Sulle cause di nullità della professione religiosa
BENEDETTO VESCOVO
I., num.
24 Cuius expensis operam praestare debeat.
25 Defensoris partes eaedem in ulterioribus instantiis.
34 [38] Quanto precede abbia già luogo nel tribunale del reverendissimo Cardinale;
37 [41] BENEDETTO XIV. 347 An. C. 1747
38 [42] Indultum nostri remediarium restituatur in integrum Sedi Apostolicae concesso, sed concessione iudicialibus inferioribus aliquanto delegata.
39 [43] Antiqua praxis concedendi restitutiones in integrum.
45 INN. CONT. DE P. T. PARS I.

13 Snperior Regularis abstinere nequit a iudicio.
14 Potest tamen alteri suas vices delegare.
15 facultatem habere coepit. Eadem veroCongregatio declaravit, in utroque pariter casu, concessum quinquennii tempus a die emissae professionis esse computandum.

BENEDICT BISHOP
servant of the servants of God, for perpetual memory of the matter.
1 If it is not permitted to break faith given to men, and to rupture and violate those agreements which receive their force from human laws; much more is it necessary that a purpose of mind bound to God be preserved immutably, and we especially, as custodians of sacred laws established by God, ought to assert the perpetual firmness and observance of those pacts which are indissoluble by divine and ecclesiastical law. For this reason, already from the year of the Lord's Incarnation [1741], in the second year of our pontificate, we gave apostolic letters, beginning Dei miseratione, afterwards published in our Bullarium Tom. I., num. 33, by which we prescribed a certain order to be observed in ecclesiastical tribunals, when causes concerning the nullity of some marriage contracted were to be discussed and decided therein; not indeed with the design that if any marriage perchance had been entered into with some impediment dissolving it, we would prohibit judgment or decision concerning its nullity from being sought or made; but, that in this most grave kind of judgment, in which the matter concerns the sacred bond of marriages, we might consult for fuller elucidation of truth; and that judges, not without most certain knowledge of all things which greatly conduce to the matter, might by their sentences dissolve this bond, indissoluble for so many reasons, as if null from the beginning. The utility of this constitution, God favoring, is openly proved to this day; since from that time, neither do so many causes concerning the alleged nullity of marriages hang pending in tribunals; nor are petitions for obtaining dispensations concerning marriage ratified and not consummated presented to us so frequently as before: while the difficulties, somewhat indeed greater, but altogether just, which arise from the new order established by us, are to be overcome by each one before obtaining the desired outcome.
2 For the same reasons we establish a new order to be prescribed for judges concerning the nullity of religious profession.
3 Reclamation against profession within five years is admitted, and by decree of the Council of Trent.
4 before obtaining the desired outcome.
5 Just as therefore we have made provision for carnal marriages, so now concerning spiritual bonds of souls, namely religious professions of both sexes in regular orders, we have decreed to establish by like reasoning: namely to deliver a certain norm and method, which ecclesiastical judges ought to observe, whenever judgments concerning the nullity of professions made in some Regular Order approved by the Apostolic See come to be agitated before them; nor indeed to this end, that access be cut off to those who wish to bring such actions for just causes and request that a profession made by them be declared null on the ground of nullity; but, that the judges themselves may discern the truth of matters in the particular case, and may deliver their sentences resting on undoubted foundations; and lest ever, from ignorance of facts, they decree someone released from a bond, while he perhaps, having validly emitted the solemn profession of vows, remains in fact bound to the Religious Order to which he gave his name. From this method to be delivered by us we likewise hope this fruit will follow, that causes concerning the alleged nullity of professions will be rarer in tribunals in the future; and those who henceforth shall have obtained in the external forum a declaration of such nullity, and consequently shall have departed from religion, may no longer live with anxious or unsafe conscience, and therefore be compelled to have recourse to us, or to the office of our Apostolic Penitentiary, as we have known to happen more than once, concealing (as is the custom) their name in petitions, confessing that the sentence concerning the nullity of profession was extorted by them through wicked arts from the judge, either by deceiving the judge, or by lies employed in the exposition of facts, or by corrupted witnesses; and therefore begging that by grace and apostolic dispensation, the faculty of remaining in the world be granted to them.
