Supernae dispositionis
10 Preliminarmente esame, processo e relazione in concistoro.
11 I promossi, cioè cardinali, vescovi e abati, anche in crimini notori, abbiano difese.
12 An.

Leo, bishop, servant of the servants of God, for perpetual remembrance of the matter, with the sacred Council approving.
1 By the disposition of divine providence, by which heavenly and earthly things are disposed with ineffable foresight, it befits the Roman Pontiff, holding the place of Christ, the only-begotten Son of God, in the sublime seat of blessed Peter, above all to exercise the office of a provident shepherd for the care and salvation of the Lord's flock divinely committed to him.
2 § 1. Wherefore, with the solicitude of the aforesaid pastoral office, since we observe that ecclesiastical discipline, the rule of living well and rightly throughout almost all grades of the Christian faithful, has through the difficulty of the times and the malice, licentiousness and impunity of men so fallen away, flowed down and wandered far from the right path, that unless it be corrected by provident amendment, it is to be feared that daily it will fall into various errors through the security of sinning, and soon break forth into public scandals.
3 § 2. Desiring therefore, insofar as it is permitted to us from on high, to correct those evils now excessively grown strong, and to reduce many things to the pristine observance of the sacred canons, and to reform them for the better, according to the institutions of the holy fathers, the Lord granting it, and all these things, with the sacred Lateran Council approving, begun by our predecessor of happy memory, Pope Julius the Second, and continued by us, to moderate healthfully, so that we may take our beginning from those things which now seem more expedient and have produced the greatest scandals in the Church of God, we have determined to begin, namely, from promotions to ecclesiastical dignities.
4 § 3. Since Alexander the Third, of pious memory, our predecessor, also decreed in the Lateran Council that age, gravity of morals and knowledge of letters should be diligently inquired into in persons to be promoted to bishops and abbots; and nothing harms the Church of God more than when unworthy men are assumed as prelates to the governance of churches: therefore, in the promotions of prelates, to which great attention ought to be paid by the Roman Pontiffs, especially since they will have to render an account in the final judgment concerning those promoted by them to churches or monasteries, we establish and ordain that henceforth, for all future time, to patriarchal, metropolitan and cathedral churches and monasteries vacant from time to time, persons endowed, according to the aforesaid constitution of Alexander, with mature age, gravity of morals and knowledge of letters, shall not be provided at the instance of anyone, through commenda and administration or conservation or in any other manner whatsoever, unless for the reason of the utility of the churches, prudence, nobility, probity, experience and ancient courtesy, with competent learning, and merits in the Apostolic See, it shall seem otherwise to be done. And the same we wish to be observed in those elected and postulated, whose elections and postulations have been accustomed to be admitted by the Apostolic See.
5 § 3. Since of pious memory Alexander the Third, our predecessor, also decreed in the Lateran Council that age, gravity of morals, and knowledge of letters should be carefully inquired into in persons to be promoted to bishops and abbots; and nothing harms the Church of God more than when unworthy men are assumed as prelates to the governance of churches: therefore, in the promotions of prelates, to which great consideration ought to be given by the Roman Pontiffs, especially since they will render an account in the final judgment concerning those promoted by them to churches or monasteries, we establish and ordain that henceforth, for perpetual future times, to patriarchal, metropolitan and cathedral churches and monasteries vacant from time to time, provision shall be made of persons, according to the aforesaid constitution of Alexander, endowed with mature age, gravity of morals and knowledge of letters, not at the instance of anyone, by commenda and administration or conservation or any other manner whatsoever, unless for the reason of the utility of the churches, prudence, nobility, probity, experience and ancient courtesy, with competent learning, and merits in the Apostolic See, it shall seem otherwise to be done. And the same we wish to be observed in the case of those elected and postulated, whose elections and postulations have been accustomed to be admitted by the Apostolic See.
