PIUS BISHOP SERVANT OF THE SERVANTS OF GOD FOR PERPETUAL REMEMBRANCE OF THE MATTER
APOSTOLIC CONSTITUTION
ETSI NOS*
CONCERNING THE VICARIATE OF THE CITY

0a Although We, constituted in the dignity of the Apostolic ministry, are urged by the daily insistence of the care of all churches (II Corinthians XI), nevertheless from the very beginning of Our pontificate, following the footsteps of illustrious Predecessors, We have not failed to hold as principal the sacred stewardship of this beloved City and the Church of all churches, to which by the secret counsel of divine Providence We are placed in charge.

0b For this reason many things have been enacted by Us on occasion, whether to protect and strengthen the discipline of the clergy, or to amplify divine worship, or to arrange parishes more aptly and opportunely; and provision has been made for many matters also of particular and private importance.

0c But that which chiefly occupied Our mind was that there should be some improvement also in the offices of the diocesan Curia of this nourishing City, that is, of Our Vicariate; so that the same might more fully respond to the new canons, might more aptly suit the new circumstances of the times, and might more speedily provide for the business to be transacted. And there were not few men conspicuous in prudence and dignity who were authors to Us of this plan of perfecting it.

1 Now, however, since it has been permitted to Our Vicariate to have its own seat in the City, to which We have deemed it opportune to assign one that is far more convenient and spacious, We have indicated that the opportune time for bringing Our plan into effect has arrived. Wherefore, all things having been weighed with mature deliberation, by Our Apostolic authority We constitute and decree the following.

2 Over all these offices presides a Cardinal, who is Our Vicar General in the City. And his office and authority, as he now holds it, is perpetual, and does not cease when the Apostolic See is vacant.

3 Subject to the Cardinal Vicar, a Prelate to be chosen by the Supreme Pontiff shall preside over each of the four aforementioned offices, to whom all who are administrators in the same office are directly and immediately subject.

3a Over the first office shall preside a Commissary for matters of divine worship and for apostolic visitation in the City, over the second an Assessor for matters of discipline, over the third an Auditor for matters of the judiciary, over the fourth a Prefect for administration. And in this same order, by reason of dignity, the individual Prelates shall take precedence among themselves.

4 The offices which are now held by the Vicar-General, the Lieutenant, the Secretary, and the Auditor of the Vicariate We suppress and by force of the present Constitution declare suppressed. But all the rights and duties which pertained to the same offices under any title whatsoever, We distribute and assign respectively according to the nature of the business and in accordance with the terms established in this constitution to the four aforementioned Prelates.

4a We will and decree that Our venerable brother Joseph Ceppetelli, Patriarch of Constantinople, to whom We assign the first office to preside over and the office of Commissary, shall, for the sake of honor, retain the title Vicar-General, he alone, during his term of office.

5 Although the individual offices and those who preside over them ought to proceed jointly and in friendly alliance, so that they may better attain their end, that is, the glory of God and the salvation of the people, by combining their efforts; nevertheless no one, even if more dignified in order and rank, shall meddle in the business of another's office, saving however those things which concerning the economic matter are prescribed in cap. IV of this law.

6 Should the Cardinal Vicar be lacking or hindered, for any reason whatsoever, even on account of the Conclave, the individual Prelates shall each by themselves manage all things which pertain to their office according to the prescriptions in this law, and shall answer according to canonical laws for the faithful fulfillment of their ministry.

6a CHAPTER I.

6b THE FIRST OFFICE OF THE VICARIATE.

6c Concerning divine worship and apostolic visitation.

7 To provide for the order and decorum of divine worship, and to carry out pastoral visitation in the City, on account of the peculiar conditions in which the city, the head of all Catholic religion, is situated, Our Predecessor Clement VIII, by constitution Speculatores on 8 June in the year 1570, erected the Congregation of Apostolic Visitation with certain prescribed laws. But in order that he might more aptly define the rights and offices of this Congregation according to the circumstances of the times, on 21 December in the year 1847 Pius IX by apostolic letters Beati Petri established new laws for the same Congregation.

7a In the present matter, however, preserving, in those things which touch the matter, the prescriptions of Our Predecessors, and putting into execution those things which We ourselves established in the constitution Sapienti consilio on 29 June in the year 1908, We entrust the work of apostolic visitation in the City and its diocese to a special body, or Commission of Cardinal Fathers, of which the President shall be Our Cardinal Vicar in the City and the members by birth shall be the Cardinal Prefects of the Sacred Congregations of the Council and of Religious.

8 The secretary of this body shall be the Commissary of Our Vicariate, of whom We have spoken in no. 3.

9 The archives and records, which were the property of the Sacred Congregation of Visitation before the constitution Sapienti consilio, pass to this office.

9a Likewise, those who were administrators of the aforementioned Sacred Congregation shall be numbered among the officials of the Vicariate, but in such manner and with the title and duties that correspond to this new arrangement of the Vicariate.

9b Its treasury, moreover, shall pass into the custody of the fourth office of the Vicariate.

10 We command and decree that in each five-year period, in that very year in which the Ordinaries of Italy are bound by obligation to present to the Holy See a report on the state of their diocese, an apostolic visitation shall be made by this Commission in the City and its diocese, with no other prescription required from Us or Our Successors, and with no place or person excepted, except the Cardinals of the Holy Roman Church, the apostolic palaces, and the offices of the Holy See.