6 In order, however, that we may proceed in an orderly manner, it must be distinguished at the outset between those Religious who within five years from the day of their profession bring an action for the nullity thereof, and those who lodge a complaint after the five-year period has elapsed. As regards the former, the celebrated decree of the sacred Council of Trent, sess. 25 on Religious, cap. 19, is well known, in these words: Whoever a Religious claims that he entered religion by force and fear, or even says that he made profession before the proper age, or something similar, and wishes to lay aside the habit for whatever reason, or even to depart while wearing the habit, without the permission of his Superiors; let him not be heard, unless within five years only from the day of profession, and then not otherwise, unless he shall have set forth the causes which he claims before his Superior and the Ordinary. In which decree, although mention is made in the letter of male religious only, nevertheless even women professed in religion are comprehended; since from the rules of law, the masculine gender also includes the feminine, where one and the same cause applies equally for women as for males. Although, however, the words of the decree are sufficiently clear, nevertheless various questions concerning their meaning and force have been raised. Since, indeed, the discourse there is only of a professed religious who contends that his profession was null: Whoever a religious claims that he entered religion by force and fear, etc., but nothing is expressly determined concerning the religion itself, whose interest it sometimes is that the profession of one of its members be declared null; as if someone, for example, should be found to have concealed some hidden impediment which he had not revealed, when questioned about it, with the declaration that, if it perhaps existed and was not disclosed, his admission by the religion would by no means be considered valid; hence it was doubted whether in such a case the superior of the religious alone could proceed without the Ordinary, or whether also in this factual matter the cause should be discussed before both the regular superior and the Ordinary of the place. Concerning which the Congregation of the Holy Roman Church of Cardinals deputed by the Apostolic See for the Interpretation of the Council of Trent itself constantly decreed that cases of this kind concerning the nullity of profession, whether brought by a professed religious or by the religion, within the five-year period and brought to judgment, should be known both by the regular superior and by the Ordinary of the place together.
7 Since, moreover, the Holy Synod wished the five-year period, within which a complaint against profession is admitted, to be reckoned from the day of profession; and since the more principal and common cause which is usually adduced for the nullity of profession consists in fear; and fear sometimes persists throughout the entire five-year period, and even beyond; it was asked whether, when fear is in question, the beginning of the five years should be reckoned from the very day of profession made, or rather from the day on which the professed began to have freedom to lodge a complaint. That decree also comprehended nuns.
8 And it proceeds equally in the case of an action brought on the part of the religion.
9 The five-year period is reckoned from the day of profession, even in the case of persisting fear and impediment to lodging a complaint.
10 An action brought within five years, although abandoned, is nevertheless judged by the Ordinary and the regular superior.
11 The regular superior for the purpose, etc., is understood to be the local superior at the time the suit was brought.
12 Likewise for nuns, unless they are immediately subject to the Ordinary.
13 The Regular Superior cannot abstain from the judgment.
14 He can, however, delegate his office to another.
15 The same Congregation, however, declared that in either case equally, the granted time of five years should be reckoned from the day of profession made. To this same five-year period pertains another question that was agitated, namely whether the aforesaid Ordinary and regular superior can know causes of nullity of profession even after the five-year period itself, where namely the professed lodged a complaint within its course, but thereafter neglected to pursue the judgment, or was unable to do so. It was decreed, however, by the same Congregation, that the cause should be heard before the aforesaid judges mentioned by the Council, even after the five-year period has elapsed, provided it is sufficiently established that it was seriously brought within the prescribed time by the one lodging the complaint.
