4 § II. Notizia di tale corruzione da abolire Ci è stata riferita da diverse parti, e sono stati indicati anche esempi di alcuni uomini che, dopo la prima, la seconda e la terza moglie che avevano sposato a causa della troppa precipitanza dei Giudici nel dichiarare la nullità dei matrimoni, mentre vivevano ancora quelle prime mogli, erano giunti a contrarre quarte nozze; e similmente di donne che, dopo il primo, il secondo e il terzo marito, si erano unite anche a un quarto, mentre questi vivevano ancora, non senza scandalo dei piccoli e detestazione di tutti i buoni, i quali soffrivano che i sacri vincoli del matrimonio fossero così disprezzati e temerariamente infranti. Noi, comprendendo ciò, colpiti da grave dolore, abbiamo gemuto nell'intimo dell'animo, e non abbiamo omesso di adempiere le parti della Nostra sollecitudine apostolica nel Signore. Infatti, nel primo anno del Nostro Pontificato, con lettere pienissime indirizzate ai Vescovi di quelle regioni in cui erano accaduti i fatti predetti, ci siamo gravemente lamentati di tale corruzione, che era tollerata nella Chiesa di Dio, e abbiamo curato di elevare i loro animi e accendere lo zelo pastorale per abolirla: cosa che abbiamo fatto anche con i Vescovi di altre regioni, dove abbiamo saputo che tale corrotto uso di sciogliere i matrimoni si era introdotto. | § III. Ma Ci è stato risposto che ciò accade spesso in parte per colpa di quei Giudici, ai quali, sia nella prima istanza, quando la causa non può essere conosciuta davanti al Giudice ordinario per qualche legittima causa, sia nella seconda, quando nelle parti non esiste alcun Giudice al cui Tribunale la causa sia devoluta in grado di appello, o se esiste, la causa giusta non può essere discussa davanti a lui, le cause matrimoniali di tal genere sono commesse dalla Sede Apostolica, i quali sono propensi, sia per ignoranza sia per cattiva volontà, a sciogliere i matrimoni, e dichiarano gli stessi matrimoni irriti e invalidi con esame leggero o addirittura nullo; in parte anche per fatto dei Coniugi che litigano sulla nullità dei loro matrimoni, poiché frequentemente uno solo di essi, colui che chiede lo scioglimento del matrimonio, compare in giudizio, e la sentenza, senza alcuna contraddizione, è ottenuta secondo i suoi desideri, e passa a altre nozze; o quando entrambi i Coniugi vengono in giudizio, uno agisce per il matrimonio, l'altro contro, e dopo la sentenza di nullità del matrimonio pronunciata, nessuno è che interponga appello al Giudice superiore, o perché i litiganti sono in apparenza discordi, ma in realtà concordi tra loro, e reciprocamente desiderano che il matrimonio contratto sia sciolto;

Constitutio Benedicti XIV super causis nullitatis matrimonii.

4 $ II. Huiusmodi autem abolendae pravitatis notitia diversis ex partibus Nobis delata est, atque etiam indicata sunt exempla nonnullorum virorum, qui post primam, et secundam, ac tertiam, quam duxerant, Uxorem ob nimiam Iudicum praecipitantiam in nullitate Matrimoniorum declaranda, adhuc illis primis Uxoribus superstitibus, ad quartas contrahendas nuptias devenerant; et similiter foeminarum, quae post primum, secundum, et tertium maritum, quarto etiam, illis quoque viventibus, se iunxerant, non sine pusillorum scandalo, et bonorum omnium detestatione, qui sacra Matrimonii vincula ita contemni, et temere perfringi dolebant. Nos autem, his intellectis, gravi affecti dolore 1ntimo animo ingemuimus, et non praetermisimus Apostolicae Nostrae sollicitudinis partes in Domino adimplere. Siquidem primo Pontificatus Nostri anno ad. Episcopos illarum Partium, in quibus praedicta acciderant, plenissimis datis litteris, graviter conquesti sumus de huiusmodi pravitate, quae in Ecclesia Dei tolerabatur, et ad eam - abolendam eorum animos erigere, et pastoralem zelum accendere curavimus: quod etiam egimus cum alis aliarum regionum Episcopis, ubi huiusmodi pravum dirimendorum Matrimoniorum usum irrepsisse cognovimus. | $ III. Verum Nobis responsum est, id saepe contingere partim ex culpa illorum Iudicum, quibus vel in prima instantia, cum causa coram Iudice ordinario ex aliqua legitima causa cognosci nequit, vel in secunda, cum in partibus nullus adest Iudex, ad cuius Tribunal Causa in gradu appellationis devolvatur, vel si adest, iusta causa coram eo disceptari nequit, causae matrimoniales huiusmodi a Sede Apostolica committuntur, qui vel ob inscitiam, vel ob malam voluntatem proclives sunt ad Matrimonia dissolvenda, atque eadem Matrimonia, levi vel etiam nullo habito examine, irrita, ac invalida declarant; partim etiam ex facto Coniugum super nullitate suorum Matrimoniorum litigantium, cum frequenter unus tantum eorum, qui disolutionem Matrimonii postulat, in iudicio compareat, et sententia, nullo contradicente, secundum sua vota obtenta, ad alias nuptias convolat; vel ambobus Coniugibus in Iudicium venientibus, alter, qui pro Matrimonio, alter vero, qui contra agit, sententia de nullitate Matrimonii prolata, nullus est, qui ad superiorem Iudicen appellationem interponat, vel quia litigantes in specie quidem discordes, re vera inter se concordes sunt, et invicem Lon. contractum Matrimonium T NA cupiunt;

Constitution of Benedict XIV on the causes of nullity of marriage.
