Bull on the reform of the Franciscan Order

Bull of Pope Leo X ·

Appointment of Executors. — 20. Derogation of Contrary Provisions. — 21. Authenticity of Transcripts. Leo, bishop, servant of the servants of God, for perpetual remembrance of the matter.

1 Go you also into my vineyard, said the man who hired labourers. Behold the father of the family, who planted a vineyard. Our Lord Jesus Christ, the Saviour and Redeemer of the World, who, although He cares for all things and directs all that He Himself has made; yet, among the other plantations which the heavenly Father1 planted through Him in the soil of the Church militant, a certain vineyard He has pursued with such burning love that He calls it, as it were, His own: this vineyard indeed He has so cultivated with assiduous, diligent and faithful labourers, that He sent other workers in the early morning, others at the third hour, the sixth, the ninth, and indeed the eleventh hour, as if ceaselessly; This is that sacred Religion of the Friars Minor, which, with the green foliage of ceremonies flourishing, through apostolic men, as through branches extended from sea to sea, and from the river even to the ends of the earth, has irrigated the mountains with the wine of wisdom and knowledge, and filled the earth. This is the holy and immaculate Religion, in which, through a mirror without blemish, the presence of the Redeemer is contemplated, the form of the way of Christ and the Apostles is beheld, through which the norm of the first founders of the Church is brought again before the eyes of the Christian people; which finally represents nothing save the divine, the angelic, filled with all perfection and conformable to Christ alone, so that not undeservedly it is called His own. To cultivate this vineyard in the early morning, the sun already rising, the Father of the family Himself sent that angel ascending from the rising of the sun, having the sign of the living God, blessed Francis, who, accompanied by men of wondrous holiness, laid the first foundations of this vine; there succeeded religious men, who, under blessed Bonaventure as leader, repaired the walls of the vineyard, already threatening on both sides, at the third hour, by the virtue and aid of the holy Trinity. After these, as it were at the sixth hour, there came forth certain brothers fervent in spirit, who, sent and strengthened by the sacred Council of Vienne, as by God, recalled the enfeebled discipline of censure to its original principles. But at the ninth hour, the Lord dying, with evils and scandals of this vineyard's labourers increasing daily, the Lord raised up the spirit of youth in a few brothers, namely, who, under the leadership and presidency of blessed Bernardino, bearer of the name of Jesus, strengthened by the supports of the sacred Council of Constance, vivified throughout the whole world an Order that was languishing, indeed almost dead. Finally in these days, as it were at the last hour, there appeared other men, who, zealous for the house of Israel, cut down groves, and demolished shrines; and, where sin abounded, with the Lord's help, they took care through the introduction of the norm of reform, that grace might superabound. But, just as among those parabolic and evangelical vinedressers, because the last were made equal to the first, a murmur arose not small, so with kings, princes, communities and peoples acclaiming; we have heard that grave disputes and quarrels and dissensions, on occasion of superiorities and degrees of preference, among some of the professors of this Religion throughout the whole world, are increasing daily more and more.

2 § 4. Wherefore We, whose mind, from tender age, has burned with ardent devotion toward the professors of this Order and the Order itself as a whole, now indeed from the common care of administration and pastoral governance, which We unworthily sustain, are driven to compose such disputes of the labourers and to calm the murmurings, in the manner of that evangelical steward, all the more earnestly, the more frequently We recall with intent mind the abundant fruits which from their exemplary life and salutary doctrine We continually see accruing to the universal Church.

3 § 2. Nor less by the continuous petitions and prayers of Christian princes, especially of Our most beloved sons in Christ Maximilian elected Emperor, and Francis the most Christian King of the French, and Charles the Catholic King of Spain, Henry the Eighth of England, and Emmanuel of Portugal and the Algarves, and Louis of Hungary and Bohemia, and Sigismund of Poland, and Christian of Denmark, illustrious kings, and certain other princes, dukes, counts, peoples and communities, are We provoked piously, by which, for the sake of appeasing such divisions arisen in the Order of St. Francis, they cease not even to this day to petition Us.