6 § 5. Moreover, so that suitable persons may be promoted more carefully and diligently, we establish that the cardinal to whom the relation of the election, postulation or provision of the Church or monastery is committed, before he reports in the sacred consistory, as is the custom, the commission of examination and relation of this kind given to him, shall make known that report to the senior cardinal of each Order, in the consistory itself by himself, or, if there be no consistory on the day on which the burden of commission was imposed upon him, through his secretary or any other of his domestic household, who shall be bound to signify it to the three first other cardinals of his Order as soon as possible; and let the business of election, administration, postulation or promotion be examined summarily and plainly by the aforesaid relator himself; and if any shall speak against it, let him call suitable, grave and trustworthy witnesses and, if it be expedient or necessary, assume others ex officio, and let him bring the processes and rights of such relation, together with the said witnesses, on the day of making the relation to the consistory; and let him in no way report unless the person to be promoted, present in the Curia, shall have previously visited the greater part of the cardinals, so that the cardinals who are to hear what the relator colleague reports may, with ocular faith, insofar as concerns the person to be promoted, be able to know.
7 § 5. Moreover, in order that suitable persons may be promoted with greater accuracy and diligence, we decree that the cardinal to whom the relation of the election, postulation or provision of a Church or monastery is entrusted shall, before he makes his report in the sacred consistory, as is customary, communicate the commission of examination and relation given to him to the senior cardinal of each Order in the consistory itself, either by himself, or, if there be no consistory on the day on which the burden of the commission is laid upon him, through his secretary or any other of his household servants, and this note shall be made known; and the three senior cardinals of the other Orders shall be bound to communicate it to the other cardinals of their Order as soon as possible; and the matter of the election, administration, postulation or promotion shall be examined summarily and plainly by the said relator himself; and if any shall speak against it, with these present, he shall assume suitable, grave and trustworthy witnesses and, if it be expedient or necessary, others ex officio, and he shall bring the processes and the rights of such relation, together with the said witnesses' testimony, to the consistory on the day the relation is to be made, nor shall he make his report in any way if the person to be promoted, being present in the Curia, has not previously approached the greater part of the cardinals, so that those cardinals who are to hear what the relator colleague reports may know, with ocular faith, as far as concerns the person to be promoted.
8 § 7. And since it is fitting that the episcopal dignity be kept unharmed and, lest it lie open to the attacks of the wicked or the calumnies of accusers everywhere, be fortified, we establish that examination, process and relation in consistory are to be required.
9 Examination, process and relation in consistory to be premitted.
10 Matters to be examined beforehand, the process and report in consistory.
11 Those promoted to the rank of cardinal, bishop, and abbot, even in notorious crimes, shall have defenses.
12 In the year 1516, so that no bishop or abbot, at any instance or request, unless he himself has the opportunity and the Prelate unwilling, shall be transferred.
13 Reform concerning the commendation of monasteries, etc.
14 The burdens of the same concerning the election of alms, etc.
15 The faculty of legitimate defense shall be permitted, even if the crimes shall have been notorious, and with the parties diligently heard, the case fully proved, he may be deprived.
16 § 8. Nor shall any prelate be transferred unwillingly, unless for other just and more efficacious reasons and causes, according to the form and decree of the Council of Constance.
17 § 9. And since from the commendations of monasteries, as the teacher of things, experience has often shown, the monasteries themselves, both in spiritual and temporal matters, are gravely harmed, inasmuch as their buildings, partly through the negligence of commendataries, partly through avarice or carelessness, collapse, and day by day the divine worship in them is further diminished, and everywhere matter for contradiction is afforded to persons, especially secular ones, not without diminution of the dignity of the Apostolic See, from which such commendations proceed; in order that their indemnity may be more healthfully provided for, we will and decree that, when those monasteries shall have become vacant through the death of the abbots who presided over them, in no way can they be commended to anyone (unless for the preservation of the authority of the Apostolic See, and to meet the malices of those impugning it, according to the quality of the times, otherwise to us, by the counsel of our brethren, it shall seem expedient), but from a suitable person, according to the prescribed constitution, let them be so provided for, that suitable abbots, as is fitting, shall preside over them.
18 § 10. But those monasteries which shall have been commended, when through their cessation or the death of those to whom they were commended, such commendations shall have ceased, may be commended only to cardinals and qualified and well-deserving persons, yet so that the commendataries of those monasteries, to whom they shall henceforth be commended, of whatever dignity, honor and pre-eminence they may be, even if they hold the honor and dignity of the cardinalate, if they shall have had a separate table, and separate from the common table of the convent, shall be bound to assign a fourth part of their table for the restoration of the fabric, or for the purchase and repair of ornaments, vestments and furnishings, or for the sustenance of the poor, as the greater necessity shall require and suggest; but if the table shall have been common, a third part of all the fruits of the monastery commended to them, for bearing the aforesaid burdens and the sustenance of the monks, all other burdens being deducted, shall be assigned to them. And the letters which shall be expedited concerning the commendations of such monasteries ought to be expedited with a clause specifically expressing this same thing; otherwise, if they shall be expedited otherwise, they shall be of no force or moment.
