SACRED CONGREGATION OF CONSISTORIAL AFFAIRS
ON THE REMOVAL FROM OFFICE AND BENEFICE OF A PASTOR. DECREE.

1 It has always been the greatest concern of the Church that the Christian people be governed and the salvation of souls be provided for by men chosen from among the priests, who would be distinguished by integrity of life and would discharge their duties with fruit.

2 Although, in order that these rectors might undertake with more willing spirit those things which they judged useful or necessary for the parish, freed from fear of being removed by the Ordinary at his pleasure, it was generally prescribed that they remain stable in their office; nevertheless, because this stability was introduced for the salvation of the faithful, it was provided by wise counsel that the same not be so insisted upon as to turn rather to their detriment.

3 Wherefore, if anyone wicked should destroy rather than build up the flock entrusted to him, he ought, according to the most ancient and constant custom of the Church, as far as is lawful, after a judicial inquiry into the crime, to be deprived of his benefice, that is, to be removed from the pastoral office. But if, by force of canon law, there is no place for criminal trial and penal deposition; and yet the pastor, for this or that reason, even with fault removed, does not exercise or is unable to exercise useful ministry in the parish, or perhaps his presence there becomes harmful; other remedies are available for providing for the salvation of souls. Chief among these is the removal of the pastor, which is commonly called economic or disciplinary removal, and is decreed not by any judicial apparatus, but by administrative means, and does not have the penalty proposed for the pastor, but the utility of the faithful. For the salvation of the people is the supreme law: and the pastoral ministry was instituted in the Church, not for the advantage of him to whom it is committed, but for the salvation of those for whom it is conferred.

4 S. Congregation of Consistorial Affairs.

5 Truly, since the canonical laws concerning this removal did not seem altogether certain and clear, the assembly of Consultors and Eminent Fathers presiding over the composition of the ecclesiastical code undertook to treat the matter separately and with repeated study; and when counsels had been compared, it was judged that a certain more careful form ought to be established by which this grave part of ecclesiastical discipline would be governed. When His Holiness Pope Pius X had both seen and approved these studies, in order to proceed more safely in a matter of such importance, he deemed it necessary to seek also the opinion of this sacred Congregation of Consistorial Affairs. This having been received and approved, so that the Church might, without any delay interposed, enjoy the benefit of this new discipline, he ordered a decree to be issued through this Sacred Congregation, by which the new norms concerning administrative removal from office or benefice of a pastor would be promulgated, and these same would constitute canonical law for the universal Church, to be duly and religiously observed by all to whom it pertains. These norms, however, are contained in the following canons.

I. — On the causes required for removal.

6 The causes on account of which a pastor can be removed by administrative means are these:

7 1° Insanity, from which, according to the opinion of experts, he cannot be seen to recover perfectly and without danger of relapse; or on account of which the pastor's reputation and authority, even if he should recover, would have suffered such loss among the people that it would be judged harmful to retain him in office. 2° Lack of skill and ignorance which renders the rector of the parish unequal to his sacred duties.

8 3° Deafness, blindness, and any other infirmity of soul and body which renders the priest permanently or even for a long time unequal to the necessary duties of the care of souls, unless this inconvenience can be properly remedied by a coadjutor or vicar.

9 4° Hatred of the people, although unjust and not universal, provided it be such as to impede the useful ministry of the pastor, and it is to be foreseen that he will not prudently survive it in a short time.

10 5° Loss of good reputation among good and serious men, whether this proceeds from dishonorable or suspect manner of living on the part of the pastor, or from some other harmful conduct of his, or even from an ancient crime of his which, recently discovered, can no longer be punished by penalty on account of prescription; or whether it proceeds from the deed and fault of the families and relatives with whom the pastor lives, unless provision has been made for the good reputation of the pastor by their departure.

11 6° A crime which, although actually hidden, is foreseen by the prudent judgment of the Ordinary to be about to become public soon with great offense to the people.

12 7° Harmful administration of temporal affairs with grave damage to the church or benefice; whenever a remedy for this evil cannot be brought about by removing the administration from the pastor or in another way, and the pastor otherwise exercises the spiritual ministry usefully.

