Praedecessores Nostri

Cogitent animoque perpendant, vacante Apostolica Sede, tunc maxime nutare Ecclcsiae statum; nam si gregi pastoris cura defuerit, faciec laqueos insidiatoris occurrit 2(2).

25 7. - Pariter opportune Sacri Palatii Apostolici Praefectus moneat Sacri Collegii Cardinalem Decanum, qui collegas ad Vaticanas Aedes advocet.

27 9. - Statim ac Saneta Sedes vacaverit, illico Apostolici Palatii portae claudantur. Nemo ingredi poterit nisi ex venia, Cardinalis Camerarii. Verum novendialibus peractis, exterior accessus ad Musses et Bibliothecam iterum patest, ut omnes es loca, visitare possixrt, veluti huc usque factum est: claudatum tamen si S. Sedis hostes hac concessione uti velint tamquam praetextu quo sibi aperiant aditum in alias Aedium Vaticanarum partes.

1 Constitution of Leo XIII, Pope, Praedecessores Nostri with appended Instruction, 24 May 1882.

2 Our Predecessors, in fulfillment of the office of the supreme Apostolate, with solicitous care and singular study continually provided that the elections of Roman Pontiffs, upon which the peace, unity and state of the Church so greatly depend, should take place in an orderly and regular manner; and for the various circumstances of the times, in order that these elections might be brought to completion swiftly, freely and expeditiously, they wisely discovered and decreed many provisions. This solicitude and their vigilant care shone forth especially when the movements of wars or the disturbance of the order of public affairs raised suspicion, lest the sacred assemblies which ought to be held for the election of a Roman Pontiff should either be deprived of liberty by open force, or the election should be disrupted in some other way, or delayed, or impediments to its completion should be placed in its path. Indeed, at such times it seemed fitting and was judged necessary to meet the impending evil with extraordinary remedies, which the gravity of circumstances more strongly urged should be employed, so that dangers might be averted by which the peace and unity of the Church itself was brought into jeopardy. Monuments of this particular solicitude are supplied especially by the Roman Pontiffs who from the previous century have held the helm of the Church in so miserable a state of affairs and disturbance, by which this Apostolic See in particular has been assailed, both by the irruption of hostile forces and by the movements of internal seditions, and also by the usurpation of civil principality, which, God so providing, was established for the free and independent spiritual governance of the Church; at which time the Cardinals of the Holy Roman Church were either driven from the City or transported to various places; and the Roman Pontiffs themselves, with impious audacity, were torn from their own see, driven into exile, or even thrust into and held in prison. For although they were tossed about by so many and such great waves of tempests, they nevertheless held nothing more dear than to place the election of a future Pontiff in safety, both by opportunely derogating from those things which had been sanctioned in the Constitutions of the Roman Pontiffs or introduced by custom in this matter, and by wisely establishing other provisions according to the circumstances, by which the election might be expedited and completed more swiftly and easily.

3 But truly, just as Our Predecessors for their own age, so We ourselves, indeed even more so, feel ourselves bound and obligated by duty to provide for the certain and expedited election of Our Successor, inasmuch as we perceive more severe tempests raging against the Church of Christ and experience daily more acute efforts and assaults of enemies against this Holy See; and the more we see all things turned upside down and the public order of affairs disturbed, so that the mind remains anxious and the fearful spirit uncertain what the future times may bring. Although, therefore, trusting in the promises of God, whose aid we never cease to implore in the humility of Our heart, we are sustained by certain hope that even in the present crisis He Himself will be present to His Church, the Spouse of Christ, with His almighty protection; nevertheless, considering on the one hand the fleeting and unstable flow of human life, and on the other hand the manifold circumstances which either may intervene in the election of Our Successor or may cause delay to it, whether it should happen that We close Our final day here in Rome in the same condition in which we now find ourselves, constituted under hostile domination and hindered on all sides by innumerable snares; or whether both We and the Sacred College of Cardinals should experience and endure still graver trials; or whether finally We should be forced to take the path of exile, and there God should call Us from the hardships of this mortal life to eternal peace: We have judged it fitting and necessary to establish those things which, according to the variety of cases which it has been possible to forestall by human counsel, ought to be observed in the election of Our Successor. Adhering therefore to the footsteps of Our Predecessors, having first implored heavenly light and sought the careful counsel of a special Congregation of the Cardinals of the Holy Roman Church, with certain knowledge and by Our own motion from the fullness of Apostolic power, We decree the following.

