1 § 1. La provvida e sollecita cura dei Romani Pontefici nel disporre e ordinare quelle cose che, dalla natura stessa dei tempi e dei luoghi, si riconoscono più opportune per una più idonea custodia e amministrazione del gregge del Signore, li spinge talvolta a costituire nuove sedi episcopali, e talvolta a trasferirne alcune, affinché, benedicendo il Signore la messe, possano da ciò derivare aiuti più idonei per il bene spirituale del popolo fedele.

2 § 2. Dunque, non appena fu restituita la tranquillità alla Germania, Noi abbiamo continuamente rivolto le Nostre cure a ordinare le cose ecclesiastiche turbate dalla calamità dei tempi passati, e, avendole opportunamente disposte nel regno di Baviera quattro anni fa, parimenti senza indugio abbiamo convertito le Nostre sollecitudini verso tutti coloro che coltivano la fede ortodossa e attualmente sono sottoposti al dominio dei serenissimi principi e stati della Germania, cioè del re del Württemberg, del granduca del Baden, dell'elettore dell'Assia, del granduca dell'Assia, del duca di Nassau, della libera città di Francoforte, del granduca di Mecklemburgo, dei duchi della Sassonia, del duca di Oldenburg, del principe di Waldeck, e delle libere città anseatiche di Lubecca e Brema, i quali, mostrandosi pronti a prestare ogni opera per la conveniente dotazione dei vescovati da erigere o da restaurare da parte della Sede apostolica, hanno inviato a Roma legati in nome comune per questa ragione.

3 § 3. Ma poiché tutte le cose ecclesiastiche, di cui si è trattato, non hanno potuto essere conciliate, tuttavia non disperando che per la saggezza di quei principi e stati possano essere composte in futuro; affinché i fedeli cristiani dimoranti nelle dette regioni, i quali riconosciamo costituiti in massima necessità di governo spirituale, non rimangano più a lungo privi dei propri pastori, abbiamo decretato che si proceda all'erezione delle sedi e alla circoscrizione delle diocesi in alcune delle principali città e territori di quei principi e stati, affinché possiamo provvedere celermente quelle chiese dei loro vescovi: riservandoci la cura di unire in futuro ai cattolici sudditi di altri principi quelle diocesi che giudicheremo più convenienti.

4 § 4. Ascoltato dunque il consiglio dei venerabili Nostri fratelli cardinali della Santa Chiesa Romana, con certa scienza e matura deliberazione Nostra, e dalla pienezza della potestà apostolica, sopprimiamo, annulliamo e togliamo il titolo, la denominazione, la natura e l'essenza, e l'intero presente stato della vacante chiesa episcopale di Costanza, come pure della prepositurale veramente nullius di san Vito di Elvazia, insieme con i loro capitoli, allo scopo di procedere liberamente alle infrascritte nuove erezioni di chiese e circoscrizioni di diocesi, e inoltre mutiamo il presente stato delle chiese episcopali di Magonza e di Fulda, in modo che quella sia completamente sottratta da qualsiasi diritto metropolitico dell'arcivescovo di Malines e non rimanga più soggetta alle disposizioni delle Nostre lettere apostoliche apostoliche inizianti = Qui Christi Domini = date il terzo giorno prima delle calende di dicembre dell'anno milleottocento primo, e questa sia intesa traslata dallo stato regolare al stato secolare per altre lettere apostoliche del Nostro predecessore di felice memoria Benedetto XIV, il cui inizio è = In apostolicae =; e con scienza, deliberazione e potestà simili, per la gloria di Dio onnipotente, per l'esaltazione della fede ortodossa e per l'incremento della religione cattolica, Friburgo in Brisgovia, città principale, insigne per l'Accademia di Studi e altre fondazioni, e abitata da novemila e più cittadini, in città arcivescovile, e il celeberrimissimo tempio sotto il titolo dell'Assunzione della beata Maria vergine in chiesa arcivescovile e parrocchiale; parimente Rottenburg ad Nicaeam, un tempo capitale del ducato di Hohenberg, nel mezzo del regno del Württemberg, nel quale esiste il tribunale della provincia, e che è abitato da circa cinquemilacinquecento abitanti, in città vescovile, e in essa il tempio molto ampio sotto l'invocazione di san Martino vescovo e confessore in chiesa vescovile; nonché Limburgo sul Lahn, situato in terreno fertile nel mezzo del ducato di Nassau, e che contiene duemilasettecentocinquanta abitanti, in città similmente vescovile, e il tempio in essa esistente sotto l'invocazione di san Giorgio in chiesa parimente vescovile, con tutti i diritti, le giurisdizioni, le preminenze, gli onori e i privilegi legittimamente competenti alle sedi arcivescovili e vescovili rispettivamente, perpetuamente erigiamo e costituiamo.

5 § 5. Inoltre alla metropolitana chiesa di Friburgo assegniamo come suffraganee le quattro suddette chiese episcopali di Magonza, Fulda, Rottenburg e Limburgo.