16 Concerning the judges themselves designated by the Holy Synod for the cognition of such causes, by those words, before their superior and the Ordinary, many questions were likewise raised, which gave occasion for greater elucidation of those same words. And first it was asked, who should be considered the superior regular in the case and for the purpose of which the matter treats; namely, whether the rector of the province, or the general moderator of the order; but the Congregation of the same Council as Interpreter defined it to be the local superior, namely the abbot, or guardian, or prior, or by whatever other name the superior or rector of that monastery or convent is called, in which the one making recourse made profession; he namely who exercises the governance of such monastery or convent, at which time the cause concerning the nullity of profession is brought to judgment. It was likewise asked, who should be called the proper superior of nuns for the purpose of judging together with the Ordinary concerning the nullity of their profession. It was answered that if the matter concerns nuns immediately subject to the Ordinary, then, since there is no regular superior of theirs, the Ordinary alone judges concerning the profession of those making recourse within five years: But if nuns are subject to the governance of Regulars, then such causes are to be judged by the Ordinary of the place together and by the regular superior; by him namely to whom the entire governance of the monastery is entrusted, not however by the regular confessor of the nuns. It was also doubted whether the regular superior could cede his right to the Ordinary of the place, and permit him to proceed and judge alone in such causes; but the aforesaid Congregation denied that this could be done; it permitted however to the regular superior, that if he should not wish to assume the judgment, or should not be able, he might be able to substitute another, either regular, or even an ecclesiastical secular expert in canon law, who together with the Ordinary might exercise the office of judge. Finally it was asked, if perchance the judgments of the Ordinary and the regular superior should have differed between themselves, which of them ought to prevail. But in this case it was answered that the cause itself should be considered devolved to the judgment of the Apostolic See: Since moreover among the heads of nullity that invalidate regular profession, one is also numbered, if namely someone made profession in a convent not at all destined for the instruction of novices, in those places however in which our predecessor of blessed memory, Pope Clement VIII, ordered his decrees concerning regulars issued by him to have force; if anyone from this head should wish to impugn his profession made within five years, or also if the religion within the same five years should have requested that someone's profession be declared null from such a head; a decree exists from our predecessor of blessed memory, Pope Urban VIII, issued for just and grave causes, and by the counsel of the aforesaid Congregation of the Council of Trent as Interpreter, on 5 January of the year 1636, beginning Ad occurrendum, by which it was established that such causes belong exclusively to the same Congregation. These are the principal decrees of this kind excerpted from the registers of the aforesaid Congregation, which although they have been approved and confirmed more than once by our predecessors the Roman Pontiffs with apostolic authority, we nevertheless, by the tenor of these present letters and by similar authority, strengthen them with new force of our approbation and confirmation, and we command that they be held as a rule in the future by all to whom it pertains, or shall respectively pertain, and be committed to full execution.
17 These things being thus established and the pertinence of causes confirmed, which within five years from the day profession was made are introduced against its validity; it follows that we also indicate those things which concerning the order and method to be observed in such judgments have been wisely established by our predecessors; then we set forth those things which we ourselves have deemed should be appropriately added, and which by equal authority and by the force of these present letters we wish to be observed for perpetual future times. When judges dissent among themselves, the cause is devolved to the Apostolic See.
18 To the same See belong exclusively the causes of professions made.
19 outside convents assigned for the novitiate.
20 We decree and command. Now concerning the introduction of such causes themselves, a decree of the Apostolic See of the same Council of Trent cited, Sess. 25, on the judgment of Regulars, cap. 19, is to be noted, that if anyone has previously voluntarily laid aside the habit, he is in no way to be admitted to allege any cause whatsoever, but is to be compelled to return to the monastery and be punished as an apostate; meanwhile he is helped by no privilege of his religion. From which it follows that a regular requesting that judgment be made concerning the nullity of his profession is to be repelled from the threshold of the judge himself, unless it is established that he dwells in the cloisters of his religion and has resumed the regular habit, if he had previously laid it aside.
21 .... As to proofs however, although the rigor is not to be ignored ....