11 The first such visitation, to be conducted under this new law, shall take place in the year 1916. The visitation now in progress shall be suspended on the very day this constitution is published.

12 Before the year begins in which the visitation is to be conducted in the City, the aforementioned Cardinal members of the assembly shall convene in order to elect associates for the visitation to be approved by the Supreme Pontiff, who together with the Cardinal Vicar, having divided the territory, shall visit the churches and pious places; and in order to decree other matters which may seem more opportune for a successful outcome of the visitation.

13 In conducting the visitation, the rules established by the decree A remotissima of the Sacred Congregation of Consistorial Affairs on 31 December in the year 1909 shall be observed.

14 The associates of the visitation, however, shall issue no decree, and shall neither establish nor command anything; they shall only observe, report, and propose to the assembly of Cardinals those matters which they judge should be corrected or established in the churches or pious places visited by them.

14a Decrees and laws, however, shall be issued only by the aforementioned assembly of Cardinals, or in its name and by its authority by the Commissioner of the Vicariate.

15 If anything occurs in the visitation which is grave and demands swift provision, it shall be reported as soon as possible by the Cardinal Vicar or by the Commissioner to the Supreme Pontiff.

15a When the visitation is completed, a written report shall be prepared by the same Commissioner and presented to the Supreme Pontiff concerning all matters of greater importance discovered in the visitation, and concerning the decrees.

16 In order that the visitation may be conducted more safely and expeditiously, the second office concerning the discipline of the clergy and the fourth office concerning economic administration and their administrators shall not fail to communicate with the visitors, either of their own accord or at their request, such matters as are necessary or opportune to know.

17 Moreover, the first office has competence both during the year of visitation and outside this time to regulate whatever pertains to divine worship in the churches, chapels and other sacred places of the City, sacred functions, relics of saints, sacred images, the fulfillment of legacies, as they are disposed in the aforementioned apostolic letters of Pius IX, and before the constitution Sapienti consilio were in use with the Sacred Congregation of Visitation.

18 The reliquary and the assembly for sacred archaeology and sacred music are attached to this office, with their order and status otherwise remaining intact.

19 If any difficulty or question concerning sacred archaeology or ecclesiastical music should arise, or if the Cardinal Vicar wishes to take counsel on these matters, the aforementioned assembly shall be convened under his or the Commissioner's direction.

20 We further will and decree that with this first office a new assembly or commission concerning sacred art shall be established, and in this first instance We reserve to Ourselves the right to elect and appoint those who shall be assigned to this assembly.

20a In the future, however, they themselves, with the Cardinal Vicar or Commissioner presiding, shall elect and propose to the Supreme Pontiff those who shall be added to this assembly.

20b The Cardinal Vicar shall use their counsel in all matters pertaining to the construction, preservation, restoration, ornamentation and similar matters of sacred buildings.

21 A record shall be made in this office and carefully maintained of all the churches of the City, with necessary or opportune annotations concerning their condition.

CHAPTER II

21a THE SECOND OFFICE.

21b Concerning the discipline of the clergy and Christian people.

22 The office concerning the discipline of the clergy and Christian people is contained in four parts. These are: 1. concerning the clergy, 2. concerning religious institutes of women, 3. concerning schools, colleges and other lay youth institutions, 4. concerning confraternities and other associations and social works.

23 In each of the four parts of this office there shall be one secretary, who under the authority and direction of the Cardinal Vicar and the Assessor shall have immediate care of all matters to be conducted for his part of the office.

24 The secretaries of the individual parts shall be elected by the Supreme Pontiff, upon the proposal of the Cardinal Vicar: the other officials by the Cardinal Vicar himself, after prior consultation.

24a PART OR SECTION 1. Concerning the secular and regular clergy.

25 To this section pertains,

25a a) to care for and provide, within the limits established by the sacred canons, all things which are necessary or opportune for the discipline of the secular and religious clergy;

25b b) to keep watch over heresies and perverse opinions which might perhaps arise, observing the rules which are prescribed in the canonical statutes and especially in the encyclical letter Pascendi of 8 September 1907, and in the motu proprio Sacrorum Antistitum of 1 September 1910;

25c c) to grant permissions for the publication of books and for the moderation or publication of periodicals or journals;

25d d) to exercise care over seminaries and other clerical colleges not exempt from the jurisdiction of the Cardinal Vicar;

25e e) to conduct an examination of doctrine for clerics to be ordained to sacred orders and to admit them to such orders;

25f f) to provide certificates commonly called celebret, by which it is established that priests may be admitted to celebrate in churches and chapels;

25g g) to grant letters of recommendation and other testimonial letters to the clergy.

25h h) To this office is likewise reserved the approval for hearing sacramental confessions and for delivering sacred sermons;

25i i) the designation to the office of confessor in any churches and institutions;

25j l) the election of priests who shall serve in the office of rectors in temples, and of those who shall work as sacristans, commonly called cappellani, in confraternities and any institutions, unless such election is legitimately reserved to others;

25k m) the provision of parishes.

25l In performing or managing all these matters, the administrators of the Vicariate shall take care that the norms of common law and the praiseworthy customs of the City are retained.

