BENEDETTO VESCOVO
12 § 8. Questo Ufficio di Decano, aderendo Noi ai decreti altrimenti dal medesimo Collegio emanati, non vogliamo che possa essere optato in alcun modo dai Iuniores o dai Coadiutori, né ottenuto dai Seniori assenti;

28 Ioanne § 17. Quotiescumque demum Summo Pontefici in Consistorio sedenti supplicandum fuerit, et sive ii, quorum res agitur, in Curia praesentes sint, sive absentes, dummodo non sint Regiae, aut Cardinalitiae dignitatis, et nisi eo in Consistorio personaliter constituti, id alicujus Advocati Consistorialis voce et opera peragendum erit. Ipsique S. R. E. Cardinales, ubi suae Dignitati renunciare, eamque in manibus Summi Pontificis dimittere voluerint, per Advocatum pariter Consistorialem a Collegio de ipsorum assensu deputandum, praesentibus earundem Procuratoribus legitimam mandatum habentibus, instantiam suam in Consistorio proponi facere debent: Qua de causa centum Ducati auri de Camera ad Collegii creditum antea depositi, eidem Collegio praestandi sunt, iique inter Participantes aequis portionibus dividendi.

33 Idque § 20. Quam proinde unionem et perpetuam annexionem et incorporationem Officii Rectoratus huiusmodi, una cum facultatibus ipsum Gymnasium, eiusque Ecclesiam, Scholas et Bibliothecam regendi, asserendi, et gubernandi, atque unum ex proprio Collegio in singulos annos pro Studiorum Rectorem, atque alium Bibliothecae tempore carium, tum etiam Bibliothecae praedictae Custodes, aliosque Gymnasii praedicti Officiales, et Ministros, respective eligendi et deputandi, salvo eorum iure, quibus vel oneroso, vel alio legitimo titulo nonnullorum Officialium huiusmodi deputatio competere dignoscatur; necnon eiusdem Bibliothecae libros permutandi; statuta quoque, ordinationes, et provisiones pro Gymnasii praedicti meliori regimine et utilitate condendi, faciendi, et publicandi, atque illa seu illas, toties quoties eisdem, seu eorum maiori parti expedire videbitur, mutandi et innovandi, sicuti per Praedecessores Nostros Sixtum V., Clementem VIII. et Alexandrum VIII. Per gli altri invece Lettori delle scienze, o facoltà, o Lingue, per provare e approvare i Candidati, dal Rettore dell'Archiginnagio di volta in volta deputato, con la partecipazione e il consenso del predetto Signor Cardinale Camerlengo, si assumeranno altri Assessori eccellenti nelle scienze, facoltà e Lingue medesime, secondo il cui consiglio e parere tanto il Camerlengo quanto gli Avvocati predetti nel dare i voti potranno dirigere i loro giudizi sulla perizia dei concorrenti. Nella scelta però per concorso, quante volte a Noi e ai Nostri Successori piacerà, tanto nel Diritto Canonico e Cesareo nell'Archiginnagio predetto quanto negli altri Insegnamenti, della Teologia, della Lingua Santa, di altre Facoltà, nonché della Filosofia razionale e sperimentale, della Medicina e delle altre arti e facoltà, che nell'Archiginnagio medesimo pubblicamente si insegnano e si spiegano, ai Professori e ai Lettori; vogliamo che l'esame dei concorrenti si tenga dinanzi al Venerabile Nostro Fratello Annibale Vescovo Portuense Cardinale della Santa Romana Chiesa Camerlengo, e del medesimo Archiginnagio, nonché dell'Università di Studio generale Cancelliere, detto di Clemente, e ai suoi Successori nell'Ufficio di Camerlengo medesimo, avendo sempre presenti;

I Privilegi invece, gli Indulti, le Licenze e le Facoltà asseriti, con il pretesto dei quali altre persone, o Collegi di qualunque stato, grado, condizione e preminenza, contendono che ciò sia loro lecito; benché da altri dei predetti e da altri Nostri Predecessori siano stati dichiarati, moderati, o rispettivamente revocati, annullati e privati di vigore; Noi tuttavia, con qualunque autorità e potestà, e comunque da qualsiasi causa, anche a titolo oneroso, Privilegi e sotto qualsiasi formula di parole e disposizioni, clausole e Decreti, anche per Noi e i Nostri Predecessori e la Sede Apostolica, al medesimo Collegio concessi, e quantunque lunga e immemorabile consuetudine ai medesimi sia per persone che per Collegi sia stata posseduta e opposta, con il tenore delle presenti parimenti, per quanto sia necessario, revochiamo, annulliamo e priviamo perpetuamente di vigore;

BENEDICT, BISHOP
2 Servant of the Servants of God, to perpetual memory of the matter. Among the conspicuous Orders by which the Roman Curia, celebrated throughout the whole world, stands forth and is constituted, and of which some, for the conduct of the government of the universal Catholic Church through the inscrutable depth of Divine counsel committed to Our humility, others for temporal matters of Our own, or rather of the Blessed Apostles Peter and Paul, in administering the patrimony, constantly afford Us counsel and assistance in various ways; others in the ecclesiastical matters, whether of Universities or of private persons, in the controversies which are brought from all sides to this Our City and Curia, for being known and judged; others finally in sustaining, defending and conducting the causes and disputes of contending parties, expend their knowledge and labors; the provident care of Our Predecessors has willed that from the most remote times there should exist the illustrious College of Consistorial Advocates, composed of distinguished men of virtue and learning, who, on account of the excellence of their knowledge and experience in affairs and prudence, were selected from the entire body of advocates, and to whom singular right and privilege were attributed of pleading before the Roman Pontiff, the Supreme Judge of Justice, with the venerable Cardinals of the Holy Roman Church solemnly assembled; namely in the Sacred Consistory, in which formerly most grave matters, referred from all sides to the judgment of the Apostolic See, were discussed; and many are still either examined, or, if those matters have already been agitated and discussed outside the Consistory, are nevertheless defined and terminated in the Consistory itself. This College of Advocates aforesaid, and the individual persons inscribed therein in successive years, so approved their industry and labor to the aforesaid Predecessors of Ours, that they were adjudged to have the proper and, as it is called, exclusive exercise of the most serious duties, which pertain to maintaining the reverence of holy judgments, to defending and preserving the rights of the Apostolic See, to the salvation and defense of the afflicted, and to promoting the knowledge of Law and the liberal arts; and they were honored and enriched with the most ample graces, privileges and favors by many of the Supreme Pontiffs.
3 venerable Brothers, Cardinals of the Holy Roman Church. A. V. solemnly assembled; in the Sacred Consistory, namely, in which formerly most grave matters, referred from all sides to the judgment of the Apostolic See, were discussed; and many are still either examined, or, if those matters have already been agitated and discussed outside the Consistory, are nevertheless defined and terminated in the Consistory itself. This College of Advocates aforesaid, and the individual persons inscribed therein in successive years, so approved their industry and labor to the aforesaid Predecessors of Ours, that they were adjudged to have the proper and, as it is called, exclusive exercise of the most serious duties, which pertain to maintaining the reverence of holy judgments, to defending and preserving the rights of the Apostolic See, to the salvation and defense of the afflicted, and to promoting the knowledge of Law and the liberal arts; and they were honored and enriched with the most ample graces, privileges and favors by many of the Supreme Pontiffs with beneficence.
