Supremi Apostolatus

Bull approving and erecting the Congregation of the Discalced Clerics of the Holy Cross and Passion of Our Lord Jesus Christ

Bull of Pope Clement XIV ·

of the Discalced Regular Clerks of the Holy Cross and of the Passion of Our Lord Jesus Christ.
Clement PP. XIV.
Clement, bishop, servant of the servants of God. For perpetual remembrance of the matter.

1 § 1. The ministry of the Supreme Apostolate having been divinely entrusted to Us not long ago, We have understood that Our principal cares and solicitudes must be directed to this end, that We should in the first place omit nothing, insofar as We are able in the Lord, of those things which conduce to promoting divine worship, to impressing more deeply the mysteries of religion upon the souls of the Christian faithful, and to increasing true piety among the peoples; and truly that We should not leave destitute of graces and privileges, which especially befit this Apostolic See, and which We trust will redound to the spiritual advancement and increase of their own and others' progress, those who, as Our helpers together with Us in the edification of our neighbours and in zeal for the salvation of souls, do not cease to expend their industry and labours, and to bring forth abundant fruits of virtues in the Lord's field, and are hoped to bring forth in the future. § 2. Since therefore Our beloved son Paul of the Cross, superior of the congregation of barefoot clerks of the Passion of Our Lord Jesus Christ so called, both in his own name and in the name of the whole of the same congregation, has set forth to Us that the blessed Pope Benedict XIV, Our predecessor of happy memory, had by his apostolic letters in the form of a Brief specifically approved and confirmed the rules or constitutions of the same congregation, with the faculty moreover granted to interpret and explain the same in the general assemblies of the same congregation, as well as to enlarge and correct them, as should seem more expedient in the Lord, and by the force of that faculty, at intervals of time, the aforesaid rules or constitutions had been explained, enlarged, and reduced into a better form by the general assemblies; and so the said Paul has humbly petitioned Us that We should not only specifically confirm the said congregation's rules reduced into the present form again, but also, to foster the propagation of the same congregation and to preserve its perpetual stability, firmly approve its institute, and by apostolic authority erect it as a congregation of clerks under the invocation of the life-giving Cross and Passion of Our Lord Jesus Christ, and receive it under the special protection of Us and the Apostolic See, and deign to consult more abundantly for its prosperous governance and condition, and to provide, as follows below.

2 § 3. We, desiring that the most holy mystery of the Cross and Passion of Our Lord Jesus Christ, the supreme and most powerful sacrament of divine mercy, wherein is contained the whole reason of Christian hope and salvation, should always remain fixed and impressed upon the minds and hearts of the faithful;

3 and understanding that nothing is more useful to the Christian people than that, according to the Apostolic doctrine of blessed Peter, all should arm themselves with the same thought towards Christ suffering in the flesh, to overcome the enemies of our salvation and to attain the palm of eternal victory, and therefore those who preach