22 we would approve, among the superior regulars, the Ordinance in Dibos, and professions [of the] Hosque according to the usage received in those places. YQ of such moment, to found their judgments on extrajudicial attestations, however much confirmed by oath, which are said to be perpetual; yet we prohibit this from henceforth to be used; wishing, and strictly commanding, that for establishing the proofs necessary in such cases, a true and judicial process be altogether conducted: in which both articles shall be exhibited on the part of him who acts against the profession; and interrogatories shall be given by that part which stands for the validity of the profession itself; and witnesses shall be examined both upon the articles and according to such interrogatories; and that, this form not being observed, the process itself and the sentence dependently pronounced from it shall be deemed to fall with an incurable defect of nullity, the disposition of common law being also saved, as to other heads of nullity, if any perhaps have intervened in the compilation of the process itself. They must be cited Under the same penalty of nullity, we decree, and establish, that in this judgment there must be cited and heard both the defenders of the monastery or convent, in which the professed received religious vows, and the relatives of the professed himself, whether near or distant, or others to whom he gave or ceded his goods; in a word all those to whom it concerns that his profession be sustained; but especially let those be cited (if they survive) who shall have been indicated as authors or accomplices of the fear inflicted upon him, so that he might bind himself unwillingly to vows. And just as in our cited constitution, which begins Dei miseratione, we decreed that in individual dioceses there should be appointed by the Ordinary some person commended for probity and learning, whose office it should be to stand in judgment in matrimonial cases for the validity of marriage; so now we commit and command to all and each of the Ordinaries of places, that they elect in their respective dioceses some person endowed with similar qualities, to whom they impose the office of defender of professions; and that to this one all things entrusted, enjoined, and respectively applied be deemed to be, whatsoever we have established in the aforesaid letters concerning the defender of marriage; for we ourselves, by the tenor of these presents, expressly extend all the same things to such defenders of professions, and respectively apply them, and decree that they have place in the same manner as to these. This alone we establish peculiarly for the defender of profession in these presents, namely that whatsoever the judge shall prudently judge ought to be paid for his honorarium or fee, or for expenses occurring in the defense of the case, all of it ought to be paid by those to whom goods renounced by the professed in entering religion were given; but if these do not exist, or if the professed had nothing to renounce, the religion itself, insofar as it is of those which possess temporal goods, shall be bound to such payments: but if neither renounced goods are at hand, nor the Regular Order of which the matter is, possesses anything, then satisfaction is made to the defender of profession from the monies of the fines of that tribunal in which the case shall have been tried, or of another, as we have established in our other aforesaid letters concerning the defender of marriage.
23 Finally, sentence having been pronounced by the superior regular and by the Ordinary of the place, if it be pronounced for the validity of the profession, and the professed does not interpose an appeal, the case is not doubted to be finished. But if the professed shall have appealed to the judge of the second instance, or if the same case must be retried even further; in all these judgments we wish similarly a defender of profession appointed ex officio to intervene, in the very same manner as in the cited constitution we decreed that the defender of marriage should always be present in judgment in the second and further instance. And just as we have moreover established that the parts of such a defender be to appeal from the sentence of the judge of the first instance pronounced for the nullity of marriage to the judge of a further instance; and we have prescribed the form of proceeding in judgment in further such instances; so further we wish that the defender of profession from the sentence in the first instance pronounced for the nullity of profession ought altogether to appeal, and in the second or further such Defender of profession to be appointed ex officio.
24 At whose expense he ought to render his work.
25 The same parts of the defender in further instances.
26 From the first sentence pronounced for nullity it must always be appealed. A sole sentence pronounced for the nullity of profession is suspended in execution.
27 In the second and further instance the cases shall be devolved to those to whom by law.
28 Another regular superior to be assumed for judging.
29 of the review of cases, we wish all the same things to be observed which we have commanded in the same constitution for matrimonial cases.
30 Just as we have established legitimate penalties therein against those who, after obtaining a single sentence for the nullity of a prior marriage, whether while an appeal was pending, or because it was not interposed through the negligence or fraud of the defender, dared to contract new nuptials; and we have decreed that it is permitted to no one to proceed to other vows unless two sentences at least, conformable to each other, for the nullity of the prior marriage have been pronounced; so, if anyone professed in a Regular Order, after a single sentence pronounced in favor of the nullity of profession, whether while an appeal was pending or culpably omitted, presumed to leave the cloister, to depart from religion, and what is more, to cast off the regular habit; we will and decree that he be subject and liable to all the penalties and censures enacted and sanctioned in the sacred canons and by apostolic constitutions against apostates; decreeing likewise that in such cases concerning the nullity of profession, it is not permitted to the professed to depart from religion unless he shall have obtained two sentences at least, conformable to each other, by which the profession emitted by him shall have been declared null and void.
31 [35] And the judges of the first instance indeed, over the validity of professions which are judicially impugned within five years, as has been said above, ought to be the superior regular and likewise the Ordinary of the place. But if those same cases are to be discussed in the second or further instance, we decree, adhering to certain ancient decrees of the aforesaid Congregation of Cardinals, interpreters of the Council of Trent (which we likewise approve and confirm by the tenor of these presents), that such cases be devolved to those judges to whom all other ecclesiastical cases, after the sentence of the Ordinary, in the grade of appeal are respectively devolved; yet so that these judges also, just as the Ordinary in the first instance proceeded together with the superior regular, so they too ought to proceed and judge together with the superior regular, not indeed of that monastery in which the reclaiming professed made profession, but of another monastery of the same order existing in their city or diocese, or, that not existing, with the superior of the nearest monastery of the same order likewise, or with another ecclesiastical person to whom, according to the foregoing, that superior to whom it pertains shall have delegated his authority for this purpose. But if such cases in the second or further instance are devolved to the Apostolic See, and are to be discussed by the aforesaid Congregation of the Council, or by another over the consultations of Bishops and Regulars, or finally by the auditory of the Rota, as is respectively customary; there will be no place for the superior regular to judge; who is not then admitted to pronounce sentence, when the validity of the profession impugned on that ground shall have been examined by the same Congregation of the Council, according to the decree of Urban the predecessor related above, even within the five years, because it is asserted to have been made in a monastery or convent not at all devoted to the instruction of religious novices.
