Apostolic Constitution on the Apostolic Penitentiary
APOSTOLIC CONSTITUTION ON THE APOSTOLIC PENITENTIARY PIUS BISHOP SERVANT OF THE SERVANTS OF GOD FOR PERPETUAL REMEMBRANCE OF THE MATTER
1 The supreme power of binding and loosing divinely committed to Us in the Blessed Peter, Prince of the Apostles, could not fail to turn Our mind, from the moment We were advanced to the pinnacle of the Supreme Pontificate, toward that Sacred Tribunal through which the Roman Pontiff exercises this same power which he possesses in the Church, in a more profound manner and one most abundant for the salvation of souls: We speak of the Sacred Apostolic Penitentiary, to which are entrusted on the one hand, as consequent upon the Sacrament of Penance, the most intimate and most difficult matters hidden in the depths of conscience and known to God alone; on the other hand, the dispensation of indulgences, by which the faithful are granted the faculty of receiving from Divine Mercy the remission of penalties which, on account of sins committed and already deleted as to guilt in sacramental confession, remain to be satisfied.
2 And not without reason. For Our Predecessor of holy memory, Benedict XIV, when he treated of the dignity of the Sacred Penitentiary, left to us these words written: "Therefore, besides the many other tribunals of the Roman Curia constituted for various classes of cases, the Pontiffs wished above all that from the most ancient times there should exist in it and be perpetually preserved never to fail, in the manner of a fountain open in the house of David for the washing of the sinner, the Office of the Apostolic Penitentiary, to which all the faithful from every region of the Christian world might safely have recourse, each for his own spiritual ailments, however hidden, whether in person or by secret letters, with their own names even suppressed, and might forthwith obtain suitable medicine for their wounds by secret and gratuitous cure (such as all would desire to obtain)."
3 Wherefore, since We Ourselves, together with Our beloved son Lawrence, of the title of St. Pancras, Cardinal Priest of the Holy Roman Church, Major Penitentiary, have learned by experience with what reverence and how exquisite care this Our Tribunal ought to be conducted, as if to signify anew with how much gravity, prudence and acuteness of mind the spiritual affairs of the faithful are to be conducted, whom the Church strives to bring to God, We have determined to define and establish the manner and method by which the most ample and most holy faculties granted to the Sacred Penitentiary by can. 258 of the Code of Canon Law are to be employed. We have been impelled to undertake this counsel all the more because We judged it necessary to do so on account of the multitude of business to be transacted, arising indeed both from the frequent commerce of men with one another, which in ancient times no one could even suspect, and from the fact that the Office of Indulgences was by Our recent Predecessor of holy memory, Benedict XV, through Apostolic Letters given Motu Proprio, and then confirmed by the Code of Canon Law itself, perpetually attached to the Sacred Penitentiary; by which attachment indeed the power of this office has been enlarged and extended also to cases pertaining to the external forum.1
4 Addressing you recently, 25 March 1917.
5 Since, however, it seemed good to Our Predecessor, likewise of holy memory, Pius X, in the Constitution Sapienti Consilio for reforming the Roman Curia given on 28 June of the year 1908, as far as the government of the Sacred Penitentiary was concerned, to recall first to mind the Constitution In Apostolicae, given on 13 April of the year 1744 by that illustrious Pontiff and likewise Master Benedict XIV, by which with his own peculiar and singular expertise, which he had acquired for himself through use at the time when he served as a Canonist of this Sacred Tribunal, he intended to "establish in the Office of the Apostolic Penitentiary... the most correct manner of proceeding in every respect," We also turn Our mind to this solemn document; and from it alone do We draw the principal lines of these letters, both in designating the proper notes and obligations of the Officials of whom the Sacred Penitentiary consists, and in defining the handling of business; directing Our intention to this one end, on account of the causes mentioned before and on account of others which it is not necessary to set forth, that the Constitution In Apostolicae, which has now existed for almost two centuries, be accommodated to those things which the use of affairs and the circumstances of the times have taught Us, just as the same Pius X had observed, paying attention especially to the customs gradually and imperceptibly introduced into this Sacred Office, which indeed have somewhat altered the same Constitution of Benedict XIV.
