Sui matrimoni segreti (di coscienza)
BENEDETTO PP. XIV.
1 Venerabili fratelli, salute e benedizione apostolica.

2 § 1. Providae tamen huiusmodi leges, tanta auctoritate saluberrime institutae, prava horuni temporum conditione sensim prolabi visae sunt, et enerves propemodum reddi, ob niatrimonia usu nimis recepta, quae occulle adeo celebrantur, ut illorum notitia, quantum fieri potest, obliteretur, et in tenebris ignorantiae perpetuo iaceat consepulta. In more etenim positum est, illa celebrari nuUis praeviis factis denunciationibus, coram solo parocho vel alio sacerdote de eius licentia, adhibita praesentili tantum duorum teslium apposite a contrahentibus advocatorum, quorum fides nemini illorum est suspecta; remque peragi saepe extra ecclesiam, quandoque etiam intra illam, ianuis tamen occlusis, vel eo temporis momenlo, quo semota alterius cuiusvis praesentia, scientia initi matrimonii praeter parochi, contrahentium , testiumque personas, alios penitus effugiat.

POPE BENEDICT XIV.
1 Venerable brethren, greetings and apostolic blessing. We do not doubt, venerable brethren, that it is well known to you that the vigilant care of our pious Mother the Church has always been directed toward ensuring that the sacrament of matrimony, called great by the Apostle, is celebrated publicly and openly by the faithful. Indeed, so that this might be observed more diligently in the future by all than it had been done before, the holy Council of Trent, following in the footsteps of the Lateran Council celebrated under Innocent III, decreed that henceforth, before matrimony is contracted, it should be publicly announced three times by the proper pastor of those contracting in three consecutive feast days in the church during the solemnities of Mass; and then, provided no legitimate impediment intervenes, the celebration should proceed in the face of the church, before the pastor or another priest with the license of that pastor or the Ordinary, and with two or three witnesses present, in due form. The same holy Council also wished that a book be carefully kept with the pastor, in which the names of the spouses and witnesses, and the day and place of the matrimony, should be recorded.
2 § 1. Yet these prudent laws, so salutarily established by such authority, have gradually been seen to decline through the corrupt condition of these times, and to be rendered nearly powerless, on account of matrimonies received all too commonly in practice, which are celebrated so secretly that knowledge of them, as much as possible, is obliterated, and lies perpetually buried in the darkness of ignorance. For it has become customary for these to be celebrated with no prior announcements made, before the pastor alone or another priest with his license, with only two witnesses present, suitably chosen by those contracting, whose trustworthiness is not suspect to any of them; and the matter is often carried out outside the church, sometimes even within it, but with the doors closed, or at such a moment of time that, with the presence of any other person removed, knowledge of the matrimony initiated, apart from the persons of the pastor, those contracting, and the witnesses, completely escapes all others.
3 § 2. How much these matrimonies, commonly called Conscience marriages, abhor the dignity of the sacrament and obedience to the sacred laws of the Church, anyone will be able to conjecture sufficiently and more than sufficiently, who turns the gaze of his mind to their ruinous effects. For from this source grave sins arise, especially of those who, setting aside the threat of divine judgment, having abandoned the first wife with whom they contracted secretly, deceive another with hope of future matrimony and lead her into shameful cohabitation with themselves, and then promise to contract openly. Moreover, the minds of some are so blinded by depraved desires that they dare to contract a new secret matrimony after another contracted secretly in the same manner, and not yet dissolved by the death of the first spouse, and render themselves guilty of the great crime of polygamy. Others have even descended into such shamelessness that, in contempt of this great sacrament, after first secret nuptials, contracting second nuptials either publicly or privately, they do not shrink from boldly binding themselves in polygamy likewise. But consider how grave, how utterly intolerable are the evils that arise from these matrimonies! For if it should happen that the man must live apart from the woman to remove any suspicion of matrimony, the continuous custom of life is immediately destroyed, and the word of the Lord is contemned: A man shall leave father and mother, and shall cleave to his wife, and they shall be two in one flesh: but if this custom of life is preserved, there is no one who does not accuse her of crime, and does not traduce her, as detestable, into matter of scandal. Nor do the injuries inflicted through scandal make amends the subsequent celebration of the secret matrimony, which lurks in darkness and is unknown to all.
