LETTERE APOSTOLICHE
PAUCIS ANTE DIEBUS*
AI MINISTRI GENERALI DELLA TRIPLICE FAMIGLIA DEI FRATI MINORI DIONISIO SCHULER, DOMENICO REUTER, PACIFICO A SEIANO [1]
1 Diletti Figli, salute e benedizione apostolica.
17 Così Adriano VI, Clemente VII, Paolo III, Giulio III, Paolo IV, Pio IV, Pio V, Gregorio XIII, Sisto V, Clemente VIII.
21 a) o perché esso distruggerebbe quell'Ordine dei Frati Minori che fin dall'epoca di Francesco, suo Fondatore, gode di legittima vita: - come se le altre due Famiglie dei Minori non vivessero parimenti in modo legittimo, o non traessero origine dallo stesso Francesco;
22 b) o perché indicherebbe che gli stessi Frati Minori da dodici anni fa, quando uscì la Costituzione « Felicitate quadam », hanno cominciato ad essere legittimi: - il che certamente contrasta manifestamente con le Nostre Lettere « Septimo iam »;
23 c) o perché si opporrebbe al pensiero di Leone XIII e alle parole della sua Costituzione « Felicitate quadam »: - come se quel Pontefice avesse inteso diversamente il semplice nome di Frati Minori da come Leone X, al quale si conformò, aveva mostrato in tanti luoghi doversi intendere. Se il Nostro sapientissimo predecessore, Leone XIII, avesse previsto queste interpretazioni non corrette delle sue parole, è verosimile che avrebbe usato il titolo completo Frati Minori dell'Osservanza Regolare, come Leone stesso e i suoi successori fino all'anno MDCCCXCVII fecero;

LITTERAE APOSTOLICAE
PAUCIS ANTE DIEBUS*
AD MINISTROS GENERALES TRIPLICIS FRATRUM MINORUM FAMILIAE DIONYSIO SCHULER, DOMINICO REUTER, PACIFICO A SEIANO [1]
3 II.
4 III.
12 XI.
13 XII.
14 XIII. Ea verba Constitutionis « Felicitate quadam » de Fratribus Regularis Observantiae: « Qui concessu Sedis Apostolicae antecedunt loco et honore ceteros, quique Fratrum Minorum merum nomen a Leone X acceptum retinent itemque illa Ministrum Generalem totius Ordinis Minorum, uti ius est, vocant » non ita interpretanda sunt, tamquam primatum illius Familiae Minoriticae in reliquas duas significent, aut quasi indicent ipsam solam in possessione esse non interruptae Sancti Francisci successionis, verum ut haec denotent: in numerandis legitime Familiis Minoriticis primo loco Familiam Regularis Observantiae numerari debere; Ministrum eius Generalem duobus aliis Ministris Generalibus Minoriticis in coetibus sacrisque publicis praecedere; eumdem honoris causa rite posse et appellatione uti Ministri Generalis totius Ordinis Minorum, et sigillum adhibere quod hunc ipsum titulum impressum habeat.
15 XIV. Nomen merum Fratrum Minorum Fratribus Regularis Observantiae certe Leo X dedit, idque, ut datum a Decessore fuerat, Leo XIII confirmavit.
17 Ita Hadrianus V I , Clemens VII, Paulus III, Iulius III, Paulus IV, Pius IV, Pius V, Gregorius XIII, Xystus V, Clemens VIII.
20 XVII. Liquet ex his quanta iniuria improbetur titulus Unionis Leonianae:
21 a) vel quod eum Fratrum Minorum Ordinem subruat, qui usque ab aetate Francisci, Conditoris sui, legitima vita pollet: - quasi duae aliae Familiae Minorum non item legitime viverent, aut ab ipso Francisco originem non ducerent;
22 b) vel quod eosdem Fratres Minores abhinc annis duodecim ipsis, quum Constitutio « Felicitate quadam » prodiit, legitime esse coepisse indicet: - id enimvero Nostris Litteris « Septimo iam » manifeste repugnat;
23 c) vel quod menti Leonis XIII et verbis Constitutionis eius « Felicitate quadam » adversetur: - tamquam is Pontifex merum nomen Fratrum Minorum aliter accepisset, ac Leo X, quem in hac sequutus est, accipiendum esse tam multis locis ostenderat. Quod si decessor Noster sapientissimus, Leo XIII, has verborum suorum non rectas interpretationes praesensisset, verisimile est, ipsum integro Fratrum Minorum Regularis Observantiae titulo usurum fuisse, ut Leo ipse et successores eius usque ad annum MDCCCXCVII fecerunt;
25 XVIII.
26 XIX. Nihilominus tamen, si Fratres Minores Unionis Leonianae malunt, quoties praesertim merum Fratrum Minorum nomen videbitur ambiguum, adhibeatur titulus, antea usque ad Constitutionem editam «Felicitate quadam» usitatus, Regularis Observantiae, id Nos quidem eis libenter concessuri sumus.
