CXLI.
The prohibition of duels from the Council of Trent is extended to duels committed privately.
Gregory, bishop, servant of the servants of God, for perpetual memory of the matter.

1 In order to eliminate the detestable custom of duels, the Council of Trent prohibited excommunication and other most grave penalties against those granting place for single combat, and likewise decreed salutarily concerning those fighting, as well as seconds, advisers, persuaders and spectators: but, with the wickedness of men increasing, there are not lacking criminals who do not hesitate to execute privately what is prohibited publicly, while thinking they are able to evade the aforesaid penalties in this manner.

2 § 1. We, considering that it is necessary to provide more fully and more thoroughly for the restraint of these things, and taking into account that private dueling is no less bloody and harmful to soul and body than that which is perpetrated publicly, by apostolic authority decree that all those who by agreement, at a fixed time and in a place agreed upon, have committed single combat, even if no seconds and associates were called to it, nor security of place observed, nor any challenging letters or notification documents preceded, are bound by all the censures and penalties proposed by the said council, just as if they had engaged in single combat by public and customary abuse. We also wish that the lords of places, if they permit such agreed combat, or, insofar as it lies in them, do not prohibit it, and all those commanding that it be done, instigating, giving aid, counsel or favor, knowingly supplying horses, arms, money, provisions and other subsidies, or by arrangement presenting themselves as spectators or associates in any way, be subject to the same censures and penalties, even if those who proceeded to the designated place to fight were prevented and did not commit the fight, if it did not depend on themselves that it was not committed.

3 § 2. Notwithstanding privileges, immunities and exemptions and all other things contrary hereto whatsoever.

4 § 3. Our constitutions and other apostolic constitutions disposing of this matter shall remain firm and endure in their force. Given at Rome at St. Peter's, in the year of the Lord's Incarnation one thousand five hundred eighty-two, on the nones of December, in the eleventh year of our pontificate.

5 Given on 5 December 1582, pontificate year xi.
