LETTERE APOSTOLICHE
SEPTIMO IAM*
Abbracci casti, affetti dolci, bacio santo, dolce conversazione, riso modesto, aspetto gioioso, occhio semplice, animo supplice, lingua placida, risposta mite, medesimo proposito, pronto obbedienza e mano instancabile.

SEPTIMO IAM*
In hac igitur saecularium solemnium celebritate, cum Ordinis a Francisco divinitus fundati, magna in rem christianam promerita verbis Decessorum Illustravimus, videtur Nobis, palam facere et mansuro probare testimonio plenum paternae caritatis animum, quo tres familias unde Franciscalium Ordo princeps constant, sine ullo discrimine, complectimur.
12 II.
18 VIII.
19 IX.
Quantus in eis piae societatis vigebat amor! Quid illud? Casti amplexus, suaves affectus, osculum sanctum, dulce colloquium, risus modestus, aspectus iucundus, oculus simplex, animus supplex, lingua placabilis, responsio moliis, idem propositum, promptum obsequium et indefessa manus.

APOSTOLIC LETTERS
SEPTIMO IAM*
CERTAIN MATTERS CONCERNING THE FIRST ORDER OF ST. FRANCIS ARE ESTABLISHED IN PERPETUITY
1 Now for seven full centuries, since the beginnings of the Franciscan Order were happily established, it is indeed right that all who acknowledge Francis as their founder and father celebrate this joyful event, and with manifold expressions of grateful piety desire to recall the memory of that most holy man and his immortal benefits bestowed upon all. Yet although there is a particular reason why the Minorites should observe this solemn celebration before others, it is fitting that all should share in this solemnity and joy, whosoever rightly esteem the Franciscan Institutes, and it is especially fitting for this Apostolic See; for these Institutes have always flourished through its singular favour and grace, and through great esteem and judgment. Almost innumerable and most excellent monuments of this fact exist in the acts of Our Predecessors. In the beginning, Gregory IX, who had cultivated the friendship of the Seraphic Patriarch with care, and as a cardinal had been the first to act as a legitimate Franciscan patron, said: "The holy planting of the Order of Friars Minor under blessed Francis of good memory began, and marvellously increased, bearing through the grace of Jesus Christ the flowers of holy conversation far and wide, and fragrances"1. And he, when pressed by a grave burden of anxieties and cares, writing thus to the sons of Francis gathered in general assembly, declared how much he trusted in the patronage of the blessed Father and in the prayers of his sons: "Amid innumerable pressures and infinite straits, which we are more able to bear than to recount, resuming matter of consolation and joy, we render such thanks and praises as we can to the Redeemer who, preventing blessed Francis, Our Father and yours, yet living in the flesh, with signal gifts of grace, now glorifies him reigning with Him in such great glory, that We, inflamed more and more in the pious love of that Saint, delight with all our affections in his praises; hoping that those whom he, living outside the world with his whole mind in the world, loved, may now embrace us more clearly, since he beholds Him who is true charity more nearly, and may not cease to intercede for us; and you, whom he, regenerating in Christ, left as heirs in the abundance of the riches of the highest poverty, bearing in the depths of charity's bowels, we ardently aspire to the advancement of your Order, with the hope set before us that through the suffrage of your prayers, the sufferings of our patience will bring us salvation"2.
2 The same Pontiff, in commending the Franciscan family to Bishops (which Honorius III had already done while Francis was still living), used these most honourable words: "Since iniquity hath abounded and the charity of many hath grown cold, behold the Lord hath raised up the Order of Our beloved sons the Friars Minor, who, seeking not their own things but the things of Jesus Christ, have dedicated themselves to the evangelization of the word of God in the abjection of voluntary poverty, both against heresies to be routed and against other deadly plagues to be extirpated"3.