6 § 6. Inoltre ciascun capitolo tanto della metropolitana di Friburgo, quanto delle chiese cattedrali di Magonza e Rottenburg sarà composto da un'unica dignità di decano e sei canonicati; quello di Fulda da una dignità di decano e quattro canonicati; e quello di Limburgo da una dignità di decano e cinque canonicati rispettivamente; e inoltre per aumentare alquanto il numero dei ministri saranno stabilite sei prebende, ossia vicarie per altrettanti prebendati, ossia vicari nelle chiese di Friburgo e Rottenburg, quattro in quella di Magonza e Fulda, e due in quella di Limburgo rispettivamente. A ciascuno dei capitoli suddetti concediamo e impartiamo licenza e facoltà di emanare, sotto la presidenza, ispezione e approvazione del rispettivo ordinario pro tempore, statuti, capitoli e decreti, leciti tuttavia e onesti e non contrari alle regole canoniche, per il servizio del coro, per la divisione delle distribuzioni e di altri qualsiasi emolumenti, per il sostentamento degli oneri, per il prospero e felice governo e direzione delle cose e dei diritti tanto spirituali quanto temporali, e di fruire liberamente e lecitamente dei privilegi, insegne e grazie di cui legittimamente godono e si avvalgono gli altri capitoli delle chiese cattedrali in queste parti.

7 A ciascun ordinario delle suddette chiese espressamente ingiungono, che, osservate le cose da osservarsi, designi dai canonici uno che stabilmente eserciti l'ufficio di penitenziere, e un altro dal quale la sacra Scrittura sia esposta al popolo nei giorni stabiliti, oppure se più convenientemente i canonici non potessero essere deputati a questi uffici, i vescovi provvederanno affinché a tali uffici sia soddisfatto da altri idonei presbiteri, e che si procurino i mezzi per procurare ai presbiteri stessi una congrua mercede per i loro lavori. § 8. E poiché secondo il prescritto del sacro concilio di Trento per l'educazione e l'istituzione del clero deve esistere in ciascuna delle suddette chiese tanto arcivescovile quanto episcopali un seminario di chierici da essere liberamente retto e amministrato dal vescovo, dove si alimenti quel numero di alunni che la necessità e l'utilità della rispettiva diocesi richiede, e poiché sappiamo che in quattro di esse già esiste, nelle rimanenti chiese ordiniamo che sia eretto al più presto convenientemente. § 9. Volendo ora procedere alla delimitazione dei territori delle cinque suddette diocesi, affinché con i confini distinti di ciascuna non possa sorgere alcuna questione tra i rispettivi vescovi circa l'esercizio della giurisdizione ecclesiastica, con la previa separazione dei luoghi qui sotto nominati dalle diocesi e dalle chiese da cui attualmente dipendono, dalla medesima pienezza della potestà apostolica decerniamo, prescriviamo e costituiamo quanto segue.

8 § 10. La chiesa metropolitana di Friburgo avrà per suo territorio diocesano tutta la signoria del granducato del Baden, cioè le parrocchie situate entro i confini di questo ducato, che in parte appartengono o appartenevano alla diocesi di Costanza, in parte anche a quelle di Strasburgo, Spira, Worms, Bamberga, Basilea e Ratisbona; inoltre quattordici parrocchie con la loro filiale situate nel principato di Hohenzollern Hechingen appartenenti alla suddetta diocesi di Costanza, nonché ventiquattro parrocchie esistenti nel principato di Hohenzollern Sigmaringen appartenenti alla medesima diocesi di Costanza, e inoltre diciotto parrocchie del decanato di Vöhrenbach e diciassette parrocchie del decanato di Haigerloch situate nel detto principato e appartenenti alla predetta diocesi.

9 § 12. La chiesa episcopale di Fulda avrà per il suo territorio diocesano tutto l'elettorato dell'Assia, cioè quaranta parrocchie attualmente comprese nella stessa diocesi, venti parrocchie dall'antica diocesi metropolitana un tempo di Magonza e poi di Ratisbona, e una al posto di Wolkmarsen dalla diocesi di Paderborn, eccettuate quelle frazioni di parrocchie che esistono nel regno bavarico e sono state applicate o saranno applicate a breve da delegazione apostolica alle parrocchie più vicine delle diocesi del regno di Baviera. Le altre frazioni di parrocchie esistenti nel territorio dell'Assia saranno applicate a qualche parrocchia più vicina della diocesi di Fulda. Alla medesima diocesi di Fulda nel frattempo lasciamo nove parrocchie situate nel granducato di Sassonia-Weimar, delle quali Ci riserviamo liberamente, così come ai Nostri successori romani pontefici, la facoltà di disporre diversamente se sarà necessario. § 13. La chiesa episcopale di Rottenburg avrà per il suo territorio diocesano l'intero regno del Württemberg con tutte le parrocchie che già dall'anno milleottocentosedici sono state separate dalle diocesi di Augusta, Spira, Worms e Bamberga, nonché le parrocchie che appartenevano alla soppressione della prepositura di san Vito di Ellwangen Nullius diocesis.

