POPE BENEDICT XIV.

2 Venerable Brethren, greetings and Apostolic Blessing.

3 The Pontiff willingly shares pastoral solicitudes with the Bishops.

4 We always willingly embrace the occasions presented to Us of directing Apostolic writings to Your Fraternities, so that the proofs of Our sincere affection toward You may frequently shine forth; but We undertake this with even greater eagerness of spirit when We are moved by the present conditions of affairs or times to excite the zeal of Your Fraternities for the preservation of right discipline in the Clergy committed to Your governance. For We are confident that We cannot otherwise sustain the burden of solicitude for all the Churches, imposed upon Our weakness, than by repeatedly inculcating the increase of Divine Worship and the exact observance of Ecclesiastical Sanctions in individual Dioceses through the religious vigilance and anxious care of the Pastors. 1744 § 1. The occasion and subject matter for writing this Epistle to You is provided first by that duty which falls upon all who have care of souls, namely, to apply the Mass for the people committed to their care; then also the application of the Conventional Mass, which is to be made for Benefactors in general by those who sing Masses in Patriarchal, Metropolitan, Cathedral, and Collegiate Churches; and finally the debt of chanting to which the Canons of the aforesaid Churches assisting in the Choir are bound. This subject matter is by no means new, but has been frequently treated by writers, and since this matter has been discussed and defined many times in the Congregations of this Our Beloved City of Rome, and especially in the Congregation of Our Venerable Brethren, the Cardinals, Interpreters of the Council of Trent, in which We once performed the office of Secretary for many years while in a subordinate position; and although the Decrees of these same Congregations have for the most part come forth uniform and consistent with one another regarding it, and some of these Decrees have even merited the approval and confirmation of Our Predecessors, the Roman Pontiffs; it would nevertheless be not at all surprising if knowledge of them had not yet reached each and every one of You. Wherefore We have deemed it not only opportune but also necessary to write this Encyclical Epistle to You, by which, the variety of opinions into which writers have gone being at last removed, the constant sentiment of this Apostolic See regarding the aforesaid matters may become known to each; and Your Fraternities may have as it were a norm and rule according to which You may direct Your Synodal and other Constitutions, Ordinances, or Edicts concerning the aforesaid matters, the publication of which We enjoin upon You. And while You will strive to urge their execution with all the care and vigilance that is fitting, according to what We prescribe in the present to be held and observed, You ought not to doubt that recourse to the Tribunals of this Our Curia shall in no way be able to place an obstacle or delay to the implementation of Your Statutes; such recourse We altogether reject and command to be rejected: Wherefore We wish these very Letters of Ours to be preserved in the Registers of each Tribunal, and We command that according to their prescription, both the resolutions of these Tribunals themselves and the judgments concerning Your decrees, which You will issue adhering to these present Letters, be exacted and compared. § 2. And indeed, what We recently stated, that the Most Holy Sacrifice of the Mass ought to be applied by Pastors for the People committed to their care, descending as it were from Divine precept, is expressly affirmed by the Sacred Council of Trent and by this Apostolic See in these notable words: "Since by Divine precept it has been commanded to all to whom the care of souls has been entrusted to know their sheep, to offer Sacrifice for them": And although there have not been lacking those who through vain and frivolous interpretations have endeavored to remove from consideration or at least to weaken this obligation mentioned by the Holy Synod; yet since the words of the Council cited are sufficiently clear and perspicuous, and since the aforesaid Congregation, specially placed over the interpretation of that same Council, has constantly decreed that those to whom the care of souls has been entrusted ought not only to celebrate the Sacrifice of the Mass but also to apply its fruit for the People committed to them, and not to apply it for others or to receive alms for such application; and what is of greater importance, since this understanding has been approved and confirmed by Our Predecessors, the Roman Pontiffs; nothing further remains for any of You to desire, so that You ought to embrace it and obey it, and procure its prompt execution in Your respective Dioceses with all diligence. § 3. Nor are We, who, as We intimated above, while still in a subordinate position performed the office of Secretary of the aforesaid Congregation of Interpreters of the Council of Trent for several years, and spent many years in the governance of the Cathedral of Ancona, and in part in that of the Metropolitan Church of Bologna, Our most beloved native land, which We still retain, unaware of the manifold kinds of evasions by which certain persons endeavor to decline the fulfillment of the aforesaid obligation, and to which therefore it is fitting that We opportunely provide a remedy.