4 tion, and by their example to stir up and inflame all the faithful of Christ to a share in the sufferings of Christ, and judging that they ought to be followed with apostolic favors, the aforesaid Paul a Cruce, superior, and the followers of his congregation and institute, having undertaken so pious and praiseworthy a work, desiring to grant them special graces, favor, and to accede to their wishes in this matter as much as we can with the Lord, we absolve their individual persons from any excommunication, suspension, and interdict, and from other ecclesiastical sentences, censures, and penalties imposed by law or by man for any occasion or cause whatsoever, if they are bound by them in any way, by the tenor of these presents for the purpose of obtaining the effect hereof only, and we consider them absolved; inclined by their supplications humbly presented to us in their name on this matter, from certain knowledge and from the fullness of apostolic power by the tenor of these presents, we receive their entire congregation and persons enrolled therein from now and in the future to be received into it and to be enrolled therein with their houses situated anywhere, which they possess and will possess in the future, under the special protection of us and the Apostolic See, and we constitute them perpetually; and their institute, as having been examined and approved by us from the rules and constitutions, as below, and also from the fruitful experience abundantly testified by many years past, being thoroughly explored, we praise and approve with equal knowledge and authority, and we erect and institute their body and society into one congregation of barefoot clerics of the most holy Cross and Passion of Our Lord Jesus Christ to be called thus, whose followers in four simple vows, namely of poverty, chastity, obedience, and of promoting among the Christian faithful veneration of the most holy cross and grateful remembrance of the passion of the same Our Lord Jesus Christ, and also in the observance of the rules and constitutions written below, shall diligently serve Almighty God and the utility of the Church, supplying all and singular defects of law and fact, if any perchance intervened in its original institution and erection. The rules and constitutions of this congregation, already approved and confirmed by our predecessor of happy memory, Pope Benedict XIV, through his apostolic letters given at St. Mary Major under the fisherman's ring on the eighteenth day of April 1746, beginning Ad pastoralis, and recently with enlargements, additions, corrections, and explanations, which the said superior and clerics, according to the faculty granted to them by the aforesaid Benedict our predecessor, judged ought to be added in their general assemblies, again by our mandate examined at expense, and appropriately reformed, and by us ourselves through similar letters of ours given on the fifteenth day of the current month of November, strengthened by the new protection of our approbation and confirmation, by the tenor of these same presents we praise and approve, and we mandate and respectively establish that by all and singular the clerics of the said congregation, both professed and novices, and also laymen respectively in the future, not however under the guilt of mortal sin, but according to their content and tenor, they be inviolably observed, and according to the same in causes of the congregation itself and of persons enrolled therein they ought entirely to be judged and considered; and to the same superior and clerics, that they wear the habit which they have used hitherto, and in the future also perpetually, and admit into their congregation and fellowship any others whatsoever, both clerics and secular priests, as well as laymen, provided however they are endowed with those qualities which are prescribed in the said rules and constitutions approved and confirmed by us, as aforesaid, and are required by them, and give to them the same habit to be worn, and after the prescribed time of probation has been completed, admit them to the public profession of the said four simple vows, with the proper observances being maintained, who after they shall have made these vows according to the prescribed rite, by no one exercising any ordinary or delegated authority or faculty, except by us and by the Roman Pontiff existing for the time being, or by the general chapter of the same congregation, or the general superior with the counsel and consent of his consultors and others of whom below, can be dismissed from the same congregation, nor can or shall they be released from the aforesaid vows, however simple they may be.

5 § 4. And that they may possess solitary houses, which they now hold with their attached gardens and lands, and retain them, and acquire other houses according to their institute, by the consent and license of those to whom respectively, according to general laws and apostolic constitutions, it pertains, or erect new ones, and construct them with their oratory, church, and humble bell tower, dwellings, cells, and necessary offices, and dwell in them, and observe the regular life and the other observances of their institute therein. In such churches, moreover, they may celebrate masses and divine offices according to the rite of the Holy Roman Church, and decently preserve the most holy sacrament of the Eucharist and the oil of the sick, which they may minister to persons only of their own congregation and family in danger of death, and minister the most holy sacraments of the Eucharist and penance to the faithful, saving the rights of the parish, and expose the same most holy Eucharist to public veneration of the Christian faithful, the general decrees and diocesan laws respectively being observed, and have pious exhortations and catecheses to the people, and bury the bodies of the dead both of the congregation and family and of other Christian faithful who have chosen burial in the same places, the right of the parish being preserved in all things: they may also have hospices in cities, lands, and towns with private oratories, in which masses may be celebrated by license of the Ordinary of the place, and without prejudice to the rights of the parish, on any day of the year except Thursday in the Lord's Supper and Holy Saturday.

