Pro excellenti praeminentia
Bull erecting the dioceses of Urbania and Sant'Angelo in Vado
are erected under the bishopric of Urbania.
Urban, bishop, servant of the servants of God, for perpetual remembrance of the matter.
1 On account of the excellent pre-eminence of the Apostolic See, in which, after blessed Peter the prince of the apostles, although with unequal merits, yet with equal authority, we have been constituted, we have deemed it worthy in the watered field of the militant Church to plant sees and churches, so that through such new planting the devotion of peoples may be increased, divine worship may flourish, and the salvation of souls may follow, and that towns and notable places, subject especially to our and the holy Roman Church's dominion, may be exalted with more worthy titles and adorned with greater honors, so that through the propagation of a new see, honored and with the assistance and governance of a presiding bishop 1 From the Registers in the Secret. of Briefs.
2 2 This bull is also referred to by Ughelli in his Italia sacra, Iota, II, col. 884 seq., Venetian edition, where another very similar one is also read, given on the same day and year for the inheritance of the episcopal see of St. Angelo in Vado, ibid. col. 896. We consulted both for the correction of the reading (r. t.). 3 We read Ughelli in both documents (R. T.).
3 4 Ughellius also reads thus, but I do not know whether the word propagation is fitting; perhaps one should read erection or planting, as he said before to plant new episcopal sees and churches (R. T.). VIII P 513 An. C. 1636 with a decent number of ministers, faithfully persisting in devotion to him, and also receiving such increase of devotion, they may more easily be able to attain the reward of eternal happiness, and worthy examples of them may fall to the ancients.
4 § 1. Indeed, since on behalf of the supplication of the universality and universities and men of the lands or territories or towns of Castro Duranti and St. Michael in Vado, of no diocese, of the province of Urbania, of the jurisdiction for the time being existing of the abbot of the monastery of St. Christopher of the land or town of Castro Duranti of this kind, of St. Benedict or another Order, it was humbly supplicated to us, that we would deign to erect both lands, or one or the other town of this kind, into a city, and the aforesaid monastery and the matrix or greater church, called the archpresbyterate of St. Michael the Archangel, of the land or town of St. Michael in Vado of this kind, otherwise capable and suitable for this, and one or the other of them, into cathedral churches, and to do and execute other things in the aforesaid by apostolic benignity;
5 § 2. We indeed, having committed this matter to the examination of the venerable congregation of our brothers, the cardinals of the holy Roman Church, placed over consistorial consultations and matters, and they, having taken counsel thereupon 1 Thus also Ughellius reads in this place; but from the other document with Ughellius and from the requirement of the context it seems that it should be added here (R. T.). 2 Thus Ughellius also has it; but either one should read worthy and their ancients in life or worthily their ancients living: a little later Ughellius reads it for they are able (R. T.). 3 Ughellius incorrectly reads in no way for of no (R. T.).
6 4 Entirely from Ughelli and from the context of reason it must be read "of the aforesaid monastery," that is, "church," for afterwards follows in the plural "churches" (note the text). 5 Thus in this place Ughelli also reads, but in the parallel place of another Bull edited by him is read the following below for "in the aforesaid" (note the text). Which was in diligent and sufficient information, whether both could be such a church, that of their [?] merited to be erected a cathedral church, they reported:
7 § 3. We (in whose hands our beloved son Francis, deacon cardinal of St. Lawrence in Damasus, called Barberini, vice-chancellor of the same holy Roman Church, our nephew by our brother german, who the aforesaid monastery, whose fruits are taxed at one hundred florins of gold in the books of the apostolic camera, as the commendatory held for his lifetime from the grant and disposition of apostolic authority, from this commend, and from all and every right belonging to him in the said monastery, in its governance and administration, or in any way competent to these, willingly and freely ceded, and Andreas Lazarus, called prepositus of St. Alexander, and Fabius Picolpassus, also called of St. Mary of Burgo, rectors of the parochial churches of the same town of Castro Duranti, beloved sons also, the aforesaid parochial churches, which they also recently held, willingly and freely resigned for the aforesaid purpose, and whom we deemed these cessions and resignations to be admitted), having heard the relation of the said cardinals, having exhibited mature deliberation upon these matters with them and other cardinals of the holy Roman Church, and by their counsel and assent, and by the fullness of apostolic power, to the praise of almighty God, and of the most glorious quality...