4 We declare and ordain that the right, long since established and prescribed, of electing the Roman Pontiff, Our Successor, belongs uniquely and exclusively to the Cardinals of the Holy Roman Church, and, insofar as it is necessary, We approve and confirm it by this Our Constitution, utterly excluding and removing any intervention whatsoever of any other ecclesiastical dignity, or of any lay power of whatever grade and order, under any pretext or colour sought, even for the purpose of supplying the office and place of the Cardinals, in the event that they, scattered throughout the world or deported or hindered by any other obstacle whatsoever, should be unable to hold the assembly for the canonical election of Our Successor. In this matter We confirm and renew the Constitution of Our Predecessor Pius IX of blessed memory, which begins Cum Romanis Pontificibus, given on 4 December 1869. But in order that still greater precaution be taken, lest anyone foreign to the election should interpose himself, even externally only, and meddle therein, We specifically derogate from the Constitutions of Gregory X in the Council of Lyons Ubi periculum, of Clement V in the Council of Vienne Ne Romani, and of Pius IV, in so far as they grant to civil or political magistrates of the city in which the election of the Roman Pontiff is to be celebrated, or even to Prelates, Rectors, Officials of the City, Ambassadors of Princes, or any others whatsoever, the power to make prescriptions for the aforesaid election to be observed.

5 We also derogate from those rules and prescriptions which have been fixed by the Apostolic Constitutions of the Roman Pontiffs, even those issued in General Councils, or otherwise worthy of special mention, concerning the time and place of the election, concerning the Conclave and its closure and other matters of lesser importance, such as the solemnities and ceremonies which have been customary to employ, namely concerning the guarding of the Conclave, concerning the provision of things pertaining to food and other necessities of life, likewise concerning the qualities and number of persons who ought to be admitted into the Conclave, which however shall not exceed the customary number, and other such matters; whether all or some of these ought to be observed or omitted shall be determined by the vote of the greater part of the assembled Cardinals. It shall likewise be within the power of the greater part of the assembled Cardinals to determine whether the election should be celebrated without any delay and before the ninth day from Our death, or whether, if a disturbance of the public order or other grave cause should intervene, the time of the assembly should be postponed to a later date; in which latter case the same Cardinals shall have equal power to modify or even relax the laws concerning the closure of the Conclave and the other prescriptions mentioned above. Wherefore We absolve all the Cardinals from the obligation of the oath by which they have promised to observe the aforesaid Constitutions of Our Predecessors, and We declare that they shall be absolved, not only in the aforesaid prescriptions of those Constitutions concerning the time and place of the assembly and the Conclave and its closure, but also in other ceremonies and solemnities of lesser importance, if the observance of any of them might delay the outcome. In other matters, however, which do not hinder the speedy election of the new Pontiff, which We greatly desire, and especially in those matters with a clause rendering the election otherwise made null and void, namely except in those from which We have derogated, We command that the said Constitutions be observed.

6 Although, however, We have granted such ample faculty to the College of Cardinals, especially regarding the time and place of the election of the future Roman Pontiff, We nevertheless declare that nothing has been changed, either as regards the general sanction of the canons, that nothing be innovated while the See is vacant, or as regards the special Constitutions by which it has been provided that such power and jurisdiction as belonged to the Pontiff during his lifetime shall not pass to the College of Cardinals; that the College shall not be able to dispose of the rights of the Apostolic See and the Roman Church in any way whatsoever, nor attempt to detract from the same rights either directly or indirectly through the appearance of connivance or through dissimulation of acts perpetrated against those rights; rather, it ought with all its strength to guard and defend the same.

7 Whereas, however, for the purpose of reaching the proposed end more expeditiously, We permit the material closure of the Conclave or place of election to be relaxed, We nevertheless in no way relax the obligation of maintaining secrecy in all matters pertaining to the election of the Roman Pontiff, and in those things which are done in the Conclave or in the place of election. Accordingly, in the manner and form prescribed, under the penalties imposed by the Constitutions of Our Predecessors, We again command and ordain that this secrecy be most carefully observed and be caused to be observed by others, and indeed all the more carefully and strictly, the more grave the difficulty of the times proves to be.