5 4* For indeed the Sacred Council of Trent, lest the care of souls be neglected, commands Bishops in more than one place that whenever it shall be necessary, they choose and appoint suitable Vicars with the assignment of certain revenues for exercising the same care, as may be seen in the Regular sess. 6. c. 2. sess. 7. c. 5., and 7. sess. 21. c. 6. and further sess. 25. c. 16.; yet it often happens that when some Parochial Church becomes vacant, a Vicar likewise ought to be appointed by the Bishop to fulfill the burdens of such Church until the election of a new Rector, the same Council of Trent commanding this in sess. 24. cap. 18. de Reform.; some of such Vicars strive to withdraw themselves from the aforesaid obligation, either because the habitual care resides with another or others, and they themselves exercise only the actual care; or because they are removable at will, or are assigned to such care for a brief time: not to speak here of Regular Rectors, who sometimes show themselves alien from the aforesaid application of Mass for the People. Therefore Our mind and judgment is, as also has been judged and determined many times by the aforesaid Congregations, that all and each, who actually exercise the care of souls, and not only Secular Rectors or Vicars, but also Regular Rectors or Vicars, in a word,

6 all and each of whom it has been said above, and all others whosoever, even those worthy of specific and individual mention, are equally bound to apply the Parochial Mass for the People, as aforesaid, committed to their care.

7 5. Some, however, in order to avoid such an obligation of implementation, are accustomed to allege that the revenues assigned to their own Parish do not suffice; or finally they have recourse to an inveterate custom of some, maintaining that it has never been in use either for them or for their predecessors, for a long time, which they affirm to be immemorial. We, however, approve and confirm our approbation to the preceding resolutions of the aforesaid Congregation of the Council; and, insofar as it may be necessary, by Apostolic authority, again by the tenor of these presents we decree and declare, that although Pastors, or others, as above, having the care of souls, are destitute of revenues suitably assigned beforehand, and although an ancient or even immemorial custom has obtained in their Dioceses or Parishes, that the Mass for the People was not applied, nevertheless the same ought entirely to be applied by them henceforth. We said indeed that all those having the care of souls ought to apply the Sacrifice of the Mass for the People committed to them, not for this reason did we wish to establish that they are bound to the aforesaid application for the People by precept, either daily or whenever they celebrate. And indeed the most holy Council of Trent, sess. 23, cap. 14, commands Bishops to take care that Priests celebrate the sacred rites of Masses at least on Sundays and solemn Feasts, if they have the opportunity; and it has said that they ought to celebrate Masses frequently, so that they may satisfy their duty; in many moreover Synodal Constitutions of Bishops we know that days have been providently established and designated on which the Pastors of souls ought to celebrate Masses. But We have undertaken in the present to decree this one thing only, namely when indeed the same ought to celebrate and apply for the People; and although we have ascertained that which was answered by the Congregation of the Council to others, namely that a Pastor endowed with ample revenues ought to celebrate and apply daily for the People: but he who does not enjoy more abundant such revenues, is bound to do the same only on festive days; yet since likewise to Us have been made clear both the controversies arising over this very matter; namely to what sum the revenues of the Parish Church ought to amount, so that they may be called ample and abundant; since ample revenues are by no means to be held those, even if copious, to which however many and grave burdens are attached; and also the complaints of many against such a decree, as if too rigid, have come to Our knowledge; For this reason We deem it opportune to declare to Your Fraternities, that We shall be abundantly satisfied, and it may suffice for You, while those who exercise the care of souls celebrate and apply the Sacrifice of the Mass for the People on Sundays and other Feast days of Precept throughout the year, since the aforesaid Sundays and other Feast days are those on which, according to the precept of the Council of Trent sess. 5, cap. 2, and sess. 24, cap. 4, each one placed over the care of souls ought to feed the People committed to him with salutary words, teaching those things which it is necessary for all to know unto salvation; and the same are days, concerning which the same holy Synod has established, that the Bishop admonish the People diligently, that each one is bound to be present in his own Parish, where it can conveniently be done, to hear the Word of God; and on which Pastors ought to instruct their Subjects in Christian Doctrine, according to that which is commanded to Bishops by the aforesaid Council in the cited Cap. 4, namely that at least on Sundays and other festive days they carefully cause the Children in individual Parishes to be taught the rudiments of Faith and obedience toward God and Parents, by those to whom it shall pertain. In the year 1744.

