Bull on the reform of the tribunals of the Roman Curia

Bull of Pope Pius IV ·

Dalia.
Reform of the ordinary tribunals and other judges of the Roman Curia, and of the office both of the advocate and procurator of the poor as well as of the fiscal of the Reverend Apostolic Penitentiary.
Pius, bishop, servant of the servants of God, for perpetual remembrance of the matter.

1 § 1. Since from the very beginning of our pontificate we have always held it as a principal concern of our heart that the offices of the Roman Curia and the tribunals of the auditors...

2 ...be reduced to a better form, with all abuses removed which, perhaps from excessive license of past times, had grown up, we have for this reason, turning the attention of our mind first to our Penitentiary, inasmuch as the salvation of souls is chiefly treated therein, issued certain statutes to be perpetually observed for its reform. And then, considering that it also falls upon us, from the duty of the supreme apostolate imposed upon us, not only to apply suitable remedies to spiritual matters, but also to relieve those subject to the temporal domain of the Apostolic See, especially the poor, from burdens, as far as it is possible, and to provide that they be governed rightly in tranquility, we have reduced the offices of our Apostolic Chamber to an honest manner, and have also reformed the office of its auditors and our own.

3 § 2. Now, for the purpose of pursuing the further reform of other such matters, deeming it opportune, indeed necessary, to reduce also the other ordinary tribunals of the aforesaid City and Curia and those depending upon them, and also the office of our fiscal's procurator to the proper standard, having assembled their magistrates and notaries and other officials together on several occasions, and having heard them in our presence and in the presence of certain of our venerable brothers, cardinals of the holy Roman Church, specially chosen by us for this purpose, and having maturely considered all things, even with the counsel of all our other brothers, we sanction, establish and ordain by this constitution to be valid in perpetuity.

4 § 3. That no judge of the ordinary judges over the city of Rome and the Roman Curia, of whatever dignity, in civil cases...

5 ...in civil cases shall receive anything whatsoever on account of fees, even from those willing to give of their own accord.

6 § 4. In criminal matters, however, for fees: for a definitive acquittal sentence from the aforesaid ordinary and mixed judges in crimes in which otherwise a penalty of deportation would be imposed, not more than ten; for deportation below, not more than five gold coins may they receive. And let them take care lest, for the purpose of extorting such fees, they induce anyone unwilling, in any manner, to seek such a sentence through delay in the expedition of cases or detention of the matter in prisons, or through sureties of presenting themselves or not departing, where otherwise there would be no place by law for providing surety, or in any other manner whatsoever. For a sentence, however, in capital cases and of ultimate punishment, or in which otherwise a corporal penalty is imposed, even if in that matter provision is made for the indemnity of the injured or prosecuting party, even of monies, and it is pronounced in their favor, let them receive nothing whatsoever. And for that in which a pecuniary penalty or relegation is imposed and incidentally indemnity is provided for and is also pronounced in their favor, they may have not more than five gold coins. In commissioners' criminal cases, which are namely introduced before them by virtue of a commission from the beginning, not more than double what they are able to receive in ordinary cases.

7 § 5. In civil cases similarly for commissioners, where the matter concerns a sum below twenty-five, nothing whatsoever; from twenty-five up to one hundred, three scudi; from one hundred up to two hundred, six scudi; from two hundred up to any sum whatsoever, ten scudi and not more. For any declaratory sentence, on account of non-compliance with a monition in contumacy, not more than ten carlini. For a declaratory having the force of letters or otherwise having the force of a definitive sentence, if the sum be certain, let them receive as was taxed above; where, however, it be not certain, but the matter concerns the execution of the letters themselves, let them receive according to the quality of the case and person, provided it be not more than five gold coins. For any interlocutory or decree before a definitive sentence, nothing whatsoever.

8 § 6. And similarly for decrees in contracts and obligations of men and women or of things of the Church and pious places, to be interposed in the house of the judges themselves, and also for the quashing of any complaint or process, nothing; for decrees, however, to be interposed outside the house, let them receive only half of one scudo. Which decrees, moreover, shall be interposed by none other than the governor, the auditor of the Chamber, the vicar and the senator and their judges in the aforesaid contracts and obligations.

9 § 7. The Captain of Appeals of the Curia of the Capitol, however, shall receive fees according to the rate delivered to him by the statutes of the City.1

10 § 8. These fees also, taxed above, they may receive in no way except from the hands of the notary of the case, and the judgment first subscribed by themselves.