4 vol. § 1. Since, however, such Privileges granted by the merits of those same persons are found to have been bestowed at different times, some indeed, and others acquired by the longest use of time with the best right, yet they have been disturbed perhaps on account of the most remote antiquity of the concessions, and appear to rest on uncertain principles and origins; and since the use and as it were possession of some has sometimes been interrupted and weakened by contrary acts; it certainly seemed desirable that, when a single collection of the same had been made, and the same fortified by the inviolable strength of Apostolic authority, provision should be made both for the splendor and dignity of the College itself, and for the security of the rights competent to it from Pontifical liberality. We therefore, whom it was once granted by our happy memory Predecessor Pope Clement XI to hold a place in the same College for many years, and whom the same was the first honor in the Roman Curia, and obtained a strong incentive to studies and labors in the service of the Apostolic See, and the most apt occasion for obtaining superior duties and rewards, do recall not without joy and grateful feeling, and do wish to perpetuate: since We have already been pleased to increase certain particular Indults and Privileges to the same College through other of Our Letters in the form of a Brief under the Fisherman's Ring; so that there might be an illustrious and perpetual token of Our esteem and benevolence toward the aforesaid College, the same Indults and Privileges both granted by Us, as aforesaid, and others whose concessions are found in the various Letters of Our Predecessors, or which are known to belong to the same College from long-established custom, We have determined to reduce into one body as it were, and to comprehend all the same, confirmed and strengthened by Our Apostolic Authority, and also, where it was necessary, declared and enlarged, in these Our Letters to be perpetually valid. Therefore, wishing to pursue Our beloved Sons, the modern Advocates of Our Consistorial Court, and their aforesaid College with more ample favor, and absolving their individual persons by these presents from any excommunication, suspension, and Interdict, and other ecclesiastical sentences and penalties imposed by Law or by Man for any occasion or cause, if they are bound by any means whatsoever, to the effect of obtaining the present only, and declaring them absolved, of Our own motion, not at the petition of the College and Advocates aforesaid, or of others in their behalf presented to Us on this matter, but of Our mere free will, and from certain knowledge, and from the fullness of Apostolic power, all the underwritten privileges, indults, rights, faculties, honors, duties, preeminences, and prerogatives to the same College by the tenor of these presents we assert, approve, confirm, and renew, and fortify them with new strength of Our Apostolic Authority, and likewise, as below, we decree, establish, declare, and ordain.
Vol. II. P
5 perpetually. And first the number of twelve of the same Advocates fixed by Our Predecessor Pope Sixtus IV in his Letters issued later on this matter, We will to be perpetual and stable in the manner and form in which it has been observed up to these times; namely, so that seven of them, who according to the order of admission shall be the more senior in the College, shall hold the name and rights of Seniors and Participants; the remaining five, however, shall be called and held as Juniors and Supernumerary. If, however, any from Pontifical dispensation, just causes urging, shall have been appointed as Coadjutors to any of the twelve Advocates with future succession, these indeed, as is now the custom, may exercise all things which the others of the number can, but during the office of Coadjutor, and until succession has taken place, they shall lack both voice and emoluments in the College.
6 § 3. Moreover, in this college of twelve Advocates of the Consistory, the City of Bologna, by immemorial right of possession, has obtained and enjoys that one place always be assigned to one of its Citizens, on account perhaps of the distinguished excellence of the Bolognese City and University, in which all the liberal arts and sciences, and especially genuine and solid jurisprudence, having lain miserably in the darkness in which the barbarism of preceding times had cast it, were happily recalled to light in the twelfth century, and are said to have fixed their own seats there as it were, and thence to have spread forth, both to the remaining schools and to the law courts, by the consent of all. Another place of this kind is found to have been perpetually assigned by the blessed memory of Pope Pius IV through Apostolic Letters given in the year of the Lord one thousand five hundred sixty-eight, on the eighth day of July, from the College of Doctors of the City of Milan, which the Roman Pontiff for the time being shall have deemed fit to choose from three, to be designated by the same Milanese College of Doctors and presented or nominated to the same Roman Pontiff. The same blessed memory Pope Clement VIII and Pope Paul V assigned another place in the aforesaid College to one Citizen of Ferrara, at least by privilege effected or created, likewise perpetually, and wished it to be granted for the time being, which concession was confirmed by Pope Urban VIII through his Letters also expedited in the form of a Brief, given on the seventeenth day of December in the year of the Lord one thousand six hundred twenty-five, when to our City of Ferrara through the same Letters he indulged that this place should be granted and assigned for the time being only to Citizens of Ferrara who were truly native-born, whose nomination pertained to the Magistrate of Ferrara. And likewise another place in the aforesaid College by Apostolic concession of the blessed memory of Pope Innocent XII, the Citizens of Naples are known to have obtained, to whom the aforesaid Innocent through his Letters in similar form of a Brief under date of the fourteenth day of November in the year of the Lord one thousand six hundred ninety-seven expedited thereupon indulged, that when the aforesaid place should become vacant for the time being, three Citizens of Naples, Doctors of both laws, should be nominated by the Elected of that City to the Roman Pontiff for the time being existing, from whom the same Roman Pontiff would choose one for this office of Consistorial Advocate and assume him; as is more fully and abundantly contained in the individual Letters of the same Pius, Urban, and Innocent, our Roman Pontiff Predecessors, mentioned above.
7 § 4. All these things indeed, which have been expressly conceded to the aforesaid Cities, Colleges, or Universities by our Predecessors, as aforesaid, or which have been acquired by the right of ancient custom,
8 we will and command that they be preserved inviolate and firm, and that from them, as prescribed above with respect to the aforesaid Advocates to be chosen, and to be admitted to the service of the College and the Advocates, we grant and, insofar as it is necessary, we present in full.
9 And the rest, to fill the remaining places of the Consistorial Advocates of the Roman Curia, we will that they be chosen from among those who are Citizens either of the Almighty City or of another City subject to the Apostolic See, and who are endowed with proven probity, learning, experience, diligence, and other requisite gifts and qualities: Yet so that whenever any place in the aforesaid College, which is not assigned to Citizens of any of the aforesaid Cities, or to whom provision has not been made before by the Coadjutor, shall become vacant, the Consistorial Advocates themselves, gathered collegially, according to their judgment and knowledge of those who, moved by zeal, have rendered praiseworthy service in the office of Advocate in the Roman Curia, shall present three men to the Roman Pontiff for the time being existing, who are either Citizens of Rome, as aforesaid, or of another City of the Ecclesiastical Dominion, whom they shall deem worthy to be inscribed in their illustrious College, and the Roman Pontiff shall choose one of them at his discretion and appoint him as an Advocate of his Consistorial Hall; And thus we command that it be observed in the future, notwithstanding the Decree of our blessed memory Predecessor Pope Clement XII, issued in the secret Consistory on the twenty-second day of January in the year of the Lord one thousand seven hundred thirty-one, in which he prescribed another form for the selection of such Advocates; whose decree we, having its tenor inserted for the present and expressed word for word, expressly derogate from in that part, by our own motion, knowledge and fullness of power with equal authority, and that decree, as if it had never been issued, we annul, render void, and nullify, and we will and command that it be held in the future as annulled, void, and nullified.
10 § 6. When the office of Advocate of the Consistory has once been conferred, except in the case of voluntary resignation or juridical deprivation, it is in no way to be understood as vacant, unless by promotion to the Auditorship of Cases of the Sacred Palace, or to the Episcopate with the burden of residence attached thereto, or to the dignity of Cardinal.
11 § 7. To those Advocates of the Consistory elected, however, according to the form prescribed by Us above, it is by no means permitted to exercise the proper duties of this office, unless after all the functions which are customarily to be performed in their admissions have been completed, and which perhaps, as also for those elected Auditors of Cases of the Sacred Palace, will receive a new and better norm from Us, God willing; nevertheless, We decree that seniority rights are acquired to them from that day on which the schedule of our or our successors' election of the same, called a Motu Proprio, is presented to the College; Coadjutors, however, shall derive the same seniority from that day on which, after all the aforesaid functions have been completed, they shall have requested seniority from the College itself and obtained it by decree of the same College, with Apostolic Letters subsequently expedited in the form of a Brief, if it shall please Us and Our successors to approve and confirm it. All which things are expressly disposed to this end, that it may clearly appear in the cases of option occurring to whom a place among the seven Seniors or Participants should be given, and to whom likewise the Deanship of the whole College for the time being should be deferred.
12 § 8. This Deanship office, We, adhering to decrees otherwise issued by the College itself, do not wish to be sought in any way by Juniors or Coadjutors, nor to be obtained by Seniors absent; nor by those who are or Bishops
13 situated, in Chili, and Privileges, so that namely from the same one for the time being, according to the prescribed respective forms elected, shall be adopted into the aforesaid College of Advocates of the Consistory, and admitted to exercising the duties competent to the same College and to the Advocates, all things being observed that should be observed, We approve and confirm, and insofar as it is necessary, We renew, and as if by the tenor of these presents granted anew, We concede and indulge.