13 8° Neglect of pastoral duties persisting after one and a second admonition and in a matter of grave importance, such as in the administration of the sacraments, in necessary attendance upon the sick, in the explanation of catechism and gospel, in the observance of residence.

14 9. Disobedience to the precepts of the Ordinary after one and a second admonition and in a matter of grave importance, such as avoiding familiarity with some person or family, caring for the due custody and cleanliness of the house of God, the manner to be observed in the exaction of parochial taxes and the like. The admonition of which above under the final double number, so that it be peremptory and a paternal presage of removal only proximate, must be done in the customary manner, by word of mouth and by the Ordinary, not secretly from all; but in such a way that legitimate record of the same is made in the acts of the Curia.

II. — Concerning the manner of proceeding in general.

15 § 1. The manner of arriving at administrative removal is this: that before all else the pastor be invited to resign: if he refuse, proceed to the decree of removal: if he lodge an appeal against the decree of removal, proceed to a revision of the acts and to the confirmation of the preceding decree.

16 § 2. In which stage of proceeding the rules set forth below are to be observed in such a way that, if they be violated in those matters which touch the substance, the removal itself shall be null and void.

17 S. Congregatio Consistorialis.

III. — Concerning the persons necessary for decreeing removal. Can. 3.

18 § 1. In the invitation to be made to the pastor to resign, and in issuing the decree of removal, the Ordinary in order to act legitimately cannot proceed alone; but he must associate with himself two of the examiners, concerning whom the Sacred Council of Trent determined, cap. XVIII, sess. XXIV, de reform., and require their consent in all acts for which it is expressly required here: in other matters, however, their counsel.

19 § 2. In the revision of the decree of removal, whenever this becomes necessary, let him assume two pastor consultors, whose consent or counsel he shall require, in the same manner as in the § above concerning the examiners. Can. 4.

20 In the election of examiners and pastor consultors, let this law be observed henceforth everywhere:

21 § 1. If a synod be held, in it, according to the received norms, there shall be elected so many in number as the Ordinary shall judge necessary by his prudent judgment.

22 § 2. To the examiners and pastor consultors, in the meantime between one synod and another, dying or ceasing from office for another reason, the Ordinary shall substitute others for the synod with the consent of the Cathedral Chapter, and, this being lacking, with the consent of the diocesan Consultors.

23 § 3. Let this rule be observed also in the election of examiners and pastor consultors, whenever a synod be not held.

24 § 4. Examiners and consultors, whether elected in synod or outside the synod, after five years from their nomination, or even sooner, upon the advent of a new synod, fall from office. They may, however, be elected again, the requirements of law being observed.

25 § 5. They cannot be removed by the Ordinary during the five-year period, except for grave cause and with the consent of the cathedral chapter, or the diocesan consultors.

26 § 1. The examiners and pastor consultors to be assumed by the Ordinary in a case of removal shall not be any whomsoever, but the two senior by reason of elec- — 31 - 8 - 910.

28 tion; and in equal election, the senior by reason of priesthood, or, this being lacking, by reason of age.

29 § 2. Those among them who on a cause recognized in law appear evidently suspect may be excluded by the Ordinary before he undertakes the matter to be handled. For the same cause the pastor may except against them, when he first comes into the case.

30 § 3. If one or both of the two prior examiners or consultors be hindered or excluded, the third or fourth shall be assumed in the same order.

31 § 1. Whenever in the canons which follow it is expressly said that the Ordinary is to proceed with the consent of the examiners or consultors, he himself must settle the matter by secret ballot, and that opinion shall be approved which has received at least two favorable votes.

32 § 2. Whenever, however, the Ordinary can proceed by the counsel of the examiners or consultors, it suffices that he hear them, nor is he bound by any obligation to accede to their vote, however unanimous.

33 § 3. In either case a written report of the results of the scrutiny shall be made, and signed by all.

