for that time. Moreover we command this to be done without expense and burden to the college: provided nevertheless that the same visitors be received honorably, and an honorable collation or meal, according to the custom of the country, be ministered to them.

74 § 56. Furthermore, in order that the said college, to which we are also greatly affected for its increase, may prosper in successive times from good to better, special protectors or defenders, namely the bishop of Ostia, vice-chancellor of Rome, and one or two other cardinals, if any

75 From the college every year three scholars from Binooium are to be provided with sustenance. If they are of our lineage or of the diocese of Reims, we have deemed it fitting to appoint them successively to the college, placing them in our stead, ourselves, according to God's good pleasure, being withdrawn from the present light, as regards the protection and defense of the college, by the tenor of these presents, perpetually substituting them: and granting to the same, in all and singular things which shall be necessary, suitable and opportune for the reformation and preservation of the state of the college itself and of individuals in successive times, full power. And earnestly beseeching the same, and in the bowels of the mercy of Jesus Christ entreating that, according to the confidence and full hope which we have in them, after our death, as is aforesaid, they may efficaciously foster, protect and maintain the aforesaid college and all scholars in their rights, justices and the promotion of their affairs, out of regard for piety, and may so diligently watch over the protection of the college itself and attend with further affections of charity that the house itself may grow in your successes and prosper happily in the Lord: so that, through this and other works of piety, they may obtain so great an eternal reward.

76 § 57. But wishing to pursue our city of Bologna, in which the aforesaid college has been founded, with special favor and benevolence, and, so that its magistrates and other citizens may protect, maintain and defend the college itself, we have established and also ordain that the aforesaid magistrates, who shall be in office from time to time, from triennium to triennium, for greater remembrance, from the month of September, may be able to elect three poor scholars, docile, citizens of Bologna, studying in canon law, whom they may present to the rector of the said college, to each of whom re-