14 The rest, § 5. Wishing that the rest, to make up the aforesaid number of two denarii of Advocates of the Consistory, be chosen from the whole body of Advocates of Rome, who are either Citizens of the Almighty City or of the other City subject to the Apostolic See in temporal matters, and endowed with the necessary gifts and qualities of probity, learning, experience, and other requisites: Yet so that whenever any place shall have become vacant in the aforesaid College, which is not attached to Citizens of any of the aforesaid Cities, or for which provision has not been made through the appointment of a Coadjutor, the Advocates of the Consistory themselves, collegially assembled, shall, for their faith and knowledge of those who labor laudably in the office of Advocate in the Roman Curia, present to the Roman Pontiff existing for the time being three men from those who are, as is aforesaid, or of the other Ecclesiastical City, Citizens, whom they shall have deemed worthy to be inscribed in their illustrious College, who by his discretion shall elect and appoint one of them as an Advocate of his Consistorial Court; And thus We command to be observed in the future, notwithstanding the Decree of Our Predecessor of happy memory, Pope Clement XII, issued in the secret Consistory of the twenty-second day of January in the year one thousand seven hundred thirty-one, in which he prescribed another form for such selection of Advocates; whose Decree we have inserted the tenor of for the present, and expressed word for word, from the same in this part, with motion, knowledge and fullness of power equally, We expressly derogate, and the same, as if it had never been issued, We annul, irritate, and abrogate, and for annulled, irritated, and abrogated in the future We will and command to be held.
16 § 7. To those elected, however, according to the form prescribed by Us above, as Consistorial Advocates, it is by no means permitted to exercise the proper duties of this Office among their other functions, unless after all the functions which are customarily to be performed in their admissions have been completed, and which perhaps, as also for those elected to the Causes of the Sacred Palace, the Auditors, shall receive a new and better norm from Us, God willing; nevertheless We decree that seniority shall be acquired by them from that day on which Our schedule, or that of Our successors for the time being, concerning their election, called a Motu proprio, shall have been presented in the College; Coadjutors, however, shall derive the same seniority from that day on which, after all the aforesaid functions have been completed, they shall have requested and obtained the aforesaid seniority for themselves from the College itself by decree of the same College, with Apostolic Letters subsequently expedited in the form of a Brief, if it shall please Us and Our successors to approve and confirm it. All which things are expressly disposed to this end, that it may clearly appear to whom in the cases of option occurring the place among the seven Seniors or Participants should be due, and to whom likewise the Deanship of the whole College for the time being should be deferred.
17 § 8. This Deanship Office, We adhering to other decrees made by the College itself, We do not wish to be sought in any way by Juniors or Coadjutors, nor to be held by Seniors who are absent: but neither by those who are either marked with the Episcopal character or otherwise are found enrolled among the Prelates of Our Curia; but We decree that it ought to be deferred to him who among the Seniors present in the Roman Curia, and not Prelates, is known to be the more senior. If, however, the case should occur in which all the Senior Advocates present in the Roman Curia are found to be decorated with the Episcopate or Prelature, he who is the more senior among them shall be invested with the title and functions of Pro-Dean; until someone who is not a Prelate shall enter into the number of the seven Participants, to whom this Deanship Office should be due by right.
18 Pont. pal character are inscribed, or otherwise are found among the Prelates of Our Curia; but We decree that it ought to be deferred to him who among the Seniors present in the Roman Curia, and not Prelates, is known to be the more senior. If, however, the case should occur in which all the Advocates who are Seniors present in the Roman Curia are found to be decorated with the Episcopate or Prelature, he who is the more senior among them shall be invested with the title and functions of Pro-Dean; until someone who is not a Prelate shall enter into the number of the seven Participants, to whom this Deanship Office should be due by right.
19 § 9. From the privileges and prerogatives of the aforesaid Advocates of the Consistory. The aforesaid Advocates of our Consistorial Court, a noble Order, from the concession of our Predecessors and from ancient custom, ought to enjoy those privileges and prerogatives which pertain to the ornaments and decorations of the Order itself; and those which pertain to the exercise of the duties of the Order, which are assigned to the same College. Since indeed the aforesaid Advocates of our Consistorial Court are true and undoubted Advocates of ourselves and of the Roman Pontiff for the time being, and Familiars and continual Commensals, and furthermore are to be held and ought to be held in the manner of other Familiars of this kind, but equally and in like manner principally with the other Familiars and Commensals aforesaid; whence also they receive the bread of honor from our daily liberality and that of the Roman Pontiff for the time being; and in the retinue of the same Roman Pontiff when traveling, just as in accompanying the Most Reverend Cardinals, Legates of the Pontificate sent from the Lateran, as well as on the occasion of going to meet Emperors, Kings, and Princes of virtue coming to the Curia, they proceed together with the other Prelates and Familiars of the Pontiff; not only do they excel all other Roman or other City Advocates of Cases, Patrons, Procurators, and Advocates, and all Doctors, Antecessors, and Masters of both Rome and any other University, even the more ancient, in the prerogative of honor and dignity; but they also take precedence over other Clerics, both Clerics and Laymen, however much born of noble lineage, and excelling in whatever office or dignity, and over the Familiars of other Princes; and both in the Chapel and in the Consistories, and Pontifical and other Supplications, or Processions, Processions on horseback and other public Functions, they ought to have a place immediately after our Cubicularies of both the Secret and the so-called Honor Court, namely above the Chaplains of our inner Chapel itself, secret ones, and others of lower rank; as indeed from our express mandate, with all occasion for doubt removed, has been put into use; and nevertheless we command and decree that the same be observed in perpetuity for future times by the tenor of these presents. And the same Chapels and all the aforesaid Functions are to be intimated to the College of Consistorial Advocates, just as to other Colleges having a place in the same location, by Couriers; and in them Candles, Palms, and blessed Wax, called Agnus Dei, are to be distributed to them in equal quantity and quality with our other Familiars, and we will and command that the same be admitted to hear the preachings of the word of God, which are held at fixed times in our Palace, together with the Prelates of the Roman Curia and our other Familiars, as they have been accustomed.
20 As to the place of sitting, which they have hitherto obtained in the Chapels which are celebrated in our Basilica of the Vatican, namely in the lower grade of the Pontifical Throne, below the Conservators of our Almighty City, we decree that the same in the future in the aforesaid and other Chapels, which according to the amplitude of the place could be arranged in the same manner, be assigned to the same. Where indeed Chapels are held in our Pontifical Sacristies, or in other Churches and places arranged in the same order as in the aforesaid, our Sacristies are accustomed to be arranged; we will that the grant of a seat or bench for their use be firm and ratified, to be placed before the bench or seat accustomed to be set up for our Cubicularies for honor, from our express mandate once placed and assigned, and then by other our Letters in the form of a Brief issued on the fifth day of March in the year one thousand seven hundred and forty-two in perpetuity attributed, so that from the use and possession of the same bench or seat they can by no one by any authority at any time whatsoever be removed. Where indeed for the deficiency of an Umbrella or Baldachin in Pontifical Supplications, the necessary number of our beloved Sons of either Signatura, our Referendaries, to whom such honor is known to have been granted exclusively, should perhaps not be present, we decree that such number, in the presence of the Pontiff, be supplied by the secret Cubicularies themselves, or, these also being lacking, by other of the same Cubicularies called of honor; but with the Pontiff absent, by the Consistorial Advocates.
21 In their General Councils as well as Provincial ones, and in others in which the same Advocates of Our Consistorial Court, or those following the Roman Curia as Familiars of the present Pontiff, or as members of the retinue of Apostolic Legates, or even as Doctors of Decrees or Civil Law, as is known to be customary, may have place and session; We will that those same preeminences and prerogatives both with respect to the Officials of the Roman Curia and of any others whatsoever shall belong to them, which they are accustomed to obtain in Our Palace and in the Roman Curia and City.
22 Moreover, let them retain in perpetuity the form of habit hitherto used by them, both in Pontifical and other more solemn Functions, in Chapels, Consistories,
BULLARIUM. 545
23 in Processions, Horseback Rides, and in collegiate acts themselves; namely a woolen talare Cope of violet color, with red stitching all around and supported by red silk lining, with a Capuche rounded in front and longer in back, lined with red silk likewise on the inside, and on the outside as well in summer, but in winter with ermine fur respectively used, and to be worn either open or closed according to the diversity of functions. Let them also have the use of a Pluvial on the day of the Coronation of the Roman Pontiff, and on the other day on which the new Pontiff solemnly takes possession of the Lateran Basilica of Constantine; so that, while proceeding to sing praises and all prayers to be made to the new Pontiff from Heaven, with the aforementioned Cardinal Deacon Prior of the Holy Roman Church preceding on the Coronation day, and on the day of Possession the other Cardinal Prior of the Priests of the same Holy Roman Church, together with the Apostolic Subdeacons, they may be clothed in transverse Pluvials; so that the open part of the Pluvial may remain over the right shoulder, and over the neck above the Pluvial they may wear the Capuche in the customary manner: But outside the aforesaid Functions We approve and confirm the usual wearing of Vestments of black color, with a similar rounded Mantellon, granted exclusively to the same College of Consistorial Advocates by Our Predecessor Pope Alexander VIII by special Decree under the twenty-seventh day of November in the year one thousand six hundred fifty-five; so that it shall be lawful for no one to use similar Vestments and Insignia, and it shall be forbidden to the same elected Auditors of Cases of the Sacred Palace and Our Chaplains to assume this kind of Habit, except by license of the aforesaid College of Consistorial Advocates, according to ancient observance, to be expressly sought from the same College by supplicant petition and respectively granted: just as We to all and each, and especially to the aforesaid elected Auditors, notwithstanding any custom perhaps induced to the contrary, by these Our Apostolic Letters forbid and interdict.