19 § 11. And since such churches ought to be provided for without any diminution of fruits, so that regard may be had both to the dignity of those presiding and to the necessity of the churches and buildings, we decree likewise and establish that, upon the fruits of the same churches, pensions shall in no way be reserved, unless from the cause of resignation, or also another, which shall have been held just, probable and honest in our secret consistory.
20 § 12. We have also established that henceforth parochial churches and greater dignities and principal ones and other ecclesiastical benefices, whose fruits, revenues and proceeds do not constitute or attain the annual value of two hundred ducats of gold of the Camera, according to common estimation, as well as hospitals, leper-houses, hospices of whatever value, which have been instituted for the use and sustenance of the poor, shall not be commended to the cardinals of the holy Roman Church, or be conferred by any other title, unless through the death of our familiars 1; which may be commended to them, so that they be bound to relinquish them within six months for the convenience of persons grateful and suitable to them, and also as to benefices, to
21 Reform concerning pensions to be reserved.
22 Which benefices are not to be united in perpetuity.
23 Reform concerning benefices to be separated and united.
24 Reform concerning the plurality and reservation of benefices.
25 which would have had recourse, we do not intend to prejudice.
26 § 13. We ordain also that the members of churches and of any monasteries and military orders be not disjoined or separated from their head, which is absurd, without legitimate and reasonable cause.
27 § 14. Perpetual unions, except in cases permitted by law or without reasonable cause, shall in no way be made.
28 § 15. Dispensations, however, for more than two incompatible benefices shall not be granted to those not qualified according to the form of common law, except for a great and urgent cause. And to persons of whatever dignity, holding parochial churches and their perpetual vicariates and greater and principal dignities, even by way of union or commenda for life, beyond four, We hereby fix a term of two years so that in the meantime, retaining only four of them, they shall be bound to relinquish the rest, and such benefices to be relinquished may be resigned into the hands of the ordinaries, for the purpose that provision be made for them by persons to be nominated by them, any reservation whatsoever, even a general one, even resulting from the qualities of the persons resigning, notwithstanding: which term having elapsed, unless they shall have relinquished them, all shall be considered vacant, and may be freely sought as vacancies; and such persons moreover retaining them shall incur the penalties of the extravagant of John, Pope of blessed memory, of the twenty-second 2, even of our predecessor. We likewise decree that special reservations of any benefices whatsoever shall in no way be granted at the instance of anyone.
29 § 16. And since the cardinals of the holy Roman Church precede all others in the same Church, after the Supreme Pontiff, in honour and dignity, it is fitting and proper that they shine forth before all in the purity of life and the splendour of virtues. Wherefore we not only exhort and admonish them, but also decree and ordain that henceforth each of the cardinals for the time being, according to the doctrine of the Apostle, shall live so soberly, chastely and piously, that abstaining not only from evil, but from every appearance of evil, he may shine before men, and honour God above all in his works. Let all be vigilant and attentive to divine offices and the celebration of Masses, and let them have their chapels in a becoming place, as they have been accustomed to do. And let their house, household, table and furnishings be not marked by ostentation or pomp, nor by superfluous things, nor in any way reprehensible, lest from thence arise licence for sinning and exceeding bounds, but, as is fitting, let them deserve to be called a mirror of modesty and frugality. Let them be content with those things which befit priestly modesty. And let them treat benignly and honourably, both publicly and privately, the prelates and any other distinguished men coming to the Roman Curia, and let them graciously and generously undertake the affairs commended to us and our successors on their behalf.
30 § 17. Moreover, let bishops and prelates not have unbecoming ministries in their houses, lest those instituted to preside over others descend into base ministries, and those marked with the sacred character bring contempt upon the pastoral office. Those therefore whom they now have or shall have in the future, let them treat honourably, as brothers, and according to the condition befitting their status.