8 Moreover, in whatever place and under whatever circumstances the election may take place, it shall be legitimate and valid in no other way than if the number of Cardinals who exist at that time exceeds by at least one; yet if this number should afterwards be diminished, whether because death overtakes one of the Cardinals who have come to the conclave, or illness oppresses him, or for any other cause whatsoever, this shall in no way be an impediment to prevent the remaining Cardinals from continuing the work begun and from legitimately and validly completing the election. We decree that the legitimately elected successor of Blessed Peter and Our successor and true Roman Pontiff shall be recognized and held to be the one upon whom two-thirds of the assembled Cardinals have agreed by secret ballot in the scrutiny, or in the scrutiny and accessus; but if the election takes place by inspiration or by compromise, it must be completed by the Cardinals, as above, assembled, with the customary canonical form being observed.

9 Having established universally all things which ought to be observed in the election of Our successor, wherever and under whatever circumstances it may be celebrated, We have deemed it necessary to add certain specific provisions which ought to be observed according to the variety of cases that may occur. We therefore command and decree that if it should happen that We end Our life in this City of Rome, the Cardinals who shall then be present in the Curia, as soon as We shall have closed Our final day, before even the funeral rites themselves are performed for the benefit of Our soul (without waiting for the prescribed period of ten days for other Cardinals, even those absent as Legates at large or for any other cause, even with Our permission or mandate), having seriously considered the circumstances of this City, of affairs and of times, shall deliberate whether the conclave for the election of a new Pontiff ought to be held in this same City or outside it. That deliberation, however, shall have full effect in which the greater part of the Cardinals then present shall have consented. But if it should seem good to the assembled Cardinals, moreover, to bring the election of a new Pontiff to completion without any intervening delay, with the body present, as it is said, it shall be free to complete the election of the new Pontiff even in the very first assembly, the things which We have prescribed above being observed. Furthermore, in order that all occasion of delay and disturbance may be removed, We prescribe that as regards the Pontifical funeral rites the customary apparatus introduced by the Constitutions and custom be omitted, and that they be performed by the Cardinals with modest rite and form in the Chapel of the Vatican Palace if it should happen that We close Our final day there. We wish, however, absolutely and command that if the Cardinals shall have decided that the conclave for the election is to be held here in the City or elsewhere in Italy, that in the case of any injury to the place of the conclave or to the persons therein inflicted, which in the judgment of the greater part of the assembled Cardinals takes away freedom from the election, all election begun shall immediately be broken off, the conclave dissolved, and transferred to a safer seat outside Italy. Finally, considering in mind the afflicted state into which the affairs of the Holy See have been brought on account of hostile domination, under which the civil principate of the same and this City of Rome itself is found to be constituted, lest during the time of vacancy the dignity and interests of this Holy See suffer further detriment, and also in order that the Sacred College of Cardinals may have a certain way by which to extricate itself from the difficulties and obstacles which circumstances may bring, We have taken care to establish by a special Instruction, which We append to this Constitution, a norm and rule, to the prescription of which the Cardinals ought to conform themselves, as circumstances may require.

10 Since, however, the iniquity of the times is such that it is rightly to be feared lest the growing oppression and audacity of our enemies day by day, or the state of public affairs falling into worse condition, may compel Us to be exiled from this City, or even that We be carried away by force, and that death may overtake Us outside the Roman Curia; We decree and command that in this case, from that place outside the Curia where Almighty God may will Us to depart from this life, whatever Cardinal may be present, or if there be more than one, the more worthy of them, namely not he who is prior by creation, but he who precedes others by right, or, all of them being absent, the Apostolic Nuncio and, in his default, the Ordinary of the place or a Prelate, or any other person invested with ecclesiastical dignity, shall as quickly as possible inform the Dean of the Sacred College of Cardinals and others of whose see he is aware of the death of the Pontiff, so that they may immediately prepare themselves to hold the conclave. The Dean, or, if he be hindered, the Cardinal of greater dignity, as soon as he shall have received such notice or in any other way shall have certainly ascertained the vacancy of the Apostolic See, together with three senior Cardinals from each Order and with the Cardinal Camerlengo of the Holy Roman Church, if they shall be present together, or, if they be absent, with such other Cardinals as may be available, or finally he himself alone, if all the rest be entirely absent, shall choose a place in some region, whatever it may be, which shall seem more opportune for holding the conclave. Thence, with no delay interposed, the same Cardinal Dean, or, if he be hindered, another Cardinal as aforesaid, shall notify the other Cardinals of the vacancy of the Apostolic See, and shall summon them to the election of the new Pontiff, and shall inform them of the place in which it has been decided that it shall be held. Moreover, We command and enjoin all Cardinals in virtue of holy obedience that, unless they be detained by legitimate impediment, they obey the letters of convocation and immediately betake themselves to the place designated to them for completing the election of the Pontiff. Furthermore, in whatever place the Cardinals, as aforesaid, shall have assembled, the election of the new Pontiff shall be held to be altogether legitimate, canonical and valid, provided that those things which are required for effecting a valid election shall have been fulfilled, except those to which We have expressly made derogation. All which things, proportion being observed, ought also to be accommodated and transferred to the case in which, although it should happen that We here in Rome come to our last day, yet the Sacred College of Cardinals, with seditions and public disturbances growing stronger, and the tumult of enemies' oppression and persecutions violently dispersing them hither and thither throughout the world, the conclave for the election of the new Pontiff cannot be held in Rome.