32 [36] Thus far concerning the judgments over the nullity of profession which are introduced within five years from the day of the profession itself emitted; concerning which, declaring also this, we decree that whatever has been established in the foregoing, all those things ought to have place and be observed even in the Curia of the Holy Roman Church, of the Cardinal, our and the Roman Pontiff's Vicar in spirituals general in the City and its district for the time being; whenever it happens that such cases within the same five years are to be judged in his ordinary tribunal. Now indeed it is to be seen concerning cases of the same kind; which, after the lapse of such five years, are brought to judgment.
33 [37] Moreover, since the Holy Tridentine Synod, after five years from the profession emitted have passed, decreed that every access to reclaiming be closed to the professed, by those open words related above: Let him not be heard unless within five years from the day of profession; so much did our predecessors adhere to the letter of such a sanction, that under our predecessor of pious memory, Pope Gregory XIII, it was decreed and as it were established as a rule, that the introduction of no case concerning the nullity of profession, after the five years had elapsed, was to be admitted; even if the profession were said to have been made by force and fear, and such force and fear were to be proved to have persisted throughout the whole time of the five years. The words of the decree issued on 5 March of the year 1578, which are found in the decrees of the Congregation of the Council, Vol. 9, fol. 55, are these: Gregory XIII, by the opinion of the Congregation of the Council declared, those who by force and fear

38 [42] Our indult concerning the restoration of the integrity of the Apostolic See concerning concessions made to inferior judges in some measure delegated.
39 [43] Ancient practice concerning the granting of restitutions in integrity.
40 [44] professed members claimed, unless they had protested within five years, after that time had elapsed, they were not to be heard, even if they alleged that force and fear had persisted throughout. But truly, as time proceeded, not without just and serious causes, as We are fully persuaded, it was brought about that petitions for restitution in full against the lapse of five years were admitted. Concerning these, however, judgment to make has always belonged exclusively to the Apostolic See, whether such petitions were proposed on the part of the professed member or on the part of the religious community, and although the protest itself was said to have been delayed on account of an impediment persisting throughout the entire five years. For this remedy of restitution in full is called extraordinary in law, the power of granting which cannot belong to inferior judges, notwithstanding any contrary custom, even immemorial, or any asserted privilege; as is evident from several decrees to the same effect of the same Congregation, Interpreter of the Council of Trent, which were reviewed in the decree issued on 24 September of the year 1640, in the Sicilian case of restitution in full, which was approved and confirmed by Us Ourselves on 28 of the same month and year, and which again by the tenor of these presents We approve and confirm; reserving to Us and to Our successors, the Roman Pontiffs, the right of granting to Ordinaries and local superiors, in certain particular cases, the faculty of examining even cases of restitution in full, and of pronouncing upon them, before they proceed to rendering judgment upon the validity or nullity of profession; as We are not unaware that this has been done more than once by dispensation of the Apostolic See.