3 With Gregory this accords perfectly, Nicholas III: "This is the mild and docile Religion of the Friars Minor, rooted in poverty and humility through that blessed confessor of Christ, Francis, who, springing from that true seed, scattered that seed through the Rule to his sons, whom he begat to himself and to God through his ministry in the observance of the Gospel. These are the sons who, as Jacob taught, received the eternal Word, God's Son, implanted in human nature in the garden of the virgin's womb, mighty to save souls in meekness. These are the professors of that holy Rule, which is founded on evangelical utterance, strengthened by the example of Christ's life, confirmed by the words and deeds of the Apostles, founders of the Church militant. This is before God and the Father a pure and unspotted Religion, which, descending from the Father of lights through His Son, delivered exemplarily and verbally to the Apostles, and finally inspired through the Holy Spirit to blessed Francis and those following him, contains in itself as it were the whole testimony of the Trinity. This is that Religion to which, as Paul attests, no one henceforth ought to be troublesome, which Christ confirmed with the stigmata of His passion, wishing to mark its founder notably with the signs of His passion"4.
4 Likewise Clement V, who accommodates that passage from Ecclesiasticus XXIV, 42, I came out of the mouth of the most High, I said: I will water my garden of plants, thus to the praise of the Seraphic Order: "This garden indeed is the holy Religion of the Friars Minor, which, firmly enclosed on all sides by the walls of regular observance, content within itself alone to God, is adorned abundantly with new plantings of sons. Coming to this garden the beloved Son of God gathers the myrrh of mortifying penance with spices, which with marvellous sweetness spread around all the fragrance of sanctity drawing to itself. This is that heavenly form of life and rule, which that eminent confessor of Christ, holy Francis, described and taught to his sons to be observed both by word and by example"5.
5 Thus also Leo X extols this Order: "This is that sacred Religion of the Friars Minor, which, with the verdant foliage of ceremonies flourishing, through apostolic men, as though extended through branches from sea to sea, and from the river even to the ends of the earth, has watered the mountains with the wine of wisdom and knowledge, and has filled the earth. This is the holy and immaculate Religion, in which, through a mirror without blemish, the presence of the Redeemer is contemplated, the form of the life of Christ and the Apostles is beheld, through which the norm of the first founders of the Church is brought before the eyes of the Christian people; which finally represents nothing save the divine and angelic, replete with all perfection, and conformable to nothing save Christ, so that not undeservedly it is called His own."6
6 Similarly Sixtus V: "To kindle anew Our hearts, O Father of mercies and of lights, Thou didst send Thy servant the blessed Francis, and didst anticipate him with so great an abundance of the sweetness of Thy blessing, that Thou didst not only make him renowned for the prerogatives and merits of virtues, but didst also renew in his very flesh the sacred Stigmata of Christ, and didst manifold demonstrate in him the wondrous mysteries of the Cross, the bonds and poverty, so vividly that truly Christ could say to Francis: 'Thou hast searched out my path and my cord, and all my ways thou hast foreseen.' Whence it came to pass that by the merits of the said blessed Francis, the most holy mother Church, enlarged by the offspring of new progeny, and enriched by the merits, virtues, examples and miracles of many of his Institute, and moreover adorned with very many Bishops, Archbishops, Patriarchs, Cardinals, Kings and Supreme Pontiffs, cannot but be inclined to follow the footsteps of his devotion and imitation."7
7 Nor indeed has the preaching of the Apostolic See ever ceased concerning Francis and his institutes. From the monuments of more recent memory, however, those Letters of Gregory XVI are not to be passed over, in which he writes concerning the Church of Mary of the Angels at Assisi: "In that temple, the principal glory of Umbria and indeed of the whole West, the holy Francis of Assisi, daily making greater progress in eminent sanctity, and receiving the wondrous charisms of almighty God, constantly fixed in meditation on heavenly things, impelled by divine inspiration, laid the foundations of his Order, and was deemed worthy by the peaceful countenance of our divine Redeemer and His most holy Mother of most sweet converse."8 — But especially worthy of commemoration are the acts of Leo XIII; who indeed in his Encyclical Letters Auspicato, wherein he pursues the praises of the Father of Assisi in grand and weighty discourse, has these words: "These wonders of things, to be celebrated rather by angelic than by human proclamation, sufficiently demonstrate how great that Man was, and how worthy he was whom God destined to recall his equals to Christian morals. Truly to the church of Damian a voice greater than human was heard by Francis: 'Repair my house which is falling.' Nor is there less cause for admiration in the form divinely offered to Innocent III, when he seemed to see the walls of the Lateran Basilica inclined, with Francis sustaining them upon his shoulders. The force and meaning of these portents is clear: namely, that it was signified that Francis would be no light support and pillar of Christian commonwealth in those times. In truth, without delay he set about it. Those twelve, who had first devoted themselves to his discipline, proved to be as a small seed, which by the second will of God, and under the auspices of the Supreme Pontiff, was seen to grow swiftly into a most abundant harvest."