27 XX.

APOSTOLIC LETTERS
PAUCIS ANTE DIEBUS*
TO THE MINISTER GENERALS OF THE THREEFOLD FAMILY OF THE FRIARS MINOR DIONYSIUS SCHULER, DOMINIC REUTER, PACIFICUS OF SEIANO [1]
1 Beloved Sons, greetings and apostolic blessing. — A few days ago, on the occasion of the centennial solemnities commemorating the institution of the Franciscan Order, We issued the Apostolic Letters « Septimo iam pleno saeculo » for the purpose of appropriately confirming the fraternal concord which ought to exist among the three families of your Order. Now, moved by the same concern for concord, We return to those matters which through those same Letters We either declared or decreed, so that the mind and will of the Apostolic See on this matter may be illustrated more clearly and made manifest. For those causes of contentions and recriminations which human cupidities under the appearance of rectitude or errors of opinion are accustomed to bring forth, all of these must now at last be cut away and removed from our midst. Therefore, holding as ratified whatever was defined, established, and granted by Us in those Apostolic Letters which We have mentioned, We further desire that these documents and precepts of Ours be inviolably observed by all in perpetuity.
2 I. Although blessed Francis named the members of his Order by the simple name of Friars Minor, this nevertheless did not prevent the Franciscan Order, when canonically divided first into two, then into three Families, from finding a particular appellation added to the name of Friars Minor, by which they might easily be distinguished from one another: and no one could say without temerity that this conflicts with the mind of the Seraphic Patriarch.
3 II. The Friars Minor Conventual, truly as a distinct body, did not exist before the year 1517: but likewise the Friars Minor of the Regular Observance, as a distinct body, came into being only in that very year and day in which the Conventuals did. Before the Constitution « Ite et vos, » issued by Leo X, which indeed came forth on 29 May in the year 1517, the Order of Friars Minor did not consist of Conventuals alone, nor of Observants alone; but of both. Leo X himself in that Constitution, joining together the Friars « who observe the Rule itself of blessed Francis purely and simply, » says: « from all these aforesaid, making one body together, We unite them to one another in perpetuity. » Touching upon this deed, Leo XIII affirms: « With the secession of some from others, hence the Observants arose, thence the Conventuals... From those earlier Friars Capuchins, the Family having coalesced, a threefold division followed. »
4 III. Nor is it right to deny to the Conventuals the name and proper character of Friars Minor, as though they do not observe the Rule of St. Francis in certain major matters. This is an injury to those religious men who, although in certain chapters of the Seraphic Rule, by permission of the Apostolic See, they follow a milder discipline, have nevertheless never failed to observe the precepts and counsels in which the substance of the Rule itself consists. For if the legitimate use of a privilege or indult, which mitigates the Rule in some respect, were to prove a religious person to be a degenerate offspring of some holy Founder, one would scarcely find a religious Order whose members, whether superiors or subjects, could rightly always proclaim themselves the children of their Author; since it often happens that the Apostolic See must grant indulgences which temper the rigor of the Rule. This is confirmed by many acts of the Apostolic See, both ancient and recent; from which it appears that such indults have not rarely been granted to the Observants themselves and even to the Capuchins, and these not only to individual members or communities, but also to certain provinces and for a time to the entire Family, and this in the matter of poverty and in the handling of money: and yet no one on that account suspected that they had ceased to be true Friars Minor as they were.
5 IV. But because the Friars Minor Capuchin arose from the Friars Minor of the Regular Observance, they are not on that account to be held of inferior condition, and much less are they to be deprived of the pure and simple appellation of Friars Minor. They themselves are none other than Franciscan members who, when they had embraced the observance of the Seraphic Rule from the beginning in the bosom of the Observant Family in common, then instituted to continue that same observance with the study of stricter discipline, coalescing separately into a Minorite body, canonically constituted and recognized by the authority of the Apostolic See, under the name of Capuchins.
6 V. That opinion is full of temerity, that it is correctly argued by reasoning that blessed Francis is the legitimate or authentic father of only one Franciscan Family, namely the Friars of the Regular Observance; nor is it less temeritous to contend that if the three Families each were to use their own name, it would follow from this that none of the three Franciscan Families which exist today proceeded from Francis, and therefore the Franciscan Order of the true name has already perished: which things indeed tend toward the inference that blessed Francis is neither the legitimate nor authentic Father of the Conventuals and Capuchins, and that neither of these Families is a true Franciscan Order.
