In supremo apostolatus solio
Bull erecting the western Lisbon collegiate church into a metropolitan and patriarchal church
A distinguished collegiate church is erected in the palace of the King of Portugal into a cathedral and patriarchal church of Lisbon in the West, with many privileges and ordinances. Clement, Bishop, servant of the servants of God, for perpetual remembrance of the matter.
1 In the supreme seat of the apostolate, by the merits of the beginning from... although unequal to the office, by divine disposition concurring to primacy, the pastoral office of ours with pious religion... most excellent mind. concerning these matters we willingly interpose, by which to orthodox kings and other princes of the Apostolic See and Catholic religion most excellent in mind we are able to exhibit illustrious tokens of our grateful spirit, and those before others, who with strong subsidies strive to aid the common cause of Christian commonwealth against its most terrible enemies, we pursue with principal and truly singular graces of pontifical bounty.
2 § 1. Indeed, since the most savage Turk... Against the Turks... the tyrant, after, by divine... prayers have been offered... and human... untouched, a dire and atrocious war to the beloved sons, noble men, the dukes and lords of the Venetians most wickedly inflicted in the superior year, greatly elated by a fortunate and swift Peloponnesian conquest, and now believing nothing to be impervious to him. To this church were united three parish churches const. ed. mdccxvi, on 19 August, pontif. xvi; and const. ed. mdccxvii, on 18 February, pontif. xvii, the acts of the apostolic delegate are confirmed for the execution of the present constitution.
3 trusting, not only Venetian, but other Christian princes' provinces, with great and perhaps hitherto unheard of apparatus of terrestrial and maritime forces, in this present year to attack, and to involve in disasters, and especially the island and city of Corfu, the bulwark of Italian security, to besiege he would attempt; we, moved vehemently by so many and such great perils of the Church and Commonwealth, indeed of our temporal dominion, first indeed to Him, who is mighty in battle, we cried out with whole heart, that according to the multitude of His mercies He would redeem us from evils, nor give His inheritance in reproach; then indeed Catholic princes with all the contention of paternal charity we did not cease to exhort, that they would bring aid to the failing Christian cause, and the same arms, with which they had recently clashed among themselves, they would turn against the barbarians. When it became clear that the King of Portugal...
4 tugal, however, among those our dearest son in Christ John, King of Portugal and the Algarves, illustrious, moved no less by the stimuli of his own distinguished piety than by our offices, and first of all stirred by the most illustrious and meritorious examples of his ancestors, the Kings of Portugal, in the protection and propagation of the orthodox faith, sparing no inconveniences and no expenses however most grave, with supreme zeal and supreme and almost incredible liberality and eagerness, sent most speedily to the aid of the Christian fleet a most powerful subsidy of very many warlike and most fortified ships, which he desired: we, well knowing to recognize the new archbishop aforesaid John the king, by many in the royal chapel... for many years moved by pious desire has the Pontiff... to have in his royal palace at Lisbon a cathedral church, most greatly desired that a secular and distinguished collegiate church in the same palace, under the invocation of the divine Apostle Thomas, otherwise erected and instituted by us, be erected into a cathedral church of this kind, under the invocation of the Assumption of the most blessed Virgin Mary, and therefore the city and diocese of Lisbon be divided into two parts, and in them two archbishoprics be constituted, the aforesaid city of Lisbon, the metropolis of Portugal, both on account of the maritime port, the continuous frequency of all peoples and nations, all kinds of commerce and abundance of riches, and on account of the great number of churches, monasteries and convents, both of men and of women, confraternities, hospitals and other pious places, and finally on account of very many most noble families and many men constituted in illustrious ranks and conspicuous both in letters and in arms, to be most celebrated throughout the whole world, and therefore worthy of such prerogative in the highest degree, and the same city and diocese of Lisbon both on account of the lay people and on account of the secular and regular clergy very numerous, as well as the fruits, revenues and proceeds of the table of the archbishopric of Lisbon, whose church at present destitute of the solace of a pastor, as we have heard, exists, to the two archbishops, after the city and diocese of Lisbon have been divided in this manner, and in the aforesaid two parts, by means of the erection of one new archbishopric, two archbishoprics have been constituted, to be most sufficiently adequate and fitting sustenance:
§ 2. Wishing to provide to the same King John a singular token of our grateful disposition, for the greater glory of God and the increase of divine worship, having regard to the great extent of the same diocese of Lisbon, by our own motion, not at the instance of any petition offered to us on this matter, but from certain knowledge and mature deliberation of ours, and from the fullness of apostolic power, we divide the aforesaid city and diocese of Lisbon into two parts, and we leave one part, both of the city and of the diocese thus divided, toward the east to the ancient archbishopric of Lisbon, and we assign the other part toward the west to a new archbishopric to be erected by us, as below; so that henceforth in perpetual future times the archbishop of Lisbon existing for the time being, who shall have the half of the city and likewise the half of the diocese of Lisbon toward the east, shall be called respectively archbishop of Eastern Lisbon, and the future archbishop of Lisbon existing for the time being, who shall likewise have the half of the city and also the half of the diocese of Lisbon toward the west, shall be called respectively archbishop of Western Lisbon. We decree that the division of the aforesaid city of Lisbon into two parts is to be made as below, as we do by force of these presents, and we divide and separate one part from the other, so that the ancient city of Lisbon, with its castle and eastern suburb, shall belong respectively to the archbishop of Eastern Lisbon existing for the time being, and the western suburb, which is called New Lisbon, shall belong respectively to the future archbishop of Western Lisbon existing for the time being, to be called respectively, and one part shall be distinguished from the other by the ancient walls of the city, namely by the wall of the city at the Gate of Consolation, by the wall of Costa de Castello, and by the wall and gate of St. Andrew; and whatever is there with the ancient city in the eastern part, together with parochial and other churches, monasteries, convents and pious places whatsoever, shall belong to the eastern, and whatever exists in the western part, or New Lisbon, likewise with parochial and other churches, monasteries, convents, and likewise pious places whatsoever, shall belong to the western, to be called respectively, and shall pertain and belong to the archbishop existing for the time being. We likewise divide the diocese of Lisbon into two parts, and we subject and assign the part of the diocese of Lisbon toward the east to the archbishop of Eastern Lisbon existing for the time being, and the part of the same diocese of Lisbon toward the west to the future archbishop of Western Lisbon existing for the time being, to be called respectively. The dividing line of the said diocese of Lisbon shall begin from the places of Arroios, Campogrande, Povoa S. Adriani and Arruda, with the whole territory of Alenquer, on which side it ends with the territory of the towns of Ribateio, and thence Moinhonovo, Otta, Cercai, Sancheira, with the Coutos of Alcobaza, as far as the boundaries of the bishopric of Leiria, including all the aforesaid places, towns and villages, with their territories, dependencies, lands, populations, and all other things which are found within this line and the shores of the Ocean sea, shall belong and pertain to the archbishop of Western Lisbon existing for the time being, to be called respectively; but the remaining places, towns and villages, which are found from this line exclusively as far as the banks of the Tagus and the boundaries of the jurisdiction of Thomar, with all their territories, districts and dependencies, shall likewise belong and pertain to the archbishop of Eastern Lisbon existing for the time being, to be called respectively: but on the other side of the Tagus, the territory of Setual as it extends within the rivers Sado and Canha as far as the boundaries of the archbishopric of Évora, with all places, towns and villages and their territories and dependencies, shall belong to the archbishop of Western Lisbon existing for the time being; and the territory of Santarém beyond the Tagus within the rivers Divor and the castle of Almourol as far as the boundaries of the bishopric of Portalegre, also with places, towns and territories, shall likewise belong and pertain respectively to the archbishop of Eastern Lisbon existing for the time being, to be called respectively.