34 § 1. Examiners and consultors must under grave penalty, having taken an oath, keep the secret of office concerning all things which they know by reason of their office, and especially concerning secret documents, discussions held in council, the number of votes and the reasons therefor.

35 § 2. If they act contrary to this, not only shall they be removed from the office of examiner and consultor, but they may also be punished with other fitting penalty by the Ordinary according to the gravity of the fault, the requirements of law being observed: and moreover they are bound by obligation to make good any damages, if any have resulted therefrom. IV. — Concerning the invitation to resign.

36 Whenever therefore, in the prudent judgment of the Ordinary, it appear that the pastor has incurred one of the causes enumerated above in can. 1, the Ordinary himself shall convoke two examiners appointed by law, shall lay all things open to them, shall discuss with them the truth and gravity of the cause, so that it may be determined whether there be place for a formal invitation to the pastor to resign. S. Congregatio Consistorialis.

37 § 1. This formal invitation must always be given before proceeding to a decree of removal, unless the matter concerns insanity, or whenever the manner of invitation is not available, as if the pastor is in hiding. § 2. It must be decided with the consent of the examiners. Can. 10.

38 § 1. The invitation is generally to be made in writing. It can, however, sometimes be made by word of mouth by the Ordinary himself, or by his delegate, with some priest present who performs the duty of notary, and a document of the invitation itself is to be drawn up and kept in the acts of the curia.

39 § 2. Together with the invitation to resign, there must be made known to the pastor, either in writing or by word of mouth as above, the cause or reason for which the invitation is made, the arguments on which that reason is based, with the proper precautions observed as in can. 11, the suffrage of the examiners having been sought and obtained.

40 § 3. If it concerns a hidden delict, and the invitation to resign is made in writing, only some general cause is to be announced; but the reason in particular with the arguments by which the truth of the delict is proved is to be explained by the Ordinary by word of mouth alone, with one of the examiners present who performs the duty of notary, and with the precautions as above.

41 § 4. Finally, whether the invitation is made in writing or by voice, the pastor is to be admonished that unless within ten days from receiving the invitation he either presents his resignation or demonstrates by effective arguments that the causes invoked for removal are false, a decree of removal is to be issued.

42 § 1. In communicating the arguments by which the truth of the cause adduced to obtain resignation is proved, care must be taken that the names of those making the complaint or of witnesses are not revealed, if they have requested secrecy, or, even if they have not requested secrecy, if from the circumstances it is foreseen that they will easily be exposed to harassment.

43 § 2. Likewise, reports and documents which cannot be made public without danger of great offense to the people, quarrels or complaints, are not to be revealed in writing; indeed not even by word of mouth, unless care is taken altogether that the aforementioned inconveniences do not occur.

44 Acta Apostolicae Sedis.—Commentarium Officiale.

45 It is permitted to the pastor, having received the invitation with an assigned time limit, to request a delay for deliberation or to prepare a defense. The Ordinary can, for a just cause, with the consent of the examiners, and provided this does not result in detriment to souls, grant this for another ten or twenty days.

46 § 1. If the pastor decides to assent to the invitation made to him and to resign from the parish, he can tender his resignation even under a condition, provided this can be and is legitimately accepted by the Ordinary.

47 § 2. It is permitted to the resigning pastor to allege another reason for resigning in place of the cause invoked by the Ordinary, one less burdensome or grave to him, provided it be true and honest, e.g., that he may obey the wishes of the Ordinary.

48 § 3. After the resignation has been tendered and accepted by the Ordinary, the Ordinary shall declare the benefice or office vacant by reason of the resignation. V.—Concerning the decree of removal.

49 § 1. If the pastor within the useful time neither tenders his resignation, nor requests a delay, nor contests the causes invoked for removal, the Ordinary, after it is established that the invitation to resign was properly made, became known to the pastor, and that he was not legitimately prevented from responding, shall proceed to the decree of removal, observing the rules which are established in the following canons.

50 § 2. But if it is not established concerning the two circumstances indicated above, the Ordinary shall provide appropriately, either by repeating the invitation to the pastor to resign, or by extending to him the useful time to respond. Can. 15.