8 To the honor of the Virgin Mary and St. Christopher and of the whole heavenly court, to the exaltation of the Catholic faith, and to the spiritual consolation of the inhabitants of the aforesaid town of Castro Durante and the salvation of their souls, and to the glory of the said town of Castro Durante—this 1 manner, which, as we have learned, is remarkable both on account of the number of noble men dwelling there, learned men, soldiers and others placed in positions of dignity, as well as of buildings, and in which, as among other things the duchy formerly of Urbino has its primary seat and capital of the province of Massa Trebaria, reside 1 the commissioner, fiscal officer and officials of the said province; and whereas this town, in the manner of other cities of such duchy, for the ducal consistory of eight men for the whole province has obtained one of its inhabitants more than once and I have appointed it, and the dukes formerly of Urbino chose that town for their residence, and especially the illustrious memory of Francis Maria, sixth and last duke, who adorned that same town with his remarkable library and the burial of his body, [with prior perpetual regular abbacy 2 of the title and denomination in the same monastery, and, both in it and in its members and dependencies and its church of this kind, of the Order itself and of every status, essence and dependency of universals 3, and of each and every of its offices (which the Pope Paul V of blessed memory had formerly in letters of mandate for the erection of the church of St. Christopher into a collegiate church, and of one primordial dignity, and of a certain number of canonries and prebends and perhaps other benefices, ordered perpetually to be suppressed and extinguished under certain mode and form then expressed), and in the parochial churches of St. Alexander and St. Mary of the Borgo aforesaid, and in each of them, of the title of rectors

11 ...in a cathedral church, and erects the church of St. Christopher as a cathedral. ...such a place, which previously, having the particular and separate territory of an abbey and exercising pontifical rights and jurisdiction almost episcopal in the land or town of Castro Durantis, shining forth in dignity and distinguished by many other names, into a cathedral church, subject and submitted to the metropolitan right of the Archbishop of Urbino, now and for the time being existing, so that one bishop whom the Bishop of Urbino and Bishop of St. Angel in Vado shall preside over, now called Bishop of Urbino and St. Angel in Vado, the permanent suffragan of the same archbishop, who over the aforesaid churches of Urbino and St. Angel in Vado, also granted by us this day to be erected into a cathedral 4, now and henceforth perpetually united to one another, and shall preside over each of them with equal right and equal dignity, and in them and in each of the same shall exercise all and singular things which pertain to the exercise of episcopal and pontifical ordination, jurisdiction and dignity, and to those and to the convocation and celebration of the diocesan synod of each church, with all and singular privileges, honors, rights, insignia, exemptions, liberties, immunities, favors and graces, and indults, by which other bishops by right and custom, or otherwise in any way whatsoever, use, enjoy and possess, and are able to use, enjoy and possess;
12 Prepositu-§ 3. And furthermore in the same church, Ughellius badly has in this place insignited
13 To the Urbanian [Church] one dignity, a prepositorship in the same church to be erected.
14 ram to be called, the first after the pontifical, for one cleric or secular priest, master in theology, or of both laws or at least in decretals or the other doctor of laws or licentiate, the future prepositus of the same church of Urbania, who, both in choir and in chapter, in processions and other acts by those holding similar dignities of cathedral churches and other canons and other beneficiaries accustomed to be worn (and which otherwise in any way they use, enjoy and possess, and are able to use, enjoy and possess) may freely and lawfully wear5 ;
15 § 4. Likewise also in the same church of Urbania, even in the diocese of Ban, eight canonries and as many prebends for eight canons and prebendaries, and five perpetual mansionaries6 requiring personal residence for as many other secular priests now constituted, or at least at that age who within the next year may be promoted to the sacred order of priesthood, and to whom the care of souls, to be renounced from the said parochial churches and to be transferred from them to the said church of Urbania, shall fall on alternate weeks, and who by prior examination through examiners in the diocesan synod according to the form of the Council of Trent for the time being appointed ought to be examined and approved, and all to be established at the said church of Urbania7, and in it on individual days to celebrate and chant or recite the canonical hours both diurnal and nocturnal, as well as the conventual and other masses, ecclesiastical discipline being observed, and to be present at others, and otherwise to serve the aforesaid church of Urbania laudably in divine matters, and to undergo the other burdens and offices prescribed for them from time to time, and for individual chaplains of confraternities and parochial churches and without cure of St. Barbara's church, incumbent upon the capitular table of Urbania, and to bear the care of souls, both of the cathedral church of Urbania itself and renounced from other parochial churches united as aforesaid and transferred to the said church of Urbania, through themselves or the aforesaid mansionaries, and other parochial burdens and offices by turn on alternate weeks or as shall seem better, duly, and to minister the ecclesiastical sacraments to the parishioners themselves, we do, by our own motion and from certain knowledge and from the fullness of apostolic power, perpetually erect and institute.
16 § 5. And the same church of Urbania thus erected and instituted and the church of St. Angel in Vado we unite together equally and principally.