BENEDICT, BISHOP, SERVANT OF THE SERVANTS OF GOD, FOR PERPETUAL REMEMBRANCE OF THE MATTER
1 By the mercy of God, whose judgments are incomprehensible and whose ways are unsearchable, placed as we are in the highest seat of the Church, so that we may diligently keep watch over the entire flock of the Lord, we recognize that it pertains to the office of pastoral care committed to us to root out utterly the abuses arising from the cunning of the infernal enemy and the malice of men, by which both harm is brought to the salvation of souls and injury to the Sacraments of the Church, and to exert the power granted to us from above, so that human rashness may be restrained and the venerable authority of Divine Law may be preserved.
2 § I. Since the covenant of Matrimony, instituted by God, which insofar as it is a duty of nature is perpetual and indissoluble for the sake of the education of offspring and the preservation of the other goods of Matrimony; and insofar as it is a Sacrament of the Catholic Church cannot be dissolved by human presumption, the Savior himself pronounced with his own mouth, saying: What God hath joined together, let no man put asunder, it has come to the ears of our Apostolic office that in certain Ecclesiastical Courts, with excessive facility and lack of consultation on the part of Judges, this is being broken, and sentences rashly and inconsiderately pronounced concerning the nullity of these Matrimonies, giving power to the Spouses to pass on to other vows. These indeed improvident Judges ought to have been admonished by the condition of human nature, and in a manner by the very voice itself, lest with such precipitate audacity they should break the holy bond of Matrimony, which the first parent of mankind forewarned to be perpetual and indissoluble, saying: This now is bone of my bones, and flesh of my flesh, and that which was added: Wherefore a man shall leave father and mother, and shall cleave to his wife, and they shall be two in one flesh.
3 § II. Knowledge of such wickedness to be abolished has been brought to us from diverse parts, and examples have also been indicated of certain men who, after the first, second, and third wife whom they had married, on account of excessive precipitance of Judges in declaring the nullity of Matrimonies, while those first wives were still living, had proceeded to contract fourth nuptials; and similarly of women who, after the first, second, and third husband, had even joined themselves to a fourth, those also living, not without scandal to the little ones and detestation of all good people, who grieved that the sacred bonds of Matrimony were thus despised and rashly broken. We, however, having learned these things, were affected with grave sorrow and groaned in our inmost heart, and did not omit to fulfill the duties of our Apostolic solicitude in the Lord. For in the first year of our Pontificate, having sent most full letters to the Bishops of those regions in which the aforesaid things had occurred, we complained gravely of such wickedness, which was tolerated in the Church of God, and took care to direct their minds toward abolishing it and to kindle their pastoral zeal: which we also did with other Bishops of other regions, where we learned that such a wicked practice of dissolving Matrimonies had crept in. § III. But we were answered that this often happens partly from the fault of those Judges, to whom, either in the first instance, when the cause cannot be heard before the ordinary Judge for some legitimate reason, or in the second, when in those regions there is no Judge to whose Tribunal the cause devolves in the grade of appeal, or if there is one, a just cause cannot be heard before him, such matrimonial causes are committed by the Apostolic See, who are inclined either from ignorance or from ill will to dissolving Matrimonies, and declare the same Matrimonies, with slight or even no examination, null and void; partly also from the action of the Spouses litigating over the nullity of their own Matrimonies, since frequently only one of them, who seeks the dissolution of the Matrimony, appears in court, and the sentence, with no one contradicting, having been obtained according to his wishes, he passes on to other nuptials; or when both Spouses come to court, one acting for the Matrimony and the other against it, after sentence of nullity of the Matrimony is pronounced, there is no one who interposes an appeal to the superior Judge, either because the litigants, though discordant in appearance, are in reality in agreement with each other, and mutually desire the contracted Matrimony to be dissolved;
