Leone PP. Decimo Secondo a tutti questi quanto pertiene all'istituzione.

204 Anno primo 1. Sacra Scrittura.

205 2. S. Teologia ore antemeridiane. 3. S. Teologia ore pomeridiane. Anno secondo 1. Sacra Scrittura.

206 2. S. Teologia ore antemeridiane. 3. S. Teologia ore pomeridiane. Anno terzo 1. S. Teologia ore antemeridiane. 2. S. Teologia ore pomeridiane. 3. Storia Ecclesiastica.

Anno primo 1. Istituzioni canoniche. 2. Istituzioni civili.

210 3. Istituzioni del diritto naturale e delle genti.

211 Anno secondo 1. Istituzioni del diritto pubblico ecclesiastico.

212 2. Istituzioni del diritto criminale. 3. Testo civile.

213 Anno terzo 1. Istituzioni del diritto pubblico ecclesiastico.

214 2. Testo canonico.

215 3. Testo civile.

216 Anno quarto.

217 1. Testo canonico.

218 2. Testo civile) da spiegare da entrambi i 3. Testo civile) professori. 210.

220 Anno primo 1. Anatomia.

221 2. Fisiologia.

222 3. Chimica.

223 Anno secondo 1. Botanica.

224 2. Igiene, terapeutica generale, e materia medica.

225 3. Patologia generale e semiotica. Anno terzo 1. Igiene, terapeutica generale, e materia medica.

226 2. Medicina teorico-pratica.

227 3. Medicina politica e legale. Anno quarto 1. Medicina teorico-pratica.

228 2. Medicina politica e legale. 3. Farmacia pratica.

230 Anno primo 1. Chimica.

231 2. Anatomia.

232 3. Fisiologia.

233 Anno secondo 1. Chirurgia teorica.

234 2. Patologia generale e semiologia. 3. Igiene, terapeutica generale e materia medica.

235 4. Medicina legale e politica. Anno terzo 1. Chirurgia teorica. 2. Igiene, terapeutica generale e materia medica.

236 3. Medicina legale e politica. 4. Ostetricia.

243 1. Logica e metafisica.

244 2. Elementi di algebra e geometria. Anno secondo 1. Etica.

245 2. Fisica.

246 3. Introduzione al calcolo.

247 Anno terzo 1. Calcolo sublime.

248 2. Meccanica e idraulica.

249 3. Ottica e astronomia.

250 Anno quarto 1. Meccanica e idraulica.

251 2. Ottica e astronomia 213.

LIV.

1 A method of studies joined with piety is ordained in the Pontifical domain. Leo, bishop, Servant of the servants of God / - For perpetual memory of the matter. § 1. Since divine wisdom teaches all, and proposes to all proceeding in the way of salvation these words: "My throat shall meditate truth, and my lips shall hate impiety," having this before Our eyes, We recognize it to be the duty of Our apostolic office to expend all care in this, that teachers of sacred doctrine, and likewise of human sciences and liberal arts, and the instructors of studious youth, should continually hold and fulfill this, in which they strive to engrave in the minds of their hearers. For from this both the progress of religion and the salvation of the commonwealth depend. And since a rightly ordered method of studies contributes greatly to this, We judge that We must strive with all diligence, so that the method of transmitting doctrines and disciplines in Our temporal domain may be perfected more and more, insofar as it shall be possible. Which also Our predecessors did not cease to care for, according to the change of times.

2 Truly it would be too long to set forth here the series of Roman pontiffs who have labored in a matter of such moment. In no way, however, can we pass over in silence Pius VII of blessed memory, who in these latter days wished to restore a new method of studies, which nevertheless he could not, being prevented by death, bring to the desired end. We therefore, having employed a select congregation of certain of Our venerable brothers, cardinals of the Holy Roman Church, have set our hand to the work begun, and have determined to complete it, mindful also of those things which Sixtus V observed wisely and prudently, namely: "The knowledge of letters, and the free doctrines and disciplines by which youth is instructed and educated in public schools, they think, or wish to be thought, to bring great utility to Christian doctrine and to the Christian commonwealth, if they are joined with piety; for the commonwealth is not willing to stand firm by virtue, but by impunity of vices, and kingdoms are best administered when wise and intelligent men possess the helm." Come therefore, and with strong and gentle spirit, God the Father of mercies assisting, the work has been completed, and We command that it be made public in Our temporal domain. But lest the presidents constituted by Us, and the teachers and disciples, should pass over those things which We have hitherto touched upon briefly, as if they were merely preambles, not only useful but also necessary for the fruitful fulfillment of the laws which We prescribe in this Our method, We commend to them the admonitions of holy Augustine, the Doctor of the Church, in his letter to Volusianus, which are never sufficiently to be meditated upon, here inserted: "What disputation is there of any philosophers, what letters, what laws of any cities, which are in any way to be compared with two precepts, from which Christ says the whole law and the prophets hang: Thou shalt love the Lord thy God with thy whole heart, and with thy whole soul, and with thy whole mind, and thou shalt love thy neighbor as thyself? Here physics, since all causes of all natural things are in God the creator; here ethics, since a good and honest life is formed from no other source than from loving those things which ought to be loved, that is, God and neighbor; here logic, since truth and the light of the rational soul is God alone; here also the laudable salvation of the commonwealth, for a city is not founded and preserved in the best way except by the foundation and bond of faith, and firm concord when the common good, which is the highest and most true God, is loved, and in Him men love one another most sincerely when they love one another for His sake, whose mind in loving they cannot hide."

