Bull on the regulation of auditors and notaries of the Roman Curia
to be issued: — 37. Those who shall be bound to observe the aforesaid. — 38. These laws to be registered in the chancery: — 39. To be read there every year. — 40. Clauses. John bishop servant of the servants of God, for perpetual remembrance of the matter.
1 The reason of law demands, the duty of honesty requires, the consideration of piety persuades, that in directing all judgments and administering justice, there should be required in those presiding, diligent vigilance, graceful modesty, purity of heart, cleanness of hands and soundness of counsel. In persons also appointed to draw up judicial acts, industrious sufficiency, proven capability, honesty of life, becoming dignity should be commended, moderate exaction of fees, compassion toward the poor should be rightly required. Therefore in the Roman Curia, the common fatherland indeed, where the supreme tribunal of judgment divinely established is located, and where the light and form of justice excel and shine forth, these things must necessarily be found. Wherefore we, who, although unworthy, are successors of Blessed Peter, and exercise the office of Christ upon earth, desiring that in the Apostolic Palace in the audience of causes, and in the persons appointed from time to time for the examination and drawing up of the same, there be maintained an ordered, fitting and salutary arrangement concerning the same causes' auditors, and their notaries writing in such causes, reasonable causes urging us, do by apostolic authority issue the statutes and ordinances which are particularly and serially noted in the present document, and we command that they be perpetually observed in all future times.
2 § 1. We therefore establish and ordain that auditors without cape and rochet shall not walk in public in the place where the Curia resides.
3 § 2. Likewise that the prelate auditors of the same causes of the Palace shall be more diligent than usual in hearing and deciding the causes committed and to be committed to them. § 3. Likewise that the aforesaid auditors shall come to the Palace at a good hour on each judicial day, and immediately after the ringing of the bell, which is rung at the hour of Terce in the cathedral church, shall begin to sit for hearing causes; and they shall not leave the said Palace until the parties have satisfied their terms before them.
4 § 4. Likewise that the same auditors shall observe only those feasts which hitherto the Auditors without cape and rochet ought to observe;
5 if they diligently.
6 in causes to be heard they persist.
7 on judicial days, they shall not follow the cardinals.
8 Let them receive nothing from anyone:
9 and let them keep the counsels of co-auditors under the penalties of the statutes.
10 In the year 1518 it is known that by mandate of our authority through the audience of our letters these same things were established to be observed; and that henceforth they shall not presume in any way to establish or observe other feasts or other days from themselves or otherwise; but on other days let them show themselves so prepared and diligent in exhibiting justice to the parties litigating before them, that from this they should merit to be commended.
11 § 5. Likewise that those of the same auditors who are familiars of our brothers the cardinals of the Holy Roman Church, on judicial days and hours in which causes shall be treated, shall not follow the same cardinals nor occupy themselves elsewhere, unless they be specially called by us or by the said cardinals, whose familiars, as is aforesaid, they are.
12 § 6. Likewise that auditors by themselves or through another or others shall receive nothing from the parties having causes before them, or from their notaries writing before them or others, for the same or in their name, neither thing, nor obligation or promise; nor even for their seal or for rubrics, in causes in which auditors are or have been appointed, or under any other pretext whatsoever: and that the counsels of co-auditors shall be kept secret until after sentence is promulgated; those acting contrary shall be suspended from entry into the same palace for one month. If however they fall again into the same fault, let them be deprived perpetually of their office of auditor of causes of the aforesaid palace.
13 § 7. Likewise that the aforesaid auditors, namely those present, immediately after the publication of the present ordinance, and those in the future before they are admitted to office, shall take an oath in the hands of the vice-chancellor of the Holy Roman Church, in our name and that of the same Church, in the form which follows, by these words:
14 § 8. I, N., auditor from this hour forward shall be faithful to Blessed Peter, the Holy Roman Church and to my lord our lord and his successors canonically entering. I shall not be in deed, counsel or consent, which the oath which each one of the Holy Roman Church.
15 vice-chancellor must take.
