Bull declaring indulgences for the souls in purgatory and granting privileges for the construction of St. Peter's Basilica

Bull of Pope Julius II ·

1 Declaration that the aforesaid indulgences may benefit souls existing in purgatory. — 24. Derogation of contrary provisions. Julius, bishop, servant of the servants of God, to all and each of those inspecting these present letters, greeting and apostolic benediction. It is clear to all guardians of the Christian faith that blessed Peter was constituted by our Savior himself, the Lord Jesus Christ, as prince of the apostles, and that to him was delivered the power of binding and loosing souls by heavenly privilege, when it is said to him: Thou art Peter, and upon this rock I will build my Church, and I will give to thee the keys of the kingdom of heaven. And whatsoever thou shalt bind upon earth, it shall be bound also in heaven; and whatsoever thou shalt loose upon earth, it shall be loosed also in heaven.

2 § 1. Whence we, who, though unworthy, are successors of that same keeper of the heavens, and reside in his place in the holy Church of God, considering that we are bound by the apostolic office enjoined upon us by God to provide for churches dispersed throughout the world, so that those churches themselves, which are the house of God, may not only be preserved in their structures and buildings, but also, if need be, repaired, we ought nevertheless to exercise greater care and diligence concerning the basilica of the City itself of Peter, prince of the apostles, so that, just as blessed Peter himself was constituted by our Savior prince of the apostles, so also that basilica itself, which requires no small repair among the other churches of the City and the world, may be rebuilt, constructed and enlarged with suitable and indeed necessary buildings, and, once rebuilt and enlarged, be preserved.

3 § 2. And since recently, from the foregoing and for certain other reasonable causes, according to the desire of our heart, we have applied working hands to the restoration of the said basilica, knowing that such a work cannot be brought to the desired end without pious and generous contributions of the faithful, through certain [indulgences granted] first to all Christian faithful of either sex, who, within a year to be reckoned from the day of publication of the same, would themselves place in a box placed for this purpose in the said basilica, or would cause to be placed by others, as much as their pious devotion would dictate to them, in money counted out or in other things to be converted to the work itself, or would exercise themselves personally about the work, or would bind themselves effectively to the good memory of Henry, archbishop of Taranto, our general treasurer, to piously contribute something to the work itself, according to their pious devotion,

4 § 3. So that they might be able to choose a suitable confessor, who could absolve them from certain cases then expressed, and concerning certain other cases also then expressed, in the forum of conscience in those cases only, we granted the faculty.

5 § 4. And then, providently attending to the fact that it would be difficult for the aforesaid [indulgences], within a year from the day of their publication, to come to the knowledge of Christian faithful beyond the mountains, so that they might benefit from them, we extended the same, through other letters of ours, to our good pleasure, and [we commanded] all Christian faithful, especially those who are in twenty-five provinces, in which the vicar

6 In the year 1510, the General Minister of the Order of Friars Minor, called the Observance, who dwells beyond the mountains, according to the manner of reckoning of the said Order, and under whom also all Italy, Sicily beyond the Strait, Corsica, Crete, Cyprus, Rhodes as far as Jerusalem, Dalmatia, Croatia, Bosnia, Hungary, Austria, Bohemia and Poland, and the islands of the Mediterranean Sea are contained, considering that, although the Christian faithful of this sort, dwelling in the said provinces and islands, devoutly desired to become partakers of the said indulgences granted for the said fabric; nevertheless, because on account of the distance of places they did not have complete convenience either of proceeding personally to the said fabric, or of transmitting pious alms for such fabric through another into the said box, desiring to provide for the eternal salvation of their souls and the opportune support of the said fabric, following the example of our Saviour himself, who sent his apostles to diverse parts of the world to preach the holy Gospel, that he might gain souls for the Father, as far as is granted from on high, to all of the same Christian faithful of either sex, of whatsoever dignity, status, degree, order, condition and pre-eminence they might be, even ecclesiastical religious and other secular persons, constituted throughout all the aforesaid provinces and islands, truly penitent and confessed, who, within one year and thereafter at our pleasure, to be reckoned from the publication of our prior letters aforesaid in the said provinces and islands, should devoutly visit the churches in the said provinces and islands, which formerly Hieronymus of Torniello, a professor of the Order of Friars Minor of the Observance so called, then living in the world, and who was then the vicar general of the said Order beyond the mountains, and to whom, on account of the integrity of his life, we specially entrusted the care of the aforesaid indulgences in the said provinces and islands, and whom we made, constituted and appointed as our nuncio and commissary of the Apostolic See in the said provinces and islands for these matters and the things written below for the said year and pleasure, should nominate, according to the prudent ordinance of the same nuncio and commissary, or of those to be appointed and to be appointed or subdelegated by him, to be made in this matter, and should effectively place pious alms in boxes, to be appointed for this purpose in aid of the said fabric by the nuncio or commissary or the one to be appointed or subdelegated aforesaid, according to the ordinance and discretion of the nuncio and commissary and those to be appointed or subdelegated aforesaid, we have granted and indulged remissions of sins and other spiritual gifts for obtaining the salvation of their souls, as is more fully contained in each of the aforesaid letters, whose tenor and faculties in the aforesaid matters granted also to the same Hieronymus in the form of a brief, we wish to be held as expressed as if they were inserted word for word in the present.