3 Indeed, that most illustrious light of the Church, Augustine, does not aim at this, that he would banish the natural disciplines from schools and from the human gymnasia, nor does he shrink from the exercises of the liberal arts, of which he had a great and most abundant supply, but he also wished to admonish both teachers and students with full right and merit, that all these things have their origin from God, if they are correct and agreeable to reason and religion, and moreover that they ought to be entirely referred to God as the principle and end of good arts. And therefore he further teaches that the most obstinate contradictions of certain pseudo-philosophers and those following the wisdom of the flesh (whose number has grown excessively in these calamitous times) are to be spurned: » which therefore it shall be established [that the Sacred College shall consist of] the Cardinal Secretary of State, the Cardinal Camerlengo, the Vicar of the City, the Prefect of the Index, the Prefect of Good Government, and other cardinals whom the Supreme Pontiff shall have chosen: from whom His Holiness shall name the Prefect of the Congregation. There shall be attached to it a worthy and suitable ecclesiastical man as secretary, either a familiar of the Supreme Pontiff or a prelate of the Roman Curia. It itself shall observe the laws in the meetings and deliberations of the other congregations. The Secretary shall diligently record the acts in the registers, shall have charge of the records, and shall complete other matters entrusted to him by the Congregation and its Prefect.

4 [5] To this Sacred Congregation all universities, both public and private schools of the City and of the whole Pontifical dominion, whatever college also and other institutions devoted to the instruction of youth shall be subject. Pope Leo the Twelfth has entrusted to them all matters pertaining to education.

5 [6] These constitutions and the others which shall hereafter be published, the Sacred Congregation shall take care to observe most diligently.

6 [7] If at any time it shall please the Sacred Congregation to visit any university or public school or other public institution for the transmission of doctrine, it shall do so through some legate, who shall either inform the Sacred Congregation of the state of affairs or shall provide from its authority in those matters whose care shall have been entrusted to him.

7 [8] If anyone shall judge that something burdensome has been inflicted upon him by the superiors of places in matters pertaining to universities, public schools, or other institutions for the transmission of doctrine, let him carry his petition to the Sacred Congregation.

8 [9] Any rescript either of the Supreme Pontiff or given from his audience in matters pertaining to studies shall have no execution unless it shall first have been exhibited to the office of the Sacred Congregation, so that it may be entered in the registers.

[10] Title II.

[11] Concerning Universities.

9 [12] § 3. There shall be two primary universities, the Roman University, which is called the Roman Archigymnasum, and the University of Bologna.

10 [13] In each of them there shall be no fewer than thirty-eight chairs besides museums and other institutions of learning, so that young men may be able to make progress in every variety of disciplines; and those who shall have completed the course of studies may have the opportunity and be encouraged to acquire the most abundant knowledge of the disciplines in which they shall have already cultivated themselves.

11 [14] There shall be five secondary universities, Ferrara, Perugia, Camerino, Macerata, and Fermo. In these universities there shall be no fewer than seventeen chairs, besides museums and other suitable institutions.

12 [15] Before the secondary universities are able to use the privilege of conferring degrees and other honors, let them be examined by the Sacred Congregation through men selected by it and instructed with the necessary and suitable admonitions.

13 [16] The Sacred Congregation shall order to be printed and published a list of the chairs which the universities shall have: nor shall it be permitted to diminish or increase the number of those assigned to each university, nor can the matters to be taught be changed without the permission of the same Congregation; otherwise the privilege of conferring degrees and other honors shall be forfeited.

[17] Title III. Concerning the Arch-Chancellors, Chancellors, and Rectors of Universities.

14 [18] § 4. The primary universities shall have a president adorned with the title of Arch-Chancellor: the secondary universities with the title of Chancellor.

15 [19] The Arch-Chancellor of the Roman University shall be the Cardinal Camerlengo; of the University of Bologna, the Archbishop: the Chancellor of the lesser universities shall be an Archbishop or Bishop of the city.

16 [20] The Arch-Chancellors and Chancellors shall watch over the good government of the universities and shall take care that the constitutions and rules are observed.

17 [21] They shall have criminal jurisdiction over all crimes which anyone, even if a foreigner, commits within the bounds of the universities.

18 [22] Such crimes they shall punish not only with penalties inflicted for correction but also with imprisonment for a year, with the advice of the Rector and another of the consistorial advocates in the Roman University; in the other universities, however, both of the Rector and one from the legal college.

19 [23] If the crime be of such a kind that it ought to be punished more severely, they shall hand it over to the forum to which by law it belongs, where its case shall be tried.

20 [24] Let the same arch-chancellor or chancellor preside over the election of professors, and over the public conferral of academic degrees, and the distribution of prizes.

21 [25] In every university, besides the arch-chancellor or chancellor, let there be a rector.

22 [26] The office of rector of the Roman archgymnasium, or Roman university, is assigned to the college of advocates of the consistorial court, which college, as is customary, shall elect a rector to be approved by the Supreme Pontiff. 23.

23 [27] The rector of the other universities shall be appointed by His Holiness upon the nomination of the sacred congregation deputed for this purpose.

24 [28] Let it be the duty of rectors to see to it themselves that the discipline to be maintained by professors, students, and servants does not become deficient and weak; and to take care that the conduct of these be most temperate, and informed by religion. 25.

25 [29] Rectors shall arrange the calendar of the academic year, and shall distribute the hours of lectures in such a way that each student may be able to attend those lectures which are prescribed in his discipline for obtaining degrees. They shall see to it with what merit each one strives for university studies, or for academic degrees and prizes, and shall admit only those whom they understand to be equipped with those qualities which are required by the ordinances.

26 [30] On the days when classes are held, the rector shall remain in the university for as long as the professors teach: or with the consent of the arch-chancellor or chancellor, he shall delegate another in the name of vice-rector, who shall personally watch during that time that order is maintained, and that each one diligently fulfils his duty.

27 [31] The rector or vice-rector shall note the professors who have not taught, or who have not been present at the appointed hour, and shall weigh the reasons for absence which they themselves have presented. 28.