4 § II. Now this knowledge of such corruption to be abolished has been brought to Us from various parts, and examples have also been indicated of certain men who, after a first, second, and third wife whom they had taken, on account of excessive precipitancy of judges in declaring the nullity of marriages, while those first wives were still living, had proceeded to contract fourth nuptials; and similarly of women who, after a first, second, and third husband, had also joined themselves to a fourth, those also living, not without scandal to the little ones and detestation of all good men, who grieved that the sacred bonds of matrimony were thus contemned and rashly broken. We, however, upon learning these things, affected by grave sorrow, have groaned in our inmost soul, and have not failed to fulfill the duties of Our Apostolic solicitude in the Lord. For indeed in the first year of Our pontificate, having sent most full letters to the bishops of those regions in which the aforesaid things had occurred, we complained gravely concerning such corruption, which was tolerated in the Church of God, and we took care to rouse their minds and to kindle their pastoral zeal toward abolishing it: which we also did with other bishops of other regions, where we learned that such a corrupt practice of dissolving marriages had crept in. § III. But We were answered that this often happens partly from the fault of those judges, to whom, either in the first instance, when the case cannot be heard before the ordinary judge from some legitimate cause, or in the second, when in those regions there is no judge to whose tribunal the case in the grade of appeal devolves, or if there is one, a just cause cannot be heard before him, such matrimonial cases are committed by the Apostolic See, who are inclined either from ignorance or from ill will to dissolving marriages, and declare the same marriages, with light or even no examination had, null and invalid; partly also from the action of the spouses litigating over the nullity of their marriages, since frequently only one of them, who seeks the dissolution of the marriage, appears in court, and the sentence, with no one contradicting, obtained according to his wishes, flies to other nuptials; or both spouses coming to judgment, one acting for the marriage, the other against, after sentence of nullity of marriage is pronounced, there is no one who interposes an appeal to the superior judge, or because the litigants, though discordant in appearance, are in reality in agreement with each other, and mutually desire the contracted marriage to be dissolved;
5 or because the Party, which stood for the validity of the Marriage and was sharply contesting its nullity against the adversary, after a sentence has been pronounced by the Judge against the Marriage, changes its will, or because money for the expenses of the suit is not available to it, or because other aids necessary for litigating are lacking, and abandons the undertaken work and cause after the first sentence. Whence it comes to pass that afterwards both Spouses, or one of them, proceeds to another Marriage.
6 § IV. As for those matters which pertain to Judges, to whom matrimonial cases are committed outside the Roman Curia for the convenience of litigants, with that paternal vigilance by which we ought to be solicitous that justice be administered to each person whole and wisely, we have taken care to provide by encyclical letters written to our Venerable Brethren the Patriarchs, Primates, Archbishops, and Bishops on the twenty-sixth of August in the second year of our Pontificate, in which we prescribed those things which, if diligently observed as we hope, are consonant with the Sacred Canons and the decrees of the Council of Trent, so that henceforth cases shall be committed only to persons furnished with suitable knowledge of law and the necessary protection of proven probity and fidelity. Furthermore, to those things which have been established in those same encyclical letters, we also add this in the present document: that, although the decree of the Council of Trent, by which matrimonial cases were withdrawn from the jurisdiction of Deans, Archdeacons, and other inferior judges, and reserved to the examination and jurisdiction of Bishops alone,

10 yet it applies only to Archdeacons, Deans, and other inferiors who, constituted in the same Diocese, either by some privilege or by prescription, at least in visitation, had arrogated to themselves the cognition of matrimonial cases; therefore commissions which are made by the Apostolic See to any of them in the second instance for the purpose of deciding those same matrimonial cases shall in no way be an obstacle; nevertheless we command and enjoin those to whom the care of expediting such commissions or delegations pertains, that in the future they shall not commit the cognition of matrimonial cases except to Bishops, especially those nearer at hand, or if there be no Bishop to whom it can conveniently be committed for a legitimate reason, then the commission and delegation shall be directed to one of those who, according to the order and manner prescribed by us in the aforesaid encyclical letters, shall have been named as a suitable Judge by the Bishop with the counsel of his Chapter.