7 § 5. Since, however, the said Hieronymus, having discharged his commission, and those appointed by him in the aforesaid matters have exercised faithful and solicitous diligence and care, and the said fabric of the basilica has not been fully provided for, and the pious contributions of the faithful piously expended for the aforesaid have not been and cannot be satisfied, on account of the somewhat intolerable expense of the fabric itself necessary for this reason, but the pious sufferings of the same and other Christian faithful are most opportune.

8 § 6. We, desiring, as it is and among our other desirable matters is dear to us, that the fabric of the said basilica be brought to due perfection, and trusting greatly in the Lord in the faithfulness, diligence and solicitude in the aforesaid matters of our beloved son Francis Zeno of Milan, a professor of the Order of Friars Minor of the Observance so called, and vicar general of the provinces beyond the mountains of the said Order, according to the order of that order, on account of his goodness and experience of affairs, do make, constitute and appoint him in the said provinces and islands as our nuncio and commissary of these indulgences and of the Apostolic See with all and singular faculties and authorities and also of inhibiting any questors, otherwise granted to the same Hieronymus, as far as the aforesaid matters are concerned, also by our letters in the form of a brief, also beyond the faculties contained in the present, by apostolic authority, by the tenor of the present; and the same and all and singular faculties granted to the same Hieronymus and by him subdelegated to commissaries in the aforesaid matters in any way, we grant to the aforesaid Francis Zeno, vicar general, and to his subdelegated commissaries.

9 § 7. And nevertheless to all the faithful of Christ of both sexes, as well lay as religious of the Orders of the aforesaid provinces and islands, who, according to the ordinance of the same Francis Zeni, nuncio or commissioner or subdelegated or to be subdelegated, made for their prudent arrangement in this matter, shall have effectively placed pious alms in boxes, for this purpose in aid of the said fabric, through the nuncio and commissioner or to be delegated or to be delegated or to be subdelegated by them, according to the ordinance and discretion of the aforesaid nuncio and commissioner and of those to be delegated and subdelegated, may they obtain the most full remission of all their sins.

10 § 8. And those who with the aforesaid commissioner or those to be delegated and subdelegated, having the license to choose a confessor, whom they may choose as suitable, a secular priest or of any Order, even of the Mendicants, a regular, who, having diligently heard their confession, for offences and excesses and sins committed by the one choosing, however grave and enormous, even in cases reserved to the Apostolic See and in ecclesiastical censures, even those imposed by name for the insanity of someone, by consent of the parties, even by reason of interdict incurred and whose absolution would be reserved to the said See (except for machinations against the person of the Supreme Pontiff, the killing of bishops or other superior prelates, and the laying of violent hands upon them or other prelates, the falsification of apostolic bulls and letters, the carrying of arms and other prohibited things to the lands of infidels, and sentences and censures on account of the theft of our chalice, and those carried from the lands of infidels to the faithful against our prohibition, incurred), once in life; and in non-reserved cases, as often as they shall request, and in the article of death, may they impart the most full indulgence and remission of all sins, and impose salutary penance and administer the sacrament of the Eucharist, except on Easter day and in the article of death at other times of the year; and may they commute any vows whatsoever issued through them (except only those of overseas, entry into Religion and chastity) into other works of piety. And with those polluted by the stain of simony committed in orders or benefices, to those contributing to the same work, concerning any irregularity if any bound by such censures; celebrating masses and other divine offices, not however in contempt of the keys, or otherwise mingling in divine things, or otherwise in any way, even occupying ecclesiastical benefices indebly, on account of the aforesaid matters or otherwise, except by reason of voluntary homicide and bigamy, may they dispense, and absolve them, and abolish every stain and mark of disability and infamy arising from these things; and so that they may minister in the orders undertaken, and as if the ecclesiastical benefices acquired, which from then on are to be considered as newly conferred upon them, and the fruits received from them, even by reason of the omission of canonical hours and divine offices, some composition being made with them, may they grant.