16 I will not lose or have captured any member or property of theirs; the counsel which through myself or through another messenger of mine or through letters has been entrusted to me, by sign, word or nod, with my knowledge, I will not disclose to anyone to their harm or prejudice: and I will likewise keep secret in this way those things which I shall have known ought to be secret, which I will knowingly make manifest to no person, concerning whom I believe it would displease him if I revealed it to him. If I shall know that harm to them is being plotted, I will prevent it, as far as I am able, lest it be done to them. If I am not able to prevent it through myself, I will take care to signify it to them through a messenger or letters, or to him through whom it may more quickly come to their knowledge. The Roman Papacy and the regalia of St. Peter and all the rights of the Roman Church, which it has everywhere, I will maintain with all my strength and defend. The business and offices committed or to be committed to me by the Lord Pope or by the Lord Vicar Chancellor of the Holy Roman Church, I will manage faithfully and will exercise diligently, and especially the office of auditor of the Sacred Palace, rendering justice to each one. Gifts or presents or tokens or obligation or promise concerning these, through myself or through another or others from the parties having cases before me or any of them, or from notaries deputed to write before me the acts of the said cases or others for the same or in their name, I will not accept; rather I will cause all my household and officials, with all the diligence I am able, to abstain. Nor also for my seal, nor for rubrications to be made in cases in which I am or shall be deputed as auditor, nor under any other pretext will I receive anything, nor will I permit it to be received from the aforesaid my officials or household members. I will also keep secret the counsels of my co-auditors, until sentence has been pronounced in the case. All and singular the aforesaid things I promise and swear to observe and keep without any deceit and fraud. So help me God, and the Holy Gospels of God.
17 § 9. We establish and ordain that the order of auditors of the same palace, from the time of his reception, the more senior shall begin first to collect the sentence before the other co-auditors: and the cases which he hears, if he be prepared for this, he shall place among the relations, as is the custom. And thus consequently the other successive auditors of the said Palace, according to the degree of their respective receptions, shall similarly refer; and the cases which they hear, they shall place in the relations, if they also be prepared for this. And that after one case has been placed in such relations, another shall be placed, until the parties have alleged what they wished to allege; nevertheless the auditors themselves are not bound to hear superfluous allegations.
18 § 10. Likewise, that no auditor of the said Palace shall pronounce any definitive sentence, whatever it may be or even if interlocutory, concerning the devolution of cases to be handled in the Roman Curia, if there has been controversy between the parties concerning the same devolution or concerning the admission or rejection of articles or concerning remission concerning the same articles or other proofs to be made outside the Curia, unless perhaps by consent of the parties there be remission or admission aforesaid; nor also concerning restitution or revocation of attempted or innovated matters, with litigation or appeal pending, or concerning appeals from an interlocutory or from a grievance interposed, or any other interlocutory concerning the matter in question, against one of the parties putting an end to the business, without public relation and counsel of co-auditors. Concerning other interlocutories, however, without public relation, with the counsel of the said co-auditors, he may proceed to their pronouncement, as it has been laudably observed in the Palace heretofore. Likewise, that the auditor making relation, having made relation to his co-auditors, shall diligently seek their counsels and, having their counsels, shall be bound to finish and terminate the said cases speedily.
19 § 11. Likewise, that each of the said auditors shall have notaries understanding, faithful to God and honest, so that the number of four notaries shall not be exceeded. Which four notaries indeed shall write through themselves and not through others, before the auditors themselves, in cases. Nor shall the said auditors commit to be written to another notary cases committed to them; nor shall any of the said auditors receive anyone as notary who is the notary of another auditor.
20 § 12. Item that the aforesaid auditors shall provide diligently that the said notaries shall not exceed in the reception of their salary, nor shall receive anything further, unless as it is described, fixed and also ordained. It is provided that if there be or have been any who on account of poverty are unable to redeem the acts for their case, the auditors shall compel the notaries writing in the same acts to restore gratis such a copy of the acts to the party, being unable to pay (as is aforesaid), if the poverty of that party appear notable to the auditor of that case. § 13. Item that none of the same auditors in causes which are in the said Palace, or are hoped to exist in brief, shall give counsel neither by himself nor by an interposed person to the parties, nor shall render any patronage, unless the causes were his own or of his relatives up to the third degree of consanguinity, or of his lords or servants, or of Churches in which he would be a beneficiary. And in the aforesaid last cases he shall by no means be admitted to the counsels of his co-auditors; and that he is bound to reveal this, if it existed hidden. Item that no auditor of the same shall receive a cause to be heard, if it be committed to him in which he gave counsel, but shall immediately remit it to the chancellery itself to be committed to another.