28 [32] The rector holds the first place after the arch-chancellor or chancellor; and if either of them should be absent or hindered, it shall be the duty of the rector to perform his office with the same authority.

[33] Concerning colleges, or collegiate bodies of the four disciplines. 29.

29 [34] § 5. In every university let there be four colleges, namely a theological college for the class of sacred studies; a legal college for the class of legal studies; a medico-surgical college for the medico-surgical class; and a philosophical college for the class of philosophical studies. 30.

30 The theological college of the Roman university shall consist of the present and future Master of the Sacred Apostolic Palace, who shall preside over it as before, the Sacristan of the same palace, the Commissioner of the Holy Inquisition, and the Procurators General of the Orders of the Friars of St. Dominic the Preachers, of the Friars Minor of St. Francis Conventual, of the Hermits of St. Augustine, of the Discalced Carmelites, and of the Servants of the Blessed Virgin Mary. Into this college shall be co-opted the professors of Holy Scripture, Sacred Theology, and Ecclesiastical History in the same university.

31 The theological college of the University of Bologna shall consist of twelve members.

32 The theological college in secondary universities shall consist of eight members.

33 In the Roman university a legal college shall not be formed, since the college of the consistorial court of advocates performs such a function.

34 The legal college of the University of Bologna shall consist of twelve members.

35 The legal college in secondary universities shall consist of eight members.

36 The medical college of the universities of Rome and Bologna shall be made up of twelve physicians. To these shall be added six surgeons in number.

37 Into the medical college of the city of Rome the physician and surgeon of the Supreme Pontiff shall be co-opted; but if, when someone is elected physician or surgeon of the Supreme Pontiff, the number of members is complete, he shall be a supernumerary member with the right of succession, as soon as a place becomes vacant.

38 Likewise in the medical college of each of the aforesaid universities, professors of veterinary medicine and pharmacy shall have a place, when matters pertaining to their profession are to be discussed.

39 Medical colleges in secondary universities shall consist of six physicians and two surgeons. A professor of pharmacy shall have a place in them, if the question concerns matters pertaining to his profession.

40 The philosophical college of the universities of Rome and Bologna shall consist of twelve members. In secondary universities six members shall constitute it.

41 Each college shall have its own president, who shall always be the dean of that college, except in the theological college of Rome; the last member shall perform the office of secretary.

42 No one shall be able to be admitted to the colleges unless he be commended by integrity of life and morals; and unless he shall have been granted the degree of doctor in some public university in that discipline to whose college he aspires.

43 Let regulars present authentic letters signed by the hand of their own superior, from which it may appear that they have completed the full course of studies, and have been decorated with the degree of doctor or master according to the rules of their institute, or have obtained the doctoral degree in a public university.

44 His Holiness through the sacred congregation shall select members of the colleges; in the present time, however, when either new colleges are to be instituted, or the number of colleagues is to be completed, principal regard shall be had both for those who previously belonged to colleges now extinct by fact, and for professors who now perform the duties of the same colleges according to their own disciplines.

45 The colleges henceforth shall be able to enact new rules and statutes, or to revive old ones for use. In these constitutions let them set forth whatever conduces to the governance and honour of the college.

46 Such constitutions, whether ancient or recently made, shall not be valid before they have been approved by the sacred congregation.

47 Members of the colleges cannot henceforth be removed without the gravest cause, which the sacred congregation shall weigh. Let the scope and office of the colleges be to hold examinations and to cast votes in the selection of professors, and in the conferral of degrees and other academic honours, and in honouring students with prizes at the end of the school year.

48 Furthermore, let the colleges be held as natural counsellors of the sacred congregation: therefore, when they are questioned by the same concerning any matter of greater moment, or any question pertaining to their discipline, let them open their opinion: and let it be their right through the arch-chancellor, or chancellor to submit to the judgment of the sacred congregation reforms and new counsels, which they shall have been accustomed to deem more suitable for the advancement of disciplines and arts, and finally for promoting the utility of the students.

49 In every university let there be a hall of the colleges for holding assemblies.

50 The theological college shall have the first place before the other colleges: the legal college shall follow: then the medical college: finally the philosophical. Except only in the Roman university the college of advocates of the consistorial hall, to which the right of precedence is confirmed.

Title V.

Concerning professors and their election.

51 § 6. Professors who now hold chairs in universities shall not be subjected to any examination of election.

52 Professors henceforth shall be selected through competition, after first exhibiting proof of learning and morals, and after public announcements have been made, which shall be affixed thirty days before.

53 Before all else it is absolutely required that those who aspire to obtain a chair be distinguished by a doctoral degree in that discipline which they wish to profess. Let the form of competition be this.

54 The competitors, with doors closed at the appointed hour in the library of the university, and with permission to use the books of the same library, but not others, nor any writings, shall write out a dissertation in the Latin language within the space of six hours on an argument or text proposed by lot from a number of not fewer than thirty pertaining to the chair which they seek.

55 Let each member of the college provide several arguments or texts (to be in no way opened to the competitors beforehand), from which on the morning of that day the arch-chancellor shall select those which shall be put into the lot, and the argument then drawn by lot shall be proposed to the competitors with no delay interposed, on which they shall complete their dissertation.

56 At which time the competitors shall write their dissertation, let the rector and two members of the college not depart from the library.

57 [66] Let there be a capsule secured with a key and sealed with the seal of the arch-chancellor, or chancellor, and also of the rector, the upper part of which shall be perforated, into which each of the competitors shall place his dissertation signed by his own hand.

58 [67] When the time of competition has elapsed, the capsule shall immediately be brought to the arch-chancellor, or chancellor, and on the same day or the next day the rector and college shall meet with the arch-chancellor, or chancellor. Before the capsule is opened, it shall be examined whether the seals are intact.

