1 concerning the reform of the cases of the palace of the Apostolic Auditory, otherwise the Rota Romana, and Paul V, Roman Pontiffs our predecessors, also in their year of the same Incarnation 1612, on the first of March, concerning the reform of the tribunals of the aforesaid City, under the title of the Auditory of the Rota, respectively expedited by letters, they established in the same tenor of words which follows: "That a due measure be imposed upon the fees, the auditors may not by the parties through themselves or another in any way by the name of fees ask for or exact anything, nor yet from those giving willingly beyond the tax written below receive, namely: In pecuniary or secular cases, or which otherwise by price in any way may be valued, if the valuation of the matter of which it shall be a question does not exceed the sum of one thousand ducats, ten gold coins; from one thousand moreover up to ten thousand, twenty-five; from ten thousand up to twenty thousand, fifty; from thence above up to whatever sum, one hundred. In beneficiary cases moreover, if the annual revenue of which it shall be a question does not exceed the sum of one hundred ducats, likewise ten; from one hundred moreover up to one thousand, twenty-five; from one thousand up to three thousand, fifty; from thence moreover above, one hundred gold coins for the fees of whatever definitive sentence only, as is aforesaid, they may receive. If moreover a case does not easily admit of valuation, moderate fees for the quality of things and persons according to the aforesaid taxes may be received. Nor may anything beyond not only to the auditors themselves, but nor to their servants or relatives, or to any other persons whatsoever, directly or indirectly, by any sought colour or device, be given in view of the sentences or auditors, excepted foods and drinks which may be consumed within three days. Which fees indeed according to the aforesaid tax at the notary of the case after the subscribed sentence and delivered to the notary, and not before, to be deposited, and to be consigned to the auditor we wish; and that the notary the deposit and consignment of this kind in the acts note and specify is bound to."

2 § 2. Similarly the same Pius predecessor by the aforesaid Pontiffs the same in other his letters concerning the reform made was of the tribunal auditor of cases of the Chamber of the Apostolic Chamber, under the date of the year of the Incarnation aforesaid 1612, on the fourth day before the Ides of June, the words written below reassumed in the aforesaid letters of Paul the predecessor, under the title of auditor of the Chamber and his tribunal thus he enacted: "In ordinary cases the aforesaid auditor, or his locum tenens in civil matters, shall not receive fees, nor the notary anything for the note of the sentence, but in commissarial and declaratory contumacial cases only." And there: "In cases which ordinarily according to the auditor's faculties in his tribunal have been introduced or can be introduced, whether after the case begun a commission supervene, or before it was obtained, or in the first, or in a further instance, in nothing let him increase the expense, but as to this let the case always be held for ordinary, so that also by reason of the sentence neither notaries nor judges who for this reason receive beyond that which they could receive if the commission were not present. We permit however his locum tenens in civil matters, in cases by commission from the beginning introduced, even of their nature ordinary, on account of the great assiduity of labors and the meagerness of emoluments, to receive moderate fees according to the present constitution. Declaring nevertheless in all other respects cases to be understood as ordinary, nor notaries anything further to be able or to owe to exact, than in other ordinary cases is permitted."

3 § 3. Likewise the aforesaid Paul predecessor in the aforesaid his letters concerning the reform of the tribunals of the City to others

4 determinations in the matter of civil cases and fees became known under the title namely of the Capitol and its officials through these words: "The Captain of Appeals for the revocation or moderation of any inhibitions shall accept fees in no way": but under the title concerning the criminal judges of the City, as follows: "The criminal judges of the City, or their lieutenants, and their subordinates, to whom a certain salary has been established by us, being content with that, shall accept nothing whatsoever either of money or of any other thing whatsoever, even of the smallest quantity, from anyone even willingly giving, nor for fees or gratuities of sentences, or for decrees, absolutions or relaxations whatsoever in whatsoever cases even delegated and to commissioners, nor in any other manner, title or name, even of gifts or regalia, although of food or drink, even in cases otherwise permitted by law or by any constitution, under the penalty of deprivation of office, and of unfitness hereafter for any judicial office, and other penalties to be inflicted at our and our successors' discretion. The Camerlengo, treasurer and presidents of the Chamber, likewise rectors of hospitals, confraternities and other pious places or colleges, and any others whatsoever having jurisdiction in the City in criminal matters and the faculty of appointing judges, shall not appoint in criminal cases other judges than some one of the ordinary judges well-pleasing to them, who ought to receive no fees, as has been sanctioned above." Again under the title concerning judges in civil cases: "Mandates for maintaining in the most summary possessory action, no judge shall give, except by way of decree, not however by schedule, nor shall anything of fees or gratuities for them be accepted even from those willingly giving." Finally under the title concerning fees or gratuities: "No judge of the ordinary judges of the City and Roman Curia of whatsoever