26 Renewing the prescriptions made by Our Predecessor Leo XIII through a decree of the S. C. of the Council Anteactis temporibus of 23 December 1894 and by Us in letters to the Most Eminent Vicar of the City on 6 August 1905, We command that henceforth no cleric, whether belonging to the Roman clergy or to other dioceses, shall be assumed or elected by anyone, even by one resplendent with Cardinal dignity, to any office or benefice which requires stable or prolonged residence in the City, unless he who wishes to elect him shall first have sought by secret letter from the Most Eminent Vicar of the City whether anything on the part of the Vicariate stands in the way, and shall have learned that nothing stands in the way.

26a Any provision or assignment of office made otherwise shall be null and void, with all privileges and exemptions in this matter being abrogated, even those requiring special mention, which are contrary to this prescription.

27 In this section there shall be a census of the entire clergy both secular and regular, with notes at each name regarding place of residence, age, the respective duties of each person and other circumstances.

28 In carrying out all the offices enumerated in this chapter, the Cardinal Vicar shall be assisted, besides the administrators of this section, by various councils already prescribed by canon law, that is, examiners of the clergy, consultors for determining the removal of a pastor, the council of vigilance, deputies for seminaries, the directive commission for the priestly ministry.

29 This last council shall henceforth consist of at least five priests to be chosen by the Cardinal Vicar with the approval of the Supreme Pontiff, who shall be of mature age, distinguished by virtue, prudence and knowledge of affairs. These shall be counselors to the Cardinal Vicar in the assignment of duties, offices and benefices of the clergy.

30 In order that the examiners may be better able to meet the necessities of the present time, the college which now exists We suppress by apostolic authority and declare suppressed, and We establish another with new laws according to what We decree below.

30a a) The examiners of the Roman clergy shall henceforth be eighteen in number, chosen from the secular and regular clergy.

30b b) Whenever their election cannot be made in synod, they shall be elected by the Cardinal Vicar with the approval of the Supreme Pontiff, and for a period of five years only.

30c c) However, at this first time, lest it should happen that all examiners fall from office at the same time, nine of them shall be elected for a period of ten years.

30d d) Those who depart from the City not to return within six months, those who are afflicted with prolonged illness and become unfit, those who assume an office which cannot be reconciled with the office of examiner, by that very fact fall from office.

30e e) Whenever for these reasons, or for another canonical cause, or by death it happens that one of the examiners is lacking, another shall be appointed in his place, who however shall remain in office only until the end of the five-year period of that examiner in whose place he is substituted.

30f f) Examiners who fall from office may be elected again by the Cardinal Vicar.

30g g) All examiners shall diligently apply their efforts at the invitation of the Cardinal Vicar to conducting examinations for the provision of parishes, for the ordination of clerics, for the approval of priests seeking to hear sacramental confessions or to deliver sacred sermons; and likewise, where it is necessary, for determining the removal of a pastor, according to the most recent decree Maxima cura.

30h h) Some of them may be convoked to provide their counsel in matters pertaining to discipline of greater importance or more difficult definition under the direction of the Cardinal Vicar of the City, or the Assessor, or the secretary of this section.

30i i) The Cardinal Vicar may also entrust to one of them the examination of some matter and the drafting of his opinion in writing, or perform other things which may seem useful or necessary for maintaining the discipline of the clergy and which cannot properly be carried out by the officials of the Vicariate.

SECTION 2.a - Concerning religious institutes of women

31 Since it is expedient that monasteries and other religious houses of women, which are in the City, be subject to one and the same ordinary jurisdiction, we decree and establish that all henceforth, from the day on which this Constitution begins to have force and execution, shall be subject to the authority and ordinary jurisdiction of one Cardinal Vicar, with exemption privileges suppressed, by which some of them were bound to certain Cardinals of the Holy Roman Church, or to secular or regular Prelates, and with the protection duty of the aforesaid Cardinal Protectors being preserved only, which they now hold over them, or which may be granted to them in the future.

32 To govern and administer all these monasteries and religious houses of women, the Cardinal Vicar shall be assisted, as is already the case at present, by six priests of mature age, distinguished in virtue and prudence, who, with the City divided into as many regions, shall be delegated to the monasteries of each region assigned to them.

33 The duty of the secretary of this section shall be,

33a a) to draw up and orderly preserve an index of all monasteries and religious houses, with a census of the number of religious women, superiors, works in which they are engaged, priests who perform sacred ministries therein and with other relevant particulars;

33b b) to attend the meetings to which the delegates convene, and to record in writing and preserve what is done or decreed in them;

33c c) to carry into execution what has been established, if delegated to do so by the Cardinal Vicar or by the Assessor; and to supply, if necessary, in particular cases and by delegation, as above, one of the delegates in his duties.

34 It shall be the duty of the delegates to visit individually the houses in their region or otherwise committed to their care repeatedly; and under the guidance and authority of the Cardinal Vicar or Assessor to ensure that the discipline of the institute is observed in them, that schools and other pious works which are maintained in them proceed rightly, that the administration of temporal affairs is conducted properly, that the nuns or sisters live together in peace and holiness.

34a It shall also be their duty to subject postulants and novices to examination, and to watch that in each house there are priests who perform the office of sacristan or chaplain, and that these same devote themselves holily and diligently to hearing confessions and delivering sacred sermons.

34b Furthermore, on days appointed by the Cardinal Vicar according to his prudence, they shall meet, so that under the presidency of the Cardinal Vicar or Assessor, they may discuss matters of greater importance, or those which concern the common good.