59 [68] If the number of competitors were such that all their dissertations could not be read and estimated with the necessary care in a single assembly, the dissertations shall be placed in the capsule to be secured with seals of the arch-chancellor, or chancellor, and of the rector. On the day following, all shall meet again for the completion of the examination. When such examination of dissertations has been completed, a day shall be appointed for the competitors: on which day they shall be subjected by the college to a verbal examination in the Latin language concerning matters pertaining to the chair to be conferred. The dean, to whom it pertains, shall propose three men to the arch-chancellor, who shall exhibit a specimen of doctrine, with an examination conducted in scholastic form by the theological college; which being completed, the arch-chancellor, rector, and the college itself shall select one through secret votes.

60 [69] Then the arch-chancellor, or chancellor, rector, and college shall meet to deliberate concerning the professor to be chosen. The last member of the college shall open his opinion in the first place, and the other members shall gradually open their opinion in turn up to the arch-chancellor, or chancellor. Opinions expressed in the college shall in no way be carried outside the college.

61 [70] After this, three white balls and an equal number of black ones shall be distributed to each, and votes shall be cast in secret: so that from the greater number of votes the superior merit shall be judged.

62 [71] In the election of any professor, besides the arch-chancellor or chancellor, rector, and college, there shall participate with a vote in the Roman university three from the college of consistorial advocates, in Bologna a senator and two conservators, in other universities the prior magistrate.

63 [72] If it should happen that certain competitors obtain an equal number of votes, the arch-chancellor or chancellor may decide by drawing lots or by his second vote bestow the position on whichever he judges more worthy. The same method shall be observed when, on account of advanced age or reason of infirm health, or any other cause, any one of the five aforesaid lecturers exercising their office is to be relieved of the burden of teaching, in assigning him an assistant with the right of succession in the future.

64 [73] The election of any professor whatsoever must be referred to the Sacred Congregation, so that it may be confirmed by it.

65 [74] Neither shall he be subject to a competition examination nor to any oral examination, who has thus proved himself to all (especially by works published by him) that he has no need of other tests of learning. However, when this occurs, the election is reserved to the Supreme Pontiff.

66 [75] No professor after his election can be removed from his chair. If anyone has committed a grave offense, the arch-chancellor or chancellor may remove him from the exercise of his office for a time; and without any delay he shall inform the Sacred Congregation of this matter, with which alone shall rest the faculty of determining the removal.

67 [76] or by drawing lots to settle the matter, or by his second vote to bestow it on whichever he judged more worthy.

68 [77] From the law of competition in the Roman university alone are excepted the chairs of Holy Scripture, two chairs of theology, natural theology, and ethics, which in the same university are held by professors of certain particular religious orders.

69 [78] When any one of the aforesaid five chairs becomes vacant, the superior general of that

70 [79] If any professor accepts an office or some duty to be performed, from which the congregation understands that he is prevented from conducting his own lectures, it shall declare the chair vacant.

[80] Title VI. On the Duties of Professors.

71 [81] § 7. Professors shall attend at the appointed hour for holding lectures from the calendar, which shall be publicly posted each year at the opening of the schools.

72 [83] When either illness presses or some other impediment intervenes, as estimated by the rector, the professor shall admonish a substitute to continue the lectures in his place.

73 [84] Professors shall not only deliver sound doctrine and by voice and example ensure that the minds of the young are formed toward religion and good morals (concerning which the arch-chancellors or chancellors, rectors, and indeed the Sacred Congregation shall exercise the most constant and diligent care), but also in their own discipline refute errors and systems which directly or indirectly corrupt the minds of the young.

74 [85] For this reason in teaching they shall observe what the Sacred Congregation shall deem fit to prescribe regarding certain matters pertaining to religion, morals, and public order.

75 [86] Each professor shall use a course printed in type, and shall spend half an hour in explaining it, and the remaining time in questioning and exercising the students.

76 [87] The course or treatise printed in type shall be selected by the professor himself, yet it shall be proposed to the Sacred Congregation, so that it may approve it.

77 [88] A professor may dictate from his writings additions or new matters which he thinks will be of greater benefit to the students.

78 [89] A professor who has had his course printed may use the same in holding lectures, provided the Sacred Congregation has approved it.

79 [90] Professors who wish to submit their course to the press within a prescribed time, and meanwhile to hold lectures from their writings, shall make supplicant letters to the Sacred Congregation on this matter.

80 [91] Professors of sacred and legal studies shall select a course written in Latin, and shall use the Latin language in their explanations.

81 Professors of medical and surgical studies used to employ a course written in Latin, but sometimes in explanations, for greater clarity, they might speak in the Italian language, yet they shall indicate the Latin synonymous words. Excepted are anatomy, physiology, theoretical medicine, and treatises on legal medicine and surgery, in which, so that what is proper may be observed, both in the course published in type and in explanations, the Latin language alone shall be used. 84.

82 Professors of philosophical studies may use the Italian language in treatises and explanations, if you except the professors of logic, metaphysics, and ethics, who shall always use the Latin language. 85.

83 Professors of eloquence, languages, and similar studies shall speak in Latin or Italian, as the matters with which they deal demand.

84 In the schools of those disciplines in which argumentation is used, on every Saturday in place of explanation there shall be held a disputation on one or more topics which shall have been explained on the preceding days of the week. In the schools of those doctrines in which there is no place for argumentation, on every Saturday there shall be held exercises which the professors judge most suited to the progress of the students.

85 Let every professor diligently record all his students in a register, and note those who excel in attendance and rapid progress, as well as those who either neglect their classes or make no progress whatsoever in their studies.

86 Let professors use such catalogues to admonish the negligent, and to give testimony to the truth of attendance and progress in letters patent or in the records of any student.

Title VII.

Concerning Substitutes.