4 Discord arisen between the brothers of the Observance and Convent of the said Order.

5 For the termination of which the princes instituted [proceedings] before the Pontiff.

6 § 3. Having therefore appointed by us in our secret consistory certain of our venerable brothers, the Cardinals of the Holy Roman Church, we have committed and enjoined upon them to inquire diligently into the causes and sources of such disputes and divisions, and to treat of suitable remedies for settling the aforesaid quarrels; who, after a long and mature examination, most diligently and faithfully fulfilling our commands, having made a report to us, and having weighed by us more carefully those matters which were treated and examined by them for the sake of such concord; having also held mature deliberation upon these matters in our said consistory with the same and the other Cardinals of the same Roman Church, and by their unanimous counsel, we judge that provision must be made for the aforesaid Order in the manner written below.

7 § 4. Because we have first ascertained the diversity of prelates, some of whom held the office of general minister for perpetuity, while others held it for a time, and this unreformed state of affairs, lasting for six years, has greatly contributed to such disputes and divisions; for this reason we will and ordain, as is contained in the Rule of Blessed Francis, that henceforth one general minister of the whole Order be placed over all and each of the brothers of the same Order, with full power which belongs to him from the Rule, to whom all and each of the aforesaid brothers are firmly bound to obey in all things that are not against God, holding fast to their soul and the Rule; which general minister shall hold the office of generalship for six years at most; within which time, if it should at any time appear to the universality of provincial ministers and custodians that the aforesaid general minister is not sufficient for the service and common utility of the brothers, the aforesaid brothers to whom the election of the said general minister was given are bound to elect another for themselves in the name of the Lord, and when the six years (as is aforesaid) are completed, he shall by that very fact be absolved from the office of generalship, and shall be held as such by all.

8 § 5. Moreover, the election of a successor shall be made by the provincial ministers and custodians of the reformed brothers, both those in the mountains and those beyond the mountains, in the general chapter of the said Order, on the feast of Pentecost, in the place which the general minister with the general chapter immediately preceding shall have deemed fit to assign. To which chapter all ministers and custodians, whether vocal, both those in the mountains and those beyond the mountains, are bound to come. And lest the head appear deformed in its members, we will and also ordain that no brother can be elected as general minister unless he leads a reformed life and is held as reformed by the community of the reformed. Moreover, in the aforesaid election of the general minister, no one whatsoever shall have a voice unless he is reformed and is held as reformed by the congregation of the reformed; and if in the future anything contrary to this be attempted, it shall be held as entirely null and void.

9 § 6. Moreover, as to the election of the future general minister, on the next feast of Pentecost, in the convent of Ara Caeli in the City, according to another ordinance of ours contained in letters in the form of a brief, to be celebrated; we establish that all reformed ministers and custodians, and vicars and discretes of the brothers of the Observance or of the Family shall celebrate the said election. And so that the aforesaid election of the general minister, which, according to the aforesaid Rule, ought to be made by the provincial ministers and custodians, may be celebrated freely, according to the intention of the same Rule, and without any scruple, we declare all provincial ministers and vicars of the brothers of the Family or Observance to be true ministers, and we ordain and institute them as such for the purpose of this election. We likewise declare their discretes to be custodians; as to the other reformed brothers, we will that in provinces in which ministers are not now reformed, nor held as reformed, under whom there are some reformed convents, two brothers elected by the aforesaid reformed convents, according to the tenor of our other letters under the form of a brief, shall supply the voices of the non-reformed ministers, as far as the aforesaid provinces are concerned, for this time only. To the brothers moreover of the congregation of brother Amadeus, of Clareno, of the Holy Gospel, or Capuchin, for each province in which they have convents, beyond the voices of their vicars, we grant two for this time only. Which election, to be made by the aforesaid brothers of such a general minister, we define and also declare to be canonical, according to the Rule of the Friars Minor and the form delivered by Blessed Francis in the Rule.

