Bull of Pope Innocent VIII ·

of those dispatched. — 23. Assured of the emoluments. — 24. Executors of this bull appointed. — Derogates contrary provisions. — Subscription of the Pope. — Subscriptions of Cardinals. Innocent, bishop, servant of the servants of God, for perpetual remembrance of the matter.

1 It ought not to be judged reprehensible if, according to the variety of times, human statutes are sometimes varied, especially when urgent necessity or evident utility and other reasonable causes demand it: since God himself changed some of those things which he had established in the Old Testament in the New.

2 § 1. For some time indeed certain Romans and our predecessors, the Roman Pontiffs, in order to select industrious men for themselves, whose services in great and difficult matters concerning the honour, state and advantage of the Apostolic See, and the increase of the orthodox faith, they might use, employed very many of them as secretaries according to the magnitude of business and the speedier dispatch of those flowing to the aforesaid See, whom afterwards of blessed memory Callistus III and Pius II, Roman Pontiffs, our predecessors, either on account of the meagreness of the emoluments assigned to the said secretaries, or from other causes moving them to this, successively reduced to six.

3 § 2. We, however, who in the year above, in this manner while our City, in which the Roman Curia also then resided, was being oppressed by armed hostile nations, were compelled to undergo great burdens of expenses for its liberation from such oppressions, and since the resources of the Roman Church did not suffice for these, we pledged the pontifical mitre, called a kingdom, and very many other precious jewels of the same Church, golden and silver, to various merchants following the said Curia, for various sums of money amounting perhaps to the quantity of one hundred thousand gold ducats of the Camera; which, since they could not conveniently be redeemed from the already exhausted revenues of the said Church, we, hoping that if to the office of the same secretaries, beyond and in addition to the said six, eighteen prelates and persons constituted in ecclesiastical dignity should be assumed, and all together for the redemption of the mitre and jewels aforesaid should pay and contribute from their resources up to the sum of sixty-two thousand and four hundred gold florins of the Camera, and there should be assigned to them also newly suitable emoluments, from which, according to the requirement of their dignity, they might maintain their station, from this not only would such urgent necessity of the aforesaid Church be provided for, but also the decorum and beauty of the same See, Curia and office; and to the easier, speedier, more diligent and more accurate dispatch of Briefs and other apostolic letters, which through the same secretaries, both in the Chancery and through the Camera by the Pontifical secretary for the time being are dispatched; and no small convenience would be opportunely consulted for those flowing to the same Curia and pursuing business in it. And wishing, as we ought, to apply appropriate remedy to the foregoing, having held mature deliberation upon this first with our venerable brothers the cardinals of the holy Roman Church, and with the persons written below through lengthy negotiation; by the unanimous counsel and assent of the same brothers, by our own motion and from certain knowledge and the fullness of our power, by apostolic authority, in this constitution to endure perpetually we decree that our secretaries and those of the Roman Pontiff existing for the time being ought henceforth to be twenty-four only, and constituted or assumed in the office of notary of the said See, or in episcopal or greater ecclesiastical dignity; holding the office of notary or such other dignity in which they shall be constituted or in the future it shall happen them to be constituted, let them bear the habit and insignia befitting it, as we the underwritten all and each of them, who in such prelature or the said office of notary shall not yet be constituted, assume as notaries of the same See: wishing that from whatever prelate they shall prefer in the Roman Curia they may be able and have power to receive the habit and insignia of the same office to be borne perpetually.

4 § 3. Let all the aforesaid secretaries also constitute for the time being among themselves one college, and let them use a common college with common chest or purse, and seal, chapel, chaplain and other collegiate insignia, and let them enjoy and possess all the emoluments, honours, privileges, immunities, graces, favours and indults heretofore conceded to the aforesaid secretaries of the Roman Pontiff, and which they were accustomed to enjoy or ought to enjoy, in the same manner and form in which they have enjoyed and possessed them heretofore, or were able or ought to enjoy and possess them, without any variation whatsoever.

