Sancta Synodus

23 §44. Presenti lettere inoltre, e tutto quanto e singolarmente in esse contenuto, da qualsiasi vizio di subreptizio, obreptizio e di qualunque nullità o invalidità, nonché dalla nostra intenzione e da qualunque altro difetto, per quanto sostanziale (anche dal fatto che nei precedenti in qualunque modo pp. 464, n. 1634 interesse abbiano o pretendano di avere, e specialmente questi stessi prefetti delle chiese predette ora e per il tempo, anche cardinali della medesima santa Chiesa Romana, ai precedenti non abbiano consentito, né ad essi vocati e uditi, e le solennità e qualunque altra cosa da osservarsi e da adempiersi in nessun modo siano state osservate e adempiute, e le cause per le quali le presenti siano emanate, addotte, verificate, o altrimenti sufficientemente o anche in qualche cosa giustificate non siano state), e da qualunque altro colore, pretesto, occasione e causa, anche nel corpo del diritto chiuse, e da qualunque altra cosa per quanto ragionevole, giusta e privilegiata, anche tale che per l'effetto della validità dei precedenti necessariamente dovrebbe essere espressa, da chiunque notarsi, impugnarsi, ritrattarsi, in diritto o controversia richiamarsi, o ai termini del diritto ridursi non possano, né sotto qualsiasi revocazione di costituzioni o disposizioni simili o dissimili, anche motu, scienza e pienezza di potestà pari, anche consistorialmente, o altrimenti in qualunque modo da qualunque nostri predecessori e successori Romani Pontefici, e anche da noi, fatte e da farsi, comprendersi, ma sempre da quelle eccettuate, e perpetuamente valide, ferme ed efficaci esistere e essere, e i loro pieni e interi effetti sortire e ottenere, e da tutti e singoli, a cui spetta e in qualunque modo in futuro spetterà, inviolabilmente osservarsi;
26 § 17. Vogliamo inoltre, che coloro, i quali a due o più chiese predette dall'unione di esse, o altrimenti dalla concessione, o dalla dispensa apostolica, con qualunque nome o titolo prefetti sono, o per il tempo saranno, dalla residenza e dalle pene di siffatta siano scusati, purché in una di esse, in cui di diritto risiedere debbono, veramente e personalmente risiedano; eccettuate però, come si è detto, le chiese episcopali prossime all'Urbe, alle quali i cardinali in ordine anteriori presiedere sogliono: la residenza infatti, se quale presso le predette chiese dei titoli cardinalizi si facesse, alcuna scusazione ai medesimi cardinali, come si è detto, non presterebbe, affinché essi in altra o altre chiese predette, alle quali anche per il tempo prefetti accadesse, risiedere affatto tenuti siano;

1 of the clergy, even of the cardinals of the Holy Roman Church, with the fixing of a term for their departure to their residences, and the determination of penalties, and a prohibition against their departing from these without the license of the Apostolic See on account of any causes whatsoever, even the most urgent.
Urban, Pope VIII, for perpetual remembrance of the matter.
