Inter cuncta
Bull on the trial of Wycliffite and Hussite heretics
Notwithstanding anything to the contrary. Martin, bishop, servant of the servants of God, to our venerable brethren, archbishops, bishops and inquisitors of heretical depravity constituted anywhere, to whom these present letters shall come, greeting and apostolic benediction.
1 Among all the solicitudes of pastoral care by which we are pressed without ceasing, that which troubles us most grievously is this: that heretics being expelled from the borders of Christendom, and their false doctrines and perverse errors being utterly eradicated, insofar as it is granted to us from on high, the orthodox and catholic faith may remain whole and undefiled, and the Christian people may persist immovable and inviolate in the sincerity of that same faith, free from every veil of obscuration.1
2 § 1. Indeed, for a long time now, more than in all the ages that have gone before, in certain regions and dominions, especially in the kingdom of Bohemia and the march of Moravia and in Prague and the places and districts neighbouring those lands, certain heresiarchs, circumcellions, schismatics and seditious persons, lifted up by Luciferian pride and wolf-like rage, deceived by the frauds of demons, coming together from vanity to the same thing (though they were of diverse parts of the world), and having their tails bound together, namely John Wycliffe of England, John Huss of Bohemia and Jerome of Prague, of damned memory, who would that they had not drawn others with them to the destruction of infidelity—have risen up against the dogmas of the catholic faith. For when such pestilent persons were persistently sowing perverse dogmas, in the beginning of their pestiferous doctrine, the prelates and others exercising the government of judicial power, like dumb dogs unable to bark, and not avenging with the Apostle every disobedience with readiness, did not take care to coerce canonically those very heresiarchs, pestilent and deceitful, and their truculent wolf-like rage immediately, as they were bound to do, nor did they expel them bodily from the house of the Lord, but rather permitted their sacrilegious, falsifying and pernicious doctrine to prevail through long delays of negligence: a multitude of peoples, deceived by their false opinions, accepted as true what they had long been sowing mendaciously and perniciously and damnably, and believing in them, a great crowd fell from the right faith, and became involved in erring deviation, alas! to such a degree that, spread through the diverse parts of those same regions and neighbouring lands, the heresiarchs themselves successively infected the catholic sheep of Christ, and made them rot in the filth of lies.
3 § 2. Wherefore the general Council of Constance, seeing the plague and ruin of so great a multitude of the faithful and of the orthodox faith, was compelled to cry out with Augustine: What shall the medicine of the Church do, seeking the salvation of all with maternal charity, as if raging among the frenzied and the lethargic? Should it despise, should it cease or can it cease? Certainly not, according to the same Augustine, but it is necessary for both to be troublesome, which is hostile to neither. For the physician is troublesome to the raging frenzied man, and the father to the undisciplined son, the one by binding, the other by beating, but both by loving. If, however, they neglect and permit them to perish, says Augustine, this false gentleness is rather cruelty. Therefore the aforesaid synod, for the glory of almighty God and for the conservation, increase and salvation and preservation of His catholic faith and Christian religion and of souls, the same John Wycliffe and John Huss and Jerome, who, among other things, concerning the sacred sacrament of the Eucharist and the other sacraments of the Church and articles of faith otherwise than the holy Roman Church believes, holds and preaches and teaches, were attempting recklessly and damnably to believe, hold, preach and teach pertinaciously, as heretics and pertinacious and obstinate persons already separated from the communion of the faithful, expelled bodily from the house of God, and declared to be spiritually expelled, and enacted and decreed certain other things useful and salutary concerning the aforesaid matters, by which others, who, the heresiarchs and their false doctrines being the cause, had spiritually gone forth from the house of God, might through canonical ways be led back to the paths of truth.
