The Statutes of the College of Patrons of Cases of the Holy Apostolic Palace are confirmed, and new privileges are granted to the same College.

Clement PP. XIII.

1 For the record of the future. § 1. By that disposition of the Council by which all things heavenly and earthly alike are governed with the greatest providence, placed, though with unequal merits, in the sublime pinnacle of Apostolic dignity, among the manifold cares of Our pastoral vigilance, We hold this especially in mind, that following the footsteps of Our predecessors, the offices of Our beloved City be exercised by men conspicuous in faith and fitness; and rewarding each according to his merits, We foster them with liberal gifts of graces and privileges, as We perceive it to be salutarily expedient in the Lord.

2 § 2. The College indeed of Patrons of cases of Our Apostolic Palace, composed of men illustrious in virtue and learning, selected from the entire body of Procurators of this beloved City, to whom it has been granted not only to expound and defend the rights of litigants before the greater Judges, especially of miserable persons, but also to plead greater cases before Us and before the Venerable Cardinals of the Holy Roman Church, appears to trace its illustrious beginnings of institution from the most ancient times. For the late Pope Innocent II, who in the year of Our Lord 1130 was

3 invited to assume this Apostolic See, did not permit an annual stipend or honorarium to be received by the Judges from him, nor through an intermediary; and if it should be received, once I know of it, I shall cause it to be returned within fifteen days; and I shall not refuse my patronage to anyone having a case, if he should ask me for it, through any ill will.

4 § 3. Then, after a long space of time had elapsed, as is asserted, the late Pope Paul II, likewise Our predecessor, turning his attention to the merits, qualities, and labors of the same Patrons, which they are accustomed to expend as much for public as for private matters, by his letters in the form of a motu proprio issued in the year 1538, granted and imparted to the same College and Procurators that in the Pontifical Chapel of the said College only the appointed ones, but in any public act and public processions the entire College and all Procurators of the said College enrolled only, might have place after the Advocates of the Consistory. § 4. Then afterwards this body of Patrons, which had previously been of those admitted by reception, reduced to only twenty-four Patrons of cases, into a just and legitimate College with insignia and all collegiate rights, the late Pope Paul V, likewise Our predecessor, by Apostolic authority erected and declared erected; and its statutes, styles, uses, and customs, which according to the quality of times and matters needed reform and change, corrected and amended by the good memory John Baptist Coccino, then Auditor and Dean of the same Palace, he confirmed and approved by the same authority; and those indeed who had already been inscribed in such a College, the same Paul, Our predecessor, granted very many graces, favors, and privileges both to those already inscribed and to those who would be inscribed in the future, Patronage of the College; place in the Pontifical Chapel, and in Public Processions after the Advocates of the Consistory.

5 Paul V converted the body of Patrons which had previously been of those admitted by reception into an enrolled body, composed of twenty-four selected Patrons, and approved its Statutes.

6 Clement PP. the Thirteenth wished to change this, and therefore declared them capable and fit to exhibit their patronage, as much in Rotal cases as in any other matters whatsoever without any other examination and approval; granted the use of the Mantle and Biretta as a sign of merited prerogative, and bestowed and granted certain other things.

7 Recently, however, the same College, offices, and privileges, which the beloved sons, the Patrons of causes of the Palace, who compose that College, set forth to Us, [showed] that already long ago by other Roman Pontiffs, Our predecessors, this College of Patrons was held worthy of special Apostolic beneficence and benignity of consideration, and their work was employed in even more serious matters, and moreover the guardianship and patronage in causes, mostly of the poor, and their defense without any emolument and without any hope of gain, according to the praiseworthy institution of the same College, was undertaken by them, and [what is more], in all past times from among their number, those who were found enrolled in it were selected by the Roman Pontiffs, Our predecessors, both as Commissioner of the Apostolic Camera and Prefect during vacancies through the death of the Apostolic Datary, as well as Lieutenant of the Civil Tribunal of the Government of this Our Beloved City, besides other offices also mostly conferred upon them. § 6. But since on account of new circumstances and changes of conditions, it was necessary that their institution also be changed and necessarily reformed, all things having been carefully weighed and considered, they thought that their statutes, especially in those chapters which cannot now be carried out in the manner in which they are found prescribed therein, should be reformed; therefore the ordinances, provisions, constitutions, uses, customs, precepts, statutes contained therein, by the counsel and assent of Our Venerable Brother Urban, at that time Auditor of the Apostolic Palace and Dean, and now Bishop of Firmum, were reformed, changed, and corrected in the following manner, namely:

8 The ancient [statute] of this College.

9 Concerning matters of Religion. Since as regards the Christian Religion, we intend to profess all those things which Holy Mother Church teaches and commands, We, the Patrons of causes of the Sacred Apostolic Palace of the College, which has been instituted as a minister of justice under the auspices of Blessed Michael the Archangel, the minister also of celestial justice, do establish and ordain that in each year on the feast day of the dedication of the same, a solemn Mass shall be celebrated in the Church of the Archgymnasium of Wisdom in the customary manner, to which the Reverend Fathers, the Lords Auditors of the Sacred Palace, as well as the Lords of the Consistorial Court, and the other Advocates of the Roman Curia shall be convoked. Likewise, that at the funeral of any member of the College, all of the College shall be convoked by the Chaplain, and there shall be distributed to them wax candles, as has been customary heretofore, and that on one day within the following month there shall be celebrated collegially particular exequies for such a deceased in the chapel of our College, and each year within the week of the day on which by Holy Mother Church the general commemoration of the Deceased is celebrated, just as it has been observed heretofore. Whoever, however, shall not attend the aforesaid functions without legitimate cause, shall pay one gold coin to be applied to the said chapel of the College itself, in each instance, and if he shall be contumacious in paying it, he shall be further punished at the discretion of the Lords Deputed.

CHAPTER II.

10 Concerning the requirements for admission. No one shall be received into our College unless he possesses the following requirements. First of all, let him have an excellent reputation, an unblemished name, uncorrupted faith, and honesty, especially in the exercise of his office. Let him moreover be born of pure and honest parentage; let him be graduated in both laws from some public University according to the Constitution of Pope Benedict XIV. Furthermore, let him be enrolled in the register of Advocates of the Rota, at least for five years, and let him have conducted himself laudably in office, refraining from any exercise in the office of Advocate which is proper to a solicitor. Finally, let him have a house furnished, himself and his household honorably maintained; and let it be established that he has given his name to the Congregation of St. Ivo and has rendered his efforts, according to his ability, to the defense of causes of miserable persons according to its pious institution.

CHAPTER III.

11 Decree concerning the form of admission. Whenever it shall be necessary to proceed to a new admission in order to fill up the number of twenty-four Patrons of our College as prescribed by His Holiness Paul V, the Dean shall convoke the College in the customary Hall of the Archgymnasium of the Sapience, and after deliberation initiated by a plurality of votes concerning the making of a new admission, it shall immediately be mandated to the Secretary that he receive the petitions of the candidates with the necessary requisites. For he who has not previously petitioned, and has not exhibited documents of his fitness, cannot be elected and co-opted among the Collegians, both by the praiseworthy custom hitherto observed and by the older statutes as well. Forthwith in the same College, with no delay interposed, two Scrutineers shall be appointed, whose office it shall be to seek out secret and truthful information concerning the life, morals, honesty, and other qualities of all the candidates, and to lay these faithfully before all the Collegians in the next special Congregation to be held, in which, after their report, the election shall take place. In conducting this, however, it shall be free for the College, especially when a multitude of petitioners abounds, to disregard and pass over others, who for that occasion, or by reason of age, or for other causes, seem to be to be set aside, and to confine the election to certain candidates in a manner. These indeed shall be subjected in order according to the seniority of their Doctorate, so that no one suffer injury, to secret scrutiny, and with ballots of different colors distributed, of which the white shall include and the black shall exclude, the Dean and Secretary shall enumerate before all in clear light the votes which each one shall have cast secretly into the Box, and the same Secretary shall accurately describe them in the folio of the College's resolutions, and when the scrutiny is completed, and a comparison made of number to number and person to person, provided that the favorable votes are above one half of those present, those shall be announced as legitimately elected and co-opted into the College to whom the plurality of votes shall have sufficed. These matters being completed, two examiners shall be appointed in the same College from among the seniors; and it shall be the duty of the Secretary, first of all, to inform the Most Illustrious and Most Reverend Lord Dean of the Sacred Rota of the election already made, and to beseech him that he appoint a certain day for the examination of those to be admitted: then through the Chaplain he shall take care to admonish the newly elected, that on the next following day they present themselves before the Dean of the College, from whom they shall better learn of their election or appointment that has taken place, receive the mandate of the thanksgiving to be rendered by each one to the Collegians, and at the same time they shall be admonished on what day and hour they ought to appear before the Most Illustrious and Most Reverend Lord Dean of the Sacred Rota, where, with the examiners appointed present, and the Secretary of our College, there shall be assigned to each one to explain, in the manner of a master, within the space of twenty-four hours, one of the decretals, which by opening the book shall have presented itself by chance. Hence on the following day, at the same hour those to be admitted shall be bound to be present before the aforesaid Most Illustrious and Most Reverend Lord Dean of the Sacred Rota, the examiners, and the Secretary, and to explain in the manner of a master the decretal assigned to them, and finally to answer arguments, both in law and in practice, which shall be proposed by each of the examiners, and by the Dean of the Sacred Rota himself, if it please him. The explanation and examination being made, and the fitness of those to be admitted being ascertained, a formal admission shall finally follow on another day to be prescribed by the Most Illustrious and Most Reverend Dean of the Sacred Rota, in which the entire College shall be convoked at his residence, and there, introduced by the Secretary of the College, those who ought to be newly admitted, kneeling, shall make profession of Faith, and shall swear to the words of the form written below, and when the oath has been taken, they shall be received by the Lords Collegians with the kiss of peace, and shall henceforth be of the College, and their name, surname, and country shall be described in the register, so that they may prove themselves Collegians and be held as such by all. Cap. IV.