11 Power given to the same commissioner of composing concerning ill-gotten goods, etc.

12 Owed to other churches, to which the Roman Church may succeed. To be restored to those whose person is unknown or doubtful, to legates, places or persons uncertain, not exact before publication of the bull, even ordinarily donated, etc.

IULTUS

13 § 9. Likewise concerning ill-gotten goods uncertain, or obtained through usurious wickedness, even certain ones which a usurer had extorted from another usurer, and which he himself, being asked, was not prepared to restore the usuries.

14 § 10. Or which were owed to some private Church, in which however the Roman Church could succeed by common law.

15 § 11. So that also concerning goods which had come into someone's hands, and those having them to whom they ought to be restored were ignorant or doubtful, although they do not exist as ill-gotten by them, or those goods came to them.

16 § 12. And similarly concerning those things which were left to the poor and other pious places, in general and without any special determination and the proper names of persons not expressed, for both past and future times, to compose: so that some sum having been paid for the said fabric to the same nuncio or commissioner or to be delegated or subdelegated by him only, to be placed in the boxes themselves, from the remainder of those thus left and ill-gotten, and obtained through usurious wickedness, or which came to them otherwise and to whom they ought to restore them they doubt or are ignorant, as aforesaid, from restitution they may exist absolved, and beyond this they are in no way bound to restore, may they grant.

17 § 13. And those sums which before the publication of the said indulgences of ours were not collected, even if they were left, given, and obtained by the ordinaries in any way for uncertain persons, and those which were collected by the ordinaries themselves or in their name after the said publication, and paid to them in any way, and also those which before the said publication were not owed for uncertain persons, or for uncertain persons and places, but after the aforesaid publication began to be owed, even if they were left, given or obtained by the ordinaries as aforesaid, as being owed to them, through the commissioner himself and those to be delegated and subdelegated by him, in the name of the said fabric, may freely be exacted and demanded and obtained and ought to be, even under ecclesiastical censures and pecuniary penalties and other appropriate remedies of law; invoking also for this, if need be, the aid of the secular arm.

18 § 14. And whosoever, before reaching legitimate age for sacred orders, even of the priesthood, promoted themselves without any dispensation in many cases, and ministered in the orders received, and who from any lawful or unlawful kinship arising, affinity and consanguinity, or carnal or spiritual kinship, between the one raised and the one raising, excepting the simple or multiple degree, and whosoever, who were publicly impeded by an obstacle of honesty, justice, or otherwise impeded in any way, contracted matrimony knowingly or unknowingly in the fourth or third degree, and through carnal copulation, though not public, even in the first degree of affinity, and consummated it, if such impediment had not been brought to judgment, or could not generate scandal, from such excess and from the sentence of excommunication which they would have incurred on this account, with salutary penance imposed on them according to the measure of their fault, which shall be directed to such fabric, and that they commit such things no more, nor provide aid, counsel or favor to those committing them, and other things which shall be enjoined by law, to absolve; and so that they may freely and lawfully contract matrimony anew with each other, and similarly remain in it thus contracted, declaring legitimate any offspring received from such matrimony, if any, and to be received, in the forum of conscience only, both as regards others, as regards those who, existing in the third or fourth degree of consanguinity, contracted matrimony as aforesaid, whom we wish to be absolved in both forums, and to be able to contract matrimony anew, even publicly; and with the same promoted, to dispense over irregularity, so that they may also minister in the said orders.

19 § 15. And with whosoever who occupied goods of churches, monasteries and ecclesiastical or pious benefices of whatever kind and judicially, with proofs failing, could not be compelled to their restitution, even if it could be proved by them.

20 § 16. And all goods and whatsoever bequeathed for ill purposes and otherwise in any way, even by title of heir or forfeiture for ill-gotten restitution hitherto left and which shall be left and transferred in the future, during the deputation now and of the commissioner made by these presents, in whatsoever wills, donations causa mortis, codicils or other last wills made by whosoever and wheresoever, and which, during such deputation, shall be made to uncertain churches and pious places, or to persons similarly uncertain or absent, so that, on account of their absence, knowledge of their merits could not be had from them; and also those which would be subject to restitution, but in them or to them persons to whom they ought to be made would not have reception.