6 dignity, even worthy of special note, in ordinary civil cases on account of fees or gratuities shall accept anything whatsoever even from those willing to give. In commissioners likewise in civil matters, where the sum of twenty-five scudi is in question, and below, nothing whatsoever; from twenty-five up to one hundred inclusive, three scudi; from one hundred up to two hundred, six scudi; from two hundred up to any sum whatsoever, ten scudi, and not beyond. For any declaratory sentence on account of non-compliance with a monition in contumacy, not beyond seven and one-half julii. For a declaratory sentence in the execution of letters, or otherwise having the force of a definitive sentence, if the sum be certain, let them accept according to the aforesaid rate, but if uncertain, and the action be for the execution of the letters themselves, let them accept according to the quality of the case and person, provided it be not beyond five gold coins. For any interlocutory sentence or decree before a definitive sentence, nothing whatsoever. Likewise and for a decree of mandate for maintaining, likewise a decree of moderation of inhibition, and much more for a decree of taxation of expenses, nothing whatsoever shall be received. But the Captain of Appeals of the Curia of the Capitol shall receive fees according to the rate established by the statutes of the City, not however in cases interdicted to him by this constitution. But the aforesaid fees, or gratuities, as above rated to judges, in no way may be accepted except from the hands of the notary of the case, and the sentence first subscribed by them; and therefore the notaries ought to have a book, in which they note the said fees or gratuities, when they are deposited for the judges; where, when afterwards the sentence is given to the judge, the judge himself by his own hand noting the deposit shall subscribe that he

7 has received it; which thus as above given to the judge, shall thereafter be placed entirely among the expenses of the litigation to be taxed and refunded, and shall be refunded to the victor, any contrary usage notwithstanding."