4 § 3. Because, as we have sorrowfully learned, we know that not only in the kingdom of Bohemia and in the marches and dioceses, nations and places aforesaid, certain persons, but also in certain parts and provinces adjoining or neighbouring to the same, even some of the followers and adherents of the heresies and errors of the aforesaid heresiarchs, having cast aside all fear of God and human shame, and taking no fruit of conversion and penance from the miserable death of those same persons, and especially of John Huss and Jerome, but as though pressed into the depths of sins, do not cease to blaspheme the Lord God, making His name of no effect, whose minds the father of lies has so damnably blinded, that they read, study, and from the aforesaid books, codices and writings containing heresies and errors, which were long since condemned by the aforesaid synod and condemned, and appointed and burned in the fires, they presume to dogmatize in peril to themselves and to many simple folk, not only against the statutes, decrees and ordinances established in the aforesaid synod, but also against the canonical sanctions, to the peril of souls and to the detriment of the purity of faith and scandal to many.
5 § 4. We therefore, considering that error which is not resisted is approved, and desiring to resist such evil and pernicious errors and to root them out utterly from the midst of Christ's faithful, and especially from the aforesaid dominions and districts of Bohemia and Moravia and their borders and vicinities, lest they extend further and more widely, do by apostolic writings, with the approval of the sacred Council of Constance, commit and command to your discretion that you, archbishops and bishops and elects, and each of you, by yourselves or through another or others, whom we will to be grave and suitable persons having spiritual jurisdiction, shall judge all and singular, of whatsoever dignity, office, pre-eminence, status or condition they may be, and by whatsoever names they may be called, who, concerning the most excellent, salutary and supremely wonderful sacrament of the Body and Blood of Our Lord Jesus Christ, or concerning Baptism or the Confession of sins, Penance for sins enjoined or the other ecclesiastical sacraments or articles of faith, think or teach otherwise than the most holy Roman Church and the universal Martin P.P.
6 Church teaches to its prelates, that they deliver the same as heretics judged to the secular Court to be punished:
7 teaches, preaches and observes, or the articles or books and doctrines of the aforesaid heresiarchs John Wycliffe and John Huss and Jerome, by the same Council of Constance, with their authors, as is aforesaid, condemned and condemned, shall hold, believe and dogmatize, and shall presume publicly or secretly in any way to praise or approve the end of life of the same heresiarchs, and their receivers, defenders and supporters of any kind, and also those believing and adhering to the same in contemplation of the aforesaid errors, you shall judge as heretics, and as heretics shall you deliver to the secular court.
8 § 5. Receivers also, supporters and defenders of such pestilential persons, who have believed in these errors, and who, not from favour or contemplation of these errors themselves, but perhaps from carnal love or some other occasion of this kind, have received such pestilential persons, besides the penalties inflicted by either law upon such persons by competent judges, shall receive punishment with such severity in so enormous a crime, that it may serve as an example to others committing crimes, so that those whom the fear of God does not recall from evil may at least be restrained by the severity of discipline.
9 § 6. With the rest moreover of such sect infected in any damnable way with the obstinate, who, after previous admonitions, severe competent admonition and frequent exhortation, which has been used piously towards them in hope of correction and amendment and conversion to the fruit of a better life, shall be unwilling to repent of the aforesaid errors and sect, and fully to recognize and confess themselves to the bosom and unity of holy Mother Church and the Catholic faith, which alone is able to save, without which no true aid of salvation comes to any, the severity of justice shall be tempered, as the quality of the deed shall have demanded, with the sweetness of mercy.
10 § 7. And nevertheless all professors of Christian and Catholic faith, the Emperor, kings, dukes, princes, marquises, and all princes of the world, that they expel the same from their dominions.
11 counts, barons, knights, potentates, rectors, consuls, proconsuls, scabini, communes and universalities of kingdoms, provinces, cities, towns, castles, villages, lands, and other places of this kind, as well as others exercising temporal jurisdiction, according to the form of law and its requirements, by apostolic authority, exhorting, admonishing and requiring that from the kingdoms, provinces, cities, towns, castles, villages, lands and all other places and dominions aforesaid, all and each of such heretics, according to the tenor of the Lateran Council, which begins, Sicut ait, in the manner also of those ensnared in the crime of usury, whom they shall know publicly or manifestly by evident proof of deed to be such, as diseased sheep infecting the flock of the Lord, they expel, until and so long as they receive other instruction in commands from us or from you or from other ecclesiastical judges or inquisitors holding the faith and communion of the Roman Church, nor permit the same in their districts to preach, to hold dwellings, to maintain a household, to enter into contracts, to exercise any business and commerce whatsoever, or to have the solaces of humanity with the faithful of Christ.