6 And indeed in truth, this Office, which has always borne its own proper form, and to which a peculiar function is entrusted, namely the governing of consciences in the internal forum, which is given to no other Office of the Apostolic See, it is fitting indeed that it should also have institutions and laws altogether proper, although as far as its own discipline and that alone of its Officials is concerned, the Sacred Penitentiary ought to be subject to the general ordinances which are in force for the Roman Curia.
7 Therefore, having obtained the opinion of that same beloved Son of Ours, Cardinal Lawrence Lauri, Major Penitentiary, with mature deliberation on Our part, and from the fullness of Our Apostolic Authority, abrogating according to the norm of can. 22 all ordinances which are contained in these Apostolic Letters neither explicitly nor implicitly, We establish and decree what follows:
8 1. - The Sacred Penitentiary, which according to the norm of can. 258 of the Code of Canon Law has two sections, namely "the Tribunal properly so called and the Office of Indulgences," is presided over and governed by the Cardinal Major Penitentiary. There is no occasion here to speak of the highest dignity of the Cardinal Major Penitentiary, who does not lose office even upon the death of the Supreme Pontiff and whose presence in Apostolic Constitutions is held to be so necessary that, if he should die during a Vacant See, the Sacred College ought to provide for the election of another Cardinal who possesses the power of Major Penitentiary; which ordinances We wish to be fully confirmed by these Letters of Ours; and We likewise confirm the offices which pertain to him, whether in delegating Minor Penitentiaries both in Rome for the Patriarchal Basilicas and for other Basilicas of Italy subject immediately to Our jurisdiction, or in granting Indulgences of 300 days by contact with the penitential rod, or in celebrating sacred solemnities in certain Papal Chapels, or finally in piously rendering spiritual aid to the Supreme Pontiff at the point of death: but that which We especially propose to ourselves in the present Constitution is to establish what place he himself holds in governing Our Sacred Apostolic Tribunal of the Penitentiary. Elected by the Pontiff from among the Cardinals of the Holy Roman Church and appointed by Apostolic Letters in brief form, the Major Penitentiary, after he has undertaken the supreme office in the Vatican Basilica with special ceremonies performed, is constituted the supreme moderator of this Office with the most ample faculties of the Sacred 1 Tribunal, and in this capacity he himself comprehends in himself all and singular faculties given to this Sacred Tribunal. The Cardinal Major Penitentiary, which indeed Benedict XIV had already established, "ought to exercise his office by himself"; wherefore if he should be detained by any impediment or should be absent from Rome for some period of time and cannot conveniently be approached, it shall be his duty, with the consent of the Supreme Pontiff, to appoint another Cardinal, who, as Pro-Penitentiary, shall act in his stead. The Pro-Penitentiary moreover shall be instructed with the same faculties as the Penitentiary, and shall exercise them "in his own name." On account of the affinity of matters, care must be taken that someone be chosen for this office who is numbered among the Most Eminent Fathers co-opted into the Supreme Sacred Congregation of the Holy Office.
9 2. - The Cardinal Major Penitentiary, in the governance of the Sacred Penitentiary and in conducting business, makes use of the services of a definite number of Major Officials and Minor Officials. For determining both their series, We fully restore the Constitution In Apostolicae of Our Predecessor Benedict XIV. We wish therefore that the Major Officials be and remain six in number, each designated by his ancient title, which We retain for historical reasons, although their offices, for some especially, no longer correspond precisely to the title; and all of them, with the exception of the Regent, We place on equal footing in these letters as regards oaths and obligations. They are: the Regent, the Theologian (which office is indeed reserved by privilege to the Society of Jesus), the Datary, the Corrector, the Sealer, the Canonist; who are all truly Prelates of the Sacred Apostolic Penitentiary. The Minor Officials moreover are the Secretary, two Substitutes (one for the Tribunal Section, the other for the Indulgences Section), and finally all the rest to whom the care of the Protocol (as it is commonly called), the drawing up of Rescripts and the Tabellionship in either Section 2 is entrusted. Both those who preside over the Tabellions and those who are assigned to drawing up Rescripts shall be held in equal degree of dignity. And he shall be considered the first, or senior among them, for all purposes, who was appointed to the office of the Sacred Penitentiary earlier, with no distinction made between one Section or the other. Which order shall not be changed, even if someone should transfer to another office, whether of his own or of the other Section. If the appointment slips should have been drawn up at the same time, he among them shall obtain the first place who is the elder. The Major Officials are indeed appointed by the Supreme Pontiff through a slip of the Secretariat of State, according to the norm defined in the aforesaid Constitution Sapienti Consilio; the Minor Officials however through a slip of the Cardinal Major Penitentiary.