5 § 4. Furthermore, in their secretariat itself for the college (which we wish to be compatible with any other offices of the Roman Curia), and in matters concerning it in any way whatsoever, they shall enjoy free power to enact any statutes whatsoever without any other confirmation from a superior.

6 § 5. Since the secretaries themselves have always been members of our Apostolic Chancery even in the office of vice-chancellor, we will and ordain that our venerable brother Roderic, bishop of Porto, cardinal of the holy Roman Church and vice-chancellor, should be recognized and regarded as their head in that Chancery; whom he in turn, regarding them as members of his body, shall cause to be treated with fitting honor by the other officials of that Chancery, and shall procure, assigning to them a place befitting their dignity for the dispatch of the business incumbent upon their said office in that same Chancery, as we assign by these presents.

7 § 6. Let the secretaries also be true prelates of the Papal Palace and of the Apostolic Palace (without prejudice, however, to other prelates of that Palace and their families), and, as regards their persons only, our familiars and those of the Roman Pontiff for the time being, domestics, continual table-companions, and let them be held and regarded as such; and in constitutions, prerogatives, exemptions and privileges and in any writings whatsoever making mention of the same prelates and familiars for the time being, as regards their persons only, let them be included and understood to be included and be included, as we by these presents include them with full latitude; and in whatever prerogatives, favors, privileges, exemptions and indults granted or to be granted for the time being to the same prelates of the Palace and familiars, they shall enjoy and benefit as their part, similarly as regards their persons.

8 § 7. And let them have in our Apostolic Palace one residence and place in which they may gather daily and dwell, and may treat and consult concerning the business incumbent upon their said office; and otherwise, according to the rite, style and manner anciently observed by the aforesaid secretaries of the Roman Pontiffs who existed for the time being, let it be arranged, so that truly and in fact, serving us and the Roman Pontiff for the time being in the said Apostolic Palace, the said prelates and familiars may be able and capable to do so conveniently; and let such a place be called, and be in fact the Apostolic Secretariat, in which, and in no other place of our said Palace, at least publicly, shall be exercised or dispatched whatsoever pertains in any way to the office of secretariat.

9 § 8. And the present lead-seals bearers and those who shall be such for the time being, under penalty of excommunication, shall be bound all and severally to carry all bulls sealed by any one of all the aforesaid secretaries, or any others dispatched through our said secret Chamber, as soon as they shall have been sealed by them, to that Secretariat, and to present them to the official appointed by the same secretaries for that purpose and to no other, so that each individual one with their taxes and tenors may be described, noted, subscribed and dispatched in the usual manner by some one of the same secretaries.

10 § 9. Let the secretaries also have apostolic letters for their persons and for each of them, freely by special privilege (which we concede to them in perpetuity by these presents) in the dispatch of any apostolic letters whatsoever. The tax-writer appointed for the time being to tax apostolic letters shall be bound, without any mandate of ours or of any other, in any letters concerning the persons of the secretaries themselves or any of them, to place: Free for the person of the secretary; and the person of one familiar for each of them: Free for him. § 10. Furthermore we will that the same secretaries, whenever they shall be absent from the Roman Curia for the purpose of conducting our or the business of the Holy Roman Church in any way whatsoever, as regards the full receipt of all emoluments of the said office, shall be regarded as present: but if, withdrawing from the same Curia for the sake of their private affairs, they shall have requested only from their college permission, and shall have arranged that some other from the college serve in their place in the ordinary burdens of the office, they shall likewise be regarded, as regards the same receipt of emoluments, as present, for a full year only. And if perchance they shall have delayed beyond one year to return to the same Curia, they shall not receive the aforesaid emoluments, except with the deduction of only a fifth part thereof, which shall go to the benefit of the others and the college actually present in that Curia.

