Bull on the jurisdiction and faculties of prelates and officials for the visitation of prisons in Rome

Bull of Pope Paul III ·

LXII.
Jurisdiction and faculties of the prelates and officials of the visitation of the prisons of the Eternal City, and ordinances to be observed by them 1.

1 Fanlius Pope III, for the memory of future matters. Called by divine disposition to the burden of apostolic servitude, if we desire that the rights of all persons be preserved inviolate and remain unharmed from every burden and loss, and willingly direct the care of our solicitude to the relief of these imprisoned persons, the archconfraternity of Charity takes care, concerning which in the constitution xiii of Leo X, Illius, tom. v, pag. 739. — Regarding the governor of the City attend to Leo X in constitution IX, Etsi pro, ibidem, pag. 619. 20 Christian people, and especially the poor and miserable persons etc, Cherub. (n. t.). Exordium.

2 we apply much care; and indeed much more, in order to protect those imprisoned and the poor dwelling in our Eternal City, by the duty of the office enjoined upon us, we are bound to exercise the functions of apostolic provision, lest they suffer the injuries of undue burdens and grievances and sustain losses.

3 § 1. Wishing therefore to remove the wicked, detestable and unjust frauds and the dishonest desires of the wicked, from which damages could arise to our subjects and the poor pressed by these things, we establish and command by this law, which shall be valid in perpetuity, that the laws, decrees and statutes written below, some of which were provided and wholesomely issued by Clement of blessed memory, our predecessor, for the benefit of these same poor and imprisoned, by motu proprio, from certain knowledge and fullness of power, for the record of the future, are to be observed in all things and throughout, as is described below, by similar motu proprio, knowledge and power. Declaring null and void whatever may be attempted otherwise concerning these things by anyone, by whatever authority, knowingly or unknowingly. Notwithstanding also contrary privileges and constitutions (the full tenor of all of which we consider to be most widely expressed) whatsoever. Which we wish to be made known and posted in public places.

4 § 2. First, that whenever anyone is captured in prison without the mandate of the officials to whom it pertains, unless he be found in the act of crime, or even if captured by mandate, if he be found not guilty, or if he purge himself before the judge, or if to the judge who had him captured, even outside the visitation, or if it seem good to the presidents of the visitation for some reasonable cause, he shall be freely released without any payment for capture and prison and without the hand of executors. And if he be found to have been unjustly captured at the instance of someone, the payment for capture and prison shall be made at the expense of that person; and if anything be exacted by the bargello or executors contrary to the foregoing, it shall be restored to the captured person at his every petition. And in all the aforesaid cases judges in their mandates concerning release, under the penalty of major excommunication incurred ipso facto, ought to provide that he be freely released everywhere. Nor can anything be exacted from the aforesaid imprisoned except under the pretext that they will be able to recover from those who had them unjustly captured. But executors and keepers of prisons shall exact their due wages from those who procured the unjust imprisonment of the prisoners. And the said judges shall cause all expenses, even for sustenance made by the aforesaid imprisoned, to be restored and repaid to them, even by royal hand, by those same who procured them to be unjustly captured and detained.

5 § 3. Those captured, even for the information of the court, as witnesses receiving nothing, shall pay nothing, nor shall they be placed in any way in public or secret prisons, but shall be examined forthwith by judges; once examined, they shall be released to conduct their affairs, otherwise judges for each time shall be fined ten ducats, to be applied only for the relief of the imprisoned, unless it seem good to the governor, auditor, vicar or senator to have them imprisoned for a cause, which they shall be bound to justify to the visitors. And the aforesaid necessary sustenance, as long as they remain in prisons, shall be provided. § 4. And the said judges are able in no way to retain one captured for any grave crime in secret prisons beyond three days before he be examined, but within three days they shall examine such imprisoned person, and according to the disposition of law, either release him if he be found innocent, or place him at large, or retain him in the said secret prisons, as the quality of the deed demands; otherwise the keeper shall be bound to make it known to the visitors at the first visitation, under the penalty of ten ducats to be applied as is written above; unless it shall have been otherwise ordained by our mandate, concerning which mandate the said judges shall be bound to do the same to the visitors; or if the said judges shall have notified the visitors of some just cause for acting otherwise.

6 § 5. The aforesaid judges shall not order anyone to be taken into custody on the mandate of anyone without legitimate and preceding judicial proceedings, unless the governor has legitimately seen fit for a legitimate cause; and then if anyone is to be taken into custody without judicial proceedings, he shall be brought before the same governor. That governor shall cause the instigator to give security for damages, injury and loss, and, as the quality of the person to be imprisoned demands, either compel him to give security for his appearance or send him to prison at his discretion. But if within two days judicial proceedings do not follow, he shall be released.

7 § 6. Any person taken into custody, before the torture of the judicial proceedings or before they subject him to torture, shall not be tortured unless to purge the judicial proceedings laboring against him they legitimately admit it, the copy of the judicial proceedings having been given in the form of a good extract and not a register, with the expression of the names of witnesses, so that the accused may be able to defend himself, except in the crime of heresy and other crimes excepted by law, according however to the disposition of law. And if the judicial proceedings have not been purged (yet first the advocate of the poor or any other at the discretion of the accused shall be heard), then he is to be tortured in continuous act of torture, not however in torture over a long space of time of one or more hours, or diverted to extraneous acts, even to meals, but, as the quality of the fact and of the person to be tortured demands, let them dispatch it forthwith: and let the examiners use clear words to discover the truth, not to entangle the understanding of the accused.