10 When the nomination form has been received, the Major Officials, as each one assumes his office, besides the profession of faith according to the form prescribed by Pius IV and Pius IX, and the oath mentioned in the Apostolic Letters Motu Proprio given by Our Predecessor of happy memory Pius X, - according to the norm of the Decree of the Holy Office of 22 March 1918 - before the Cardinal Major Penitentiary, with the other Major Officials and all Officials of both Sections present, shall also take the oath established by Benedict XIV in the Constitution In Apostolicae. The Minor Officials of the Tribunal, however, shall make both the profession of faith and the oath in the Signature. The obligation of the oath proper to the Sacred Penitentiary, imposed to be renewed in the first Signature of each year by both Major and Minor Officials, shall remain ratified and firm.
11 3. - Six Major Officials constitute the council or advisory body of the Cardinal Major Penitentiary; therefore, not only the Regent, but also the other five Prelates must always be ready at the nod of the Major Penitentiary. However, besides this duty of counsellors to the Major Penitentiary, all and each one, and not the Regent alone among the Sacred Prelates, 3 shall be held to be truly Major Officials of the Sacred Penitentiary, as they truly are, who assist the Regent himself, whenever called by him with the consent of the Cardinal Major Penitentiary. Indeed, having before Our eyes a suitable ordinance of Benedict XIV which has become somewhat obsolete for some time, We decree that it pertains to the five Prelates aforesaid to take turns in the office of Regent, when he is absent or legitimately hindered, since it is a matter of the highest importance that such a Tribunal be always governed, and therefore also during the time of holidays, by Prelates, Major Officials, whom Benedict XIV formerly designated not only as "adorned with integrity of life and morals," as he said when speaking of Minor Officials, but further as "distinguished by exceptional learning and expert in cases of conscience," and whom We also wish to be in every respect superior in virtue and learning. A Major Official, while he holds the place of the Regent, shall exercise all his faculties.
12 It is necessary, therefore, that the Regent maintain suitable communication with the other five Major Officials, especially by communicating to them all those matters whose knowledge is necessary to them, both for the governance of the Office and also for the dispatch of business, when they are to be substituted in the office of Regent.
