Bull erecting the Diocese of Secusio (Susa) from the Abbey of San Giusto
1 Erection of a bishopric in the city of Susa in the kingdom of Sardinia, made from goods already pertaining to the abbey called St. Justus, by Clement, bishop
2 Servant of the servants of God
3 To the perpetual memory of the matter.
4 § 1. That the Lord of the harvest would send labourers into his harvest, lest the abundant crops growing day by day in the field of the Lord should sometimes lie rotting on the ground for want of them—this is a matter which We rejoice has come to pass in the Lord, seeing the number increased of those called to share in the burden of Our solicitude, who by their diligent labour at last place this harvest in the Lord's barn with prosperous outcome. Wherefore We, who bear the place of the heavenly father of the household on earth, and strive to follow his footsteps insofar as it is granted to Us from above, whenever the occasion first presents itself to Us of increasing the number of faithful dispensers of God's mysteries, by whose aid the divine worship is promoted more and more, and the salvation of souls is furthered through the institution of some new episcopal see, We do not fail to grant it readily and with willing mind, especially when the royal piety itself requests it.
5 § 2. Not long ago, in the name of Our most beloved son in Christ, Charles Emmanuel, the illustrious King of Sardinia, through Our beloved son, the noble man John Baptist Balbis Simeon, Count of Rivera, knight of the great cross and perpetual commendator of the renowned order of Saints Maurice and Lazarus, his minister of state and plenipotentiary minister with Us, it was signified to Us that for the spiritual utility and advancement of the people and clergy, it would be most opportune, indeed necessary, that from the monastery, the abbey called St. Justus of the town of the city called Susa, of no diocese in the province of Turin, which through the free cession made into Our hands by Our beloved son, Peter Joachim Caisotti, a presbyter holding it in commendam by apostolic concession and dispensation, and admitted by Us, should be destitute of the rule of an abbot, one bishopric should be instituted.
6 § 3. We, observing the approved custom in similar matters, selected Our beloved son, the cardinal Charles Victor Amadeus, of the title of St. Praxedes of the Holy Roman Church, called de Lanceis, a presbyter, and committed to him that he should thoroughly examine this entire matter, require those having interest in it, and remit to Us a full report of the whole proposed affair. § 4. And when the same Charles Victor Amadeus, cardinal, whose great faith and diligent and careful concern in ecclesiastical matters is abundantly evident, duly performed all that he had in his charge, and from his report and authentic documents transmitted to the city We have carefully ascertained that the town, the city called Susa, an illustrious and most ancient fortified gateway of Italy, and the ample head of the province, together with a garrison of chosen soldiers, is filled with about five thousand inhabitants, royal ministers presiding over the juridical, military, and economic administration reside there constantly, nor are schools of good arts publicly lacking for imbuing youth with learning, and two hospitals lie open for the refuge of the sick; but in spiritual matters it is subject to no bishop, but in the same town and throughout the entire territory the abbot of the said monastery of the order of St. Augustine of regular canons of the Lateran congregation, a perpetual commendator, exercises ordinary jurisdiction as if episcopal. § 5. Moreover, an increase of no small dignity has accrued to it, with which Our predecessor of blessed memory, Pope Benedict XIV, proceeding with the deficiency of regular canons who formerly inhabited the same monastery, by his apostolic letters erected that church into a secular and distinguished collegiate church under the invocation of St. Mary and of St. Justus the martyr and St. Maurus the abbot, and in the same four dignities, namely the archdeaconry, the archpresbyterate, the prepositure with the care of parochial souls united to it, and the treasurership, as well as fourteen canonries and as many prebends, of which two are assigned the duties of theologian and penitentiary, and four mansionaryships, although on account of the deficiency of revenues now reduced to two, and honoured with other graces. § 6. The revenues of the same monastery, although they are found to amount to only three hundred florins per month in the books of the apostolic camera taxed for the bishop, nevertheless annually amount to about fourteen thousand pounds of the money of those parts. On account of these circumstances of affairs, therefore, means would not seem to be lacking that some detriments should at length cease there, which are wont to arise from the want of a proper resident bishop, and especially that provision should be made for the education and advancement of the clergy.