10 § 14. La chiesa episcopale infine di Limburgo avrà per il suo territorio diocesano tutto il ducato di Nassau, nel quale sono compresi cinquantotto parrocchie dell'antica diocesi di Ratisbona, e cinquantadue parrocchie dell'antica diocesi metropolitana di Treviri, nonché ventiquattro parrocchie esistenti nella provincia di Dillenburg e Weilburg, e inoltre il territorio della libera città di Francoforte nel quale con tre filiali esiste una sola chiesa parrocchiale sotto l'invocazione di san Bartolomeo apostolo alla quale appartengono tutti i cattolici della detta città e territorio, e che dipendeva dalla suddetta diocesi di Ratisbona.

11 § 15. Le suddette città e le chiese in esse situate erette in arcivescovili ed episcopali con i predetti luoghi e parrocchie, cinque chiese sopranumerate attribuite per il rispettivo territorio diocesano, i loro abitanti di ambo i sessi, tanto chierici quanto laici per il clero e il popolo, assegniamo perpetuamente e sottoponiamo in ogni modo alla giurisdizione spirituale di ciascun arcivescovo e vescovo, affinché a persone degne e idonee secondo le sanzioni canoniche per reggere le medesime chiese arcivescovili ed episcopali tanto per questa prima volta quanto per i tempi futuri, per autorità apostolica, previo processo d'inchiesta dal romano pontefice secondo la forma dell'istruzione redatta per ordine del Nostro predecessore papa Urbano VIII in singoli casi, sia lecito preporre, come

14 Noi ordiniamo e comandiamo per se stessi, o per altri in loro nome, dopo che tuttavia le presenti lettere saranno state debitamente e integralmente eseguite, e i predetti presuli avranno ottenuto le lettere di provvisione apostolica, di apprendere liberamente il vero, reale e corporale possesso del governo, dell'amministrazione e di ogni diritto diocesano nelle predette chiese, città e diocesi, e dei beni e altri redditi assegnati o da assegnarsi per la dotazione, e di mantenerlo perpetuamente. Decretiamo nel frattempo che tutti e singoli i luoghi sopramenzionati da questi stessi, o da vicari o amministratori legittimamente deputati, continuino a essere governati temporalmente, ai quali attualmente sono sottoposti.

15 § 16. Affinché tuttavia tutti e singoli i provvedimenti da Noi disposti sopra ottengano effetto celere e felice, al venerabile fratello Giovanni Battista De Keller vescovo di Evreux, che nominiamo, eleggiamo e deputiamo esecutore delle Nostre presenti lettere, affidiamo e comandiamo che proceda alla rispettiva dotazione delle suddette chiese, capitoli e seminari in beni, fondi stabili e altri redditi con diritto di ipoteca speciale, e nei fondi successivamente e beni stabili da convertirsi da essi in proprietà da possedere e amministrare, nel modo e nella forma in cui sono stati offerti ed espressi dai serenissimi principi sotto il cui dominio sono situate le singole diocesi per mezzo degli strumenti legittimi sottoscritti qui di seguito e trasmessi a Noi, i quali si conservano negli atti della congregazione preposta alle cose consistoriali, e di cui autentiche copie dal predetto esecutore saranno consegnate alle singole chiese per essere conservate nei loro rispettivi archivi; cioè.

16 17. Alla chiesa arcivescovile di Friburgo in Brisgovia assegnerà il dominio di Linz, volgarmente Linz, e altri redditi, quali beni e redditi in totale producono la somma annua di settantacinquemila trecentosessantaquattro fiorini renani, come è dato e distintamente descritto nello strumento fatto per speciale mandato del gran duca di Baden il ventitreesimo giorno di dicembre dell'anno milleottocentoventi. I fondi detti Giovanni Battista vescovo così distribuirà, affinché da essi provengano ogni anno alla mensa arcivescovile tredicimila quattrocento fiorini, ai quali aggiungendo quelle prestazioni qui sotto narrate da tre cattedrali chiese annualmente da pagarsi, della medesima mensa friburghese arcivescovile i redditi annui saranno quattordicimila settecentodieci fiorini; al decano del capitolo quattromila fiorini, al primo dei canonici duemilatrecento fiorini; a ciascuno degli altri cinque canonici milleottocento fiorini, a ciascuno infine dei sei prebendati novecento fiorini; inoltre al seminario diocesano venticinquemila fiorini; alla fabbrica della chiesa cattedrale cinquemiladuecento sessantaquattro fiorini, alla cancelleria arcivescovile tremila fiorini, alle case infine degli ecclesiastici emeriti, e demeritorum, o già esistenti, o da erigere da parte dell'ordinario alla cui giurisdizione saranno sottoposte, ottomila fiorini; inoltre per l'abitazione dell'arcivescovo assegnerà il palazzo nella città di Friburgo adiacente alla piazza della chiesa metropolitana, prima destinato agli stati provinciali di Brisgovia con i suoi annessi, pertinenze, e orto davanti alla porta della città e per l'abitazione tanto del decano, quanto di sei canonici, e sei prebendati altre case nel predetto strumento descritte.