8 — The same in the Constitution Misericors Dei Filius: "Now indeed in preserving the precepts of Jesus Christ the Franciscan Institutes are wholly engaged; for the most holy founder looked to nothing else than that in them, as in a certain arena, Christian life might be more diligently exercised. Truly the two prior Franciscan Orders, informed with the disciplines of great virtues, pursue something more perfect and more divine." — And in the Constitution Felicitate quadam: "Remarkable indeed and worthy of the benevolence and zeal of the Apostolic See is that which is called the family of the Friars Minor, the frequent and enduring offspring of blessed Francis. His Parent commanded him to observe religiously in perpetuity all those laws and precepts of living which he himself had given; nor did He command in vain. Scarcely indeed is there any society of men which has produced so many rigid guardians of virtue, or so many heralds of the Christian name, martyrs for Christ, citizens of heaven, or in which there has been so great a harvest of men who by those arts in which those who excel are judged to surpass others, have illustrated and aided both the Christian cause and the civil order itself."
9 Now indeed We, who, as Leo himself confirmed of himself9, have been accustomed from youth to admire Francis of Assisi and to venerate him with special reverence, and we glory in being enrolled in the Franciscan family, certainly esteem the great Work of the blessed Father no less than any of Our Predecessors, nor do We regard it otherwise than they did, as worthy of Our particular study. In this celebration of the secular solemnities, since We have illustrated by the words of Our Predecessors the great merits of the Order divinely founded by Francis toward Christian affairs, it seems to Us to make plain and to prove with lasting testimony the full spirit of paternal charity with which We embrace the three families from which the principal Franciscan Order consists, without any discrimination. Certainly it is pleasing, by the mobility of human genius and the varied change of times, that Franciscan members gradually departed from the most harmonious community of life and sustenance into diverse disciplines thereafter. «The supreme poverty of all things, which the most holy Man loved uniquely throughout his entire life, some of his followers desired in the same manner, some, to whom it seemed more burdensome, preferred it moderately tempered. Wherefore by the withdrawal of some from others, hence the Observants arose, thence the Conventuals. Similarly, rigid innocence and lofty and magnificent virtues, by which he shone forth to the point of wonder, some indeed wished to imitate courageously and strictly, others more gently and remissly. From the former of these brothers the family of the Capuchins was formed, a threefold division followed»10.