21 § 17. Likewise whatsoever in wills, donations causa mortis, codicils or other last wills, for redemption of captives, pilgrimage, even if left to the Blessed Mary of Mercy, and the Holy Trinity Orders of the Redemption of captives, and St. Eulalia of Barcelona, and inheritances and goods of the deceased from intestacy of clerics and laypeople, even by apostolic indult, or otherwise ought to pertain to the aforesaid Redemption of captives, the faculty of the nuncio and commissioner granted during such time.

22 § 1 7. Likewise, whatever in testaments, wills, donations on account of death, codicils and other last wills whatsoever, for the redemption and ransom of captives, even if they shall have been left to the Blessed Mary of Mercy, and to the Orders of the Most Holy Trinity for the Redemption of Captives, and to St. Eulalia of Barcelona, and inheritances and goods of the deceased, both clerics and laypeople, even by apostolic indult, or otherwise dedicated to the aforesaid redemption of captives, ought to pertain thereto, with the faculty granted to the nuncio and commissioner during the duration of such office.

23 § 18. Likewise all and singular monies and other things, which in preparing and conducting festivities and public spectacles, at certain times of celebration, by will and statute, or custom, in whatsoever places they have been accustomed to be expended, and during the faculty of such nuncio and commissioner, ought to be expended, we apply to the fabric of such building; and under restitution of the honors of churches, monasteries and benefices of such kind, with competent receipt of portion or quantity for them to be converted into the fabric of such building, we freely absolve those thus holding them from further restitution thereof, and we also grant to them that they may freely retain it hereafter.

24 § 19. And the said nuncio and commissioner, and those to whom he shall have deemed fit to commit his powers in general or in particular, may decide whatsoever doubts, both concerning the quality of persons to whom the faculty of choosing a confessor may be granted, even if they be comprehended in the common cities, universities of towns, castles, villages and other places, and colleges, which and their individual persons would need absolution from the aforesaid or any of the aforesaid, and dispensation over them or any of them, as well as other doubts, and may limit and relax the sum of money for obtaining such indulgence and the other aforesaid matters.

25 § 20. And the faculty of choosing a confessor of such kind; and whatsoever indulgences, both from us and from our predecessors and from the aforesaid See or its authority to whatsoever churches, monasteries, hospitals, even our Holy Spirit in Saxia of the City, of the Order of St. Augustine, and other pious places, universities, confraternities of whatsoever quality, and for whatsoever use, even of layfolk and clerics instituted, and to singular persons, even plenary ones in life, and whatsoever faculties to whatsoever persons, of whatsoever dignity, even those holding the honor of cardinal or exercising legation over the aforesaid or any of the aforesaid heretofore granted (excepting those granted by reason of sustenance of the poor and miserable persons dwelling in hospitals in the Parisian and St. James of Galicia and Portuguese kingdoms, which, as to their use, are to be terminated in the provinces in which the said hospitals are respectively situated, according to the manner of our Chancery, and not to endure in any other places; and those granted for expedition against Turks and heretics), even with whatsoever clauses preservative against revocations and suspensions of the same contained therein, when and as often and for what time to the aforesaid nuncio and commissioner or those to be appointed or subdelegated by him shall seem opportune, to suspend; all and singular of which we by these presents suspend at the pleasure of our will, and decree and declare to be suspended. Wholly prohibiting whatsoever questuae, accustomed to be made on their occasion.

26 Giving faculty to choose confessors, and to suspend the indulgences of pious places, and whatsoever clauses preservative against revocations and suspensions of the same contained therein, when and as often and for what time to the aforesaid nuncio and commissioner or those to be appointed or subdelegated by him shall seem opportune, to suspend; all and singular of which we by these presents suspend at the pleasure of our will, and decree and declare to be suspended. Wholly prohibiting whatsoever questuae, accustomed to be made on their occasion.