17 § 18. Alla chiesa episcopale di Magonza, fermi i redditi e i proventi di cui attualmente gode, tribuerà la somma annua di ventimila fiorini renani da percepirsi dai proventi e redditi della prefettura di Magonza costituita all'esazione dei dazi e redditi dominicali, da pagarsi ogni anno alla predetta chiesa con questa legge, affinché la ricordata somma goda del diritto di ipoteca nei beni, fondi, e redditi dominicali della medesima prefettura di Magonza, e affinché questa disposizione rimanga ferma, stabile, e inconcussa, finché alla medesima chiesa episcopale di Magonza non siano assegnati i poderi e i fondi, i cui frutti producano annualmente la somma di ventimila fiorini da possedersi da essa in pieno diritto, come espressamente è stabilito nello strumento fatto per speciale mandato del gran duca dell'Assia, e al Reno il ventiseiesimo giorno di agosto dell'anno milleottocentoventi. Questa somma però di ventimila fiorini annui unita ai redditi che costituiscono la dote attualmente esistente della chiesa di Magonza, come supplemento della dotazione, la quantità totale dei redditi che ne risulterà, così dal predetto esecutore sarà distribuita, affinché al vescovo ottomila fiorini, al suo vicario generale duemilacinquecento fiorini, a ciascuno dei sei canonici milleottocento fiorini, al primo però dei quattro prebendati novecento fiorini, e a ciascuno degli altri tre ottocento fiorini annui redditi liberi forniscano. Questa però disposizione quanto al decano, canonici, e prebendati suo effetto non avrà se non quando la chiesa cattedrale di Magonza

18 Poiché il numero dei canonici della Basilica Romana è stato ridotto a sei, a questo fine decerniamo che quattro dei dieci benefici attuali di quel capitolo, quando per qualsiasi motivo si rendessero vacanti, non siano conferiti ad altri; affinché lo stesso capitolo consti in seguito del decano e di sei canonici. Nel frattempo tuttavia i dieci canonici viventi percepiranno gli stessi redditi annuali che percepivano prima della porzione staccata e attribuita alla chiesa di Spira dell'antica diocesi di Magonza, e che dopo la nuova circoscrizione delle diocesi del territorio un tempo della Gallia, stabilita per altre Nostre Lettere in piombo date il terzo giorno prima delle calende di dicembre dell'anno milleottocentouno, furono loro attribuiti. Quanto ai prebendati che attualmente non esistono nella chiesa cattedrale di Magonza, poiché in loro vece fungono da sacerdoti coloro che hanno redditi parte della prebenda dall'ufficio della fabbrica minuta nel presente denominata, parte da pensioni che dal governo sono versate al presente, quindi tali sacerdoti continueranno a prestare il medesimo servizio con detti redditi alla chiesa cattedrale, finché, venendo a mancare costoro, quattro prebende suddette da ora per allora potranno essere erette e costituite con la suddetta dotazione di novecento fiorini annuali per la prima, e di ottocento fiorini per ciascuno degli altri tre prebendati. Per l'abitazione del vescovo servirà quella casa con l'orto adiacente, di cui finora ha goduto, e la medesima dovrà essere mantenuta tanto per i canonici presenti quanto per i futuri, per la cui abitazione sono già assegnate dieci case, quattro delle quali hanno anche orti adiacenti. Per la fabbrica della chiesa cattedrale e per sostenere le spese necessarie al culto divino saranno conservati i fondi, i poderi e gli altri redditi posseduti da tempo dalla suddetta chiesa, che ammontano alla somma annuale di milletrecentotrentacinque fiorini. Lo stesso disponiamo riguardo al seminario diocesano, che, previa soppressione del convento un tempo abitato da uomini religiosi dell'ordine dei Frati Eremiti di sant'Agostino, decerniamo debba essere stabilmente eretto nello stesso convento con la chiesa annessa e l'orto, e gli assegniamo redditi annuali parte dai fondi antichi restituiti nell'anno milleottocentosei, parte da donazioni e legati posteriori provenienti, che costituiscono la somma di settemila settecento fiorini, oltre anche la recentissima e abbondantissima donazione fatta a suo favore, e non altre eventualmente da farsi in seguito, i cui redditi saranno perpetuamente assegnati al medesimo seminario. Lo stesso infine disponiamo riguardo alla casa dei sacerdoti emeriti di Pfaffenschwabenhemii esistente e destinata a fomentare e sostenere i chierici, o stanchi per l'età, o debilitati dalla malattia, che decerniamo debba essere costituita nella fabbrica di quel convento, previa soppressione del convento un tempo abitato da canonici regolari dell'ordine di sant'Agostino, e la cui dotazione produce la somma annuale di milleottocentoventidue fiorini oltre a ciò che viene raccolto a titolo di sussidio caritativo nella parte dell'antica diocesi di Magonza, poi di Ratisbona, e che finora è stato solito essere versato con non piccoli incrementi di capitale. § 19. La chiesa episcopale di Fulda avrà campi, prati, boschi e altri fondi costituenti la somma annuale di ventiseimila trecentosettanta fiorini renani, come è descritto più ampiamente nello strumento redatto dal suddetto elettore dell'Assia sotto il quattordici marzo dell'anno milleottocentoventuno. Questo dotazione il suddetto esecutore la distribuirà in modo che al vescovo spettino seimila fiorini, al decano del capitolo duemilasei cento fiorini, a ciascuno dei quattro canonici milleottocento fiorini, a ciascuno dei quattro prebendati ottocento fiorini annualmente, alla fabbrica della chiesa cattedrale duemila fiorini, al seminario diocesano settemila fiorini, e all'arcivescovo di Friburgo come metropolita centosettanta fiorini annualmente siano versati. Inoltre per l'abitazione del vescovo e per la curia episcopale stabiliamo la casa prossima alla chiesa cattedrale verso il monte di san Michele con due orti adiacenti e le sue pertinenze, per l'abitazione del decano, dei quattro canonici e dei quattro prebendati altre case descritte nel memorato strumento, e infine per il seminario l'edificio prossimo alla chiesa cattedrale già destinato a questo uso con l'orto adiacente.