41 The method of this judgment was once different from that which is now observed. For in ancient times, a probable reason being seen, or smoke, as they say, of cases of restitution in full, it was granted by the Apostolic See; namely, the faculty was indulged to those protesting against profession, so that, although five years had elapsed, they could nevertheless promote an action concerning its nullity before competent judges; for the instruction of which judgment a process was thereafter made by the regular superior and by the Ordinary of the place, and judgment was rendered upon validity or nullity. Which method indeed, if it were also in use at this time, it would be necessary for Us to have regard especially for those things which are consequent upon such judgment; and to provide, lest regular professions be dissolved by the force of one sentence alone. But another order is in use at the present time, which in the aforesaid congregations, or tribunals of the City, for granting restitution in full against the lapse of five years, is observed; for before anything is decreed concerning it, it is committed to the Ordinary of the place and the regular superior, that they make a process; and that having been sent, a doubt is proposed concerning the granting of restitution in full and it is examined no less accurately and severely, as if the doubt proposed were concerning the very validity or nullity of profession. But if restitution in full sought is granted, then it is committed to the Ordinary and local superior, that they render judgment upon the disputed validity of profession. But although in such commissions full faculty is left to them of judging either for validity or for nullity of profession, as it shall seem just to them; yet by experience it has been found that, when the same ones know well enough with what diligent and grave judgment cases have been discussed at the Apostolic See, on account of which restitution in full was granted; upon seeing merely such a rescript of concession, and without further instituted examination, they proceed for the most part without hesitation to render judgment for the nullity of profession.
42 Accurate examination of such cases of restitution in full by the judges of the Roman Curia placed in custom, We not only do not intend to change, but also by Our approval to each one to whom it pertains, We greatly commend, and We will and command that it be observed by them henceforth; with this addition, however, that in the commissions which are directed to regular superiors and Ordinaries of places for making processes, to them, under penalty of nullity of acts, it shall be enjoined, that in all things they ought to proceed with the intervention of a defender of profession; to whom truly it shall pertain to give interrogatories, according to which witnesses ought to be examined, and other things pertaining to the office imposed upon him to perform most diligently. Likewise We will, that in the very proposition of a doubt concerning the granting of restitution in full, both in the aforesaid Congregations of Cardinals, Consultation on the Interpretation of the Council of Trent and of Bishops and Regulars presiding, and in the aula, now concession is not made, unless by prior process and examination of cases.
43 The sentences of ordinary judges are for the most part in conformity with the judgment upon restitution in full.
44 The defender of profession ought to assist both in the making of processes concerning cases of restitution in full, and in the examination of cases at the Holy See.
45 INN. CONT. DE P. T. PARS I.
46 A twofold examination of this kind is required before the Ordinary and superior are able to proceed.
47 How long the one making objection ought to remain in religion.
48 Observance of the foregoing is enjoined upon all to whom it pertains.
49 And upon superiors the observance of the canons, constitutions and rules of the Church.
50 of the Rota, or in whatsoever congregation perhaps specially appointed for this, under a like penalty of nullity, a defender of profession, appointed by him who is the head of the tribunal, at the expense of those mentioned above, ought always and in all judicial acts to stand; and not only in the first presentation of such doubt, but also in subsequent proceedings; so that the one making objection, if rejected in the first instance, may be admitted to a new hearing. Finally, so that for enjoying the benefit of restitution in full, a single favorable resolution may by no means suffice, unless it be confirmed by a second conformable resolution, upon a renewed examination of the case, and the defender of profession always being heard; just as in another constitution of ours, cited at the beginning of the present, concerning cases on the nullity of marriage, we have decreed; we by the tenor of these presents decree, and under the penalties sanctioned against apostates we strictly prohibit that no one under the shield of a single resolution for the granting of restitution in full obtained, dare or presume to depart from religious cloisters, and much less to lay aside the regular habit: since to avoid the aforesaid penalties, both another resolution on restitution in full consonant with the first, and a sentence on the nullity of profession to be pronounced by the regular superior and by the Ordinary, ought altogether to be awaited: nor can judgment be deemed absolute save by such a sentence legitimately pronounced by the aforesaid judges, with the two prior resolutions for the granting of restitution in full having preceded it. All which things if they shall be observed as they have been constituted by us, and as they are to be carefully observed and fulfilled by all to whom it pertains and shall pertain in the future, as we prescribe and earnestly inculcate; we certainly do not doubt that petitions and contentions of those who either within five years from the day of profession made, or even after that time has elapsed, attempt to abandon the undertaken institute of religious life will be far rarer in the future. To obtain this more certainly, it will greatly help if the superiors also of the regular Orders shall observe in the admission of novices those things which are both established in their Constitutions and in the decrees of our predecessor of happy memory, Pope Clement VIII, all of which we likewise command and enjoin upon them to be most fully observed and fulfilled; then also if they themselves shall not so readily give their consent that novices, or those who have indeed completed the age prescribed by the Council, but have not attained to that which is established by the constitutions of the Order, or those who, although they have completed a year of novitiate according to the norm of the Council, ought nevertheless