2 § 1. The holy synod of Trent, under the direction of our predecessor of blessed memory, Paul III, established many things concerning the residence of bishops for the restoration of ecclesiastical discipline, wisely providing that all, whatever dignity, rank and pre-eminence they might possess, placed over patriarchal, primatial, metropolitan and cathedral churches of any kind whatsoever, by whatever name or title, ought to reside personally in those churches; otherwise, if they were absent for six continuous months, they would incur by the law itself the penalty of the loss of one quarter of the fruits of one year; and if they persisted in absence for another six months, then they would lose another quarter of such fruits by that very fact; and as contumacy increased, the Roman Pontiff could by his supreme authority take action against those absent and provide the churches themselves with more useful pastors. 1
3 And in the same synod, § 2. Then under our predecessor of happy memory, Pius IV, the same synod also declared that all those placed over patriarchal, primatial, metropolitan and cathedral churches, even if they were cardinals of the Holy Roman Church, were obliged to make personal residence in their church or diocese; nor could they be absent except for legitimate causes, to be approved in writing. And for the execution of the decrees of the same council, the same Pius IV, our predecessor, by his letters issued under lead, dated the 7th of the Kalends of December in the year of our Lord 1564, admonished those same prelates of the aforesaid churches, in virtue of holy obedience, and, beyond the penalties contained in the same council, under the threat of their privation from the governance and administration of those same churches and the loss of the faculty of making a will and disposing of property and other penalties to be imposed at his and the Roman Pontiff's discretion, commanded them that they ought to reside entirely in person in the aforesaid churches. Finally, being informed that many of those same prelates were disobedient, by his own motion he committed to the auditor general of the apostolic chamber that he should proceed against them up to sentence, and then report to him, for the purpose of pronouncing against them in his secret consistory the sentence of privation and deposition.
4 And in the same way, § 3. Subsequently other Roman Pontiffs also published various edicts against those not residing and Gregory XIII declared that they should be afflicted.
5 of the Holy Roman Church; and our predecessor of pious memory, Gregory XIII, by his consistorial decree 2 declared that the decrees of the same council concerning personal residence to be made in the aforesaid churches also applied to the cardinals of the Holy Roman Church, by whatever title they presided over them, so that they were not excused from the guilt and penalties established in the said council unless the cause of absence had been approved in writing; and 3 knowledge 4 or toleration would not excuse those cardinals or other bishops.
6 § 4. Similarly, our predecessor of blessed memory, Clement VIII, by a like consistorial decree 5 for the observance of personal residence ordained by the same council added the penalty of ineligibility for obtaining greater dignities and churches, as is more fully contained in the aforesaid councils 6 and apostolic letters and consistorial decrees.
7 § 5. And whereas we have also caused edicts against non-residents to be published repeatedly, and yet in the months past some, even cardinals of the Holy Roman Church, placed over metropolitan or cathedral churches by apostolic concession, forgetful of their obligation to make personal residence in them, to the grave detriment of their own souls and to the prejudice of the flock entrusted to them, have continued to be absent from those same churches (even under the pretext of their titles of cardinalate, especially of episcopal ones near the City or in the City's district respectively, and on the ground that they were staying in that same City in our sight and presence), we, for our pastoral duty, wishing to provide not only for the souls aforesaid, but also for the security of the churches, have declared in our secret consistory that those same cardinals of the Holy Roman Church, who presided over those metropolitan and cathedral churches and did not reside nor were residing in them, have not made nor do make the fruits of those churches theirs, even under the pretext that they preside over one of the said episcopal churches, to which cardinals in the prior order are wont to be,7 and there or in the City they dwell, or under any toleration or faculty, except by Brief of Clement VIII, who added uninhabited ones to greater dignities.
8 This Pontiff ordered edicts to be published together with penalties against those not residing, and admonished them to proceed to residence.
In the year 1634 URBAN
9 cial of ours, or of the Roman Pontiff existing for the time being, granted to them: and therefore we admonished those same cardinals for the first time, that they should immediately betake themselves to such residence, under the loss of fruits incurred by that very fact and other canonical penalties, with the intention also of proceeding to further measures, if they should not obey, and as is more fully contained in our consistorial decree.4 However, because
§ 6. Since indeed from that time forth not all have obeyed the conditions as they were bound to do, but some remain contumacious even to the present; we, so that they may fully recognize what is owed against them by apostolic edicts already approved and confirmed, and by the decrees of the Council of Trent and by constitutions still in force, and so that it may be more expedient, as far as is granted to us from on high regarding the present matter, to provide further and to restore; adhering to the decrees of the Council of Trent and to apostolic letters, and to our motu proprio and the aforesaid consistorial decrees, and having the tenor of those, as if they were inserted word for word, as fully inserted and expressed, by similar motu proprio and from certain knowledge and mature deliberation of ours, and from the fullness of apostolic power, we confirm and approve the aforesaid decrees of the council, and the apostolic letters, and the aforesaid motu proprio of the first day, and the consistorial decrees, and whatever is contained in them, by this our perpetual constitution, and, insofar as it would be necessary, against any pretended non-use or contrary use, we innovate and most fully restore.