11 § 9. For the seal, especially in mandates for releasing prisoners, for whatever crime, even capital, and in any other kind of expeditions in criminal cases, let them not exact beyond one giulio 1 Lib. i, cap. 46.

12 In civil cases, the fee of judges for decrees in contracts, the fees of the captain of appeals, the time of reception of fees, the fee for the seal of judges, one, excepted the auditor of the Camera, as to his expeditions requiring the tax only. In civil cases, however, let each exact according to custom. For the seal in expeditions which are made in the Curia, with the clause Si quis, nothing.

13 § 10. From the bargello and from any other Prohibition executors, even of their own courts, let them not presume to receive anything from the bargello, .... . . ..

14 riseiio, ne. reparticulanbus, even if they wish to give willingly, under any pretext whatsoever, nothing at all.

15 § 11. And as to the expedition of prisoners, let them observe in all things and by the motu proprio of Paul III of blessed memory, Paul III, concerning the expedition of the same prisoners issued.

16 § 12. And the same judges, both in criminal and in civil cases, who have been accustomed to have sentences, terms for serving, as in the schedule, and terms for served, must subscribe the schedules of the said sentences and declare the terms for served within ten days absolutely. Nor may they retain citations, in whose terms it happened to pronounce or to have their terms for served, with themselves, but let them leave them with the notaries actuaries. Otherwise the sentences and terms themselves, the said ten days having elapsed, shall be held for circumducted.

17 § 13. Let them not regard nullities, except from defect of citation, jurisdiction or mandate, but, these notwithstanding, let them proceed to the expedition of causes.

18 § 14. Let them expedite cases from two scudi within summary, by royal hand, to the parties of the causes, scudi below, only orally heard and without writings, unless otherwise it seemed to them from reasonable cause, which the judges of Burgi de Sabellis, Ripa, and Ripetta must express in the acts.

19 § 15. The governor once in a month, together with the advocates of the poor and of the fisc and the procurators and the deputy from the Society of Charity, 1 Vide Cartona, vi, pag. 384.

20 attending visitation, beyond the ordinary visitation once in a week to be made, let him visit the prisons, both secret and public, by himself, lest the prisoners be unjustly oppressed by the keepers of the prisons; and let him provide that the table most recently issued by our beloved son Guido Ascanio, cardinal of the holy Roman Church and our camerlengo, and affixed in the same prisons be observed.

21 § 16. But the Protector of Charity and his deputy, with the intervention of the governor and the procurator of the fisc, let him elect two physicians skilled and experienced in their office, namely one a physician, the other a surgeon, who shall visit the sick prisoners and care for them, and concerning their infirmity, when it shall be necessary, let them give proof to the same governor and other judges; and let him provide for them a competent salary to be paid from the penalties of malefactors.

22 § 17. And first of all let him elect some priest, secular or regular, who by election for the confession of prisoners, shall hear the confessions of the same sick prisoners or other prisoners, not however those condemned to final execution, after they have been consigned into the hands of the executors, whose care pertains to the confraternity called the Society of St. John the Baptist of Mercy, let him visit the same prisoners and console them spiritually.

23 § 18. Let no judge, even of Burgi de Sabellis, Ripa and Ripetta, proceed in criminal cases or pronounce sentence, unless the fisc in all acts, in which by law it ought to be cited, be legitimately cited.

24 § 19. Let them not retain in their home as a member of the household any procurator nor advocate, nor also a notary of their court.

25 § 20. The judge of Sabellis shall pay no monies to the judge judged for obtaining the office of marescallo for the time being, nor lend to him, even after obtaining the office, nor under any pretext anything to him; still less may the marescallo himself from the same judge, on any occasion or cause, even in the form of

26 Notaries of the Curia in number, hitherto keepers election, judges of the said Curia and Burgi, Torre Nuova, Ripa and Ripetta syndicate, Camerlengo of Ripa office for six months, Judge of Burgi jurisdiction, Conservators of the City residence in the palace of the Capitol, of whatever pretended indult granted to them by the Apostolic See, or pretended custom, which both and which by these presents we revoke and disapprove, presume to receive.