11 § 11. In like manner, wishing that all the notaries and thirty secretaries and each of them of the aforesaid office, both those present in the said Curia and those absent, may freely dispose of their said offices, and that the acceptance of the resignation of the same offices cannot and ought not to be denied or deferred, even if those resigning were themselves infirm and would likely die within the space of twenty days and did die; nor, for the signature of the petition for the grant of the same office vacated by resignation, shall anything be exacted from him to whom provision shall be made of that vacancy, beyond the sum of one hundred florins of gold of the Camera.

12 § 12. He, if he shall not have been appointed a notary of the said See or a notary of the apostolic nunciature or of the episcopal see or of a greater ecclesiastical dignity, shall nevertheless, through the grant of the said secretarial office, even if sole, receive the notarial office of the said See from the Vice-Chancellor. One from the said college or another shall be deputed by the college to the domestic secretariat of the Pope, with all and singular the prerogatives, honors and burdens customary to the same office of notary of the Apostolic See, and by that very fact shall be deemed to be and shall be assumed, and shall be received as secretary. § 13. And the habit and insignia of the said notarial office shall be exhibited to him (if he shall be present in the said Curia) by the aforesaid Vice-Chancellor, with the other secretaries aforesaid associated with him, in the same context (but first after the due oath of fidelity received from him). And whether he shall be present or absent from the same Curia, letters to be drawn up upon the petition for the grant of the secretariat, even if in it no mention had been made of the aforesaid office of notary and its habit and insignia, shall nevertheless be expedited, both through the Apostolic Chancery and through the Secret Camera, with the express grant of the said notarial office, with its habit, insignia, honors and customary burdens; nor can or ought it be exacted by our or the Roman Pontiff existing for the time being's Datary or by any other whatsoever, for the signature of such petition, although it have the force of a grant of two such offices on account of the aforesaid, anything beyond what is expressed above, absolutely; but just as through the grant of the secretarial office comes likewise the grant of the aforesaid notarial office, so through a single payment of the signature aforesaid, let it be entirely satisfied, as if of a single grant. If, however, the secretary thus newly instituted shall be absent, the aforesaid habit and insignia, when he comes afterward to the Curia, when he shall first present himself to the said college and shall be received as secretary, the aforesaid form being observed, shall likewise be exhibited.

13 § 14. And because it is expedient for us and for the Roman Pontiff existing for the time being to have, besides the aforesaid secretaries, one other domestic secretary, residing constantly in the aforesaid Palace, to whom it may be permitted, whenever he shall be commanded by us, legitimately to expedite our and the Roman Church's secrets, our and the same Church's or orthodox faith's state concerning matters, and to whom (lest he be able or ought to impede himself from the underwritten or any other of the aforesaid secretarial office emoluments, or have any controversy with the same secretaries) it is fitting that from the said secretarial office emoluments, for the decent sustenance of his status, some honest portion be assigned, by the same authority we ordain that, as far as the title of the same secretaries and the legitimate expedition of the aforesaid secret matters only, one of the aforesaid, or another secretary, beyond the aforesaid number, may be deputed by us and the Roman Pontiff existing for the time being, and even if, as is aforesaid, he were not qualified. Who, however, cannot in any way dispose of the aforesaid office and place, and of the portions of emoluments to be received by him outside the number, but shall be removable from those, for the sole will of us and the Roman Pontiff existing for the time being; as to the rest, however, so long as he shall exercise the office, he shall enjoy the same prerogative of favor and honor as the other secretaries.