24 And furthermore, to the aforesaid Advocates of Our Consistorial Court setting out from Our Beloved City, due honor shall be shown by all; which We have already granted to them by word of mouth, namely that they may use and are able to use traveling dress in the form of dress customarily worn by Our Prelates and Familiars outside the City, preserving nevertheless the black color, and by the tenor of these presents We expressly grant and indulge this.
25 IV. § 14. The principal and proper duties of their College are indeed those which concern the Consistory, and the acts of duties and business to be conducted and transacted therein; which duties are so proper to the Advocates of the Consistory themselves, that for the performance of such functions as an Advocate in the Consistory, those are not admitted from the same College who are found enrolled among the Prelates of the Roman Curia, unless they lay aside the Prelatic habit and consent to assume the habit of Advocate of the Consistory for that purpose. When therefore some matter of greater importance is to be judicially handled in the secret Consistory according to ancient custom, none other than the aforesaid Advocates of the Consistory are to be admitted for conducting the Cases of the Parties. And since among the greater causes, which are defined by the Roman Pontiff with the counsel of his Venerable Brothers the Cardinals, namely the Beatifications of the Servants of God and the Canonizations of the Blessed, are deservedly reckoned, it seemed fitting for that reason that the prerogative of writing in law in such Cases should be reserved to the College of Advocates of the Consistory; yet, having regard to the number of offices which fall to them, it was also opportunely decreed that by the Congregation of the Holy Roman Church of Cardinals presiding over Sacred Rites, twelve others from the more celebrated Advocates of Cases of the Roman Curia should be approved and deputed for this effect, but on this condition that the Postulators of such Cases may entrust their patronage to one of them, according to their own judgment, observing what is to be observed. 1744. § 15. To the Advocates of the Consistory themselves it belongs exclusively to propose public instances in the Consistory for the Beatification of the Servants of God, or the Canonization of the Blessed, in those public Consistories which are celebrated in the tradition of the Pallium to newly created Cardinals, or in the reception of a Legate of the Apostolic See returning to the City, or of some Prince's Orator sent to render obedience to the Apostolic See, to deliver Orations upon the merits and virtues of the aforesaid Servants of God and Blessed, and by urging the Supreme Pontiff, that their Beatification or Canonization Cases be committed or further promoted, or respectively expedited; just as, the old custom of a less decent kind having been abrogated, namely of declaiming on profane matters, and often on more atrocious crimes feigned and imaginary, by Decree of our Predecessor Pope Urban VIII under the date of the twenty-seventh of January in the year one thousand six hundred thirty-one issued, there followed thereafter concerning the method to be observed in such Orations a particular instruction, confirmed it. For the performance of which Orations, which are accustomed to be divided into two, or at most three Consistories individually, and which are accustomed to be held not only by the Seniors and Participants, but also by the Juniors and Coadjutors in turn, observing the order of seniority, and by the Coadjutors aforesaid both from their own person and from that of the Coadjutor, ten gold scudi in gold should be paid to the Advocate pleading for each occasion, from the proceeds of penalties, with an expedited Mandate from the Notary of Charity, and subscribed by the Governor of our Almighty City.
26 § 16. In those likewise public Consistories, which are convoked for the Canonization of some Blessed, it pertains to the Advocate of the Consistory to narrate fully and completely the life, public virtues, and miracles of the Servant of God, and to represent to the Supreme Pontiff the Instances of the Churches, of Princes, and of Peoples for the Canonization of the same Servant of God. 348 Benedict XIV.
27 And the same should be prepared to report the aforesaid matters strictly, if need be, in the following public Consistory. Then on the solemn day of the Canonization to be performed in the Vatican Basilica, to propose the formula for the pronouncement of the definitive sentence before the Supreme Pontiff and publicly urge it. For the accomplishment of all which, he who shall have performed it shall receive thirty scudi of money from the emoluments which on the occasion of the Canonization are owed to the aforesaid College of Advocates, and from the Postulator of the Case a painted Image of the Servant of God numbered among the Saints shall be given to him as a gift.
28 § 17. Whenever it shall be necessary to make supplication to the Supreme Pontiff sitting in Consistory, whether those whose matter is being treated are present in the Curia or absent, provided they are not of Royal or Cardinal dignity, and unless they are personally constituted in Consistory, this shall be done through the voice and action of some Advocate of the Consistory. And the Cardinals of the Holy Roman Church themselves, when they wish to renounce their Dignity and lay it down in the hands of the Supreme Pontiff, must likewise cause their petition to be proposed in Consistory through an Advocate of the Consistory appointed by the College with their assent, with their legitimate Procurators present and having mandate. For this reason, one hundred gold Ducats of the Camera, previously deposited to the credit of the College, are to be paid to the same College, and divided among the Participants in equal portions.
29 § 18. Similarly, Patriarchs, Archbishops, and those chosen from Bishops as Nuncios, who are decorated with the honour of the Pallium either from the rights of their Church governance or from personal concession, shall request it in Consistory in secret through the intermediary of the person of an Advocate of the Consistory. Therefore, if a Patriarch, Archbishop, or Bishop, as above, having been granted the Pallium, is present in the Roman Curia and presents himself in the aforesaid Consistory before the Pontiff, he shall stand in the middle between the Advocate acting on his behalf on the right, and the Master of Ceremonies on the left; but if the Prelate dwells outside the Curia, his Procurator shall hold the right, the Master of Ceremonies the left, and the Advocate of the Consistory the middle place; and he shall present to the Pontiff humble prayers for the aforesaid concession of the Pallium. And unless it concerns a Church existing in Infidel Lands, or one for which a Pastor has been provided at the petition and according to the Decree of the Congregation of the Holy Roman Church of Cardinals presiding over the affairs of the Propagation of the Faith, the aforesaid Advocate shall receive ten gold Ducats of the Camera, which must have been previously deposited, for such petition. But for proposing these petitions in Consistory, only seven senior Advocates or Participants shall be admitted by turn, excluding Juniors and Coadjutors, unless they have come to petition in the person of one of the aforesaid Seniors.
30 § 19. Moreover, there is another kind of office which belongs exclusively to the same College of Advocates of the Consistory, which concerns the governance of this our beloved City's Archgymnasium and General Studio; the Rectorship of which Gymnasium was formerly accustomed to be granted and assigned to one of the Prelates of the Roman Curia for the duration of his life, by Sixtus, our Predecessor, through his Letters in the Year of the Incarnation of the Lord one thousand five hundred and sixty-seven, on the seventeenth day before the Kalends of September, issued under Lead, for many reasons moving his mind, and also in compensation for a certain sum of money paid by the aforesaid College of Advocates of the Consistory for that purpose at that time.
31 To the same College of Advocates of the Consistory, with all and singular the rights, revenues, and emoluments of that office, as well as with all honours, burdens, jurisdictions, faculties, and privileges aforesaid competent to the Rector Prelate, it was perpetually united, annexed and incorporated.
32 § 20. Which union and perpetual annexation and incorporation of the office of Rector of this Gymnasium, together with the faculties of governing, maintaining, and administering the same Gymnasium and its Church, Schools and Library, and of electing and appointing from their own College in individual years a Rector of Studies, and another Librarian in their time, as well as the aforesaid Library's custodian and other officials and ministers of the aforesaid Gymnasium, respectively, saving their right, to which the appointment of some of these officials may be known to belong either by onerous title or by other legitimate title; and also of exchanging the books of the same Library; and of drawing up, making, and publishing statutes, ordinances, and provisions for the better governance and utility of the aforesaid Gymnasium, and of changing and renewing them, as often as it shall seem expedient to them or to the greater part of them, just as by our Predecessors Sixtus V, Clement VIII, and Alexander VII, Roman Pontiffs, had been granted to them at other times, we approve and confirm, and insofar as it is necessary, we newly grant and indulge.
