Motu Proprio sull'unione della Congregazione dell'Indice al Sant'Uffizio e sul trasferimento delle indulgenze alla Penitenzieria Apostolica
MOTU PROPRIO ALLOQUENTES PROXIME DI SUA SANTITÀ BENEDETTO XV
1 Recentemente, parlando in Concistoro al Sacro Collegio dei Cardinali, annunciammo la Nostra intenzione di completare la riorganizzazione della Curia Romana, opera insigne del Nostro Predecessore di felice memoria Pio X, anche in quel punto su cui egli fu indotto a soprassedere a seguito di alcune difficoltà sopraggiunte, vale a dire la fusione delle Sacre Gongregazioni dell’Indice e del Sant’Uffizio. Considerata infatti la natura di entrambe le Congregazioni, poiché la censura sui libri, che è il compito della prima, è implicita nella funzione di « proteggere la dottrina della fede e dei costumi », che è propria della seconda, appariva del tutto evidente l’opportunità di unificare le due Congregazioni, anche per evitare quei conflitti di competenza che potevano facilmente nascere tra l’una e l’altra. Ordunque, al fine di realizzare questo proposito, con Motu Proprio stabiliamo e ratifichiamo quanto segue:

- La Sacra Congregazione dell’Indice viene fin d’ora soppressa.
- Il compito fino ad ora peculiare della Sacra Congregazione dell’Indice, quello cioè di esercitare la censura su libri ed altri scritti, sarà d’ora in poi di competenza del Sant’Uffizio.
- Alle funzioni che sono proprie del Sant’Uffizio si aggiungerà una particolare Sezione per l’Indice; ad essa saranno destinati i funzionari che erano impiegati nella Congregazione soppressa. La Sacra Congregazione del Sant’Uffizio redigerà il piano organizzativo di tale Sezione e lo sottoporrà alla Nostra approvazione.
- Ad evitare che con questa fusione si accresca eccessivamente la mole di lavoro del Sant’Uffizio, passerà alla Penitenzieria Apostolica tutto ciò che riguarda le Indulgenze: essa sarà pertanto competente a giudicare su tutto ciò che si riferisce « all’uso e alla concessione delle Indulgenze, fatto salvo il diritto del Sant’Uffizio di esaminare sotto l’aspetto dogmatico le nuove preghiere e devozioni ».
- La Sezione delle Indulgenze che esisteva presso il Sant’Uffizio sarà trasferita, con i suoi funzionari, alla Penitenzieria Apostolica; dell’organizzazione di questa Sezione si incaricherà il Cardinale Gran Penitenziere, dopo averCi consultato. Così stabiliamo e comandiamo, nonostante qualsivoglia cosa contraria, ancorché degna di speciale menzione. DE ATTRIBUENDA SANCTO OFFICIO CENSURA LIBRORUM ET POENITENTIARIAE APOSTOLICAE CONCESSIONE INDULGENTIARUM.
1 Alloquentes proxime in Consistorio Sacrum Cardinalium Collegium, ediximus consilium esse, ut ordinationem Romanae Curiae, praeclarum opus Decessoris Nostri fel. rec. Pii X, perficeremus in ea quoque parte, cui is ob quaedam rerum adiuncta supersedisset, id est Ss. Congregationes coniungendo Indicis et Sancti Officii. Inspecta enim natura utriusque Congregationis, quum censura librorum, quod esset munus unius, contineretur munere tutandi doctrinam fidei et morum, quod esset alterius, ex eis Congregationibus unum fieri omnino apparebat oportere, vel ad praecavendas de competentia controversias quae facile inter eas orirentur. Nunc igitur id exsequentes consilium, Motu Proprio haec constituimus et sancimus:
2 I. S. Congregatio Indicis iam nunc non erit.
3 II. Quod fuit usque adhuc proprium munus S. Congregationis Indicis, erit posthac Sancti Officii de libris ceterisque scriptis censuram facere.
4 III. Ad ministeria quae sunt apud S. Officium, accedat peculiaris Sectio de Indice; eique addicantur Officiales qui exstinctae Congregationi ministrabant. Rationem autem eius Sectionis ordinandae S. Congregatio Sancti Officii definiet, Nobisque probandam proponet.
5 IV. Ne autem Sancti Officii negotiorum moles nimis hac accessione crescat, quidquid ad Indulgentias pertinet, omne iam esto Poenitentiariae Apostolicae: quae quidem pro suo instituto iudicabit de omnibus quae spectant ad usum et concessiones Indulgentiarum, salvo iure S. Officii videndi ea quae doctrinam dogmaticam circa novas orationes et devotiones respiciunt.
6 V. Sectio de Indulgentiis, quae est apud S. Officium, cum suis officialibus, ad Poenitentiariam Apostolicam transferatur: quam ipsam Sectionem Cardinalis Poenitentiarius Maior, Nobis consultis, ordinandam curabit. Haec statuimus et praecipimus, contrariis quibuslibet, etiam speciali mentione dignis, non obstantibus.

ON CONFERRING UPON THE HOLY OFFICE THE CENSORSHIP OF BOOKS AND UPON THE APOSTOLIC PENITENTIARY THE GRANTING OF INDULGENCES.
1 Having recently addressed the Sacred College of Cardinals in Consistory, We declared it to be Our counsel that We should complete the ordinance of the Roman Curia, that illustrious work of Our Predecessor of happy memory Pius X, in that part also which he had deferred on account of certain circumstances, namely by uniting the Congregations of the Index and the Holy Office. For upon examining the nature of each Congregation, since the censorship of books, which was the function of one, was contained within the function of safeguarding the doctrine of faith and morals, which was that of the other, it appeared altogether necessary that one Congregation should be formed from them, both to prevent controversies concerning competence which might easily arise between them. Now therefore executing this counsel, by this Motu Proprio We establish and ordain as follows:
2 I. The Sacred Congregation of the Index shall henceforth cease to exist.
3 II. That which has hitherto been the proper function of the Sacred Congregation of the Index shall henceforth be the function of the Holy Office, to exercise censorship of books and other writings.
4 III. To the offices which are attached to the Holy Office, let there be added a special Section on the Index; and to it shall be assigned the Officials who served the extinct Congregation. The Holy Office shall determine the manner of organizing that Section and shall propose it to Us for approval.
5 IV. But lest the burden of the Holy Office's business grow too great by this addition, let all matters pertaining to Indulgences henceforth belong entirely to the Apostolic Penitentiary: which shall indeed, according to its institute, judge concerning all matters that pertain to the use and granting of Indulgences, saving the right of the Holy Office to examine those matters which concern the dogmatic doctrine regarding new prayers and devotions.
6 V. The Section on Indulgences, which is attached to the Holy Office, together with its officials, shall be transferred to the Apostolic Penitentiary: which same Section the Cardinal Penitentiary Major, after consulting with Us, shall arrange to organize. These things We establish and command, any contrary provisions whatsoever, even those worthy of special mention, notwithstanding.