10 —But that legitimate variety of disciplines should be no obstacle to those who were enrolled in any of them defending themselves as true offspring of Francis by right, has been sanctioned many times by the authority of the Apostolic See. Thus Leo X: «That the same Brethren of the Observance and Reformed, true and undoubted Brethren of the Order of Blessed Francis and observers of his Rule, have always been, and, by divine grace favoring, shall be in the future, without any interruption or division, from the time the Rule was promulgated by Blessed Francis until the present, and under the Rule of Blessed Francis himself have served, and also at present serve; and thus in all things to be held and observed and decided We decree and command»11. And Clement VIII protects the Brethren Minor of Stricter Observance called Reformed from the injuries of certain ones. And he declares the same Reformed to be true sons and undoubted Brethren of the Order of Saint Francis12. Concerning the Capuchins, Paul V13, Urban VIII14, Clement XII15, declare them to be truly Brethren Minor, and their origin or beginning to be reckoned really and with effect from the time of the primitive and original institution of the Seraphic Rule, whose observance the Brethren Capuchins have always continued without any interruption, and the same «to have been and to be from the true and never interrupted line, and true and undoubted Brethren of the Order of Saint Francis and observers of his Rule, and to have served under the Rule of Blessed Francis and also at present to serve they establish. — We ourselves affirming these same things, will and command that as many as there are of the three disciplines of the Franciscan Order of the first rank, all not only brothers but twin brethren, all born of the same Francis and trained in the same teachings of religious life to the one Rule of his, be regarded both among themselves and by all. Therefore, so that the rights of this fraternal charity, which ought to reign alone among the sons of the most blessed Father, may be better protected and preserved, and therefore so that the Franciscan Institutes may bear more abundant fruits for holy Church, We decree these things concerning the common affairs of the whole Minorite people to be valid in perpetuity, as certain principles and heads, and by the fullness of Apostolic power We command them to be holily observed by all, which are written below:
11 I. The first Order of Saint Francis, if one considers the Father lawgiver by whom it was founded, if the Rule by which it is used, is one religious family: if, however, one considers the manner of governance and the Constitutions by which, by the prescription of the Apostolic See, it is governed, it is divided into three families: of which one is the Brethren Minor; which formerly was called by Regular Observance, and which, when it was distinguished into four sodalities, that is into Observants, Reformed, Alcantarines, Recollects, was recalled to unity by Leo XIII of happy memory, with the single name of Order of Brethren Minor imposed; another is the Brethren Minor who are called Conventuals; the third is Brethren Minor who are called Capuchins.
12 II. The Family, or Order, of the Friars Minor, which was formerly called by the name of the Regular Observance, after it was brought together into one by Leo XIII from various sodalities, if it be called the Leonine Union, is rightly so called. It indeed "by concession of the Apostolic See takes precedence in place and honor" over the other Franciscan families, and its members "retain the true name of Friars Minor received from Leo X", as Our Predecessor says in the Constitution Felicitate quadam: yet nevertheless this name is not to be interpreted in such a way as if in that family alone the whole Order of Minors is seen to consist. It is evident that such an interpretation is far from the truth, and is very injurious to not a few other Minorities. Whenever therefore the appellation Order of Friars Minor without any addition would have ambiguity, it is necessary that this family of which we speak, and its Superiors and members, especially in public acts, be designated and called by their own peculiar distinguishing mark, namely the Order of Friars Minor of the Leonine Union, and the Superiors and members the Order of Friars Minor of the Leonine Union, we decree and ordain.
13 III. The title Minister General of the whole Order of Minors, by which title the Minister General of that same family which we call of the Leonine Union makes use, is of mere honor, and denotes nothing of jurisdiction or power over the other Franciscan families.
14 IV. The names Capuchin, Conventual, Leonine Union distinguish Franciscans not by noting that which pertains to the very nature and character of a Friar Minor: for this consists in the Seraphic Rule which is one and the same among all Franciscans of the First Order: but by designating those things which in this kind happen to the nature; and these are the Constitutions, which each family follows as its own and peculiar in observing the Rule, by the prescription of the Apostolic See.
15 V. The Minister General of the Friars Minor of the Leonine Union, likewise by concession of the Apostolic See, in all assemblies and public sacred functions, wherever the law of precedence of place obtains, precedes the Minister General of the Conventuals, and both precede the Minister General of the Capuchins. But what place the families from individual convents hold among themselves in processions and other public sacred functions has been defined by many decrees of the Apostolic See.
16 VI. The Ministers General of the three Franciscan families are all equal both in dignity and power, as Vicars and indeed true successors of St. Francis, namely each for his own family, and also for the members of the Second and Third Order, as many as are subject to his jurisdiction or aggregated to his family; all these derive the perpetual succession of their predecessors from the Seraphic Father himself by right.
17 VII. The three families of the Order of Minors are, as it were, so many branches of a most noble tree, whose root and trunk is Francis. Therefore the Friars Minor both of the Leonine Union, and Conventuals, and Capuchins by equal and full right are true Franciscans, and are true Friars Minor and ought to be held as such. And they are not to be called some older than others, since the true origin of them all is to be traced back to the very instituted Seraphic Rule, whose observance all have continued without any interruption.
