Explanation of the office and authority of the Superior General of the Clerics Regular of the Society of Jesus, with the grant of various favours and the establishment of ordinances for its good governance. Paul, bishop, servant of the servants of God, for perpetual remembrance.
1 Although the duty of pastoral office binds all those leading a regulated religious life, so that they may be preserved and increased in their disciplines and praiseworthy institutions, and this renders us favourable and benign towards them, yet towards the Society of Jesus, instituted and approved by us, whose example, like a fertile field in the Lord, has brought forth and daily brings forth manifold and abundant fruits of souls, to the praise of the supreme King and the increase of faith, by word and example among the Christian people, we deem it worthy to direct our eyes, as a loving father, especially towards that Society and towards those persons serving in its sweet odour to the Most High, to bestow upon them special favours and to grant them graciously those things by which the Society itself may be usefully governed and prosperously directed, and may faithfully proceed in the Lord for the aid of souls.
2 § 1. Hence it is that we, inclined by the supplications of our beloved sons Ignatius of Loyola, the present Superior General, and of the other members of the same Order, do grant that the Superior General of the said Society for the time being, as soon as he shall have been elected to its superiorship according to the constitutions of the same Society, shall by that very fact be the true Superior General of that Religion, with free, general and complete care and administration of all and singular matters pertaining to and concerning the happy governance and prosperous direction of the said Society, and shall begin to exercise his office of Superior in all things, and shall exercise his full jurisdiction over all the members and persons of the same Society and those living under his obedience, dwelling anywhere, even those having examples or any faculties whatsoever.
3 § 2. And the said Superior may and ought, through persons having authority from the said Society and deputed for this purpose, in certain cases, according to the said constitutions, to be removed, and another put in his place by the same persons, and otherwise, as the persons deputed aforesaid shall judge it to be salutarily expedient in the Lord.
4 § 3. And the Superior himself for the time being may go and send his members wherever he shall judge it expedient in the Lord, even among the infidels, and recall them, and those sent by us and our successors to any place without limitation of fixed time, when it shall seem expedient for the glory of God and the aid of souls (upon which we burden the conscience of the said Superior), may freely and lawfully be transferred to other places; who, wherever it may happen to them, at the nod of us and of the Roman Pontiff for the time being existing, to the Apostolic See, or whither it shall be fitting and shall have been enjoined upon them by the said See, according to the profession of the Society itself, we grant that they ought to come.
5 § 4. And we will, decree and ordain that the Superior, without the consent and express permission of the said Superior, and without the assent of the Society, may in no way consent to the election or provision of any person of the Society to the office of bishop, archbishop or any other dignity whatsoever, or to any prince or any chapter, or to any other persons having authority for this, made for the time being, or be admitted to it, nor shall he be capable of holding any prelacy and dignity in the same Society, if he shall be convicted of having sought it with secret or manifest ambition.
6 § 5. And that from correction made by the Society according to ordinances (so that the vigour of discipline may be better preserved) there may be no appeal, nor such appeal be admitted by any judge, nor may absolution from offices or deprivation be sought.
7 § 6. And both the Superior General and other inferior Superiors of the same Society shall in no way be bound to depute any of the priests or members of the said Society to patriarchs, archbishops, bishops or other prelates of churches and persons, as members or otherwise to any of their ministries, unless by the authority of letters of the same See, making express mention of the Society and this indult; and if it should happen that they depute any, they shall nevertheless remain under the correction of the Order, and when they shall judge it expedient, they may remove the same.
8 § 5. And that an appeal from the correction of the Rule of the aforesaid Society made according to the ordinances of the same Rule (so that the vigor of discipline may be better preserved) cannot be made, nor can such an appeal be admitted by any judge, nor can absolution from offices or deprivation be sought.
9 § 6. And both the general and other inferior superiors of the same Society shall not be bound to appoint any of the priests or members of the said Society to patriarchs, other church prelates, archbishops, bishops or other persons, or to any of their ministries, unless by the authority of letters of the same See, making express mention of the Society and of such indult; and if it should happen that they appoint any, nevertheless they shall remain under the correction of the Order, and when they shall judge it expedient, they shall be able to remove the same.