35 If, however, any particular prescription should be necessary either concerning the regular discipline of the religious women, or concerning the pious works in which religious women are engaged, or concerning the priests who perform sacred ministry among them, the delegates shall not take this matter upon themselves, but shall refer the matter to the Cardinal Vicar or Assessor in the ordinary meeting of delegates, or even outside it, either by themselves or with the aid of the secretary of this section, if the matter is urgent or otherwise necessary.

36 They shall also report in writing every two years what in the state of the religious houses in their region is worthy of note, what is to be praised, what is to be corrected, what seems opportune to be established; so that the Cardinal Vicar, either by himself or in the meeting of delegates, may more fully and maturely weigh all things, and may establish what is necessary.

37 Finally, we desire that the remuneration which these religious institutes are able to give each month or year to the priests who exercise sacred ministry for their benefit or in their houses, shall henceforth be sent to the Vicariate, and from it, after deduction for the religious women, shall be distributed by the Cardinal Vicar's prudent judgment to those to whom it belongs.

37a SECTION 3.a - Concerning schools, colleges and other institutes for the education of laypeople

38 Schools for the instruction of lay youth of both sexes, whether day or night schools, whether lower or primary or higher of any kind, by whatever name they are called, shall all henceforth be directly subject to the authority and jurisdiction of the Cardinal Vicar.

38a In like manner, colleges and other institutes in which lay youth of both sexes are gathered for the purpose of education shall be directly subject to his authority, saving the rules of canonical exemption of religious.

39 By force of the present Constitution, the rights and offices which hitherto belonged to certain schools, asylums, colleges and pious institutes, whether to the Prefect of the Pontifical Household, or to the Superintendent of Pontifical Charities, or to the Pontifical Society for the Preservation of the Faith, shall cease and be transferred to the Cardinal Vicar.

39a Likewise, the rights and offices which belonged to the Sacred Congregation of Studies concerning certain technical schools of the City, as they are called, or gymnasia and similar institutions, shall cease and be transferred to the Cardinal Vicar.

40 The revenues customarily paid by Us annually for the support of all these schools, and other revenues which were retained or offered to the individual pontifical associations or Prelates for schools or institutions proper to each, shall be collected together and administered by the Cardinal Vicar according to the norms established in Office IV, and shall be distributed among the various schools and institutions according to the will of the founders and donors, with justice and equity observed.

41 The pontifical association instituted by Our predecessor of venerable memory Leo XIII in the year 1878 for directing certain schools shall cease as such: and in its place a scholastic council shall be established under the authority and direction of the Cardinal Vicar or Assessor.

41a Those to be enrolled in this council shall be chosen by the Cardinal Vicar, the same rules being observed according to the nature of the matter as have been established above for examiners.

42 In schools, colleges and other educational institutions, which are supported by the temporal Vicariate, the duty of the scholastic council shall be to appoint and remove, if necessary, directors and teachers, to select books to be used by the students, to inspect and maintain internal discipline; to take care for the correct and, as far as possible, perfect education of the young; to watch over the preservation of school buildings and halls.

42a Whenever, however, it is a matter of making expenditures, nothing shall be determined unless the Prefect of administration, of whom below in cap. IV, is called into the council and his vote is required.

43 In schools and institutions, however, which are supported by some pious cause or religious family, the duty of the scholastic council shall be to ascertain who are the directors and teachers, what textbooks are used; whether religious and moral instruction is sufficient and correct; in what manner Christian doctrine is taught and what exercises of piety are conducted; whether civil instruction conforms to the laws and is useful, and that nothing contrary to the laws of health protection is found in the schools. If, however, anything is found to be wholly reprehensible or not entirely correct, the Council, or by the vote of the Council the Cardinal Vicar, shall report this to the directors of the pious cause or religious family, so that appropriate remedies may be provided.

44 Under the care and vigilance of the scholastic council are also all those works which are called by the name of scholastic patronage or works after schools, or are designated by some other similar title.

45 To fulfill its duty of vigilance and care, the scholastic council shall select several inspectors, whose services it shall use for visiting the schools and the aforementioned institutions and works.

46 The duty of the secretary of this section shall be,

46a a) to draw up and orderly preserve an index of all schools, colleges and institutions mentioned above, noting who are the directors and teachers, how many students or pupils are enrolled, what is the state of affairs and morals in the institution;

46b b) to attend the meetings of the scholastic council, and to record and file in the archives the acts and decrees of the Cardinal Vicar and his scholastic council;

46c c) to carry out what has been determined by the Cardinal Vicar and his scholastic council, if he has this expressly in his mandate.

46d SECTION 4.a - Concerning confraternities and other associations and social works.

47 To this section pertains first of all the care and vigilance over sodalities and archsodalities, insofar as it can pertain to the Vicariate by right, saving of course the individual laws, statutes and privileges duly recognized by ecclesiastical or Apostolic authority, from which nothing is taken away by the present Constitution.

48 Moreover, since by the grace of God there are in the City many other associations and works which have some pious purpose of religion, charity or justice proposed for the good now of their own members, now of others, or of society as a whole; We will and command that all these and as many others as shall be instituted in the future be subject to the care and authority and jurisdiction of this part of the Vicariate and of the Cardinal Vicar.

48a If any association or pious work has some Prelate or Cardinal of the Holy Roman Church as protector, this office of protection must be understood and interpreted in such a way that the jurisdiction of the Cardinal Vicar always remains intact.

48b The authority and jurisdiction of the Cardinal Vicar necessarily claims for itself over the aforementioned associations and works, so that they may be approved by him, and may obtain from him the approbation of their statutes in those matters which pertain to their pious purpose, unless perhaps the statutes themselves have been directly received from the Supreme Pontiff.