7 reperiantur, nihilominus ad quatuordecim mille libras circiter monaetz illarum partium annuatim ascendunt. Ob has itaque rerum circumstantias media non deesse viderentur, ut aliqua tandem inibi desinerent detrimenta, quæ deficiente proprio residente episcopo, eriri soleat, et præcipue cleri educationi, ac profectui consuleretur.
8 § 7. But because the assignment of the territory of the same monastery to a diocese seemed not sufficiently ample for the dignity of the episcopal order, it was therefore thought to provide for the future amplification of the diocese, and to procure similar advantages in other intermediate and adjacent places. For indeed, since the territory of the Susa monastery, as it extends toward the setting sun, has bordering upon it another territory of a similar monastery and abbey likewise called of the Saints Peter and Andrew of Novalitium, also of no diocese, in the same province comprising three places, namely Novalesa, Venaux, and Ferriere, in which the abbot thereof, perpetual commendatory, exercises jurisdiction in like manner almost episcopal; and since the beloved son Peter Anthony Sineo, presbyter, the present abbot perpetual commendatory of the aforesaid monastery, in the year above mentioned, in order to discharge his duty, had traversed those three places with pastoral visitation, and had learned of grave detriments occurring in the same places on account of the deficiency of a proper bishop, by special agreement, which is recorded among the acts transmitted to Us by the same Charles Victor Amadeus cardinal and delegate; in the hands of the said Charles Victor Amadeus cardinal and delegate, with certain preeminences and rights, however, enunciated in the same agreement being reserved to himself, he freely ceded ordinary quasi-episcopal jurisdiction in the three aforesaid places for the following effect in the future, as is evident from the same acts transmitted to Us by the same Charles Victor Amadeus cardinal and delegate; from the same acts it appears that the town of Susa is proximate on one side to three valleys called Bulx, Bardonèche, and Sezana, in which are situated the underwritten places, namely Chamont, Bardonèche, Exilles, Arnaud, Salbetram, Meleset, Pulx, Deserte, Sauxe d'Oulx, Fenil, Savoulx, Cesane, Chateau, Beolard Bousson, Beolard Thures, Milauries, Rochemoles, Sauxe de Cesane, or St. Restituta, comprehended under the rule of the town of Susa in temporal matters and subject in spiritual matters to the provostry of Oulx, now pertaining to the diocese of Pinerolo, and on the other side four lands depending on the spiritual jurisdiction of another monastery and abbey likewise called of St. Michael of Clusa, also of no diocese, of the aforesaid province, called Vales, St. Antonino, Chiusa, and St. Ambrose, so adhering that they extend almost within the territory of Susa, and since a long series of mountains intersects the same valleys from the rest of the Pinerolo diocese, which prevents the inhabitants thereof, especially in winter time, from passage to the city of Pinerolo except by long journeys, and moreover the four aforesaid lands subject to the spiritual jurisdiction of the monastery of St. Michael of Clusa are very near to the territory of Susa; for this reason, when a new bishop shall be appointed to that see, it seems most fitting and opportune that his pastoral solicitude should extend to the same three valleys and four aforesaid lands.
9 § 8. When all these matters had been duly perceived by the beloved son Master Peter Mary Nigrone of the consistorial congregation and of Our venerable brethren the cardinals of the college of the Holy Roman Church and secretaries, who also exhibited to Us the autograph consents both from Our venerable brother Francis Lucerna Horengo of Rorà, archbishop of Turin, and from the beloved sons the chapter and canons both of the metropolitan church of Turin and of the said collegiate church, and from Peter Anthony the aforesaid abbot commendatory, and when all the circumstances of the matter had been carefully weighed, We understood that the erection of a new episcopate in that region was most necessary and useful.
10 § 9. And immediately We rendered thanks to almighty God, that He has so poured forth into the same Charles Emmanuel king such religious and pious sentiments toward the happiness of his subjects; then, moreover, being informed of his adverse health, We beseech with assiduous and earnest prayers the Lord of lords, that, bestowing upon him all prosperous and favorable things, He may restore him first and foremost safe and flourishing in good health to his kingdom and dominions, so that he may continue to heap upon him day by day, and more abundantly, new merits upon his former ones. Being therefore most willing to comply with the wishes of the same Charles Emmanuel king, the said monastery of St. Justus and its collative title and regular quality, so that it may henceforth not be able to be conferred or granted in title or commenda, and that it be regular. There accede the consents of the bishop of Turin and of the canons of the metropolitan church of that city, so that the erection might be made more freely.
