1 and the offices of subdeacon through the canons of St. John Lateran and St. Peter and St. Mary Major respectively be performed. 1 From the Register in the Secret. Brev. Alexander Pope VII, for perpetual memory of the matter.

2 § 1. For the pastoral office divinely committed to us, wishing to provide as is due to the canons of St. John, we have established that divine offices in the pontifical chapels in St. Mary Major be celebrated to the glory of almighty God and the splendor of the Catholic Church with that dignity which is fitting, by our own motion, and from certain knowledge and mature deliberation of ours, and from the fullness of apostolic power, so that in perpetual future times in solemn masses, which in the same pontifical chapels by whomsoever, whether by us or by the Roman Pontiff existing for the time being, present or absent, shall be celebrated through our venerable brothers the cardinals of the Holy Roman Church or assisting prelates, the office of the assisting priest be performed by one of the canons of the church of St. John in the Lateran, the office of deacon by one of the canons of the basilica of the Prince of the Apostles, and the office of subdeacon by one of the canons of the basilica of St. Mary Major of the City, by the tenor of these presents we establish and ordain. And therefore the office of assisting priest to our beloved sons the chapter and canons of the church of St. John in the Lateran, and likewise the office of deacon to the chapter and canons of the basilica of the Prince of the Apostles, and the aforesaid office of subdeacon to the chapter and canons of the basilica of St. Mary Major we unite and assign respectively in perpetuity. Willing that, both now in the first place and hereafter, whenever the same offices or any of them happen to become vacant, each of the aforesaid chapters shall elect six canons from their own body, whom they shall have judged in the Lord to be more apt for respectively exercising the aforesaid offices; and our beloved sons the cardinals of the same Holy Roman Church and archpriests of the aforesaid churches and basilicas shall present the six canons thus elected as aforesaid respectively to us and

3 to the Roman Pontiff existing for the time being, from whom we shall assume someone by our judgment, and the Roman Pontiff existing for the time being shall assume; who thus assumed, as long as they live, shall be bound to minister in the office respectively committed to them to the aforesaid cardinals and assisting persons performing the solemnities of masses in the pontifical chapels, and to the same cardinals performing the office of vespers there, us and the Roman Pontiff existing for the time being being absent. But in the event that any of the canons thus assumed be detained by legitimate impediment so that he cannot fulfill the ministry enjoined upon him, we establish that the aforesaid chapters respectively elect others from their body suitable for this, who shall be bound to supply that deficiency.

4 § 2. And decreeing that these present letters,

5 even from the fact that whosoever, even those worthy of special mention, having or in any way pretending to have interest in the aforesaid matters, have not been called and heard to them, or the causes on account of which these present letters were issued have not been adduced or justified, or from any other whatsoever legitimate and privileged cause, color, pretext and ground, even in the body of the law closed, shall at no time be able to be noted, impugned, invalidated, or called into controversy on account of the vice of subreption or obreption, or of our intention or the consent of those having interest, or any other whatsoever however great and substantial defect, but these present letters shall always remain firm, valid and efficacious and shall produce and obtain their full and complete effects, and thus and not otherwise in the aforesaid matters by whatsoever ordinary and delegated judges, even auditors of the causes of the apostolic palace, and the aforesaid cardinals of the holy Roman Church, even legates a latere, and all others whatsoever exercising and about to exercise any authority and power, with authority and power of judging and interpreting otherwise taken away from them and from each of them, ought to be judged and decided, and null and void, if otherwise concerning these things by anyone, by any authority, knowingly or unknowingly should happen to be attempted.

6 § 3. Notwithstanding, insofar as it is necessary, of contrary things derogated.

7 be, our and the apostolic chancery rule concerning not taking away acquired right, and by other constitutions and apostolic ordinances, and of the aforesaid churches and basilicas, and by all other things whatsoever, even by oath, apostolic confirmation, or any other firmness, established and customs, privileges also, indults and apostolic letters, under whatsoever tenor of words and forms, and with whatsoever even derogatory clauses of derogatory clauses, and other more efficacious and unusual clauses, and irritant and other decrees, in general or in particular, even by similar motu proprio, and consistorially, and otherwise in any way contrary to the aforesaid granted, confirmed and many times renewed; all and singular of which, even if for their sufficient derogation there should be observed special, specific, express and individual mention of them and their whole tenors, and word for word, not however through general clauses importing the same, or any other expression to be observed for this purpose, the tenors, forms and occasions of all and singular of them being held by these presents as fully and sufficiently expressed and observed respectively, which otherwise would remain in their force, for the purpose of the aforesaid on this occasion only specially and expressly we derogate; and all other things to the contrary whatsoever.