11 § V. But as regards the order and procedure of judgments in matrimonial cases to be observed for their due and proper termination, by our own motion, certain knowledge, and mature deliberation, and from the fullness of Apostolic power, by this our sanction to endure in perpetuity, we constitute, decree, and command that by all and each of the Ordinaries of places in their respective Dioceses some suitable person shall be chosen, and if it can be done, from the ecclesiastical order, endowed with knowledge of law and likewise with probity of life, who shall be named the Defender of Matrimonies, with the faculty however of suspending or removing him if a just cause shall have arisen, and of substituting another equally suitable and adorned with the same qualities, which also may be done whenever the person designated for the defense of matrimonies, when the occasion of acting shall have presented itself, shall be legitimately impeded. § VI. Now to the office of the Defender of Matrimonies thus elected as above, it shall pertain to come into judgment whenever it shall happen that matrimonial cases are disputed concerning the validity or nullity before a legitimate Judge, and he ought to be cited in every judicial act, to be present at the examination of witnesses, to defend the validity of the marriage by word and writing, and to adduce all those things which he shall deem necessary for sustaining the marriage. § VII. And finally, the person of such a Defender shall be considered as a necessary party for the validity and integrity of the judgment, and shall always be present in the judgment whether one of the spouses, who acts for the nullity of the marriage, or both, of whom one acts for nullity and the other for validity, come into judgment. But the Defender, when such a duty shall be committed to him, shall take an oath to faithfully discharge his office, and whenever it shall happen that he ought to be present in judgment for defending the validity of some marriage, he shall again take the same oath: but whatever shall have been done in the judgment without him being legitimately cited or notified, we declare null, void, and invalid, and we will that it be held as null, void, and invalid, just as if that party whose citation was necessary and whom according to the prescription of laws and canons it was altogether necessary to cite or notify for the legitimate validity of the judgment had not been cited and notified.
12 § VIII. When therefore before the Ordinary, to whom it pertains to know cases of this kind, some controversy is brought forward in which doubt shall arise concerning the validity of Matrimony, and there being in the judgment either one of the Spouses, who acts for the nullity of Matrimony, or both, of whom one pursues an action for validity, the other for nullity, the Defender of Matrimony shall diligently fulfill all parts of his office. Therefore if the Judge shall pronounce judgment for the validity of Matrimony, and there be no one who appeals, he himself shall also abstain from appeal: and this likewise shall be observed if the Judge of the second instance shall have pronounced judgment for the validity of Matrimony, after the Judge of the first instance had pronounced sentence concerning its nullity; but if on the other hand sentence be rendered against the validity of Matrimony, the Defender shall appeal within the legitimate time, adhering to the party which acted for validity; and when in the judgment there is no one who insists on the matter for the validity of Matrimony, or if he be present, sentence having been rendered against him, he shall desert the judgment, he himself shall appeal ex officio to the superior Judge.
13 § IX. With an appeal from the first sentence pending, or even none having been interposed on account of malice, or negligence, or collusion of the Defender and the Parties, if both or one of the Spouses shall have dared to celebrate new nuptials, we will and decree that not only those things which have been established against those who contract Matrimony contrary to the prohibition of the Church be observed, especially that they be separated from cohabitation with each other, until another sentence concerning nullity shall have been issued, from which no appeal shall have been made within ten days, or an appeal having been interposed shall have been thereafter abandoned; but further that the contracting party or parties, Matrimony of this kind shall be wholly subject to the penalties established against Polygamists by the Sacred Canons and by the Apostolic Constitutions, which we upon them, insofar as it shall be necessary, by our own motion, knowledge, and similar power again establish, decree, and renew.
14 § X. After the cause shall have been brought to the second instance before another Judge by the benefit of appeal, all and singular whatever things were prescribed to be observed before the Judge in the first instance shall likewise be exactly and diligently kept before the other in the second, the Defender of Matrimony being cited in every act of judgment, who shall strenuously and to the best of his ability defend the validity of Matrimony by voice and in writing, and if the Judge in the second instance shall be the Metropolitan, or a Nuncio of the Apostolic See, or a neighboring Bishop, let the Defender of Matrimony be he who shall have been appointed by them, as we command them to appoint, so that he may be able to perform those things which have been established by us above; but if the Judge in the second instance shall be a Judge Commissary, to whom the cognition of the cause has been committed by the Apostolic See, and who does not have tribunal and ordinary jurisdiction, and therefore lacks a Defender of Matrimony, we will that he use that Defender of Matrimony who shall have been constituted by the Ordinary in whose Diocese he shall know the cause, even if the same Ordinary be he who pronounced the first sentence in the same cause.