10 Comprehended in those to whom the People are bound to hear Mass.

11 Faculty is granted to dispense poor Pastors from appli-

12 cation for the People on Feast days.

13 3 10 Benedict XIV.

14 7. And because in some Dioceses the number of Feast days of precept, by Our Apostolic authority and consent, has been diminished to this extent, namely that on some Feasts the Christian faithful both ought to hear Mass and abstain from servile works; on others however the People are permitted to perform servile works, the obligation of hearing the Sacrifice of the Mass remaining firm; We, in order that doubts already arising concerning the burden of application of the Parochial Mass on such Feast days may be entirely eliminated, establish and declare, that also on those Feast days on which the People ought to be present at Mass and may abstain from servile works, all those having the care of souls are bound to celebrate and apply the Mass for the People.

15 § 8. Since indeed by our own experience we have sufficiently learned that some Pastors are so poor that they are almost forced to live from the alms which they receive from the Faithful for the celebration of Masses; and those who, when a Parish Church is vacant, are appointed under the name of Vicar or Administrator to exercise the care of souls, are in some places treated so illiberally that the meager revenues assigned to them and the few uncertain emoluments accruing to them scarcely suffice for their necessary sustenance; which also not rarely happens to those who in some Churches, while habitual care remains with others, are devoted only to actual exercise; and therefore since it would seem that these are treated too severely if on Feast Days, on which especially such an occasion presents itself, it were forbidden to them to receive alms for the application of Mass; For this reason We, taking pity on the poverty of these and those alike, and wishing to provide for them, as far as it is within Our power; although, as has been said above, all and each of the aforesaid are bound on Feast Days to celebrate and apply Mass for the People; nevertheless, as far as pertains to the aforesaid needy Pastors, We grant to each of you the faculty of dispensing opportunely with those whom you shall truly know to be such, so that even on such Feast Days, they may freely and lawfully be able and permitted to receive alms from some pious offerer and to apply the Sacrifice for him, insofar as it shall be required by him; provided that they celebrate Mass in the same Parish Church for the necessary benefit of the People; yet with this added condition, that they apply within the week as many Masses for the People as they shall have offered within the same week on Feast Days according to the particular intention of another pious Benefactor.

16 § 9. But as regards Vicars or Administrators of vacant Churches, since by the Sacred Council of Trent, sess. 24, cap. 18, there is granted to each Bishop the faculty of appointing and constituting them with a congruous portion of fruits assigned at his discretion, it shall be your part, Venerable Brethren, to deal with those who exact the fruits of the vacant Church, so that to the needy Vicar, who enjoyed a meager assignment of such certain fruits and few uncertain revenues, some congruous increase may be provided, for the burden of celebrating and applying Mass for the people on Feast Days. Wherefore for those places in which the fruits of vacant Churches are exacted for the benefit of Our Apostolic Chamber, We direct appropriate orders to Our General Treasurer, which he shall not fail to announce to the particular Collectors of the said places, with whom the Bishops of Our Ecclesiastical Territory and of other places in which, as aforesaid, the fruits of vacant Churches pertain to the aforesaid Chamber, shall be bound to interpose the parts of their office for the end of which We have spoken above.