to remain in it further, according to the prescription of their particular constitutions; and much more those who have not undergone their trial for a full year, but for eight or six months only; and finally if the superiors themselves shall not interpose, nor take care that professed persons be promoted to sacred orders before legitimate age. For whatsoever things are providently established either in the sacred canons or pontifical constitutions, or in the particular statutes of the Orders, concerning the foregoing, have no small weight in establishing religious vocation in the hearts of men, and in restraining the fickle mobility of souls, which, for the most part, is either the sole or the principal cause by which professed persons are led to desire that the vows by which they are bound be declared null. Nor has the Apostolic See ever been accustomed to grant any dispensations in the foregoing except with the prior assent, or even with the added prayers of the regular superiors; to whom it is indeed just and necessary that credence be given in the exposition of the causes which they assert they urge for the granting of the dispensations which are sought. But that which can by no means be borne or approved, and yet is known to have prevailed among very many, is namely that those making objection against profession, whether within five years or after its lapse, the superiors themselves do not show themselves as opponents, or even openly connive, from a false opinion, namely, that a man ought to be deemed rejected from the society of religious men and cast out, whoever desires to depart from it; and that from a useless monk, perhaps a useful secular cleric might exist. For it is never lawful to abandon or betray justice, which commands that in every way there be upheld an act so solemn, and by its nature irrevocable, in the performance of which, together with the professed person, religion itself also is involved.
51 To the aforesaid end, moreover, it will be of the greatest benefit if ecclesiastical prelates and judges do not neglect to fulfill the duties of their office properly. Church prelates indeed, if they shall declare subject to anathema all and each, of whatever quality, condition and dignity they may be, who shall have compelled virgins, or widows, or any other women whatsoever against their will, except in cases expressed in law, to enter a monastery, or to receive the habit of any religion, or to make profession; according to the sanction of the sacred Council of Trent, Session
52 XXV, Cap. 18 on Regulars, where also equal censures are established against those who shall have given counsel, aid or favor in such deeds; and likewise all those, as many as shall have dared to compel men to enter religion and to make vows, shall be afflicted with just and grave penalties. Judges truly, if, laying aside beforehand all prejudice, which some believe a very broad path ought to be opened, as far as possible, to those who wish to depart thence, where they remain with unwilling mind; shall weigh all things at the exact balance of justice and shall consider the number and quality of witnesses who are brought forward to prove the nullity of profession; and shall distinguish greater force from lesser, grave fear from light, weakness of the weaker sex from constancy, the faculty of reclaiming being cut off from that being permitted; and shall carefully observe all other circumstances, which in this whole class of matters are wont to be considered by authorities.
53 Therefore we most gravely announce and strictly command all and each of the aforesaid, that in all things which pertain to their offices, they depart not even in the least from the path of justice and from the laws prescribed to them, and let them remember that for all things whatsoever they shall have done, they shall render a most severe account both before the divine Judge and before men. We truly, if it shall please God to preserve us in health together with life, intend to apply no small effort, so that more clearly and easily causes of this kind may be judged by them hereafter. For it is our purpose, with the counsel of select men excelling in theological and canonical learning, to examine carefully and settle certain questions, which, tossed about by various opinions of writers and taking on various forms, according to the different circumstances of cases occurring, are wont to keep the minds of judges in doubt and anxiety; as we ourselves, when constituted in a lesser position, have more than once experienced, when, in the office of secretary of the aforesaid congregation of Cardinals, interpreters of the Council of Trent, we had such causes at hand to be required according to the rule of law. Such are, for example, the questions: Whether a profession, although null at the beginning, may be validated by subsequent acts; what acts are those from which such validation or ratification is induced; and what weight the reception of sacred Orders has toward this effect at the title of religious property. Furthermore, if anyone perhaps before legitimate age, ignorant, shall have made profession, and in that ignorance shall have remained in religion for several years, and, believing himself validly professed, shall have performed all things that are of the professed, together with his companions, whether he then, understanding at what age he made vows, notwithstanding acts of true profession performed by him, still, by the protection of the aforesaid ignorance, has an action to reclaim against the profession made by him; or whether such ignorance shall avail him nothing, so that profession null at the beginning shall not be deemed to have been ratified by subsequent acts. Likewise, whether a professed person, who in the act of profession concealed some impediment or defect, concerning which he was questioned, with the addition of a declaration according to the form of the Constitutions, namely that the religion did not intend to admit him with such defect or impediment perhaps concealed; whether, I say, such a professed person, who has practiced fraud against the religion, can derive such advantage from his own deceit, so that he may be able to impugn the validity of his profession on that ground. Finally, whether it ought to have any force in the external forum to persuade the judge of the nullity of profession, which reclaiming professed persons often do not hesitate to assert, that they kept a mind alien from the purpose of binding themselves in professing religious vows. All these things, and others similar, frequently occurring in such judgments and hitherto disputed on both sides, both by our own study and that of others, whom, as we have said above, we shall call into counsel, we have resolved, with God's aid, to explain with diligent care.