18 VIII. That temple of the Franciscans is to be held as most sacred in which the blessed Father himself, the lawgiver, rests; it scarcely needs to be said: which building for this reason was early declared by Gregory IX the Head and Mother of the Seraphic Order, and by Benedict XIV through the Letter Fidelis was further raised to the dignity of a Patriarchal Basilica and Papal Chapel. — But the building of St. Mary of the Angels of Portiuncula is also of distinguished dignity; concerning which Benedict XIII said: "Let no one so extol and exalt in words or writings the Basilica of blessed Francis of the city of Assisi, where his sacred body rests, which has been enriched by various privileges by the Roman Pontiffs, Our predecessors, above the other churches of the same Order, that due honor and reverence be denied to the Basilica of Blessed Mary of Portiuncula outside the walls of the same city, in which it is established that the Seraphic Father began his Institution; we command and enjoin that both Basilicas, though for different reasons, Blessed Mary indeed on account of the beginnings of the Order, that of Assisi truly on account of the sacred body of the most holy Founder, as Mother Orders be recognized and observed by all Friars Minor"17. We moreover ourselves in Letters recently given, Omnipotens ac misericors Dominus, have called the Basilica of Mary of the Angels the Mother and Head of the Order of Minors, and have honored it with the title of Patriarchal Basilica and Papal Chapel. Wherefore both Basilicas, as a common patrimony, ought to be protected by all who glory in the name of the children of Francis: let all celebrate both as a paternal home with confidence and joy, and there, refreshed by all the offices of fraternal charity, may they feel, how good and how pleasant it is for brethren to dwell together in unity.16
19 IX. The Ministers General of the threefold family of Minors possess equal power over the Third Order. Tertiaries therefore who obey the Minister General of one family enjoy the same privileges and indulgences as those who are subject to the two others. Nor shall it be permitted that those enrolled in the Third Order be called Tertiaries or members of the Leonine Union, or Conventuals or Capuchins, but they ought to be called Tertiaries of St. Francis or Franciscans, without any other appellation.
20 X. The honors by which one of the three families of Minors is distinguished; the praises with which it is adorned by the Apostolic See; the holy, blessed, and venerable men by whom it is illustrated, although they belong especially to that family, nevertheless by right of fraternity pertain also to the others as common ornaments. But the ancient glories of the Order, arising from deeds accomplished or from holy men before the canonical division made by Leo X of the Order itself18, are not to be considered the special possession of any one of the three families, but are the common property of all.
21 These things which We have prescribed, whether by declaring, defining, or commanding, We believe can greatly serve to bind together the hearts of all Franciscans among themselves. Furthermore, "He who speaks peace to His people and to His saints has designated by His teachings and examples to His disciples that certain power and means of turning aside contention, exhorting them that whoever would be greatest among them should become as the least, and therefore should strive not for preeminence and primacy, but for the humility of serving and submitting to others. These teachings blessed Francis, the founder of the Seraphic Order, himself wonderfully embraced and expressed, and wished to be the foundation for preserving peace among his followers"19. Let all therefore, hearkening to the word of the Father who gives the law, obey thus commanding: "Let them not quarrel, nor contend in words, nor judge others; but let them be meek, peaceful, modest, gentle, humble, speaking honestly to all, as is fitting"20.
22 And "let them beware of all pride, vainglory, and envy"21. Those who, according to the norms of their Constitutions, in the very worship of the House of God and in the performance of sacred rites and in the use of human things follow rigorous poverty, should not despise others; concerning whom Leo X said: "We declare and decree that you are custodians only and not possessors of these things, and therefore, without stain or violation of your profession, when it is fitting, according to the solemnity of feasts and more solemn offices and more becoming vestments, to honor divine Majesty and to enhance its worship, and to use and enjoy freely and lawfully other things which both the Order and the Friars use, whether in common or individually"22. But if any legitimate distinction of precedence is to be recognized among the Friars Minor, it should not be placed in the fact that one is of another family, for indeed We have said that all are equal in this respect; but in this, that one more than another better preserves fraternal charity toward his companions, especially of the other families, in his judgments, words, and deeds; and that one more perfectly than another observes the precepts of the Seraphic Rule according to the Constitutions of his own family.