8 § 4. Finally, to be remembered, Innocent XI, Pope of blessed memory, also our predecessor, in his letters expedited upon the confirmation of the decree of the Congregation of the Reformation concerning the fees of judges of the tribunals of the City, in the year of the aforesaid Incarnation 1689, on the fourth day before the Kalends of July, confirmed and ordered to be inviolably observed among other things a decree of the same Congregation under the title concerning fees or gratuities, the tenor of which decree is as follows1: "Whereas, among other things which are disposed by the constitution of Paul V of blessed memory upon the reformation of tribunals, that in particular is earnestly commanded, that no judge of the ordinary judges of the City and of the Roman Curia of whatsoever dignity, even worthy of special note, in civil cases on account of fees or gratuities shall accept anything whatsoever even from those willing to give of their own accord; but in commissioners likewise in civil cases, where the sum of twenty-five scudi is in question, and below, nothing whatsoever; from twenty-five above up to one hundred inclusive, three scudi; from one hundred up to two hundred, six scudi; from two hundred up to any sum whatsoever, ten scudi, and not beyond: but certain complaints of litigants have come to the ears of the Most Holy Father against the non-observance of the same constitution in this part: wherefore, by his command, the matter having been maturely and repeatedly examined, it was decreed and declared, that the aforesaid constitution prohibiting fees to ordinary judges, ought to be observed by all judges, who are not truly commissioners, according to the universality of the letter and words, with whatsoever limitation or interpretation, or argument, or contrary custom being set aside and rejected; and that ordinary judges are all those who are appointed to some university or some kind of cases, so that commissioners are only those who by special commission are appointed to certain and particular cases, and these are bound likewise to observe the said constitution, so as in no way to exceed the sums of gratuities taxed by it, and to be able to exact more. But in order that all occasion of doubting or contravening be removed, the Congregation thought fit to express and enumerate, who are the ordinary judges of the City and of the Roman Curia; and these are written below, others not excluded, insofar as they are present (yet in no way shall it be prejudicial to them as regards those fees or gratuities which are expressly and literally, not however by arguments or inferences and interpositions, or by understood meanings, conferred and attributed to them by the same constitution of Paul V, or by privileges and particular apostolic concessions, not however by custom), and these are as follows, with the declaration, that by the description no order shall be deemed to be established, nor shall anything be prejudicial to anyone: the lord cardinal camerlengo, and his auditor and judges appointed even in criminal cases; the lord cardinal vicar, and his vice-gerent and locum tenens, and other judges appointed by him; the lord cardinals archpriests of the three patriarchal basilicas, and their vicars and auditors and others appointed; the lord cardinal titulars in their titles of the City, and in six bishoprics, and their vicars, auditors and others appointed: the lord cardinals protectors of colleges, monasteries, hospitals and pious places, and their auditors, and other judges and appointed; the lord governor of the City, and his locum tenentes, and civil judges, one or more, etc; the lord auditor of the chamber, and his locum tenentes, and judges appointed; the lord senator of the City, and his colleagues, captains of appeals, and others appointed; the lord general treasurer, and his auditor, and other judges appointed by him even in criminal cases; the lord presidents and prefects respectively of roads, grain, mint, riverbanks, provisions, archives and prisons, and their auditors, and others appointed; the lord prefect of the sacred apostolic palace, and his auditor and locum tenens1, and others appointed, both as regards Palatines, and as regards Tusculum and the Citadel of Gandulph, and villas; the lord commissioner of arms, and his auditor, or others appointed; the lord judge or auditor of confidential matters, judge of the fabric of St. Peter, judge of soldiers, judge of the Castle of St. Angelo, judge of triremes or maritime fleet, assessors of aediles or masters of roads, consuls of agriculture, camerarii of riverbanks, protophysicians and consuls of arts or merchants and customs. With this declaration added, that such disposition shall have place even if the said judges or appointed proceed in the grade of recourse, or in second or other instances, which would be competent to the aforesaid tribunals; and all the aforesaid and other ordinary judges are still such according to the norm of the same constitution, and are comprehended in the aforesaid prohibition, although a commission should come to them, or that they be enjoined to proceed by or with the vote of the Rota or of another tribunal or person, or that they profess to proceed for the execution of apostolic letters, or by virtue of whatsoever general deputation, and as often as there is not an express and special deputation to certain and particular cases, they can be said to be true commissioners, as above, saving however as regards the auditor of the Chamber the disposition of the said constitution of Paul V in the section concerning the auditor of the Chamber, § We permit however; and otherwise whatsoever also voluntarily paid ought to be deemed illicit. And therefore both judges and notaries receiving are deemed to incur the penalties inflicted by apostolic constitutions, nor shall what is thus paid come under the condemnation and taxation of expenses; nay rather, so that to those who have paid there may be competent restitution both from the judge and from the notary at their election, without it being possible that any custom to the contrary be ever induced, and which is declared to be null, void and reprobated, it was decreed and declared. And that those judges both ordinary and commissioners, to whom by the same constitution of Paul V or by special indult it is granted to be able to exact fees, as above, cannot in the whole case exact, except a single gratuity according to the rate, as above, although there were several persons in the case, so that if victory touch both or more parties, all proportionably and pro rata concur in paying the said single gratuity, nor shall division of sentences or points, and their reservation, avail anything in this; so that the same judge in the same case receive but a single gratuity." Thus far the decree confirmed in the aforesaid letters of Innocent the predecessor.

9 § 5. Desiring therefore to provide more abundantly for the indemnity of so many litigants flowing together to the aforesaid City, even in this matter, and to settle and ward off controversies and grievances concerning such fees, insofar as it is granted to us from on high, and moreover to look more fully to the honor and dignity of the entire Roman Curia, so that its judges, advocates, and the litigants themselves may more conveniently and easily have in one place, weigh, and carry out for execution those things which have been established and declared by us and by the aforesaid predecessors of ours, by our own motion, from certain knowledge and mature deliberation, and from the fullness of apostolic power, as well as from the counsel of certain beloved sons of the same Roman Curia, prelates and men distinguished in piety, learning, prudence and practical experience, gathered together by our mandate for this purpose, we approve, confirm and renew the aforesaid letters of our predecessors Pius, Paul and Innocent in those respects in which they are compatible with the declarations or decrees written below, and by the tenor of these presents we add to them the strength of perpetual and inviolable firmness, and we decree and ordain that they be observed by all and each whom they concern, entirely and under the penalties contained therein for those acting contrary, and with all the decrees therein made, whose tenors we wish to be held as fully and sufficiently expressed in these presents, as if they had been inserted word for word. We do not intend, however, by the recitation or enumeration of judges and tribunals in the aforesaid portions of the letters of our predecessors Paul and Innocent as confirmed above, in any way or in any even minimal part to recede from the suppression, abolition and abrogation of certain of the same judges and tribunals, which we established and ordained in our other letters issued in the year of the Incarnation aforesaid 1692, on the 18th day of September, but we wish and command that the same suppression, abolition and abrogation, with all things contained therein, remain safe, unharmed, untouched and unimpaired, and in all and each of their parts to be observed, kept and carried out inviolably and unshakably.