6 § 3. In the aforesaid part of the city and part of the diocese of Lisbon towards the west, for a pious future archbishop of Western Lisbon to be named thus as is aforesaid constituted and assigned, a new archbishopric to be called Western Lisbon for one true and future archbishop to be named Western Lisbon, at the nomination of the aforesaid King John, and of his successors in the kingdoms of Portugal and the Algarves for the time being existing, as below, to the same archbishopric to be called Western Lisbon by apostolic authority proceeding (which new archbishop to be named Western Lisbon in no way whatsoever subject to any other archbishop to be named Eastern Lisbon and to any other whatsoever archbishops, prelates and superiors by whatsoever name to be called, but from them and from their jurisdiction and superiority wholly and entirely exempt, and subject only to the Apostolic See immediately), we erect and institute; and the said secular and distinguished collegiate church under the invocation of the divine Apostle Thomas in the aforesaid royal palace as is aforesaid existing, with the prior suppression of the denomination and title of the distinguished collegiate church of the same divine Apostle Thomas, into a true archiepiscopal see and metropolitan church to be called Western Lisbon under the invocation of the Assumption of the most blessed Virgin Mary we likewise erect and institute, and with the archiepiscopal and metropolitan name Western Lisbon we mark and adorn; and we will that the same collegiate church (which from six dignities, eighteen canonries, and as many prebends, which and whom obtaining constituted its chapter, as well as from twelve perpetual ecclesiastical benefices was constituted), erected into a cathedral, with the same number of dignities, canonries and prebends, which and whom also obtaining shall likewise constitute its chapter, as well as with the same number of benefices be constituted, of which however three of the canonries in the penitentiary, theological and doctoral respectively canonries are to be designated by the same King John, observing however in the presentation, collation and institution of the canonries of penitentiary, theological and doctoral in this manner, both concerning age and concerning fitness and other qualities, the decrees of the Council of Trent. And since the said cathedral church to be called Western Lisbon, formerly as is aforesaid a collegiate church, now to such sublimity and honourable excellence is elevated, and the said King John, as we have learned, in it to have dignities and canons, who have certain and peculiar qualities, to this end that they may be promoted or presented to higher dignities and to the governance of cathedral churches, most earnestly desires, to the same King John, that he be able and have power freely and lawfully to remove from them for this occasion only some of those now obtaining the dignities and canonries and prebends and benefices aforesaid, and to substitute others in their place, provided however that first the indemnity of those who shall thus be removed be consulted at least equivalently, we grant and indulge by the tenor of these presents, by our own motion (and thus removed from dignities or canonries and prebends or benefices in this manner, by any reason and under any pretext even of triennial possession they cannot be aided, nor can they contradict and oppose themselves to this removal, and we will and command that they be held as removed by apostolic authority).
7 jurisdiction and § 4. Moreover, in order that both the archbishop of Lisbon in the East and the archbishop of Lisbon in the West, for the time being existing, beyond their own and distinct diocese and their own and distinct territory with their own, true and particular authority, jurisdiction and power over their respective subjects and diocesans may be able to have, to the archbishop of Lisbon in the East for the time being existing, so that he may have authority, jurisdiction and superiority over the clergy and people, in the fortresses, towns, villages, territories, districts, churches and persons both secular and ecclesiastical existing and to exist in the half of the city and half of the diocese of Lisbon towards the East, assigned to him as aforesaid, and may freely and lawfully exercise the same, and such places and persons remain always and perpetually subject to his jurisdiction, subjection, visitation and correction (saving nevertheless the prejudice of persons or places perhaps having privileges of exemption from such visitation, which shall remain firm and unharmed, and as before ought respectively to be exempt from such visitation); and likewise to the same archbishop of Lisbon in the East for the time being existing, beyond jurisdiction and authority over persons and places in the half of the city and half of the diocese of Lisbon in such manner towards the East as aforesaid assigned to him, the collations, provisions and all other dispositions of dignities, canonries and prebends, personates, administrations, offices, and all and singular other ecclesiastical benefices, with cure and without cure and presentations, elections to the same, confirmations and institutions in the same heretofore in the whole city and whole diocese of Lisbon competent to the archbishops of Lisbon now deceased (saving nevertheless and remaining always unharmed the apostolic reservations and affections, and without prejudice to the presentation of benefices of royal and lay patronage), henceforth for the half only of the city of Lisbon and half of the diocese of Lisbon in such manner towards the East as aforesaid assigned to him, we leave and assign; and to the same archbishop of Lisbon in the East for the time being existing, the episcopal churches of Egitania, Portalegre, Cape Verde, St. Thomas, and Congo, and the modern and for the time being existing prelates or administrators thereof respectively, for their own and for the time being existing archbishop of Lisbon in the