10 § 6. As to the election of the future Minister General, we ordain that it be celebrated in the approaching feast of Pentecost, in the assembly at the Church of Ara Caeli in the City, according to another ordinance of ours contained in letters in the form of a brief ij; and we establish that all reformed ministers and custodians, and vicars and discretes of the brethren of the Observance or of the Family shall celebrate the said election. And in order that the aforesaid election of the Minister General, which, according to the aforesaid Rule, ought to be made by the ministers, provincials and custodians, be celebrated freely, according to the intention of the same Rule, and without any scruple whatsoever, we declare all provincials and vicars of the brethren of the Family or Observance to be true ministers, and we ordain and institute them as ministers for the purpose of this election. We likewise declare their discretes to be custodians; as to the other reformed brethren, we will that in provinces in which ministers are not at present reformed, nor held to be suitable for the reformed, under which there are some reformed convents, two brethren elected by the aforesaid reformed convents, according to the tenor of our other letters in the form of a brief, shall supply the votes of non-reformed ministers, as far as the aforesaid provinces are concerned, for this time only. To the brethren moreover of the congregation of brother Amadeus, of Clareno, of the Holy Gospel, or Capuchin, for each province in which they have convents, beyond the votes of their vicars, we grant two votes for this time only. We define and also declare that this election, to be made by the aforesaid brethren of such a Minister General, is canonical, according to the Rule of the Friars Minor and the form handed down by blessed Francis in the Rule.

11 § 7. And so that in the Order itself, as much as with God's help can be done, peace may be preserved, and charity may flourish among the brethren, let...

13 We ordain that if the minister general, as aforesaid, shall have been elected from the cismontane brothers for six years, in the following six years he ought to be elected from the ultramontane brothers; which manner, by alternating turns, we wish to be observed by them in perpetuity. But, because we perceive that the same Order has been marvelously expanded throughout all Christendom, lest, on account of such amplitude, it should lack the benefit of due pastoral governance, we decree that if the minister general shall have been elected from the cismontane brothers, he shall institute in the ultramontane regions a general commissary, to be elected by the same ultramontane brothers, to whom the minister general shall commit his authority over the aforesaid ultramontane brothers, as it shall seem expedient to the general chapter. Yet so that the aforesaid commissary shall be properly subject to the minister general, as the other prelates of the said Order are subject, and he shall be bound to obey him in all things according to the Rule.

14 § 8. But when the minister general shall have been elected from the ultramontane brothers, then likewise he ought to institute a general commissary of the cismontane brothers in the same manner as was touched upon and established above concerning the ultramontane commissary. The same general commissary shall exercise the office of general commission for three years only; which three years having elapsed, a new commissary, to be elected by the minister general in the general chapter, as above, according as shall be provided for the ultramontane commissary, ought to be instituted; but the minister general, in the regions in which he shall have been for his six years, and if he shall wish to betake himself to other regions, for the time in which he shall be absent, may leave a commissary in his place, by the counsel and consent of the definitors of the general chapter only. And in the regions in which there shall not be a general commissary during the said six years, the minister general shall be bound to celebrate one general chapter in the first three years of the said six years, to which the vocal members of those regions from which he was assumed shall convene; and likewise he shall have to celebrate another chapter in the regions from which he was not assumed, by himself or his commissary, to which all the vocal members of the said regions shall be bound to attend; or let that be done which the general minister with the general chapter shall have judged to be done.

15 § 9. Furthermore, as to the provincial ministers in the provinces in which ministers are not now reformed, or are not held to be reformed, we declare, ordain and decree that the vicars of the brothers of the Observance or Family of those provinces respectively, from now and in perpetuity, are the true and undoubted ministers of the same provinces, and ought henceforth to be called by that name; to whom we fully submit all and each of the brothers, as well as the houses and places of the same, existing in the said provinces, as aforesaid; and we perpetually grant to the general and other provincial ministers the authority and power, previously attributed and granted to the general and other provincial ministers, vicars of the Family so named, and we decree it to have been granted and attributed.

16 Ministers and

17 provincial office to be completed in three years.

18 They and the custodes may be deposed by the provincial chapter.

19 And let them be of the Observance

20 Observance who are deemed

21 Commanding the aforesaid brothers, even those purely and simply observing the Rule of Blessed Francis, that they obey the said ministers thus declared and ordained by us, as the true ministers of those provinces, according to the Rule, in all things.

22 § 10. Finally, lest from the perpetuity of provincial ministers the Order itself should collapse into ruin, we will and ordain that the aforesaid provincial ministers cannot be continued in their offices beyond three years; which three years having elapsed, they shall be held by all the brothers as absolved from office.