14 § 15. But in order that the aforesaid secretaries, both those of old and those newly admitted, who from the minutes, thirty in number at that time, freely paid from their own monies, as aforesaid, the sum of sixty-two thousand four hundred florins of gold of the Camera, for redeeming the mitre and other aforesaid jewels, and their successors holding the aforesaid office of secretary for the time being, may apply themselves more diligently to the exercise of those things which are incumbent upon their office, inasmuch as they shall know that fitting emoluments proceed therefrom to them; in the first place and before all things, we command by this present document to the aforesaid Roderick bishop vice-chancellor that he carefully examine the rule or declaration formerly issued by our predecessor of happy memory Pope Martin the Fifth, and registered in the register of the Chancery, concerning the emoluments to be received by the secretaries who were then in the aforesaid Chancery from the minutes to be expedited, of the following tenor, namely: "In order to remove disputes and doubts which sometimes arise from a certain concession made by us to our beloved sons the secretaries concerning certain emoluments to be received by them from certain minutes, described in the register of the Chancery by our mandate, by the tenor of these presents we declare the intention of ours to have been and to be, and thus we command to be observed, that the said secretaries, freely and without any contradiction, receive the customary emoluments of all the minutes which are described in the said concession, namely of the office of notary, of portable altars, of celebrating in interdicted places and before the appointed day, of the perpetual confessional and of indulgences at the point of death and in life, even if other faculties concerning such graces have been granted, and the graces themselves exceed the form of the register; even if the supplications of the said graces were registered, and distributed by the vice-chancellor or his locum tenens for the time being to certain abbreviators, or inserted in the roll of other supplications in any manner whatsoever; furthermore, to receive ecclesiastical sacraments and any indulgences whatsoever, granted or to be granted to Churches, monasteries, chapels and other pious places in any manner, we likewise declare and decree to pertain to the said secretaries; and we command and will that those henceforth be expedited by them and not by others. Let it be done, and thus we declare. O.", to examine carefully, and having examined it, to cause it to be inviolably observed in favor and for the benefit of the same secretaries by all and each to whom it pertains in any manner, causing all and each of the aforesaid minutes of the office of notary, of portable altars, of celebrating in interdicted places and before the appointed day, of the perpetual confessional, of indulgences at the point of death and in life, of ecclesiastical sacraments and of any indulgences whatsoever granted to any Churches, monasteries, chapels and other pious places in any manner and to be granted hereafter, together with the taxes and emoluments proceeding therefrom, to come wholly to the aforesaid secretaries, and in the same Chancery to be examined and signed by the secretaries themselves and not by any other, under whatever pretext perchance, and to be presented to the same and to the vice-chancellor of the same Roman Church for the time being, or his locum tenens, for expediting and sending to the Apostolic Bullary, any custom perchance to the contrary notwithstanding (which custom we do not intend to prejudice the same secretaries in any manner so that they may be able and enabled to enjoy and use the full and entire effect and peaceful possession of all the things contained in the aforesaid constitution of our said predecessor), in no wise standing in the way.

15 § 16. Moreover, also beyond the aforesaid, we assign to him a fifth tax, to be exacted for the expedition of apostolic letters, which are expedited through the same Chamber by the secretary for the time being, in times past by the aforesaid secretaries, or in the name of themselves or any one of them, in the Bullaria of the same letters, or also elsewhere customarily exacted, and which our predecessors and we have sometimes been accustomed to remit, in whole or in part, and in the opportunities of the same See, called the secretary's tax, both for those hitherto expedited (which have not yet been restored to the parties) and for those to be expedited in the future, in the manner in which hitherto by whomsoever they have been customarily expedited and exacted or ought to have been, we likewise assign to be exacted by the same perpetual secretaries. Willing and by the aforesaid authority decreeing that it be lawful to no one whatsoever, by himself or by another or others, to procure or ordain or solicit that any of such letters relaxed and expedited by the same Chamber be delivered or restored or sent to the parties, before the same college of secretaries be duly satisfied concerning the said fifth tax. But if anyone shall presume otherwise to procure, ordain, solicit, or to deliver or cause to be delivered or command to be delivered the same letters, under whatever pretext, otherwise in fact, he shall incur the sentence of excommunication latae sententiae (from which, unless first and before all else satisfaction be made to the same college of secretaries, of the true and entire sum of the tax of the bull, if procured, solicited or delivered, or of satisfying by efficacious ordinance preceding, by whomsoever confessor, even under the pretext of any indult whatsoever, emanated or granted by us or our successors concerning this, and in the article of death, he cannot be absolved) and also deprivation of all and singular offices, obtained by the same in our aforesaid Curia for the time being, and also of all emoluments whatsoever due to him, in any manner, by reason or cause, then and to be owed in the future, by reason of the same offices which he shall hold and which he shall exercise in any manner whatsoever, the penalties latae sententiae respectively (which by that very fact and as often as he shall contravene) he shall incur. And our venerable brother Peter, bishop of Cesena, present, and he who shall be for the time being, general auditor of causes of the Chamber of our Apostolic Curia, is bound to proceed and cause to proceed with effect to the declaration and execution of the same penalties, whenever it shall be established to him concerning the aforesaid.