87 § 8. Let there be at least one substitute, that is, a supernumerary professor in each faculty. In the legal discipline there shall be two, one for the schools of natural and canon law, the other for the remaining legal schools. 90.

88 It shall be the duty of substitutes to perform the duties of professors who are exercising their office, when they are either ill or hindered, fulfilling all those offices to which professors are bound.

89 Substitutes shall have the right to succeed to the chair which first becomes vacant in that discipline; for this reason they shall be chosen by public competition, just as other professors are. 92.

90 They shall enjoy the same privileges as professors: they shall have a place in the public functions of universities, and shall be adorned with the same vestments as professors. 93.

91 Let there be a librarian. He shall be chosen by the arch-chancellor or chancellor, and confirmed by the holy congregation. As regards the Alexandrian library of the Roman university, let the bull of blessed memory of Alexander VII be observed. 96.

92 It shall be his duty to ensure that the library is well arranged, and that the indices of books are carefully organized.

93 The library shall be open for the common benefit on each day on which classes are held, for half an hour before the morning and evening lectures: in the morning for four continuous hours, in the afternoon for two and a half hours.

94 On days when lectures are not held, except on Sundays and other days dedicated by precept to divine worship, the library shall be open at the same hours for the greater convenience of students.

95 During the summer vacation let it be open for four hours, from the beginning of that vacation until the thirty-seventh day of September, and let it be closed half an hour before noon: the same shall be observed on the first three days both of the vacation of Lent and of Holy Week.

96 However, an annual stipend shall not be paid to them until they have succeeded to a chair; only some allowance shall be given to them when they have supplied more than the number of twenty lectures.

97 As regards the five chairs of the Roman archigymnasum assigned to the regular orders, the superior general shall immediately choose one from the family of religious with the approval of the rector, who shall perform the duties of the professor who is ill or hindered.

Title VIII.

98 During those same summer vacations, beyond Sundays and other days dedicated by divine precept to divine worship, the library shall be closed on every Thursday, on the feast of St. Peter in Chains, and on days on which solemn degrees are publicly conferred, or another solemn office is performed in the temple of the university. Likewise let it be closed on the first day of October for the opening of schools.

99 Each year let a calendar show the days on which the library shall not be open. 102.

Concerning Librarians.

100 § 9. In each university the librarian shall go to the library on each day on which it is open, and shall not depart from it unless the hour for closing it has arrived.

101 Let there be a volume in which whoever requests a book to read shall write his own name and the title of the book. The librarian shall ensure that each book that has been written down is returned before the person to whom it was given departs from the library. 104.

102 Let him take care that nothing be written on the pages of books, and that they be not corrupted in any way. 105.

103 Likewise let him take care that the library not resound with insults, and that no one speak or read with disturbance to others.

104 Before departing from the library, let him carefully examine whether as many books as were given out that day to be read have also been returned, and have been restored to the shelves; and if perhaps some book should be missing, let him warn the rector concerning the book that is missing and concerning the person to whom it was lent, so that the book may be found, and he who took it may be corrected and even punished.

105 It shall be unlawful for the librarian to lend prohibited books for reading for any reason whatsoever to those who do not exhibit legitimate authority for this.

106 108. Let no one, not even the librarian, carry any book whatsoever out of the library.

107 With the library door locked, the keys shall remain with the librarian, to whose trust they are committed.

108 Such rules printed in type shall always be available in the libraries of each university.

Title IX.

Concerning the Moderators of Astronomical Observatories and Museums.

109 § 10. Let the care of the astronomical observatory and museums be entrusted to the professors of those disciplines. 112.

110 Let the moderators diligently protect the machines and other things committed to them.

111 If an inventory should not exist, let it be made within six months without fail, and each year let the machines and other such things be compared with the inventories in which they have been described. Let the rector choose who shall preside over the comparison.

112 In the archives of each university let a copy of the inventories be placed, and subsequently let the machines and other things be noted in them which the universities shall have acquired for themselves. 115.

113 Let the moderator of the astronomical observatory constantly observe the heavens, and compose ephemerides, which shall afterwards be published in due time.

114 Let him engage in literary commerce with the most distinguished astronomers, insofar as it is granted to him, so that he may receive what new phenomena are discerned, and explore their truth, whereby he may make such a science more abundant for students, and beneficial not only to natural but also to sacred disciplines.

115 Let the directors of the museums betake themselves to them four times in the week. 118.

116 They shall remain there, both so that they may hold lectures, where it shall be necessary, and also so that they may serve the convenience of the scholars. 119. Let their duty be to thoroughly discern the excellence and use of things, not only so that they may explain them to the hearers of the university, but also to others, whether men of letters or those distinguished by any dignity whatsoever who may come to the museum.

Title X.

Concerning the keeper of the botanical garden

117 Let the keeper of the botanical garden be subject to the professor of botanical science, and let him be stationed in the place which shall have been assigned to his office. Let him be chosen by the rector of the university. 121.

118 It shall be unlawful to deliver, sell, exchange plants whether living or dried, seeds, or anything whatsoever pertaining to the garden without the permission of the rector of the university.

119 ctions are held, let them prevent disturbances from arising in the university, or noise from being raised, and let their duty be to admonish the disciples and other persons who do not observe modesty and silence: and if they should accomplish nothing, they shall report it to the rector.

120 Let these same beadles more promptly and diligently inform the rector whenever anything occurs contrary to custom either in the schools or within the bounds of the university. Title XI. Concerning the proper administration of the revenues of universities 122.

121 Let him perform all things which the professor commands regarding botanical science and practice.

122 It shall not be permitted to the keeper to cultivate a private botanical garden for himself.

123 Let it be his duty to note carefully the species of herbs and to prepare the structure of all of them. Let an example of the plants described be placed in the archive.