15 § XI. The judgment having been thus instructed, if the second sentence be conformable to the other, that is, if in the second as well as in the first the Matrimony be judged null and void, and by the Party or Defender for his conscience it shall not have been thought necessary to appeal, or having interposed an appeal they shall not have deemed it necessary to pursue it, it shall be in the power and discretion of the Spouses to contract new nuptials, provided that to neither of them is this forbidden on account of some impediment or legitimate cause. The power however after another conformable sentence, as above, made to the Spouses shall be understood, and shall have place, the right or privilege of matrimonial causes always remaining safe and firm, which on account of the lapse of any time never pass into a matter judged; but if a new matter, which shall not have been brought forward or shall have been unknown, be discovered, they can be resumed and again recalled into judicial controversy. But if from the second sentence concerning nullity either party shall have appealed, or it be of such a kind that the Defender of Matrimony cannot in good conscience acquiesce in it, either because it appears to him manifestly unjust or invalid, or because it shall have been rendered in the third instance and be revocatory of another preceding sentence concerning validity issued in the second instance, we will that, the prohibition remaining firm to both Spouses against passing to other nuptials, which if they shall have dared to contract, we decree that they be subject to the penalties as aforesaid established by us, the cause be known in the third or fourth instance, all things being diligently observed which have been committed by us in the first and second instance, namely in every judicial act the Defender of Matrimony being cited and heard, appointed by the Judge of the third instance.
16 § XII. The Defender of Matrimony, whom We exhort in the Lord to undertake his duty freely for the love of God and the utility of our neighbour and reverence for the Church, if he refuses to render his service without any fee or salary for any reason, shall have it assigned to him by the Judge of the Cause itself, and shall be paid by that party which acts for the validity of the Matrimony, if he has the means; if not, it shall be provided by the Judge of the first, second, or third instance respectively, who shall be able to apply money collected from the fines of their tribunals, or to be collected, and to be expended in pious works, to such expenses. But when the judges of the cause shall be Commissary Judges, who have neither a forum and consequently neither money collected from fines, We will and command that the Defender of Matrimony be satisfied from the money of the fines of that Bishop in whose Diocese the Commissary Judge shall exercise judgment according to the mandate of the Apostolic See.
17 § XIII. Thus far indeed concerning matrimonial causes which are handled outside the Roman Curia. But concerning causes which are to be decided at Rome, since their cognition in the first instance pertains to the Cardinal of the Holy Roman Church, Our Vicar in spiritual matters for the time being in the aforesaid City, its Suburbs, and district, We command and order that all and singular things which have been prescribed in other causes handled outside the Roman Curia, namely that judgment be carried out with the Defender of Matrimony cited and heard, appointed by the same Cardinal Vicar, and other things as above be altogether observed, then also in other causes which in the first instance by consent of the parties, or in the second by appeal to the Apostolic See, omitting the intermediate stage, interposed, or in the third are brought to Rome, all of which We will to be judged either in the Congregation of the Cardinals of the Holy Roman Church on the interpretation and execution of the Council of Trent, or in the Audience Hall of Our Palace, provided it does not seem to Us and to the Roman Pontiff for the time being for just causes that a particular Congregation of the Holy Roman Church or of the Prelates of the Roman Curia should be appointed. But when a cause concerning the nullity of Matrimony shall be agitated in the said Congregation of the Cardinals of the Holy Roman Church, Interpreters of the Council of Trent, the Defender of Matrimony shall be appointed by the Cardinal Prefect of the same Congregation; if truly in the Audience Hall of Our Palace, by the Dean Auditor of the aforesaid Tribunal; if finally in a particular Congregation, by the more dignified Person of the same Congregation.