12 § 8. And if such heretics, public and manifest, although not yet declared by the Church, shall have departed in this so grave a crime, let them lack ecclesiastical burial, nor let offerings be made or received for them in piety: yet their goods from the time of the commission of the crime, according to canonical sanctions, being confiscated, let them not be occupied by those to whom they would otherwise pertain, until by such ecclesiastical judges having power in this matter a declaratory sentence upon the crime of heresy itself shall have been promulgated.
13 § 9. Those who, however, concerning heresy, by a competent ecclesiastical judge, shall have been found noted with mere suspicion or suspected, unless, according to the consideration and requirement of the quality of suspicion and the condition of the person, at the discretion of such a judge, they shall have shown their own innocence with fitting devotion, failing in a canonical purgation enjoined upon them, and being unable to purge themselves canonically, or, for the making of such a purgation, with damnable obstinacy refusing to swear, let them be condemned as heretics. Those, however, who shall have omitted to show the said innocence, from a certain negligence or sloth, and to make such a purgation, let them be struck with the sword of anathema, and until fitting satisfaction let them be avoided by all; so that, if they persist in such excommunication for a year, from then let them be condemned as heretics. If anyone, however, shall be found culpable concerning any of the aforesaid pestilential doctrine of the heresiarchs aforesaid, or concerning some articles only scandalous, rash, seditious or offensive to pious ears, let him be canonically punished. If, however, anyone shall be found suspected merely on account of infamy or suspicion of the said articles or of any of them, and in the canonical purgation enjoined upon him for this reason should fail, let him be held as convicted, and as canonically convicted let him be punished.
14 § 10. And moreover, renewing and also executing the disposition of our predecessor of happy memory, Pope Boniface the Eighth, which begins: Ut inquirendi negotium, in cap. 18 De haeresi, we exhort, require and command all the aforesaid temporal powers and lords and judges, by whatsoever dignities or offices or names they may be called, that, as they wish to be reputed and held faithful, and to be called sons of the Church, and to glory in the name of Christ, so, for the defense of the faith, to you archbishops, bishops and elects and inquisitors of heretical depravity and other ecclesiastical judges or persons, by you appointed to this end, as is set forth above, holding the faith and communion of holy mother Church, let them obey, and let them intend to provide and give aid and favor in the investigation, capture, diligent custody of heretics, as well as of believers, supporters, receivers and defenders of the same, when they shall have been requested by the same, so that the aforesaid pestilential persons, seeking to destroy others with them, in the power or prison by you archbishops, bishops, elects and inquisitors aforesaid, or to be appointed by you, or to a place which you or they shall order, within the district of the same lords' power, rectors or judges, let them lead or cause to be led without delay, where by Catholic men appointed by you archbishops or bishops, elects, or inquisitors or persons to be appointed in this manner, or by some one of you, under strict and diligent custody, lest they flee, placing them also in iron fetters and shackles, let them hold them, until their case shall be terminated by the judgment of the Church, and that from heresy by the competent ecclesiastical judge, who holds the faith and communion of the said holy Roman Church, they be condemned, let the aforesaid temporal lords or rectors, judges or their officials or messengers receive them left to them without delay to be punished with fitting punishment.