33 Wherefore we approve and confirm that union and perpetual annexation and incorporation of the Office of Rector of this Gymnasium, together with its faculties, with the Gymnasium itself, and its Church, Schools and Library, to govern, maintain, and administer it, and to elect and appoint annually from their own College a Rector of Studies for the Gymnasium, and another for the Library in time of vacancy, as well as the aforesaid Library's custodian, other officials of the aforesaid Gymnasium, and Ministers respectively, saving the right of those to whom the appointment of certain of these officials may be known to belong by burdensome or other legitimate title; and likewise to exchange the books of the same Library; and to draw up, make, and publish statutes, ordinances, and provisions for the better governance and utility of the aforesaid Gymnasium, and to change and renew the same, one or more, as often as it shall seem expedient to them or to the greater part of them, just as by Our Predecessors Sixtus V, Clement VIII, and Alexander VII, Roman Pontiffs, the same had been granted to them at another time, we approve and confirm, and insofar as it is necessary, we newly grant and indulge.
34 In selecting, moreover, through competition, as often as it shall please Us and Our Successors, both in Canon Law and Civil Law in the aforesaid Archigymnasum, as well as in the other Arts, Theology, Holy Scripture, and likewise in rational and experimental Philosophy, Medicine, and the other arts and faculties, which in this Archigymnasum are publicly taught and explained, for Professors and Lecturers; We will that the examination of competitors be held before Our Venerable Brother Annibale, Bishop of Porto and Cardinal of the Holy Roman Church, Camerlengo, and Chancellor of the same Archigymnasum and of the University of General Studies, and his Successors in the Office of Camerlengo of this kind, with the aforesaid Advocates always assisting collegially;
35 and for those who shall have been examined, the election, together with the aforesaid Camerlengo, who nevertheless ought to enjoy the right of double suffrage, the same Consistorial Advocates shall cast their vote. And indeed the examination of those who, to obtain Chairs in Decretals or in civil law, shall demonstrate their knowledge and skill, shall be conducted by the same Consistorial Advocates. For the Lecturers of the other sciences, whether faculties or Languages, to be tested and approved, by the Rector of the Archigymnasum appointed for the time being, with the participation and assent of the aforesaid Most Reverend Cardinal Camerlengo, other Assessors shall be assumed, skilled in such sciences, faculties, and Languages, according to whose counsel and judgment both the Camerlengo and the aforesaid Advocates, in casting their votes on the skill of the competitors, may direct their judgments. And finally, a report of the whole examination, or competition, and of the votes cast, shall be made to Us or to the Roman Pontiff for the time being, so that to the vacant Chair or Lectureship, a suitable and fit person may be provided by Apostolic authority.
36 § 22. And We further will that the exclusive faculty of testing and approving Candidates in both or either Canon Law and Civil Law, and of creating the same Doctors in both or either Law aforesaid in the Roman Curia and City, and of conferring upon them the insignia of such Doctorate, be firm and perpetually ratified, as much by the right of ancient custom and possession, competent to the aforesaid College of Consistorial Advocates, as also by the express Indults and Privileges of Our Predecessors, granted and attributed many times, especially indeed by the blessed memory of Pope Sixtus IV, Pope Julius III, Pope Sixtus V, and Pope Clement VIII, as in their Letters of the eighteenth of September of the year one thousand four hundred eighty-three, the sixth of February of the year one thousand five hundred fifty-two,
37 it was perpetually united, annexed and incorporated.
38 § 20. Which union and perpetual annexation and incorporation of the Office of Rector of this kind, together with the faculties of ruling, preserving, and governing the same Gymnasium, its Church, Schools and Library, and of electing and appointing one from their own College in single years as Rector of Studies, and another as Librarian, etc., and likewise the Guardians of the aforesaid Library, and other Officials and Ministers of the aforesaid Gymnasium, respectively, saving their right, to whom either by payment or by other legitimate title the appointment of some of these Officials may be known to belong; and also of exchanging the books of the same Library; and of drawing up, making, and publishing statutes, ordinances, and provisions for the better governance and utility of the aforesaid Gymnasium, and of changing and renewing them, as often as to them, or to the greater part of them, it shall seem expedient, just as by Our Predecessors Sixtus V, Clement VIII, and Alexander VII, Roman Pontiffs, the same were otherwise granted to them, We approve and confirm, and insofar as it is necessary, We newly grant and indulge. § 21. In selecting, moreover, through competition, as often as it shall please Us and Our Successors, both in Canon Law and Civil Law in the aforesaid Archigymnasum, as well as in the other Arts, Theology, Holy Scripture, and likewise in rational and experimental Philosophy, Medicine, and the other arts and faculties, which in this Archigymnasum are publicly taught and explained, for Professors and Lecturers; We will that the examination of competitors be held before Our Venerable Brother Annibale, Bishop of Porto, Cardinal of the Holy Roman Church, Camerlengo, and Chancellor of the same Archigymnasum and of the University of General Studies, named Clement, and his Successors in the Office of Camerlengo of this kind, with the aforesaid Advocates always assisting collegially;
39 The aforesaid Advocates shall always assist collegially; and for the election of those who shall have been examined, together with the aforesaid Camerlengo, who nevertheless ought to enjoy the right of a double vote, the same Consistorial Advocates shall cast their vote. And indeed the examination of those who shall put forward their knowledge and skill for obtaining Chairs in Canon Law or in civil law shall be conducted by the Consistorial Advocates themselves. For the other sciences, faculties, or Languages, Candidates for Lecturers are to be tested and approved by the Rector of the Archigymnasum appointed for the time being, with the participation and assent of the aforesaid Most Reverend Cardinal Camerlengo, and other Assessors shall be assumed who are distinguished in such sciences, faculties, and Languages, according to whose counsel and judgment both the Camerlengo and the aforesaid Advocates may direct their judgments in casting votes concerning the skill of the competitors. And finally, a report of the whole examination, or competition, and of the votes cast shall be made to Us or to the Roman Pontiff for the time being, so that to the vacant Chair or Lectureship, a suitable and fit person may be provided by Apostolic authority.
40 § 22. We further will that the exclusive faculty of testing and approving Candidates in both or either Canon Law and Civil Law, and of creating the same Doctors in both or either of the aforesaid Laws in the Roman Curia and City, and of conferring upon them the insignia of such Doctorate, which belongs to the aforesaid College of Consistorial Advocates both by the right of ancient custom and possession, and also by the express Indults and Privileges of Our Predecessors granted and attributed many times, especially by the blessed Pope Sixtus IV, Pope Julius III, Pope Sixtus V, and Pope Clement VIII, as is more fully set forth and contained in their Letters given respectively on the eighteenth of September in the year one thousand four hundred eighty-three, the sixth of February in the year one thousand five hundred fifty-two, the third of September in the year one thousand five hundred eighty-seven, and the twelfth of September in the year one thousand six hundred one, shall be firm and ratified perpetually. But the Privileges, Indults, Licenses, and Faculties which are asserted, under the pretext of which other persons or any College of whatever status, rank, condition, and preeminence contend that this is permitted to them; although they may have been declared, moderated, or respectively revoked, annulled, and rendered void by others from the aforesaid and other Our Predecessors; We also, by whatever authority and power, and for whatever causes, even under the title of onerous privilege, and under whatever forms of words and expressions, clauses, and Decrees, even if the same had been granted to the aforesaid by Us and Our Predecessors and the Apostolic See, and although long and immemorial custom may have been possessed and objected by the same persons or Colleges, by the tenor of these presents, insofar as it is necessary, do likewise revoke, annul, and render perpetually void.