17 § 10. And finally, as to those who as Vicars, whether perpetual or constituted for a time, administer the care of souls, which resides habitually with others, by reason of some Parish Church, their Churches, Monasteries, Colleges, or Pious Places formerly united to them: although by Our Predecessor of revered memory, St. Pius V, a certain portion of such fruits was fixed to be assigned to such Vicars, as is distinctly provided in his Constitution which begins: Ad exequendum, given on the Kalends of November in the year 1567; nevertheless where the prescribed portion of fruits is found to be assigned to the aforesaid Vicars either in no way or not in full, or also where that which was attributed to them according to the norm of the aforesaid Constitution is deemed by you to be in no way sufficient, on account of the circumstances of the times, and especially for fulfilling the burden of celebrating and applying Mass for the People on Feast Days of precept; you shall use the power which the Council of Trent, sess. 7, cap. 7, granted to Bishops, when it permitted their discretion, according to the circumstances of the times and the nature of the imposed burdens, to assign a congruous portion of fruits to the aforesaid Vicars; for which reason We also impart to your Fraternities, insofar as it be necessary, all needful and opportune faculties, whatever appeals, privileges, or exemptions, as is sanctioned in the same Council, being in no way of avail against those things which shall have been salutarily established by you.

18 § 11. We have therefore judged that these matters concerning the Parochial Mass should be established and announced to your Fraternities. And proceeding from there to those things which pertain to the Conventional Mass, we believe that none of you are unaware of the sanctions of the Sacred Canons, by which it is commanded that on individual days in Patriarchal, Metropolitan, Cathedral, and Collegiate Churches, both the Canonical Hours be recited in the proper manner and form, and also the Conventional Mass be celebrated; which are so clear that no doubt can arise concerning them. And on this matter the Resolutions emanating from this Congregation of our Venerable Brethren, the Interpreters of the Council of Trent, are likewise perspicuous and in all respects uniform, having been issued repeatedly, all of which we confirm and approve by our Apostolic Authority, earnestly impressing upon you their execution: namely, that the Conventional Mass, which is sung on individual days by the Clergy of the aforesaid Churches, should be applied daily for the Benefactors of those same Churches in general; in precisely the same manner as we have declared above that the Parochial Mass ought to be applied by those who have the care of souls for the People committed to them, on at least the individual Feast Days of precept.

19 § 12. Therefore take care to eliminate that false opinion which we know has been introduced into some Churches in this manner, whether through malice or through error: namely, that when the Conventional Mass is celebrated and applied for a certain particular Benefactor of the Church, either out of gratitude or by force of an imposed obligation, the duty of the application of the Conventional Mass is considered to be fulfilled. For indeed such a duty does not regard certain individual Benefactors, but Benefactors in general of any Church, to whose service are devoted all those who in the same Church hold either Dignities, or Canonries, or Mansionaryships, or Choral Benefices, and celebrate the Conventional Mass in their respective turns.

20 § 13. Nor should you regard as any less to be disapproved the opinion of some, who think that the aforesaid obligation is sufficiently fulfilled when in their Churches some prayers are made for Benefactors in general at certain times, or anniversary Sacrifices are performed on fixed days for them. For no one ought to arrogate to himself the right to satisfy an imposed obligation in any manner other than that which has been prescribed many times by Ecclesiastical Law; namely, by celebrating the Conventional Mass on individual days for the Benefactors and applying it for them in general.

21 § 14. Truly not only in the earlier centuries of the Church, but also in times not far removed from our own age (which we do not doubt you have learned from the History of the Church), there was observed formerly in individual Churches an accurate record of all and each of those by whose liberality each Church had been enriched, and their names were inscribed in the Sacred Diptychs, for so they were called, so that the memory of those same persons would never perish, and so that prayers would be poured forth for them and the Sacrifice of the Mass would be offered for them; for which reason also the aforesaid Catalogue was customarily placed before the eyes of the Priest Celebrant in most Churches; although those same pious Benefactors had stipulated nothing whatsoever for themselves in their Donations, but had merely declared that they were offering their goods to God for the remission of their sins. The Prelates of Churches indeed thought that prayers ought to be sought for them; although those same persons, offering their own goods, had not said a word about the matter. The use of such Sacred Diptychs gradually fell into disuse; and on account of this the names of many Benefactors lie in oblivion in some places. But it was not therefore permitted to abandon the practice and discipline of praying for them and of offering the Sacrifice of the Mass for them. And from this the precept of applying the Conventional Mass for Benefactors in general derives its origin and rationale.