19 § 20. La chiesa episcopale di Rottenburg godrà dei redditi singolarmente descritti nello strumento redatto per speciale mandato della regia Württemberg il dieci novembre dell'anno milleottocentoventi, i quali certamente dal suddetto esecutore dovranno essere divisi in modo che alla mensa episcopale spettino diecimila fiorini, al decano del capitolo duemilaQuattrocento fiorini, a ciascuno dei sei canonici milleottocento fiorini, al primo dei sei prebendati novecento fiorini, a ciascuno degli altri cinque prebendati ottocento fiorini, alla fabbrica della chiesa cattedrale e al mantenimento degli altri edifici mille fiorini.

1 § 1. The provident and diligent solicitude of the Roman pontiffs in arranging and ordering those matters which, from the very nature of times and places, are recognized to be more expedient for the more suitable custody and care of the Lord's flock, impels them sometimes to establish new episcopal sees, and sometimes to transfer some of them, so that, with the Lord blessing the harvest, more suitable supports for the spiritual good of the faithful people may be obtained therefrom.

2 § 2. As soon, therefore, as tranquility was restored to Germany, We immediately directed Our cares to arranging ecclesiastical matters, which had been disturbed in the past times by calamity, and having opportunely ordered these four years ago in the kingdom of Bavaria, We likewise turned Our solicitude without delay to all those cultivators of the orthodox faith who are now subject to the dominion of the most serene princes and states of Germany, namely the king of Württemberg, the grand duke of Baden, the elector of Hesse, the grand duke of Hesse, the duke of Nassau, the free city of Frankfurt, the grand duke of Mecklenburg, the dukes of Saxony, the duke of Oldenburg, the prince of Waldeck, and the free Hanseatic cities of Lübeck and Bremen, who, showing themselves prepared to give every effort for the suitable endowment of bishoprics to be either erected or restored by the Apostolic See, sent legates in common name to Rome for this reason.

3 § 3. But since all ecclesiastical matters, concerning which action was taken, could in no way be reconciled, yet not despairing in hope that by the wisdom of those princes and states they might be arranged in the future; lest in the meantime the faithful Christians dwelling in the said regions, whom We recognize to be placed in the greatest necessity of spiritual governance, be deprived longer of their own pastors, We have decreed that it is necessary to proceed to the erection of sees and the circumscription of dioceses in certain principal cities and territories of those same princes and states, so that We may be able to provide those churches speedily with their bishops: reserving to Us the care of joining in the future to those dioceses which We shall judge more suitable the Catholics who are subjects of other princes.

Having therefore heard the counsel of certain venerable brothers, Our cardinals of the Holy Roman Church, with certain knowledge and mature deliberation of Ours, and from the fullness of apostolic power, We suppress, annul, and entirely remove the title, denomination, nature, and essence, and the whole present state of the vacant episcopal church of Constance, as well as of the provostship truly of no diocese of St. Vitus of Einsiedeln, together with their chapters, to the effect of freely proceeding to the new erections of churches and circumscriptions of dioceses to be mentioned below, and further We change the present state of the episcopal churches of Mainz and Fulda, so that that one is entirely withdrawn from any metropolitan right of the archbishop of Mechlin and is no longer subject to the dispositions of Our apostolic letters beginning = Qui Christi Domini = given on the third of the kalends of December in the year one thousand eight hundred and one, and this one is understood to be transferred from its regular state by other apostolic letters of Our predecessor of happy memory Benedict XIV, whose beginning is = In apostolicae = to a secular state; and with knowledge, deliberation, and power similar to the glory of almighty God, the exaltation of the orthodox faith, and the increase of the Catholic religion, We erect and establish in perpetuity Freiburg in Breisgau, a principal city, distinguished by an academy of studies and other foundations, and inhabited by nine thousand and more citizens, into an archiepiscopal city, and the celebrated temple under the title of the Assumption of the Blessed Virgin Mary into an archiepiscopal and parochial church; and likewise Rottenburg on the Neckar, formerly the capital of the duchy of Hohenberg, in the middle of the kingdom of Württemberg, in which a provincial tribunal exists, and which is inhabited by about five thousand five hundred, into a city similarly episcopal, and the very spacious temple in it under the invocation of St. Martin, bishop and confessor, into an episcopal church; and also Limburg on the Lahn, situated in fertile soil in the middle of the duchy of Nassau, and containing two thousand seven hundred inhabitants, into a city similarly episcopal, and the temple existing in it under the invocation of St. George into an episcopal church likewise, with all rights, jurisdictions, preeminences, honors, and privileges respectively belonging legitimately to archiepiscopal and episcopal sees in perpetuity.