41 § And nevertheless, attending to the fact that between Our Beloved Sons the College of Our Apostolic Notaries and the Apostolic See, namely the Notaries and Protonotaries so-called, of the number of Participants, on the one hand, and the College of Our Consistorial Advocates, on the other hand, a certain case and cause is pending undecided in the Palace of Our Apostle in either Auditory, before a certain Auditor thereof; We, who have carefully examined by Ourselves the exceptions of either Party, both as insinuated to Our ears and as set forth in writing, and have weighed them with mature consideration; Wishing from either College, both of Notaries and of Advocates of this kind, whose individual persons are familiar to Us, to remove entirely from the midst all and whatsoever disputes and controversies upon this matter, and to prescribe their respective rights, faculties, and privileges within certain and fitting limits; By Our Motion, knowledge, and fullness of power equal thereto, the aforesaid and whatsoever other case and cause, if any there be, pending in the aforesaid Auditory, or in any other tribunal whatsoever, before whatsoever Judge, and in whatsoever instance, between either College of this kind upon the aforesaid matters in its respective state, merits, and all other things whatsoever, even those which of necessity of law or fact are to be entirely expressed, as well as the concessions, indults, privileges, and Apostolic Letters of either College aforesaid, and their complete and entire tenors sufficiently known and perceived by Us, which by these presents We hold as fully and sufficiently expressed, and inserted word for word, by the tenor of these letters, We call to Us, and entirely and completely suppress and extinguish, and impose perpetual silence thereupon, and close the mouth. To the same Notaries of the aforesaid number We declare it was in no way permitted, nor do We permit it to be permitted, by virtue and force of the Letters of our Predecessor Pope Sixtus V of happy memory, begun Laudabilis, issued upon their privileges, under the date namely of the Nones of February in the first year of his Pontificate, or of whatsoever other Apostolic Letters under whatsoever form conceded to the same College, to examine the examination of anyone desiring to receive the degree of Doctor in either or both Laws, with the parties and outside the City, nor under the faith and reports of another, and to promote anyone absent to this degree of Doctor in the same City with a clause as if he were present, as We understand has been done many times heretofore; but only Our Notaries aforesaid, and their College, four persons each year, and those truly and really present in the aforesaid City, with prior rigorous examination, personally and collegially by the Notaries themselves conducting it,
42 and in no other way, according to the norm of the Apostolic indult granted to the same College by Our Predecessor Pope Urban VIII also, by his Letters given under the year on the fifth day of September of the year one thousand six hundred twenty-nine, to promote to the degrees of Doctor of this kind, to be able to promote freely and licitly according to the oracle of Our present declaration We define: Decreeing that thus, and not otherwise, the Letters of the same Sixtus and Urban Predecessors aforesaid are to be understood and interpreted, and henceforth are to be understood and interpreted; which same Letters of the aforesaid Sixtus and Urban Predecessors, which for greater caution and insofar as it is, We revoke and abolish, insofar as they are in any way adverse to Our present Letters, reducing the same in all and throughout to the way and terms of these present ones; Lest in a matter of such moment, for the right and happy government of Holy Church and the Commonwealth, danger should threaten, that under the faith and reports of another, the unlearned and those who, if they had undergone diligent examination administered by the Notaries themselves personally and collegially, would perhaps have been found less suitable, should be promoted to these degrees; Or that which We account absurd should follow, namely that to the aforesaid College of Our Notaries, to which truly and really to those present in the same City, not more than four each year, with diligent examination premised, according to the aforesaid indult of Our Predecessor Urban, it was conceded to promote to the aforesaid degree; the same thing should be deemed permitted in an indefinite number, as regards those who remain absent from the same City and are constituted perhaps in the most remote regions.
43 § 24. To provide, however, for the indemnity of those who up to now have received the degree of Doctor in both or in one of the laws from the aforesaid Beloved Sons, the Notaries of the Apostolic See, outside the City and in their absence, contrary to our present declaration; we validate and confirm by our authority in perpetuity all and singular such promotions made up to this day, and we heal any nullities of such promotions arising solely from defect of authority by the tenor of these presents; and we decree that such promotions and degrees thus far obtained and respectively received shall be valid for all effects for which they were henceforth to be considered valid, and that those thus promoted shall henceforth also be able to benefit therefrom in the same manner as is set forth.
44 § 25. Since, moreover, the illustrious and most ancient College of Notaries of the number of Participants in this College, on account of the grateful devotion and familiar services which it has unceasingly rendered to Us and the Apostolic See, and other merits of that College and the aforesaid Notaries, which we regard with favor, we, wishing to exhibit some sign of our will as a recompense for this, grant to the same Notaries of the number aforesaid and to their College full freedom, license, faculty, and power by these same presents, which we grant and impart, so that they themselves may henceforth in perpetuity each year promote to the aforesaid degree of Doctor in one or both laws, not merely four persons only, and those familiar and poor, as is found prescribed in the Letters of Urban, Our Predecessor, but by virtue of these presents, six persons indeed, even if not familiar nor poor (provided, however, that they be present in the City and that other necessary requisites be satisfied for them), and that those thus promoted and laureated by them for the time being shall be able to enjoy and shall enjoy all and singular the favors, honors, graces, and privileges by which similar Doctors laureated in the public Archigymmasium of the Sapience of the City are accustomed to enjoy, use, and possess by right, by privilege, by custom, or in any other way; similarly and equally they shall be able to use, enjoy, possess, and enjoy them, and for all and any effects, even for obtaining Cathedral Churches, be esteemed, held, and reputed by all everywhere, and as if they had been laureated in the aforesaid Archigymmasium by these and the other Letters of Our Predecessor.
45 each one to the Predecessor's Letters and to fulfill the aforesaid six, and no subsequent; within the Dominicans, for each one to the Archivum, by the Secretary aforesaid, and not otherwise, to conduct themselves, insofar as to which, both privately and by right in one or the other law.

48 prescribed in the aforesaid, and following, for any and all effects at no time ever to be able to benefit, and them by others than the Advocates aforesaid; even by the same Notaries of the number aforesaid, beyond the six aforesaid, to the degree of Doctor in this manner nullly and invalidly promoted or assumed, to be held as non-Doctors, by the same Apostolic Authority we decree and determine.
49 § 28. Furthermore, wishing to honour the aforesaid Advocates of Our Consistorial Court and their College with more ample favours and graces, and to provide more fully for the splendour and dignity of the aforesaid Archigymnasiium, the Alma Mater of Our City, in a manner more happy and useful to the state and government of the Roman Curia, and considering this to be consonant with reason and justice, so that those who seek admission to Dignities, Prelatures, Magistracies, and other offices and duties of the said Curia, which exist in and are exercised in the same Curia and in the Roman City, and which have connected with them the degree of Doctor in one or both branches of Law, now or at any time hereafter desire to be promoted and advanced, may give public proof of their learning and fitness in the aforesaid Archigymnasiium; by the Apostolic Authority aforesaid, by Our own motion, knowledge, and the fullness of power, We establish and ordain that those indeed who before the day of publication of these presents shall have been legitimately promoted to such a degree of Doctor in any public and approved University of General Studies, whether of the Ecclesiastical State or foreign, may be admitted to Prelatures, Magistracies, Judgeships, Lectureships, and Dignities, even Ecclesiastical ones, of this City, as well as to the faculty of writing in both law and fact, and of acting as Procurators in cases before the aforesaid Rota Romana Auditory, provided that other necessary requirements are otherwise respectively satisfied for them, and may freely and lawfully receive, retain, and exercise the same and those, and may not on that account be required to have been
50 truly promoted and laureated in the Archigymnasiium; extending and enlarging as to these matters both the Letters of Sixtus and Urban, Our Predecessors, aforesaid, which shall henceforth remain in their force. Saving nevertheless §. 26. We will, however, that the same Notaries and their aforesaid College in the promotion and creation of the said six Doctors of Law, one or both, shall observe and fulfil all and singular things prescribed by the ordinance of Urban, Our Predecessor, as contained in Our present Letters, and shall completely and entirely observe and fulfil them; and that the number of the said six, and no more, in any year shall not be able to be completed in that year, nor shall it be able to be completed or restored in subsequent years; and that a record of the promotions, with the names, surnames, and native country of the promoted, within one month from then next following, to be reckoned from the day of each promotion, shall be brought to the Urban Archive, in the manner of other records, by the Secretary of this College, or by the promoted themselves and laureates, and shall be brought; and only then, that is, after the aforesaid record shall have been brought to the Urban Archive, and not before, may such a promoted person conduct himself as a Doctor, and be held as legitimately laureated and promoted for all effects of Law: Otherwise the promoted person himself conducting himself as a Doctor publicly or privately shall incur the penalty of forgery by the fact itself and by law. All §. 27. All other promotions and creations of Doctors in both or one branch of Law, and the bestowal of Doctoral insignia by others than the aforesaid Consistorial Advocates, whether by Palatine Counts or by Notaries from the number of Participants and their College, contrary to or beyond the prescribed form and the fixed number in the Roman Curia and City aforesaid, hereafter made or to be made, with all and singular things following and to follow therefrom, are null and void, of no force or moment, and shall be held and deemed as null and of no effect, and ought to benefit no one for any effect whatsoever at any time; and those promoted or assumed to the degree of Doctor in this manner by others than the aforesaid Advocates, even by the same Notaries from the aforesaid number, beyond the six aforesaid, We establish and decree by the same Apostolic Authority to be held as non-Doctors, and of no validity and effect.