23 § 11. They may, however, within the said three years, by their provincial chapters, as they shall be celebrated according to the Rule and custom, if they shall be found less useful, be absolved from provincial offices; and the same judgment shall be held concerning the custodes in all respects.

24 § 12. No one, however, can be elected as provincial minister or custos, or have a voice in their election, unless he lead a reformed life and be held as such in the community of the reformed of that province to which he is to be placed in charge; but whatever shall have been attempted to the contrary is by that very fact null and void.

25 § 15. Furthermore, because mention is made frequently in the preceding and following sections of the Reformed and those who observe the Rule of blessed Francis in a pure and simple manner, We will and declare that under the name of Reformed and those who observe the Rule of blessed Francis in such a pure and simple manner are to be understood all and each of the following, namely the Observants, both of the Family and Reformed under ministers, and the brothers of Amadei, of Colelanis, of Clarenis, of the Holy Gospel, or of Capucio, and those called Discalceati, or others, and similar ones called by whatever other name and observing the Rule itself of blessed Francis purely and simply; and from all the aforesaid making one body together, We unite the same to one another perpetually, so that henceforth, the aforesaid diversity of names being set aside, the brothers Minor of St. Francis of the regular Observance may be called and may and ought to be called both together and separately. And all and each, as is aforesaid, united to the aforesaid general minister and to the provincial ministers and custodians, in whose provinces and custodies they respectively dwell, ought to be subject in all things and throughout all things according to the Rule. But the Conventuals living according to privileges, in what manner they ought to be subject to and obey the same general and provincial ministers, We shall declare through other letters of Ours to be issued on this matter.

26 § 14. Moreover, in order that the source of dissensions, scandals and partialities may be completely removed from the Order itself, We firmly command and enjoin, under the penalty of excommunication latae sententiae incurred by the very fact, from which no one, except at the point of death, can be absolved save by Us or by the Apostolic See, that no brother of the Order of St. Francis call another brother of the same Order maliciously, mockingly or contemptuously, privilegiatus, coletanus, bullista, amadeilam, clarenum, of the Gospel, or Capucio, bigot or by any other name whatsoever, even newly invented, or perhaps in the future, on account of the former divisions of the Order itself or of this Our holy institution and union, composed by the grace of the Holy Spirit, imposed by anyone, or by any other mocking, injurious or contemptuous name, or what is held to be contemptuous by those who suffer it: and likewise all, both clerics and laymen, that they not call such brothers or their supporters by the aforesaid names, mockingly or maliciously, but that all brothers of the Order itself be named by themselves and by all others brothers Minor, as is aforesaid, or of St. Francis.

27 § 15. Likewise, We decree that henceforth no reformed brother may—And that, the other denominations being set aside, all brothers Minor of St. Francis may be called.

28 The old names, especially in contempt, are forbidden to be used, under the penalties herein.

29 by any prelate of the Order, even the minister general, be sent to dwell at some convent not reformed or not held to be reformed; except that if it should seem to the provincial chapters a lesser evil to dismiss some brother to the not yet reformed than to retain him with the reformed; in such a case the prelates may send a brother or brothers reformed to the not yet reformed. Forbidding, under the penalty of excommunication latae sententiae, all and each of the prelates and brothers of those living according to privileges that they dare to receive any of the aforesaid reformed except in the manner aforesaid. Likewise to the said reformed brothers, under the same penalty, that they in no way recede from the obedience of their ministers except in the manner aforesaid. And lest, from the possible introduction of new sects in the said Order, the Order should again come into quarrels, We will, and in virtue of holy obedience firmly command and enjoin that henceforth no new sects or reformations be introduced or made in the said Order, without the express consent of the general minister or of the provincial ministers of the reformed in their provinces respectively. Yet so that the said reformations are in all things subject to the said general minister and provincial reformed according to the Rule, as is expressed above concerning the other reformed.