15 §11. But lest prejudice and scandal to the faith and orthodox Christian religion should arise from ignorance, whereby some might be circumvented in this matter, or crafty men might palliate it under the veil of frivolous excuse, and so that fuller instruction may be had in the future concerning the conviction or knowledge of heretics, receivers, defenders, supporters, believers and adherents thereof, as well as those suspected of heresy and others in any way stained by such perverted doctrine, we decree that the articles written below, concerning the said heresiarchs, are to be transmitted and also sent for the direction of the said faith, as much to the kingdom of Bohemia and regions adjacent to it, as to any other parts whatsoever in which this superstitious doctrine has in any way sprouted forth. Upon these matters we command and enjoin you and all other archbishops, bishops, and elects, and commissaries and inquisitors, in virtue of holy obedience, that each of you within the limits and places of your jurisdiction, as well as in the kingdom and marquisate and places adjacent to those aforesaid, even if those places extend beyond that jurisdiction more than two days' journey, shall diligently watch over the extirpation and correction of errors and heresies, and of such pestilential sect, in favour of the said orthodox faith, and shall compel all those defamed or suspected of such pestilential taint, under confession of crime, excommunication, suspension, interdict, or other formidable canonical or legal penalty, as it shall seem expedient to you, when and in what manner the quality of the deed shall require, to answer, by oath corporally sworn, touching the most holy Gospels or relics of saints, the image of the Crucifix, according to the observance of certain places, according to the interrogatories written below pertaining to each article, to each and every such article. For we intend and shall proceed against all and singular archbishops, bishops, and elects, and inquisitors, who shall have been negligent or remiss in extirpating the leaven of heretical depravity and purging their territory, district or place of such evils and wicked men, even to the privation or deposition of pontifical dignity, and we shall cause proceedings to be made, and shall substitute others in their place who are able and capable of confounding heretical depravity, and to proceed to other penalties inflicted against such by law and to others more severe, if it be expedient, we shall proceed and cause proceedings to be made, according to the exigency of law and fact, and the foulness of such guilt and crime. But the tenor of those same articles or chapters, of which mention was made above, follows in order in these words.
16 § 12. Tenor of the articles of John Wycliffe. 1. The substance of material bread and likewise the substance of material wine remain in the Sacrament of the altar. 2. The accidents of bread do not remain without a subject in the same Sacrament.
17 3. Christ is not in the same Sacrament identically and really in His own bodily presence.
18 4. If a bishop or priest exist in mortal sin, he does not ordain, does not consecrate, does not confect, does not baptize. 5. It is not founded in the Gospel that Christ ordained the Mass. 6. God ought to obey the devil.
19 7. If a man be duly contrite, all external confession is to him superfluous and useless.
20 8. If the Pope be foreknown and wicked, and consequently a member of the devil, he has no power over the faithful given to him by anyone, unless perhaps by the Emperor. 9. After Urban VI no one is to be received as Pope, but one ought to live after the manner of the Greeks under their own laws. 10. It is contrary to Holy Scripture that ecclesiastical men should have possessions.
21 11. No prelate ought to excommunicate anyone unless he first know that he is excommunicated by God: and he who thus excommunicates is by this fact a heretic or excommunicated.
22 12. A prelate excommunicating a cleric who has appealed to the king or to the council of the realm is by that very fact a traitor to the king and realm.
23 13. Those who cease to preach, or to hear the word of God, on account of excommunication by men, are excommunicated, and in God's judgment shall be held as traitors to Christ.
24 14. It is lawful for any deacon or presbyter to preach the word of God without the authority of the Apostolic See or of a Catholic bishop.
25 15. No one is a civil lord, no one is a prelate, no one is a bishop, while he is in mortal sin.
26 16. Temporal lords can at their discretion take away temporal goods from the Church, from those habitually delinquent in possessions, that is, delinquent from habit, not only in act.
27 17. The common people can at their discretion correct delinquent lords. 18. Tithes are pure alms, and parishioners can, on account of the sins of their prelates, at their pleasure take them away.
28 19. Special prayers applied to one person by prelates or religious do not profit him more than general prayers, other things being equal.
29 20. One who gives alms to the brothers is excommunicated by that very fact.
30 21. If anyone enters into a private religion, whether of those possessing property or of mendicants, he becomes less fit and less capable of observing the commandments of God.