11 Since, however, Christ by a wonderful dispensation directed the Blessed Peter to Rome, where, as he shone forth sublime in the strength of his doctrine, so he rests adorned with the glorious shedding of his blood 1, We command and enjoin that the Cardinals in the first general assembly which they shall hold for the election of the new Pontiff shall pledge themselves by oath that they will bring all study and all diligence to bear so that the Pontifical See may be restored to Rome, as soon as the obstacles and impediments which may have compelled its transfer shall have been removed.

12 Although We are raised to good hope that Our Successor may enjoy better times and sit long in this supreme Chair of Peter, yet that We may also provide for the contrary event, by Our own motion and from the fullness of Apostolic power, We extend all things which in these letters are sanctioned and constituted for the conclave to be held for the first time after Our death, and in like manner We decree for another election to be completed after the death of Our Successor, if namely, no new law being issued concerning these matters, Our Successor shall have died.

13 If, however, any doubts should arise concerning the meaning of the prescriptions which are contained in this Our Constitution, or even whether, or in what manner the same ought to be reduced to use and practice, or concerning any other chapter of this Our Constitution, We decree and ordain that the power to pronounce judgment on these matters rests solely with the Sacred College of Cardinals; for which purpose We grant to the Cardinals themselves full faculty by which they may interpret this Our Constitution and declare doubts. In which matter, as in the rest concerning which it may happen to deliberate according to the course of this Our Constitution, except the election act itself, it shall be altogether sufficient if the greater part of the assembled Cardinals, as has been declared above, shall consent to the same opinion. We command, however, that these Apostolic Letters, witnesses of Our will, as soon as possible after Our death, and, if circumstances permit, even on the very day of Our death, shall be read in full in the first general assembly of the present Cardinals to be convened forthwith and outside the ordinary order. This, however, shall be no impediment to the reading of the same being carried out beforehand, if time permit and no other difficulties intervene, in the Assembly of the Heads of Orders, when this shall take place.

14 We meanwhile, commending Our soul to God and the Father through His only-begotten Son Jesus Christ the redeemer of mankind, that He may receive it snatched from the troubles of this life into the heavenly homeland, beseech and earnestly entreat Our Venerable Brethren, the Cardinals of the Holy Roman Church, who, when We are released from the body, survive Us, through the bowels of the mercy of Jesus Christ, that by mutual harmony of minds and agreement of wills they direct all their studies and all their counsels to this end, that the Ship of Peter, tossed about by so many and such great waves, may not long lack a helmsman. Let them think and weigh in their minds that when the Apostolic See is vacant, then especially does the state of the Church waver; for if the care of a shepherd fail the flock, it shall meet the snares of the deceiver 2(2). Let them think that scarcely anything more desirable and opportune can befall the enemies of the Church than that the election of the Roman Pontiff be protracted for a long time, or even be disturbed. For if the Pope is called into question, the Bishopric of the City will already appear to be wavering, not the Bishop 3(3). Again We beseech and earnestly entreat Our Brethren the Cardinals, that moved by no inclination of mind or aversion, inclined by no one's favor or compliance, not moved by the intercession of the powerful in the world, but having solely the glory of God and the good of the Church before their eyes, they direct their votes to him whom they shall perceive to excel in excellence of mind and zeal for religion, and who shall be able to steer the helm of the mystical Ship with strength and wisdom and to break the assaults of impending enemies; otherwise let them know that they shall suffer the penalties of the most strict judgment of God, if through their fault and negligence in such great peril they neglect to provide for the afflicted state of the Church by a speedy and excellent election of a new Pontiff. And to the Elect, Our heir and Successor, to whom We pray with all the affection of Our heart from the Lord that he may occupy Our place more happily, We ask that he not be deterred by the difficulty of the office from undertaking it, but rather humbly submit himself to the counsel of the divine will; for God who imposes the burden will Himself also put His hand beneath it, that he may not be unequal to bearing it; for He who is the author of the burden is Himself the helper of the administration, and lest the weak one succumb under the magnitude of grace, He will give strength who bestowed dignity 4(4).