13 4. - The Minor Officials, however, that is the Secretary, Substitutes, and all others - of whom none has power to govern this Office and to decide cases - according to their respective duties, defined in this Our Constitution and designated in the letters of nomination, shall furnish prudent and effective assistance in the dispatch of business; in this matter they depend on their respective superior. 5. - The Regent, first among the six Major Officials, as his very title signifies, under the immediate direction of the Cardinal Major Penitentiary, governs the Sacred Office, protecting the discipline of the Offices and the good administration of the Office, as is established for all Presidents of the Offices of the Roman Curia. He possesses all the faculties which are required to attain the ends for which the Sacred Penitentiary was instituted, according to can. 258 of the Code of Canon Law. We except, however, from the power of the Regent, besides the faculties which the Cardinal Major Penitentiary may have reserved to himself in either section, namely: in the matter of Indulgences those which we have already indicated in the list of faculties granted to the Cardinal Major Penitentiary, which list We wish to be religiously and inviolably observed; in the matter of the internal forum, the recourses which pertain to can. 132, joined with can. 214; 827; 828 c.i.c. 1527; 840; 985, 4°; 1060 ss.; 1070; 1075, 2°, 3°; 1138 ss., even for the internal forum only; 2314; 2320; 2342; 2360; 2363; 2367; 2369; 2371; 2388; 2392. In these recourses the Regent shall be able to provide, if and insofar as it is necessary, that power be given to the confessor to absolve from censures and, if the case warrants, also to dispense from irregularity; however, only in those cases in which the confessor himself could have provided by can. 2254 and 990 § 2, if it be urgent that souls be restored to the state of grace and divine friendship: but he shall immediately refer the whole matter to the Cardinal Major Penitentiary so that he may receive suitable instructions from him, since these are specially reserved to him, so that he may judge according to the norms and ordinances which We Ourselves have frequently imparted to him, and which together with others - which perhaps in the future shall be given either by Us Ourselves or by Our Successors - shall be inviolably and carefully observed by all Officials. Finally, it shall be the duty of the Regent in all the aforesaid recourses which exceed his power, to set forth each case so accurately for the record, that by the Cardinal Major Penitentiary or by the Supreme Pontiff himself with full cognizance a definitive judgment may be pronounced.
14 Const. cit.
15 and the good administration of the Office, just as it has been established for all the Prefects of the Offices of the Roman Curia. He obtains all the faculties which are required for achieving the ends for which the Sacred Penitentiary was instituted, according to can. 258 of the Code of Canon Law. We except, however, from the power of the Regent, besides the faculties which the Cardinal Major Penitentiary may have seen fit to reserve to himself in either section, namely: in the matter of Indulgences, those which we have already indicated in the list of faculties granted to the Cardinal Major Penitentiary, which list we wish to be religiously and inviolably preserved; in the matter of the internal forum, recourse which pertains to can. 132, joined with can. 214; 827; 828 of the Code; 1527; 840; 985, 4°; 1060 ss.; 1070; 1075, 2°, 3°; 1138 ss., even for the internal forum only; 2314; 2320; 2342; 2360; 2363; 2367; 2369; 2371; 2388; 2392. In these recourses the Regent shall be able to provide, if and insofar as it shall be necessary, that power be given to the confessor of absolving from censures and, if the matter warrant it, also of dispensing from irregularity; yet only in those cases alone in which the confessor himself could have provided through can. 2254 and 990 § 2, provided that it be urgent that souls be restored to the state of grace and divine friendship: but let him immediately refer the whole matter to the Cardinal Major Penitentiary so that he may receive fitting mandates from him, since these are specially reserved to him, so that he may judge according to the norms and ordinances which We Ourselves have frequently imparted to him, and which together with others—which perhaps may be given in the future either by Us Ourselves or by Our Successors—shall be inviolably and carefully observed by all Officials. Finally, it shall be the duty of the Regent in all the aforesaid recourses which exceed his power, to expound each case so accurately in the discharge of his office, that by the Cardinal Major Penitentiary or by the Supreme Pontiff himself with full cognizance a definitive judgment may be pronounced.
16 But if matters to be transacted, both in this and in that section, even those which pertain to the ordinary power of the Regent, should present themselves as obscure or implicated in some difficulty, the Regent shall refer them to the Major Penitentiary, so that they may be sent to the Prelates for the purpose of inquiry, with an equal distribution of labour made between them and account taken of the particular expertise of each, so that the solution may be more perfect and complete; then indeed the matter shall be disputed in the Signature concerning these cases. For this reason, after it shall have been determined that a certain matter is to be subjected to the inquiry of the Prelates, let it be handed over to the prefects of the Archives, who shall bring forth from the same Archives the documents necessary to each Prelate for a more certain solution and shall take care that copies of the same matter be transcribed for the other Prelates. Let the one who presides over the Archives of the Tribunal perform this twofold work, with the Regent as guide and moderator; and let the one who guards the Archives of Indulgences execute it, with the Substitute of this Section as guide and moderator.