8 § 7. And no one shall be tortured unless legitimated by prior judicial proceedings and witnesses for judicial proceedings repeated, imprisoned and the advocate of the poor summoned in the legitimation and repetition, and to the poor at the discretion of the judges, by whose mandate they shall be detained, let a copy of the judicial proceedings be given gratis, or the process

9 with the judicial proceedings to the advocate of the poor, without any expense, be shown. And if the fiscal procurator, summoned to give interrogatories, shall not have given them within the term contained in the summonses, witnesses for the defense of the imprisoned shall be examined without interrogatories.

10 § 8. The same judges shall not in any way interrogate the accused for one crime about others, concerning which they have no judicial proceedings; but in these as well as in all other matters occurring they are bound and ought to observe the disposition of common law, and judges who have proceeded, when they propose causes in life, shall have the process with them, so that visitors may understand and see that the imprisoned is not defrauded less or more than is due.

11 § 9. And moreover, lest the illiterate suffer undue harm from the bad translation of the words of notaries into Latin,

12 we decree that the words concerning which the accused is interrogated, in the manner in which he himself utters them, shall be written in Latin, if he speaks in Latin, or in the vernacular language by the notary; and if the accused speaks in the vernacular, let there be employed a notary of that language or idiom which is that of the accused, or an interpreter of that language.

13 § 10. And if it should happen that the accused wishes to seek a copy of the judicial proceedings, the same notaries shall provide it in the form of an extract and not a register, and in small and current hand, and for each margin full containing thirty lines, and for each hundred sheets of written pages let them receive no more than five ducats, and thus in proportion in a smaller or larger number of sheets, under the aforesaid penalty to be exacted and applied irremissibly, as is set forth above.

14 § 11. But if the acts were to be transported to another judge, then let a register of the acts be made and let it be paid as is customarily paid in the same court for each hundred folios of the register.

15 § 12. And if any imprisoned person be found innocent

16 Alt. C. 1648 Innocent III it is not paid.

17 their servants shall observe the decrees of the Chamber.

18 Executors the same shall do.

19 Jailers at the visitation Custodians shall present the detained in public, and notification in secret.

20 and for his innocence ought to be released, nothing shall be exacted from him in any court, even on the occasion of any settlement.

21 § 13. The custodians of prisons are bound to observe the decrees of the Chamber otherwise issued: the Tower of Nona, for each cleric, beyond six old carlini; for a layman, beyond three: the custodian of the Tower of Sabellis, beyond two similar carlini indifferently, both for cleric and for layman, even for release or liberation, shall not exact. And if beyond a month, without fault of the jailers, they are detained there, in no way shall duplication be made, as has been observed heretofore.

22 § 14. In like manner the barisellus, marshals and executors, for the fee of their execution shall observe the decrees of the said Chamber, under penalty of twenty-five ducats to be incurred for each time, and to be applied as above.

23 § 15. For honest sustenance, let them not exact more than one carleno in total, provided however that for each occasion of feeding, they take not more than half a carleno, so that if he shall have been fed only in the morning, or in the evening half, as is aforesaid. But for the quality of the time let less or more be paid, provided that one grossus is not exceeded for each occasion of feeding. If truly they shall have been fed in no way, even if in certain prisons they shall have been detained for days in secret places, let nothing be exacted. But those detained in the open prison shall make their own expenses in their own manner, and the keepers of prisons shall not be able to detain prisoners not paying the expenses of food for more than five days in chambers; which days having elapsed, let them place them in public prisons. § 16. Let the said keepers be bound at the time of visitation to present all prisoners, with no one excepted, to the visitors, and to announce in writing those detained in secret; and after they shall have been examined, the examination being finished, let them be presented, and this under the penalty aforesaid of ten ducats for each time of contravention.

24 § 17. And moreover let the said judges not arrest prisoners by arrest of another, but by the mandate of the judge by whose commission he was imprisoned, and he shall proceed in all things against the prisoner; except the governor, who may arrest on account of the cause of the report of arms. Likewise, if any of the judges shall have committed a mandate for the capture of someone, before the governor or another of the said judges shall have committed it, no other judge may concern himself with it, provided that in the book of acts it is evident of the commission of such mandate, and under the same day.

25 § 18. Likewise, notifications made by the governor or other judges, suitable security having been given, shall be observed by all for two months; two months having elapsed, they shall not be observed.

26 § 19. Likewise, a prisoner for some cause by one judge, that judge having released him, may be imprisoned by other judges for a new cause, but not for the same, unless by mandate of us or our chamberlain.

27 § 20. Likewise, that the visitors of prisons visit all prisons once in a week, or at least twice in a week two prisons, unless they shall have been hindered, and let them cause those to be released immediately before their departure from the visitation.

28 § 21. Likewise, that which shall have been deliberated by the common vote of the visitors, let it always be observed and committed to execution, and the keeper of prisons ought to obey them, under the penalty of ten ducats, as is aforesaid to be applied, notwithstanding the contradiction or inhibition of a third party, nor let him who contradicts and alleges after votes have been cast that there is a mandate of us or our chamberlain be believed, unless he shall exhibit it, but let the release be made entirely.

LXII.

18 I visitatori medesimamente facciano così.
