Bolla che istituisce la Rota di Ferrara

Bolla di papa Clemente VIII ·

CCVIII.

In supremae, tom. iv, pag.

32 Appellationes causas quomodo tractandae.

33 Causae ceptae coram praetore a quo terminandae.

35 rum secundum tamen dispositionem l. Unicae Cod. quand.

§ 37. CCVIII.
Institution of the Rota in the city of Ferrara for the Ecclesiastical State to decide cases of that city and territory, with the grant of indults * by Pope Clement VIII, for perpetual remembrance of the matter.

1 Seated in the supreme throne of justice, by divine providence disposing, we are bound to care above all that justice be administered to all with an equal scale in our own time and in future times as well, and to accomplish this as is fitting, we appoint just and most upright judges with appropriate powers, through whom not only is to each his due rendered, but also the inconveniences and expenses of litigants are spared, insofar as it can be done. Moved therefore by these considerations, and desiring to provide for the right governance and happy administration of the peoples of our city of Ferrara and of other cities, lands, castles, and places of our Ferrarese duchy and dominion, and to consult opportunely for the safety and advantage of individuals, we have decreed to institute, besides other things ordained by us in the same city and duchy, one tribunal of judges, to be called the Rota, in the said city of Ferrara, in which civil cases, as shall be provided below, ought to be heard and, as the law shall require, terminated.

2 § 1. By our own motion therefore, and from certain knowledge and mere deliberation of ours, and from the fullness of apostolic power 1 Ferrara (where Boniface IX had instituted a university of studies by his const. In supremae, tom. iv, p. 610), Clement VIII R.C.A. added by constitutions clxii, clxiii, clxvi, clxxi, and seq. A new form of governance he introduced into it by const. clxxx: Quoniam, p. 428. And he instituted magistrates and a council of one hundred men in it by const. exc. Inter, p. 449. And he granted to it that it could retain its orator at the Pontificate by const. excm. Prooemiun.

3 The number of auditors is prescribed, and the election is assigned to the city council. In the aforesaid city of Ferrara, we erect and institute by apostolic authority, by the tenor of these presents, perpetually to endure for all future times, one tribunal of audience of cases, to be called the Rota, which ought to consist of five judges, to be called auditors, to be elected by the Council of the aforesaid city of Ferrara every five years, who all and each may and ought to hear, decide, and terminate and judge with due conclusion all and singular cases, suits and civil controversies, mere and mixed, in whatever manner conducted between citizens, inhabitants, district dwellers, and colleges, farmers also, and any others whatsoever subject to the legation of Ferrara, of the cities of Ferrara and Comacchio, and of whatever lands, castles and places of our Ferrarese duchy.

4 § 2. Since moreover all things are rendered more stable in the Auditors, the more solid and certain a state, by which they can be happily ruled and governed, they assume; for this reason we have deemed this same Rota tribunal to be supported by the constitutions and ordinances written below, to be perpetually and firmly observed. For this reason we establish, command and ordain, that the aforesaid five auditors of the Rota ought to be doctors of both laws, not from the city of Ferrara or from any of the aforesaid places of the duchy, but from other places of the ecclesiastical dominion subject to us and the Apostolic See immediately, of the highest integrity, prudence, learning and experience, not less than thirty years of age, who have taught for at least the space of five years in some public distinguished academy, or have devoted themselves to the forum in some celebrated place, by judging or advocating, and have not been held as the last in these duties to be performed, but have conducted themselves in a distinguished and praiseworthy manner.