17 When the office of Major Penitentiary is vacant, the ordinary faculties of the Regent do not on that account cease.
18 6. - Cases are handled, some in the daily Congregation, some in the Signature of the Prelates or Major Officials, and finally some are brought before the Supreme Pontiff.
19 a) Secret and urgent matters which come to the Penitentiary for the internal forum demand that they be considered, examined, and if possible completed on individual days; which most praiseworthy custom We know has always been that of this holy Tribunal. From which the necessity of a daily Congregation has arisen. Now indeed, with the Secretary and Substitutes, according to what Our Predecessor Benedict XIV, speaking of the Secretaries themselves, once established, "that the expedition of no business whatsoever, however ordinary or clear, be permitted to begin without the prior recognition and approval of the Regent himself," the Regent shall hold on individual days a twofold Congregation: one for matters of the internal forum, the other for petitions for Indulgences. The Regent himself shall preside over such Congregations, and the Secretary shall always be present together. Let the Substitute of this Section participate in the Congregation for the internal forum; but let the Substitute who pertains to this matter participate in the Congregation concerning the matter of Indulgences according to the cited Constitution. The Secretary and Substitutes, with the aid of each one's own Official, shall take care first that the cases be faithfully inscribed in the registers and that their summaries, where they have been made, be noted; then let them distribute them equally among themselves, read them, and strive to know them diligently; and let them also make a summary of them; soon let them communicate them back and forth among themselves, so that each individual relator may have them all examined, and may be able to bring mutual counsel to bear on the matter; finally let them report on them accurately in the Congregation before the Regent. He indeed, before he shall fully decide the matter, which is to be reduced to the norms which We have handed down for individual Sections, or which shall also be handed down by Us and Our Successors, ought himself to examine each case individually, so that he may be more certain of the full truth of the reports made to him. For just as the Official relators, so also the Prefect of the Office must answer jointly for the counsels taken.
20 Nothing therefore, in the matter of the internal forum, can be decided by the Prefect of the Office unless the Secretary and the Substitute of that Section are present. Wherefore if either the Secretary or the Substitute be absent, in his place the senior of the Minor Officials of that Section who is present in the Office shall suffice; senior, We say, according to the norms which We have established above. The same manner of proceeding shall also be decreed for the Indulgences Section; wherefore if the Substitute be absent from the Congregation, he shall be replaced by the senior of the Minor Officials of that Section who is present. For the Congregations ought, as far as possible, to consist of three Officials.
21 During the time of the summer recess, matters shall be so arranged that the Secretary and Substitute of the Section do not both be absent from the Tribunal at the same time; they shall therefore relieve each other in such a way that one of them remains in the Office in the usual manner; for Indulgences the absent Substitute shall be replaced by the senior Official who is present.
22 Nevertheless during the summer recess, in both this and that Section, only those matters shall be expedited which do not admit of delay and which pertain to ordinary administration. Since however the Cardinal Major Penitentiary, as is the custom, does not attend the twofold daily Congregation, it shall be open to him to request that the counsels concerning matters, whether of the internal forum or of indulgences, taken in the Congregation by the authority of the Regent, be brought to him and subjected to his approval, before Rescripts be sent out on this matter.
23 b) The Assembly of Senior Officials, presided over by the Cardinal Penitentiary Major, shall retain the name of the Sacred Signature of the Apostolic Penitentiary. The Cardinal Penitentiary Major convokes the assembly or meeting whenever he deems it opportune for handling more serious matters or matters pertaining to either Section, which in any way require further examination, and likewise for examining either competitors for the office of Minor Officials, when a competition is held for obtaining it, or candidates for the office of Minor Penitentiary in the Basilicas. When a day for the Sacred Signature has been set by the Cardinal Penitentiary Major, the Regent shall transmit instructions to him who presides over the Registry of the Tribunal, and who, while sending to the Prelates various copies of matters, whether of the internal forum or of Indulgences, which are to be discussed, shall indicate the Sacred Signature of the Apostolic Penitentiary at the command of His Eminence. And furthermore, since those matters pertaining to the Minor Penitentiaries belong to the same Prefect of the Registry, he, as he shall have been instructed, shall convoke the candidates for this office at an opportune time, making trial of them in this matter.