5 § 5. We assign to the aforesaid metropolitan church of Freiburg the four episcopal churches mentioned above, namely those of Mainz, Fulda, Rottenburg, and Limburg, as suffragans.

6 § 6. Moreover, each chapter, both of the metropolitan church of Freiburg and of the cathedral churches of Mainz and Rottenburg, shall consist of a single deanery dignity and six canonries; that of Fulda, however, of a deanery dignity and four canonries; and that of Limburg of a deanery dignity and five canonries respectively; and furthermore, to increase somewhat the number of ministers, six prebends or vicariates for as many prebendaries or vicars shall be established respectively in the churches of Freiburg and Rottenburg, four in those of Mainz and Fulda, and two in that of Limburg. To each of the aforesaid chapters, moreover, we grant and impart license and faculty, so that under the presidency, inspection, and approval of the respective bishop existing at the time, they may lawfully and freely make, establish, and issue whatever statutes, chapters, and decrees—provided they be lawful, honest, and not contrary to canonical rules—for the choir service, for the division of distributions and other emoluments whatsoever, for the bearing of burdens, for the prosperous and proper governance and direction of things and rights both spiritual and temporal; and that they may freely and lawfully enjoy and possess the graces, insignia, and privileges which other cathedral church chapters in those parts legitimately enjoy and possess.

7 We expressly enjoin upon each bishop of the aforesaid churches that, all things being duly observed, he appoint from among the canons one who shall stably exercise the office of penitentiary, and another from whom sacred Scripture shall be expounded to the people on appointed days; or if it be less convenient that canons be appointed to these offices, the bishops shall take care that such offices be fulfilled by other suitable priests, and that means be sought to procure a fitting remuneration for the labors of these priests themselves. § 8. And since according to the prescription of the sacred Council of Trent there ought to exist in each of the aforesaid archiepiscopal and episcopal churches an ecclesiastical seminary for boys to be freely governed and administered by the bishop, where such a number of pupils shall be nourished as the necessity and utility of the respective diocese demands, and since we know that four of these already exist, we command that in the remaining church it be suitably erected as soon as possible. § 9. Wishing now to proceed to the circumscription of the five aforesaid dioceses, so that with the distinct boundaries of each established no question may arise between the respective bishops concerning the exercise of ecclesiastical jurisdiction, with the prior dismemberment of the places hereinafter named from the dioceses and churches to which they now belong, by the like fullness of apostolic power we decree, prescribe, and establish the following.

8 § 10. The metropolitan church of Freiburg shall have for its diocesan territory the entire dominion of the Grand Duchy of Baden, namely the parishes within the limits of this duchy, which in part belong or belonged to the diocese of Constance, and in part also to the dioceses of Strasbourg, Speyer, Worms, Würzburg, Basel, and Regensburg; likewise fourteen parishes with their filial church situated in the principality of Hohenzollern-Hechingen belonging to the aforesaid diocese of Constance; and also twenty-four parishes existing in the principality of Hohenzollern-Sigmaringen belonging to the same diocese of Constance; and furthermore eighteen parishes of the deanery of Vöhringen and seventeen parishes of the deanery of Haigerloch situated in the said principality and belonging to the aforesaid diocese. § 11. The episcopal church of Mainz shall have for its diocesan territory the entire dominion of the Grand Duchy of Hesse, namely all parishes remaining to the diocese of Mainz after the separation of places under Bavarian dominion, and other places and parishes from the dioceses of Regensburg and Worms, and also one parish of the place Herbstein from the diocese of Fulda belonging to the aforesaid grand duchy in temporal matters; and finally parishes in the places Darmstadt, Giessen, and Offenbach of the same Grand Duchy of Hesse, provided, however, that by the first future bishop in places which are inhabited in the greatest part by non-Catholics, new parochial churches shall be founded for Catholics, if they be in great number; but if they be in small number, let them be assigned to the nearest Catholic parishes.

9 § 12. The episcopal Church of Fulda shall have for its diocesan territory the whole electorate of Hesse, namely forty parishes now comprehended in that diocese, twenty parishes from the ancient metropolitan diocese formerly of Mainz and afterwards of Ratisbon, and one in place of Wolkmarsen from the diocese of Paderborn, excepting those fractions of parishes which, existing in the Bavarian kingdom, have been or shall shortly be applied by apostolic delegation to the nearer other parishes of the dioceses of the kingdom of Bavaria. But the other fractions of parishes existing in the territory of Hesse shall be applied to some nearer parish or parishes of the diocese of Fulda. We meanwhile leave united to the same diocese of Fulda nine parishes situated in the Grand Duchy of Saxony-Weimar, concerning which, if it shall be necessary, We reserve to Ourselves and to Our successors the Roman Pontiffs the faculty of disposing otherwise. § 13. The episcopal Church of Rottenburg shall have for its diocesan territory the entire kingdom of Württemberg with all the parishes which from the year eighteen hundred and sixteen have been separated from the dioceses of Augsburg, Speyer, Worms, and Würzburg, as well as the parishes which formerly belonged to the suppressed provostry of St. Vitus of Ellwangen, a diocese of no superior.