27 § 21. Let it be permitted to the same marshal to have only two notaries and clerks in his court, nor may he by any pretext increase the number of such notaries. Suppressing from now, as we do suppress, all the offices of notaries of the said Court, except two only at the election of the marshal himself. Yet so that the said two shall be bound to satisfy from the price of their offices.

28 § 22. Likewise the marshal shall in no way lease out the office of commentariensis and captain of his court, but shall cause it to be exercised by faithful and suitable custodians and executors, after they have first been approved by the Governor of the City as custodians of prisons.

29 § 23. The judges of the Borgo and of Sabellis and Torre Nona shall undergo audit before the Governor and the auditor of the Camera at the end of each year; and those of Ripetta and Ripa, at the end of their office before the clerk of the same Camera of Ripa presiding over the audit.

30 § 24. Nor may the same camerarius of Ripa remain in or be confirmed in his office for more than six months.

31 § 25. The cases, however, of those who dwell in the Borgo shall be heard and determined in the first instance before the judge of the Borgo, except for cases of obligations in the form of the Camera, which shall be before their judges, and for wages and cases of miserable persons, which may be introduced at the instance of creditors before all ordinary judges and terminated by them.

32 § 26. The Conservators of the City shall be bound to reside in the palace appointed for them, namely in this manner: the first of them in the first month, the second in the second, and the third in the third, so that one of them shall always reside in the said palace.

33 § 27. They may not in any way grant pardon for statutory penalties or those inflicted by their proclamations, and especially for corporal ones, nor commute them, without the consent of all of them convoked together, and in that case may remit no more than half the penalty; nor may they sign anything in the office concerning such pardons, but shall proceed swiftly to the execution of the same penalties, once their incurrence has been established. And for the execution also of such penalties, especially corporal ones, in the event that they are not carried out by the conservators within fifteen days from the day the crime was reported, any other ordinary judge may proceed, provided that he cause pecuniary penalties to be paid into the hands of the camerarius of the people by the defendants, and does not release the defendants from prisons without the consent of the said conservators. And since their office consists principally in restraining and punishing bakers, butchers, salters, greengrocers, fruiterers and other tradesmen, so that the City itself may abound in all things necessary for sustenance as much as possible, let them abstain from every kind of gift, even from food and drink, from such class of men, nor let them accept anything from them under any pretext. And let them cause their scribe, notary and secretary and faithful and other their officials and especially the extraordinary ones to abstain entirely from these, restraining them by corporal penalty and then removing them from office.

34 § 28. Let them in no way admit such extraordinary ones to the exercise of this extraordinary office unless they have received from them a bond, at least sworn, under a penalty pleasing to the conservators themselves, concerning the faithful exercise of the office itself and the observance of the aforesaid, and concerning their representing themselves for all that they may incur in the exercise of their said office.

35 Of the jurisdiction of the Conservators themselves, the Extraordinary ones of the Roman people, their bond and title.

36 § 29. To which extraordinary ones indeed let them give faith according to the form of the decree lately issued by the modern conservators and not otherwise. Let them compel the greater extraordinary to exercise the office also through himself and through a suitable substitute approved by the conservators themselves.

37 § 30. And the same greater extraordinary and the substitute of his office, and the lesser extraordinary ones of the same, may compel anyone, even by detention of their persons, to permit the weighing of meats and all other things which are under their care, and to declare the price, and those refusing shall be punished for the first time in double the value of the thing found with them, and for another time, if they commit the same, in double and other penalties, even corporal, at the discretion of the conservators; and nevertheless the extraordinary and his substitute and the other lesser extraordinary ones aforesaid shall report all things to the conservators, and shall in no way retain things thus found, but shall be bound to bring them to the conservators themselves. And the bargello and other executors of whatever courts shall obey the same greater extraordinary and his substitute in the aforesaid matters and in others concerning their office.

38 § 31. All executive mandates whatsoever, decreed by whatever judges both in civil and criminal matters, shall be freely delivered to execution everywhere and indiscriminately, throughout, both in the City and in the Borgo and Ripa, with no distinction of places, without the license of anyone and especially of the captain and judge of the Borgo and the camerarius of Ripa, by whatever executors: nor can execution be impeded in any way, even under the pretext that the place is not subject to the judge who decreed the mandate.