51 § 1. If the pastor wishes to contest the causes invoked for decreeing removal, he must within the useful time set forth his rights in writing, with allegations directed to this alone, that he impugn and overturn the cause for which resignation is sought.

52 § 2. He can also propose two or three witnesses to prove some fact or assertion in which he has an interest, and request that they be examined.

53 § 3. It is, however, for the Ordinary with the consent of the examiners to admit and examine them or some of them, if they are suitable and their examination seems necessary; or even, if the cause of removal is clear and the examination of witnesses appears useless and sought to protract matters, to exclude them.

54 § 4. But if, after allegations have been presented, a doubt arises which ought to be cleared up so that it may be safe to proceed, it shall be for the Ordinary, with the counsel of the examiners, even without the pastor requesting it, to bring forward witnesses who seem necessary, and to question the pastor himself, if need be.

55 § 1. In the examination of witnesses, whether brought forward ex officio or at the request of the pastor, only those things are to be observed which are necessary to place the truth in safety, with all judicial apparatus and rejection of witnesses excluded.

56 § 2. The same rule is to be observed in the questioning of the pastor, if it takes place.

57 § 1. If the pastor is present and documents and the names of witnesses are revealed to him, it shall be for him, if he can and wishes, to make exceptions against what is brought forward.

58 § 2. When, however, the pastor cannot be invited according to can. 9 to conduct his defence, or when according to can. 11 the names of witnesses and certain documents cannot be made known to him, the Ordinary himself shall employ all care and diligence (or shall conduct the investigations, as is commonly said) so that a just judgment may be made concerning the value of the documents and the credibility of the witnesses. Can. 18.

59 § 1. To prevent resignation and removal, it is unlawful for the pastor to stir up crowds, to promote public subscriptions in his favour, to excite the people by sermons or writings, or to do other things which can impede the legitimate exercise of ecclesiastical jurisdiction: otherwise, according to the prudent judgment of the Ordinary, he shall be punished according to the gravity of the fault.

60 § 2. Moreover, since the matter concerns the promotion of the spiritual welfare of souls and is to be resolved in an administrative manner, the pastor, unless he be legitimately hindered, ought himself to be present in person, excluding the intervention of others. If, however, he be hindered, he may appoint as his procurator some worthy priest well-pleasing to him and acceptable to the Ordinary.

61 § 1. When all things pertaining to the just protection of the pastor have been completed, the decree of removal is to be discussed by the Ordinary with the examiners, and the matter is to be decided by secret ballot according to the prescriptions in can. 6.

62 § 2. No one, however, ought to cast a vote for removal unless it be certain to him that the cause announced to the pastor truly exists and that it is legitimate. Can. 20.

63 § 1. If the conclusion be for removal, a decree must be issued by the Ordinary, whereby it shall be generally stated that the pastor is removed for the reason of the spiritual welfare of souls.

64 The proper and particular cause of removal, however, may be expressed according to the prudent judgment of the Ordinary, if it be expedient and may be done without inconvenience. Mention, however, must always be made of the invitation made to resign, of the allegations presented by the pastor, and of the required and obtained vote of the examiners.

65 § 2. The decree is to be made known to the priest; but it shall not be promulgated unless after the useful time for interposing an appeal has elapsed. Can. 21.

66 If the conclusion be not for removal, the pastor is to be informed of this. The Ordinary, however, shall not omit to add admonitions, salutary counsels and precepts which according to the diversity of cases may seem opportune or necessary: the greatest account is to be taken of these, if the matter of the removal of that priest should come up again in the future.

VI. — Concerning the Review of Acts.

67 § 1. Against the decree of removal, an appeal is given solely to the same Ordinary for a review of the acts before a new Council, which consists of the Ordinary and two pastor consultors according to § 2, can. 8.

68 § 2. The appeal must be interposed within ten days from the decree made known; nor is a remedy given against the lapse of this fatal period, unless the pastor prove that he was hindered from appealing by force majeure; concerning which the Ordinary must decide with the examiners, whose consent is required.