48c It shall also be his, or the Assessor's, to exercise vigilance over them, to have care for them, always saving their legitimate statutes; and to provide priests assisting, delegates, appointed to hear confessions, or in any way moderators for the same.

49 In exercising these duties, various associations or councils shall provide assistance to the Cardinal Vicar, which have been instituted, or shall be instituted in the future, for directing works and associations of each kind.

49a And so first in social works there will be a help to the Cardinal Vicar and Assessor the diocesan council of Catholic action in the City, which according to the apostolic letter Il fermo proposito already exists: in the assemblies of men from St. Vincent de Paul a Roman central council: in the associations of ladies of charity from St. Vincent de Paul another central council of the City: and thus in similar matters.

50 Among social works, since the pious work of catechesis holds the principal place, and is by far most important for the good of religion and society, we will and command that it be carried out with unremitting care and special attention by the Cardinal Vicar.

51 Therefore in individual parishes, according to the norms which in the constitution Acerbo nimis on the 15th day of April in the year 1905 were prescribed, there shall be a canonically constituted association, to which the name congregation of Christian doctrine is given. But the Cardinal Vicar and Assessor shall diligently watch that the parish priests, and the congregations subject to them which we have mentioned, teach catechism according to the prescription of law, in that manner and method by which children are most attracted to attend and to draw the genuine doctrine of faith and morals.

52 But so that the Cardinal Vicar may be able to exercise assiduously and effectively the care and vigilance necessary for so great a work, he shall establish a council of at least six priests, whose election shall be approved by Us and Our successors for the time being: they shall remain in office for a five-year period and shall leave office in the same manner as the examiners of the clergy, concerning which above at no. 30.

53 The duty of this council of priests shall be,

53a a) to convene at fixed times, under the leadership of the Cardinal Vicar or Assessor, so that they may determine what things are necessary or opportune for cultivating and perfecting the work of catechesis in individual parishes;

53b b) to visit at the mandate of the Cardinal Vicar or Assessor individual parishes, churches or schools where catechism is taught, and to see and report by what method, with what fruit Christian doctrine is transmitted, and whether the schools which are held are sufficient for the instruction of youth of both sexes, or whether others should be opened at more suitable hours and places;

53c c) to institute competitions with prizes among the more outstanding pupils of catechism of one or several parishes.

54 The Archconfraternity of Christian Doctrine which in the City at the church of St. Mary a planctu has been established, we will that its rights and duties be circumscribed to this one purpose, and by the present constitution we circumscribe them, so that it may have the care and administration of its church and of the pious bequests which are in it, and may be able to aggregate other confraternities of Christian Doctrine to the participation of indulgences: but in the direction of diocesan catechesis it shall not interfere. The statutes therefore of this archconfraternity shall be changed in this sense and approved by the Cardinal Vicar.

55 But as regards the hospitals which are now in the City, endowed with many privileges, while we do not wish to detract from the use or right by which the care of souls of some religious Order or Congregation is reserved in some of these pious houses, we decree and prescribe that henceforth no religious man shall be sent by his Superiors to these pious houses for this purpose, except with the consent and approval of the Cardinal Vicar: to whom moreover we attribute the exercise of vigilance over them, and, if need be, to remove them from office; just as we also attribute to and reserve to him vigilance over the nuns who there engage in the pious work of charity: with all privileges in this matter removed, even those deserving special mention, which are contrary to these dispositions.

55a We command therefore that henceforth the moderators of Orders and Congregations, before they send any religious of theirs to hospitals, shall propose his name to the Cardinal Vicar, and shall await his approval, so that he may lawfully be able to exercise the sacred ministry there.

56 The office of the secretary of this section shall be,

56a a) to draw up and preserve an index of all confraternities and archconfraternities of the City, as well as of associations and social works, with a record of those who preside over them, the number of members, the place where they meet or where the pious work is situated;

56b b) to attend the meetings of the assemblies or councils, concerning which in no. 49 and no. 53, lett. a), to record in a register and to preserve in the archives what has been done or decreed;

56c c) to carry out, if expressly commanded by the Cardinal Vicar or by the Assessor, what has been decreed concerning these associations and works.

56d APPENDIX. - Concerning the delegate to the Roman countryside.

57 To provide more suitably for those who are engaged in the Roman countryside, as long as the present conditions of affairs persist, we will and decree that under the authority and direction of the Cardinal and Assessor there shall be a priest who shall have immediate care of all those matters which in the same countryside are to be determined and carried out for the salvation and discipline of the clergy and faithful.

57a He shall be called delegate to the Roman countryside; and his election shall be made by the Cardinal Vicar with the approval of the Supreme Pontiff.

57b CHAPTER III.

57c THIRD OFFICE.

57d Concerning judicial matters.

58 The Cardinal Vicar of the City shall be the ordinary and sole judge of first instance in all cases which can be tried before the ecclesiastical forum of the Roman diocese, with all other tribunals and jurisdictions heretofore in force suppressed.

59 He, however, shall not himself personally hear cases, unless he has expressly reserved this to himself in some case for particular reasons; but through his Auditor, who shall indeed hold his place in judicial matters and constitute one tribunal with him, and who shall be held as Official of the Roman diocesan curia.

