Ecclesiastica
Bull on the resignation of benefices and pensions
1 and punishment. Although undeserving, placed in such a position; we are constrained by grave sorrow, whenever we turn the eyes of our consideration to a part of the Lord's Flock, that is to the ecclesiastical assembly; and we behold it dishonored either by depraved morals or by unseemly acts; for we are not ignorant how great is the danger of corruption to be feared among the peoples from this; if the salt by which all other things ought to be seasoned shall have lost its savor. It has indeed come to the ears of our solicitude, not rarely does it happen that certain Clerics constituted in minor or major orders, or decorated with ecclesiastical tonsure alone, possessing Benefices, simple Offices or with the burden of residence, resign them to others; with an annual pension reserved to themselves under Apostolic approval, made at the same time a pact with the Resignee for canceling and abolishing the said pension, money being represented namely by certain anticipated payments of sums to that amount; which was established by express convention between the Parties for the abolition and extinction of the aforesaid pension, or rather for the concealed sale of the benefice itself to be wickedly carried out. And since profane merchants of Benefices are not lacking; because if such improper pacts should become known to our Apostolic Ministers or to us; such resignations would never be admitted by our Datary; or Pro-datary; or by us; or by other Roman Pontiffs existing for the time being; so that the cunning depravity of wicked men might elude the circumspect vigilance of the same Apostolic Datary Officials, and ours, and of other Pontiffs, this way and method of perdition has been devised; by secret and clandestine pact between the Resignor and the Resignee, for the pension to be canceled and extinguished; by the quantity of money agreed upon; and this sometimes also deposited with a public merchant or money-changer, together; and at the same time they arrange for the Bull of resignation of the Benefice to be expedited; and another of the Pension reserved on the same Benefice in favor of the Resignor; in such a way, however, that shortly after the same, or not long after the time, to which the Supplication for the reservation of the Pension is usually dated, another Supplication is subscribed, or signed for the cancellation, and according to the same Pension to be made by anticipated or to be anticipated payments; with no mention made of the preceding abominable convention, and the simoniacal stain reeking pact, by which the resignation of the Benefice is transformed by execrable change into the concealed sale of the same Benefice. Since therefore pacts of this kind are patent, improper, reprobated, condemned; and grants of such cancellation, or extinction of the Pension, as obtained by subreptitious and fraudulent cunning, and which, in the reality of the matter and in the whole series of the business expressed; would never have been granted by the Apostolic See, are null, void, and empty, and render the greatest damage and detriment to the souls of those fraudulently obtaining them, and moreover scandal to the simple and good, abomination; and to many eternal ruin: Indeed those obtainers of such grants, who traffic in ecclesiastical Benefices in such infamous commerce rather than resign them, not only ensnare their souls in most grievous sin; which they ought to have before their eyes; but moreover openly before all in the people not without infamy of the ecclesiastical order, are execrated; and despised; And if they shall have dared to approach the Apostolic Datary for obtaining other Benefices, as sellers of Benefices they are ill-spoken of; and publicly rebuked; since immediately to them by their competitors is opposed the Resignation made, with the cancellation of the Pension by anticipated or to be anticipated payments; that is, the unworthy commerce of the Benefice already previously obtained; and the clandestine under ambiguities, and fraudulent conventions detestable sale. We therefore this execrable matter of the cancellation of the Pension, by which no light injury is done to the ecclesiastical Order.