22 Various reasons are falsely offered for declining this.

23 It is established against custom that even ancient custom does not suffice.

24 § 15. Just as, when speaking of the Parochial Mass, it was said above that various excuses are customarily offered to decline its application for the People on Feast Days of precept; so likewise it has happened that various excuses are offered regarding the daily application of the Conventional Mass for Benefactors in general. But just as those former excuses were providently removed by the opportune resolutions of the Congregation of the Council of Trent, so also these latter ones have been removed; which resolutions we therefore approve and confirm in these matters also by our Authority.

25 § 16. Some indeed, under the pretext of a contrary custom, even immemorial, prevailing in their own Church, have persuaded themselves that they could be exempted from such a burden. But it has already been replied many times that such a custom, although immemorial, which is to be called a polished abuse and corruption, avails nothing for anyone. 44 § 17. Others have wished to excuse themselves from the Mass for Benefactors to be applied in general, from the fact that they are bound by some other Mass obligation, either by reason of their own Canonry, or of another Ecclesiastical Benefice, which they hold together with the Canonical prebend; or because, besides the office of Canon, or Beneficiary, or Mansionary in the Cathedral or Collegiate Church, since they also exercise pastoral care in the same or in another Parish Church, when they sing the Conventional Mass on feast days of precept, they must apply it for the people committed to them; and therefore they cannot offer the same specially for the Church's Benefactors. But this too has been met by commanding each of the aforesaid to apply the Conventional Mass which they sing for the Church's Benefactors in general; but for others, for whom they are particularly bound to apply the Mass, let another be substituted, who in their place shall celebrate and apply such a Mass.

26 § 18. Likewise the exception of others was that the Conventional Mass is not always celebrated by Canons, or Dignitaries, but sometimes also by Beneficiaries, or Mansionaries; whom it seems less equitable to lack the alms for the celebration of the Mass, from which it is unknown how it could be drawn. Yet this matter too has been similarly provided for, by ordering that it be drawn from the Mass of distributions.

27 § 19. Finally, others objected to the smallness of such distributions, which, on account of the daily alms withdrawn for the Conventional Mass, have been reduced to almost nothing, scarcely would be cared for by anyone, with great detriment to the provision of the Church's service. The Tridentine Council indeed, session, chapter 15, showed suitable means by which the poverty of Canonical Prebends could be provided for. But if the way designated by the Council, as almost usually happens, cannot be entered upon, it will remain to have recourse to the Congregation of the Council; whose duty it will be, having examined from your reports the state of affairs, by Apostolic authority imparted to it by Our Predecessors, and also confirmed by Us by the tenor of these presents, to reduce the daily application of the Conventional Mass for Benefactors in general, so that another, to feast days only.

31 The Pontiff absolved from the application for Benefactors.

32 of Benedict XIV.

33 quam iniri posse contingat, reliquum erit ad Congregationem Concilii recursum habere; cujus erit, perspecto ex Vestris relationibus rerum statu, auctoritate Apostolica a Praedecessoribus Nostris eidem impartita, et a Nobis etiam praesentium tenore confirmata, quotidianam applicationem Missae Conventualis pro Benefactoribus in genere, ut alius, ad Festos tantummodo dies reducere.

34 § 20. Not only in Patriarchal, Metropolitan, Cathedral, and Collegiate Churches is it found prescribed that the Conventional Mass be sung daily in the same, but also in the General Rubrics, whose most exact observance we commend to your Fraternities, it is prescribed that on certain days not one, but two, and sometimes even three Conventional Masses be celebrated on one day. Therefore, since it was recently said by Us that the first Conventional Mass should be celebrated daily and applied for Benefactors in general; now it remains to be considered whether you ought to compel the Chapters of the same Churches respectively subject to your Jurisdiction to apply the other Masses too, if more, as aforesaid, should happen to be celebrated, similarly for Benefactors in general.