11 By apostolic authority the erection of the episcopate is decreed and the abbey of St. Justus is suppressed.
12 cease, and likewise the collegiality in the aforesaid church of St. Mary, and of Sts. Justus and Maurice, we completely suppress and extinguish respectively for the purposes set forth below, and the ordinary quasi-episcopal jurisdiction in the three aforesaid places we, having attributed to him the rights and preeminences written below, renounce and separate from the commendatory abbot of that monastery. Therefore from now, but as to effect immediately when the church of Pinerolo shall have become vacant in any manner, and the commenda of the said monastery of St. Michael shall have ceased, or our venerable brother Charles Albert, bishop of Ostia and Velletri, cardinal of the Holy Roman Church, called Guidobono Cavalchini, commendatory of the same monastery of St. Michael, or also our venerable brother John Baptist of Orilia, bishop of Pinerolo by the favor of the new bishopric of Susa, insofar as it shall have been opportune for them, shall respectively have given assent, the aforesaid three valleys with the places named within them situated in the diocese of Pinerolo, and also four lands subject to the ordinary ecclesiastical jurisdiction of the aforesaid bishops of Pinerolo and of the commendatory abbot, we separate, dismember, segregate, and divide from them alone, but with the dominion and temporal rights of the aforesaid bishop and abbot preserved, and we set apart; and these things being done, the town of Susa into a city with all the rights, honors, and prerogatives by which other cities marked by the Apostolic See, and their citizens use, enjoy, possess, and rejoice, and are able to use, enjoy, possess, and rejoice in any manner in the future. Churches, collegia.
13 and the collegiate church under the same St. Mary is erected.
14 dignities, and canons, and to the church nuncupated Secusino, who shall preside over the same church, and city, and diocese of Secusino, as shall be assigned below, and over all inferior abbots and prelates, saving only as to the abbot of the monastery of Novalitio the preeminences inscribed below, episcopal ordinary jurisdiction, and all likewise and singular rights enumerated in spiritual matters by the same monastery of St. Michael depending upon it by apostolic authority for perpetual future times, the episcopal see of Secusino to be named with the invocations of the holy Justus and Mauritius in a cathedral. § 10. And the said church, which was before a collegiate church, We now erect and constitute into a cathedral with its chapter, dignities, and episcopal offices and duties, so that it may have and exercise freely and lawfully, with its clergy, seal, coffer, episcopal table, and pontifical insignia, as well as rights, faculties, preeminences, prerogatives, privileges, honors, graces, favors, and real, personal, and mixed indults, by which other cathedral churches, their prelates and chapters, dignities and canons in any manner whatsoever use, enjoy, possess, and rejoice, not however by burdensome title or from particular indult or privilege, and may use, enjoy, seek, and rejoice in the future, so that the archdeaconate after the pontifical be the first, the archpresbyterate the second, the prepositure, to which the care of souls of the parishioners shall pertain as before, the third, and the treasurership the fourth dignity, and fourteen canonries not collegiate but of the cathedral church of Secusino shall constitute and form the chapter, and they shall be bound to perform choir service, divine offices, and sacred functions with the same insignia, as well as all and singular burdens of the capitular table and of individual prebends, goods, fruits, revenues, and income and emoluments of whatever kind belonging to the same capitular table and to individual persons, to the praise and glory of almighty God for perpetual future times by this series We erect and institute. § 11. In the new diocese of Secusino, the diocese of Secusino according to what the bishop prefect Charles Victor Amadeus, cardinal, episcopal and delegate, proposed from now, the city itself of Secusino where the bishop shall always reside, and the territory and all places pertaining to the ordinary ecclesiastical jurisdiction of the suppressed monastery of St. Justus, and as denominated and recited below, namely Foresto, Chianoco, Bossoleno, Bruzolo, San Giorio, Borgone, Villafocchiardo, Cordave, St. Evasio and Monpantero, Chiavrie, Moechie, St. Mauro, Trassinere, Rubiana, Gelle, Gravere, Novaretto, Mattie, Almese, Giaglione, Villar presso Almese, Meana, and nevertheless saving the above expressed conditions, the aforesaid three places, namely Novalitio, Veneaux, and Ferriere with their boundaries and confines, and all and singular churches, vicars, parishes, benefices, monasteries, convents, clergy, persons secular and regular in the said city of Secusino and the aforesaid places existing and dwelling, it being consulted to the successors of the abbacy of St. Justus suppressed, and to the necessary rights