10 § 14. Finally, the episcopal Church of Limburg shall have for its diocesan territory the whole Duchy of Nassau, in which are comprehended fifty-eight parishes belonging to the ancient diocese of Ratisbon, and fifty-two parishes belonging to the ancient metropolitan diocese of Trier, as well as twenty-four parishes existing in the province of Dillenburg and Weilburg, and moreover the territory of the free city of Frankfurt, in which with three filial churches there exists one parish church under the invocation of St. Bartholomew the Apostle, to which all Catholics of the said city and territory belong, and which was subject to the aforesaid diocese of Ratisbon.

11 § 15. The aforesaid cities and subject churches erected into archiepiscopal and episcopal sees with the aforesaid places and parishes, five in number, attributed to the respective diocesan territories, We assign perpetually the inhabitants of both sexes, both clergy and laity, for the clergy and people, and subject them in every way to the spiritual jurisdiction of each bishop, so that to persons worthy and suitable according to canonical sanctions for governing the same archiepiscopal and episcopal churches both for this first time and for future times by apostolic authority, after a process of inquiry conducted by the Roman Pontiff according to the form of the instruction issued by the command of Our predecessor Urban VIII, it may be permitted to appoint them in each case, just as

14 We command and order, by themselves or through others in their name, that after these letters have been duly and fully executed and the said prelates shall have obtained the letters of apostolic provision, they may freely take real, actual, and corporeal possession of the governance, administration, and all diocesan right in the aforesaid churches, cities, and dioceses, and in the goods and other revenues assigned or to be assigned for endowment, and retain it perpetually. We decree meanwhile that all and singular the aforesaid places shall continue to be governed temporally by the same, or by vicars or administrators legitimately appointed, to whom they are now subject.

15 § 16. But in order that all and singular the things disposed by Us above may obtain speedy and happy effect, to Our venerable brother John Baptist De Keller, bishop of Eichstätt, whom We name, choose, and appoint as executor of these Our letters, We commit and command that he proceed to the respective endowment of the aforesaid churches, chapters, and seminaries in goods, stable funds, and other revenues with the right of special mortgage, and in funds afterwards and stable goods to be converted and possessed and administered by them in ownership, in the manner and form in which they have been offered and expressed by the most serene princes, under whose dominion the several dioceses are placed, through the instruments to be mentioned below, drawn up in legitimate form and transmitted to Us, which are preserved in the acts of the congregation set over consistorial matters, and of which authentic copies shall be delivered by the aforesaid executor to the several churches in their respective archives to be kept; namely.

16 17. To the archiepiscopal church of Freiburg in Breisgau he shall assign the domain of Linz, commonly called Linz, and other revenues, which goods and revenues in total produce an annual sum of seventy-five thousand three hundred sixty-four Rhenish florins, as is given and distinctly described in the instrument made by special mandate of the Grand Duke of Baden on the twenty-third day of December in the year one thousand eight hundred twenty. Moreover, John Baptist, the bishop, shall distribute the said lands in such a way that from them there shall accrue annually to the archiepiscopal table thirteen thousand four hundred florins, to which adding those payments to be described below to be paid annually by three cathedral churches, the annual revenues of the same Freiburg archiepiscopal table shall be fourteen thousand seven hundred and ten florins; to the dean of the chapter four thousand florins, to the first of the canons two thousand three hundred florins; to each of the other five canons one thousand eight hundred florins, to each finally of the six prebendaries nine hundred florins; moreover to the diocesan seminary twenty-five thousand florins; to the fabric of the cathedral church five thousand two hundred sixty-four florins, to the archiepiscopal chancery three thousand florins, finally to the houses of ecclesiastics retired and demerited, or already existing, or to be erected by the ordinary under whose jurisdiction they are subject, eight thousand florins; furthermore for the archbishop's residence he shall assign a palace in the city of Freiburg adjacent to the forum of the metropolitan church, formerly destined for the provincial estates of Breisgau with its annexes, appurtenances, and garden before the gate of the city and for the residence both of the dean and of six canons and six prebendaries other houses described in the aforesaid instrument.