124 He shall cleanse and restore the gardens: let him be at hand to the professor of the science of herbs, and let him follow in his footsteps in botanical excursions.

Title XI.

Concerning beadles and other servants 126.

125 § 12. In each university let there be beadles and other servants.

126 Let the rector of the university choose these: let them perform their office as the rector shall command, or in his absence he who holds the place of rector. 128.

127 Moreover, beadles, at the time when le- 130.

128 § 13. Let the rector of the university at Rome administer the revenues as before. 131.

129 In other universities let the magistracy of the city choose an administrator who shall furnish suitable security, and be approved by the holy congregation. Let the magistracy decree a suitable stipend to be paid to the administrator.

130 Before the Ides of October of each year let the magistracy draw up a schedule of expenses for the entire following academic year. Let it be the duty of one arch-chancellor or chancellor either to approve the expenses or to apply some method to them.

131 If within the year any expenses must be incurred outside the ordinary order, let the authority of the arch-chancellor be obtained, without which neither shall the magistracy command payment of money nor shall the administrator pay; otherwise let them make good the expenses from their own resources.

132 Let the administrators, when the academic year has ended, and thus within the month of September, present a careful account of their administration to the arch-chancellor and the magistracy. 135.

133 Expenses called to account, which the arch-chancellor or chancellor and the magistracy shall have approved, shall be brought to the holy congregation, in whose power it shall be to confirm the same by supreme judgment.

Title XIII.

Concerning public schools outside universities 136.

134 § 14. Let bishops, having regard for the citizens who are occupied in the cities and towns of their dioceses, and likewise observing what faculty each city has for maintaining schools, deliberate with the magistrates and propose to the holy congregation how many public common schools they wish to establish, so that the holy congregation may render judgment on this matter. 137.

135 Let bishops preside over these schools, and in each community let them choose an ecclesiastical man who may himself watch over all things which pertain to doctrine and morals: and let them take care that teachers instruct their disciples in the rudiments of faith and the dogmas of religion. 138.

136 Let bishops not refrain from visiting these schools.

137 Those whom the bishop shall have placed in charge of the schools, when the academic year has ended, let them admonish the bishop concerning the state of the schools, and if the bishop think that anything should be consulted regarding the schools, let him bring the matter to the holy congregation. 140.

138 It shall pertain to the magistracy of the city or town to take care that the rules of school discipline be in force; to take care that teachers and disciples perform their duty, and that order be maintained. 141.

139 Let the magistracy by public letters announce the day of competition for the common schools which are vacant, and let them employ chosen men suitable for testing in teaching.

140 Let the examination be held before the magistracy and the bishop's legate. After the examination let an assembly be convened, at which the bishop's legate shall be present: after those by whom the examination was conducted shall have given their opinion, let him be chosen by the magistracy by secret ballot who shall have obtained the greater number of votes. 143.

141 Henceforth let it be the sole duty of the bishop to approve the newly chosen masters. 144.

142 Let the councils of the community cast their votes at times fixed beforehand regarding the master according to ancient custom and the law of the papal state; the complete authority remaining to the masters of presenting petitions to the sacred congregation according to art. 7.

143 If outside those times it should seem to the councils of the community to call away the public master from teaching for just causes, let them refer the matter to the bishop, who, having made consultations, will be able, if he so judge, to abrogate the office of master to the school for a time, laying the matter before the sacred Congregation of Studies, so that it may understand what further is to be done. Let there also be faculty to the bishop to remove the public master for a time on account of grave causes evident to him, nor shall the council be able to resist or call the matter into question; yet let it be open to have recourse to the sacred congregation.

Title XIV.

Concerning the Reception of Auditors 147.

144 § 15. In any university there shall exist a book in which auditors of all schools shall be noted.

145 148. The book shall be opened at the beginning of the school year. To complete the matter more fully, let the school year be divided into three parts, which one might call Terms. Let the first be from the 5th of November until the twenty-fifth day of December. The second from the second day of January to the Saturday before Palm Sunday. The third from the Wednesday after Easter to the end of the school year. 149.

146 Whoever wishes to enjoy the rights and honors which befit auditors of universities, and to seek degrees and prizes, let him receive from the rector a certificate of his reception, subscribed by the same rector; which it shall be necessary to renew at the beginning of each school year.

147 For this reason let the book or list of auditors lie open until the tenth day of November; and in it let each auditor inscribe by his own hand his name, surname, age, country, parish, residence, and indicate to which discipline he wishes to apply himself. 151.

148 The book being closed after the tenth day of November, the rector of the university shall be able until the first day of December to grant permission only for grave causes that some young man inscribe his name, who did not do so at the appointed time. After the first day of December the rector shall not be able to grant this favor to anyone.

149 The rector shall not deliver the certificate of reception on first sight to those requesting it unless they exhibit testimonies concerning life and morals, and concerning studies completed; and from these they shall be tested in an examination to be held by four professors, or members of colleges, whom the rector shall appoint.

150 Those to be received for the study of philosophy shall give proof of human letters; and especially of the Latin language. Likewise, those to be received for the study of theological, legal, and medical disciplines shall not be admitted unless they have shown in this examination that they have applied themselves to the study of logic, metaphysics, ethics, and the elements of algebra, geometry, and physics.

151 From this examination those may be exempted who have received in some university either an academic degree or another principal testimonial of progress in these same studies. 155.

152 Auditors already received, and who continue the school course, let them be given a new certificate, provided they prove either that in the previous year they showed themselves assiduous in the lectures and made progress in them, or that they have obtained an academic degree, and finally that they have attended the spiritual congregation.

153 On the reverse side of the certificate let the professors of the university attest every third month that the auditors have not only been assiduous in the lectures, but have also given proof of progress in the exercises of each week.

154 Illness, proved by the testimony of a physician, or some other grave impediment, concerning which the rector shall judge, may excuse the defect of assiduity.