6 § 5. Which houses and hospices and the enclosures of attached gardens, which namely by the authority of the superior general or provincial, with boundaries once marked out, we strictly forbid under censures and penalties established against those violating the enclosure of regular men, that no woman ever dare to enter by any pretext, or presume to enter, or be introduced into them; and that in all other places whatsoever, to which they may happen to be sent or called by the Ordinaries of the places to announce the word of God publicly, to hold sacred missions according to their institute to the peoples, and to minister the sacraments of penance and Eucharist to the faithful. But while they shall labor at such missions, or on occasion of them, or for any other cause whatsoever they shall travel, both in public churches and in private oratories fortified by apostolic privilege, they may freely and lawfully celebrate mass one hour before the dawn of morning light, and another hour after midday, and we grant and indulge to them by the same authority and tenor. And that also general, provincial, and particular chapters may be held at recurring times, or for occurring causes judged in the rule, and in them there may be held discussions of the affairs of the whole congregation, or respectively of provinces and particular houses, and opportune decrees may be enacted, and indeed in general assemblies only may the rules themselves and constitutions be interpreted and declared; if anything in them should seem to be changed, cut away, or added, experience suggesting it, it is decreed that this be referred to the Apostolic See; they may dismiss from the congregation clerics professed or otherwise found less suitable, or incorrigible in their defects, or perhaps guilty of graver fault, or respectively, as below, eject and expel them, and most especially in the same general chapters the superior general for the time being and his consultors, and in provincial chapters the provincial superior and his likewise consultors, may perform canonical elections according to the prescriptions of the said rules and constitutions, and may be able to do so, and that these, by the very fact that they have been thus elected, shall be held as confirmed by the authority of the Apostolic See, nor shall they be able to renounce their offices without the assent of the chapter in which they were respectively elected.

7 § 6. Moreover, in their offices let them enjoy full authority to perform, ordain, and dispose of all things which are recognized as attributed to them in the said constitutions and rules, and respectively enjoined and commended to them; and in particular to visit and reform the houses of the same congregation and the persons therein, and to correct and amend such persons according to their merit, to impose penance and punishment upon them, and to transfer them from place to place, the license of the diocesan ordinary being in no way required in these matters. And to the said general superior, when just and reasonable causes concur in particular cases, concerning the observance of the rules and constitutions of the congregation with individual persons to dispense, and also by the counsel and consent of his consultors and provincials, or the greater part of them, according to the changes of times and the exigency of cases, to remit somewhat of the rigor of the same constitutions as regards entire houses or provinces for a time, we likewise grant and impart faculty.

8 § 7. Furthermore, that clerics professed in the same congregation, whom the said general superior or the provincial superiors, with the judgment of at least three examiners assumed by them for this purpose, shall have judged suitable in the Lord, with the consent of the same general or provincial superior respectively, may by dimissorial letters from the diocesan bishop of the house of whose family they are, or with his license from any other Catholic prelate having the grace and communion of the Apostolic See, be promoted and ordained to all even sacred orders and the order of presbyter at the title of poverty, observing what is to be observed; and thus promoted and ordained may and ought to minister in those orders even in the ministry of the altar, the laws retained which are in the apostolic constitutions of Our predecessors, especially of blessed memory Benedict, Pope XIV, concerning the ordinations of regulars, which begins "Impositi Nobis," and in the decrees of the congregation of cardinals, interpreters of the sacred Council of Trent, established and prescribed, we likewise by the tenor of these presents indulge and respectively decree. Yet so that if it should happen that any promoted to sacred orders at the title of poverty of this kind be dismissed from the same congregation, whether at their own request or by decree of superiors as below, after dismissal they shall abstain from exercising the orders received and shall be suspended as regards the ordinary's judgment until it is established that they receive from the annual income constituted for them, whether from patrimonial or ecclesiastical goods, fruit sufficient for their suitable sustenance according to the dispositions of the sacred canons and synodal constitutions. From those, however, who shall have been constituted in the order of presbyter, both individual rectors of houses and masters of novices, and others by delegation of the same rectors or of the general or provincial superior, may hear sacramental confessions of persons of the congregation and household only; but those also who shall have been found suitable and approved by the ordinaries of places for this purpose may hear the confessions of other faithful Christians and sacramentally absolve them according to the tenor of the faculties imparted to them.