10 § 6. Moreover (to settle the daily controversies which are wont to arise from the importunity of litigants and especially of those who lose, concerning the interpretation of the aforesaid letters of our predecessors Pius, Paul and Innocent in taxing the fees and honoraria of delegated judges and tribunals of the said City, especially in that part in which it is determined that where a case does not easily admit of valuation, moderate fees according to the quality of things and persons may be received in accordance with the rates established in the same letters), by motion, knowledge, deliberation and fullness of power equal to the foregoing, as well as by similar counsel of the said prelates and men, we have decreed to come to the underwritten declarations or sanctions to be religiously observed in all cases to be expedited hereafter.

11 i. And first in cases of any kind of urban and rural servitudes of lands, rights of redemption, or rights of use, the taxation of fees shall be made according to the measure of the servitude itself or right brought into litigation, and its valuation shall be derived only from that which by reason of the said servitude or right is accustomed to be diminished or increased in law from the value of the matter in controversy.

12 ii. In cases of adoptions, arrogations, legitimations, filiations, and similar matters, fees ought regularly to be regulated by the value of the matter likewise brought into judgment, namely by the value of the inheritance, if an inheritance is sought, by the value of maintenance if maintenance is sought, and so in other cases.

13 iii. In cases of precedence and other preeminences or rights between private persons, both ecclesiastical and secular, the taxation of fees may not exceed twenty-five gold coins; between magnates, however, colleges, chapters, universities and similar bodies, fifty or one hundred gold coins, having regard nevertheless to the quality of things and persons.

14 iv. In cases of patronage rights, if the dispute be between those presented, fees shall receive no increase, even if the patrons are in the case by adhering to or assisting their presentees; but where the patron or patrons have pressed the matter in the acts for canonization of their right in the petition, then, whenever the petition for canonization is granted in the sentence, the value of fees shall be commensurate with the value of the benefice; and the same shall be observed in cases in which the matter concerns the right of instituting, electing, nominating or conferring one or more benefices, or any other similar right.

15 v. In cases of maintenance, ecclesiastical pensions, and in other rights of a lifetime nature, the valuation of fees shall be made according to the measure.

16 vi. In cases in which the matter concerns the right of tithing, receiving a share, or perpetually exacting some annual payment, whether in kind or in money, the rate or valuation in exacting fees shall not exceed that which would correspond to the capital of the annual payment itself, no account being taken of the annual payments or fruits accrued while the suit was pending.

17 vii. Where a commission has supervened while a case is pending before an ordinary judge, so that he may proceed with or by the vote of the Rota, or of another tribunal or congregation, then the same ordinary judge may not receive any fees in pronouncing sentence; but if he shall have been a delegated judge, the fees to be received by him shall not exceed ten gold scudi.

18 viii. And the same measure of ten gold scudi shall not be exceeded by any prelate or ordinary judge of the Roman Curia in cases truly delegated or commissioned, even if he shall be the Camerlengo of the Holy Roman Church for the time being, in the City and its district vicar general in spiritual matters, prefect of the said City, general auditor of causes of the Camera of the Apostolic Chamber, senator of the said City, or general treasurer of the said Camera, under the pretext that the matter is of great value, or that it has been thus observed in their tribunals commonly or repeatedly.

19 ix. The same shall be observed in cases committed to a Congregation of several prelates, or with or by the vote of the same or of the same ones; for, although the cases be of greater importance, nevertheless no greater fees than ten gold scudi can be received by individuals.

20 x. If there shall have been agreement between the parties or otherwise withdrawal from the suit, even by one of the parties, yet by way of pure and free renunciation in any instance and at any stage of the judgment before the definitive sentence, the litigants cannot in any way be compelled to expedite the sentence or to pay fees.

