MOTU PROPRIO
Prov. Mediolan. I, p. 2.

MOTU PROPRIO
3 Providentissimi huius instituti salutaribus effectibus experientia comprobatis, vix dum, licet inviti, universalis Ecclesiae gubernacula, Deo disponente, tractanda suscepimus, ad illud perficiendum provehendumque animum intendimus.
Prov. Mediolan. I, p. 2, omnino faciendum praecipimus.

MOTU PROPRIO
ON THE ELECTION OF BISHOPS TO BE BROUGHT BEFORE THE SUPREME SACRED CONGREGATION OF THE HOLY OFFICE*
1 It has always been a matter of the greatest concern to the Roman Pontiffs that Pastors be placed over the individual Churches throughout the world who would know well and be able strenuously to bear so great a burden, one that would be formidable even to angelic shoulders. From this it came about that from ancient times they themselves issued many decrees, by which either new norms were handed down for the happy selection of Bishops or the observance of those already given was urged.
2 Among these we consider worthy of special remembrance those which, before the Sacred Council of Trent, the Supreme Pontiff Leo X1, and after it, Sixtus V2, Gregory XIV3, and Urban VIII4 most wisely established concerning the qualities of those to be promoted and the form to be observed in their promotion; yet it is our pleasure first to recall what was decreed by our Predecessors of blessed memory Benedict XIV5 and Leo XIII6. The former, grieving that the method in this most serious matter which had been introduced by his predecessor had gradually fallen into disuse, and thinking to restore it, from the first year of his Pontificate, by the Constitution Immortalis memoriae instituted a special Congregation of the Cardinals of the Holy Roman Church, whose duty it was, with the form and procedure observed hitherto by this Holy See in the election and confirmation of Bishops of foreign regions remaining intact in all respects, to apply its efforts diligently to the promotion of those to be placed over the dioceses of Italy.
3 With the salutary effects of this most provident institution confirmed by experience, scarcely had we, though unwillingly, undertaken to guide the universal Church's helm by God's disposition, when we turned our attention to perfecting and advancing it. To this end, joining the aforesaid Congregation for the election of Bishops of Italy founded by Leo XIII to the Supreme Sacred Congregation of the Holy Office, which we ourselves immediately preside over, we decree and establish that, with the reasons and forms which are now employed in the election of Bishops for places subject to the Sacred Congregations of Propaganda Fide and of Extraordinary Ecclesiastical Affairs, or where particular Constitutions or Concordats regulate the matter, being preserved in their entirety, the selection and promotion of all other Bishops shall be referred to that same Supreme Congregation of the Holy Office, as a matter properly belonging to it.
4 And since it is proper to this Congregation that its members and officials are bound under penalty of incurring excommunication latae sententiae, to be incurred ipso facto and without any other declaration, to faithfully discharge their duty and to maintain inviolable secrecy in all things and with all persons, from which none can be absolved save by us and by our Successors the Roman Pontiffs for the time being, exclusively also as regards the Sacred Penitentiary itself and the Lord Cardinal Penitentiary, except in the article of death; we will and expressly declare that all and each, of whatever dignity and preeminence they may be, who in any way, for any reason or title, happen to have a part in the matter of the election of Bishops by the aforesaid Supreme Congregation of the Holy Office, shall be bound by the same obligation under the same penalties and sanctions.
5 But so that the same Supreme Congregation might have a certain and constant norm at hand in expediting this most serious matter, we have taken care to describe in detail by an appropriate Instruction the method to be followed in this matter; in which, besides what we have established concerning the most careful inquiry to be conducted regarding the faith, life, morals, and prudence of those to be promoted, we have restored to full force the examination on doctrine which we prescribe to be undertaken entirely by those to be promoted, taking into account the prescriptions of St. Charles Borromaeus in the Provincial Council of Milan I, part 2. And so that all these things may be fully accomplished by the Supreme Congregation of the Holy Office itself, we finally command those to whom it pertains that the vacancy of Episcopal Sees, as excepted above, be notified to it in the future by letters given to its Cardinal Secretary as soon as possible and in the proper manner.
6 These things we decree, declare, and sanction, notwithstanding anything to the contrary.
7 Given at Rome at St. Peter's on 17 December 1903, in the first year of our Pontificate.