51 § 28. Furthermore, desiring to honour the aforesaid Advocates of Our Consistorial Court of the Palace, and their College and Benefices, with more ample favours and graces, and both to consult more fully and to provide for the splendour and dignity of the said Archgymnasium, the Alma University of Our City of Rome, and for the happier and more useful state and governance of the Roman Curia, and at the same time considering this to be consonant with reason and right, that whosoever, desiring to be admitted to the Dignities, Prelacies, Magistracies, and other duties and Offices of the said Curia, which exist in and are exercised in the same Curia and in the Roman City; and which have annexed to them the degree of Doctor in one or both branches of Law, now or in any manner require, and for the time being seek to be promoted and advanced, should give public proof of their learning and fitness in the aforesaid Archgymnasium; by the Apostolic Authority aforesaid, and by Our own motion, knowledge, and fullness of power, We do establish and ordain, that those indeed who before the day of the publication of these presents shall have been legitimately promoted to such a degree of Doctor in any public and approved University of Study, whether of the Ecclesiastical State or foreign, may be admitted to the Prelacies, Magistracies, Judgeships, Lectureships, and Dignities, even Ecclesiastical, of the said City, and also to the faculty of writing in both law and fact, and of acting as Procurators in cases before the aforesaid Rota of Rome, provided that the other necessary requisites shall otherwise respectively suffice for them, and may freely and lawfully receive, retain, and exercise the same and those, and shall not on that account be required to undertake again the same degree of Doctor in the said Archgymnasium. On the other hand, those who before the day of the publication of these same presents shall be found to have begun to pursue the Doctoral degree as aforesaid, shall not be able to obtain any of the Dignities, or any of the Ecclesiastical Benefices in the Basilicas, or Collegiate, or other Churches of the City of Rome existing in the City, for which, when they are to be obtained, held or retained, the degree and quality of Doctor is required by the disposition of the Sacred Canons, or of general Councils, or of Apostolic Constitutions, or of other Sanctions, or even by the law of foundation, and also to the Prelacies, Magistracies, Judgeships, even to be exercised in another's name, and public Lectureships of the City and Curia aforesaid, and also to the faculty of acting as Procurators in cases before the same Rota, or of answering in law, or of writing as an Advocate in the office before any Judge or Tribunal; and finally to any duty or Office of the City and Curia aforesaid to be exercised in the same City, which by law equally, or by statute, or from some Apostolic Constitution and Ordinance, or even from long and inveterate custom, requires and demands such degree and quality of Doctor, cannot and are not able to be received or admitted, and cannot respectively obtain or exercise the same and those, even if the aforesaid Prelacies and Judgeships of the same Rota, and of the Chamber and Apostolic Chancery, of Our Signature, of the Roman People, or of any College, even privileged and most privileged, and with special and most special, and specific and individual mention and expression, should exist; unless before admission and reception of this kind, or, as regards the aforesaid Ecclesiastical Benefices and Dignities, within the time fixed by law in the Constitutions and Canonical Sanctions aforesaid or in the foundation respectively, they shall have undertaken the degree of Doctor in the public Archgymnasium of Our City:
52 Decreeing and by the same Authority establishing, that the degree of Doctor of this kind, after the publication of these presents, given and received in any other University of Study whatsoever, whether foreign or of Our Ecclesiastical State, however public, approved, celebrated, and famous, and worthy of most special mention, shall avail the graduates themselves for obtaining any other thing, but never for the effect of acquiring the aforesaid Dignities, Prelacies, Judgeships, Lectureships, Duties, and Offices aforesaid in Our Curia and City; indeed for the effect of the aforesaid matters, the degree of Doctor given and received elsewhere shall be held, and ought to be held, as if it had in no way been given and received.
53 § 3. We wish, however, that those be excepted from this general law whom by virtue of an Apostolic privilege or indult granted by this Holy See to some nation, city, university, or college, or to the office of Advocate of Our Consistory, as above, or to the office of Auditor of Cases of Our Apostolic Palace, it may happen to be named to Us or to the Roman Pontiff existing for the time being, and to be chosen and appointed according to the tenor of such indults: Namely, that if those who are nominated and elected to the aforesaid offices shall be found to have been promoted to the doctoral degree in both laws in some notable university of that nation, or city, or in that university or college respectively to which such indults or privileges were granted, such degree received by them, as aforesaid, joined with the testimony of those who presented them, as well as the judgment of the Pontiff who elected and appointed them to the aforesaid offices, shall be deemed sufficiently to avail them for the purpose of obtaining such offices and exercising them with the observances to be observed; and without their being able to be compelled to a repeated reception of the aforesaid degree in the said Sapienza Archigymmasium.
54 In order, therefore, that this ordinance and statute of Ours may be inviolably observed in perpetuity for all future times, We commit and enjoin by these same writings to Our Venerable Brethren Thomas, Bishop of Ostia and Velletri, and to the Most Reverend Cardinal Ruffo, Vice-Chancellor of the Holy Roman Church, and to Annius, Bishop of Porto, Camerlengo of the same Holy Roman Church; as well as to Our beloved Nero, Cardinal Deacon of St. Eustachius of the aforesaid Holy Roman Church, Prefect of the Justices of Our signature, and to their respective successors in the aforesaid offices; and likewise to Our beloved sons, the Colleges of Apostolic Notaries, the Protonotaries called of the number of Participants, and Our Chaplains, the Auditors of Cases of the Sacred Palace, as well as the Clerks of Our Apostolic Chamber, and the Referendaries voting of the Signatura of Justice, and the Abbreviators of the Major Parco, and their respective Advocates of Our Consistory and Procurators of Cases of the Sacred Palace, and their respective Deans; also to the Chapters or Colleges of the Basilicas, Collegiate Churches, and other Churches of the said City, and to other Superiors and Persons, present and future, to whom this now in any way pertains, and shall pertain for the time being, that attending humbly to the aforesaid ordinance and statute, they shall take care that the aforesaid be observed and fulfilled, and shall not henceforth admit or receive anyone to the aforesaid Dignities, Prelacies, Magistracies, Judgeships, Lectureships, Offices, and Benefices, who has not received the degree of Doctor in the aforesaid Archigymmasium, outside the cases excepted by Us, as above, nor permit the series, disposition, and tenor of this ordinance and statute of Ours to be knowingly or unknowingly attempted against by anyone whatsoever with any authority at any time.
VII. § 32.
55 Finally, whatever offices of the Roman Curia attributed to the aforesaid College of Advocates of the Consistory, both by express concessions of Our predecessors and by long custom, are known to belong to it exclusively, as aforesaid, We declare all and singular of them to be so attached and acquired to the aforesaid College of Advocates, and in perpetuity for all future times neither the office of Promoter of the Faith, concerning which a decree exists under Urban VIII, given on the eighth day of January in the year of Our Lord one thousand six hundred thirty-one, in the writings of the same College hitherto inviolably observed; and which We ourselves, when constituted in minor orders, held a place in the same College and performed for several years; nor the office of Advocate of the Poor, or other office of Advocate of the Fisc and of Our Apostolic Chamber, which once fell to the Senior of the aforesaid College for the time being, but thereafter by the will of the Supreme Pontiff, was always conferred upon someone from the same College; nor likewise that of Advocate of the Fabric of the Basilica of the Apostles, Princes; or that of Advocate of the Senate and People of Our Almighty City; or finally the office of Commissioner of the Consistory during a vacant See, shall be granted to anyone whomsoever, except to someone from the said College of Advocates of Our Consistory, any custom whatsoever to the contrary, if any should perchance be alleged concerning any of the aforesaid offices, notwithstanding in the least.
§ 32.
56 We nevertheless approve the aforesaid Offices of the Promoter of the Faith and Advocate of the Fiscal, which two offices were formerly accustomed to be obtained and exercised jointly by one and the same person, but by our of blessed memory Predecessor Pope Clement XI, for reasonable causes were thereafter disjoined and separated from one another, by his Letters in perpetual form conveyed on the seventh day of April in the year one thousand seven hundred and seven, issued in the form of a Brief, and likewise in the future to be conferred separately and to be exercised by two respective Consistorial Advocates; whatever thereafter has been observed in practice, and obtains at present in the person of our beloved Son Master Louis of the Valleys, modern Promoter of the Faith and Advocate of the Fiscal, by special grace granted to the same by our of blessed memory Predecessor Pope Clement XII, and not to be extended beyond his person in any way. Wherefore also the assignment of a portion of bread and wine, as well as of three hundred scudi of Roman currency, which thereafter the aforesaid Clement XI, by other his Letters in similar form given on the thirtieth day of April in the year one thousand seven hundred and fourteen, deducted from the salaries and emoluments of the Advocate of the Fiscal, together with such portion of bread and wine, which was formerly accustomed to be given to the aforesaid Advocate of the Fiscal from the Apostolic Palace, to the Promoter of the Faith for the time being henceforth to be paid, by the aforesaid authority and by this series we approve, confirm, and renew, and in the future, when the case shall occur for the mandated separation to be executed again in fact, we command to be perpetually observed.