27 § 21. And commanding all and each of the ordinaries of places, abbots and others, to whomsoever the care of such matters may be committed, of whatever dignity, status, grade, order, religion and condition or pre-eminence they may be, under pain of excommunication latae sententiae and a fine of five hundred ducats to be applied to the aforesaid fabric, to be incurred ipso facto, that they do not impede the publication and preaching of the said indulgences of ours and other suspensions of this kind in their churches, cities, dioceses, where and as often as it shall be necessary, and do not demand anything under pretext of publication, and do not even receive and exact from those offering of their own accord, or commit fraud or deceit in the aforesaid matters or concerning them, nor do those procuring such indulgences become partakers thereof and do not retard the bestowal of their pious suffrages from such their purpose of theirs, in whole or in part, directly or indirectly, tacitly or expressly, or through themselves or their vicars or officials grant license to conduct any collections to certain questors of any Order or Religion or fraternities or hospitals, or in any manner appointed. Moreover, all and each questors whom they shall find in their jurisdiction, together with their things and goods, which we decree to have been applied to the said fabric, and we command to be faithfully brought to the Apostolic Chamber, they may retain; nor in any way shall they dare or presume, through themselves or another, to molest or impede those dispensed, or those with whom, by virtue of these presents, it shall have happened to be dispensed by the aforesaid legate or those to be delegated or subdelegated, or to exact any penalties, in the case in which, as is aforesaid, dispensation shall have been made from statute or from custom. But to the questors named above under like penalties we forbid that they presume to conduct collections in any way; nor shall they in any manner vindicate their goods, arrested, applied and sold by the aforesaid fabric through the aforesaid commissioner or delegates or subdelegates, even by virtue of other letters of ours, their demerits requiring it, or recover them from the buyers or holders, or from the commissioner delegates or subdelegates aforesaid. And under like sentence and penalty we command all preachers of the word of God of whatever Orders, even Mendicant ones, that when requested by the aforesaid commissioner, or by those to be delegated or subdelegated by him, they exhort the aforesaid faithful to contribute to the said fabric; and when admonished by the aforesaid commissioner or by those to be delegated or subdelegated, they abstain from preaching on the days on which the said indulgences and suspensions are published by them or by their commission.

28 § 22. Yet it shall be lawful for the aforesaid commissioner and those to be delegated or subdelegated, to command and enjoin all and each of the aforesaid matters, even to all and each of the aforesaid, under the same penalties, as often as it shall seem to them or to any of them opportune; and likewise to relax any oaths whatsoever from any laypeople of either sex, concerning standing in any society, fraternity or number of persons, and concerning paying some share in perpetuity or for a time, on occasion of the fraternity, society and number, made in any manner on account of the said indulgences, privileges and collections, and to absolve the same from them. To restrain and compel any contradictors and rebels whatsoever, even by ecclesiastical censure and other appropriate remedies of law, invoking to this end, if need be, the aid of the secular arm; and to cause public processions to be made for the aforesaid purpose, and the people to be convoked by the sound of the bell for the performance of such works; and to absolve from the aforesaid censures and penalties, after previous satisfaction, and to remit them, and to relax such suspensions of indulgences. And that also to transcripts and confessionals in the said provinces, islands and territories, to any persons through the aforesaid nuncio and commissioner or those to be appointed or subdelegated by him, subscribed and furnished with his seal only, faith shall be given, by apostolic authority, by the tenor of these presents we grant license and faculty and will and command.

29 § 23. And so that the salvation of souls may be procured all the more readily, inasmuch as they have greater need of the suffrage of others, and are less able to profit themselves, by the aforesaid authority, from the treasure not lacking in Holy Mother the Church, to souls existing in purgatory, who departed this life united to Christ through charity, and who, while they lived, merited that such an indulgence should suffrage for them, being moved by paternal compassion, and desiring to succor them as much as we can with God, from divine mercy and from the fullness of apostolic power, we will and grant that, if any parents, friends, or certain faithful Christians, moved by piety, for those same souls in purgatory, for the expiation of the penalties owed to them according to divine justice, retained during the commission of the nuncio and commissioner, shall bestow some alms toward the work of such a fabric, according to the ordinance of the nuncio and commissioner and of those to be appointed and subdelegated by him, to whom they shall commit their authority, that same most full indulgence by way of suffrage shall suffrage to those same souls existing in purgatory, for whom the said alms shall have been piously bestowed, as aforesaid, for the remission of penalties. And all and each of the faithful of either sex, both ecclesiastical and secular, from the same fullness and liberality of power, who shall have extended helping hands to the work of such a fabric, and all and each of their deceased parents, benefactors, who departed with charity, in all prayers, suffrages, alms, fastings, prayers, masses, canonical hours, disciplines, pilgrimages, and all other spiritual goods whatsoever, which are done and can be done in the whole universal holy Church militant and in all members thereof, shall be made partakers in perpetuity.

30 § 24. Notwithstanding the foregoing and derogating apostolic constitutions, etc. But, because it would be difficult, etc. Let no one whatsoever be permitted to alter this page, etc. If anyone, however, shall attempt this, etc.