reserved for the time of the monastery of Novalitio, so that the city of Secusino and the aforesaid places with their boundaries and confines shall be subject to the new and for the time being existing bishop of Secusino, as they have hitherto been subject to the commendatory abbot of the monastery of St. Justus, as aforesaid, suppressed, and to the respective commendatory abbot of the other monastery of Saints Peter and Andrew, by the authority aforesaid We concede and assign. § 12. So that the said Peter Aalanius and his successors holding the monastery of Saints Peter and Andrew aforesaid for the time being may also after the aforesaid cession be strong in the prerogatives which We have deemed fitting, We preserve to them the rights inscribed below, and insofar as need be, We grant them in full. First, that to the abbot of the same monastery and his successors as lords the temporal jurisdiction of the said three towns of Novalitio, Veneaux, and Ferriere shall remain unimpaired. Second, that the jurisdiction and any other right inscribed in the abbatial church competent to him in any manner whatsoever shall likewise be reserved. Third, that the abbot of the same monastery and his successors shall be exempt from any ordinary subjection even of the future bishop of Secusino, and shall be immediately subject to the Holy See, as they have hitherto enjoyed such prerogative, and the abbatial church of Novalitio shall likewise enjoy the same exemption with all and whatsoever indults and privileges otherwise granted to it. Fourth, that to the commendatory abbots for the time being of the monastery of Novalitio all preeminences, faculties, insignia, titles, prerogatives, and the use also of pontificals in the proper church alone of the same monastery of Saints Peter and Andrew shall remain unimpaired, insofar as they legitimately pertain to them. Fifth finally, that in favor of the abbots all fruits, revenues, and emoluments of whatever quality and quantity shall be preserved entire, those alone excepted which follow from the jurisdiction ceded to the future bishop of Secusino, and the same shall remain exempt from any contribution whatsoever toward any ordinary and also toward the new bishop, saving nevertheless the rights and if to the rectors by reason of congruity or to others competent it be not derogated. Moreover, for the enlargement of the same diocese of Secusino and to meet the spiritual needs of the neighboring places, even from now, but as to effect in the above expressed events, the aforesaid three valleys of Oulx, Bardonèche, and Sezana, and the enumerated towns namely Chaumont, Bardonèche, Exilles, Arnaud, Salbeltram, Meleset, Oulx, Deserte, Sauxe de Oulx, Fenil, Savoulx, Cesane, Chateau, Beolard Bousson, Beolard Thures, Milauries, Rochemoles, Sauxe de Cesane, or of St. Restituta comprising them, which now are of the diocese of Pinerolo, as well as the four places likewise aforesaid above, that is Vales, St. Antonino, Chiusa, and St. Ambrose subject to the aforesaid monastery of St. Michael, which We, as aforesaid, have dismembered from the diocese of Pinerolo and from the jurisdiction of the said monastery of St. Michael, as aforesaid, respectively, We also attribute and grant to the diocese of the newly erected episcopate of Secusino.
15 § 13. In the same city of Susa, and in the diocese assigned both now and after the aforesaid events, the new and for the time being existing bishop of Susa may freely and absolutely exercise all ordinary episcopal jurisdiction, and that of orders, as it is called, over persons both secular and ecclesiastical, and according to the form of the decrees of the Council of Trent and apostolic constitutions also over regulars, as well as over churches, monasteries, and pious places whatsoever, just as it is competent to other bishops, and shall exercise it; so that it shall be lawful for a person of the same church of Susa, both now from its original erection and institution in this manner, and hereafter for the time being in whatever way deprived of the solace of a pastor, to be placed in the episcopate by apostolic authority through himself or another, or others in his name to take true, real, actual, and corporeal possession of all diocesan right in the said town erected into an episcopal city, and in places assigned to the diocese in the manner and after the aforesaid events by virtue of apostolic letters of provision of his person as bishop of Susa, freely to seize and seized to retain perpetually, no license whatsoever being required; and to the same bishop of Susa for the time being whatsoever and whatsoever ecclesiastical benefices with cure and without cure in any way not occupied, even canonicates and prebends, and dignities, not however the greater pontifical one in the said cathedral church of Susa in the city and diocese aforesaid, in the same manner and form as to abbots in commendam to the bishop of Susa ordinary jurisdiction is granted according to the limits of the decrees of the Council of Trent, and the collation of benefices according to the rule of the chancery.