7 VI. It is injurious to the Conventuals and Capuchins to deny that they are numbered in the First Order in exactly the same manner as the members of the Regular Observance, for the reason that the former make use of pontifical indults, while the latter do not altogether obey Francis, who commanded all the students of his institute to obey one Minister General.
8 VII. Moreover, to attempt to persuade that the Family of the Friars Minor of the Regular Observance is the only one whose perpetuity of legitimate life can be shown from blessed Francis to the present day by the monuments of history and the arguments of law, is contumelious to the two remaining Franciscan Families and contrary to their right, sanctioned by the Apostolic See; by which right they trace themselves back to the Seraphic Founder without any interruption.
9 VIII. Likewise false and injurious to the two other Families of Minors are these assertions: either that an unbroken succession of the ancient Order of Minors is found only in the Family of the Friars of the Regular Observance and in the series of its Ministers General, or that there is no legitimate successor of St. Francis, on account of an unbroken series of predecessors, except the Minister General of the whole Order of Friars Minor, or of the Regular Observance.
10 IX. For if among any religious Order canonically divided into two or more Families or Congregations, which, while they observe one and the same Rule, nevertheless follow Constitutions differing in monastic austerity, the spirit which we here disapprove were to prevail, assuredly examples would everywhere become more frequent of brethren contending with stubborn zeal among themselves concerning the primacy of Congregations, the dignity of superiors, the inheritance and succession of their Founder, with great offense to the Christian people, with greater loss to Christian humility, fraternal charity, and religious discipline. — Therefore, concerning any religious Order canonically divided into several Families, which observe one and the same Rule according to their respective Constitutions, we decree this: that all members from the various Families into which that Order has been properly divided are to be numbered in the legitimate line of the original or undivided Order; and that all their supreme moderators are to be held to be true successors of the lawgiver Father with equal right, inasmuch as they proceed from succession never interrupted from him; and that they themselves, even when one of them would need to seek ratification of his creation from another, were autonomous in their own right among themselves, and each exercised full authority and jurisdiction over his own subjects.
11 X. Although the three Families of Minors, as they are canonically constituted today, are not older than the sixteenth century; nevertheless all in the same manner and with equal right « have their origin or beginning really and with effect to be reckoned from the time of the primeval and original institution of the Seraphic Rule without any interruption or division, through a true line of descent never interrupted », as was solemnly declared by Our predecessors, Leo X, Clement VIII, Paul V, Urban VIII, Clement XII, and by Us Ourselves in the cause of the Observants, Reformers, and Capuchins; which declarations also benefit the Conventuals with full right.
12 XI. Therefore it is in no way to be tolerated what is asserted: « That two or three Ministers General of Minors cannot at the same time be and be held to be true and legitimate successors of St. Francis, except with manifest contempt of his precept, just as it is not permitted that there be at the same time two or three Supreme Pontiffs, and that they be held to be Vicars of Jesus Christ and successors of St. Peter, since Christ Himself openly commanded that one Shepherd preside over His Church ». In asserting this, first a great confusion is made between ecclesiastical law and divine law; then a pernicious error is admitted by equating the succession of Pontiffs in the Chair of blessed Peter with the succession of superiors in the supreme government of Religious Orders; since the whole force of this succession remains with the authority of the Apostolic See, by whose grant Religious Orders not only have whatever right they have, but indeed that they exist at all, whereas the succession of Roman Pontiffs rests upon the ordinance of Jesus Christ.
13 XII. To the three Minoritic Families and likewise to each of their members are to be perpetually applied those words which the S. Congregation of the Council used when the cause concerning the Third Order was being heard, and which thereafter Benedict XIV employed in the Apostolic Letters Laudabile on 2 August 1745: « This faculty and power of instituting the Third Order of Penance was granted to all those who are the legitimate Children and true Successors of the divine Francis, Parent of all these, by whatever name they are called, whether Minors Observant, or Discalced, or Recollect, or by some other and other name, to such an extent that this faculty was also granted even to the Friars Minor Capuchins ». And this rightly: since all are Franciscan with equal right. If the Apostolic See recognizes each and every one of these friars as true successors of St. Francis, it is indeed to be lamented that so much and for so long these matters have been disputed with the design that one Minoritic Family should be exalted above the others.