18 § XIV. A single resolution indeed for the nullity of Matrimony emanated, if the cause be known in the Congregation of Cardinals, Interpreters of the Council of Trent, or in a particular Congregation appointed, and likewise in the Audience Hall of Our Palace a single sentence pronounced on the same nullity shall by no means suffice to grant to the Spouses free faculty to contract new nuptials, but if the cause shall have been introduced in the aforesaid Congregation of Cardinals of the Council of Trent, let it be again proposed in the same at the instance of the Defender of Matrimony; if truly it shall have been committed to a particular Congregation, at the petition of the same Defender another particular Congregation also shall be appointed; if truly it shall have been judged in the Audience Hall of Our Palace, an appeal being interposed by the aforesaid Defender, it shall be determined by others according to the order in rotation or turn; if however the cause shall have been committed to the whole Tribunal, it shall be examined again by all the Auditors, We being unwilling altogether that in no case the bond of Matrimony be deemed dissolved unless two judgments or resolutions or sentences entirely similar and conformable, from which neither the Party nor the Defender of Matrimony believed should appeal, shall have emanated; but if it shall have been done otherwise, and a new Matrimony begun, let the transgressors of Our will in this manner be subjected to the penalties established by Us as above.
19 § XV. And since petitions are often presented at the Apostolic See for a dispensation of a ratified and non-consummated marriage, which are for the most part referred by consultative vote to the Congregation of the Cardinals of the Holy Roman Church, Interpreters of the Council, or sometimes to some particular Congregation appointed by the Roman Pontiffs from time to time, so that such petitions may proceed in order and properly, we will and command that a supplicant petition be presented to us, or to the Roman Pontiff for the time being, in which the full and accurate account of the entire matter be contained, and all causes be expressed in it which the supplicant believes could conduct to obtaining the requested dispensation, so that the Roman Pontiff, having read it and carefully considered it, may deliberate with himself whether to reject the petition, or to commit its examination to one of the said Congregations, from which, after its consultative vote shall have been given, by the Secretary of the same Congregation the entire series of the matter shall be accurately reported to the Roman Pontiff for the time being, who according to his prudence shall judge whether the resolution of the Congregation is to be approved, or rather the examination of the entire cause is to be committed again to another Congregation, or Tribunal, as shall seem good to the same Pontiff. § XVI. Finally we will and decree that these same present letters shall always be firm, valid, and effective, and shall have and obtain their full and complete effects, and shall be observed by those to whom it pertains, and for the time being, in all things and through all things most fully and inviolably. Thus and not otherwise by whatsoever Ordinary and Delegate Judges, and also Auditors of the Cases of the Apostolic Palace, and the same Cardinals of the Holy Roman Church, even legates a latere, and Nuncios of the Holy See, and any others whatsoever exercising or about to exercise any preeminence and power, with the faculty and authority of judging and interpreting otherwise taken away from them and from each of them, everywhere it ought to be judged and defined, and null and void, if otherwise anything concerning these things shall happen to be attempted by anyone whatsoever with any authority knowingly or unknowingly. Notwithstanding the foregoing, and Apostolic constitutions and ordinances, as well as any statutes and customs even strengthened by oath, Apostolic confirmation, or any other firmness, privileges also, indults, and Apostolic letters of whatsoever tenor and forms, and with whatsoever derogatory and other more efficacious and unusual clauses irritating and other decrees even by motu proprio, knowledge, and fullness of power equal in general, or in particular, or otherwise howsoever granted, confirmed, and renewed. All and singular of which, even if for their sufficient derogation special, specific, express, and individual mention of them and their entire tenors, and word for word, and not through general clauses importing the same, or any other expression, or some other exquisite form delivered in them ought to be observed, we having these present for expressed and inserted, those otherwise remaining in their force, for the purpose of the foregoing this time only we expressly derogate, and to all other things contrary whatsoever.
20 We will, however, that these present letters be published and affixed on the doors of the Lateran Church, and of the Prince of the Apostles, as well as of the Apostolic Chancery, and in the area of the Campus Florae of the City, as is the custom, and thus published and affixed, all and singular whom they concern, shall be bound and affected in the same way, as if they had been intimated to each of them by name and personally; and that to the transcripts or copies of these same present letters, even printed, subscribed by the hand of some public Notary and furnished with the seal of some person constituted in ecclesiastical dignity, the same faith shall be given both in judgment and outside it everywhere, which would be given to these same present letters, if they were exhibited or shown. § XVII. Therefore let it be lawful for no one whatsoever to infringe this page of our decree, statute, constitution, prohibition, revocation, annulment, declaration, mandate, and will, or to dare to act rashly against it. But if anyone shall presume to attempt this, let him know that he shall incur the indignation of Almighty God, and of the Blessed Apostles Peter and Paul.