16 of the Council of Trent, and collation of benefices according to the rule of the chancery.
17 Clement, Pope the Fourteenth, to the bishop of Pinerolo aforesaid, which before pertained to them, occurring in any manner their vacancies, provided however that the aforesaid benefices reserved or affected to the disposition of the Apostolic See shall not have been, we grant and impart authority and power to confer upon suitable persons by full right, and to provide of them. The same church of Susa we decree and establish to be suffraganean and subject to the metropolitan right of our venerable brother the modern and for the time being existing archbishop of Turin.
18 Moreover, as to the endowment and goods assigned for the sustenance of the bishop of the recently erected episcopal see of Susa; let them remain firm by a transaction or agreement stipulated between the aforesaid Peter Joachim then abbot commendatary of the monastery of St. Justus and the chapter and canons of the said collegiate church now erected into a cathedral under the eighth day of November in the year of the Lord one thousand seven hundred sixty-two by public instrument made; which we establish to be preserved unharmed and entire by the future bishop also. And we therefore confirm and approve it; hereafter all revenues pertaining to the suppressed monastery of St. Justus, which the aforesaid Peter Joachim according to a certain transaction, with prior apostolic approval of the year one thousand seven hundred sixty-eight between the same Peter Joachim and the administrators of the royal treasury perceived: as well as the income from a sum of one thousand five hundred pounds of the money of those parts, and also of certain houses and effects existing in the city of Susa.
19 § 15. Which indeed revenues and income, as we have learned, amount to about fourteen thousand pounds of the said money annually, over which however a pension of two thousand six hundred pounds of the same money to the life of the said Charles Albert bishop and cardinal is found reserved by apostolic authority, in the perpetual endowment of the episcopal see of Susa, so that the new and for the time being existing bishop of Susa in the same revenues and income and effects may take true, real, actual possession, administer them, and revenues and income of this kind perceive, exact, levy, and after the burdens inscribed below are fulfilled by him, convert into his own uses and utility, no license whatsoever being required.
20 § 16. Nevertheless, the bishop now in office and existing for the time being is commanded that Secusinus annually pay the sum of seven hundred pounds of the same currency to the canons of the said new cathedral church in supplement of the burden of maintaining the sacristy, otherwise incumbent upon them, restoring the church, and bearing other burdens; and moreover, after the pension in favor of the aforesaid Charles, bishop and cardinal, shall have ceased, he shall be bound to pay another annual sum of two thousand six hundred pounds in favor of the seminary of ecclesiastical boys of Secusinus respectively, by the consent of the said Charles Emmanuel, king, by apostolic authority we appropriate and apply, and respectively unite, annex, and incorporate.
21 § 17. For the habitation and residence of the future bishop and existing for the time being of Secusinus, we assign, attribute, and grant respectively the same house which the said Charles Victor Amadeus, cardinal and delegate, by virtue of a certain decree executed by mandate of Ours on the twenty-second day of the month of May last past, shall acquire, and the other houses of the new cathedral church nearby, in which formerly the regular canons dwelt, for the use of the new episcopal seminary to be erected according to the form of the decrees of the same Council of Trent.