5 § 3. We will that all these be elected by the Council of the city of Ferrara, every five years, except in this first instance; and after they have been elected at the beginning or before the entry upon their office, in the hands of our legate existing for the time being and of the Apostolic See in the city and duchy of Ferrara on the side, or his vice-legate, or governor, with the judge of the wise men assisting and the wise men themselves of the community of Ferrara, they shall promise by oath that they will observe to the letter not only these constitutions of the Rota, but also all and whatsoever provisions, ordinances and statutes of the city of Ferrara, now received by use, and moreover justice, as is fitting, with holiness and integrity, to administer, under penalties to be inflicted at the discretion of superiors in the syndicature to which we will that they be entirely subjected, when their office is finished, and in which they are to be held only for fraud, deceit and barratry, according to the style of the whole Rota and the disposition of law, and concerning these not to be inquired into except individually, since it is not to be presumed that the whole Rota would commit fraud, deceit and barratry, we command and declare. § 4. When their office and that of each of them is finished, we do not will that they or any of them be able to be elected or confirmed again for another five years, unless three parts out of four of the votes in the Council should be obtained for a new election or confirmation; we grant however that after five years, elapsed from the day their office is finished, they may rightly be elected again by law.

7 § 5. And since, as has been stated above, auditors are to be chosen from quinquennium to quinquennium, and this is to be observed perpetually in future times, it seemed reasonable and consonant with reason that one of those who served in the Rota in the preceding quinquennium should remain in the same Rota in the following quinquennium, so that those newly entering might be more easily and quickly instructed; for this reason the oath to be taken by them.

8 Confirmation in office of auditors and when it may take place.

9 The term of office shall be concluded by quinquennium.

10 Alt. C. 1599 Election after the first quinquennium pertains to the city of Ferrara.

11 The office of praetor is concluded in a year.

12 Stipend of the praetor and auditors.

13 We have established that the election shall be made in this order and manner: for this first time five auditors shall be chosen, and when their office is completed, one of them shall be selected by the Council to persevere in the new Rota for two years; and at other times, indeed an election of five auditors shall take place, but one of them, namely the last elected, shall not immediately at the beginning of the quinquennium enter the Rota, but after two years have elapsed, and he shall be the one who in the Rota of the following quinquennium, for the course of two years, shall remain for the instruction of new auditors, and thus we command that it be observed perpetually in future times.

14 § 6. We wish the election of the said auditors by the aforesaid Council of the city of Ferrara, as is aforesaid, to begin after the present quinquennium, in which we wish the auditors already elected through our beloved son Peter, deacon cardinal of St. Nicholas in Carcere, called Aldobrandini, our nephew by our brother german, and our and the Apostolic See's legate de latere in the said city and duchy, to continue, and their quinquennium to begin from the day of the date of these presents, and to end as follows.

15 § 7. We have also established that the praetor of the said Rota, already elected, shall exercise the office of praetorship for one year, beginning from the same day of the date of these presents, according to the form described below.

16 § 8. But because the mouth of the ox that treadeth out the corn is not to be muzzled, and a worthy reward is to be set before each one for his labors, so that he may be rendered more eager to undertake them; we therefore assign and constitute to each of the aforesaid judges of the Rota of Ferrara, besides the praetor, in individual months thirty-five gold scudi in gold; and to the praetor indeed fifty-five similar scudi as monthly provision from the revenues and provision of our Apostolic Camera, to be paid by the depositary of the same Camera in our city of Ferrara with the mandate of the legate or vice-legate, or the governor of the same city for the time being.

17 § 9. And furthermore we will and ordain that the community of the city of Ferrara shall be bound to assign gratis a place for the auditory in which the Rota is to be held, and houses in which the aforesaid auditors may dwell conveniently and according to their rank, decently, and honorably.

18 § 10. And that they elect messengers who shall assist in the aforesaid Auditory during the time of the Rota, and shall cleanse it of all filth.

19 § 11. To the same praetor and auditors, moreover, we permit and graciously grant that they may receive sportulas and emoluments of whatever kind according to the statutes of Ferrara, and gifts according to the constitutions and customs of the Rota of Bologna, notwithstanding the Aldobrandine constitution.

20 § 12. Furthermore, so that the said auditors may apply themselves more diligently to the dispatch of cases, which is of the greatest concern to us, we strictly forbid them under penalties to be imposed at the discretion of the legate, vice-legate, or governor, lest in any way they dare to give counsel in cases pending before other judges in the city of Ferrara and its district, or elsewhere in the legation, or subscribe themselves to the counsels of others; we grant, however, that they may sometimes do this in cases which are handled outside the legation.