9 § 8. Moreover, if any of the clerics or laymen professed in the said congregation, on account of adverse bodily health, or weakness of strength, or for some other just and reasonable cause, should not be able to persevere in the same congregation, and should petition to be dismissed from it and to have the obligation of vows emitted therein relaxed for themselves, or if the superiors themselves, having tested the ingenuity and character of someone, and considering him altogether unsuitable and unfit for fulfilling the works of the congregation and for attaining the end of its institute, should judge that the same person ought to be honorably dismissed from the congregation, or finally if someone should have fallen into some grave crime, which God forbid, or on account of incurable depravity of morals, or on account of confirmed disobedience and obstinacy, should be judged to be expelled and removed from the same congregation, We will that such dismissals, whether expulsions or otherwise, shall not be proceeded with in any other way than in general chapters assembled with the votes of all the capitulars, and according to the judgment of the greater part of them; outside the general chapter, however, by the superior general joined with the councils of his consultors, and also the president of the province and the rector of the house from which those to be professed, dismissed, or expelled were, and from their sense or that of the greater part of them, inquiry being made in writing and exhibited and given by these. But just as in weighing the reasonable causes of such dismissals, and in determining such dismissals, whether at the petition of those seeking it or ex officio, We have established that no other reason than that of religious charity and Christian prudence is to be had: so if it should happen that one proceeds to the expulsion of someone criminal or incorrigible in his vices and defects, We do not wish that more rigorous inquiries into causes and crimes be instituted, as is customary in ordinary courts, or that any formal process be drawn up, but only the truth of the fact being examined, and having regard to the persons, places, times, and other circumstances, from which the gravity of faults and vices is usually estimated, whatever shall seem expedient in the Lord according to the form of the aforesaid rules and constitutions, all appeal and recourse being set aside, shall be judged and decreed. Furthermore, just as those whom either of their own accord seeking it, or by the prudent judgment of superiors it has happened to be dismissed from the congregation, shall be said to have contracted no mark whatsoever on account of which they are to be barred from sacred orders and their exercise, or from ecclesiastical benefices and offices, to which otherwise they are suitable or whom they are found worthy, so also We decree that those who by their own fault, but without the judicial order being observed as aforesaid, have been expelled from the same congregation, shall by no means be subject to the graver penalties which in the apostolic constitutions, especially of Urban VIII of happy memory, are established for those expelled and removed from regular orders, unless insofar as their crimes have been brought to the external forum and there proved, or are otherwise notorious and subject to more severe canonical censure.

10 § 9. Since truly those who neither sow nor reap nor gather into barns must live from the alms of others, and especially those who, in order to provide others with spiritual food, do not cease to labor day and night, therefore We to the men of the aforesaid congregation seeking alms from pious Christian faithful in three seasons of the year especially, namely harvest, vintage, and the pressing of oil, and also by themselves in other ways, grant and impart in perpetuity the faculty not only through the dioceses in which the houses of the aforesaid congregation are at present situated and shall be in the future, but also if need presses through others, where no house of the same congregation has yet been built, provided however that the written license of the Ordinary of each diocese in which it shall be necessary to seek alms, whether for a certain or indefinite time, be previously obtained, and We perpetually forbid and prohibit that anyone impede, disturb, and prohibit in seeking, receiving, and collecting such alms, whatever cause, right, custom, privilege, indult granted to any persons, congregations, orders even of regular and mendicant friars by any authority even by the Roman Pontiffs Our predecessors, to which effect alone, insofar as it is necessary, We expressly derogate, notwithstanding anything whatsoever.

11 § 10. And also that from the same donations, and other contracts among them, as well as from wills, codicils, and other final dispositions, even those less perfect in form, they may receive whatever sums of money, and annual payments of money, or of grain and fruits, oil and wine, not however with perpetual burdens of masses, but by way of alms, and by law, so that for obtaining these no action which they might pursue in judgment shall be deemed to belong to them, both in the foundations of houses themselves, and otherwise whenever they may take and receive, we likewise grant and indulge.