69 When an appeal has been interposed, ten more days are given to the pastor to produce new allegations, the same rules being observed which were above established in the discussion before the examiners, saving the provision

70 § 1. The consultors, meeting with the Ordinary, ought to examine only two things: whether in the preceding acts there have crept in defects of form which touch the substance of the matter, and whether the reason adduced for removal is destitute of foundation.

71 § 2. For this purpose they ought to examine and weigh all the acts and allegations made above.

72 § 3. They may also of their own accord inquire into and question those two aforementioned heads of discussion to place them on a firm footing, and concerning matters which they judge necessarily to be known, having heard also, if need be, new witnesses.

73 § 4. The pastor, however, has no right to demand that new witnesses be brought forward and examined; nor that further delays be granted to him for conducting his defence.

74 § 1. The admission or rejection of the appeal is to be decided by a majority of votes.

75 § 2. Against the resolution of this council no further recourse is given.

VII. — Concerning the Provision for the Removed Pastor.

76 § 1. For a priest who has resigned at the invitation made to him, or who has been removed from the parish in an administrative manner, the Ordinary shall, to the best of his ability, make provision, either by transfer to another parish, or by assignment of some ecclesiastical office, or by some pension, according as the case may require and circumstances permit.

77 § 2. In the assignment of provision, the Ordinary shall not omit to hear the examiners, or the pastor consultors if the case has reached them.

78 § 1. The Ordinary shall not assign a parish unless the priest be worthy and suitable to govern it; he may, however, propose to him a parish of equal, inferior, or even superior rank, according as equity and prudence may seem to require.

79 § 2. If the matter concerns a pension, the Ordinary shall not assign this unless the requirements of law be observed.

80 § 3. In equal circumstances, favour is to be shown in provision to one who has resigned rather than to one who has been removed.

81 § 1. The Ordinary may reserve the matter of provision for the priest until after the case of removal has been completed, and generally it is to be expedited as soon as possible.

82 § 2. But he may also in the very invitation to resign or in separate letters, while the matter of removal is pending, or in the very decree of removal itself, propose and indicate this provision, if he shall have judged it expedient.

83 § 3. In any case whatsoever, the question of the future provision of a priest ought not to be mixed with the present question of removal from the parish; nor should that hinder or delay this, if the good of souls require that it be expedited.

84 § 1. A priest who has resigned, or has been removed from a benefice or office, must as soon as possible leave free the parochial house and all things pertaining to the parish, and hand them over regularly to the administrator. And if he unlawfully causes delay, he can be compelled to do so by ecclesiastical sanctions.

85 § 2. But if it concerns a sick person, the Ordinary shall permit him the use, even exclusive use where necessary, of the parochial buildings, until such time as he can conveniently be transferred elsewhere according to the prudent judgment of the same Ordinary. Meanwhile, however, the new rector of the parish shall see to procuring for himself some other temporary dwelling in the parish.

VIII. — Concerning those who are subject to this law.

86 The rules established above, to be applied with precision to all those who hold a parish, by whatever title, as its proper rectors, whether they be called Perpetual Vicars, or desservants, or by any other name whatsoever, have no application whenever a parish is committed to the care of a priest as a temporal administrator or Vicar for a time, whether on account of the infirmity of the pastor, or on account of a vacancy of the benefice, or on account of some other similar cause. Can. 31.

87 § 1. If a pastor is brought to trial as a defendant in a criminal case, while the criminal trial is pending either before an ecclesiastical or before a civil authority, there is no place for his administrative removal; but the outcome of the trial must be awaited.

88 § 2. In the meantime, however, if it concerns a crime which brings infamy of fact, the Ordinary can prohibit the pastor from exercising the care of souls and from conducting the temporal administration of the benefice: but he shall commit those duties with a suitable assignment of fruits to a Vicar or to another chosen by himself.

89 § 3. When the criminal trial has been concluded, there will be place for the restoration of the pastor, or for his administrative removal, or for his canonical deposition, as justice shall demand and circumstances warrant.