23 What the mutual conduct of the Friars Minor ought to be can be understood from what Thomas of Celano relates concerning the ancient sons of Francis: "O with what ardor of charity did the new disciples of Christ burn! What love of holy fellowship flourished in them! For whenever they came together in any place, or met one another on the way, as was their custom, there sprang forth a dart of spiritual love, shedding over all love a seedbed of true affection. What was this? Chaste embraces, sweet affections, a holy kiss, sweet conversation, modest laughter, a pleasant countenance, a simple eye, a humble heart, a gentle tongue, a soft answer, one purpose, ready obedience and tireless hands. And indeed, since they despised all earthly things and never loved themselves with private affection, pouring out the whole affection of their love in common, they strove to give themselves as the price, so that they might together relieve the needs of fraternal charity"23. — Now We, so that the bonds of charity and fraternity by which the Franciscans of the three families are held together may become even stronger, give and grant these things in perpetuity:
24 I. That the dedication of the two Basilicas of Assisi, which are the mother churches and heads of the entire Order of Minors, although for different reasons, shall be celebrated by all the clerics of the threefold family with the rite of the second class; and both shall enjoy the same indulgences and the same privileges now and in the future. But the Friars attached to these Basilicas shall remember that they represent the person of all their companions, not only of their own family but of the others as well; and for this reason they should not cease daily to worship and praise Almighty God, Mary Immaculate, and the Seraphic Father in the name of all.
25 II. That in sacred ceremonies, processions, and other solemnities which take place in the presence of the Supreme Pontiff, the three Ministers General shall proceed together at the same time, observing however among themselves the law of precedence.
26 III. That all indulgences, graces, exemptions, privileges which have been granted or shall hereafter be granted to one family of the Minors, these same shall be deemed granted and shall be granted to the other families. But if the granting of any matter pertains to the mitigation of the Seraphic Rule, it shall not benefit those whose Constitutions permit no such mitigation. Moreover, faculties which concern the Way of the Cross, the chapel of St. Joseph, the cord of St. Francis, and likewise pious associations and confraternities, shall hereafter be granted by that Minister General alone to whom they have heretofore been reserved.
27 IV. That ritual offices, which are of the Saints and Blessed of the Order or pertain to private sacred rites or devotions, granted to one family, may also be used by other families, with the approval of the general Chapter or Definitory, without any other indult intervening: the same may be done concerning all other privileges in liturgical matters granted to one family.
28 V. That all Letters of the Roman Pontiffs or of the Apostolic See, in which the Franciscan institutes are praised, adorned, defended in general, even if given to the Minister General of one family, other moderators, members, shall nevertheless be understood to be given to the Ministers General, other moderators, members of the other families as well.
29 We decree that these present Letters and whatever is contained in them can never at any time be noted or impugned on account of subreption or obreption, or defect of Our intention, or any other defect whatsoever; but shall always be valid and in their full force and effect, and ought to be inviolably observed by all of whatever rank and preeminence, in judgment and outside of judgment; and We declare null and void if otherwise anything contrary to these matters should happen to be attempted by anyone, by whatever authority or pretext, knowingly or unknowingly; notwithstanding anything to the contrary whatsoever, even those matters worthy of special and most special mention; all of which We expressly derogate from the fullness of Our power, with certain knowledge and of Our own motion as regards the foregoing, and declare to have been derogated.
30 We will, however, that copies of these Letters, even printed ones, subscribed by hand by a notary and sealed with the seal of a man constituted in ecclesiastical dignity, shall have the same faith as would be had from the signification of Our will shown in these presents.
31 Let no man therefore infringe this page of Our constitution, ordinance, union, limitation, derogation, will, or dare to contradict it with rash presumption. If anyone, however, shall presume to attempt this, let him know that he will incur the indignation of Almighty God and of the blessed Apostles Peter and Paul.
32 Given at Rome at St. Peter's under the Fisherman's Ring, on the feast of St. Francis of Assisi, on 4 October 1909, in the seventh year of Our Pontificate.