12 § 11. That all and each of the clergy and laity of the same congregation, both professed and novices, may more fervently apply themselves to the pious exercises befitting their institute, and may more eagerly perform the offices of the same congregation, We, trusting in the mercy of almighty God and the authority of the blessed Apostles Peter and Paul, to each of them, as often as they attend conferences, whether public or private, for recalling the memory of the Passion of Our Lord Jesus Christ, or for procuring the reform of morals, or shall fulfill the prescribed acts of divine worship and piety or mortification, whether in common or in private according to the prescription of the rule, or shall exercise any work of spiritual or corporal mercy toward their neighbors, we remit so many times forty days of the penances enjoined upon them or otherwise in any way due in the customary form of the Church, and we extend the same indulgence to all those, whether secular or regular ecclesiastics and laity, who shall in any way have aided or relieved the members of the same congregation in missions and catecheses to be held among the people, and in other works of piety to be promoted among the faithful, as also to those who shall withdraw to the house of the aforesaid congregation to devote themselves to spiritual exercises, during the course of such exercises. Finally, all and singular privileges, indults, indulgences, and remissions of sins, faculties and spiritual graces, with which similar congregations of clerks, whether secular or also regular, and their houses, both regular and general, and other superiors, officials, ministers and persons, by apostolic concession or otherwise in any way, use, enjoy and possess, and are able and shall be able to use, enjoy and possess in the future, to the same congregation of barefoot clerks of the most holy Cross and Passion of Our Lord Jesus Christ, and to its houses, and to the general superior and other superiors, officials, ministers and all other persons whatsoever now and for the time being existing, by the same apostolic authority and by the tenor of these presents we grant and extend and enlarge, and all and singular of these, just as if they had been granted principally to them and specially and expressly, and not merely in the manner granted, and expressed in these presents and inserted word for word, and moreover of all prayers, fastings, penances and other spiritual and good works which are performed in all regular orders, we fully communicate the merits to the said congregation of barefoot clerks, and to its aforesaid persons and respectively to the houses.

14 of the same congregation, both clerics and laymen, whether professed or novices, may more fervently apply themselves to the pious exercises suited to their institute, and may more eagerly perform the offices of the same congregation. We, trusting in the mercy of almighty God and the authority of the blessed Apostles Peter and Paul, His apostles, do grant to each and every one of them that as often as they attend conferences, whether public or private, for recalling the memory of the Passion of Our Lord Jesus Christ, or for procuring the reform of morals, or as often as they fulfill the prescribed acts of divine worship and piety or mortification, whether in common or in private according to the prescription of the rule, or exercise any work of spiritual or corporal mercy toward their neighbors, so many times do we remit forty days of the penances enjoined upon them or otherwise in any way due in the customary form of the Church. And we extend the same indulgence to all those, whether secular or regular clergy and laymen, who shall in any way have aided or assisted the members of the same congregation in missions and catecheses to be held among the people, and in other works of piety to be promoted among the faithful, as also to those who shall depart to the house of the aforesaid congregation to devote themselves to spiritual exercises, during the course of such exercises. Finally, all and singular privileges, indults, indulgences, and remissions of sins, faculties and spiritual graces, with which similar congregations of clerics, whether secular or also regular, and their houses, both regular and general, and other superiors, officials, ministers and persons enjoy and make use of and are able to enjoy and make use of and shall be able to in the future by apostolic concession or otherwise in any way, we grant to the same congregation of barefoot clerics of the most holy Cross and Passion of Our Lord Jesus Christ, and to its houses and to the general superior and other superiors, officials, ministers and all other persons whatsoever now and for the time being existing, by the same apostolic authority and by the tenor of these presents, and we extend and enlarge them to and for it and them, and all and singular of these things we grant as if they had been principally conceded to them and specially and expressly, and not merely in the manner conceded, and expressed in these presents and inserted word for word. Moreover, we fully communicate to the said congregation of barefoot clerics and to its aforesaid persons and respectively to its houses all the merits of prayers, fastings, penances and other spiritual and good works which are performed in all regular orders.