35 § 21. Such a question was proposed to the aforesaid Congregation of Our Venerable Brethren, the Interpreters of the Tridentine Council, by some of you burning with ecclesiastical zeal. And before its proposal it had already been ascertained that a response had been given by the same Congregation, that exemption should be granted from the burden of applying the second and third Conventional Mass for Benefactors in general, having regard to the poverty of Canonries and Benefices; from which it could be inferred that such an obligation of application should remain where the matter concerns not poor Churches.

36 § 21. This question was proposed to the aforesaid Congregation of Our Venerable Brethren, the Interpreters of the Council of Trent, by some of you burning with ecclesiastical zeal. And before its proposal it had already been ascertained that the same Congregation had previously responded that exemption ought to be granted from the burden of applying the second and third Conventional Mass for Benefactors in general, having regard to the slenderness of Canonries and Benefices; from which it could be inferred that the obligation of such application should remain where the matter did not concern poor Churches.

37 § 22. But since We have not found this rule for defining the question properly established by ancient observance in the aforesaid Congregation, and since the same Congregation has recently deemed that the solution of this doubt should be referred to Our judgment; We judge thus, and We indicate this to be observed by You: namely, that those are to be praised, and to be exhorted, and to be confirmed, who of their own accord apply the third or third Conventional Mass for Benefactors in general; but those who do the same by virtue of a custom prevailing in their Church are to be commanded to persevere in that custom; Where, however, this is not found to be received in practice, complete freedom of applying the second and third Conventional Mass is to be left to those celebrating, provided that in the commemoration for the Deceased, the Benefactors of the Church in general are not forgotten. § 23. Finally, bringing Our Letter to an end, We earnestly exhort Your Fraternities to bring the greatest care and vigilance to bear, so that in the Choirs of Your Churches, besides devout celebration and proper application of the Conventional Mass, the Canonical Hours may be sung not hastily, but exactly, with pauses interspersed, and with the greatest reverence and religion as is fitting.

38 § 24. Indeed We know that in some Metropolitan and Cathedral Churches, an opinion has prevailed among the Canons, that they sufficiently fulfill their duty while being present in the Choir, even though they impose silence upon themselves, and do not join themselves in singing with the Beneficed Clergy or Vicars in the chant. In confirmation of this opinion, however, they are accustomed to adduce long-established customs, particular statutes, or even alleged Privileges of their Churches. But since the Council of Trent in session 22, chapter 12, speaking of Dignities and Canons who ought to be present in the Choir, says that one of their duties is in the Choir appointed for singing, to praise the name of God in Hymns and Canticles reverently, distinctly, and devoutly; and since there are very few Chapters in which Canons assist in the Choir in this manner, and therefore the discipline received in the universal Church is known to be opposed to those few; since moreover that opinion has never been examined in the Congregation for the Interpretation of the Council of Trent without being immediately rejected and disapproved; although it was supported by presumed customs and other foundations and reasons, even when the Canons of the Patriarchal Churches of this Our City urged it; since finally the same judgment is found to have been pronounced by several Provincial Councils, approved and confirmed also by this Apostolic See; nothing now seems to remain why the smaller number should not accommodate themselves to the universal law. Indeed it is not at all known to Us by what particular title those Canons of one or another Church are supported in being persuaded that they satisfy their duty by simple presence in the Choir without the singing of Divine Psalmody. But unless there be at hand an Apostolic Privilege or Indult not presumed, but legitimate and in force, it is rightly and deservedly to be feared that these men, while conducting themselves thus, do not make the fruits of Prebends and distributions their own, and consequently that they are bound to their restitution. Wherefore it will be Your part, Venerable Brethren, to lay open all these things to them, so that neither to Us nor to You before the Divine Judge may it be a source of reproach, if in a matter of such importance, namely one which directly concerns the worship of God Himself, we should be found to have fostered and confirmed by our dissimulation and silence the abuses and corruptions which we ought to have eradicated by reproof and rebuke. Meanwhile We most lovingly impart the Apostolic Blessing to Your Fraternities, whom We embrace with the deepest affection of Our heart. Given at Rome at St. Mary Major on the 19th day of August, 1744, in the fifth year of Our Pontificate.

BENEDETTO XIV PAPA.

2 Venerabili Fratelli, salute e Benedizione Apostolica.

9 POBT, A. V.