60 He himself shall not assume cases to be judged unless he has first informed the Cardinal Vicar of the City about the matter. With his assent he shall institute the trial, and shall conduct it until the definitive sentence, observing the rules of common law.

61 To him is also reserved judgment concerning questions of funeral fees and other matters which heretofore were proper to the Camerlengo of the clergy, whose office and jurisdiction are accordingly suppressed.

62 An assistant substitute shall be given to the Auditor, whose election is reserved to the Supreme Pontiff.

63 If any case is not to be decided by one judge according to the norm of law, but by a collegial tribunal, the president of this shall be the Auditor himself, unless the Cardinal Vicar has reserved the right of presiding to himself.

64 The election of those who shall serve in the collegial tribunal in the office of associate judges is reserved to the Supreme Pontiff. But to determine which of them shall sit with the Cardinal Vicar or the Auditor in some particular and specific case to judge, we attribute to the Cardinal Vicar.

65 To the office of judicial matters, that is, to the Auditor and to the officials subject to him, pertains also to draw up processes concerning matrimonial dispensations, mandates of free status or of contracting, correction of the record of birth, marriage and similar documents, recognition of signatures and documents, and other matters of this kind.

65a In handling and deciding these matters, the rules of common law shall be observed, and where these are lacking, the praiseworthy and approved usage of the Vicariate.

66 There shall moreover be in this office of judicial matters a Promoter of Justice and a Defender of the Bond, to be chosen by the Cardinal Vicar with the approval of the Supreme Pontiff.

66a Nothing, however, prevents these duties from being entrusted to one and the same person, if he is equal to satisfying them properly.

67 Notaries, a chancellor and other inferior administrators, who are necessary for carrying out the proper duties of this office, shall be chosen by the Cardinal Vicar, after their examination.

67a CHAPTER IV.

67b THE FOURTH OFFICE.

67c Concerning economic administration.

68 There shall be a single economic administration for all the offices of the Vicariate under the dependence of the Cardinal Vicar and of the Prelate Prefect assigned to this administration.

69 To it shall be brought all revenues which come to the Vicariate and its various offices from rescripts and any other titles whatsoever. It shall keep the cash box and capital funds which were proper to the Vicariate and the ancient sacred Congregation of the Visitation: it shall pay pensions and remuneration, distribute subsidies (unless the Cardinal Vicar shall judge otherwise in some case), satisfy obligations, meet expenses both ordinary and extraordinary, which shall have been approved by the Cardinal Vicar of the City or by the Prelates placed over the offices of the Vicariate.

70 Although the administration is single, the portion and revenues attributed to some office or work from a foundation, or from the express will of pious donors, or from a prescription of the Supreme Pontiff, shall be preserved intact for it, and shall be disbursed by the moderators of this office for the prescribed purpose.

71 It shall also be the duty of this office to have care for the preservation and proper management of the goods of parish priests, especially when a benefice is vacant, and of goods pertaining to pious causes, especially if these pious causes lack their own and distinct administration recognized by canon law.

72 The cash box shall be kept according to canonical norms.

73 Moreover, there shall be two inferior administrators to be chosen by the Cardinal Vicar with the approval of the Supreme Pontiff, having given financial security which shall correspond to the amount or money of which they can at any time dispose: and to them, if necessity should seem to require it, there can be given by the Cardinal Vicar with the approval of the Supreme Pontiff some assistant.

74 One of them shall serve in the office of accountant: the other shall chiefly perform the office of distributor and cashier.

75 Each month the Prefect of administration shall render an account to the Cardinal Vicar of receipts and expenditures.

75a Each year, moreover, he shall draw up a summary of the entire administration, to be submitted for approval to the Cardinal Vicar in the City and to the Supreme Pontiff.

75b CHAPTER V.

75c Concerning the internal discipline of the offices.

76 The norms concerning internal discipline established in the sacred Congregations and other offices of the Holy See after the constitution Sapienti consilio shall be observed with due proportion in the various offices of the Vicariate.

76a Especially, however, shall those things be observed which have been established concerning the taking of an oath and concerning the discipline of offices.

77 Each of the four offices shall have its own registry, commonly called protocollo, in which there shall be a record of matters pertaining to that office, and acts and documents shall be preserved concerning which there may still be question: then they shall be sent to the archive.

78 Both the registry and the archive shall be twofold, one secret, the other not secret.

79 From these, however, even if not secret, no document or copy shall be extracted, nor communicated with anyone, except by mandate of the Cardinal Vicar, or of the Prelates to whose office the matter pertains.

80 The duty of the administrators to whom the care of the registry or archive has been entrusted shall be to record acts and documents, to guard them, to preserve them in order, and to make copies of them, upon receipt of mandate, and to deliver each to its respective office.

81 The Archivist, or prefect of the archive, shall be chosen by the Supreme Pontiff. He shall be subject directly to the Cardinal Vicar, and in his absence or default, to the Commissioner of the Vicariate, saving however the disposition of can. 79, concerning which above.

82 Concerning the time during which the various administrators ought to be present in the office and concerning holidays, let the Cardinal Vicar propose a norm to Us, having regard to the laws which obtain in the Holy Congregations, which We Ourselves have approved.

82a Decreeing that these present letters shall be firm, valid and effective always and forever, and shall produce their full and complete effects from the day of their promulgation in the Commentary on Apostolicae Sedis actis; and that it shall be null and void if anything contrary to these should happen to be attempted by anyone, notwithstanding Our rule and that of the Apostolic Chancery concerning acquired right not being taken away, and other Apostolic constitutions and ordinances or any other authority by which they are strengthened, statutes, customs, and all other things contrary to these, even those worthy of most special mention.