10 § 7. Those truly from among the brothers or associates appointed to the aforesaid Deputation, who shall have been assigned to preach the Cross, or to inquire against heretical depravity, or to other similar matters, Ignatius and his other successors, general superiors of the said Society existing for the time being, may freely and lawfully remove or revoke and transfer, and enjoin upon them that they cease, and substitute others in their place, whenever it shall seem expedient.
11 § 8. And to the same Ignatius and other general superiors existing for the time being, by themselves or through others appointed by them for the time, We grant power to absolve all and each of the members of the same Society and persons, under their obedience, discipline and correction existing for the time, from all and each of their sins committed before or after entrance into the said Society, as well as from any excommunication, suspension and interdict and other ecclesiastical and secular sentences, censures and penalties, howsoever established by law or by man and promulgated, and those bound by such sentences, or celebrating divine offices in places subject to ecclesiastical interdict, and receiving orders while so bound and thereby incurring irregularity; and they may dispense with them when dispensation shall be needed, unless the excesses of those to be absolved and dispensed with shall be so grave and enormous that they ought meritoriously to be referred to the Apostolic See; and lest it be often called into doubt who are to be sent to the aforesaid See, We confirm the declaration made in that part by Sixtus, Pope of blessed memory, Our predecessor, in the bull which is called Mare Magnum.
12 § 9. We will, however, that after those wishing to be received into the Society and fellowship of this kind have been absolved and dispensed with, as is aforesaid, unless they immediately enter the Order, and after the probation period, according to the constitutions of the said Society, are prepared to make vows, even if a delay be granted them in this matter by the superiors of the same Society, by that very fact they relapse and fall back into their former sentences, from which they happened to be wholly absolved.
13 § 10. Moreover, that each of the members of such a Society must confess his sins to his own confessor placed over the Society, or to one designated or appointed by him, and otherwise according to the ordinances of the aforesaid Society, unless he shall have obtained from the said superior 1 the faculty of choosing another confessor.
14 § 11. And We forbid that anyone, after vows have been made according to the aforesaid constitutions, whether professed or scholar or coadjutor, who has entered the Order of the Society of this kind, to which they cannot transfer to any other Order, even one approved by the aforesaid See, except the Carthusians only, unless with express permission of the superior himself or of the said See; and those who have departed otherwise than as aforesaid from the Order or fellowship of this kind may not be admitted, received or retained in any other, except in the aforesaid Order of the Carthusians.
15 § 12. And the general superior himself and other inferior superiors, by themselves or through others, those thus departed and any others whatsoever of the said Society who are apostates, as also any others whatsoever who are insolent and who appear to deserve it, in whatever habit the aforesaid apostates may be found, may freely and lawfully excommunicate, seize, imprison and otherwise subject to their discipline, and invoke the aid of the secular arm if need be.
16 § 13. The Society itself and all its members and persons, and all their goods whatsoever, We exempt and free from all superiority, jurisdiction, correction of any ordinaries, and take under Our protection and that of the aforesaid See.
17 § 14. And it shall be lawful for the superiors, and by their faculty for all the brothers and each member of the Society of this kind constituted in the order of priesthood, in the places in which they dwell, and wherever they may happen to reside for the time, to have oratories, and in them and in any other honest and suitable place, at a portable altar, with due reverence and honor, even in time of interdict, by any authority whatsoever, even apostolic, imposed, with doors closed, excluding the excommunicated and interdicted, in a low voice, to celebrate masses and divine offices free from the jurisdiction of ordinaries.
18 § 14. And let it be permitted to the superiors, and to their faculties by celestial authority, to all brothers and to the order to... [Note: This text appears to be corrupted or damaged by OCR errors and is incomplete. The Latin is not fully legible or coherent as printed.]
19 and to receive and minister ecclesiastical sacraments to others, provided that they themselves have not given cause for interdict, nor does it happen that it be specially interdicted to them.
20 (it is said).
21 to celebrate the divine offices, and to receive and administer the ecclesiastical sacraments to others, provided that they themselves have not given cause for interdict, nor does it happen that this is specially interdicted to them.
22 § 15. Those, however, who dwell in the houses of the aforesaid and their associates and companions may freely minister all things and ecclesiastical sacraments; and they themselves, when they depart, may be buried in their cemeteries.
23 § 16. If at any time in lands in which the aforesaid or any of them for the time being reside or are heard, a sentence of excommunication or interdict of the Society should happen to be promulgated, children or servants of the same associates, assigned to their service, and the procurators and workers of the business of the Society itself, shall in no way be subject to such sentences; and there they may hear divine services, unless they themselves have given cause, or it should happen that they are specially excommunicated or interdicted.