10 § 7. Moreover, we command all and each of the bishops and other prelates of patriarchal, primatial, metropolitan, archiepiscopal and episcopal churches by whatever name or title, even cardinals of the Holy Roman Church, absent from their aforesaid churches, in virtue of holy obedience (and under the interdict of entry into the church, and the loss both of the fruits of those same churches for the time during which the absence shall last, and of the faculties granted to them otherwise by the Apostolic See for making a will and disposing of their goods, incurred by that very fact without any other declaration, as well as deprivation from the governance and administration of their churches in this manner, and other penalties to be inflicted at the discretion of ourself and the Roman Pontiff existing for the time being), strictly commanding we admonish, that, setting aside all things, as quickly as possible, those remaining in the Roman curia namely within one month, those outside it but in Italy within two months, those existing outside Italy within four months, to be reckoned from the day of publication of these presents in the places written below, which we assign and will to be assigned to them as three canonical admonitions and peremptory delays and terms respectively, they should commit themselves to the journey, and by legitimate journeys to their churches or dioceses proceed, and betake themselves personally, and there, as they are bound, they ought to reside.
11 § 8. And to those same prelates, after they have personally betaken themselves to reside, we enjoin, under the same penalties also incurred by that very fact respectively, that they do not depart from their churches, unless they have first obtained our and the Roman Pontiff's existing for the time being permission by Brief or missive letters.
12 § 8. And to these same prelates, after they have departed from—[text unclear]—unless they have personally betaken themselves to reside, we enjoin, under the same penalties also to be incurred by that very fact respectively, as well as to whatsoever others residing personally at their churches at any time, that they depart not from their churches unless they have first obtained our licence and that of the Roman Pontiff for the time being through Brief or missive letters.
13 shall be appointed to any of the aforesaid patriarchal, primatial, metropolitan, archiepiscopal and episcopal churches by whatever name or title, even if they shall be or are cardinals of the Holy Roman Church at any time, under the same penalties, also incurred by that very fact respectively, ought, and each of them ought, within the aforesaid time, to be reckoned from the day of their promotion to one of the aforesaid churches, which we assign to them as three admonitions and delays as aforesaid from now,
14 likewise commit themselves to the journey, and betake themselves to the churches or dioceses committed to them for personally residing in them; and respectively, after they have begun to reside, not to depart from them, unless they have first obtained the aforesaid permission from us and the Roman Pontiff existing for the time being.
15 likewise commit themselves to the journey, and to the churches or dioceses committed to them betake themselves for personally residing in them; and respectively, after they have begun to reside, not to depart from them, unless they have first obtained the aforesaid permission from us and the Roman Pontiff existing for the time being.