31 § 18. And since it is most unbecoming that those who assist the Roman Pontiff, the father of all the faithful and of all Christians, should become accepters of persons or advocates; we therefore decree that they shall not show partiality in any way, nor become promoters or defenders of princes or communities or any others against anyone, except insofar as justice and equity demand, and their dignity and condition require; but, separated from all private passion, let them apply themselves with all diligence to settling and composing disputes among any parties, and let them earnestly promote the just affairs of princes and any others, and especially of the poor and religious with pious affection; let them aid the oppressed and unjustly burdened, according to their strength and the duty of their office.
32 § 19. Let them visit the places of their titles, if they are present in the Curia, personally; if however they are absent, let them visit them through a suitable vicar at least once in two years; let them inquire into the life of the clergy and peoples of their churches, let them carefully investigate the churches subject to their title, and let them be vigilant concerning divine worship and the goods of the said churches, and above all let them diligently examine the morals and life of the clergy and parishioners, and let them admonish all and each of them with paternal affection to live rightly and honourably. For the increase of divine worship and the salvation of their own soul, let each cardinal either during his life donate, or at the point of death leave to his title as much as is sufficient to support one priest comfortably there; or, if the church should need repair or other assistance, let him leave or donate to it as much as shall seem good to his conscience.
33 § 20. And since it is by no means fitting to neglect relatives and blood relations, especially those who have deserved well, and the poor in need of assistance, but rather to provide for them is just and praiseworthy; nevertheless we do not think it fitting that on this account church goods be filled with them through a multitude of benefices or ecclesiastical revenues, so that others suffer loss from such intemperate largesse and scandal arise therefrom. We have therefore decreed that the goods of churches be not squandered recklessly, but that they be expended in pious and holy works, for the sake of which great and excellent revenues were established and ordained by the holy fathers.
34 § 21. We also wish that those churches commended to cardinals, even if they have vicars and other necessary cathedral abbeys or priories or any other ecclesiastical benefices whatsoever, shall without any excuse whatsoever take care and provide with all their effort that they be duly served; providing for cathedral churches worthy and suitable vicars or suffragans, as custom has been, with fitting and competent stipend; and for the other churches or monasteries commended to them, providing for a just number of clerics or chaplains, or religious or monks serving God sufficiently and laudably.
35 § 22. Moreover, the buildings and possessions of each church they shall conserve and restore the rights whatsoever in fitting condition; they shall preserve them and restore what is ruined, as pertains to the duty of good prelates and commendataries.
36 § 25. We have also decreed that the said cardinals, concerning the number of their household members and mounted attendants and their maintenance at their own expense, shall exercise great circumspection and diligent care, lest they maintain a greater number than their resources, condition and dignity permit, and be noted with the vice of luxury and prodigality; nor again be held to be miserly and sordid, if with great and ample revenues they provide sustenance for very few, since the house of a cardinal ought to be an open house, a port and refuge especially of good and learned men and poor nobles and honest persons. Let them therefore be prudent concerning the manner and number of their household, and especially careful about the quality of their servants, lest they contract for themselves a shameful mark of infamy from the vices of others, and give just occasion for the common people to speak ill and calumniate. And since it must be provided with the greatest care that our works be approved not only before God, to whom we must first please, but also before men, so that we may be an example for others to imitate, we ordain that each cardinal show himself to be the best rector and prefect of his house and household, both concerning those things which appear outwardly to all, and those which lie hidden within.