31 22. The saints who instituted private religions sinned in so instituting them. 23. Religious living in private religions are not of the Christian religion. 24. The brothers are bound to acquire their sustenance through the labors of their hands and not through begging.
32 The first part is scandalous and presumptuously asserted, inasmuch as it speaks thus generally and indirectly, and the second is erroneous, inasmuch as it asserts that begging is not permitted to the brothers.
33 25. All are guilty of simony who bind themselves to pray for others when the latter provide them with temporal support.
34 26. The prayer of the foreknown avails no one. 27. All things happen by absolute necessity.
35 28. The confirmation of youths, the ordination of clerics, the consecration of places are reserved to the Pope and bishops on account of greed for temporal gain and honor. 29. Universities, schools, colleges, graduations and masterships in the same are vain things introduced by pagan custom, and profit the Church as much as the devil.
36 30. The excommunication of the Pope or of any prelate is not to be feared, because it is a censure of Antichrist.
37 31. Those who found cloisters sin; and those who enter them are men of the devil.
38 32. To enlarge the clergy is against the rule of Christ.
39 33. Pope Silvester and the Emperor Constantine erred in endowing the Church 2. 34. All of the Order of Mendicants are heretics: and those who give them alms are excommunicated.
40 35. Those entering a religion or any Order are by that very fact unfit to observe the divine precepts, and consequently to attain the kingdom of heaven, unless they apostatize from the same. 36. The Pope with all his clerics who possess property are heretics, because they have possessions; and all who consent to them, namely all secular lords and other laypeople.
41 37. The Roman Church is the synagogue of Satan, and the Pope is not the proximate and immediate vicar of Christ and the Apostles. 38. The decretal letters are apocryphal, and they seduce from the faith of Christ, and clerics are foolish who study them. 39. The Emperor and secular lords are seduced by the devil, so that they endowed the Church 3 with temporal goods.
42 40. The election of the Pope by the cardinals was introduced by the devil.
43 41. It is not necessary to believe that the Roman Church is supreme among other Churches.
44 It is an error if by the Roman Church one understands the universal Church, or a general council, or if one were to deny the primacy of the Supreme Pontiff over other particular Churches.
The tenor of the articles of John Hus.
45 42. It is foolish to believe in the indulgences of the Pope and bishops.
46 43. Oaths are illicit which are made to confirm human contracts and civil commerce.
47 44. Augustine, Benedict and Bernard are damned, unless they repented of this, that they had possessions and instituted and entered religions: and thus from the Pope down to the last religious all are heretics.
48 45. All religions indiscriminately introduced were introduced by the devil.
§ 13. The tenor of the articles of John Hus.
49 1. The holy universal Church is one, which is the totality of the predestined, and it follows below: The holy universal Church is only one, just as there is only one number of all the predestined. 2. Paul was never a member of the devil, although he performed certain acts similar to the acts of those maligning the Church. 3. The foreknown are not parts of the Church, since no part of it will finally fall away from it, because the charity of predestination, which binds it, will not fall away.
50 4. Two natures, divinity and humanity, are one Christ.
51 5. The foreknown, although sometimes he is in grace according to present justice, is nevertheless never a part of the holy Church: and the predestined always remains a member of the Church, although sometimes he may fall away from adventitious grace, but not from the grace of predestination.
52 6. Taking the Church for the assembly of the predestined, whether they are in grace or not according to present justice, in this way the Church is an article of faith.
53 7. Peter is not and was not the head of the holy Catholic Church.
54 8. Priests living criminally in any way pollute the power of the priesthood: and thus, like infidel sons, they feel infidelity concerning the seven sacraments of the Church, concerning the keys, offices, censures, customs, ceremonies and sacred things of the Church, the veneration of relics, indulgences and orders. 9. Papal dignity grew up from Caesar, the authority and institution of the Pope emanated from the power of Caesar.
55 10. No one without revelation could reasonably assert of himself or another that he was the head of a particular Church, nor is the Roman Pontiff the head of the Roman particular Church.