East as suffragans, who as members to the head for the time being existing archbishop of Lisbon in the East are subject by metropolitan right, we designate and depute (so that the same archbishop of Lisbon in the East for the time being existing in the same cities and dioceses of Egitania, Portalegre, Cape Verde, St. Thomas, and Congo may claim metropolitan right for himself, and the bishops of Egitania, Portalegre, Cape Verde, St. Thomas, and Congo for the time being existing shall be bound and obligated to the same archbishop of Lisbon in the East for the time being existing in all and singular matters to which any suffragans whatsoever are held and obligated to their metropolitans and metropolitan churches according to the canonical sanctions); and to the same archbishop in the East for the time being existing his aforesaid suffragans to consecrate, provincial synods to convoke, and with the same suffragans ecclesiastical matters to transact and define, causes of any appeals or complaints whatsoever, according to the decrees of the sacred canons and the Council of Trent, to know, and all other and singular things whatsoever which by right, use, custom, or otherwise in any way pertain and belong to archbishops and the archiepiscopal office, and precisely to the ancient archbishop of Lisbon heretofore pertained and belonged, in the half only of the city of Lisbon towards the East and the half only of the diocese of Lisbon in such manner also towards the East thus left and assigned to him for his archbishopric and territory by us through these presents, to exercise and perform, full, free and complete faculty and authority we likewise leave and assign.1
8 jurisdiction and 8 5. For the time being existing archbishop of Lisbon in the western part, who must always be the greater chaplain of the said royal chapel, (beyond the thanks, privileges, prerogatives and indults, which he ought to enjoy as the greater chaplain of the said chapel, and precisely beyond the spiritual and temporal jurisdiction, which ought to be competent to him over the royal household and other persons, according to the form and tenor of the privileges otherwise granted to the same greater chaplain, wherever they have or shall have their domicile) he himself also ought to have jurisdiction and authority over the clergy, people, fortresses, towns, villages, territories, districts, churches and persons, both secular and ecclesiastical and regular, existing and to exist in the half of the city and half of the diocese of Lisbon in this manner towards the west assigned to him, and he may freely and lawfully exercise them, and such places and persons ought to remain always and perpetually subject to his subjection, visitation and correction (saving however the prejudice of persons or places perhaps having privileges of exemption from such visitation, which shall remain firm and unharmed likewise, and ought to be exempt from such visitation respectively as before); likewise to the same for the time being existing archbishop of Lisbon in the west, beyond the jurisdiction and authority over persons and places in the half of the city and half of the diocese of Lisbon in this manner towards the west thus assigned to him, the collations, provisions and all other dispositions of dignities, canonries and prebends, personates, administrations, offices, and all and singular other ecclesiastical benefices, with cure and without cure, and presentations, elections to them, confirmations and institutions in the same, formerly competent to the deceased archbishops of Lisbon in the whole diocese of Lisbon (saving however and always remaining likewise unharmed the reservations and affections of the apostolic see, and without prejudice to the presentation of benefices of royal and lay patronage), henceforth for the half only of the city of Lisbon and the half only of the diocese of Lisbon towards the west thus assigned for the time being to the archbishop of Lisbon in the west, we likewise grant and respectively indulge; and to the same for the time being existing archbishop of Lisbon in the west the episcopal churches of Leiria, Lamego, Funchal and Angra, and the modern and for the time being existing their respective prelates or administrators, for their own and for the time being existing archbishop of Lisbon in the west suffragans, who, as members to the head, ought to be subject to the same for the time being existing archbishop of Lisbon in the west by metropolitan right, and ought to render obedience and reverence to him, as to their own metropolitan, we likewise designate and depute, so that the same for the time being existing archbishop of Lisbon in the west in the same cities and dioceses of Leiria, Lamego, Funchal and Angra may have and ought to have metropolitan right, and the bishops of Leiria, Lamego, Funchal and Angra ought to be bound and obliged to the same for the time being existing archbishop of Lisbon in the west in all and singular matters to which any suffragans are bound and obliged by right, use or custom; and to the same for the time being existing archbishop of Lisbon in the west his aforesaid suffragans to be consecrated, provincial synods to be convoked, and with them also ecclesiastical matters to be transacted and terminated, causes of any appeals or complaints, according to the statutes of the sacred canons and the decrees of the Council of Trent, to be known, and all other and singular matters, which likewise by right, use, custom, or otherwise in any way pertain and are accustomed to belong to archbishops and the archiepiscopal office, and precisely to the ancient archbishop of Lisbon formerly in the whole city and diocese of Lisbon pertained and belonged, henceforth in the half only of the city and the half only of the diocese of Lisbon in this manner towards the west, thus likewise assigned to him for his archbishopric and territory by us through these presents, to be conducted and exercised, we grant and impart full and complete faculty and authority.
