Bull on the residence of bishops and pastors

Bull of Pope Pius IV ·

on 3 August 1568. TITLE II. CONCERNING CLERICS NOT RESIDING IN THEIR CHURCH OR BENEFICE. (AP. Penalty for bishops not residing in their diocese and neglecting the care of souls. PIUS IV, from the Council of Trent. D: For the salvation of the Lord's flock committed to us from on high, considering this matter attentively, we willingly direct our efforts toward those things by which that flock itself, continually called by divine law to this horrible and execrable crime, may be preserved from harm, and falling into error, may be brought back to the path of rectitude, so that the pastors themselves may more conveniently make that residence, as they are bound to do, and may more willingly and fervently watch over the care of that flock, and may be able to preserve it from the precipices of errors, and to keep it in the orthodox faith and our devotion, we extend effective aid and assistance, as, having weighed the quality of matters and times, we perceive to be salutarily expedient in the Lord. Hence it is that we, by our own motion, not at the instance of any petition offered to us on this matter, but of our mere deliberation, do strictly command and admonish all and each of our venerable brothers, the archbishops, primates, and patriarchs, absent from their churches and dioceses, in virtue of holy obedience, and under the interdict of entry into the church incurred ipso facto, without any other declaration, that, setting aside all other matters, as quickly as possible, those lingering in the Roman curia, within one month, those outside it but in Italy, within two months, and those existing outside Italy, within four months from the day of publication of these presents, the time for travel to be computed in the places hereinafter described, they commit themselves to the journey, and by legitimate routes proceed to their churches or dioceses, and personally present themselves there, and there, as they are bound to do, reside and exercise the pastoral office. If anyone, however, absent from a patriarchal, primatial, metropolitan or cathedral church committed to him by whatever title, name or right, however much he may shine with that dignity, rank and preeminence, ceasing to have legitimate impediment or just rational causes, shall have remained outside his diocese for six continuous months, let him incur the penalty of a quarter of the fruits of one year, to be applied by the superior ecclesiastic to the fabric of the church and the poor of the place: and if he shall persist in such absence for another six months, let him ipso facto lose another quarter of the fruits to be similarly applied: and with increasing contumacy, let him be subjected to the more severe censure of the sacred canons. The metropolitan shall denounce to the Roman pontiff the absent suffragan bishops, and the senior resident suffragan bishop shall denounce the absent metropolitan, under the penalty of interdict of entry into the church incurred ipso facto, within three months, by letter or messenger: who against those absent, as the greater or lesser contumacy of each shall have demanded, may by the authority of his supreme see take action, and provide those churches with more useful pastors, as he shall know to be salutarily expedient in the Lord. Privileges and faculties granted to bishops for the sake of pastoral residence. But wishing to favor with special favors and graces those patriarchs, primates, archbishops, and bishops obedient to our mandates and personally residing at their churches or in their dioceses, so that they may more freely and conveniently exercise their office, we grant to them and to each of them, that when they shall have resided, even under the pretext of whatever crimes and grave excesses, even of heresy and lèse-majesté, committed by them in any way, they cannot and ought not to be dragged or cited to appear personally in the Roman curia by any ordinary or delegated judges, even cardinals of the holy Roman Church, unless by virtue of a special commission signed by our hand or by the Roman pontiff existing for the time being, and we decree and ordain that citations and censures otherwise made against them, and whatever has followed therefrom, shall be null and void, and of no force and moment, and shall in no way affect or bind them. And likewise we, by apostolic authority, by the tenor of these presents, from similar knowledge, completely and entirely exempt and free them and each of them from all and singular tithes, subsidies, and other burdens, ordinary and extraordinary, howsoever named, imposed by us and our successors, the Roman pontiffs existing for the time being, and the apostolic see, even by our own motion and from certain knowledge, and also consistorially, even at the instance of kings and princes howsoever, and from whatever cause, even however most urgent, most just, pious, and necessary, even for the defense of the Catholic faith, by reason of the said churches now and for the time being, and from the payment thereof, nor shall our beloved sons, the modern and existing for the time being camerlengo of the Holy Roman Church, nor also the treasurer of the apostolic chamber, the presidents and clerks, and the collectors and subcollectors of tithes, subsidies, and other such burdens, or exactors and commissioners appointed for this for the time being, even by virtue of privileges, indults, and letters, even derogating from these presents, and expressing the whole tenor thereof word for word, granted and to be granted to them in any way, be able to compel or force them, and on account of non-payment, to incur any such sentences, censures, and penalties; and we decree that they and any of them, in virtue of holy obedience, and under our displeasure, and under excommunication, or suspension, or privation of their offices and benefices, which they hold, and for the time— a Pastoral residence is commended by the Council of Trent, sess. 6. Constantinople, can. 7 and 24. Antioch, can. 17. Athens, can. 39. It is found in can. 20, 7, q. 1, where a bishop not residing in the church, but wandering through various places and refusing to return, is thrust into a monastery. Greg. lib. 5, epist. 23.

1 Concerning clerics not residing.

2 shall obtain, by that very fact incurring the penalties, those same bishops, archbishops, primates and patriarchs, thus residing in the said churches, or their dioceses, as long as they shall have resided in them, as aforesaid, to the payment of tithes, subsidies, and the aforesaid burdens, we most strictly forbid that they dare or presume in any way to compel, or on account of their non-payment to promulgate sentences of excommunication or other sentences, censures, and penalties howsoever. And furthermore to those same bishops, primates, and patriarchs, as is premised, residing, beyond the privileges and indults granted to them by whatsoever Roman pontiffs our predecessors, and the apostolic see, and the general rules and apostolic chancery, which we wish to remain in their force, as delegates of the said see in whatsoever civil, criminal, or mixed causes, against whatsoever particular secular clerics, and also regular clerics howsoever exempted dwelling outside their monasteries or regular places, to proceed by our authority, and to know the said causes, to terminate them with due process, and to cause whatever they shall have terminated to be executed and observed, and to punish, correct, and exercise all jurisdiction over those exempted delinquents for the time being according to their excesses and offences, and to do, exercise, and execute all other and singular things, in the premises and concerning them howsoever necessary and opportune, which we ourselves could do, exercise, and execute, in all things and throughout all things to do, exercise, and execute freely and lawfully we grant full and free license and faculty, by the authority and tenor aforesaid. Decreeing, that from their ordinances, interlocutions and decrees, before a definitive sentence, or one having the force of definitive, and where the correction of morals is in question, in no way, even to us and the apostolic see, an appeal can be made: and nevertheless by whatsoever appeals against the tenor of the present howsoever interposed, the causes are in no way to be devolved, or even by any inhibitions, even by whatsoever censures and penalties, perhaps to be made to them by whatsoever ordinary or delegated judges, the further cognition and expedition of those, and where the correction of morals is in question, even the legitimate execution in no way to be impeded, or by such censures and penalties to be bound or ensnared we decree.