22 § 18. Moreover, in order that the new cathedral church of Secusia may arise from the beneficence of the Apostolic See as a cathedral church meriting such distinction: therefore to the future bishop of Secusia, and to his successors, and to the dignities existing from time to time, to the chapter and canons, and to other persons of this church and chapter, and to its ministers, we grant and indulge to all and each of them all privileges, immunities, exemptions, liberties, preeminences, prerogatives, concessions, faculties, indults, favors, and graces, by which the bishops of other churches and dignities, chapters and canons, and other cities and dioceses, especially of Piedmont, and their property and goods enjoy, use, possess, and are pleased with, or are able to use, enjoy, possess, and be pleased with in any manner whatsoever in the future, that they may freely and lawfully use, enjoy, possess, and be pleased with, and be able to do so even in perpetual future times. Moreover, to the chapter and canons, and to persons holding dignities in the new cathedral church, so that they, insofar as it shall seem opportune, gathered together in chapter for the prosperous and happy state, governance, direction, and regulation of the cathedral church of Secusia, and of its capitular table, sacristy, and fabric, and of their things and goods both spiritual and temporal, and for the fulfillment of the burdens incumbent upon them, for the celebration of masses, canonical hours both daily and nocturnal, and other divine offices, processions, funerals, and anniversaries, also for the distribution of daily emoluments and of whatever revenues, for the imposition of penalties on those absent from divine offices and functions not attending, for the ceremonies and functions to be observed in the new cathedral church, in its choir, chapter, processions, and other acts, and also for appointing and removing ministers, assigning salaries and stipends, and for whatever other matters in the premises and concerning them in any way necessary and opportune, new statutes, ordinances, chapters, and decrees, lawful however and honest, and not contrary to the sacred canons and constitutions and apostolic decrees, but with the approval of the future bishop of Secusia to be approved and confirmed, we grant by the same apostolic authority perpetually full and complete faculty to draw up, issue, and having been drawn up and issued, to change, declare, and reduce to better form according to the variety of times and things, or to draw up others entirely in the manner aforesaid, and to cause them to be observed by those to whom it shall pertain from time to time under penalties to be established against those acting contrary. § 19. Whereas indeed the monastery of St. Justus, from whose revenues the entire endowment of the new bishopric of Secusia is made, is recognized to be subject to the right of patronage of the said Charles Emmanuel, king by reason of the marquisate of Secusia, of which the same Charles Emmanuel, king is also marquis, from foundation, or endowment, or from apostolic privilege, to which nothing has hitherto been derogated in any way: so also to the aforesaid Charles Emmanuel, king, whose merits toward the Holy See increase daily, and to his successors existing from time to time in the marquisate of Secusia, the right of presenting or nominating to the church of Secusia in this first instance from its first erection by us, as aforesaid, as well as thereafter whenever it shall happen that it is destitute of a pastor in any way whatsoever, a suitable person to be appointed by us and the Roman Pontiff existing from time to time to this presentation or nomination to the same church of Secusia as bishop, we similarly reserve by apostolic authority perpetually; we constitute and assign, and the right of presenting or nominating this same to the same Charles Emmanuel, and to the king of Sardinia existing from time to time by reason of the said marquisate of Secusia, and the cause of presenting or nominating, the right which belonged to him to the aforesaid monastery from similar apostolic concession, we constitute and decree to belong, and to be truly royal, and as such in no way to be comprehended under any derogation, nor to be derogated from. § 20. Finally, that the tax in the books of the apostolic camera of the new church of Secusia, as the aforesaid monastery, as aforesaid, suppressed is found taxed in them at three hundred florins of gold, we also decree and enact.
23 § 21. These present letters shall at no time be able to be noted, impugned, invalidated, or called into question on account of any defect of subreption or obreption, or nullity, or of Our intention, or any other defect whatsoever; nor shall any remedy of law or fact or other kind be able to be obtained against them; nor shall they be comprehended under any derogations or other contrary dispositions, if any should be made by Us, but as having been issued and emanated for the increase of divine worship and the spiritual governance and salvation of souls of the people, they shall always be excepted from those, and shall be valid and efficacious, and shall obtain and secure their full and complete effects. So too by whatever ordinary judges and delegates exercising authority of any kind, even auditors of cases of the apostolic palace, and cardinals of the Holy Roman Church, even legates a latere, vice-legates, and nuncios of the said See, with the faculty and authority of judging and interpreting in any other manner being removed from them and from each of them, they ought to be judged and decided; and if otherwise anything should be attempted against these by anyone of whatever authority, knowingly or unknowingly, We likewise decree it to be null and void. § 22. Since indeed the aforesaid Charles, Cardinal of Vittoria Amadeus, has applied himself so diligently to that matter, when he is commanded to preside over the beginning of that work before others, the election of a vicar general is to be performed by secret ballot after the erection of the bishopric has been made.