57 § 33. Furthermore we strictly command that any of the aforesaid Advocates to whom the office of Advocate of the Fiscal and of the Apostolic Chamber, likewise also the office of Advocate of the Poor has been assigned, shall abstain from undertaking the patronage of other cases which do not pertain in the least to the office respectively committed to him; any custom whatsoever made to the contrary notwithstanding.
58 § 34. But in order that the aforesaid Advocates may conveniently be able to devote assiduous labour to so many and so great public and grave duties, and that provision may be made for their spiritual consolation as well through the favour of Apostolic benignity, which we granted to them by our Letters in the form of a Brief to be made under the twenty-eighth day of February in the year one thousand seven hundred and forty-two, we also by the tenor of these presents and by the aforesaid authority confirm and renew, namely that to the same Consistorial Advocates and their Coadjutors now and for the time being whenever existing, in the private house of any one of their dwellings, even in this our Beloved City, in an Oratory decently built with a wall and adorned for this purpose, or to be built and adorned, free from all domestic uses, by our beloved Son in the same City and its District Vicar General in spiritual matters, as regards Oratories in the said City, and as regards others outside the same City, by the Ordinary of the Place respectively, first visiting and approving, one Mass for each day, provided that the licence for celebrating Mass in such a house, which still endures, shall not have been granted to another, they themselves, if they shall be Priests, may celebrate, or by any approved Secular Priest, or by a Regular with the licence of their Superiors, without however any prejudice to the rights of the Parish, and excepting Easter of the Resurrection, Pentecost, and the Nativity of Our Lord Jesus Christ, and other more solemn festival days of the Year, in their own presence, and insofar as they shall be married, in the presence of their respective wives, as well as of their sons, blood relations, and relations by marriage dwelling together with them in the same house, and of any of their family, they may freely and lawfully cause to be celebrated, provided however that the wives and children and blood relations and relations by marriage aforesaid may only hear the aforesaid single Mass with the Advocates themselves present, but may never cause it to be celebrated, and that the servants of the same not necessary for the services attending the Mass there shall not be considered free from the obligation of hearing Mass in the Church on festival days of precept. And that this grace shall be enjoyed only by those of the Consistorial Advocates who shall have petitioned for it and obtained Apostolic Letters in the form of a Brief to be issued in favour of each one, and not otherwise.
59 § 35. Furthermore all and singular the aforesaid matters, and other Privileges and Indults granted to such a College of Advocates, as well as the same College's laudable styles, uses, and customs, and also ordinances and Constitutions are confirmed.
60 Pontiffs, and the Statutes made and established for the proper governance and administration of the same College, provided they are lawful and honest, and in no way contrary to the Sacred Canons and the Decrees of the Council of Trent, to the Apostolic Constitutions, and to the tenor and disposition of these presents, We do by Apostolic authority confirm and approve the same in perpetuity by the tenor of these presents, and We add to them the full and inviolable strength of Apostolic firmness; and We supply all and singular omissions, whether of law or of fact, as well as of solemnities of whatever kind, and any other defects that may perchance have intervened in the same;11 and thus We renew all things by the aforesaid authority and tenor, and grant them anew, and We will and command that they be inviolably observed in perpetuity by all and singular persons to whom it pertains and shall pertain in the future. And that the aforesaid Statutes, Constitutions, Ordinances, styles, usages, and customs of the same College may be freely and lawfully abrogated, annulled, changed, altered, and others put in their place, made, established, and observed, according to the quality of things and persons and as often as it shall seem expedient to them, which after they have been made, established, and issued, provided, as is premised, they are lawful and honest, and are not contrary to the Sacred Canons and Decrees of the said Council, to the Apostolic Constitutions, and to the tenor of these presents, shall by that very fact be confirmed by the said authority, and shall be observed in the future by all and singular to whom they pertain, under the penalties contained in them: Moreover, that they may elect and appoint the Rector and Secretary of the same College and other Officials and Ministers, remove, dismiss, and change them at their pleasure, as often as it shall seem good to them, the same authority and tenor of these presents We also grant and indulge in perpetuity, and We impart full, free, and absolute faculty and authority, any custom to the contrary notwithstanding.

62 Decreeing that the same present Letters, and whatever is contained in them, even for the reason that anyone in the premises, or in any of them, having or pretending to have interest, of whatever status, degree, order, precedence, or dignity they may be, or otherwise worthy of specific and individual mention and expression, have not consented to them, nor have been called and heard, nor have the causes on account of which the same presents were issued been adduced, verified, or sufficiently justified, or from any other cause whatsoever, even however juridical and privileged; under color, pretext, and head, even in the body of law closed, shall at no time be noted, impugned, infringed, retracted, brought into controversy, or reduced to the terms of law, or against them aperition, restitution in full, or any other whatsoever remedy of law, fact, or grace be sought or obtained, or even by Motu proprio, and from the fullness of Apostolic power similarly granted or issued, anyone in judgment or outside it use or avail himself in any way; but the same presents shall always be firm, valid, and efficacious, and shall exist and be, and shall benefit the said College and the Advocates existing for the time in all things and throughout, even in perpetuity, and the same College shall be bound in no way to the verification or justification of the premises, or part of them, nor shall it be compelled in any way by any authority; but the same, and whatever is contained in them, shall be inviolably and firmly observed by all to whom it pertains, and for the time, whenever it shall pertain. § 37. 64 Deputation § 38. Wherefore to these same Venerable Brothers of Ours, Thomas Bishop of Ostia and Velletri, Executive Cardinal and Vice-Chancellor of the Holy Roman Church, Rufus, and Hannibal, Bishop of Porto, of the same Holy Roman Church, Cardinal Camerlengo of St. Clement respectively appointed; as well as to our beloved Son, Master Flavius Chisio, Auditor General of the Causes of the Court of Our Apostolic Chamber, and to their respective Successors in these Offices; by these Apostolic writings we command, that they themselves, or any two, or any one of them, by themselves or through others, or another, by our authority, may assist the aforesaid Advocates of Our Consistorial Court, and their College, in all and singular the foregoing matters, with the protection of effective defense, and may cause them, and each of them, whenever they shall be required on their behalf concerning this matter, to enjoy and possess peacefully all and singular the aforesaid things, not permitting them, or any of them, to be molested, disquieted, or hindered in any way whatsoever by anyone: compelling any and all Contradictors and rebels, of whatever status, rank, order, dignity, or pre-eminence they may be, by Ecclesiastical Censures and pecuniary penalties, and by such other appropriate remedies of law and fact, appeal being set aside.
65 Notwithstanding § 39. Notwithstanding Our rule and that of the Apostolic Chancery concerning acquired right not to be removed, and all the foregoing, and other Apostolic Constitutions and Ordinances issued in Universal, Provincial, and Synodal Councils, whether general or special;
66 Derogation 567 nor the Statutes and customs, even those confirmed by oath, Apostolic confirmation, or any other firmness, of any of the Colleges of Our City, of whatever kind, Tribunals, Universities, and of the aforesaid Advocates of the Consistorial Court and Gymnasium, even those strengthened by oath, Apostolic confirmation, or any other firmness; nor privileges, exemptions, and indults, even those contained in the body of law or in Apostolic Letters granted to any persons, and to the same City, as well as to Our beloved Sons the Roman People, and to other Cities and places, to Colleges also, Tribunals, Universities, and to any others whatsoever worthy of specific and individual mention, even under whatever tenor and forms of words, and with whatever clauses and decrees, even those irritating in general or in particular, even by similar motion and from the fullness of Apostolic power, or Consistorially, and in any other way whatsoever granted in contravention of the foregoing, and confirmed, approved, and renewed many times. Publication § 40. We will moreover and by the same authority command by these presents, that these same presents, or their transcripts, in the accustomed places of Our City of Rome, by one of Our Cursors, as is the custom, be published and affixed, and thus published and affixed, all and singular whom they concern, or shall concern in the future, shall be affected and bound in the same manner as if they had been announced and notified to each of them annually.