12 Formula of the oath. I, N., swear that from this hour forward I shall faithfully and without any evasion defend the causes whose patronage I shall have undertaken for justice

13 Pope Clement the Thirteenth will strive to assist, whatever I shall judge to be true and just I shall endeavor to advise my clients, I shall not knowingly accept unjust cases, and if I shall have accepted any which seemed just to me at the beginning, but in the course of proceedings shall appear to be unjust, I shall take care to persuade my clients to desist from their prosecution, otherwise I shall absolutely remove myself from their patronage in such cases: to the admonitions and precepts of the College and its Officials in those matters which pertain to the College itself, I shall strive to obey in good faith, and I shall observe the statutes of the College itself and shall not reveal its secrets, so help me God and these holy Gospels of God.

14 [a] Chapter V, On the Number of Officials. And since it is necessary that there be certain persons who shall particularly understand, procure, and minister to the College, we therefore ordain that the following Officials shall be continuously appointed and established according to the form noted below, namely: two Deputies; two Defenders; one Treasurer; and one Chaplain, who however shall not be of the number of the Collegians.

15 Chapter VI.

16 On the Congregation and its Notification. That the ordinary Congregation at the mandate of the Dean of the aforesaid College, or of the aforesaid Deputies, or in their absence or impediment, at the mandate of some senior Colleague present in the City, shall be held on the first days of each month and of the first week of the month. Extraordinary Congregations shall also be held according to the urgency of necessity, and the Chaplain shall on the day, hour, and place to be appointed by one of the aforesaid, notify all Collegians whom he shall know to dwell within the walls of the City, either personally or by leaving a note at home, the hour, day, and place of the future Congregation; and in the Congregation of the month of January, the Officials for the coming year shall be drawn by lot from the Box. Nor shall any account be taken of the absent, and a Deputy drawn for one office shall not be admitted to another for that year, except that the offices of Treasurer and Secretary, which we wish to be conferred upon one and the same Collegian, are excepted. Moreover, in casting votes, unless all shall be unanimously agreed by voice, votes shall be given by balls, except for the creation of Officials, which we will to be done entirely by lot, which, so that they may be done without contention, we command that three Boxes be made, in each of which the names of all the Colleagues shall be written, and one shall be inscribed for Deputies, another for Defenders, and the remaining one for Treasurer: and when the necessity arises (after all shall have been drawn) of refecting the Boxes, two shall be chosen from the College, who together with the Deputies shall faithfully renew and make those Boxes; and thus refected they shall be kept with the Treasurer; and if any one of the Colleagues shall be hindered by some impediment approved by the College from attending the aforesaid Congregations, he shall be bound to send an excuser, and to make the College more certain of such impediment before the hour of the Congregation arrives, otherwise for each time, in place of his name, he shall be absolutely and irremissibly bound to pay one gold shield to be applied to the use of the Chapel into the hands of the Treasurer.