82b Given at Rome at St. Peter's in the year of Our Lord's Incarnation one thousand nine hundred and twelve, on the Kalends of January, the feast of the Circumcision of Our Lord Jesus Christ, in the ninth year of Our pontificate.

PIUS EPISCOPUSSERVUS SERVORUM DEIAD PERPETUAM REI MEMORIAM
CONSTITUTIO APOSTOLICA
ETSI NOS*
DE URBIS VICARIATU

0a Etsi Nos in Apostolici ministerii fastigio constitutos urge at instantia quotidiana, sollicitudo omnium ecclesiarum (II ad Corinth.

1 Nunc vero, quum licuerit Vicariatui Nostro propriam sedem in Urbe, eam quem ulto commodiorem amplioremque attribuere, propositi Nostri in rem deducendi opportunum tempus advenisse indicavimus.

6a CAPUT I.

6b PRIMUM VICARIATUS OFFICIUM.

8 A secretis huius coetus erit Commissarius Nostri Vicariatus, de quo in num.3 diximus.

12 Antequam annus incipiat Visitationis in Urbe peragendae, PP.

13 In visitatione peragenda regulae servabuntur quae decreto A remotissima S. Congregationis Consistorialis die 31 decembris an.1909 statutae sunt.

14 Socii visitationis tamen nullum edant decretum, nihilque ipsi constituant aut iubeant; tantummodo videant, referant, proponantque coetui PP. Cardinalium quae corrigenda vel stabilienda censeant in ecclesiis piisve locis a se lustratis.

14a Decreta autem legesve ne ferantur, nisi a memorato coetu PP.

SECTIO 2.a -De institutis religiosis mulierum

33 Huius sectionis a secretis munus erit,

33a a) indicem conficere et ordinate servare monasteriorum omnium ac domorum religiosarum, cum recensione numeri religiosarum, moderatricum, operum quibus vacant, sacerdotum qui ibidem sacra ministeria explent et cum aliis indicationibus ad rem facientibus;

33b b) interesse coetibus ad quos delegati conveniunt, et scripto redigere ac servare quae in eis acta vel decreta sint;

37a SECTIO 3.a - De scholis, collegiis aliisque educationis laicorum institutis.

38 Scholae ad erudiendam laicam utriusque sexus iuventutem, tam diurnae quam nocturnae, tam inferiores seu primariae quam superiores quaelibet, quovis nomine nuncupentur, omnes in posterum auctoritati et iurisdictioni Cardinalis Vicarii proxime suberant.

38a Pari modo eius auctoritati proxime obnoxia erunt collegia aliaque instituta in quibus laica utriusque sexus iuventus educationis causa colligitur, salvis canonicae exemptionis religiosorum regulis.

41 Coetus pontificius a decessore nostro v. m. Leone XIII anno 1878 institutus nonnullis scholis moderandis, qua talis cessabit: eiusque loco Consilium scholasticum sub Cardinalis Vicarii seu Adsessoris auctoritate et nutu constituetur.

IV, eiusque voto requisito.

46 A secretis huius sectionis munus erit,

46a a) indicem texere et ordinate servare omnium scholarum, collegiorum et institutorum de quibus supra, adnotando quinam sint moderatores et magistri, quot habeantur discipuli seu alumni, quinam sit status rerum et morum in instituto;

46b b) interesse conventibus consilii scholastici, ac recensere et in tabularium referre acta et decreta Cardinalis Vicarii eiusque scholastici consilii;

46d SECTIO 4.a - De confraternitatibus aliisque consociationibus et operibus socialibus.

49a Adeoque primum in socialibus operibus auxilio erit Cardinali Vicario et Adsessori consilium dioecesanum actionis catholicae in Urbe, quae iuxta apostolicas litteras Il fermo proposito iam exstat: in coetibus virorum a S. Vincentio a Paulo consilium centrale romanum: iri consociationibus dominarum caritatis a S. Vincentio a Paulo aliud centrale Urbis consilium: et ita in similibus.

53 Sacerdotum huius consilii munus erit,

53a a) statis temporibus, sub ductu Cardinalis Vicarii vel Adsessoris convenire, ut quae necessaria vel opportuna sint ad catechismi opus excolendum, perficiendum in singulis paroeciis decernant;

53b b) invisere de mandato Cardinalis Vicarii vel Adsessoris singulas paroecias, ecclesias vel scholas ubi catechismus doceatur, et videre ac referre qua methodo, quo fructu christiana doctrina tradatur, et utrum scholae quae habentur sint satis ad iuventutis utriusque sexus institutionem, an aliae horis et locis aptioribus aperiendae sint;

56 A secretis huius sectionis officium erit,

56a a) indicem texere et conservare omnium sodalitatum et archisodalitatum Urbis, nec non consociationum et operum socialium, cum recensione eorum qui praesident, numeri sodalium, loci quo hi conveniunt aut ubi pium opus est situm;

56b b) interesse conventibus coetuum seu consiliorum, de quibus in num.49 et num.53, lett. a), in regesto conscribere et in tabulario asservare quae gesta aut statuta sint;

57b CAPUT III.

57c OFFICIUM TERTIUM.