16 § 17. And furthermore, all and singular emoluments of apostolic letters in the form of a brief, both under wax and under lead, for whatsoever persons expedited already and to be expedited for the time being, upon whatsoever, even governorships, or rectorships and commissions, or podestas, captaincies, vicariates, treasurerships, camerlengeships and chancelleries of provinces, cities, lands and castles, and custody of fortresses whatsoever, subject to us and the Roman Church and subjects; as well as of whatsoever other administrations or commissions, even of gabelles or revenues pertaining in any manner to the same Roman Church, upon offices or concessions or locations. Which offices or their places and titles, in a certain quire sealed with lead and subscribed by our hand, we have caused to be described individually each one, and, considering the quantity of emoluments to those who shall exercise the offices themselves for the time being, likely to accrue, so that those also who gratuitously receive advantage from us, in such necessity of the Roman Church, may contribute some portion, we have caused to be taxed in perpetuity to a certain moderate tax; to which quire we will that reference be had in all things to be said below, a copy of which in the form of a transcript is to be sent to each legate and governor or rector aforesaid, so that by themselves it may be diligently made known and published to all the aforesaid officials and others, whom the taxes and other things designated in the same quire concern (so that none of them may be able to allege their ignorance, and the time below written of one month, or thirty days, thence to have legitimate beginning, we will and command), we decree to pertain and belong to the same secretaries in perpetuity.

17 § 18. Decreeing that both letters of concession and letters of grace concerning reforms over all and singular offices or commissions whatsoever, to be made by us and our successors, who shall be in office from time to time, for however long a space of time, even the longest, letters shall always be expedited and ought to be expedited to each of the same secretaries every six months, reckoned from the dispatch of the first letters; and for each such letter, a single tax ought to be paid to the same secretaries at each instance, as it shall be found noted in the aforesaid register. Likewise also all and singular emoluments for any other similar letters on any other matter in brief form, to be expedited under wax or lead, whatsoever and however many and of whatever kind they may be, in no way whatsoever, under any colour or pretext, excepted or reserved; but as by our predecessor and ourselves and the other aforesaid secretaries, who shall be in office from time to time, it has hitherto been customary to exact and receive, we assign in perpetuity to the convenience and emoluments of the same secretaries.

18 § 19. And furthermore the office of visiting all and singular fortresses of the holy Roman Church, and of making musters or descriptions of all and singular armed forces of the same, both cavalry and infantry, the office of revision of armed forces and the office called of the wings, with the customary authority, power, facility, administration and exercise, and complete perception of emoluments owed to that office by right or custom in any way due and to be due in the future, to the college of the same secretaries, through one of the secretaries themselves, or another suitable person (to whom we and our successors in office from time to time shall have deemed it right to commit it, and to whom by the same secretaries a fitting salary, a sum not exceeding one hundred ducats annually, ought to be paid) to be laudably exercised, we likewise grant and assign in perpetuity. Decreeing furthermore that the secretaries themselves may obtain vacant possession thereof, that the office itself from now vacates and pertains to the same secretaries with full administration thereof, as aforesaid, any concession of the same made by us to any person whatsoever, even with possession following, notwithstanding.