17 § 6. Likewise to the aforesaid bishop for his residence the buildings of the suppressed monastery, when he shall reside in the same Urbania, and, when in the aforesaid St. Angel in Vado, the rectoral buildings of the church of St. Michael the Archangel, granted to be erected into a cathedral as aforesaid, for the perpetual use and habitation of the same; and further to the same bishop the same cities of Urbania and St. Angel in Vado for his cities, and for the diocese of Urbania the lands formerly subject to the jurisdiction of the abbot of the suppressed monastery assigned to the bishop, and to the canons to constitute a chapter of the said church of Urbania (R. T.).
18 not however the aforesaid St. Angel in Vado, which, together with its territory and district, by that very fact from all and any other jurisdiction, except that of the bishop of St. Angel in Vado himself, free, immune and exempt is and shall be deemed to be, and shall remain for the diocese of St. Angel in Vado, and the communities of the same cities, and the universities and men of the aforesaid lands, inhabitants and residents for their peoples and diocesans, and their clergy for their clergy, and of the churches thus erected into cathedrals vassals for vassals, by the said authority we grant and assign. § 7. And moreover to the same episcopal table of Urbania all and singular things contained in the instruments of the foundations of prebends and canonries in this manner respectively for its dote, and of the prepositure, canonries and prebends in this manner, and both from certain lay confraternities of the said cities or from pious dispositions or otherwise in any way respectively both assigned and to be assigned, and for the dote of the college of five mansionaries erected in the same church of Urbania in this manner, and for the support of the burdens incumbent upon them, the tithes and quarters formerly accustomed to be paid to the chaplains, and three hundred scuta annually of the money of those parts, to be paid by the community of Urbania for twenty years only, and not beyond, and afterwards by the bishop of Urbania for the time being existing in perpetuity to be assigned and paid, we do perpetually apply and appropriate: so that it shall be lawful for the bishop both of the suppressed monastery and of St. Angel in Vado in this manner and of others, and for the prepositus of the said prepositure, and for individual canons of Urbania, and for each of their canonries and prebends particularly, to them and to each of them in specie and both to them and to the chapter of Urbania respectively
19 united, applied, assigned, as it pertains and belongs to them and to each of them respectively, and shall for the time being pertain and belong, the true, real, actual and corporeal possession of all and singular of them, through themselves or another or others, by their own authority, and without the decree or ministry of a judge or court, to apprehend and apprehended to retain perpetually.
20 § 8. Moreover to the bishop together with the chapter we grant power to make such statutes, ordinances, chapters, lawful however and honest, for the governance of the church, etc.
21 and the canons and decrees of the Council of Trent, and apostolic constitutions not contrary thereto, over the celebration of divine offices, the administration of the sacraments, and personal residence, the division and participation of daily distributions, to make and enact, and those made and enacted for the variety and quality of times and things, as often as it shall seem opportune and expedient, to limit, correct, declare and interpret, and to reduce into better form, full and complete and free faculty, by our own motion and the fullness of apostolic power in like manner, we grant and impart.
22 § 9. Finally to the bishop, provost, chapter and canons of the church of Urbania in this manner, and to other persons and ministers of the same chapter and church of Urbania existing for the time being, that in all and singular privileges, immunities, exemptions, liberties, preeminences, prerogatives, concessions, faculties, indults, favors and graces, which other bishops, and chapters of other cathedral churches, and other cities and dioceses, and their clergy, inhabitants and dwellers, and their things and goods, by right, use and custom, or by privilege, or otherwise in any way whatsoever, use, enjoy, 1 Partic: and we add (n. t.). 2 Badly edited. Main. reads chapter (r. t.). Privileges granted to the same.
23 Vili PP. 517 An. C. 1636 possess and hold, and use, enjoy and hold can and shall be able in any way in the future,1 as regards the wearing of habit, to use, enjoy, possess and hold freely and lawfully may and are able, by our own motion, authority and the fullness of power in like manner, we grant and indulge.
24 § 10. Finally to the community and men of the town of Castello Duranti in the City of the present presentation to the canonry of Urbania erected, and to confraternities, etc., instituted canonically in the same or other church of Urbania, and to others, according to the form of the foundations made and their instruments, the right of presenting, to canonicates and prebends falling vacant, suitable persons, by the Roman Pontiff or the Ordinary of the place existing for the time being to be instituted upon this presentation, and whenever from any cause they and those fall vacant, to the same Pontiff or Ordinary of the place respectively to be presented, and by the same Pontiff or bishop respectively to be instituted, with the burdens contained in the instruments of the foundations and erections, by similar motion we reserve, grant and assign.
25 § 11. Decreeing from now null and void clauses of nullity.