24 § 17. Nor shall any prelate be permitted to pronounce against anyone of the aforesaid Society or against any of them a sentence of excommunication, suspension, or interdict, contrary to the privileges of the same Society granted by Us (the interpretation of which We reserve to Ourselves and the Apostolic See); and if they shall have pronounced it, by that very fact it shall be null and void and of no force or moment.
25 § 18. And all and singular other Christians, infidels of whatsoever condition they may be, who shall attend the sermons or preachings of the word of God by the associates or brothers of the Society itself in the churches where they shall preach, may freely and lawfully hear masses and other divine offices on those days and receive ecclesiastical sacraments there, nor shall they be bound to go to their own parish churches for this.
26 § 19. And because the brothers of the same Society can and do transfer associates from place to place,
PAUL PP.
27 for which reason they cannot have a stable and continuous residence in certain and determined houses, and We have understood that in the same Society only suitable and approved men are promoted to sacred orders, We grant to the same superior general that he may present the ordinands, associates and brothers of the same Society to whatsoever Catholic bishops, having the unity and communion of the said See, as he shall prefer; and those bishops to whom such are presented, without any promise or obligation of the ordinands themselves, brothers and associates, may promote them to all orders, even sacred and presbyteral orders.
28 § 20. And since the same associates, enduring great poverty in many lands for the name of Christ, with pious zeal of exhortation strive to direct the good to better things and
29 to recall the erring to the path of rectitude in a praiseworthy manner, We grant that they may freely dwell in the lands of the excommunicated and heretics or schismatics or infidels and converse with the same, with the permission however of the superior general; and from them, then and also when it happens that they pass through those lands, they may ask for and receive the necessities of life.
30 § 21. And that none of them shall be bound to exercise correction or visitation or inquisition in monasteries or churches or to any persons whatsoever, or to proceed to the cognition of causes, citations of parties and denunciations of sentences of interdict or excommunications, or to undertake the care of nuns or any religious persons, by apostolic letters obtained or to be obtained in the future, unless this indult and the Order of the same associates make express mention thereof, by the authority and tenor aforesaid, of special grace We grant.
31 § 22. Granting to the same members that concerning those things which are in ornaments, or for them or books, building, lights, or for sustenance or maintenance of their documents, nor for the annual redemption of their decent burials, to the payment of which some houses of the aforesaid Society may perhaps be obliged; and concerning houses and colleges, and their lands, gardens and other places, granted to the same members, according to their manner of living; or concerning those things which, for the sake of such things, houses, colleges, lands and places and gardens, happen to be bequeathed or left to them by whatever persons from time to time, and other goods whatsoever possessed and obtained by the aforesaid Society and its colleges, they should pay some tithe, even papal, or exhibit a canonical portion, or be bound to the performance of procurations of legates of the aforesaid See or its nuncios, or of the ordinaries of places, or of exactions, collections or subsidies or provisions of whatever kind, nor can they be compelled to this at any time by letters of the same See or of legates or nuncios or of the aforesaid diocesans, of whatever tenor they may be, unless the same apostolic letters have made full and express mention, word for word, of this indult and concession and of their Order. And if perchance by us or the said See, concerning pious legacies disposed and left in general or in particular, a tithe or other portion or quarter has been conceded in any way to another pious or non-pious cause up to now, or if it should happen that it be conceded or paid or given or ordered in the future, we decree and will that the aforesaid members and their houses and whatever goods, and legacies and bequests to them or otherwise disposed in their favor, be in no way comprehended in such concessions and mandates, unless true, express and specific mention be made of the same and of this decree and our will in them, not through general clauses importing the same.
32 Of subsidies, i.e. (r. t.).
33 Houses and colleges given to the Society or left to it are by that very fact deemed erected by apostolic authority.
34 Goods given to the Society for the sustenance of colleges are even by apostolic authority deemed applied thereto.
35 Churches can be blessed and consecrated by any bishop, etc.
36 And newly to be constructed everywhere.
37 § 23. And moreover if it should happen that the same members, with the assistance of some prince, duke, marquis, count or community, or any person powerful and abounding in resources for this purpose, build and construct some house, church or college for the aforesaid Society, or if this be ordered by the testament of some similar person, or in whatever way such houses, churches or colleges be offered to them, with all things necessary and suitable for this, to be constructed and built, and the place offered for such construction to be received; the same houses, churches, colleges, cells, oratories, wherever constructed by the said members from time to time or given to them, by the very fact that they have been built or given, are by the aforesaid apostolic authority erected, approved and confirmed.