19 § 20. The manner truly of collecting all the aforesaid emoluments, we permit to be that which the secretaries themselves by common will shall have deemed to be established. The emoluments collected, however, for the time being among the same secretaries in the manner which follows ought to be divided and distributed in perpetuity, namely: beginning from now and as long as the aforesaid secretaries shall be in number thirty, let them be divided into thirty-two equal parts, of which each of them shall receive one, and the domestic secretary of the Roman Pontiff aforesaid shall receive two of the remaining ones, so that they presume in no way whatsoever to touch anything beyond the emoluments denoted above, each month. But when it shall happen that the place or places of any one or more of them dying shall be extinguished, and until the whole number shall have been reduced to twenty-four, let them be divided into as many portions as there are secretaries in number in their college and two more, to be similarly distributed respectively by lot; and the same shall be perpetually observed after it shall have come to the number of twenty-four, so that namely the emoluments themselves divided into twenty-six equal parts, one part shall fall to each secretary from the college, and the remaining two to the aforesaid domestic secretary of the Roman Pontiff, so that he abstains from all the aforesaid, being assigned.

20 § 21. And so that this our ordinance may have its proper effect and the effect which we intend, by virtue of these presents we prohibit, after the lapse of thirty days from the publication of the aforesaid register, as aforesaid, that anyone, even under the pretext of any other of our letters of earlier date, be received or admitted to any of the offices noted above, unless by new letters expedited after the same publication through the ministry of the same secretaries; subjecting to the sentence of excommunication all and singular who, after the aforesaid term from the aforesaid publication has elapsed, shall presume not to obey these letters by admitting or causing to be admitted or commanding anyone whatsoever as an official to exercise any of the offices noted above. But those who already exercise any of these offices, whether by title of first concession or reform, if they have not yet exercised these offices for the full three months, we command that within the same space of thirty days they come or send to obtain new letters concerning the same offices, to be expedited by the aforesaid secretaries. And if perchance they have exercised these offices for more than three months, and have letters for exercising them for more than a semester, we nevertheless decree that they cannot exercise such offices beyond the end of the now current and already half-completed semester, unless by newly obtained letters, and again expedited by the same secretaries. And thus both those who are still within their three-month period from the beginning of the exercise of their offices, within the said thirty days next to be reckoned from such publication, and those who have expedited letters for continuing, after the time of the then current semester, these offices which they have already exercised for more than three months, if they shall presume to continue the exercise of these offices without new letters expedited by the same secretaries before the end of the semester, shall by that very fact be removed from these offices; and whatever shall have been done therefrom under the pretext of these offices shall be null and void and of no effect. And nevertheless both they themselves and those who knowingly tolerate them and presume to have them as officials therefrom shall by that very fact be bound by the same sentence of excommunication.

21 § 22. In like manner, wishing that offices which are also conferred and commended by the legates or governors for the time being of the provinces, cities and territories themselves, whether by ordinary law or by virtue of whatever faculties they are accustomed to obtain or expect, or shall obtain or expect in the future, if the offices are described in the aforesaid register, they shall be held and ought to be bound under similar penalties, within the space of the same thirty days, from now and successively in perpetuity, before these offices begin to be exercised and after they have begun, to come or send every six months to us for confirmation of the concessions made by the same legates or governors concerning these offices, paying the same taxes each time. And nevertheless both the aforesaid legates or governors and rectors shall compel all and singular these taxed officials, at the simple requisition of the same secretaries or their messenger, to make payment of such tax every six months aforesaid, with effect, without any judicial delay; and the treasurers or camerarii or depositaries of the places (in which these offices may have been, or from whose hands such officials receive salaries or stipends), even if they have been appointed by the communities of the places, whenever they shall have been simply requisitioned on behalf of the same secretaries, under the penalty of like excommunication, shall be bound to retain from the salaries of such officials paid by them, and to pay to the same secretaries or their messengers as much as they understand to be owed to the same secretaries for the tax of these offices described in the aforesaid register.