37 § 24. Let each of them therefore have priests and levites in his household clothed in honest vestments, and let him carefully provide that no one in his household who is in any way beneficed and in holy orders wear parti-coloured garments, nor use that habit which is little fitting to the ecclesiastical order. Wherefore, those in the order of priesthood shall wear vestments of colours which are not prohibited to clerics by law, reaching at least to the ankles; and those having dignities in cathedral churches and canons also of the said cathedrals, and those having the first dignity in collegiate churches, and the chaplains of cardinals celebrating Mass, shall be required to wear a hood in public, while grooms may be allowed garments somewhat shorter above the ankles. Grooms, because they are in constant motion and perform more laborious service, may use shorter and more practical garments, even if they be clerics, provided they are not in the order of priesthood, yet so that they do not depart from honesty, but live so that their morals do not conflict with their ecclesiastical orders. Let the remaining clerics do all things temperately and modestly; and both those clerics who are beneficed and those in holy orders shall not wear long hair or beards nor have mules or horses with ornaments and trappings made of velvet or silk, but shall use such things made simply of cloth or leather only. If any of the aforesaid household members shall act contrary to this, or after three months, legitimate warning having preceded, from the publication of these presents, shall have worn such prohibited garments, he shall incur excommunication. If moreover he shall not correct himself within three other months, he shall be understood to be suspended from the receipt of the fruits of the benefices which he holds. And if he shall remain obstinate in such pertinacity for another six months, legitimate warning having likewise preceded, he shall be deprived of all benefices whatsoever that he has and shall be deemed to be deprived; and those thus vacated may be freely obtained from the Apostolic See.
38 § 25. All these things and each of them we wish to have force in our household and in that of any Roman Pontiff existing for the time being, and likewise in all, even curial, persons. With this one exception only, that our said familiars and those of the Roman Pontiff may wear vestments of red color, for the dignity and custom befitting pontifical rank.
39 Of the Pope.
40 § 26. And since it pertains especially to cardinals, as the principal hinges, to care for the preservation and propagation of the best works, they shall labor to know which regions are infected with errors and superstitions and with things contrary to the true and orthodox faith, and where ecclesiastical discipline of divine commandments is lacking, and which kings and princes or peoples are troubled by wars or fear to be troubled. They shall endeavor to know these and such things, and to report them to us and to the Roman Pontiff existing for the time being, so that opportune and salutary remedies for such evils and plagues may be devised with vigilant care.
41 § 27. And since it is known from frequent and daily experience that in provinces and cities, on account of the absence of their legates, many evils often occur and various scandals arise, not without prejudice to the Apostolic See, we decree and ordain that no cardinals shall be permitted to hold provinces and cities under the title of legation and to administer them through vicars or any officials whatsoever, but they themselves must be present in person for the greater part of the time, and are bound to govern and rule them with all vigilance. And those who now hold the title of legation or shall hold it for the time being, if in Italy, within three months; if outside Italy, within five months from the day of the publication of the present document, are bound to go to their provinces and to reside there for the greater part of the time, unless, by our mandate and that of our successors, they are retained in the Roman Curia for certain weightier matters or are sent to other places, as necessity demands; and then in the said provinces and cities they shall have vicelegates, auditors and vicars and other customary officials with due provisions and salaries. Whoever shall not observe all and each of the foregoing things shall be deprived of all emoluments of the legation. These things were indeed ordained and instituted of old, so that the opportune presence of legates might be salutary to the peoples, not that they themselves, entirely free from labors and cares, should aim only at profit and at the title of their legation.
42 § 28. And since the office of cardinal is engaged principally in frequent assistance to the Roman Pontiff and in the affairs of the Apostolic See in the Roman Curia, for this reason we decree that all cardinals reside in the Roman Curia, and those who are absent, if in Italy, within six months; if outside Italy, within a year from the day of the publication of the present constitution, shall return. Otherwise they shall lose the fruits of their benefices and all emoluments of their offices, and shall be entirely deprived of all privileges granted generally and specially to cardinals, so long as they are absent; excepting however those who, by reason of an office imposed by the Apostolic See or by mandate or license of the Roman Pontiff, or by fear, or any other legitimate cause preventing them, or by sickness, are absent, the privileges, indults and immunities granted to the same cardinals and contained and expressed in our bull under the date of our coronation nevertheless remaining in their force.
43 § 29. We further decree that the funeral expenses of cardinals, with all costs of the funerals of cardinals, shall not exceed the sum of florins, unless the executors, with just causes and reasons alleged, shall have judged that more ought to be expended. The exequies and the catafalque shall take place on the first and ninth days; within the octave, however, masses shall be celebrated in the customary manner.
44 § 30. For the reverence of the Apostolic See, moreover, and for the utility and common honor of it and of the cardinals themselves, so that the occasion of scandals which might arise be removed, and greater freedom of votes be made in the sacred Senate, and it be permitted, as is fitting, for each cardinal to speak freely and with impunity whatever he feels according to God and his conscience, we decree that no one of the cardinals shall reveal in writing or by word or in any other manner the votes given in consistory and whatever things are done or said there, which might redound to the hatred or prejudice or scandal of anyone, under penalty of perjury and disobedience.