56 11. It is not necessary to believe that whoever is the Roman Pontiff is the head of any particular holy Church, unless God has predestined him.
57 12. No one holds the place of Christ or Peter unless he follows him in morals, since no other following is more pertinent, nor does he otherwise receive procuratorial power from God, because for that office of vicariate there is required conformity of morals and the authority of the one instituting.
58 13. The Pope is not a true and manifest successor of the Prince of the Apostles, Peter, if he lives in ways contrary to Peter: and if he seeks avarice, then he is the vicar of Judas Iscariot. And, with equal clarity, cardinals are not true and manifest successors of the college of the other apostles of Christ, unless they have lived in the manner of the apostles, keeping the commandments and counsels of our Lord Jesus Christ. 14. Doctors who hold that someone who is to be corrected by ecclesiastical censure, if he is unwilling to be corrected, is to be handed over to secular judgment, in this certainly follow the Pontiffs, Scribes and Pharisees, who, because Christ was unwilling to obey them in all things, said: It is not lawful for us to put anyone to death, and handed Him over to secular judgment, and such men are graver murderers than Pilate.
59 15. Ecclesiastical obedience is obedience according to the invention of the priests of the Church, apart from the express authority of Scripture.
60 16. The immediate division of human works is that they are either virtuous or vicious: because if a man is vicious and does anything, then he acts (1) viciously: because just as vice, which is called crime or mortal sin, infects universally the acts of a vicious man, so virtue vivifies all the acts of a virtuous man.
61 17. Priests of Christ living according to his law and having knowledge of Scripture and the effect of building up the people, ought to preach, notwithstanding a pretended excommunication; and further: If the Pope or any prelate commands a priest so disposed not to preach, the subject ought not to obey.
62 18. Whoever receives the office of preaching by mandate, who has attended to the priesthood: and he ought to execute that mandate, notwithstanding a pretended excommunication. 19. By ecclesiastical censures of excommunication, suspension and interdict, the clergy supplies the lay people to itself for its own exaltation, multiplies avarice, protects malice and prepares the way for Antichrist. And a clear sign is that such censures proceed from Antichrist, which they call in their processes fulminances, by which the clergy proceeds most principally against those who lay bare the wickedness of Antichrist, whom the clergy will usurp most especially for itself.
63 20. If the Pope is wicked and especially foreknown, then, like the apostle Judas, he is a devil, a thief and a son of perdition, and he is not the head of the holy Church militant, nor is he even a member of it.
64 21. The grace of predestination is the bond by which the body of the Church and any member of it is joined to Christ the head insolubly.
65 22. A wicked and foreknown Pope or prelate is equivocally a pastor, and truly a thief and a robber.
66 23. The Pope ought not to be called most holy, for according to office, because otherwise a king ought also to be called most holy according to (1) Addenda from Raynaldus: viciously; and if he is virtuous and does anything, then he acts etc., which perhaps fell away from the Mainardian printers.
67 office, and torturers and executioners would be called holy, indeed even the devil ought to be called holy, since he is an officer of God. 24. If the Pope lives contrary to Christ, even if he ascended by a right and legitimate election according to the commonly published human constitution, nevertheless he ascended from elsewhere than through Christ, even granted that he entered by an election made principally by God: for Judas Iscariot was elected lawfully and legitimately by God Christ Jesus to the episcopate, and yet he ascended from elsewhere into the sheepfold of the sheep.
68 25. The condemnation of forty-five articles of John Wycliffe made by doctors is irrational and unjust and wrongly done, and the reason alleged by them is false, namely that none of them is catholic, but each of them is either heretical, or erroneous, or scandalous. 26. Not by the very fact that electors or the greater part of them have consented by word of mouth according to the rite of men in some person, by that very fact is that person legitimately elected, or by that very fact is he a true and manifest successor or Vicar of the Apostle Peter, or of another apostle in ecclesiastical office: hence whether the electors have chosen well or badly, we ought to believe in the works of the elected. For by the very fact that someone operates more abundantly in a meritorious way for the benefit of the Church, he has from God power to do this more abundantly.