15 These things therefore being gravely considered in view of the perils of Our times and the whole matter at issue, and being also moved by the examples of Our Predecessors Pius VI, Pius VII, Gregory XVI and Pius IX, We establish, prescribe, grant and decree these present Letters and whatever is contained in them, even from the fact that anyone having any right or interest in the foregoing, or pretending to have it, has in no way consented to them, nor has been called to or heard concerning them, or from any other causes whatsoever, can in no way be impugned, but these same shall always and perpetually be firm, valid and efficacious and shall produce and obtain their full and complete effects and shall be favored by those to whom it pertains and shall pertain for the time being, and shall be respectively and inviolably observed by them, and shall be null and void if otherwise be attempted concerning these things by anyone whatsoever with any authority, knowingly or unknowingly. Notwithstanding, insofar as it may be necessary, without prejudice to acquired right, and other Constitutions and Apostolic ordinances issued concerning the election of the Roman Pontiff as much by Alexander III, Gregory X, Clement V, Pius IV, Gregory XV, Clement XII, and other Roman Pontiffs Our Predecessors, as also by Us, whose tenor We have present, as fully and sufficiently and word for word inserted, We most broadly and fully derogate from all and each of these, insofar as they concern the foregoing effect only, those remaining in their value as to the rest contained in them, and from all other things also worthy of individual and most special mention and derogation, whatever they may be to the contrary. We further will that transumpts or copies even printed of these present Letters, subscribed by the hand of some Apostolic Notary and furnished with a seal, shall have the same force as these present themselves would have if they were exhibited or shown. Let no man therefore be permitted to infringe this page of Our permission, dispensation, faculty, ordinance, decree, mandate, will, derogation, or to dare to act contrary to it. If anyone, however, shall presume to attempt this, let him know that he shall incur the indignation of Almighty God and of the Blessed Apostles Peter and Paul.

16 Given at Rome at St. Peter's in the year of the Lord's Incarnation 1882 on 24 May in the fifth year of Our Pontificate.

17 LEO PP. XIII

18 INSTRUCTION

19 To be observed by the Sacred College of Cardinals when the Apostolic See is vacant as long as the extraordinary condition in which it now finds itself shall endure. 1. When the Apostolic See is vacant, the Sacred College of Cardinals shall conduct itself in the same manner as it showed itself on that very day when Rome was occupied. Wherefore a) the Cardinals, whether individually or collectively, shall abstain from all communication with any civil authority: b) they shall dress and conduct themselves in private manner, as has been observed by them hitherto: c) they shall not publicly perform the sacred duties which are of their dignity.

20 2. - The Prefect of the Sacred Apostolic Palace shall opportunely admonish the Cardinal Camerlengo of the Holy Roman Church that he himself proceed to the Vatican Palace.

21 3. - The Cardinal Camerlengo, as soon as he shall have received word of the death of the Pontiff from the same Prefect of the Sacred Apostolic Palace, shall go there to take possession of the Palace itself by an act of supreme authority, and shall never abandon it, and there shall discharge all the duties of his office.

22 4. - Since the Cardinal Camerlengo is the sole authority which can legitimately ascertain the death of the Pontiff, he shall draw up an authentic attestation of the death itself.

23 5. - Seals shall be affixed to the private residences of the deceased Pontiff solely by the Cardinal Camerlengo, and this for the purpose of preserving the rights both of the Holy See and of any private person. Any violation of this precept shall be regarded as violence inflicted against the liberty of the Sacred College and the supreme authority of the Holy Roman Church.