2 me with disgrace; and an infamous mark is impressed, as the dignity and necessity and pastoral duty demands, it is annulled. : : : : Wishing to restrain such things in the future, and to remove far from the Sanctuary of God such profane abomination, by Our own motion, with certain knowledge, and mature deliberation of Ours, and from the fullness of Apostolic power, We establish and declare that all such pacts and agreements for the cessation or abolition of Pensions through anticipated or to be anticipated payments made contemporaneously with the Resignations of Benefices, with reservation of Pension, entered into by whatever persons adorned with whatever dignity, honor, and preeminence, as disapproved by the Sacred Canons and Apostolic Constitutions, and smelling of the stain of simony, are null, void, and invalid; and all such cessations, abolitions, and extinctions of Pensions which shall happen to be made hereafter within six months from the day of taking possession of the Benefice by the Resignatory, computed from that day, even if no pact between the parties can be proved to have intervened; and even if the aforesaid cessation be made by virtue of a Supplication signed by Our hand or that of the Roman Pontiff for the time being; which We in no way wish to be valid, as obtained through subreptitiousness and frauds, neither in judgment nor outside it, for any effect; but to be null, void, and empty; and (insofar as it is necessary) by motion, knowledge and deliberation similar, and from the fullness of Apostolic power, by the tenor of these presents We condemn, revoke, annul, void and abolish; and furthermore both the Resignor and the Resignatory are deprived of all right to the Benefice, and they themselves by that very fact, without any other declaration of Us or of a Judge's sentence, are deprived; and shall be unable to obtain any other Benefice; and that from anyone this Benefice, as vacant by law and by fact, can be sought; and moreover We decree and declare that the Resignor is bound under grave sin to restore the monies received for the cessation of such Pension indebitely and simoniacally, which by the judgment of the Ordinary shall be applied to pious places or distributed to poor persons; and if he refuse, he can be compelled by ecclesiastical remedies and penalties, by Our motion, knowledge, and equal power, without any other sentence and declaration, by right itself. And because there is much malice of men on earth, so that all access to fraud, deceits and tricks which the perverse cunning of some is accustomed to devise for their own destruction, insofar as it can be done, may be cut off; We will, command, and declare, under this Our will, constitution, and disposition, to be comprehended all and singular cessions, translations to the Resignatory himself, or to another person, of the benefit or utility of receiving the fruits of such Pensions, as well as all other cessions, translations, resignations, extinctions, abolitions, in whatever manner, title, name, color, and authority, made through anticipated payments or represented money within the said time of six months; and even beyond that space of time, provided that the reprobate and detestable pact shall have preceded it. We moreover command and enjoin that these same present letters be perpetually firm, valid, and efficacious, and at no time under whatever color and pretext, even of defect of Our intention, be able to be impugned: And thus, and not otherwise; in all and singular of the aforesaid, by whatever Ordinary and Delegated Judges, even the Auditors of Cases of the Apostolic Palace, and the aforesaid Cardinals of the Holy Roman Church, even Legates a Latere, and Nuncios of the Apostolic See, and all others whatsoever exercising and about to exercise whatever preeminence and power, with the faculty and authority of judging and interpreting otherwise taken away from them and from each of them, it ought to be judged and decided; and if anything contrary to this be attempted by anyone whatsoever with whatever authority knowingly or unknowingly, it shall be null and void. Notwithstanding the wills, conditions, protestations, and clauses of the Resignors or Cedents, appended in the resignations and cessions themselves, or in the constitutions and Mandates of Procurators, and otherwise, even for the preservation of their rights and signification that they do not resign or cede otherwise or in another manner, and expressed with whatever force of words, formula, and multiplication and amplitude; as well as whatever indults, privileges, and Apostolic graces both general and particular; however worthy of special mention and note, granted and confirmed to whatever Archbishops, Bishops, and other superior and inferior Prelates of Churches, even Cardinals of the Holy Roman Church, and their and Our familiar continuous table-companions, as well as to the Writers of Apostolic Letters, Abbreviators, and other Officials of the Roman Curia; and whatever other things contrary to these. Furthermore, so that these present Letters may be easily known to all, and no one may excuse himself on the pretext of ignorance of them, We command that the same be published at the doors of the Lateran Church and of the Prince of the Apostles, as well as at the Apostolic Chancery, and the general Curia on the Citatorio Hill, and in the Field of Flowers of the City, and in other places customary and accustomed, as is the custom, and that copies of them be affixed: And We will that they thus published affect and bind all and singular just as if they had been singularly intimated to them. And also with copies of the aforesaid even printed, and signed by the hand of a public Notary and the seal of an Ecclesiastical Prelate or his Curia, the same faith is to be given as would be given to these presents, if they were exhibited or shown. Let no one whatsoever be permitted to infringe this page of Our decree, constitution, declaration, annulment, invalidation, prohibition, interdict, and will; or to dare to act contrary to it; but if anyone should presume to attempt this, let him know that he will incur the indignation of Almighty God, and of the Blessed Peter and Paul His Apostles.