30 § 16. Wherefore all houses, places and hermitages of the New Observance, which the brothers of the Observance or of the Reformation, or other reformed brothers under ministers, by whatever name they have been called, have hitherto held and possessed, we do perpetually subject and incorporate to the said minister general and provincial ministers of the reformed and thus instituted and declared in their respective provinces. Willing that those places be perpetually held and possessed, ruled and governed by the said ministers and their successors, the reformed. All disputes arising therefrom, before whatsoever ordinary or delegated judges, even cardinals of the Holy Roman Church and the protector of the said Order or auditors of our sacred Palace or apostolic commissioners, as much in the Roman Curia as outside it, and as much among subjects in whatsoever status or stage, as much concerning possession as concerning claim, or even spoliation, if it can be alleged in any way, pending thereupon, even if such places had previously been of the Obedience and of the chapters of the conventional brothers of the said Order, we call to ourselves entirely and extinguish, imposing perpetual silence upon the parties. We also quash and annul the sentences and proceedings had and rendered by whatsoever judges therein, and whatever followed therefrom, even if the said disputes, by reason of the places, brothers and goods received on either side, or any other matter, occasion or cause, had been moved.

31 § 17. And nevertheless to the said conventional brothers, as well as to whatsoever judges and all others whatsoever, we forbid, command and mandate that they presume not to attempt, procure, judge or pronounce anything against this our declaration, institution, innovation, union and incorporation, in judgment or outside, even if it has been or shall be committed to them by us, under penalty of excommunication incurred by the very fact of the sentence, and deprivation of the benefices which they hold, and also disqualification from obtaining others hereafter.

32 § 18. Finally, so that, according to the exigency of the preservation of this reformation in the chapters, all things concerning the places, persons and morals which shall appear to conduce to the maintenance of the reformation, which by divine grace has already been introduced throughout Christendom in the said Order, may justly, providently and discreetly be established and ordained, we will that the next general chapter to be celebrated be held by deputies, some of the more approved, learned and most experienced brothers, assumed from diverse regions, who shall collect together all and singular things which they shall have judged fitting for the maintenance of the reformation and true observance of the Rule and due execution of this our constitution, to be approved by the whole chapter or the greater part thereof, and finally to be fortified by the protection of our apostolic confirmation.

33 § 19. And nevertheless to the present auditor general of the Apostolic Chamber for the time being, as well as to all archbishops and prelates of churches, and to whatsoever persons constituted in ecclesiastical dignity, by apostolic letters we command that they and each of them, publishing these our letters and whatsoever is contained therein, where and when it shall be necessary, and as often as they shall be required on behalf of the said general and provincial ministers of the reformed or any of them concerning this matter, solemnly publishing them and assisting them with the protection of effective defense in the premises, cause them to enjoy and possess peacefully all and singular the aforesaid, not permitting them to be molested thereupon in any way induly by whatsoever persons, exercising any authority. Compelling the contradictors by ecclesiastical censures and other remedies of law, invoking to this end also, if it shall be necessary, the aid of the secular arm, appeal being set aside. § 20. Notwithstanding whatsoever contrary apostolic letters and indults, even of the sacred Council of Constance, granted to the brothers, families, congregations or any of them of the said Religion, or to the authors and founders thereof, conventional or reformed or of the Family brothers, under whatsoever forms of words, solemnities and stronger and unusual clauses, granted or perhaps to be granted in the future, even if such were to be, so that special, express, individual and word-for-word mention would have to be made of them and their whole tenor, which, as far as the premises are concerned, we expressly derogate, and all other things contrary whatsoever.

34 § 21. Moreover, because it would be difficult to carry these our present letters to whatsoever places where it shall be necessary, etc.

35 our present letters to whatsoever places where it shall be necessary, etc.

36 Let no one at all, etc.

37 If anyone, however, shall attempt this, etc. Given at Rome at St. Peter, in the year of the Lord's Incarnation one thousand five hundred and seventeen, on the twenty-fourth day of May, in the fifth year of our pontificate. Given on 29 May 1517, pontificate year v.

Deputazione degli esecutori. — 20. Deroga dei contrari. — 21.

29 osservanza.

34 § 21. Del resto, poiché sarebbe difficile portare queste nostre presenti lettere a qualsiasi luogo, dove sarà necessario, ecc.

35 ecc.

36 A nessun uomo dunque ecc.