9 § 6. So that both the Archbishop of Lisbon Oriental and the Archbishop of Lisbon Occidental, existing at the time in the exercise of their respective archiepiscopal office and authority, may have a fixed and invariable tax in the books of the Apostolic Camera and certain and distinct fruits, whereas the tax of the ancient archbishopric of Lisbon is found described in the books of the Apostolic Camera at two thousand gold florins, and it is fitting that, just as the city and diocese are divided, so also the fruits and burdens be divided, we will and ordain that henceforth the fruits of the archbishopric of Lisbon Oriental shall respectively be taxed at one thousand similar florins in the books of the Apostolic Camera. To each moreover of the aforesaid two archbishops of Lisbon Oriental and Occidental existing for the time being, those fruits from tithes and all other whatsoever revenues,
CLEMENT XI PP. An. G. 1716
10 incomes, stable goods, rents and other such things proceeding, which may proceed from that moiety of the city and moiety of the diocese of Lisbon thus assigned to him as aforesaid; and, lest the ancient chapter of Lisbon suffer any detriment from this division and dismemberment and from the erection of the new archbishopric of Lisbon Occidental, as to the fruits and other emoluments pertaining to it as below, both the fruits and tithes and other emoluments, which before pertained and belonged to the same ancient chapter, even after the division of the city and diocese of Lisbon and the erection of this new metropolitan church, ought to pertain and belong as before, without the chapter and canons of the new metropolitan church aforesaid being able to exact or claim anything from the aforesaid tithes, fruits and emoluments pertaining to the ancient chapter of Lisbon as aforesaid, even if such fruits, tithes and emoluments proceed in any way from whatsoever goods, things and persons existing in the moiety of the city and moiety of the diocese of Lisbon toward the west. § 7. For the purpose moreover that from the division of the city and diocese of Lisbon aforesaid, and from the existence of two archbishoprics within the limits of the same ancient city and of the same diocese, discords and dissensions may not arise, desiring to foster peace and tranquility among ecclesiastical persons most earnestly consonant, we mandate that all and singular the things written below, which may regard jurisdiction, superiority, and other things for the quiet and concord of both archbishoprics, ought to be firmly and inviolably observed in perpetual future times both by the Archbishop of Lisbon Oriental and by the Archbishop of Lisbon Occidental, and by their respective vicars, officials and ministers by whatsoever name called, and by any authority, superiority, jurisdiction and facility possessed, as well as by subjects and diocesans both secular and ecclesiastical.
11 i. Namely, that confessors and preachers, if approved by their own one of the two aforesaid archbishops existing for the time being and found suitable for hearing confessions and making preachings of the word of God in one part of the city and diocese of Lisbon in which that said own archbishop exists, then and in that case, exhibiting before the other archbishop the approbation of their own archbishop, may in the other part of the city of Lisbon and its district hear confessions and preach the word of God without any examination and other approbation, but having only license from the archbishop of the place in which they shall wish to hear such confessions and preach the word of God.
12 ii. That all and whatsoever cases, which shall be reserved in one of the aforesaid two archbishoprics, or shall be reserved in the future, be likewise and ought to be also reserved in the other of the aforesaid two archbishoprics, lest subjects of one of the aforesaid two archbishoprics committing such excesses, which are reserved in their archbishopric, be easily absolved in the other of the aforesaid two archbishoprics, in which similar cases shall not have been reserved.
13 in. In the event of burying some deceased person from one part of the city or diocese in another part of the same city or diocese, or because he has chosen his sepulchre in this other part, or because in this other part there exists the sepulchre of his ancestors and blood relatives, then the pastor of the deceased ought to accompany the cadaver as far as the boundaries of that archbishopric in which he died, and from thence it shall be accompanied by the pastor within whose boundaries is situated the parish or church in which the aforesaid cadaver shall be buried, dividing however between both pastors the emoluments due by reason of the funeral.
14 iv. Religious orders and lay confraternities of the whole city, which at present are found in the same city, may henceforth in accompanying cadavers and in all other whatsoever functions, both going and returning, proceed through the whole city in procession in the same manner and form in which they proceed at present; those religious orders and lay confraternities, however, which in the future shall be newly founded and established, in order that they may proceed in the aforesaid functions through the whole city in procession, ought to seek permission and faculty from both archbishops.
15 v. Whenever it shall be necessary to make proclamations concerning marriages to be contracted and concerning orders to be conferred for persons dwelling in the said city of Lisbon, such proclamations, although those wishing to contract marriage and to be promoted to such orders are inhabitants of one part of the said city as aforesaid divided, shall be made not only in their parochial church, but also in one of the parochial churches of the other part of the same city as aforesaid divided, in order that fraud may be prevented, and at no time whatsoever may marriages be contracted and orders both minor and sacred be conferred without the testimony of notaries, commonly called follia corrida, of both archbishoprics, in which it shall be expressly provided that both those who shall wish to contract marriage and those who shall be promoted to the aforesaid orders are entangled by no canonical impediment, and labour under no infamy of crime as regards such orders.