21 § 13. We further forbid under the same penalties that they be absent from the city and auditory on non-feast days without the permission of the Council: unless perhaps it should be necessary for them or some of them to be absent by reason of cases and office, or they should be detained by some just impediment preventing them from coming to the auditory and applying themselves to the dispatch of cases. A house shall be assigned gratis to the auditors by the community.

22 Messengers shall be chosen by them.

23 Sportulas and gifts are permitted to the auditors.

24 When counsel may be given to cases.

25 What is to be done when some auditor is absent on account of a case.

26 may; and in this case we will that, notwithstanding the impediment or absence, if the case pertains to the whole Rota, the others shall proceed in it and if he who was ponens was absent, another shall be substituted in his place by lot to be drawn, and if the ponens returns, or the impediment ceases before the case is decided, he shall resume his case in the terms in which he shall find it, and dispatch it; but if the impediment or absence should occur in the person of the praetor, the senior auditor shall be substituted in his place.

27 § 14. Now approaching more closely to the jurisdiction of the auditors, we establish in the first place concerning the auditors, that one of them shall be praetor of the city of Ferrara each year, namely the senior, that is, he who was first elected as auditor; who shall hold the praetorship for one year, and after completing that praetorship, others in turn, according to the order in which they were elected as auditors, shall succeed to the praetorship, and the last, who according to what has been established above enters the new Rota in the third year only, shall remain for two years, obtaining the praetorship in the first year upon entering the new Rota, and thus it shall always be observed henceforth, except in this first instance; in which, necessity requiring it, we provide that, when the five-year period is completed, he whom the general council shall have elected shall persevere in the new Rota, and he shall again obtain the praetorship in the first year upon entering the new Rota.

28 § 15. We decree that all cases of appeals of the entire legation of Ferrara shall pertain to the praetor alone; who ought to know of these and to terminate them with due conclusion alone, and to receive fees and emoluments alone, nor shall he be bound to share these with the other auditors. And we will that all appeals and whatever from the sentences of any judges whatsoever, in whatever civil cases, as well as reductions to the arbitrium of a good man, which shall be interposed by arbiters or arbitrators both voluntary and necessary, in cases however permitted, shall be devolved to the said praetor and his office; and he may also know whatever other cases in the city and legation of Ferrara, just as the praetor of the Rota of Bologna can in the city and legation of Bologna.

29 § 16. Establishing meanwhile that, the old abuse of appealing before good men ceasing, all appeals shall be interposed before the judge from whose sentence appeal is made, entirely; and if interposed otherwise they shall not be valid, nor shall they hold, unless truly a copy of the judge could not have been obtained.

30 § 17. Decreeing for the swifter expedition of cases, that from incidental and emergent matters, concerning which it shall happen that the praetor interlocute, in cases in which appeal from interlocutory sentences is permitted by the form of the law, statutes or provisions of Ferrara, appeal shall be made to the Rota, which, without the will of the praetor, ought to terminate that appeal itself; just as we perpetually and inviolably ordain that in whatever cases to be brought before the Rota, in which in the first place some one of the auditors shall have judged, he nevertheless shall have a vote in that case.