14 XIII. Those words of the Constitution Felicitate quadam concerning the Brothers of the Regular Observance: "Who by concession of the Apostolic See precede others in place and honor, and who retain the mere name of Friars Minor received from Leo X, and likewise call their Minister General the Minister General of the whole Order of Minors, as is right" are not to be interpreted as if they signify the primacy of that Minorite Family over the other two, or as if they indicate that it alone is in possession of an uninterrupted succession of St. Francis, but rather as denoting: that in numbering the Minorite Families legitimately, the Family of the Regular Observance should be numbered in the first place; that its Minister General should precede the two other Minorite Ministers General in assemblies and public sacred functions; that the same may rightly use and be called, for the sake of honor, Minister General of the whole Order of Minors, and may use a seal which has this very title impressed upon it.
15 XIV. Leo X certainly gave to the Brothers of the Regular Observance the mere name of Friars Minor, and Leo XIII confirmed it, as it had been given by his Predecessor. But the intention of neither Pontiff was that such an appellation should never admit any addition, even if it seemed necessary to avoid ambiguity; and still less that it should be turned into an instrument of vain glory for depressing the members of the other Families. For Leo X gave to the Brothers of whom we speak the faculty, not the necessity, of using that mere name: for, when he had solemnly called them Friars Minor of St. Francis of the Regular Observance, he nevertheless said it would be lawful for them, either together or separately, to use this title, that is, with the cognomen of the Regular Observance expressed or implied. It scarcely needs to be said that by this title not only is signified the praise of discipline peculiar to those members, but also a distinctive mark which would distinguish them from the other Friars Minor. — That this, and nothing else, was the will of Leo X appears from the fact that he himself, a few days after the Constitution Ite et vos was issued, in the Apostolic Letters Cum in honorem of 6 June 1517, and afterwards in many other documents, calls the Friars Minor whom he had united Friars Minor of the Regular Observance, or of the Observance, or of the Order of blessed Francis of the Regular Observance. Moreover, when commemorating the Brothers of the twofold Minorite Family constituted by him, he calls them thus: Observant and Conventual Brothers. — And it should be noted here that nothing can rightly be gathered from the Constitution Licet alias of 6 December
16 1517 of the same Leo that would be prejudicial to the Conventuals and Capuchins. For there the Pontiff does nothing other than defend the Brothers of the Regular Observance against certain ones who denied that they were legitimate sons of Francis. When therefore he says: "That.... they have always been true and undoubted Brothers of the Order of blessed Francis and observers of his Rule, and, by the favor of divine grace, shall be so in the future without any interruption," he certainly affirms of them what was denied by their adversaries, that they are true Franciscan Brothers, but in no way excludes others. Add to this that the Apostolic See afterwards used almost the same words in the case of the Minors of Stricter Observance and the Capuchins; which words We cited in the Apostolic Letters Septimo iam. — Moreover, the Pontiffs who succeeded Leo X were accustomed similarly to designate those same Friars Minor united by him with the cognomen of the Regular Observance added.
17 Thus Adrian VI, Clement VII, Paul III, Julius III, Paul IV, Pius IV, Pius V, Gregory XIII, Sixtus V, Clement VIII. Nor did the other Predecessors of Ours act otherwise down to the promulgation of the Constitution Felicitate quadam, who almost always, when speaking of these Minors, used the appellation of the Regular Observance. Indeed, such an appellation was always held in affection and in use among the Brothers themselves: concerning which a recent Manual of the History of the Friars Minor makes this unjust complaint (wherein not a few other things are contained that are by no means approvable): "It is to be lamented that the Order so loved the title of the Regular Observance that it retained it until the year 1897."
18 XV. This title, therefore, used in six hundred Apostolic Letters, especially from the year 1517 to the year 1897, has always been and will be most honorable for the Minorite Family of which we speak. But no less honorable is that which We have attributed to it: Friars Minor of the Leonine Union: for it contains the remembrance of a twofold fact, certainly most worthy of memory, namely the union accomplished once by Leo X through the Constitution Ite et vos, and again by Leo XIII through the Constitution Felicitate quadam. But if anyone should contend that the name of Friars Minor ought always to be used, with every addition rejected, he would certainly arouse suspicion, not so much that he is vindicating for his Family a title which was never granted as proper and peculiar to it, as that he wishes to abuse this very title for depressing the other Families and exalting his own.