54 Meanwhile we will and decree that these present letters, together with all clauses for and each and every one in the same decrees and statutes, be confirmed, valid and efficacious, and shall be perpetually so, and shall obtain and secure their full and complete effects, and by those to whom it pertains and shall pertain at any time hereafter, in all things and through all things most fully and inviolably to be observed. And thus and not otherwise by any judges ordinary and delegated, even auditors of causes of the apostolic palace, and the aforesaid congregations general and particular of the S. R. Church, and other cardinals of the same S. R. Church, even Legates of the Lateran and Nuncios of the Holy See, and any others whatsoever exercising or about to exercise any preeminence, authority and power, with faculty taken away from them and from each of them of judging and interpreting in any other manner, everywhere to be judged and defined; and null, void and invalid, if otherwise concerning these things by anyone, by any authority knowingly or unknowingly should happen to be attempted. Notwithstanding which, as well causes perhaps introduced to this day pending, which indeed causes, in whatsoever states and terms they may be found at present, according to the above prescribed are to be treated, judged and defined entirely; as our and the Apostolic Chancery rule of not taking away acquired right, and other apostolic, and in universal, provincial and synodal councils issued, general or special constitutions and ordinances, decrees also and resolutions by the aforesaid congregations of Cardinals, whether by the aforesaid Rota auditory, or by any other judges and tribunals whatsoever, otherwise perhaps, and otherwise made, drawn up and issued, as well as by any oath, apostolic confirmation, or any other firmness strengthened statutes, privileges, exemptions, and indults, even in the body of law closed and apostolic letters to any persons, colleges, places, orders, even military, congregations, societies and institutes, even of the Society of Jesus and of St. John of Jerusalem, or any others whatsoever worthy of specific and individual mention, even under any tenor of words and forms, and with any clauses and decrees, even of derogatory clauses derogatory and invalidating in general, or in particular, even by similar motion, and from the fullness of apostolic power, or consistorially, and otherwise in any manner whatsoever in contrary to the aforesaid granted, and many times confirmed, approved and renewed. All and each of which, even if for their sufficient derogation, of them, and their whole tenors, special, specific and individual mention, or any other expression to that end to be observed were required of their tenors, forms, causes and occasions, the present ones having for fully and sufficiently expressed and most exactly served and specified respectively, those otherwise in their strength remaining, this time only and for the effect of the aforesaid, most fully and amply by equal motion we derogate, and will to be derogated, and all other things contrary whatsoever. We will moreover, and by the same authority aforesaid command, that these same present letters and whatever is contained in them be brought more easily to the knowledge of all, nor may anyone be able to pretend ignorance of them, these present letters themselves, or their copies, at the doors of the church of St. John in the Lateran, and the basilica of the Prince of the Apostles in the City, as well as the Apostolic Chancery, and the general court of Innocent on Monte Citatorio, and in the Field of the Flower, by someone from our couriers, as is the custom, to be published and affixed, and thus published and affixed, all and each, whom they concern, or shall concern in the future, to affect and bind in the same manner, as if to each of them personally intimated and notified had been.
55 And that to copies or exemplars of these same present letters, even printed, subscribed by the hand of some public notary, and furnished with the seal of some person constituted in ecclesiastical dignity, the same faith altogether both in judgment and outside it, everywhere in all places be held, which would be held to these present letters themselves, if they were exhibited or shown.
56 Let no one therefore at all be permitted to infringe this page of our confirmation, approval, will, commands, statutes, decrees, derogations, or to dare to act contrary to it. If anyone, however, shall presume to attempt this, let him know that he will incur the indignation of Almighty God, and of the blessed Peter and Paul his Apostles.