39 § 32. The Masters of Roads shall exact from bakers, millers, salters, fruit-sellers and others selling wares in such places, for the price of locations for exposing and selling wares, both in streets and in shops, a fourth part less than has been customarily exacted heretofore, except from those bringing goods for sale to the market in the Piazza Agonalis, from whom they shall exact nothing whatsoever.

40 § 33. For brick-paved streets in the ways, as it shall seem necessary to them, they shall compel the masters of houses, of whatever dignity they may be, or if they themselves be absent or unable to pay, their tenants, by appropriate legal remedies and under penalties at their discretion. They shall take care that from monies exacted from the artificers of the City and deposited, and also from the carters, which shall likewise be deposited, and shall in no way be received by these masters, the streets of the same City and the Piazza Agonalis and the other streets of the said City shall be continuously cleaned at least four times in the year, namely in the months of March, June, September and December. They shall conduct no acts or business of any moment without the request of their notary.

41 § 34. The Sub-masters of these, moreover, the reports which they are accustomed to make as experts, shall make only by means of an oath; and if they shall have done anything through fraud or deceit, they shall incur the penalties of perjury and others at the discretion of the Treasurer and the Clerk of the Chamber presiding for the time being, and shall be condemned to make satisfaction to the parties.

42 § 35. Let them publish at the beginning of their office proclamations under the name of the said Treasurer, and concerning the penalties contained in these and the statutes they shall grant no remission without the mandate of the same Treasurer or at least of the Clerk presiding. In other matters, both as regards appeals from their sentences and as regards all other things, let them observe the new and old statutes.

43 § 36. The Advocate of the Poor shall diligently take care that the imprisoned be not burdened in any way, either by the office itself, as regards food, or also by the executors and keepers of prisons. And for this reason let him never be absent from the visitations of prisons, both public and private; and let him summon the procurators of the poor and their substitutes and also the visitor of prisons to himself once each week, and let him diligently inform himself concerning all the imprisoned, especially those who are held in secret. And if he shall find those procurators or substitutes and the visitor negligent, let him report them to the visitors of prisons and urge that provision be made for others. And since, by reason of his office, he ought to defend the poor freely and act as their advocate, let him accept nothing whatsoever from them. And so that he may more easily render his service to the poor themselves, the visitor of prisons shall, on each day after the visitation of the imprisoned, approach him, and shall be bound to deliver to him in writing the names of those who are imprisoned day by day, and likewise also to the judges.

44 § 37. The Procurators of the same poor and their substitutes shall visit the prisons each day and note the names of all who are brought to them, and the judges by whose order, and also the causes of their detention, and the day on which they are released, and whether before or after dinner or supper, and shall bring all this to the knowledge of the said Advocate, to whom, even if not requested by him, they shall come once in each week and in the meantime as often as shall be necessary for the imprisoned. They shall accept nothing whatsoever from the poor, nor even from other prisoners, even if they be rich, without special license of the Governor or at least of the Advocate of the Poor. The said procurators and substitutes shall in no way be able to intervene against the accused to their offense, even if the cause of the accused be conducted outside the prisons, nor shall the Advocate, by acting as counsel or in any other way whatsoever under any pretext, intervene.

45 § 38. The Advocate of the Fisc shall intervene in all criminal cases and otherwise touching the Fisc, where articles of law shall have emerged, and the Procurator of the Fisc shall be bound to require him for this purpose entirely, and he shall act as counsel in them without any reward. He may, however, receive from those prosecuting their own injury or interest, if they shall wish to give something of their own accord. And he shall likewise be bound to be present at all visitations of prisons, nor shall he assume the defense of the accused, even those existing outside the prisons, but shall pursue the cause of the Fisc for truth and justice.

46 § 39. The Procurator of the Fisc, in the first place, shall see to it that, just as in his admission to his office in the Apostolic Chamber he takes an oath concerning administering it rightly and faithfully, so in its prosecution he shall conduct himself in such a way that he promote no case which he shall have known to be frivolous; and as soon as it shall have been established after the suit has begun, either of frivolousness or of the innocence of the accused, let him desist from it, and not otherwise await the sentence.

47 § 38. The advocate of the treasury shall intervene in all criminal cases and otherwise concerning the treasury, wherever points of law shall have arisen, and the procurator of the treasury shall be bound to require him for this purpose entirely, and in them he shall plead without any fee. He may, however, receive from those prosecuting their own injury or interest, if they shall wish to give anything of their own accord. And he shall likewise be bound to be present at all inspections of prisons, nor shall he undertake the defence of the accused, even those existing outside the prisons, but shall plead the cause of the treasury for truth and justice.