21 § 14. Item that the counsels of the same auditors, which are given in causes, shall be written by the notary of that cause in which such counsels are expended, and the secrets of the causes and of the same counsels, both by the auditors themselves of the said causes and by the notary writing in them shall be held under the seal of confidence.

24 § 16. Concerning the aforesaid notaries also of the same auditors writing in the causes committed to them, likewise establishing and ordaining we subjoin that they be diligent and attentive in the office of notary committed to them aforesaid, and that they faithfully and carefully write and exercise the aforesaid office, and that they receive nothing from the parties or from any other in their name, as is described below, fixed and also ordained. Those truly acting contrary shall be bound to restore double.
25 § 17. Item that none of the same notaries shall write in the same palace in causes before any auditor of the Palace, unless first by the vice-chancellor or another by his special mandate, he shall have been examined concerning sufficient literacy and writing for exercising such notarial office; and information concerning his life and conduct shall have been received, and he shall also have been approved by the same; and also an oath shall have been taken in the hand of the vice-chancellor in this form:
26 § 18. I, N., notary of N. auditor, shall carefully and faithfully exercise the office committed to me. From the parties having or about to have causes in which I am or shall be notary deputed, or from any of them, or from anyone whatsoever in their name by whatever colour or manner sought, I shall receive nothing beyond the taxation ordained by the Most Holy Lord, our Lord John XXII, Supreme Pontiff, upon this matter. I shall not procure any cause committed to me to be written, nor shall I heed any instance in this part. I shall not be a promoter or procurator in causes which are agitated before my auditor, or which it shall happen to be agitated. In the aforesaid causes in which I am or shall be, as is aforesaid, notary deputed, I shall write all judicial acts substantially in a manual or memorandum in the presence of my auditor and also of the parties, if they shall wish to wait for this, and after I shall have written them, I shall faithfully reduce them and the instruments and all other and singular things produced in the causes, where I shall be required by the auditor or parties, or any of them, into a register or cause them to be reduced, required by the same parties or any of them in individual successive terms; and I shall make a copy to the parties themselves, when it shall have been decreed by the auditor, without difficulty and any fraud whatsoever, saving my salary moderated by the same Lord Supreme Pontiff. I shall keep the secrets of the cause secret, and especially the counsels of the auditors and the sentence, until the same shall be pronounced. All and singular the aforesaid things I promise and swear to observe and keep, without any guile and fraud; so help me God, and these holy Gospels of God. § 19. Item we establish and also ordain that no notary of the same shall procure or apply instance in this part for any cause to be written committed to him, by himself or another. § 20. Item that the said notaries shall study to observe all modesty, honesty in all things.