31 § 18. Finally we command that cases begun before one praetor, when his office is completed, shall be completed before the same and by the same, provided that the process and writings, before he lays down the office of praetorship, shall have been presented by the parties, according to the form of the statutes and provisions of Ferrara. Declaring that this, during the five-year period, shall hold, and cases begun before the last praetor, not before the same and by the same, but before the praetor of the new Rota and by him are to be completed. § 19. To the Rota moreover we provide that all cases of widows, wards, and all miserable persons shall pertain, according however to the disposition of l. Unica Cod. quand. Imper. in ter pupil. and not otherwise; as well as of dowries and aliments, and besides all cases, cumulatively however as to the place holding the general jurisdiction of civil cases of the legate, vice-legate, or governor, which by the form of the statutes, ordinances and provisions of Ferrara ought to be known and terminated with appeal removed, except those which by reason of the person acting or being sued, or by reason of the case by the form of the same statutes, ordinances and provisions, or by privileges of some forum have particular jurisdiction, and ought to be treated and decided before some particular judge. Moreover we grant and indulge to the same Rota the knowledge of second appeals, not only from the sentences of the praetor, but also of any judges whatsoever of the entire legation and duchy of Ferrara; and we will that these second appeals, even of the entire legation, shall be entirely devolved to the Rota, provided that, as to those outside the city, the value of the case exceed one hundred gold pieces at four pounds. Nor can the said auditors know whatever other cases in the said city and legation of Ferrara, just as the auditors of Bologna can in the city and territory of Bologna. Declaring that all the aforesaid cases, even with the vote of the praetor, are to be decided, except the cases of appeals, which are interposed from his sentences, as has been premised.

32 How appeals in cases are to be handled.

33 Cases begun before the praetor by whom they are to be terminated.

34 What cases are said to be Rotal and pertaining to the Rota.

35 according, however, to the disposition of the unique law of the Code, when [concerning] wards and not otherwise; as well as dowries, and maintenance, and moreover all cases, cumulatively however as to place holding the general forum of civil cases legal, of the vice-legate, or governor, which from the form of the statutes, ordinances and provisions of Ferrara ought to be known and determined with appeal removed, excepting those which by reason of the person acting or sued, or by reason of the case from the form of the same statutes, ordinances, and provisions, or by privileges of some forum have a particular [jurisdiction], and ought to be handled and decided before some particular judge. Moreover we grant and indulge to the same Rota cognizance of second appeals, not only from the sentences of the praetor, but also of any judges whatsoever of the whole legation and duchy of Ferrara; and we will that these same second appeals, even of the whole legation altogether, be devolved to the Rota, provided that, as to those outside the city, the value of the case exceed one hundred gold pieces by four pounds. Nor can the said auditors know any other cases in the said city and legation of Ferrara, just as the auditors of Bologna can in the city and territory of Bologna. Declaring all the aforesaid cases, even with the vote of the praetor, to be decided, excepting the cases of appeals, which are interposed from his sentences, as aforesaid.

36 § 20. In all the aforesaid matters, we decree that both the Faculty of the Priors and the Rota, in proceeding, may proceed summarily, simply and plainly, without the formality and appearance of judgment, with sole regard to the truth of the facts; but in deciding, the provisions, constitutions and statutes of Ferrara are to be observed by the same; excepting the cases of places and cities of the legation, in which their statutes and provisions, and their particular matters pertaining to decisions, if any they have or possess, we command to be observed. | 21. And since, as has been said repeatedly to curators and future guardians, we hasten toward the ending of cases and the cutting off of litigation, we order that, with the order of the statute of Ferrara set aside, both the praetor and the Rota, in cases pending before them, shall have the power of decreeing curators and guardians, and for inheritances lying unclaimed and vacant, for the absent, for minors and wards, and for all others whatsoever who might need a curator or guardian, yet so that the election of the guardian or curator to those present shall be notified by two ballots with the proper interval of one day, and to the absent, and for inheritances lying unclaimed and vacant, upon the platform of the common palace of Ferrara with loud voice and the sound of a horn being given beforehand, and the ballots shall afterwards be affixed to the doors of the same palace; and if those to whom a guardian or curator shall have been decreed appear, and request another curator or guardian, or shall name to themselves a guardian or curator legitimately constituted, the Praetor or Rota shall be bound to give another, or to order that judgment be conducted with the named guardian or curator.