19 XVI. The Supreme Moderator of the Friars from the Leonine Union has very often been called by the Roman Pontiffs not Minister General of the entire Order of Friars Minor, but Minister General of the Minors of the Observance, or of the Regular Observance, or of the Order of blessed Francis of the Regular Observance, or of the Order of Saint Francis of the Observance. Thus Leo X after the Union was accomplished, and his immediate successors in many Letters; thus our other predecessors in not a few instances down to Leo XIII did so, as the acts of the Apostolic See testify. Wherefore he indeed will be able to use the title of Minister General of the entire Order of Friars Minor at his own discretion, and to require his subjects to use it; nevertheless, if he is wise, he will not take it ill that he be named by those especially who are not of his jurisdiction, chiefly to avoid ambiguity, with the addition either of the Leonine Union, which is a historical designation, or of the Regular Observance, which is the distinctive mark of the Family.
20 XVII. It is clear from these things how great an injury is disapproved by the title of the Leonine Union:
21 a) either because it would undermine that Order of Friars Minor, which has enjoyed legitimate life from the age of Francis, its Founder: - as if the two other Families of Minors did not likewise live legitimately, or did not derive their origin from Francis himself;
22 b) or because it would indicate that these same Friars Minor began to exist legitimately twelve years ago, when the Constitution «Felicitate quadam» was issued: - this indeed is manifestly contradicted by Our Letters «Septimo iam»;
23 c) or because it would be contrary to the mind of Leo XIII and to the words of his Constitution «Felicitate quadam»: - as if that Pontiff had understood the mere name of Friars Minor differently than Leo X, whom he followed in this matter, had shown it was to be understood in so many places. If Our most wise predecessor, Leo XIII, had foreseen these incorrect interpretations of his words, it is likely that he would have used the complete title Friars Minor of the Regular Observance, as Leo himself and his successors did down to the year 1897;
24 d) or because it would interrupt the continuity of the holy praises with which the Order of Friars Minor has been adorned throughout this span of seven centuries: - by which words it is wrongly intended to signify that the Saints of the Minority who flourished before the Union made by Leo X should not be ascribed to the three Families as a common patrimony of glory, but to one Family of Minors of the Observance alone. If the Conventuals and Capuchins name the blessed citizens of heaven who came forth from their Families, after they were rightly constituted separately from the others, by their own designation, they violate no one's right; for it is permitted to them, and likewise to the Friars of the Regular Observance, to do so. But rightly in the Litanies of Saints, which the Franciscans use by Apostolic privilege, all Saints from the first Order of Minors, both those who existed before the threefold division of Families and those who came after it, are invoked without any Family designation. And it is to be desired that in the Calendars of the three Families the Saints and Blessed Franciscans be noted with only of our Order appended; as is customary, for the sake of fostering fraternal charity, among other Religious Orders divided into several Families or Congregations.
25 XVIII. Moreover, we do not see what reason there is why the historical title of the Leonine Union, which has been given to the Friars Minor, should displease them, since the great merits of both Leos, the Tenth and the Thirteenth, toward that Family indicate it. - Likewise why this title of the Leonine Union should bring the very union itself into jeopardy, which not a few Friars embraced chiefly in order to obtain the simple name of Friars Minor, does not appear; except that they were deceived by the opinion of attributing to this name the force of a certain primacy over the other Franciscals, which the Apostolic See has never granted. - But to affirm by this title of the Leonine Union that a great mark of ignominy has been branded upon the Order of Minors, this indeed is injurious to the Apostolic See, and far removed from the Seraphic spirit. A title given in honor of two Pontiffs and in memory of a twofold most illustrious deed, and given by Letters full of love and benevolence toward the entire race of Minors, by which Letters certain honorific privileges of the Minoritic Family of the Regular Observance were confirmed, such a title, We say, it is impious to turn into ignominy of the Family itself, since it rather redounds to its glory. But indeed it can seem less honorable only to those to whom it stands in the way of their boasting themselves superior to their brethren by injury.
26 XIX. Nevertheless, if the Friars Minor of the Leonine Union prefer that, whenever especially the mere name Friars Minor shall seem ambiguous, the title formerly used down to the Constitution issued «Felicitate quadam» be employed, namely of the Regular Observance, We shall indeed willingly grant this to them.
27 XX. Finally, we impose perpetual silence upon all and each of the Friars Minor of the three Families concerning such questions; and we will that from all of them, as twin sons of one most holy Father, there be one heart and one soul. And we decree all these things, and command them, notwithstanding any contrary provisions whatsoever, even those worthy of most special mention. - As a pledge of divine gifts, and as a witness of our special benevolence, we most lovingly impart to you, beloved sons, and to the whole Seraphic Order the Apostolic Blessing.
28 Given at Rome at St. Peter's, on 1 November, on the feast of All Saints in the year 1909, the seventh year of our Pontificate.