27 their concubine, and if any of them is at present keeping some woman, he is bound to dismiss her. But if within eight days after the publication of this statute and ordinance, he has not dismissed her, he shall not resume the same or any other henceforth, and if thereafter he or others are found to be keeping any woman, they shall be perpetually deprived of the office of notary in the said palace. A notary of any auditor shall not henceforth hear or write in a case, or presume to do so, if either party of the said case in the audience of contradictory letters, or in the apostolic palace or Roman Curia is a procurator or promoter of business, or a pensioner in whatever manner he may be or exist. But if by ignorance an auditor should commit some case or cases to such a notary for writing, the notary shall immediately restore such case or commission into the hands of the said auditor. Doing otherwise, he shall be deprived for a year of the office of notary in the palace. § 24. Likewise, the aforesaid register of any case in which notaries are appointed, together with his manual and original documents, before they exhibit the register to the auditor and before they deliver copies reduced to public form or to simple writing, together with the same register, to the parties, let them listen diligently and otherwise see so perfectly and correct carefully, that through their carelessness, negligence or otherwise nothing of the substantial matters be omitted, or any damage be suffered by any of the said parties; nor shall they delay or postpone the aforesaid matters in favor or prejudice of one party. Likewise, that the said notaries shall give all judicial acts distinctly and substantially in the manual or memorial, in the presence of the auditor of the case in which they write, and of the parties, if they wish to wait, and shall not postpone writing them down. And after they have written them down, let them faithfully enter them or cause them to be entered into the register; and when required by the said parties or any of them, in each term, let them make a copy to the same parties, when it shall have been decreed by the said auditor, without difficulty and any fraud whatsoever, saving their just salary moderated below. Likewise, that the same notaries in the register of that case in which they write, as aforesaid, shall write down all definitive and interlocutory sentences and inhibitions, as well as intimations and appeals issued verbally or in writing, when they shall have been required by the party or parties or the auditor of the same case. Likewise, that instruments and other things produced by the parties let the notaries register diligently or cause to be registered in the said memorial. Acts truly held before the parties let them not register, but let them be preserved carefully by the notary of that case, unless the parties or one of them request them to be registered; but the party requesting this shall be bound to satisfy the register. Likewise, that notaries, whom it sometimes happens to be absent from the curia perpetually, and sometimes for a time, shall deliver all registers, acts and documents of cases in which they were appointed notaries, namely those who depart with no intention of returning, to some other suitable notary sworn, examined and approved as above, substituting him in his place; but he who wishes to be absent for a time shall deliver and place them in the hands of one of the other notaries of his auditor, with the license and knowledge of the same auditor: which depositary notary shall write faithfully in the aforesaid matters committed to him for the same absent one and shall supply his place.
28 § 25. Moreover, since every labor desires its reward, and the withholding of just payment is not to be denied to the laborer, nevertheless with moderation observed, lest excessive exaction draw blood, there follows by these statutes and ordinances a certain reasonable and discreet mode, by which the aforesaid notaries may receive moderate satisfaction for their salary; and litigants, who are involved in the windings of litigation, and are wearied by many prolonged labors, shall not be burdened by superfluous outpouring of expenses. Namely, that the aforesaid notaries for a page of the register shall have one and one-half turonese of silver, and no more, and each page shall contain twenty-six lines on each side, and each of the said lines shall have fourteen words. Likewise, that for a page of the register, reduced into public form, each page numbered in the same manner, they shall be content with the receipt of one and one-half turonese similarly.
29 Art. C. 1396 - § 22 BULLARIUM ROMANUM
30 § 26. Likewise, that for a copy or copies, whether made in a quire or in pages of the register or of a page, they shall receive one similar turonese.
31 § 27. Likewise, that for a citation to be read in public audience, beyond one-half a similar turonese it shall not be lawful for them to receive.
32 § 28. Likewise, that for an inhibition, which is customarily made in cases, if it be reduced into a public instrument, they shall receive six similar turonese, and no more.
33 § 29. Likewise, for an intimation, when it is reduced into a public instrument, they shall be able to receive no more than four similar turonese.
34 § 50. Likewise for an appeal, if it is reduced to a public instrument, for the receipt of a copy of the register two similar Tours denarii only are permitted to be received by the same.
35 § 31. Likewise, concerning attestations of witnesses, whom anyone shall have named from among the aforesaid notaries, the receipt of a copy of the register shall not exceed two similar Tours denarii; and thus a copy of the same attestations, one and a half similar Tours denarii of the aforesaid notary, shall be received for the receipt of the same register, if that copy is reduced to public form. But if such a copy is received on paper, as above has been expressed concerning other copies.
36 § 32. Likewise concerning a definitive sentence for each receipt of a register, twelve similar Tours denarii can be received. Concerning a public instrument, however, when it shall have been made by itself concerning the sentence itself, twelve similar Tours denarii are owed for each receipt of the register, and for a copy of the sentence in public or in simple form, as much as and as has been expressed above concerning other copies.