62 Auditori dabitur adiutor substitutus, cuius electio Summo Pontifici reservatur.

67 Notarii, cancellarius aliique inferiores administri, qui necessarii sint explendis muneribus huius officii propriis, a Cardinali Vicario eligentur, praemisso eorum examine.

67a CAPUT IV.

67b OFFICIUM QUARTUM.

72 Arca nummaria secundum canonicas normas custodietur.

73 Duo praeterea erunt inferiores administri a Cardinali Vicario cum approbatione Summi Pontificis eligendi, praestita pecuniaria cautione, quae respondeat sorti vel pecuniae, de quibus ipsi possunt aliquando disponere: eisque, si necessitas exigere videatur, dari poterit a Cardinali Vicario cum approbatione Summi Pontificis aliquis adiutor.

74 Alter ipsorum ratiocinatoris munere fungetur: alter vero distributoris et capsarii officium potissimum peraget.

75 Singulis mensibus Praefectus administrationi rationem reddet Cardinali Vicario accepti et expensi.

75a Quotannis vero epitomen totius administrationis conficiet, approbationi Cardinalis in Urbe Vicarii et Summi Pontificis subiiciendam.

75b CAPUT V.

81 Archivarius, seu archivo praefectus,a Summo Pontifice eligetur.

82b Datum Romae apud S. Petrum anno Incarnationis dominicae millesimo nongentesimo duo decimo, Kalendis Ianuariis, festo Circumcisionis D. N. I. C, pontificatus Nostri anno nono.

PIO VESCOVO SERVO DEI SERVI DI DIOA PERPETUA MEMORIA DELLA COSA
COSTITUZIONE APOSTOLICA
ETSI NOS*

6a CAPUT I.

6b PRIMO UFFICIO DEL VICARIATO.

24a PARS SEU SECTIO 1.a - Del Clero secolare e regolare.

25 A questa sezione spetta,

25a a) curare e provvedere entro i limiti costituiti dai sacri canoni a tutto ciò che sia necessario o opportuno per la disciplina del clero secolare e dei religiosi;

25b b) vigilare contro le eresie e le opinioni errate, che per caso sorgessero, osservate le norme che nei canoni sono prescritte e segnatamente nell'enciclica Pascendi dell'8 settembre 1907, e nel motu proprio Sacrorum Antistitum dell'1 settembre 1910 stabilite;

25c c) concedere indulti per i libri da pubblicarsi e per i giornali o diari da moderarsi o da pubblicarsi;

25d d) avere cura dei seminari e degli altri collegi di chierici non esenti dalla giurisdizione del Cardinale Vicario;

25e e) istituire l'esame di dottrina per i chierici destinati agli ordini sacri e ammetterli ad essi;

25f f) rilasciare attestazioni comunemente dette celebret, dalle quali risulti che i sacerdoti possono essere ammessi a celebrare nelle chiese e negli oratori;

25g g) concedere lettere commendatizie e altre lettere testimoniali al clero.

25h h) A questo ufficio è pure riservata l'approvazione per ascoltare le confessioni sacramentali e per tenere le sacre prediche;

25i i) la designazione al munere di confessore nelle chiese e negli istituti qualsiasi;

25j l) l'elezione dei sacerdoti che esercitino l'ufficio di rettori nei templi, e di coloro che operino come cappellani, comunemente detti cappellani, nelle confraternite e negli istituti qualsiasi, a meno che tale elezione non sia legittimamente riservata ad altri;

33a a) compilare e conservare ordinatamente l'elenco di tutti i monasteri e delle case religiose, con il censimento del numero delle religiose, delle superiore, dei lavori ai quali si dedicano, dei sacerdoti che vi esercitano i sacri ministeri e con altre indicazioni pertinenti alla materia;

33b b) partecipare alle riunioni alle quali si convengono i delegati, e redigere per iscritto e conservare ciò che in esse sia stato fatto o decretato;

46a a) tessere e conservare ordinatamente un indice di tutte le scuole, collegi e istituti di cui sopra, annotando chi siano i direttori e i maestri, quanti siano gli alunni, quale sia lo stato delle cose e dei costumi nell'istituto;

46b b) partecipare alle riunioni del consiglio scolastico, e redigere e depositare nell'archivio gli atti e i decreti del Cardinale Vicario e del suo consiglio scolastico;

53a a) riunirsi a tempi stabiliti, sotto la guida del Cardinale Vicario o dell'Assessore, affinché decidano ciò che sia necessario o opportuno per sviluppare, perfezionare in ogni singola parrocchia l'opera del catechismo;

53b b) visitare per mandato del Cardinale Vicario o dell'Assessore le singole parrocchie, chiese o scuole dove il catechismo sia insegnato, e osservare e riferire con quale metodo, con quale frutto sia tramandata la dottrina cristiana, e se le scuole che si hanno siano sufficienti per l'istruzione della gioventù di ambo i sessi, oppure se altre debbano essere aperte in ore e luoghi più opportuni;

56a a) tessere e conservare un indice di tutti i sodalizi e gli arcisodalizi dell'Urbe, nonché delle associazioni e delle opere sociali, con l'elenco di coloro che li presiedono, il numero dei sodali, il luogo dove questi si riuniscono o dove l'opera pia è situata;

56b b) intervenire alle riunioni dei sodalizi o dei consigli, di cui ai nn. 49 e 53, lett. a), registrare in un registro e conservare in archivio ciò che sia stato deliberato o statuito;

56d APPENDICE. - Del delegato all'agro romano.
