SULLE FACOLTÀ QUINQUENNALI DEGLI ORDINARI

1 Dopo l'istruzione data e la norma stabilita per la concessione delle facoltà quinquennali, molti Vescovi, sia singolarmente che insieme, hanno insistentemente supplicato Noi affinché non fosse mutato l'uso già invalso e antico di ottenere queste facoltà mediante un unico foglio stampato e distribuito da un solo Ufficio. Dicevano infatti che era loro gravoso ricorrere a tanti Uffici, cosa che non potevano fare se non per mezzo di procuratori e non senza inconvenienti e spese. Poiché tutte queste cose ci sono parse degne di considerazione, per compiacere ai Vescovi e per rendere loro più facile l'amministrazione delle loro Chiese, con la presente Lettera motu proprio e con certa scienza stabiliamo e decretiamo che in avvenire le facoltà quinquennali, entro i limiti prefissati e secondo le formule presentate il 17 marzo 1922, siano concesse da una sola Sacra Congregazione, presso la quale tutti i Vescovi, non soggetti alla giurisdizione né della Sacra Congregazione di Propaganda Fide né della Sacra Congregazione per la Chiesa Orientale, sono tenuti a presentare le loro relazioni diocesane, cioè dalla Sacra Congregazione Concistoriale. I ministri della Sacra Congregazione Concistoriale, almeno prima dell'inizio di ogni quinquennio, richiederanno a tutti gli Uffici della Santa Sede se nelle «facoltà quinquennali» debba farsi alcuna modifica, e la introdurranno esattamente nelle formule che saranno poi distribuite. Le presenti Lettere avranno valore, nonostante qualsiasi cosa contraria, anche se degna di particolare menzione.

Gravamen enim esse sibi dicebant tot Officia adire, idque facere non posse nisi ope procuratorum et non sine incommodis atque dispendiis. Quae quidem omnia quum Nobis visa sint digna consideratione, ad gratificandum Episcopis et ad faciliorem ipsis reddendam suarum Ecclesiarum administrationem, praesentibus Litteris motu proprio et certa scientia statuimus et decernimus, ut in posterum facultates quinquennales, intra limites praefinitos et sub formulis exhibitis die 17 martii 1922, ab una Sacra Congregatione tribuantur, apud quam omnes Episcopi, non obnoxii iurisdictioni sive Sacrae Congregationis de Propaganda Fide, sive Sacrae Congregationis pro Ecclesia Orientali, relationes suas dioecesanas deferre tenentur, hoc est a Sacra Congregatione Consistoriali. Ministri autem Sacrae Congregationis Consistorialis, saltem ante initium cuiuscumque quinquennii, a singulis S. ON THE QUINQUENNIAL FACULTIES OF ORDINARIES

1 Following the instruction issued and the norm established for the granting of quinquennial faculties, many Bishops, both individually and collectively, have earnestly besought Us that the already customary and long-standing practice of obtaining these faculties by means of a single printed sheet distributed by one Office should not be changed. For they said it was a burden to them to have to approach so many Offices, and this they could not do except through the aid of procurators and not without inconvenience and expense. Since all these matters have seemed to Us worthy of consideration, in order to gratify the Bishops and to render the administration of their own Churches easier for them, by these present Letters issued motu proprio and with certain knowledge, We establish and decree that henceforth quinquennial faculties, within the limits prescribed and under the formulas set forth on 17 March 1922, shall be granted by one Sacred Congregation, to which all Bishops, not subject to the jurisdiction either of the Sacred Congregation for the Propagation of the Faith or of the Sacred Congregation for the Oriental Church, are bound to submit their diocesan reports, that is, by the Sacred Congregation of the Consistory. Moreover, the officials of the Sacred Congregation of the Consistory shall require from each Office of the Holy See, at least before the beginning of each quinquennium, whether any change is to be made in the "quinquennial faculties," and they shall introduce it precisely into the formulas which are then to be distributed. These present Letters shall have force, all things to the contrary notwithstanding, even those worthy of special mention.