155 Title XV.

Concerning the Discipline of Auditors.

§ 16. Let no disciple, without just cause, be absent from school when the lecture begins, or depart from it unless it be completed; otherwise let the professor deny him a certificate of assiduity.

156 In each school, let those who apply themselves to any study exhibit obedience and respect to their professors, and moreover let them apply themselves with silence, modesty, and diligence both to the lectures and to other scholastic exercises.

157 If any omit the obedience and respect due, they shall be admonished in the same school by the professor, and if the matter require it, their names shall be reported to the rector.

158 Likewise, the names of those shall be reported to the rector who by their deeds and conversations, whether impious, obscene, or uncivil, are a bad example or an impediment to those who come to the schools, or to outsiders. 162.

159 The faults of disciples, if they be lighter, shall be corrected by the rector, as they deserve.

160 Bullarium Romanum 163.

161 If they have committed something more grave, with the articles 17, 18, 19 remaining intact, they shall be expelled from the university, even if the crime was perpetrated outside the university. 164.

162 Let expulsion be decreed by the rector alone; but at Rome indeed the arch-chancellor, rector, and advocates of the hall of consistory; in other universities the arch-chancellor or chancellor, rector, and three moreover professors or deans, to whom the accused is unrelated, shall come together in council, and by secret ballot shall determine his punishment. The matter is settled by the greater number of votes, and if the accused be punished by expulsion, this decree shall be affixed to the walls of the university. 165.

163 Expulsion shall not be decreed by the rector alone; but at Rome indeed the arch-chancellor, the rector, and the advocates of the consistorial court: in other universities the arch-chancellor, or chancellor, the rector, and moreover three professors deans to whom the accused is unrelated, shall come together in council, and by secret ballot shall determine his punishment. The matter is settled by the greater number of votes, and if the accused is punished by expulsion, this decree shall be affixed to the walls of the university; 165.

164 When anyone has been expelled, he can no longer be received in the same university of the Pontifical State, nor in any other.

165 When a lecture is being held, no one is permitted to enter another school for any reason whatsoever, except only that one to which he has been assigned.

166 The arch-chancellor or chancellor, together with the rectors, shall have the power to prescribe whatever else they think fit, so that the discipline of the schools may more easily and in order be maintained. But before this is put into execution, it shall be sanctioned by the sacred congregation.

167 172. The prescribed ordinances shall be common to other schools as well, which are held to be public, although constituted outside universities.

168 Both the bishop and the magistrate shall have the right to expel students from the schools of the community on account of some grave fault committed.

169 When parish priests learn that someone in their parish is living too freely, or is guilty of some grave crime, if he is devoted to the university or to the schools of the community, let them inform the bishop or the rector of this matter.

170 Concerning the duties of piety and religion. It is strictly forbidden that any student approach the university with a staff or any kind of weapon, not even if he has taken up the name of soldier 168.

171 Likewise all are prohibited from tearing down any paper which has been fixed by the order of the authorities, either in the schools or on another wall of the university.

172 No one shall walk about near the schools, either before or after the time of lectures, or when they are being held, nor shall he make noise or obstruct with loud voices.

173 All shall abstain from conventicles, nor shall many gather together under any pretext. Moreover, let them avoid places and persons who do not have a good reputation among the people. 175.

174 § 17. In each university there shall be a chapel or oratory in which sacred rites may be performed and the duties of piety carried out. 176.

175 Secular priests of the Society of St. Paul the Apostle shall continue to exercise spiritual direction and to devote their labour in the Roman university.

176 In other universities the arch-chancellor or chancellor shall entrust this excellent and holy office either to some regular family or to a society of secular priests distinguished in doctrine and example.

177 176. In the temple or oratory of each university these annual sacred rites and duties of piety shall be held.

178 On the day when the opening of the university takes place, a solemn sacred rite shall be performed to obtain the gifts of the Holy Spirit. There shall be present the arch-chancellor or chancellor, the rector, the colleges, the professors, the librarian, and the other ministers of the university, and all the students. When the sacred rite is completed, each professor and master shall make a profession of faith according to the formula which Pius IV delivered. Then one of the number of professors shall recite an oration for the inauguration of studies, and shall conclude with the customary prayers: Come, Creator Spirit; O God, who dost enlighten the hearts of the faithful; and O God, the shepherd and ruler of all the faithful.

179 At the end of the school year likewise, with the same persons mentioned above being present, a solemn sacred rite shall be performed for the giving of thanks, which being completed, after the singing of the Ambrosian hymn, the prayers shall be said: O God, whose mercy; and O God, etc. The same solemn sacred rite shall be performed, with the same persons present, when the feast day of the saint whom each university has as its patron recurs.

180 If any university celebrates other feast days besides these, nothing shall be changed in this matter.

181 On each day on which a lecture is held, at least one sacred rite shall be performed, which the students are able to attend.

182 On Sundays and other days dedicated to divine worship by precept, whether in the temple or in the oratory instituted for this purpose, an assembly shall be held to which all students are commanded to come. This assembly shall begin with some pious reading, which shall last for half an hour, so that in the minds of the young the seeds of Christian piety may either be planted or may grow better. Then, after the prayers Come, Creator Spirit, O God, who dost enlighten the hearts of the faithful, and O God, etc., have been sung, one of the nocturns with the lauds of the office of the Blessed Virgin Mary shall be recited; afterwards the president of the assembly, or another priest chosen by him, shall deliver a brief sermon on the Gospel, which shall be full of zeal and piety: finally, a sacred rite shall be performed. The president shall employ other priests distinguished in morals and doctrine to assist, who shall hear the confessions of the students and prepare them to receive the sacred Eucharist. The assembly shall conclude with the Litany of Loreto and some psalm, hymn, or prayer to preserve perseverance in divine service.