17 Chapter VII.

18 On the Deputies. The Deputies shall be two, who shall be bound to protect the rights and above all the honor and dignity of the College, and against Colleagues for any offense, especially (God forbid) against the form of the aforesaid Oath, reported by the Defenders or otherwise defamed, to proceed extrajudicially, and finally for the utility or necessity of the College to be able to command each one of the same College, and also the Chaplain himself under penalties to be determined by them and applied to the Chapel, and to exact those penalties by all remedies of law and fact.

19 Chapter VIII.

20 On the Defenders. The Defenders shall likewise be two, and shall be drawn as is aforesaid, and they shall be bound and ought to defend the affairs and business of the College, as the name of their office sounds, especially in court, and to have them defended by others, to take care to arrange and effect patronage, and concerning the life and morals of Colleagues, especially regarding the legality and fidelity of patronage, to inquire diligently: and if they shall discover that any one has done anything contrary to the form of the oath taken, they shall diligently report it to the Deputies (so that they may be able to deliberate on what ought to be done concerning this), and shall assist the Deputies themselves in the affairs of the College, and shall procure, execute, and do what shall have been enjoined upon them by the Deputies for the interest of the College.

21 -- * to care for and to do, and concerning the life and morals of Colleagues, especially regarding the legality and faithfulness of advocacy to inquire diligently: And if they shall discover that anyone has done anything contrary to the form of the oath taken, they shall carefully report it to the Deputies (so that they may be able to deliberate whatever it shall be expedient to be done concerning this), and they shall assist the Deputies themselves in the affairs of the College, and shall take care; they shall execute and do those things which shall have been enjoined upon them by the Deputies for the interest of the College.

22 Chapter IX.

23 Concerning the Treasurer and Secretary: There shall be one Treasurer, and he shall be appointed as stated above, and he shall keep one book in which he shall note all emoluments, revenues, and income, as well as the expenses and expenditures of the College; and he shall preserve the privileges, seal, monies, and other movable property of the College itself: and likewise any other documents, and the chest or box of the College with movables and documents of this kind to be described in a public inventory, and at the end of his office he shall render an account of receipts and expenditures to the new Deputies, and shall restore the account books together with the rest, and also the movables and documents according to the aforesaid inventory, and the aforesaid chest or box, and its key. However, he shall not be able to make any expenditures by himself, but only whenever and when the Deputies shall command it by a mandate made in writing and subscribed by the aforesaid Deputies: the same Treasurer shall also perform the office of Secretary, wherefore he shall have moreover another book, in which he shall note with his own hand all the decrees which shall be made in the Congregations, and shall not disclose or reveal them to anyone, unless by mandate of the College itself. Cap. X.

24 Concerning the Chaplain: There shall be one Chaplain outside the College, marked with the Priestly character, and he shall be appointed in the general Congregation by votes, and he shall be bound to assist the Lords Deputies and other Officials, the general or particular Congregations, and other matters of the College as shall be imposed upon him, to all Collegians existing in the City personally, if he is able; if not, he shall send notice by means of a written notice to their homes, and he shall have for his salary what shall have been promised to him by agreement.

25 Cap. XI.

26 Concerning the Patronage to be Exhibited to the Poor: Whenever there shall be a general Congregation, whether ordinary or extraordinary, they shall not depart from the place of the College without the Chaplain first diligently inquiring whether there stand before the doors any Poor persons needing patronage in their own cases, and if he shall find them to be standing there, he shall introduce them, or shall set forth their petitions, and if a Poor person shall have designated to himself one of the Collegians; whether that he write for him in fact or in law, that one so designated; if not, whom the College shall have appointed by turn, shall absolutely (ceasing legitimate excuse to be expressly approved by the College) undertake the burden of patronage for him, and shall provide freely for the love of God until the end of the case: and shall accept not the least thing from him even if he willingly gives, or even, the case finished, wishes to give. Cap. XII.