21 xi. Such declarations shall respectively be observed both in the Rota and in the Camera, and in all other whatsoever tribunals and judges of the aforesaid City, to whom it is not prohibited by apostolic constitutions and other ordinances to be able to receive fees or gratuities. xii. For the declaration of the reforms or letters of Paul and Innocent aforesaid everywhere under the title concerning fees or gratuities, we will and decree that no ordinary judge of the aforesaid City in cases and matters in which the execution and verification of the decrees of our Congregations is in question shall be able to receive anything whatsoever by reason of fees, even from those willing to give of their own accord, nor in the aforesaid cases and matters shall it be lawful for notaries to make registers, but all things both by judges and by notaries shall be completed by ordinary law as in other cases and matters of their tribunal.

22 xiii. Finally, wherever in this matter of fees any question shall have arisen concerning the interpretation, declaration or execution of these and the aforesaid letters, as is aforesaid, confirmed by Pius, Paul and Innocent our predecessors, we decree that recourse shall be had to the judgment and declaration of the said prefect of the City and of two more worthy in order succeeding from the Congregation for the reform of the tribunals of the said City, who, if it shall so appear to them, may also seek the vote of the same whole Congregation, all other recourse and appeal being removed.

23 § 7. Decreeing that these same present clauses, letters, and in them respectively all things contained whatsoever, even for the reason that all and each of the aforesaid, and all others whatsoever in the premises in any way having right or interest or pretending to have it, of whatsoever status, degree, order, preeminence or dignity or otherwise worthy of specific and individual mention and expression, have not consented to the same premises, nor have been called or heard concerning them, although by the force of their indults and privileges they ought to have consented or been called and heard once or repeatedly in any way whatsoever, or from any other juridical and privileged cause, color, pretext and ground; even in the body of the law closed, at no time whatsoever by the vice of subreptiousness or obreption or nullity, or of our intention, or of the consent of those having interest, or by any other defect whatsoever, however great and formal and substantial, be noted, impugned, broken, called into controversy, reduced to the terms of law, or against them opening of the mouth, restitution in full, or any other whatsoever remedy of law, fact or grace be attempted or obtained in any way; but the same letters always and perpetually exist and shall be valid, firm and efficacious, and ought to produce and obtain their full and complete effects, and be inviolably observed by all to whom it pertains and for the time being in whatsoever manner and way it shall pertain, and thus, and not otherwise, by whatsoever ordinary and delegated judges, even auditors of causes of the apostolic palace, and the said Camerlengo of the Holy Roman Church, and other cardinals, even legates a latere, as well as the presidents of the aforesaid Camera and clerics, and other officials and ministers, and all others whatsoever exercising and about to exercise any authority, preeminence and power, with all faculty of judging and interpreting otherwise being removed from them and from each of them, be judged and defined; and also null and void, if otherwise concerning these things by anyone, by any authority, knowingly or unknowingly, should happen to be attempted.

24 Definition 8 8. Notwithstanding, insofar as it may be necessary, our and the Apostolic Chancery's rule concerning not removing acquired right, and all other matters which the aforesaid Pius, Paul and Innocent, our predecessors, in their respective letters mentioned above wished not to stand in the way, and with respect to those things which are contrary to these presents, and other constitutions and apostolic ordinances, as well as any decrees, statutes, uses, styles and customs, even immemorial ones, of the aforesaid tribunals, even those strengthened by oath, apostolic confirmation, or any other firmness, and also privileges and indults and apostolic letters whatsoever, under whatsoever tenors and forms, and with whatsoever even derogatory clauses of derogations, and other more efficacious, most efficacious and unusual clauses, and irritant and other decrees, even by motu proprio, knowledge and fullness of power similar and in consistorial and other manner whatsoever granted, issued, and also many times and however many times confirmed, renewed and approved in the contrary of the aforesaid; all and singular of which, even if for their sufficient derogation special, specific, express and individual mention of them and their whole tenors should be made, not by general clauses, or any other expression, or some other exquisite form to be observed for this, the tenors of these, as if word for word, with nothing whatsoever omitted, and the form delivered in them being observed, were expressed and inserted, having these same presents for fully and sufficiently expressed, inserted, observed and specified, which would otherwise remain in their force, for the effect of the aforesaid, specially and expressly, most fully and most amply we derogate, and will that it be derogated, and command; and all other things contrary whatsoever.

25 § 9. Let no man whatsoever be permitted to infringe the page of our approbation, confirmation, renewal, wills, statutes, decrees, mandates, sanction and derogation, or to act against it with rash presumption; if anyone, however, shall presume to attempt this, let him know that he will incur the indignation of almighty God and of the blessed Apostles Peter and Paul.