183 When anyone, whether a student or another person devoted to the university, departs from life, at the first assembly, omitting the office of the Blessed Virgin Mary, the office for the dead shall be recited for the expiation of his soul. If the deceased be a professor or one of the colleges of the university, on a day appointed by the rector, the last rites shall be paid to him, at which the colleges, professors, and students shall be present. 186.

184 Each and every year, at the final time of Lent, let spiritual exercises be conducted by all disciples, selected for this purpose by the arch-chancellor or chancellor, with two priests or more, who are deemed suitable by doctrine and religious study, who may stir the minds of the hearers and lead them to better fruit.

185 All these offices of piety and religion bind absolutely all those enrolled in any school, both clerics and laypeople. If any are absent, whether by impediment of health or other just cause, let the president of the congregation be informed of this matter. From this law, however, priests and clerics are dispensed, who at the same time, whether by obligation or by ministry, ought to render their service either to parish churches or to other churches, yet with this precaution observed, that every three months they exhibit a certificate of the truth of the matter to the president of the congregation.

186 Every three months let the president of the congregation deliver to the hands of the rector a list of all disciples, and in it let it be most religiously noted how frequently each one has been present, how many times he has approached the sacraments, how diligently and modestly he has shown himself, or how many times he has failed in these matters. 189.

187 Let the president have a list in which it is carefully written down how many times each one has been present in the congregation; but when he is asked to testify concerning the assiduity of anyone, let him set down the number distinctly.

188 In order that anyone may be held as a disciple and may be able to seek honours, degrees, and prizes, it is necessary that he be increased with a certificate of assiduity. But if anyone has been present never, or rarely, or without an outward appearance of devotion and piety, let him be subject to correction; and if he does not desist from obstinacy, let him be expelled from the university.

Title XVII: On the Conferring of Degrees.

189 § 18. Both primary and secondary universities shall have the right to confer these three degrees in theological, legal, and philosophical disciplines, namely the baccalaureate, the licence, and the doctorate. 196.

190 In medical and surgical disciplines, secondary universities alone shall have the right to confer the two aforementioned degrees; but the conferring of the doctorate shall be the proper right of the University of Rome and of Bologna; which two universities alone shall also grant the faculty of publicly practising medicine and surgery.

191 Professors of universities, as they are distinguished by virtue, so with all effort let them take care that, when they are free, they frequently attend such exercises, so that the minds of youths may be impelled to piety and religion by the example of their elders.

192 In the remaining public schools instituted outside universities, let bishops designate either a church or an oratory, if the multitude of disciples requires it, in which disciples may perform the exercises of piety and religion.

193 What has been commanded concerning the offices of piety and religion for universities, we wish all the same things to be said also for these public schools; but we entrust to the prudence of bishops and their zeal that they take care to accommodate them according to the diversity of places. No one shall be honoured with a laurel degree unless he has first obtained the baccalaureate and the licence. The baccalaureate and licence shall be granted to no one except those who, upon examination being held, have been deemed worthy by three members of the college designated by the rector. The examination for the baccalaureate shall be held on all those matters which are taught in the first year of the scholastic course; for the licence, on those matters which are taught in the second and third years.

194 But those who seek the laurel degree shall undergo a test in all those matters which pertain to university discipline. Laurel degrees are of three kinds, namely for honour, for prize, and common: laurel degrees for honour and for prize are conferred upon prior examination and competition; common degrees are conferred upon prior examination, as shall be explained in the titles which follow.

195 Likewise we wish it to be commended to bishops that they provide opportunely and diligently that even in small towns, and where there are only one or two schools, disciples attend the sacred [office] daily, and that according to age and capacity of mind they frequently receive the sacraments.

196 Let candidates exhibit a specimen before the college of that discipline in which they seek the laurel degree. Examinations delegated to any person or group are absolutely prohibited, and degrees, if any should happen to have been conferred after such examinations, shall be null by the law itself.

197 Collegiate meetings for examining the doctrine of candidates shall not be legitimate without the presence and intervention of the arch-chancellor or chancellor, or at least the rector, and at least six members of the college. All, however, who belong to the college must be called, and if any of these are absent, let them receive no fruit from the expenses of the laureates, except if they have been ill; nor let them remit anything to one another by agreement, for from these matters nothing may be received by the absent.

Professors in delivering their lectures shall follow the body of civil law itself, which, as it divides the fifty books of the Digest into seven parts, so also shall they do; let the first explain the three earlier parts, who, in order to complete four years, shall begin the first year with the origin and progress of civil law, and with the method of interpreting all laws and statutes, and with the rules of law and the signification of words. 265 If any of them shall merit the laurel degrees for honor or for prize, let him enjoy all their privileges, except only the restitution of the expense which was incurred for the baccalaureate and license.

Title XX.

Concerning laurel degrees in common form 229.

266 When the rector shall have ascertained that the documents have been duly prepared, let him permit the candidate to proceed to the examination.

267 § 21. Whosoever, when the course of studies has been completed, shall not wish to petition, or shall not have merited the laurel degree in the petition: but generally whoever, whether subject to the Pontifical dominion or a foreigner, who, when studies have been completed in some public university of studies, wishes to be honored with the doctor's laurel degree, let him make known his intention to the rector of that university in which he desires to be decorated with the laurel degree, and let him present testimonials of studies rightly completed, of the honesty of his parents, and of his own life and morals.

268 Likewise let him admit to the examination for the laurels of sacred theology those clerics who shall have completed a theological course in episcopal seminaries.

269 And also all those for obtaining both the laurel degree of sacred theology and of both laws, who, although they shall not have devoted themselves to studies in some university, shall nevertheless have obtained a benefice or ecclesiastical dignity, or some public office, to which a doctoral laurel degree is required.