90 By the name of Ordinary for all things which are established in this title is not meant the Vicar General, unless he be furnished with a special mandate for this. But for the speedy execution of those things which are established in this decree, Our Most Holy Lord commands that all and each of the Ordinaries as soon as possible constitute some priests as consultors, according to the prescriptions of Can. 4. But as concerns examiners, if these are appointed in the diocese, whether in synod or outside synod, he establishes that, with the advice of the cathedral chapter or of the diocesan consultors, they may either confirm them in office (with this condition, however, that after five years they cease from the office), or proceed to a new election of examiners, observing the rule of Can. 4, as prudence and circumstances shall suggest. But if examiners are lacking in the diocese, let them proceed without delay to their election, observing the things established above.

91 These present provisions shall be valid, notwithstanding anything to the contrary.

92 Given at Rome, on 20 August 1910.

SACRA CONGREGATIO CONSISTORIALIS
DE AMOTIONE ADMINISTRATA AB OFFICIO ET BENEFICIO CURATO. DECRETUM.

4 S.CongregatioConsistorialis.

II. — De modo procedendo in generali.

III. — De personis ad motionem decernendam necessariis. Can. 3.

Can. 4.

20 Examinatoribus et parochis consultoribus eligendis lex in posterum ubilibet servanda haec esto:

21 § 1. Si synodus habeatur, in ea, iuxta receptas normas, eligendi erunt tot numero quot Ordinarius prudenti suo iudicio necessarios iudicaverit.

24 § 4. Examinatores et consultores sive in synodo, sive extra synodum eiecti, post quinquennium a sua nominatione, vel etiam prius, adveniente nova synodo, officio cadunt. Possunt tamen, servatis de iure servandis, denuo eligi.

IV.

§. 2. Decernenda autem est de examinatorum consensu. Can. 10.

Can. 15.

58 § 2. Quando vero parochus iuxta can. Can. 18.

62 § 2. Suffragium autem pro amotione nemo dare debet, nisi sibi certo constet causam parocho denuntiatam vere adesse eamque legitimam. Can. 20.

Can. 21.

68 § 2. Recursus interponendus est intra decem dies ab indicto decreto; nec remedium datur contra lapsum fatalium, nisi parochus probet se vi maiori impeditum a recursu fuisse; de qua re videre debet Ordinarius cum examinatoribus, quorum consensus requiritur.

69 Interposito recursu, dantur parocho adhuc decem dies ad novas allegationes producendas, iisdem servatis regulis quae superius in discussione coram examinatoribus statutae sunt, salva dispositione

Interim vero novus paroeciae rector aliquam aliam temporariam habitationem in paroecia sibi comparari curet.

VIII. — De iis qui huic legi subiacent.

86 Superius constitutis regulis, - adamussim applicandis iis omnibus qui paroeciam, quovis titulo, ut proprii eius rectores obtinent, sive nuncupentur Vicarii perpetui, sive desservants, sive alio quolibet nomine, - locus non est, quoties paroecia committatur curae alicuius sacerdotis qua oeconomi temporalis vel Vicarii ad tempus, sive ob infirmitatem parochi, sive ob vacationem beneficii, aut ob aliam similem causam. Can. 31.

88 § 2. Interim tamen si agatur de crimine quod infamiam facti inducat, Ordinarius parochum prohibere potest, quominus curam animarum exerceat ac temporalem administrationem beneficii gerat: ea vero munia cum congrua fructuum assignatione Vicario aliive a se eligendo committat.

Acta Apostolicae Sedis. - Commentarium Officiale.
SACRA CONGREGATIO CONSISTORIALIS
SULLA RIMOZIONE AMMINISTRATIVA DALL'UFFICIO E DAL BENEFICIO CURATO. DECRETO.

17 S. Congregatio Consistorialis.

III. — Delle persone necessarie per decernere la rimozione. Can. 3.

Can. 4.

IV. — Dell'invito a rinunziare.

Can. 10.

Can. 15.

Can. 18.

Can. 20.

Can. 21.

Can. 31.
