Citato in 1 voce dell'Enciclopedia ↓

or books, or merchandise are returned.
1 With vigilant zeal, this Sacred Congregation has continually applied itself to the removal and eradication of abuses concerning the celebration of Masses, and has issued many decrees by which it wished all shameful gain in this matter to be removed, and has commanded that the pious wishes of testators and the faith pledged to benefactors be preserved with exactness and guarded religiously.
2 Wherefore, to restrain the perverse license of certain persons who were making use of Masses to exchange more easily with the clergy for periodicals, books and other merchandise, it established certain provisions, and these, with the approval of Pius IX of happy memory, it caused to be published and made known to the Ordinaries so that they would be observed by all. For when the following doubts had been proposed among other matters:
FROM THE SACRED CONGREGATION OF THE COUNCIL
3 « I. Whether the conduct of those booksellers or merchants who, by employing public advertisements and rewards, or by any other method whatsoever, collect Mass stipends, and repay the priests to whom they entrust the celebration of them, not with money but with books or other merchandise, savors of shameful commerce, and therefore ought to be disapproved and even restrained by Bishops with ecclesiastical penalties, if necessary:
4 « II. Whether this manner of conduct can be excused on the ground that, without any diminution, as many Masses are entrusted to the aforesaid collectors for celebration as correspond to the stipends collected, or because by means of it poor priests lacking Mass stipends are assisted:
5 « III. Whether collections and distributions of such stipends ought likewise to be disapproved and restrained, as above, by Bishops, when the profit which is derived from the exchange of merchandise for stipends is not gathered for the private advantage of the collectors, but is expended for or toward the increase of pious institutions and good works:
6 « IV. Whether those who deliver to booksellers, merchants, and other collectors of stipends the Mass stipends received from the faithful or from pious places concur in shameful commerce, and therefore ought to be disapproved and even restrained, as above, whether they receive or do not receive any reward from the same in return: « V. Whether those who receive from the aforesaid booksellers and merchants books or other merchandise in place of Masses to be celebrated, at the price thereof either diminished or in full, concur in shameful commerce, and therefore ought to be disapproved and restrained, as above: « VII. Whether it is lawful for Bishops, without special permission of the Holy See, to deduct something from the Mass stipends which the faithful are accustomed to deliver to more celebrated Sanctuaries, in order to provide for their decoration and ornament, especially when they lack their own revenues: « in a special assembly of the year 1874 the Sacred Congregation resolved: « To I. In the affirmative.
7 « To II. In the negative.
8 « To III, IV, and V. In the affirmative.
9 « To VII. In the negative, unless by consent of the donors. » 1 But since in these recent years it has been established that these salutary provisions have often been neglected through ignorance or malice
FROM THE SACRED CONGREGATION OF THE COUNCIL
10 and abuses in this matter have become very widespread, the Eminent Fathers of the Sacred Congregation of the Council, interpreters and defenders of the Tridentine decrees, having carefully weighed all matters in a twofold general assembly, have deemed it their duty to recall to the memory and full observance of all what had been decreed long ago, and moreover to strengthen it with appropriate sanction.
11 By the present decree, therefore, they ordain that henceforth if anyone of the priestly order shall transgress against the aforesaid decrees, he shall be liable to suspension from the divine offices reserved to the Holy See and incurred ipso facto: a cleric not yet initiated into the priesthood shall likewise be subject to the same suspension as to the orders he has received, and shall moreover be rendered incapable of receiving higher orders: finally, the laity shall be bound by excommunication latae sententiae reserved to the Bishops.
12 Furthermore, since experience has taught that the evils which are lamented arise chiefly from the fact that a greater number of Masses is accumulated in the hands of certain private persons than just necessity requires, the same Eminent Fathers, adhering to the dispositions given by the Roman Pontiffs, and especially by Urban VIII and Innocent XIII in the constitution Cum saepe contingat, under grave precept of obedience decree and command that henceforth all and each beneficiaries and administrators of pious causes everywhere, or in any way obliged to fulfill the burden of Masses, whether ecclesiastical or lay, at the end of each year shall deliver to their own Ordinaries the Mass intentions which remain and for which they have not yet provided satisfaction, according to the manner to be defined by the Ordinaries. The Ordinaries, having received the Mass intentions with the attached stipend, shall first distribute them among the priests subject to them who are known to be in need of them: otherwise they shall then either commute them to the Holy See or to other Ordinaries, or even, if they wish, to priests of other dioceses, provided they are known to them and of unquestionable character, and shall issue legitimate documents within the prescribed suitable time, by which it may be evident that exact satisfaction of the same has been made.
13 Finally, all indults and privileges whatsoever granted hitherto, which in any way are contrary to the dispositions of the present decree, being revoked, the Sacred Congregation commits to the care and office of individual Ordinaries, that they diligently make the present decree known to all ecclesiastics subject to their jurisdiction, and to others to whom the prescriptions hereof pertain, so that no one hereafter may be able to allege ignorance
EX S. G. CONCILII
14 59* or in any way excuse himself from the observance of this decree: and moreover that they vigilantly watch, whether in sacred Visitation or otherwise, lest abuses in this matter take root again. Moreover, when a report of all these matters has been made to Our Most Holy Lord Leo XIII by the undersigned Prefect of the Sacred Congregation, His Holiness ratified and confirmed this decree of the Eminent Fathers and ordered it to be published, all things to the contrary notwithstanding.