45 § 31. And whenever by us and the Roman Pontiff existing for the time being, silence shall be specially and expressly enjoined upon any matter, if anyone shall act contrary to this, beyond the said penalties, he shall incur excommunication of the sentence already pronounced, from which he cannot be absolved except by us or the aforesaid Roman Pontiff and with an expression of the cause, except in the article of death.
46 § 32. And since every age from adolescence is prone to evil, and it is a great work and effort to accustom the young to good from tender years, we have established and ordained that masters of schools and teachers shall instruct their boys or adolescents not only in grammar and rhetoric and other such subjects, but also are bound to teach those things which pertain to religion, such as divine precepts, articles of faith, sacred hymns and psalms and the lives of saints; and on feast days they are able to teach them nothing other than matters pertaining to religion and good morals; and they are bound to instruct them in these, to exhort and compel them insofar as they are able, so that they may attend churches not only for masses, but also for hearing vespers and divine offices, and similarly they shall impel them to hear sermons and homilies, and nothing contrary to good morals or which might lead to impiety may be read to them.
47 § 33. Moreover, to abolish the execrable blasphemy, which to the greatest contempt of the divine name, of the Virgin and of the saints has invaded, we have established and ordained that whoever shall curse God openly or publicly, or shall blaspheme with contumelious and obscene words our Lord Jesus Christ or the glorious Virgin Mary his mother expressly, if he shall have held public office or jurisdiction, let him lose the emoluments of three months of the said office for the first and second time; if he shall offend a third time, let him be deprived thereof by that very fact: if he shall be a cleric or priest, by that very fact that he shall have been convicted of such a crime, let him be fined even with the fruits of whatever benefices he shall have held for one year, to be applied as below, and this shall be for the first time that the blasphemer shall have so offended. For the second time, if he shall so offend and be convicted as aforesaid, if he shall have held a single benefice, let him be deprived of it; if however he shall have held several, let him be compelled to lose whichever the ordinary shall prefer. But if he shall be accused and convicted a third time of his crime, let him be deprived by that very fact of all dignities and benefices whatsoever he shall have held, and let him be rendered incapable of retaining them further, and let them be freely obtained and conferred. A layman, however, who blasphemes, if he shall be noble, shall be fined with a penalty of twenty-five ducats; and for the second time, to be applied to the fabric of the basilica of the Prince of the Apostles of the City, and to others, as is deduced below. For the third time, however, let him lose his nobility. But if he shall be ignoble and of the common people, let him be thrust into prison; and if he shall be detected blaspheming publicly beyond two times, let him be compelled to stand in an infamous mitre for a whole day before the doors of the principal church; if however he shall have fallen into this same sin more frequently, let him be condemned to perpetual imprisonment or to the galleys, at the discretion of the judge appointed. In the forum of conscience, however, no one guilty of blasphemy, without the gravest penance imposed by the judgment of a strict confessor, is able to be absolved. We wish that those who shall have blasphemed the other saints be punished somewhat more mildly by the judgment of the judge, having regard to the condition of persons. We have also established that secular judges, who shall not have taken action against such convicted blasphemers and shall have inflicted upon them no just penalties, insofar as it lies in them, as if they themselves were liable to the same crime, shall be subjected to the same penalties. But those who shall be diligent and severe in inquiring into and punishing these matters shall obtain for each instance an indulgence of ten years and shall have a third part of the pecuniary fine. Whoever shall have heard a blasphemer is bound to rebuke him sharply with words, if it can be done without danger to himself, and the same person ought to report or notify him to the ecclesiastical or secular judge within three days. But if several shall have heard the said blasphemer together, each one is bound to accuse him, unless perhaps all shall have agreed that one shall perform such an office for all. All of these we exhort in the virtue of holy obedience, and we admonish in the Lord that, for the reverence and honor of the divine name, in their domains and lands they command and cause all the aforesaid to be observed and executed most exactly, being about to have the most abundant reward from God himself for so good and pious a work, and likewise to obtain a similar indulgence of ten years from the Apostolic See, with a third part of the fine by which the said blasphemer shall be punished, as often as they shall have taken care to punish such a crime, which indulgence and the remaining third part of the fine we likewise wish to be granted and assigned to the accuser who shall report the name of the blasphemer, other penalties against such blasphemers expressed through the sacred canons nevertheless remaining in their force.