16 § 10. We do not wish anyone to be able to excuse himself from the incurrence of these penalties by the pretext and reason of any service whatsoever rendered and to be rendered for the conduct and handling of the affairs of any princes whatsoever, even the Emperor, and of kings or republics, kingdoms and provinces; nor by reason of any command or mandate of theirs or thereof made at any time or to be made; nor even by reason of the prosecution or defense of any lawsuits or controversies, even ecclesiastical; or of entering into a treaty, or of handling any other business whatsoever, even the most serious and worthy of special mention, or of distance of places, or brevity of time (on account of which it may not seem that the license of the aforesaid Apostolic See should be awaited before they depart from their churches and dioceses), or by reason of any other cause or occasion whatsoever, even public, or otherwise favorable and equally pious, even of any utility or necessity of churches and persons (except personal attendance at provincial synods or congregations or general assemblies, in which ecclesiastics are accustomed to attend, or by reason of the office or public function of the state attached to the aforesaid bishoprics or greater churches, on account of which they are accustomed to be occupied for a certain time, and then for the time during which those synods, congregations and assemblies, and the exercise of the office or public function attached to those churches for them, shall actually 8 last; which being finished, they ought to return by the right path to the aforesaid churches committed to them). Nor do we wish the aforesaid cardinals of the Holy Roman Church, now and for the time being existing, who are or shall be placed in charge of any of the aforesaid churches, to be excused from the aforesaid residence and incurrence of the aforesaid penalties, even if as in some order prior they hold and shall hereafter hold one of the said episcopal titles near the City or in its district, and have resided in the aforesaid bishoprics titular near the City, or in the Roman Curia in their respective titles, even with our knowledge and that of the Roman Pontiffs our successors, seeing and in some way tolerating delay, so that by no connivance of ours and of the Roman Pontiffs our successors, silence, and for the celebration of any functions and pontifical acts, even public and solemn ones, can they ever protect themselves by reception and admission.
17 § 11. And for the inviolable observance of the aforesaid and underwritten matters, we commit and command to our beloved son, the general auditor of the apostolic camera now and for the time being existing, that he proceed against all and each of the aforesaid, both dwelling in the City and elsewhere, and not residing in their churches or dioceses, by affixion to the doors of the basilica of St. Peter, and in the field of the Campus Florae, and, as regards those present in the Roman Curia, for more abundant caution, also by leaving a copy at their homes; and, when it shall be sufficiently established for him, summarily, simply and plainly, with sole regard to truth, and by royal hand, concerning the contravention and disobedience aforesaid, he shall proceed up to the sentence exclusively; and then he shall report to us and to the Roman Pontiff for the time being existing, so that we and the Roman Pontiff for the time being existing in consistory may be able to proceed to the declaration 9
18 And to the cardinals in the vacancy of the Apostolic See.
19 He adds the preservative clauses of this constitution.
URBANUS
20 of the incurrence of penalties, and respectively of the privation or deposition and other punishments of the aforesaid disobedient ones, and the Roman Pontiff for the time being existing may be able to proceed.
21 § 12. We wish, however, that bishops, archbishops, metropolitans, primates and patriarchs, even cardinals of the Holy Roman Church, existing on this side of the mountains or sea, be excused for four, but others dwelling beyond the mountains or sea, for seven continuous months from residence in the aforesaid churches to be made for the purpose of visiting the thresholds of the holy Apostles Peter and Paul according to the sacred canons and apostolic constitutions for each visitation; provided, however, that during those times, they shall be bound to fulfill this duty of visitation, and shall not divert themselves to other acts.
22 § 43. To the cardinals, however, now and for the time being existing, who in the case of a vacancy of the Apostolic See are accustomed to proceed to the election of the Roman Pontiff to be made at the place of the conclave designated for this, we grant license to depart from the aforesaid churches committed to them, having first, however, obtained certain notice of the vacancy of the same Apostolic See, and to dwell and remain outside of residence, in the place in which such election shall happen to be celebrated, until the election is completed, and also afterwards for two months after the Roman Pontiff shall have assumed the insignia of his coronation: which time having elapsed, the aforesaid cardinals, unless immediately, as is aforesaid, they shall have betaken themselves to the aforesaid churches, which they shall happen to preside over, shall be subject to the penalties aforesaid.