22 § 23. Moreover, since these same secretaries, concerning the amount of the revenues of the tax of the aforesaid offices described and taxed in the aforesaid register, and generally concerning all their offices assigned by us with emoluments, believed in good faith on our simple word, and for this reason did not refuse to contribute the said sum of money for relieving the aforesaid necessities of ours, we, deeming it worthy to provide for their indemnity, by the like counsel and assent of our brothers and by the fullness of power, by the tenor of these present letters decree and declare, in the event that for any of the offices described in the aforesaid register, either because those offices themselves did not exist or did not satisfy, or did not suffice for the payment of the tax in whole or in part; or because by us or our successors there should be granted to any of the venerable brothers of the holy Roman Church cardinals emoluments, or also to our or their relatives, or to others so dear, that the aforesaid taxes could not be conveniently exacted from them by the same secretaries without unseemly disturbance; so that from all the aforesaid offices already, as aforesaid, taxed in the aforesaid register, there should not be exacted each year at least the sum of eight thousand gold ducats; or otherwise by our act or that of the Roman Pontiff existing for the time being, from all the remaining emoluments themselves assigned to the secretaries from the tenor of these present letters, in whole or in part, something should be subtracted from or diminished to the said office; or the office itself should be revoked or, the manner and order given and instituted by us in these present letters being changed, should be altered, so that it should not have in perpetuity with all the aforesaid emoluments in full, by the manner and order expressed above, to be exercised, ruled and governed; we and the same successor and the Apostolic Chamber are bound and obligated in good faith, if there shall have been made a simple diminution of emoluments, to pay and satisfy them from the whole sum, which on account of these causes or otherwise in any way they shall have lost, or shall be about to lose in the future, by means of their oath (to which in that case credence and belief ought to be given) it shall be established. But if there shall have been made a revocation or alteration of the office, as is premitted, to restore the aforesaid whole sum of sixty thousand four hundred gold ducats from the Chamber, paid and numbered by them, as aforesaid, in which in no way and for no reason or cause can or ought to be computed, in whole or in any part, the emoluments of that office, which perhaps meanwhile they should appear to have received, which we decree and declare that they and each of them ought justly and legitimately to acquire for themselves and make their own by the same authority and fullness of power. For thus with the secretaries themselves we recognize and attest that we have agreed in the negotiation of all the aforesaid, and thus by express pact to them for themselves and their successors, with the like counsel and assent of our brothers, we have been solemnly pledged in the faith of the Pontiff.

23 § 24. Willing therefore and by the tenor of these present letters commanding our beloved son the illustrious and most reverend father Raphael, cardinal deacon of St. George at the Golden Sail, our camerlengo, and his successor for the time being; as well as the presidents and clerks of the said Apostolic Chamber and all others to whom it shall pertain in any way for the time being, that recognizing and following this obligation made by us, they shall make to the same secretaries, concerning the aforesaid and their full and inviolable observance in perpetuity, an instrument of obligation of the goods of the same Roman Church and Apostolic Chamber whatsoever at every requisition of theirs; and in the aforesaid event, without awaiting any other declaration or mandate, they shall make due and full satisfaction. Decreeing from now that whatever shall thus be done and transacted by the camerlengo and the others aforesaid ought to be perpetually ratified and firm. The aforesaid and constitutions and ordinances of the apostolic predecessors, and the rules of the Apostolic Chancery concerning resignations of offices made within twenty days before death, even if full and express mention and word for word, not however by general or other clauses importing their derogation, ought to be had of them and their whole tenors, and others, which may be contrary to the tenor of these presents, in whole or in part, or may hinder or delay their effect, notwithstanding any contrary matters whatsoever.

24 Let no one therefore etc.

25 If anyone however etc.

spediti. — 23. Assicurateli dd. emolumenti. — 24.