16 vi. That public processions, both on the day of the solemnity of the Body of Christ to be made from both cathedrals, and those which are made on other days by custom or vow, or which may henceforth be made, shall in no way be able to be made outside the proper boundaries of one archbishopric, without the express permission and faculty of the other archbishop. vii. Ministers and officials of one archbishopric may not and ought not to bear in another part and in another domain and territory of another archbishop insignia denoting jurisdiction and justice, nor to make executions by themselves, or to cast anyone whatsoever subject to them into prisons, but hortatory letters shall be used according to the custom of the kingdom of Portugal; excepting however the case in which offenders shall be found either in the act of flight or in flagrant crime, in which cases the offenders shall be delivered to the official of that archbishop in whose jurisdiction they shall have been captured, in order that he either punish them, if by law the faculty of punishing them belongs to him, or remit them to their judge, who by law ought to proceed to the examination of the crime committed by such offenders.
17 VIII. All and every apostolic letters, whether under lead or under the Fisherman's ring, to be issued henceforth, and concerning both grace and justice together or separately, which are to be committed for their execution to the archbishop or official of Lisbon, whenever it shall not be clear from the same letters whether their execution was committed to the archbishop or official of Eastern Lisbon or to the archbishop or official of Western Lisbon, then and in that case such execution shall be understood to be committed to that archbishop who shall have jurisdiction either over the person, if the matter be personal, or over the thing, if it be real. IX. All and every causes and disputes in litigation which are at present found to have been introduced and undecided shall be continued and terminated unto a definitive sentence before the same officials or judges before whom they were introduced; executions moreover are to be made by the official of that archbishop to whom, according to the aforesaid division, they shall pertain, by means however of the customary letters of exhortation according to the usage of the kingdom of Portugal; those disputes and controversies however which are to be newly moved and introduced shall be judged and decided by the official of that archbishop of Lisbon, either Eastern or Western, who ought by law to know of them and to judge concerning them, either by reason of the person subject to him, or by reason of the thing existing in his archiepiscopal see and in his diocese. X. The new archbishop of Western Lisbon shall be able to create and elect all and singular officials who are accustomed to be created there, or to confirm and approve those already created and elected, with the same jurisdiction and power competent to other officials in the part of the city and diocese assigned to him; nor by this shall the old officials of the archbishopric of Lisbon be able to claim any relief, except in the case in which offices had been purchased by them, because then the new archbishop of Western Lisbon shall have to decree that the officials newly elected by him make good the damages which the old officials of the archbishopric of Lisbon might suffer from this new erection and election of officials, and the judges executors written below shall summarily and with only the truth of the matter examined, cause the price owed to the same old officials to be paid. XI. Because in both parts of the city and diocese of Lisbon, both Eastern and Western, there are found dignities, canonries and benefices which require personal residence, lest, on account of the aforesaid division of the city and diocese of Lisbon, the dignities, canonries and benefices of this kind held for the time being be prejudiced in any way, we will that, if the holders of dignities, canonries and benefices in one part of the city or diocese of this kind shall have dwelt, they nevertheless shall be held and ought to be reputed present in the place of the dignities, canonries and benefices of this kind; they themselves, but not however their household and servants, shall be subject to that archbishop in whose city or diocese the dignities or canonries or benefices of this kind shall have existed. XII. That all and singular controversies which in the future may arise on account of such division and the erection of the new archbishopric shall be defined and judged summarily without noise and form of trial, and with only the truth of the matter examined, by the same judges executors written below. Moreover that from all the aforesaid nothing prejudicial shall be brought to bear, nor at any time in the future be able to be brought to bear, upon the jurisdiction already competent to the new archbishop of Western Lisbon as greater chaplain of the royal chapel of Lisbon, which jurisdiction shall always and at all times remain unimpaired and unharmed in its original state, to be exercised however by the said new archbishop of Western Lisbon as prelate of the said chapel over the royal household, and the same chapel and its officials and household of the said King John, according to the form of the indults and apostolic privileges granted hitherto in favor of the greater chaplain existing for the time being, to which in no way derogation or prejudice is to be understood, but the new archbishop of Western Lisbon, as greater chaplain of the said royal chapel, according to the form of the apostolic indults and privileges of this kind, exclusively with respect to all other judges or superiors exercising any authority and dignity shall be able to exercise his jurisdiction as greater chaplain without any diminution and controversy.