37 § 22. And since it sometimes happens that, through the negligence of litigants, an appeal is lost, and the appeal itself becomes abandoned with great loss often to the negligent party, who frequently has the best right in the merits: we, having equity before our eyes, decree that, any law, statute, or constitution notwithstanding, after execution of the sentence from which appeal had been made has first taken place, and the expenses have been made good to the party up to one quarter, he whose appeal was abandoned shall be heard upon the merits by way of restitution in full to be committed by the legate, or by the prodelegate for the time being. Declaring that this is to be observed once; for if the appeal be abandoned a second time, we command that the sentence pass entirely into judgment and have full effect, lest cases be protracted indefinitely. And since it can happen that the first sentence be retracted; therefore we will that the party in whose favor the aforesaid execution shall be made shall be bound to give suitable security for the restoration of all things which by right ought to be restored to him, in the matter of the losing party's liability and retraction.

38 | 23. Finally, from all sentences and from any whatsoever, which the Rota or this Rota...

39 may give, by the tenor and virtue of our constitution, or sole revision in the same Rota, otherwise from our delegation, or that of the legates, vicelegates, or governors, we will that in no way can appeal be made, nullity however notorious be alleged or opposed, supplication be made, nor recourse be sought or granted, or even restitution be demanded to the Apostolic See even on the ground of minority of age, or the office of the judge be implored, or in any way be acted against them, but as they shall have been pronounced, they ought to be committed to complete execution; and in the case that, on account of some most grave cause, some remedy against the aforesaid sentences ought to be granted, we enact that no other remedy can be granted except sole revision to the same Rota before the same auditors, to whom, as to all, we will that no one be joined, but to them as individuals, when need shall be, only from the same Rota be one joined, since we indulge this one thing alone to our city of Ferrara and its district and legation, so that the cases thereof can in no way at any time, under whatever pretext or sought color or cause, however grave, be withdrawn from that city, even to the Roman Curia, but in it and in its Rota (which we have erected in its favor and as a sign of our affection toward it) be decided and brought to proper conclusion, the camera obligation and all other however more urgent matters whatsoever notwithstanding. Granting to the same praetor and auditors the faculty of reassuming all the aforesaid cases, even from whatsoever judges and tribunals, whenever need shall be, and of prosecuting them also in the state and terms in which they shall be found, and of inhibiting under arbitrary penalties, in the legation and outside, and of executing the aforesaid penalties.

40 | 24. Now since we have granted jurisdiction to the auditors, it is not without purpose that we also prescribe to them a certain form by which litigation can be expedited more quickly and suitably. First therefore we will that the parts of the praetor, whom we have constituted the supreme magistrate of the Rota and city, be to divide all rotal cases among the auditors.

41 § 25. We appoint these auditors and the praetor as individual judges of their respective cases; provided, however, that without the vote of their colleagues, they may neither proceed to the determination of cases nor even to the resolution of relevant articles.

42 § 26. The division of fees and emoluments shall be made through the notary, and the same notary, after sentence is rendered, shall distribute to each judge or auditor his own portion; the praetor, however, claiming no portion in the fees and emoluments of second appeals.

43 § 27. But because the judge of the case, whom we wish to be called the relator, will labor sufficiently in studying the proceedings (since we wish the state and merits of the case to be set forth by him and proposed to his assistants), and therefore he will not be able to be conveniently free for deliberation, we decree that the relator himself shall have no vote in his own case, but shall be bound to determine any article and the case itself according to the vote of the greater part of his co-auditors; unless, however, the auditors should be divided, and the votes should be equal, in which case we provide that he shall then have a vote, when he is bound to adhere to one party.

