Bull erecting the college of referendaries of both Signatures

Bull of Pope Alexander VII ·

CCXLVII.
Constitution on the erection of a college from the referendaries of both signatures and on the qualities of those to be admitted henceforth as referendaries.
Alexander, bishop, servant of the servants of God, for perpetual memory of the matter.

1 Among the other cares of apostolic solicitude, by which we are ceaselessly pressed, it has always been our concern that the prelates of the Roman Curia, who shine forth as stars in the firmament of the Church militant, and who ought to be ready with work and counsel to the Apostolic See in all difficult matters, should be chosen from those who, distinguished by excellent character, morals and learning, present themselves as an example of true virtue to others. To this end indeed, although certain of our predecessors, the Supreme Pontiffs, have established many things in their constitutions, especially for the referendaries of both signatures, some of which have nevertheless become antiquated in the course of time, as often happens, and perhaps have been neglected: for this reason we have deemed it opportune to renew those things, to restore them to their former observance, and also to add certain matters which the experience of affairs has taught to be expedient.

2 § 1. By this our constitution, therefore, to endure perpetually, we confirm and renew the aforesaid constitutions of our predecessors in those parts which are not contrary to the present, or which have not otherwise been legitimately reformed; moreover, we erect and institute a college of the same referendaries, which we wish to be represented by twelve voting members of the signature of justice chosen from the body and number of the same referendaries and to be chosen in the future, whose head and moderator we perpetually constitute as the prefect of the same signature of justice existing for the time being, and the senior of them in office shall be called dean.

3 § 2. Their office shall be to form inquiries and processes concerning the qualities of those who are to be admitted to the aforesaid office and dignity of referendary, as shall be assigned to each by the prefect of the signature by special rescript, as is set forth below. Furthermore, it shall be incumbent upon the same dean and college to instruct diligently the other referendaries, especially those to be received in the future, concerning those matters which pertain to the exercise of their office, and to make known to all the decrees and ordinances whatsoever, both ours and those of the prefect, concerning and to concern their persons and office, as well as the days and times and services to be rendered by each of them to us both in our chapel and in other functions, and also to ensure that tablets indicating the signatures and congregations to be held are set forth at suitable times by the ministers appointed, as is customary, and finally to attend to all matters which concern the order.

4 § 3. Whenever indeed the said college shall need to be convened and assembled, the permission of the prefect is first required and at his command the dean shall convene it, and it may be convened and assembled in the house of residence of the same prefect, and nowhere else nor otherwise, except by the express consent of the same prefect, and permission given in writing only.

5 § 4. We wish moreover that the aforesaid college instituted by us shall enjoy and possess the same privileges and exemptions by which the other colleges of the prelates of the Roman Curia enjoy and are endowed.

6 § 5. Moreover, those who seek to be chosen into the order of referendaries shall, before all else, take care that their petition, having been reported to us and our successors by the prefect of the signature, shall be preceded by our and our aforesaid successors' approval; then that by the same prefect one of the prelates of the aforesaid college shall be delegated for conducting the process, in which the underwritten qualities of petitioners shall be legitimately justified; namely first that they be born and begotten of true and lawful matrimony and of upright and honest parents, and shall have been of good character, life, and reputation entirely beyond reproach, and shall be constituted in the twenty-fifth year of age; furthermore that they shall have applied themselves to legal studies in some public university for at least five years, and shall have obtained the doctorate of both laws, namely canon and civil law, in the same; and that they truly and really and peacefully possess annual revenues constituting the sum of fifteen hundred scudi of currency, or shall have been validly assigned them by parents or relatives; and finally that they shall have been engaged in this Roman curia for at least two years, and shall have diligently devoted themselves to the study of practice under one of the auditors of our Rota, or other prelates, officials or advocates of the same curia; concerning which matters, the process having been carefully compiled, a report shall be made by the relator or delegate thereof in the college, and if it shall seem to them that the aforesaid matters are sufficiently proved, then the petitioner shall be admitted to examination, with two petitions or commissions assigned to him (as is customary) to be presented before the college itself; and thereafter the examination having been completed, if by the judgment of the same prefect and college, whose conscience we burden, or at least by two out of three parts of the votes, which we wish to be expressed secretly by white and black beans, he shall be approved, then the prefect, all matters having been reported to us and our successors, shall pronounce him referendary by our authority, and shall order him to be enrolled in the number of others, having first, however, taken the customary oath in his hands.

7 § 7. Finally, so that in the signatures both of grace and of justice there may be freer discussion of cases and expression of votes, we prohibit all and singular, both those voting and all others whatsoever intervening in the same signatures, and their auditors and study assistants, from reporting or divulging the votes themselves to any other person, even with special expression worthy thereof, orally or in writing, by themselves or through others in whatsoever form and contrived manner, under penalty of our displeasure.

8 § 8. Decreeing that these present letters be valid and inviolably observed, and thus ought to be defined by whatsoever judges, etc., and null and void, if otherwise, etc., should it happen to be attempted.

9 § 9. Notwithstanding the aforesaid, and contrary matters, insofar as it be necessary, our and the apostolic chancery's rule concerning graces not to be granted in the manner of, and of our predecessor of happy memory Pope Pius IV concerning graces in any way concerning the apostolic camera to be registered in the aforesaid camera, and other apostolic constitutions and ordinances, and all those which the aforesaid predecessors in the said constitutions wished not to hinder, and all other contrary matters whatsoever. Let no man whatsoever be permitted to infringe this page of our confirmation, innovation, erection, institution, will and decree, or to contravene it with rash presumption. If anyone, however, etc. Given at Rome, at St. Mary Major, in the year of the Incarnation of the Lord 1659, on the Ides of June, in the fifth year of our pontificate.

CCXLVII.