48 § 54. In order that clerics especially may live chastely and continently, according to the precepts of the canons, we have established that those acting contrary shall be punished severely according to the canons.
49 § 55. If anyone, whether layman or cleric, shall be convicted of the crime on account of which wrath comes upon the sons of disobedience, let him be punished with the penalties imposed respectively by the sacred canons or civil law.
50 § 56. Concubinaries, whether laymen or clerics, shall be punished with the penalties of those same canons, nor shall the tolerance of superiors or a depraved custom, which ought rather to be called a corruption, on account of the multitude of sinners, or any other excuse whatsoever avail them in any way, but they shall be severely punished according to the judgment of law. For the good and peaceful governance of cities and all places subject to the Roman Church, we renew the good constitutions formerly issued by Egidius, bishop of Sabina, and we command and decree that they be inviolably observed.
51 § 57. And so that the stain of nefarious simony and the penalty of Simonians, the omission of the recitation of the Office, the penalties of principals and of the officials themselves in the fruits of benefices and those receiving them, may be eradicated—
52 not only from the Roman Curia, but also from the entire Christian realm in perpetuity, we renew the constitutions issued by our predecessors, even in sacred councils against such Simonians, and we command that they be inviolably observed, and the penalties contained in them are to be held as expressly stated and inserted, and we will that those offending be subjected to them, even by our authority.
53 § 58. We also decree and ordain that whoever holds a benefice, whether with cure or without cure, if after six months from obtaining the benefice he shall not have recited the divine office, legitimate impediment ceasing, shall not make the fruits his own in proportion to the omission of the recitation of the office and time; but he shall be bound to expend them, as unjustly received, for the fabric of such benefices or for alms to the poor. But if he shall contumaciously persist in such negligence beyond the said time, legitimate admonition having preceded, he shall be deprived of the benefice itself, since the benefice is given on account of the office. It is to be understood, however, that one omits the office, so far as to be able to be deprived of the benefice, who has not recited it at least twice within fifteen days, yet he shall render account to God, beyond what is aforesaid, concerning such omission. Which penalty in those holding several benefices shall be repeatable as many times as they are convicted of transgressing.
54 § 59. And since the full disposition and administration of the fruits of cathedral and metropolitan churches, monasteries, and all other ecclesiastical benefices pertain to us and to the Roman Pontiff for the time being, and also to those who hold such churches, monasteries, and benefices by right and canonically; and secular princes, even though all divine law prohibits it, ought in no way to intermeddle with the said churches, monasteries, and benefices, we decree and ordain that the fruits, revenues, and proceeds of churches, monasteries, and benefices shall not be sequestered, occupied, or detained in any way by any secular princes whatsoever, even if they be emperors, kings, queens, or republics or powers, or by their officials or judges, even ecclesiastical ones, or by any other persons, public or private, by the mandate of the same emperors, kings, queens, and princes, or of republics or powers; and those same holding such churches, monasteries, and benefices shall not be hindered, under the pretext of the repair and restoration of the fabric, without the express license of the Roman Pontiff for the time being, or of alms, or under any other color or pretense, from being able to dispose of them as before freely and without impediment. And if they shall have been sequestered, occupied, or detained, they shall be restored whole and free and without exception or delay to the prelates to whom they rightfully and legitimately pertain, and concerning which, if they cannot be found because they have been dissipated, we will that satisfaction be made to the said prelates by their just estimation by those who made or ordered such sequestrations, applications, and dissipations, under the penalty of excommunication or ecclesiastical interdict to be incurred ipso facto from the lands and dominion of such princes. And so that their goods and those of the same subjects, wherever found, if they shall be unwilling to obey when admonished, may be seized and retained. Those same contravening shall be subject, as much to the aforesaid penalties as to the privation of fiefs and privileges which they now hold and shall hold for the time being from us and the Roman Church or other churches, and to others imposed against violators and oppressors of ecclesiastical liberty, even by the extravagantes and other constitutions, even unknown and perhaps not in use, the tenors of all of which, holding them as expressly stated and inserted, we renew, and we decree and declare that they have perpetual force and firmness, and according to them by any judges whatsoever, even cardinals of the holy Roman Church, the power of judging and declaring otherwise being taken away and removed from them, we will and command that sentence be pronounced, judgment rendered, and interpretation made.