48 § 39. Let the Procurator of the Fisc first ensure that, just as in his admission to that office in the Apostolic Camera he takes an oath concerning its right and faithful administration, so in its prosecution he conduct himself in such a manner that he promote no case which he shall have known to be frivolous; and as soon as it shall be established after litigation has begun that the case is frivolous, or of the innocence of the defendant, let him desist from it, and not otherwise await sentence.

49 § 40. And since, by reason of his office, he is compelled to introduce cases in which the interest of the treasury is at stake, let him accept absolutely nothing from the instigators for any decree or subscription of whatsoever monitory, even for personal appearance; but in the prosecution of cases, only moderate compensation for labor undertaken by him or his substitutes, to the utility and convenience of those same instigators; but let him accept nothing from the defendants, under any pretext whatsoever, and especially from those who have obtained an acquittal sentence, from which the same procurator was unwilling to appeal. Nor even for the imposition of his hand upon mandates for release, by which nevertheless the keepers of prisons, where this is expressly committed to them by judges, without the imposition of the hand of the said fiscal procurator, are bound to obey and to release the imprisoned.

50 § 41. As to contumacy expenses, or those otherwise to be reimbursed by the defendant, if the fiscal advocate or fiscal procurator shall have been present in prosecuting the cases.

51 From the treasury nothing, i.e. from the instigators moderate compensation;

52 And concerning contumacy expenses, if an instigator shall have been present, whether openly or secretly, rejected by notary... [text corrupted]... who make the same, let the fiscal procurator himself, to whom by reason of the condemnation they come to be paid for himself, restore them; but where no instigator shall have been present, the notaries being first satisfied for the fee of their labors, the remainder of the said expenses (since it is not just that the defendant ought to obtain profit from his contumacy) shall be paid to the same fiscal procurator. Let him not interrogate defendants, nor examine witnesses, except in the presence of the judge; and for assistance or examination of defendants or witnesses, whether for the offense or for the defense or otherwise for the defendant introduced, let him accept absolutely nothing, nor even let his substitutes accept anything, and where within the term of citation he shall not have been present at the examination of witnesses, or shall not have given interrogatories, let the witnesses introduced be examined without further delay.

53 § 42. The one cited cannot retain the original citation with himself beyond the day, but must expedite it; he is bound to return it to the courier on the following day, a copy of it having been left if he wishes; in which citation the party, at whose instance it is made, must append the name of the notary, in whose office the case is being handled or ought to be handled, and of the procurator, if the principal is absent from the City; otherwise the said citation shall be deemed null, nor shall it affect the fiscal procurator himself.

54 § 43. Let him not give mandates for the arrest of anyone by word or in writing, except where danger of flight shall have been made known, and a copy of the judge cannot be had immediately.

55 § 44. And since it pertains to the Signature to determine appeals, to him the fiscal procurator by the name of the said protector from sentences against him issued to the defendants, to reject or to commit the matter of appeals; the same procurator is not prohibited from appealing. But, as to the rejection or commission of those, for the quality of cases and persons, the Signature itself, when such cases occur, is able to provide, in whose commission the Signature first cites, before it is signed, the party which obtained the acquittal sentence, and otherwise the Signature shall be of no force or moment.

56 § 45. And since the office of the fiscal procurator principally, as to criminal cases, consists in the prosecution of public vengeance, let him not interpose himself for obtaining inhibitions of superseding in civil cases and especially under the pretext of usuries, except where by law it can be inhibited at his instance.

57 § 46. Nor let remissorial letters be granted to him or even to the instigator, even under the pretext of the indult granted by Paul III of happy memory, except in cases in which otherwise it ought to be granted by law.

58 § 47. Still less let letters be granted to him for capturing judges for the parts, except when first, by some supreme discretion of the judge from whom they are obtained; and then let them not be committed to another than the ordinary of the place, or his vicar, unless there subsist a probable cause of suspicion.

50 § 41. Quanto alle spese contumaciali, o che altrimenti sono rimborsate dal reo, se l'instigatore avrà assistito, sia apertamente sia segretamente, il procuratore del fisco, nella prosecuzione delle cause, nulla riceva dai rei, cioè dagli instigatori moderatamente;