24 6. The same Cardinal Camerlengo shall make known the death of the Pontiff to the Cardinal Vicar, so that he may inform the Roman People of the matter by public edict, in which the same Cardinal Vicar shall declare that the matter has been communicated to him by legitimate authority, namely by the Cardinal Camerlengo of the Holy Roman Church, and that the funeral rites are to be performed in the Vatican Basilica by the Chapter of St. Peter.

25 7. - Likewise the Prefect of the Sacred Apostolic Palace shall opportunely admonish the Dean of the Sacred College of Cardinals, who shall summon his colleagues to the Vatican Palace.

26 8. - The Cardinal Dean in this summons, which shall be expressly issued from the Vatican Palace, shall make known to the Sacred College that they are to come in accordance with the prescriptions of the first article of these rules.

27 9. - As soon as the Holy See shall be vacant, the gates of the Apostolic Palace shall immediately be closed. No one shall be able to enter except by permission of the Cardinal Camerlengo. However, after the nine days of mourning have been completed, external access to the Museums and Library may again be permitted, so that all may visit those places, as has been done hitherto: yet it shall be closed if the enemies of the Holy See wish to use this concession as a pretext to open for themselves an entrance into other parts of the Vatican Palace.

28 10. - If anyone should approach the gates of the Vatican Palace armed himself or with a band of men equipped with arms, with the intention of invading the Sacred Palace, the gates shall not be opened, but rather shall be allowed to be broken down by the invader.

29 11. - If it should happen that someone sent by the Government or by the Municipality should approach the Sacred Palace, the guard who shall then be on duty shall ask him who he is and for what reason he has come; the response being received shall be reported to the Cardinal Camerlengo, who shall act according to the circumstances of the time.

30 12. - If any authority, whether political or civil, should wish to speak with the Cardinal Dean or the Cardinal Camerlengo, he shall satisfy the petitioner. However, he shall receive that person in a place already expressly designated for the matter; the place, however, shall be distinct from the other residences of the Cardinals, and situated in no part of the Apostolic Palace where he is accustomed to receive all others to whom by any title the right belongs to be admitted to his presence. Access to the aforesaid place shall be by the external way of the Museums. But the Camerlengo or any other shall refuse to receive whoever should perhaps have declared that he wishes to enter the Apostolic Palace with the intention of performing acts of supreme authority and power, or to take possession of any part of the Vatican Palace, or in any way to violate the rights of the Holy See.

31 13. - If it should happen that the Italian Government should offer its services and assistance to the Sacred College, it must be distinguished whether this offer of assistance is made in writing or rather by word of mouth, namely by the approach of some legate sent by the same Government, to the Cardinal Dean or to the Cardinal Camerlengo.

32 In the former case, the Cardinal Dean shall make no response to the aforesaid communication, but shall request by appropriate letters the diplomatic body of Legates who are accredited to the Apostolic See to make known to the Government now occupying Rome that a) the Sacred College, mindful of the oaths by which it is bound, can introduce no change into that condition of affairs which the deceased Pontiff left and which the Sacred College itself must transmit intact to his Successor. b) Therefore the Sacred College can have no communication with the Government with which the deceased Pontiff had no communication. c) Moreover, as regards those matters which concern the interior of the Sacred Palace, no assistance is needed: but as regards those matters which pertain to external tranquility, since the Sacred College does not govern the City, it can make no response.

33 In the latter case, however, if someone sent by the Italian Government should request to speak with the Cardinal Camerlengo or with the Cardinal Dean, he shall receive him in the same manner as shown above in article 12, and shall take the occasion of the offer to make the same declarations and protests, of which mention was made above in the former case, where the letters of protest were to be directed to the Diplomatic Body.

34 In any case, however, it shall not be permitted for any other member of the Sacred College to receive these visits and communications in the name of those who now govern, but shall report them to the Cardinals of the Order or to the Cardinal Camerlengo: and this shall be done with the intention that in these difficult circumstances of affairs they may preserve intact the unity of authority, action, and direction.

35 14. - If acts of violence should occur outside with the intention of stirring up disturbances and thereby taking pretexts for penetrating the Holy Palace, the Sacred College shall adopt necessary precautions and shall inform the Diplomatic Corps of the matter, so that tranquility may be restored and liberty returned to the Cardinals.

36 15. - If anyone should attempt to seize the Library, the Museums, the Archives, or any other part of the Holy Palace, the doors shall be closed, they shall be allowed to be overturned, and with a proper protest issued by the Cardinal Camerlengo, the Diplomatic Corps shall be informed of the matter by solemn letters.