27 Concerning Patrons Writing in Law: If anyone from the Collegians, either together or separately, shall wish purely and simply to respond in law and to write upon information of others' facts, which in the Roman Curia is called by the special name of acting as an Advocate, he may do so at his pleasure.

28 Cap. XIII.

29 Concerning Those Who Have Transgressed in Some Matter or Have Been Reported or Defamed: If any of the Collegians (which God forbid) concerning any one of those things comprehended in the aforesaid formula of oath, shall have acted otherwise than he promised, and on account of this shall have perjured himself, or shall be found guilty of some other crime whatsoever bringing infamy, whether by the Defenders (to whose office we especially wish this to pertain) or by any other person whatsoever, yet not malevolent, but trustworthy, reported or previously defamed by legitimate indications, the Lords Deputies, whose conscience is burdened by this: immediately, after such report or defamation shall have come to them or to one of them, shall summon the same person so reported or defamed to themselves with due modesty, so that then in the next Congregation, under penalty of cancellation from the register and perpetual exclusion from the College itself, he shall appear personally, and shall purge himself of the crime ascribed to him by clear proofs. But if he shall contumaciously fail to appear in the same Congregation, or appearing, as aforesaid, shall not purge himself, and shall not prove his innocence, immediately in the sight of the whole College as a diseased beast he shall be cancelled from the register, and shall be entirely and perpetually excluded from the College, and he shall be henceforth alien to the Collegians, and outside commerce. And if any of the Collegians thereafter ever speaks on behalf of receiving him, that one likewise by that very fact shall be deprived of the commerce of the College, and shall be perpetually excluded from the College, and if it should happen that the Deputies or Defenders, or both, are negligent concerning the aforesaid matters, if indeed the negligence shall be in the Deputies alone, then it shall be permitted to the Defenders, as above, to report; but if both shall have been negligent, it shall be permitted, and under the obligation of oath each one of the Collegians shall be bound in the next Congregation to report, so that the Congregation itself, having rebuked (as shall be fitting) the Deputies and Defenders for their negligence, as shall seem expedient, may provide. Cap. XIV.

30 Concerning private documents not to be subscribed. No one from the College henceforth shall dare to subscribe to any attestation or credential made by anyone or any persons concerning the style of the Palace or the Roman Curia; but whenever it happens that the College is consulted concerning such style in matters pertaining to their office, it shall be convened in the customary manner, and the votes of all shall be heard, nor shall any attestations concerning such style be formed otherwise; and those which ought subsequently to be registered shall be granted by the Lord Treasurer in the book of the Decrees of the College for perpetual memory, lest there be any further doubt about this matter afterwards. Chapter XV, Concerning the inventory of things and writings of the College and their custody. All and singular things, rights, and writings of the College, or pertaining to it in any way whatsoever, shall be kept in the customary Archive or chest, together with an inventory of them. Moreover, the aforesaid Archive or chest shall be locked with two keys, one of which shall be held by the senior of the Deputies, and the other by the Treasurer with the aforesaid book, and seals shall be kept safe; and whenever it happens that any writings are to be drawn from it, it shall be noted on the last page of the same Inventory, and the Treasurer shall take care to have them returned as soon as possible, and likewise he shall note the return on the same page, and the Treasurer especially shall render an account of these things to his successor at the end of his office. § 7. Since, moreover, as the same exposition subjoined, the said expositors, in order that these reforms, changes, ordinances, provisions, precepts, and statutes might subsist more firmly and be observed more exactly, greatly desired to be strengthened by the patronage of Our Apostolic confirmation, and moreover have humbly besought Us that henceforth not only the duties of Commissioner of the Apostolic Camera and Prefect during vacancies by death of the Apostolic Datary and of the civil Lieutenant of the Tribunal of the Governance of the City, hitherto entrusted and committed to those inscribed in the aforesaid College of Patrons of the Apostolic Palace, but also that other offices of Our Roman Curia, to be designated by the judgment and paternal providence of Us, should always be conferred upon the same, and that We should grant some other prerogative and distinction, and confirmation of privileges already obtained, and in the premises provide opportunely, and as below, deign to indulge by Apostolic benignity.

31 § 8.