23 §44. These present letters, moreover, and all and singular things contained in them, on account of any defect of subreptiousness, obreption, and any nullity or invalidity whatsoever (even from the fact that in the foregoing in any way pp. 464, n. 1634 having or claiming an interest, and especially those same now and for the time being placed over the aforesaid churches, even cardinals of the same holy Roman Church, did not consent to the foregoing, nor were called and heard, and solemnities and any whatsoever things to be observed and fulfilled were in no way observed and fulfilled, and the causes on account of which these present letters were issued, were not adduced, verified, or otherwise sufficiently or even in some respect justified), and on account of any other color, pretext, occasion, and cause, even those closed in the body of law, and any other whatsoever, however reasonable, just and privileged, even such as would necessarily need to be expressed for the effect of the validity of the foregoing, cannot by anyone be noted, impugned, retracted, called into law or controversy, or reduced to the terms of law, nor under any revocations, suspensions, limitations, or other contrary dispositions whatsoever of similar or dissimilar constitutions or dispositions, even by motu proprio, knowledge, and fullness of power alike, even consistorially, or otherwise in any way by any of our Roman Pontiff predecessors and successors, and also by us, made and to be made, for the time being in any way made, be comprehended, but always excepted from those, and perpetually valid, firm and efficacious exist and be, and their full and complete effects produce and obtain, and by all and singular to whom it pertains and shall in any way pertain in the future, be inviolably observed;
24 §45. Thus, and not otherwise, in the foregoing all and singular things by any whatsoever ordinary and delegated judges, even auditors of causes of the apostolic palace, nuncios and the aforesaid cardinals of the S.R.E., even legates a latere, and any whatsoever 10 others exercising any authority and power, with removed from them and from each of them any facility of otherwise taking root, declaring, interpreting and defining, everywhere ought to be judged, interpreted, declared and defined (so that, if ever any doubt or hesitation upon the foregoing, or some part of it, should arise or be raised, no one, except us and the Roman Pontiffs our successors, shall be able to interpret and declare these letters in any way), and we decree null and void, if otherwise upon these things by anyone, by any authority, knowingly or unknowingly, should happen to be attempted.
25 §16. Notwithstanding the foregoing, and apostolic constitutions and ordinances, even those issued and to be issued in universal, general, provincial and synodal councils, and the rules of the apostolic chancery, even of the first and any second edition, and, insofar as it should be necessary, concerning not taking away acquired right, statutes also, even of law, and customs, even long-standing and immemorial of the aforesaid churches and of each of them, and licenses otherwise, as aforesaid, obtained, and privileges and indults, even apostolic, to the same churches and their prelates in any way and from any cause, here perhaps necessarily to be expressed, granted, even by motu proprio, knowledge and fullness of power alike, even consistorially, and otherwise in any way issued, and any oath by the same placed over these churches in any pretext or cause sworn and to be sworn (which we declare to have been and to be null and void, and in no way to hinder, nor to suffice anyone, so that from complete observance of the present in any respect they might be excused, and, insofar as it should be necessary, we decree), as well as all and singular things which our aforesaid predecessors in their aforesaid letters and decrees willed not to hinder; all and singular of which, their complete tenor being had as fully and sufficiently expressed and inserted in the present for the effect of the present, we most fully specially and expressly derogate; and all other things whatsoever to the contrary.
26 §17. We also will that those who are placed over two or more of the aforesaid churches from their union, or otherwise from concession, or apostolic dispensation, by whatever name or title, or shall be for the time being, be excused from residence and penalties of this kind, provided that in one of them, in which they ought by law to reside, they truly and personally reside; excepting however, as aforesaid, the episcopal churches near the City, which cardinals in the prior order are accustomed to preside over: for residence, if any should be made at the aforesaid churches of the titles of cardinals, would afford some excuse to the same cardinals, as aforesaid, so that they themselves in another or other of the aforesaid churches, to which they also for the time being should happen to be placed over, ought altogether to reside;
27 § 18. - Besides the places of the Council of Trent indicated in the apostilles of this Constitution § 1 and 2, see Constitution XII, De salute, of Pius IV, vol. vii, p. 55. And of the same Constitution CV (in this edition CVIII) In suprema, ibid. p. 332.

- Read council or of the council decrees (R. t.).
- Perhaps it should be read preside (r. t.).