44 § 28. We wish the said Rota to be divided by the praetor by lot for cases; the vote, however, to be determined by the whole Rota. Fees to be divided by the notary. The relator does not vote in cases unless the votes of the others are equal. The Rota shall meet twice in a week, namely on Monday and Wednesday and Friday, and they shall be informed in the morning, and if Monday should be a feast day, we order it to be held at the request of the petitioning party, insofar as the matter so requires, and on the question the vote of the whole Rota shall be employed, on the following Wednesday and Friday; but if Friday should be a feast day, and Monday of the same week should be a juridical day, then it shall be held on those same days of Monday and Wednesday; and in sum we decree it to be held twice in a week on non-feast days, provided, however, that for each Rota, on one day the parties with their advocates and procurators shall inform each of the auditors at home, written informations also being left, and duplicates for the relator, so that he may give a copy to the petitioning party; and each one in the evening of the same day shall transmit to all his co-auditors his doubts which he has decided to propose in the next forthcoming Rota; on the following day they shall study the cases and receive the memoranda of the parties concerning the response to the informations given on the preceding day; on the third day they shall decide them, as far as it can be done. We leave and commit to the discretion of the auditors themselves the number of cases and articles arising to be proposed and to be proposed in each Rota.

45 § 29. In order that empty and frivolous disputation of doubts may be avoided, we provide that a case introduced into the Rota, the plaintiff shall present to the relator his memorandum concerning the doubt to be disputed, which according to the nature and requirement of speedier expedition of the case he shall formulate, and shall cite the adverse party before that judge to agree upon the doubt, and the party appearing and accepting it, shall subscribe to that doubt, and shall grant a copy to each party so that it may be able to inform upon it; but if the other party shall not have appeared, the judge shall subscribe the duplicate copy of the doubt to the petitioner, so that he may retain one for himself and be able to notify and transmit the other to his adversary by a messenger. And if the parties shall be at variance in the acceptance of the doubt, the relator himself shall strive to reconcile them as shall seem just to him; and the other matter shall be decided.

46 § 30. The terms of citations for perfecting the process before the same auditors shall be observed by the notaries and clerks and procurators, immediately after the Rota is finished; which auditors we decree may hold as observed within the next ten years, even at home.

47 § 31. And in order that depositions of witnesses may be more easily examined, and lest the auditors be fatigued more than is expedient, we order that whenever they shall have been examined by both parties or by one of them, and it shall seem good to the relator, their statements shall be reduced into a summary; and since they are examined more carefully by none than by the parties having an interest, the summary shall be made by the plaintiff, and he shall exhibit it to the relator, and the adverse party shall be cited before him to agree upon the summary, otherwise it shall be seen that reliance should be placed upon the summary presented by the petitioner, and it shall be subscribed by the said relator, and the adverse party appearing, if he shall approve the summary, it shall be agreed upon; if not, he shall add or diminish on a separate sheet, as he shall see fit, and the relator himself shall settle the differences, and the parties shall exhibit a copy of the same summary subscribed by the relator to each of the auditors.

48 § 32. But we do not wish that citations produced for agreeing upon the doubt and for agreeing upon the summary be entered in the acts, nor other citations which are not necessary for the validity of the judgment, but only those which are necessary.

49 § 33. Finally, after the expedition of cases, the Rota shall be bound to deliver the decision to the petitioning party in cases exceeding the sum of two hundred scudi. In executive cases, namely, within ten continuous days; in all other cases whatsoever within thirty continuous days from the day of the pronouncement of sentences in the said cases to be reckoned immediately.

50 § 34. And since the tribunal of the Rota is now the supreme one in judging, in the city of Ferrara and in the entire legation, it merits some prerogative, therefore we decree that the praetor of the Rota in all actions, both public and private, ought to precede the other judges, both of the city and of the entire legation, even the locum tenentes generales of civil and criminal cases, whom, after the praetor, we wish to proceed above the other auditors. We wish the auditors of the Rota itself to precede all and any judges of the same city and legation, except the two locum tenentes themselves, now and for the time being, generals aforesaid.