69 27. There is not a spark of appearance that it is necessary for there to be one head in spiritual matters ruling the Church, who always converses and is preserved with the Church militant itself.
70 28. Christ without such monstrous heads would better rule his Church through his truthful disciples scattered throughout the world.
71 29. The apostles and faithful priests strenuously of the Lord in things necessary for salvation ruled the Church before the office of Pope was introduced: they would do so, with the Pope failing by the utmost possibility until the day of judgment.
72 30. No one is a civil lord, no one
73 The tenor of interrogatories according to which heretics or those suspected of heresy ought to be interrogated.
74 is a prelate, no one is a bishop while he is in mortal sin.
75 § 14. The tenor of interrogatories according to which heretics or those suspected of heresy ought to be interrogated.
76 1. Concerning the foregoing articles, however, whoever is suspected of any of them, or is found in the assertion of them, shall be interrogated according to the manner written below: first, whether he has known John Wycliffe of England, John Huss of Bohemia, Jerome of Prague, or any of them, and whence he has had knowledge of them, and whether he has had conversation or friendship with them or any of them while they lived. 2. Likewise, whether, knowing that they or any of them were excommunicated, he knowingly participated with them, considering and saying that such participation is not a sin. 3. Likewise, whether after their death, he has prayed for them or any of them, and publicly or secretly exercised works of piety, asserting that they are blessed and saved. 4. Likewise, whether he has regarded them or any of them as saints, and said so, and has exhibited venerations to them as to saints. 5. Likewise, whether he believes, holds and asserts that every general council and also the Council of Constance represents the universal Church.
77 6. Likewise, whether he believes that what the sacred Council of Constance, representing the universal Church, has approved and approves in favor of the faith and for the salvation of souls, that this is to be approved and held by all the faithful of Christ (1), to be believed and asserted as condemned.
78 7. Likewise, whether he believes that the condemnations of John Wycliffe, John Huss and Jerome of Prague made concerning their persons, books and documents by the sacred general Council of Constance, were (1) Lacking here also, without doubt, and for the same reason as on the preceding page, these words or equivalent ones: and what it condemned and condemns, this etc.
79 rightly and justly made, and are to be held by any Catholic as such and firmly asserted. 8. Likewise, whether he believes, holds, asserts that John Wycliffe of England, John Huss of Bohemia and Jerome of Prague were heretics and are to be named and regarded as heretics, and that their books and doctrines were and are perverse, on account of which and which, and through their obstinacies, by the sacred Council of Constance they are condemned as heretics.
80 9. Likewise, whether he has in his power any treatises, opuscules, epistles or any other writings in whatever language by John Wycliffe, John Huss, and Jerome heretics, or by their pseudo-disciples and followers published or translated, published or translated, which he shall present those or those to the ordinary of the place, or his commissioner or inquisitor under oath. Which if he does not know that he has such writings with him, but elsewhere, that he shall swear to deposit those around his ordinary or the others aforesaid within a certain term to be fixed for him. 10. Likewise, whether he knows any one or any ones having the aforesaid treatises, opuscules, epistles, or any other writings in whatever language composed or translated, that he shall denounce or reveal that one or those, for the purification of the faith or the execution of justice.
81 11. Likewise, let him be interrogated especially if literate, whether he believes the sentence of the sacred Council of Constance concerning the forty-five articles of John Wycliffe and the thirty articles of John Huss described above, made, to be true and catholic, namely, that the aforesaid forty-five articles of John Wycliffe and the thirty of John Huss are not catholic, but some of them are notoriously heretical, some erroneous, others rash and seditious, others offensive to pious ears.
82 12. Likewise, whether he believes and asserts that in no case is it lawful to swear. 13. Likewise, whether he believes that at the command of a judge an oath concerning the truth is

27 17. I popolani possono a loro arbitrio correggere i signori delinquenti. 18.

74 è prelato, nessuno è vescovo mentre è in peccato mortale.
C. IM8