26 in vain, if otherwise concerning these matters by anyone whatsoever, by whatever authority, knowingly or unknowingly, it should happen to be attempted. Notwithstanding the foregoing, and our [authority] concerning unions to be committed to the parties, with those interested being called and the true value being expressed, and the unions of the most recently celebrated Lateran Council perpetual unless from cession or another probable cause being prohibited, and, insofar as it is necessary, [notwithstanding the decrees] of Paul, Pope of happy memory, and of other Roman Pontiffs our predecessors, concerning the things of the Church not to be alienated, and the foundations of individual chaplaincies and of the other aforesaid benefices, if they be an obstacle in any respect, so that in the case of benefices, chaplaincies and churches in the execution of all and singular the aforesaid [things] destined, applied, united and assigned (the tenors of all of which, and of the foundations, and of the testaments and dispositions of the founders, as well as the situations, boundaries, names, denominations, qualities and quantities of individual churches, chaplaincies and other benefices, and of other things and lands, storehouses, rents and other goods aforesaid, the true annual values, we wish to be held as sufficiently expressed in the present [document], and the wills of the founders, if they be an obstacle in any respect, and insofar as all and singular the aforesaid [matters are concerned], sufficiently, specially and expressly, by our motu proprio, authority and power aforesaid, we change), and by all other apostolic [constitutions], and those issued in synodal, provincial councils, special or general, constitutions and ordinances, and of the monastery and Order aforesaid, and of individual confraternities aforesaid, even [those] strengthened by oath, apostolic confirmation, or any other firmness, statutes and customs, privileges moreover, indults and apostolic letters, [granted] to those, and to all of theirs, superiors and persons, under whatsoever tenors and forms, and with whatsoever derogatory clauses of derogatory [clauses], and other more efficacious and most efficacious clauses and also irritant decrees, in general or in particular, or otherwise howsoever, conceded, approved and renewed; all of which, even if for their sufficient derogation special, specific, express and individual mention of them and of their whole tenors, and not by general clauses importing the same, or any other expression should be had or any other form whatsoever sought for this purpose, they would otherwise remain in their force, on this occasion only, by the tenor of these [letters], specially and expressly, by our motu proprio, authority and fullness of power similar [to the above], we derogate; and [we derogate] all other things contrary whatsoever.
27 We will, however, and by the same apostolic authority we decree, that if the aforesaid bishop should be compelled by special power to assign funds, revenues, the storehouse and other things to be guarded for the chapter.
28 are not according to their assignments corresponding assignments to the supplement of the deficient portion, [they] may and ought to be compelled and forced by the Ordinary of the place existing for the time being, or by the auditor of the apostolic camera, by royal hand, with all necessary and opportune remedies of law and fact.
29 § 13. Let it be lawful for no one whatsoever to infringe this page of our erection, institution, union, concessions, assignments, incorporations, applications, reservation, indult, impartition, derogation, commutation, will and decree, or to act against it with rash presumption; if anyone, however, should presume to attempt this, let him know that he will incur the indignation of almighty God and of the blessed Apostles Peter and Paul His.
30 Given at Rome, at St. Peter's, in the year of the Lord's Incarnation 1636, on the 12th day before the Kalends of March, in the 13th year of our pontificate. Given on 18 February 1636, in the 13th year of the pontificate.

Notes
- Ughellius reads resideal; but it seems rather that one should read resident (b. t.).
- Thus also Ughellius, but one should rather read praevià (or praeviis) of the aforesaid abbey (or in the aforesaid abbey) of regular title, as follows thereafter, perpetual suppression and extinction. Moreover, Ughellius incorrectly in the parallel place of another document has praediis for praeviis (r.t).
- Thus Ughellius also reads in this place; but perhaps one should read regularium for universalium
- Erroneously both the Main. edition and Ughellius in this place read archiepiscopo; that one should read archiepiscopi is evident from the sense of the context and from the parallel place of another document in Ughellius (r t).
- Rather read valeat, as is read in another Bull in Ughellius, for the discourse concerns only the prepositus; but in the premises which I have enclosed in parentheses perhaps something is missing; for example, and privileges, by which otherwise in any way, etc., and he himself might enjoy, or something similar (r. t.).
- Thus also Ughellius reads in this place; but that one should rather read perpetuas mansionarias, as is read in the parallel place of another document, I do not doubt (R. T.).
- From Ughellius read: residere, and together with the dignity (Ughellius wrongly h. dignilate) holding
- Although Ughellius also reads cóncessis, yet it seems that one should read in the singular concessele, as an incidental clause, and the adjective should refer to the church of St. Angelo in Vado alone, and this is argued from the parallel place of another document (R.T.),
- Thus also Ughellius in this place; but in another document aptly reads illisque (R. T.).
- More aptly Ughellius in this place reads cappellaniis (R.t).
- I would read ipsasmei (r. t.).

Notes
- Aptius Ughell. in h. l. leg. cappellaniis (R.t).
- Legerem ipsasmet (r.t.).
