Constit. xvii Eugenii IV, pag. 32. (2) Leg. f. nitantur (a. t.).

7 Dat. die 18 augusti 1485, pontif. anno i.

Testo inglese

Innocent, bishop, servant of the servants of God, requests this for perpetual remembrance of the matter.

1 Since, as we have learned, certain persons, adhering more to the rigor of the law and its fine points than to equity, attempt to call into doubt whether in cases involving our beloved sons, the clerics and presidents of our Apostolic Chamber, and especially between our treasury and the said Chamber on the one hand, and private persons on the other hand, on account of monies, things and goods pertaining to the said Chamber in any manner or cause, directly or indirectly, or in which the interest of the said Chamber might result, the judicial solemnities and positive law, as are customarily observed in other cases before other judges, ordinary or delegated, or any tribunals whatsoever, ought to be observed; and whether the omission of these same solemnities before the said presidents and clerics ought to vitiate the proceedings and sentences had and rendered, to be had and to be rendered.

2 § 1. We therefore, considering that the clerics and presidents of the Chamber, representing in the same person ourselves, and the cases which are conducted before them are considered to be conducted before us, since they are able to consult us for any doubts whatsoever, and by the custom of that place such judicial solemnities and terms are accustomed to be omitted, and only the truth of the matter to be attended to. (1) Regarding this jurisdiction and other indults, and the election and number of the same clerics, see above Const. xvii of Eugenius IV, p. 32. (2) Read: nitantur (in the text).

3 Therefore, wishing to cut through this scrupulous ambiguity, and desiring that cases concerning any matters whatsoever in the said Chamber, between any persons, and especially the aforesaid treasury and others now and for the time being pending, may receive a speedier conclusion, by our own motion and from certain knowledge, and by our deliberation and will, we decree, declare and command that in all and singular cases of this kind pending for the time being, proceedings shall be conducted summarily, without noise and judicial formality, with only the truth of the matter inspected, and all positive law and judicial solemnity set aside, by the said clerics and presidents of the said Chamber, and that these cases ought to be terminated and decided; and sentences rendered and to be rendered by the same, on account of the omission of judicial solemnity and positive law, can in no way or ought to be impugned for nullity, provided that they be rendered according to the truth.

4 § 2. And thus we will and command that it be observed by any judges whatsoever before whom these cases may perchance be agitated in any manner hereafter. Decreeing null and void whatever shall happen to be done contrary to this decree.

5 § 3. Notwithstanding apostolic constitutions and ordinances and laws, the style of the Palace, and anything whatsoever made to the contrary, we having the status, names and cognomens of all pending cases as sufficiently expressed.

6 It is pleasing, and thus by our own motion we command. Given at Rome at St. Peter's, on the 15th day before September, in the first year of our pontificate.

7 Given on 18 August 1485, in the first year of the pontificate.