24 Derogation of contrary provisions.
25 Clement, Supreme Pontiff, the Fourteenth, whom we have chosen by rite; to him therefore according to our will also the execution of all things which we command by these letters is to be entrusted—instructing, we impose upon the same Charles Victor Amadeus cardinal, and we most fully attribute and impart to him all authority of these letters also by their force, so that he himself through himself, or another, or other persons to be deputed by him may solemnly publish these present letters of ours, and the things contained in them in any manner whatsoever, and may cause them to be inviolably observed in their entirety by all to whom it pertains; and may permit the future bishop of Susa, and the chapter of that cathedral church to enjoy and possess them peacefully; not permitting them, and any one of them to be indebted molested by any persons whatsoever exercising any authority: any contradictors whatsoever by sentences, and even by ecclesiastical censures and penalties, and other opportune remedies of law and fact, appeal being set aside, we shall overcome; thus also for the complete execution of these present letters, let him establish that divine service be rendered in the new cathedral church, and its choir. § 23. After the execution of these same present letters by the said Charles Victor Amadeus cardinal, and delegate shall have been completed, within eight days the chapter, and canons of the said erected cathedral church, gathered collegially by secret ballot, ought to elect and are bound to elect a vicar in spiritual matters general, who may exercise that jurisdiction, just as, with the episcopal see vacant, it is exercised by individual capitular vicars. § 24. Notwithstanding the constitutions of Boniface, Pope VIII, our predecessor of happy memory, by which it is provided that no one outside his own city, or diocese, except in certain cases therein expressed and excepted, and in those not beyond one day's journey from the end of his diocese be summoned to judgment, or that judges deputed from the aforesaid See outside the city, or diocese in which they shall have been deputed may proceed against any persons whatsoever, or others, or to others commit their powers, and in the general council issued concerning two days' journeys by any others even in synodal, provincial, and general councils issued, or to be issued special, or general constitutions, and apostolic ordinances: as well as ours, and of the apostolic chancery rules concerning expressing the true annual value, as well as concerning not removing acquired right, and concerning dismemberments to be committed to the parties, those interested being called, and of the Lateran council last celebrated in place: dismemberments and perpetual applications unless in cases permitted by law to be made being prohibited: and the episcopal church of Pinerolo's foundation and erection, as well as of St. Michael of Clusa, and of Sts. Peter and Andrew of Novalitium abbacies also by oath, apostolic confirmation; or any other firmness otherwise strengthened respectively, statutes, and customs; privileges also granted, and apostolic letters whatsoever to superiors, and persons under whatsoever tenors; and forms; and with whatsoever derogatory clauses of derogations, and other more efficacious most efficacious, and unusual clauses, irritant and other decrees also by motu, knowledge, and fullness of power, and also consistorially, or otherwise in any manner whatsoever even repeatedly by our predecessors Roman pontiffs granted, confirmed, approved, and renewed: as well as, insofar as it is necessary, the wills and dispositions of pious testators. All and singular of which, even if for their sufficient derogation special, specific, express, and individual mention of them, and their whole tenors, and word for word, not however through general clauses meaning the same, or some exquisite form to be observed for this were to be made; the tenors of this kind as if word for word, nothing whatsoever omitted, and the form transmitted in them observed, inserted into the same present letters for fully; and sufficiently expressed, and word for word inserted we hold, otherwise in their strength to remain, for the effect of the validity of all and singular of the aforesaid, this time only specially, and expressly, and most widely, and most fully from certain knowledge, and from the fullness of our apostolic power by the series of these letters we derogate, and to all other things contrary whatsoever. § 25. We will, however, that of the same present letters even printed transcripts subscribed by the hand of some public notary; and furnished with the seal of the said Charles Victor Amadeus cardinal, and delegate, the same faith altogether in judgment; and outside it, be given, which would be given to the same present letters; if they were exhibited, or shown.
26 § 26. Let no one whatsoever of mankind be permitted to infringe this page of our suppression, extinction, abdication, disjunction, separation, dismemberment, segregation, division; erection, institution; concession, assignment,
27 Penal sanction.