38 § 24. And whatever goods, for the endowment of colleges, or for the sustenance of scholars dwelling therein from time to time, given, left and bequeathed by whatever faithful Christians from time to time, are by that very fact by the aforesaid apostolic authority perpetually applied and appropriated and deemed to be so, unless they otherwise pertain to the collation of the aforesaid See.
39 § 25. And we decree that the aforesaid churches, with their cemeteries, can be blessed or consecrated and the first stone laid by whatever bishops (if the diocesans should be unwilling to do this beyond four months).
40 § 26. Forbidding all and singular archbishops, bishops and other prelates of churches and ordinaries of places, and whatever other ecclesiastical and secular powers, nevertheless commanding them that they in no way impede, disturb or molest the same members, or their houses, churches or colleges of this kind, at the request of any, wishing to build them from their own will, if this be expedient in the Lord.
41 § 27. And so that the superiors of such a Society may be able to deprive the members of all occasion for wandering, and to cut off recourse to the aforesaid Apostolic See, as far as possible, by necessity and with its permission, to the provincial superiors of the said Society existing from time to time and their vicars and local superiors, so that with persons of the same Society suffering a defect of birth from adultery, sacrilege, incest, and any other nefarious and illicit intercourse; as well as with those who have become irregular from any cause (except voluntary homicide, bigamy, and mutilation of limbs) after they have made vows in the Order itself, so that notwithstanding such defect or irregularity, they may be promoted to any orders whatsoever, even the sacred priesthood, and may minister in those orders, even at the altar; and the aforesaid irregular persons suffering a defect of birth may be freely and lawfully elected, received and assumed to any administrations and offices of the said Society, and may hold and exercise them: we grant and indulge by the authority and tenor aforesaid.
42 § 28. Moreover, since we have learned that confessors of cities, lands and places, near which the same members have their dwelling, or where it happens that they are occupied or pass through, attracted and induced by the example of the religious life which, the Lord granting, they lead, willingly flock to confess to them and to receive the most sacred Communion from their hands, so that they may be able to satisfy those thus flocking to them: we grant to all and each of the faithful of both sexes, that each one of the Society aforesaid may confess to them without the permission of his superior being required, and they are not bound to confess again to him those same sins of which they have confessed and been absolved.
43 § 29. Likewise to all and each of the faithful, both foreigners and those dwelling in the cities and places in which the aforesaid members are present, to minister the sacraments.
PAUL
44 residing or passing through, to receive the sacrament of the Eucharist (which we wish the aforesaid members to keep properly in their churches) at any time of the year, except on the feast of the Paschal Resurrection of the Lord, and at the point of death, unless necessity should press, without the permission of the rectors of their parochial churches being required, they may freely and lawfully receive.
45 § 30. Likewise, wishing to provide for the progress of souls, trusting in the mercy of almighty God and the authority of the blessed Apostles Peter and Paul, we mercifully grant and bestow by apostolic authority, to all and each of the faithful of both sexes dwelling anywhere, truly penitent and confessed, or having the intention of confessing at the times appointed by law, who shall devoutly visit some church or other pious place of the said Society once in each year, except in the year of jubilee, on a day to be chosen by the superior of the said Society existing from time to time, from the beginning of Vespers until sunset of the same day inclusive, and shall there recite the Lord's Prayer and the Hail Mary, a plenary indulgence and remission of all their sins in the form of jubilee, by apostolic authority, by the tenor of these presents.
46 § 31. And moreover on four other feasts, namely those of the Nativity, Circumcision, Epiphany, and the Body of Christ, as well as on Fridays and Sundays and the weekdays of Lent of each year, until the octave of Easter, if they shall devoutly visit the churches and other pious places of the said Society, and shall there likewise recite the Prayer and Salutation aforesaid, and shall devoutly hear the word of God if it be preached in them, we mercifully remit in the Lord seven years and as many quarantines of the penances enjoined upon them.
