DE NOBILITATIS PRIVILEGIO IAM ORDINIS PIANI PROPRIO ABOLENDO PIUS PP. XII

1 Ad perpetuam rei memoriam. — Litteris suis Apostolicis sub anulo

2 Piscatoris obsignatis die decima septima m. Iunii, an. MDCCCXLVII ac die pariterdecima septimamensis Iunii, an. MDCCCXLIX, necnon decreto ex Aedibus in Quirinali dato die xi m. Novembris an.

3 Datum Romae, apud Sanctum Petrum, sub anulo Piscatoris, die xi m. Novembris, an. MCMXXXIX, Pontificatus Nostri primo.

CONCERNING THE PRIVILEGE OF NOBILITY OF THE PIAN ORDER ITSELF NOW TO BE ABOLISHED BY PIUS PP. XII

1 To the perpetual memory of the matter. — By his Apostolic Letters sealed with the seal of the Fisherman on the seventeenth day of the month of June, in the year 1847 and likewise on the seventeenth day of the month of June, in the year 1849, as well as by a decree given from the Buildings on the Quirinal on the eleventh day of the month of November in the year 1856, Our Predecessor Pius PP. IX created and instituted an Equestrian Order, called the Pian Order, which consisted of three classes of Knights. Moreover, by the aforesaid Apostolic Letters it was also decreed that Knights co-opted into the first class of the same Order should enjoy the privilege of nobility to be transmitted also to their sons, while those who were honored with the insignia of the second class should enjoy the title of nobility for their person only. This, having regard especially to the circumstances of our times, appears less opportune, since the other Equestrian Orders, even the more distinguished ones, whose insignia are conferred by the Roman Pontiffs, in no way enjoy any privilege of nobility whatsoever. Therefore, having carefully weighed all the considerations of the matter, We, in order that the Pian Order likewise be made equal to the other Pontifical Equestrian Orders in this right, by our own motion deem it necessary to decree that, those things abolished which had already been decreed by the aforesaid Apostolic Letters, from now and for the future all and each, admitted into whichever of the three classes of the aforesaid Pian Order, may lawfully use, enjoy and possess the insignia and proper title of their class only, without any right or privilege of nobility whatsoever. Notwithstanding any contrary provisions; decreeing that these present Letters remain firm, valid and effective perpetually and permanently, and produce and obtain their full and complete effects; and thus it is to be judged and determined, and if anything to the contrary should happen to be attempted by anyone, by whatever authority, knowingly or unknowingly, it is to be rendered null and void from now on.

2 By Letters sealed on the seventeenth day of June in the year eighteen hundred and forty-seven and likewise on the seventeenth day of June in the year eighteen hundred and forty-nine, as well as by a decree given from the Palace on the Quirinal on the eleventh day of November in the year eighteen hundred and fifty-six, Our Predecessor Pius the Ninth, Pope, created and instituted an Equestrian Order, called the Pian Order, which consisted of three classes of Knights. Moreover, by the aforesaid Apostolic Letters it was also decreed that Knights admitted to the first class of the same Order should enjoy the privilege of nobility transmissible to their sons, while those who should be honored with the insignia of the second class should enjoy the title of nobility for their person only. This, having regard especially to the circumstances of our times, appears to be less fitting, since the other Equestrian Orders, even the more distinguished ones, whose insignia are conferred by the Roman Pontiffs, in no way enjoy any privilege of nobility. Therefore, having carefully weighed all the considerations of the matter, We, in order that the Pian Order may likewise be made equal to the other Equestrian Orders of the Pontiffs in this right, do judge it necessary to decree by Our own motion that, those things being abolished which had already been decreed by the aforesaid Apostolic Letters, from now and for the future all and each of those admitted to any of the three classes of the aforesaid Pian Order may lawfully use, enjoy and possess the insignia and proper title of their class only, without any right or privilege of nobility. Notwithstanding any contrary provisions whatsoever; decreeing that these present Letters shall remain firm, valid and effective perpetually and continue in force, and shall produce their full and complete effects; and thus it is to be judged and determined, and if anything to the contrary should happen to be attempted by anyone, by whatever authority, knowingly or unknowingly, it shall be null and void from now on.