15 We decree that these Our present letters shall always and perpetually be valid, firm, and efficacious, and ought to obtain and secure their full and complete effects, and that at no time, from whatever cause or for whatever reason, on account of any defect of subreption or obreption, or of nullity or invalidity, or of Our intention, or any other defect whatsoever, however great, substantial, unforeseen, and unforeseeable, or requiring specific and individual mention or expression, or from any other cause and right established by statute or any custom whatsoever, however just, which would necessarily have to be expressly stated for the validity of the aforesaid, they may be noted, impugned, invalidated, retracted, called into question or controversy, or reduced to the terms of law, or against them restitution in full, reduction to the way and terms of law, or any other remedy whatsoever of law or fact or grace, or of justice be obtained; nor shall these present letters be comprehended under any general revocations, suspensions, limitations, modifications, derogations, or other contrary dispositions made by Us and Our successors the Roman Pontiffs for the time being, and the aforesaid Apostolic See, even by Our own motion from certain knowledge and fullness of power, from whatever causes for the time being; but they shall always and entirely be excepted from them; and thus, and not otherwise, in all and each of the aforesaid matters, and not otherwise, by whatever ordinary and delegated judges, even auditors of causes of the apostolic palace, and cardinals of the Holy Roman Church, even legates a latere or vice-legates, and nuncios of the said See, or any others whatsoever exercising any authority, power, prerogative, and privilege, and shining in honor and preeminence, the faculty and authority of judging and interpreting otherwise being taken from them and from each of them, in whatever judgment and whatever instance they ought to be judged and decided; and if otherwise anything be attempted against these by anyone whatsoever with whatever authority, knowingly or unknowingly. § 13. Wherefore We earnestly exhort in the Lord Our venerable brothers, the patriarchs, archbishops, and bishops, and Our beloved sons the Ordinaries of those places in whose dioceses and territories monasteries, houses, and hospices of the said barefoot clerics have already been erected, and by the blessing of the Lord shall be erected, as well as those to whom these same barefoot clerics, with the permission of their superiors, shall especially present themselves for performing evangelical works, that they receive them as zealous laborers in the vineyard of the Lord and cause them to be received by others, and hold them as most commended for Our reverence and that of the Apostolic See; and nevertheless to these same patriarchs, archbishops, and bishops, and other Ordinaries aforesaid, We also enjoin by this present series, that they themselves and each of them, by themselves or through another or others, solemnly publishing these letters and the things contained in them, as often as need shall be and as they shall be required on behalf of the said barefoot clerics, affording them effective assistance of defense in the aforesaid matters, shall cause them by Our authority to enjoy and possess these letters and the things contained in them peacefully, not permitting any molestation whatsoever to be unjustly inflicted upon them or any of them in the aforesaid matters by anyone, repressing any contradictors whatsoever by Our authority, appeal being set aside. § 14. Notwithstanding, insofar as it shall be necessary, Our and the apostolic chancery rules regarding acquired right not to be taken away, and regarding indulgences not to be granted in the manner of, and other things made in contrary to the aforesaid in any way, special or general apostolic constitutions and ordinances; privileges also granted and apostolic letters of any kind whatsoever to other regular orders and their persons, even worthy of special mention, under whatever tenors and forms, and under whatever derogatory clauses of derogations and other more efficacious and unusual clauses, irritant and other decrees in general or in particular, even by Our own motion or otherwise in any way whatsoever made, approved, confirmed, and renewed in contrary to the aforesaid; all and each of which, even if of them and their whole tenors special, specific, and individual mention, or any expression word for word, and not by general clauses importing the same, or whatever other exquisite form to be observed for this should have to be made, holding the tenors of all and each of them as fully, sufficiently, and word for word inserted and expressed in these presents, which would otherwise remain in their force, for the effect of all the aforesaid this time only most broadly and fully, and specially and expressly by this series We derogate, and to all other things whatsoever in contrary. But in order that these Our letters may more easily come to the knowledge of all; We will that to their transcripts even printed, subscribed by the hand of some public notary and furnished with the seal of a person constituted in ecclesiastical dignity, the same faith be given in judgment and outside it as would be given to these presents themselves, if they were exhibited or shown in the original. Let no man whatsoever be permitted to infringe this page of Our absolution, reception, confirmation, approbation, erection, institution, concession, impartation of indult of faculties and privileges, decree, derogation, and will, or to dare to act contrary to it with rash presumption; if anyone, however, shall presume to attempt this, let him know that he will incur the indignation of Almighty God and of the blessed Apostles Peter and Paul His. Given at Rome at St. Mary Major in the year of the incarnation of the Lord one thousand seven hundred sixty-nine, on the sixteenth day before the Kalends of December, in the first year of Our pontificate.

ricorum regularium discalceatorum sanctae Crucis, et Passionis D. N. Jesu Christi.
Clemente PP. XIV.
Clemente vescovo servo dei servi di Dio. Per perpetua memoria della cosa.