Against violators of ecclesiastical liberty the constitutions of the Roman Pontiffs are renewed.
Reform concerning malefactors and enchanters.
55 § 40. And since by law, both divine and human, no power in ecclesiastical persons is attributed to the laity, we renew all and singular the constitutions of the blessed memory Pope Boniface VIII, also our predecessor, which begins Felicis, and of Clement V which begins Si quis suadente, as well as whatever other apostolic sanctions whatsoever issued in favor of ecclesiastical liberty and against its violators; and the penalties also against those presuming such things, contained in the bull which is read in Coena Domini, remaining in their force. And since in the Lateran Council likewise and in general councils, under penalty of excommunication, it has been prohibited that kings, princes, dukes, counts, barons, republics and other powers whatsoever, presiding over kingdoms, provinces, cities and lands in any manner, impose and exact collections, tithes and other such burdens on clerics, prelates and other ecclesiastical persons whatsoever, nor receive them even from those giving willingly and consenting; and those affording aid, favor or counsel in the aforesaid matters openly or secretly incur the penalty of excommunication ipso facto; and the same republics and communities and universities, offending in any manner concerning this, are subject ipso facto to ecclesiastical interdict; and prelates also consenting to the aforesaid without express license of the Roman Pontiff incur the penalty of excommunication and deposition ipso facto, we decree and ordain that henceforth those presuming such things, even if, as aforesaid, they shall have been qualified, beyond the aforesaid penalties, which we will those contravening to incur ipso facto and we renew, shall be held incapable and unfit for all legitimate acts and shall be infamous.
56 § 41. And since according to civil laws and the censures of sacred canons, sorceries by invocation of demons, incantations and divinations and superstitions are prohibited, we decree, determine and ordain that clerics who shall be found culpable in the aforesaid be marked with infamy at the discretion of their superiors; but if they do not desist, they shall be deposed, and shall be thrust into a monastery for a time to be fixed at the discretion of the superior; and they shall be deprived of benefices and ecclesiastical offices. But the laity of either sex shall be subject to excommunication and other penalties of law, both civil and canonical.
57 § 42. And so that all faithful Christians and heretics losing the faith and thinking badly, of whatever rank or nation they shall be, as well as heretics, whether or some heresy stain polluted or Judaizing, shall be completely eliminated from the assembly of the faithful, and shall be expelled from any place, and especially from the Roman Curia and punished with due severity, we decree that diligent inquiry shall proceed against them everywhere, and in the said Curia especially, by judges to be appointed by us; those guilty of that crime and legitimately convicted, to be punished with due penalties; but the relapsed, without any hope of pardon or remission, we will to be afflicted with due penalties.
58 § 45. And since our constitutions and ordinances of this kind, which for now concern ecclesiastical life, morals and discipline, it is fitting that both our officials and others, both in the Roman Curia and outside everywhere dwelling, imitate, be bound by them, and we will and decree that they be held inviolably to their observance.
59 § 44. And lest the constitutions themselves seem to derogate in any way from other censures and penalties imposed on those contravening by ancient law and constitutions; since they were issued and devised for increase, we also declare through their dispositions and ordinances that nothing whatsoever is derogated from common law or the decrees of other Roman Pontiffs in any way. Rather, if any of them, on account of the perverse corruption of times or places or men or abuse or any other cause not at all approvable, shall have lost their force, we now renew, confirm and inviolably establish them.
60 § 45. These our most prudent constitutions, after two months from their publication, we also decree and declare ought to bind; we strictly forbid that anyone presume to gloss them or make commentaries, interpretations or explanations upon them without special license from us or the Apostolic See. If anyone shall contravene with rash presumption, he shall incur the penalty of excommunication ipso facto.
61 we strictly forbid that anyone presume to gloss them or make commentaries, interpretations or explanations upon them without special license from us or the Apostolic See. If anyone shall contravene with rash presumption, he shall incur the penalty of excommunication ipso facto.
62 Let no one whatsoever therefore etc.