47 § 32. And to the general superior of the same Society, so that he may assign to lectures of theology and other faculties, without the permission of another being required for this, wherever he shall judge suitable in the Lord from among his members.
48 § 33. And so that, when he shall have sent some of the brothers or members of such a Society into the lands and provinces of Saracens and pagans and other most remote infidels, from which the Apostolic See cannot be approached, he may be able to grant them by our authority the faculty that, having heard the confession of sins of Christians dwelling there and imposed salutary penance, they may absolve them and each of them from all and each of their sins, even those reserved in the bull Coenae Domini, and from the consequent censures and penalties.
49 § 34. And with those who are converted from infidelity alone and in most remote places, who previously in unlawful degrees, yet not prohibited by divine law, had contracted marriages, to dispense that they may remain in the same.
50 § 35. And in the aforesaid most remote places, to erect whatever churches, hospitals and other pious places shall seem expedient, and now and for the time being to reform those erected, without prejudice to anyone, and to bless sacred vestments, altar cloths, corporals, chalices, altars, cemeteries (if the bishop who might do these things, a Catholic, is not present there), and to reconcile profaned churches, and to make whatever statutes and ordinances necessary concerning these matters, and after they have been made, to change, alter, and to add to and subtract from them.
51 § 36. And when the provincial superior residing in those distant parts dies, in the meantime, until another is sent by the general superior, they may freely and lawfully elect another in place of the superior so deceased.
52 § 37. And because in numerous peoples il- An. e. lb'(9 Praep. gen.

58 An. C. iJ'iO 400 To say Mass twice in a day. The scarcity of priests in those regions is so great that one must undertake the care of several peoples, so that they may be able to celebrate Mass twice on the same day in different places.
59 § 38. And moreover, having considered how much the professors of the aforesaid Society bring and are able to bring to the exaltation of the Christian faith and evangelical truth, we approve, renew and confirm all and singular the graces, immunities, concessions, privileges and indults, previously granted by us to the same Society and to its members and persons in any manner whatsoever, which we wish to be considered as specified here.
60 § 39. That the members of the said Society, who make profession anywhere other than in the city of Rome, may not emit the letters of profession without license from the Society itself, notwithstanding apostolic letters obtained by the same Society for this for some reasons for a time, we grant and indulge to them, by license of the aforesaid general superior, that they may freely and lawfully emit the same profession anywhere.
61 § 40. Likewise to Ignatius and to his other successors as general superiors of the said Society existing for the time being, without a fixed number of coadjutors, as was granted before by us to the same Society, concerning having twenty coadjutors, to extend to any others whomsoever they shall judge to be suitable, living under their obedience.
62 to be had.
63 § 41. And whatever graces, concessions and indults granted to the same general superiors of the said Society existing for the time being by us, may be freely and lawfully exercised through their vicars or persons appointed by them for this purpose, especially in the Indies and other remote parts for the time being substituted.
64 § 42. And the present letters and whatever is contained in them, from whatever cause, by reason of the vice of surreption or obreption or nullity of those letters, or defect of our intention, may in no way be noted or impugned, and

67 § 43. And that transcripts of the same, subscribed by the hand of a public notary and furnished with the seal of some canon of the metropolitan or other cathedral church, or of a person constituted in ecclesiastical dignity, ought to receive the same faith everywhere, in court and outside, as would be given to the same original letters, if they were exhibited or shown.
68 § 44. And thus by any judges and commissioners whatsoever, even exercising apostolic authority, the faculty and authority of judging and interpreting otherwise being taken away from them and from each of them, they ought to judge and decide; and if otherwise should happen to be attempted concerning these things by anyone, with whatever authority, knowingly or unknowingly, we decree it to be null and void.
69 § 45. And to our beloved sons in Christ, illustrious and noble men, princes and temporal lords and venerable brothers, prelates of the Church, constituted in whatever dignity, commending the aforesaid Society and each of its members greatly in the Lord, we exhort and beseech in the Lord not only that they permit them not to be disturbed or their privileges violated, but that they receive them kindly and with charity, as is fitting.
70 § 46. And nevertheless to all and each of our venerable brothers the archbishops, bishops and beloved sons the abbots, priors and other persons established in ecclesiastical dignity, as well as the canons of metropolitan and other cathedral churches, and of the same a Copy shall be given with credence.