18 § 8. Finally, considering that the aforesaid metropolitan church of the Western Archbishopric of Lisbon, which is constituted in the royal palace of Lisbon, as has been set forth, erected and instituted by us, and that the royal persons themselves are able to be present there very frequently at ecclesiastical functions, we deem it altogether fitting that the same metropolitan church of Lisbon in the West, and its archbishop for the time being, the Archbishop of Lisbon in the West, should be adorned with more abundant indults, privileges and prerogatives from our special indulgence and that of the Apostolic See. Hence, desiring to follow the aforesaid King John with more ample favors and graces (nevertheless with all and singular the aforesaid indults and privileges granted to the same royal chapel and its greater chaplain, as has been set forth, by us and our Roman Pontiff predecessors remaining firm and unharmed, and without any prejudice or diminution of the authority, jurisdiction, preeminences and rights of any kind, even honorific and merely ceremonial, now and for the time being belonging to our nuncio and that of the Apostolic See in the kingdoms of Portugal and the Algarves, or to another legate of the same See 2 existing for the time being similarly in the same kingdoms; which aforesaid nuncio and legate, with respect to the said Archbishop of Lisbon in the West, are able and ought to exercise in like manner and without any difference whatsoever, and with respect to the other archbishops and bishops of the said kingdoms), by similar motive, knowledge and power, we invest and adorn the same secular and distinguished collegiate church, thus erected by us into the metropolitan church of Lisbon in the West, with the name, title and prerogative of a patriarchal church, and its archbishop for the time being, the Archbishop of Lisbon in the West, similarly with the name, title and prerogative of Patriarch of Lisbon in the West, in the manner of our venerable brother the present Patriarch of Venice, as regards however only the province of the archbishopric of Lisbon in the West, with facility of using the insignia and coat of arms of his own archiepiscopal church of Lisbon in the West and other ornaments which the same Patriarch of Venice uses by right, usage and custom, as well as in the same kingdoms of Portugal and the Algarves of bearing the cross and the open rochet, of blessing the people, of having a throne and baldachin, of exercising pontifical functions, of granting the indulgences written below, and of having precedence over the Archbishops of Braga, Lisbon in the East, and Évora, as well as over the Bishops of Guarda, Covilhã, Viseu, Miranda, Lamego, Egitânia, Leiria, Funchal, Angra, Cape Verde, St. Thomas, Congo, the Algarves, Portalegre and Elvas, and all other singular prelates of these kingdoms, in all acts and functions, even in their churches, of which none, even in their churches, in his presence, is able to perform any act of jurisdiction, honor or faculty which their aforesaid legate of the Apostolic See could not perform; but as regards other jurisdictions and faculties competent to other patriarchs or the aforesaid See's legates, the same archbishop for the time being of Lisbon in the West, called patriarch, is able to have and exercise none, except those aforesaid, unless another jurisdiction or faculty of this kind shall have been previously declared by us or our successors and the aforesaid See and respectively granted to him; as well as of using the pallium not only on the days, festivals and functions described and designated in the Roman Pontifical, but also on the festivals of the Conception of the Blessed Virgin Mary, of the Finding and Exaltation of the Holy Cross, of St. Joseph, of St. Anne, of St. Michael the Archangel, of St. Vincent the protector of the city of Lisbon, of St. Elizabeth Queen of Portugal, of St. Anthony of Lisbon, of the Holy Guardian Angel and of St. George the defender of the kingdom of Portugal, which festivals are all solemnly celebrated in the same collegiate church erected into the cathedral and metropolitan church of Lisbon in the West 3 and throughout the whole kingdom of Portugal, as well as on any other day, if there be any more solemn in the church in which throughout the whole kingdom the aforesaid archbishop of Lisbon in the West, called patriarch, shall have used pontificals, and in the blessings of marriages and in the solemn baptism of the sons and descendants of the royal house, and in other similar and solemn functions of the king 4 which shall be celebrated within or immediately after the solemnities of Mass; and that the aforesaid archbishop for the time being of Lisbon in the West, called patriarch, thus created and instituted by us through these presents, and adorned with the name and prerogative of patriarch, is able to be clothed in purple habit, in the manner also of our venerable brother the present Archbishop of Salzburg, and is able to grant those indulgences which our nuncii and those of the aforesaid Apostolic See in the aforesaid kingdoms of Portugal and the Algarves, by the authority of the same See, are accustomed to grant; namely, one hundred or more other days, not however beyond a year, as well as, on one festival only, from first vespers until second vespers and the setting of the sun of such festival day, five years and five quadragesimas, or less, provided however that it be done only once for one church or chapel, we also grant and indulge. § 9. But to the Chapter of the said collegiate church, thus erected by us into the cathedral and metropolitan church, and adorned with the title, denomination and prerogative of a patriarchal church, and to its dignities and canons, that they may henceforth wear a prelatic habit of violet-colored silk or wool over the rochet everywhere on earth, except however the Roman Curia, and where there shall not