37 § 53. Likewise, that concerning an interlocutory sentence having the force of a definitive sentence, as concerning a sentence is expressed above immediately preceding, shall be observed. But if such an interlocutory sentence has the force of a definitive sentence in no way, two similar Tours denarii are to be received for each receipt of the register, as is said above in computing; and if from the interlocutory sentence itself an instrument becomes public by itself, six for the same instrument are able to be received.
38 § 31. Likewise we will, we decree and we also ordain, that the remaining judicial fees are to be taxed according to the manner designated above, this however being added and ordained specially and expressly, that namely wherever in the aforesaid taxations mention is made of a Tours grossus, we will that to be understood of that, so long as the Roman Curia shall be on this side of the mountains; but where it shall happen that the Curia itself is beyond the mountains, namely at Rome or in other parts of Italy, let a Roman denarius be put in place of a Tours denarius, and let it be computed in the aforesaid taxations. § 33. Let notaries beware, however, lest, thinking that on account of the aforesaid modifications they may make longer writings, they make writings not at all longer, nor place superfluous matter in the same, unless as it shall have been necessary and is customary to be done hitherto, nor let them maliciously delay or cause delay in assigning writings to the parties. But those doing otherwise shall restore double. And if they shall have frequently persisted in this excess, let them be expelled from the audience of their auditor and the aforesaid palace.
39 § 56. We will moreover, we decree, and we also ordain, that a similar oath from our venerable brothers, the three other cardinals of the holy Roman Church, by their auditors and notaries, and also our chamberlain by the auditor or vice-auditor of our camera curia, and its notary, and also the marshal of the Roman Curia by their judges and notaries, or whoever else hearing or about to hear cases by apostolic authority in the Roman Curia, shall receive an oath from their notaries in the same cases according to the forms by which the said auditors and notaries of the apostolic palace ought to take care, ordained by us, as is set forth above, insofar as it concerns their offices.
40 § 37. Likewise we decree and ordain, that the aforesaid others concerning duties, gifts are bound to observe the aforesaid.
JOHANNES XXI (called XXII) PP.
41 and gifts, for the exactions of writings,
42 These are to be read in the Chancellery and audience:
43 And in each year, as is provided, the auditors and notaries of the said palace are established, and also ordained through the said cardinals, and also the auditors and judges of our camera curia and of the curia of the marshal, and through their and whoever else in the Roman Curia hearing cases by apostolic authority and those about to hear in the future, notaries shall be served inviolably.
44 § 38. In order therefore that our ordinances and statutes of this kind, which we judge are to endure for perpetual future times, may be observed inviolably; and lest they be given to oblivion on account of the frailty of human memory; and also that the aforesaid auditors and notaries through the inspection of the same ordinances and statutes may be more attentively and vigilantly intent concerning their observance; we will and decree, that our ordinances and statutes of this kind word for word in the registers of letters of our chancellery and the aforesaid audience be written out in full.
45 § 39. And that in each year on the Kalends of October, or the first following day of the audience, if it be a feast day on the day of the Kalends themselves, our ordinances and statutes of this kind be read solemnly in the aforesaid audience. And each of the auditors and notaries themselves shall keep and have a copy of the same with themselves.
46 § 40. Let it be permitted to no one whatsoever to infringe this page of our decrees, statutes, reformation, prohibition and will, etc.
Notes
- 21. And that none of the same, namely any of the notaries who shall have been received as a notary by any one of the said auditors, shall be able to be the notary of another auditor, so long as he shall be the notary of the first auditor. 22. Likewise, that no notaries shall retain a concubine.
- 25. Likewise, that the aforesaid notaries and procurators or their procurators in causes which are being conducted before their auditor shall not be present in the said palace. Likewise, that no one. Concerning things to be observed.

4 § 4. Parimenti che i medesimi giudici osservino soltanto quelle feste che finora i Giudici senza cappa e rocchetto devono osservare;
10 An.

26 § 18. Io N. notaio di N. uditore, e tale commisso a me ufficio sollecitamente e diligentemente esercerò. D. N. D. Giovanni XXII Sommo Pontefice su ciò ordinata. Nessuna causa a me commessa procurerò scrivenda, né aderirò istanza alcuna in questa parte.