37 16. - Proper protests shall likewise be issued if anyone should attempt to disarm the guards of the Holy Palace with weapons, and to place Italian soldiers in their place.

38 17. - All Congregations, both particular ones of the Heads of the Order and general ones of the entire Sacred College, shall be held in the Vatican Palace.

39 18. - The Cardinals gathered together in order to hold the first Congregation shall appropriately consult regarding the celebration of the Conclave.

40 19. - The Sacred College, having regard to the places which shall be available and the expenses incurred in the smallest possible measure, shall deliberate concerning the admission of Conclavists, and likewise concerning the number of Masters of Ceremonies, servants, and others who are accustomed to be admitted to the Conclave.

41 20. - When the prescribed oaths shall have been taken by the Sacred College, then it shall repeat all the protests issued by the deceased Pontiff for the protection of the rights, laws, and goods of the Holy See and the Church, yet shall not omit to inform the Diplomatic Corps of the matter.

42 21. - The death of the Pontiff shall be announced both to the Pontifical Legates and to the Cardinals who were not in Rome when the Pontiff himself died, immediately by telegram, to which, after the death has been signified, these words shall be added: the rest by letters. After the first Congregation has been held, the same notice shall be given again by registered letters, sealed, so that the place and time may be signified to them in which the Conclave shall be held.

43 22. - In the first congregation, which the Heads of the Order shall hold with the Cardinal Camerlengo, all communications shall be sent in the customary manner to the Governments, that is, they shall be sent to all Governments, even to those with which the Holy See perhaps does not have diplomatic communications, even if these communications have never taken place or have been interrupted, provided that these Governments have already been recognized by the deceased Supreme Pontiff. By this way and method it shall be prevented that notice be given by the Apostolic See to all those Princes whom it does not now properly recognize.

44 23. - Since nothing is to be changed by the Sacred College (as was established above in the first article of these Instructions) during the vacancy of the Apostolic See in that condition of affairs which the dying Pontiff left behind, it shall in no way be permitted to receive the legates of those States which have broken off diplomatic relations with the Apostolic See, even if these States should seek to be received.

45 24. - The body of the deceased Pontiff shall be clothed in pontifical vestments as quickly as possible, and shall be carried privately by the inner staircase to the Basilica of St. Peter in the chapel of the Most Holy Sacrament. There, after absolution has been given, it shall be exposed, with four members of the Pontifical Noble Guard watching over the body, and the railing closed.

46 25. - The Sacred College, unless it shall have been otherwise established by particular pontifical dispositions concerning the place of burial and the manner of burial, shall act according to the appropriate norms and customs which have always been observed strictly, insofar as the conditions of the times permit. The burial shall take place with the Cardinals present, the doors being closed.

47 26. - Besides the funeral rites which shall be performed publicly in the Basilica of St. Peter, the Cardinals shall perform others privately in the Sistine Chapel, with the assembly of Prelates and those who by right are to be invited to the pontifical and cardinal chapels.

48 27. - The acts to be drawn up during the vacancy of the Apostolic See shall be recorded in writing together by one Clerk of the Chamber (who shall then also exercise the office of Apostolic Protonotary) and the Notary of the Apostolic Chamber.

49 28. - It shall be the duty of the Cardinal Camerlengo to introduce all those innovations which shall be necessary for the particular situation, so that he may fittingly and appropriately preserve and protect certain parts of the administration which are accustomed to be entrusted to individual Prelates of the Chamber.

50 29. - Likewise it shall be the care of the Cardinal Camerlengo that food be provided and served to the Cardinals in the very buildings of the Vatican.

51 The same Cardinal shall take care that on this and every other occasion, which concerns communications with persons not belonging to the Conclave, the most rigorous sanctions which have been established so that no one from the Conclave communicates with outsiders shall in no way ever be broken.

52 30. - If in the first General Congregation the Sacred College shall have determined that the Conclave be celebrated outside Italy, this shall be announced immediately to the Cardinals who are not in the Curia.

53 31. - In the same notice a certain place and time at which they shall come together shall be signified.

54 32. - Likewise the Cardinals, Heads of the Order, shall announce the matter to the Diplomatic Corps and shall invite it to follow the Sacred College going to the place which the Sacred College itself shall have chosen: when it shall have arrived there, it shall employ those methods and counsels in acting which it shall have judged more suitable and useful.