17 § 18. To the episcopal church of Mainz, with firm revenues and income which it now enjoys, he shall grant an annual sum of twenty thousand Rhenish florins to be received from the revenues and income of the prefecture of Mainz constituted for the exaction of tolls and lordly revenues, to be paid annually to the aforesaid church under this condition, that the aforesaid sum shall enjoy the right of mortgage in the goods, lands, and lordly revenues of the same prefecture of Mainz, and that such disposition shall remain firm, stable, and unshaken, until lands and properties to the episcopal church of Mainz, whose fruits produce annually the sum of twenty thousand florins, shall be assigned to be possessed by it with full right, as is expressly provided in the instrument made by special mandate of the Grand Duke of Hesse and on the Rhine on the twenty-sixth day of August in the year one thousand eight hundred twenty. However, this sum of twenty thousand annual florins joined with the revenues which now constitute the endowment of the Mainz church, as a supplement to the endowment, the total quantity of revenues arising therefrom shall be distributed by the aforesaid executor in such a way that they provide to the bishop eight thousand florins, to his vicar general two thousand five hundred florins, to each of six canons one thousand eight hundred florins, to the first of four prebendaries nine hundred florins, and to each of the other three eight hundred florins in annual revenues free and clear. This disposition, however, as regards the dean, canons, and prebendaries shall not take effect unless the Mainz cathedral church

18 When the number of canons of the Roman Church shall have been reduced to six, for which purpose We decree that four of the ten actual prebends of that chapter, whenever they first become vacant in any manner, shall not be conferred on others; to the end that the same chapter shall henceforth consist of a dean and six canons. In the meantime, however, the ten living canons shall receive the same annual revenues which they were receiving before the portion was severed and attributed to the Church of Speyer from the ancient Diocese of Mainz, and which after the new circumscription of dioceses of the territory formerly of Gaul, established by Our other Letters under the lead seal on the third day before the Kalends of December in the year one thousand eight hundred and one, were assigned to them. As for the prebendaries not actually existing in the Cathedral Church of Mainz, since priests holding revenues partly from the prebend of the office of the small fabric, at present called by that name, partly from pensions which are paid by the government at present, are performing their function in their stead, hence such priests shall continue to render the same service to the cathedral church with the said revenues, until upon their death the four aforementioned prebends can be erected and established from now for then with the aforesaid endowment of nine hundred annual florins for the first, and eight hundred florins for each of the other three prebendaries. For the bishop's residence, the house which he has hitherto enjoyed with the adjacent garden shall serve, and the same shall be done both for the present and for future canons, for whose residence ten houses have already been assigned, four of which also have adjacent gardens. For the maintenance of the cathedral church and for sustaining the expenses necessary for divine worship, there shall be preserved the funds, lands, and other revenues possessed by the aforesaid church from ancient times, which amount to an annual sum of one thousand three hundred thirty-five florins. We likewise dispose concerning the seminary of the diocese, which, after the prior suppression of the monastery formerly inhabited by religious men of the order of the Hermits of St. Augustine, We establish to be erected stably in the same monastery with the adjoining church and garden, and We decree that there be assigned to it annual revenues partly from its ancient funds restored in the year one thousand eight hundred and six, partly from subsequent donations and legacies proceeding therefrom, and constituting a sum of seven thousand florins, and also from the most recent and most abundant donation made in its favor, and perhaps from others to be made hereafter, the revenues of which shall be perpetually assigned to the same seminary. We likewise dispose concerning the house for emeritus clergy at Pfaffenschwabenhemm existing and destined for fostering and supporting clerics either worn out by age or broken by illness, which We order to be established in the fabric of this monastery after the prior suppression of the monastery formerly inhabited by canons regular of the order of St. Augustine, and whose endowment yields an annual sum of one thousand eight hundred twenty-two florins beyond those which come under the name of charitable subsidy collected in the part of the ancient Diocese of Mainz, afterwards of Regensburg, and which have been accustomed to be paid hitherto with no small increase of revenue. § 19. The Episcopal Church of Fulda shall have fields, meadows, and forests, and other revenues constituting an annual sum of twenty-six thousand three hundred and seventy Rhenish florins, as is more fully described in the instrument made by the aforesaid Elector of Hesse under the date of the fourteenth of March in the year one thousand eight hundred and twenty-one. The aforesaid executor shall distribute this endowment in such manner that there shall accrue annually to the bishop seven thousand florins, to the dean of the chapter two thousand six hundred florins, to each of the four canons one thousand eight hundred florins, to each of the four prebendaries eight hundred florins; to the fabric of the cathedral church two thousand florins, to the diocesan seminary seven thousand florins, and to the Archbishop of Freiburg as metropolitan one hundred seventy florins shall be paid annually. Moreover, for the residence of the bishop and for the episcopal curia We establish the house near the cathedral church at the mount of St. Michael with two adjacent gardens and its appurtenances; for the residence of the dean, four canons, and four prebendaries, other houses described in the aforesaid instrument; and finally for the seminary the building near the cathedral church already destined for this use with the adjacent garden.

19 § 20. The Episcopal Church of Rottenburg shall enjoy revenues individually described in the instrument made by special mandate of the aforesaid Royal Government of Württemberg on the tenth of November in the year one thousand eight hundred and twenty-one, which indeed shall be divided by the aforesaid executor in such manner that to the episcopal table ten thousand florins, to the dean of the chapter two thousand four hundred florins, to each of the six canons one thousand eight hundred florins, to the first of the six prebendaries nine hundred florins, to each of the other five prebendaries eight hundred florins, to the fabric of the cathedral church and maintenance of other buildings one thousand five