be the Roman Pontiff, in the manner of the canons of the patriarchal churches of the City, and that they, who already by virtue of an apostolic indult have the use of a great cape of violet color, may henceforth in winter also wear a great red cape, and in summer seasons, a mozzetta over the rochet similarly red, in the manner of the canons of the church of Pisa, respectively in each of the canonical hours, masses and other divine offices, as well as in processions both within and outside their church to be performed, as well as in public and private capitular acts; and that the chapter and canons of the said church of Lisbon in the West, both clothed in prelatic and canonical habit, and existing or proceeding capitularly, ought to precede all chapters, even in their churches, and all canons of whatever cathedral and collegiate churches of the whole kingdom of Portugal, similarly if one or more of the said church of Lisbon in the West with another or others, in dignity or canonry, or in dignities or canonries of any other church of the kingdom of Portugal proceed, or shall be present at some ecclesiastical function, even in their churches; as well as that they, and their successors in these dignities and canonries and prebends, for perpetual future times, and as much in the part of the city and diocese of Lisbon in the West, as in the whole kingdom and dominions, in the presence of the king, and in his absence with the permission of the Ordinary, in masses and canonical hours to be solemnly sung and performed, and also in processions, blessings of candles, ashes, palms, and the baptismal font, and in other ecclesiastical functions in which sacred vestments are used, in the presence or absence of the archbishop, may use the mitre and other vestments or ornaments, in the manner of abbots having the use of the mitre, as well as in their arms and gentilicial insignia cause the mitre to be placed in the manner of the dignities and canons of the archiepiscopal churches of Benevento and Milan, and that the aforesaid dignities and canons of the church of Lisbon in the West, and their successors, are able and may bless vestments and ornaments, and other ecclesiastical things in which the unction of sacred oil or chrism is not required, not however chalices or patens, in the manner of the canons of the church of Naples; and to the same aforesaid canons of the church of Lisbon in the West, whatever causes and concerning whatever titles and controversies to be brought or to be moved before them, respectively, freely and lawfully are able and may, we also grant and indulge.
19 § 10. Furthermore, with the firm right of royal patronage and presentation remaining, as from the beginning, to the pure western region, to dignities, canonicates and prebends reserved to the king, and benefices of the said collegiate church, thus by us erected into the metropolitan church of Lisbon in the west, to the archbishopric of Lisbon in the west, both on this first occasion from its original erection being vacant in this manner, and hereafter in whatever other vacancies whenever and however they may occur even at the Apostolic See, we reserve, grant and assign to the aforesaid King John and to his successors in the said kingdoms, the right of royal patronage and of presenting a suitable person to us and to the Roman Pontiff for the time being, and by us and the same Roman Pontiff for the time being through apostolic authority and by means of apostolic letters to be appointed to the said archbishopric of Lisbon in the west; and we decree that this right of patronage and presentation pertains and belongs to the aforesaid King John and to his successors in the said kingdoms aforesaid, not from apostolic privilege, but as from true, original, real and actual, full, complete and absolute foundation and perpetual lay endowment, made from purely lay goods, and as such under derogation of the right of patronage acquired from apostolic privilege or custom or prescription is in no way to be comprehended, nor to that one at any time whatever, even from the cause of vacancy at the aforesaid See, or under any other pretext, or from any other cause, however legitimate, even by us and the aforesaid Roman Pontiffs our successors for the time being, by like motion, knowledge and fullness of power we decree.
Firmness of the archbishopric and patriarchate. § 11. Finally, so that in the event that the aforesaid John or for the time being the king of Portugal and the Algarves, and his successors, elsewhere transfer their court, their royal persons, either perpetually or for some space of time, respectively, nevertheless both the cathedral character of the said collegiate church, thus by us erected into the metropolitan and patriarchal church of Lisbon in the west, and all and singular privileges and indults granted to the same cathedral church of Lisbon in the west thus as aforesaid, should remain firm and unharmed, even by like motion, knowledge and fullness of power, we decree and declare.
20 the King of Portugal and the Algarves existing at that time, and his successors, should transfer the court elsewhere, and their royal persons, either perpetually or for some space of time, respectively, nevertheless the cathedral status of the said collegiate church, thus erected by us into the metropolitan and patriarchal church of Lisbon in the West, and all and singular the privileges and indulgences granted to the same cathedral church of Lisbon in the West as aforesaid, should remain firm and unharmed; we decree and declare this also by our own motion, knowledge and fullness of power.
§ 12. In order, however, that all and singular the aforesaid things granted and
21 ordained by us and contained and expressed in the present, may be committed to due execution, and in perpetual future times the said
22 matters may be preserved with appointed division in the chancery and elsewhere...

13 in.