51 § 35. And we likewise constitute the same praetor and each individual auditor of the Rota immune from the port of letters, and from all duties, gabelles and burdens whatsoever: and moreover we also wish them to enjoy all privileges, immunities, preeminences and prerogatives, by which the counsellors of justice, in whose place the praetor and auditors themselves are substituted, have hitherto enjoyed. Finally to the same Rota Ferrarese and its praetor, and to each auditor, that by all and singular privileges, graces, faculties and preeminences, by which the Rota Bononiensis and its praetor and auditors in any way enjoy, possess and rejoice, in like manner and without any difference they may be able and have power to enjoy, possess and rejoice, we perpetually grant and indulge. Declaring that insofar as the said faculties and privileges of the Rota Bononiensis and the council of justice were formerly of the ducal state lesser than those expressed above, and the Rota Bononiensis itself possessed lesser privilege and faculty than the council of justice itself, and conversely, we in no way intend to derogate from the greater privilege, but as by the aforesaid, and each one of them more fully provided, by that greater also privilege, immunity, preeminence, emolument, prerogative, facility and grace, we decree and command our Rota Ferrarese and its praetor and each auditor to be adorned, and to possess them.

52 § 36. Moreover our beloved son Peter, cardinal of the title of St. Nicholas in Carcere Tulliano, named cardinal Aldobrandini, our nephew by our brother german, as long as he shall live, in the said Rota, and its praetor and auditors, and their rights and privileges, and whatever indults, protector with all facility and authority all and singular, as far as the office of praetor and the said auditors in any way, by force of these presents, and other things by right or custom pertain and belong, and which other similar cardinals of the Holy Roman Church, protectors, are able to do and have been accustomed to do and exercise, doing, saying and exercising, by the said authority, we also perpetually constitute and depute. § 37. Decreeing that these present letters of this bull at no time whatsoever be noted for the vice of subreptiousness or obreption, or nullity, or of our intention, or any other defect, nor that they be infringed, invalidated or revoked, but that they always and perpetually remain valid and efficacious and obtain their full and complete effects, and be inviolably observed perpetually.

53 § 38. And thus by any judges whatsoever and commissioners, even the auditors of causes of our apostolic palace itself and cardinals of the same Roman Church even legates a latere, or vicelegates, or presidents of the Apostolic Camera and clerics, and any others whatsoever, the faculty and authority of judging and interpreting in any other way being taken away from them and from each one of them, everywhere they ought to be judged, determined and interpreted. And whatever is attempted otherwise concerning these things by anyone whatsoever, by whatever authority, knowingly or unknowingly, we declare null and void.

54 § 39. And commanding all and singular of the entire State of the Church aforesaid, the commissioners, governors, potestates, and their locum tenentes, legates, vicelegates, and our venerable brothers the archbishops and bishops, and our beloved sons their vicars general in spiritual matters, and others exercising jurisdiction whatsoever, that as often as they shall be requisitioned concerning this, the sentences, decrees, statutes, sequestrations, mandates, letters of execution, remissorial letters, citations and others to be emanating from the said Rota and its auditors for the time being, by all opportune remedies cause to be executed in reality and with effect, as shall be necessary, and as shall have been committed to them.

57 § 40. Notwithstanding the constitutions, clauses and apostolic ordinances, and the prerogatives especially granted to our beloved [person] as general auditor of the Apostolic Chamber, and the aforesaid Aldobrandina constitution, as well as the statutes and customs of the same city of Ferrara and of other cities, lands and places of the aforesaid duchy of Ferrara, even those confirmed by oath, apostolic confirmation, or any other firmness, laws also municipal, uses and customs, privileges also, indults and apostolic letters even to the same province, cities, towns, lands, castles, villages and places, and their communities, universities, jurisdictions, governors, potentates, officials, and inhabitants and persons, under whatsoever tenors and forms, and with whatsoever clauses and decrees perhaps in any way issued to the contrary, confirmed and renewed. All of which, even if special, specific and express mention of them and of their whole tenors, not however by clauses general importing the same, or any other expression necessary for this, should be required, we hold the tenors of all and each of them as if they were expressed and inserted word for word in the present [document], otherwise remaining in their force, this time only, by the tenor of these [letters], specially and expressly, by our own motion, knowledge and fullness of power, we will to have derogated and to have derogated, and all other things whatsoever to the contrary.