24 In the Signature, the Senior Officials, together with the Regent, for handling matters ex officio, shall perform the function of Counselors, since it pertains to the one Cardinal Penitentiary Major to render a deliberative and decretal judgment; in examinations, however, they have the right to cast a secret ballot, according to the norms given for this. The Penitentiary Major himself shall preside over the Signature; the Secretaries shall perform their function, for matters of the internal forum, the Secretary of the Office, and for matters of Indulgences, the Substitute of this Section. It is the duty of the Penitentiary Major to establish the order of matters to be discussed. Concerning each case, after the reading of the vote drawn up by the Senior Official, it shall be discussed by all the same Prelates present, with opinions requested by the Penitentiary Major, "according to the order of session in the Signature, which is: the Theologian, the Datary, the Corrector, the Sealer, the Canonist; finally in the last place the Regent, who through his daily dealings with the Office will be able to bring weightier considerations to bear on the final judgment. After the Cardinal Penitentiary Major has made his conclusion, this shall immediately be inscribed in the position of the case pertaining to it by the Regent, who, before proceeding to another matter, shall himself read it aloud, so that it may appear whether the words correspond to the decreed decision. He who performs the function of Secretary in the Signature lacks the right both of casting a ballot and of expressing an opinion, since this pertains only to the six Senior Officials. It is his duty first and foremost to make an accurate and careful record of the session. This record, made for the purpose of committing the discussion of the Assembly to writing, shall be read and approved in the following Signature and subscribed by the Cardinal Penitentiary Major. Both the Secretary and the Substitute of the Indulgences section shall religiously preserve in their own handwriting the book of such records pertaining to them.
25 Furthermore, he who performs the function of Secretary must always be prepared to report, in the matter pertaining to him, concerning the positions of cases which have not been subjected to deeper inquiry, but concerning which the Penitentiary Major desires to know the opinion of the Senior Officials. The conclusions shall immediately be inscribed by the reporting Official in his positions of cases and shall be read aloud by him, as was established above, when matters were being discussed concerning which the Prelates had reported.
26 All matters, concerning which anything whatsoever has been done in the Signature, the Regent shall bring to the Cardinal Penitentiary Major, who shall subscribe his own name to each decree. But if the Cardinal Penitentiary Major is absent, the Regent shall preside over the Signature (except, as is evident, in the case where a Cardinal Pro-Penitentiary has been appointed, with whom, as we have said above, all the rights are and all the faculties of the Penitentiary Major are); but the decrees of the Signature, over which the Regent has presided, must be proposed for the approval and subscription of the Penitentiary Major. If this cannot be done, they shall be brought to the Pontiff at the first Audience which is held after the Signature.
27 c) The Cardinal Penitentiary Major shall have an Audience with the Supreme Pontiff twice a month.
28 All matters shall be brought to the Audience which exceed the authority of the Major Penitentiary in one or the other Section; all matters already taken up by the Pontiff in the former Audience; and whatever the Major Penitentiary (who must always be informed of all case summaries that come to the Office) shall judge opportune to be made known to the Supreme Pontiff, so that the Pontiff may know those things which can better serve the governance of the Universal Church in this matter, and so that the same Major Penitentiary may receive norms and rules from Him in the exercise of the most ample and most holy faculties of the Sacred Penitentiary, He who, as the Supreme Moderator of consciences, is without doubt endowed by divine aid with a particular gift for the Apostolic Office which He exercises. The case summaries reserved to the Apostolic Audience shall be prepared under the direction and custody of the Regent by the Secretary, if they concern matters of conscience, or by the Substitute of Indulgences, if they concern Indulgences. Both the Secretary and the Substitute of the Indulgences Section shall, for their respective matters entrusted to each, approach the Cardinal Major Penitentiary to bring their reports to him; which reports, however, they shall first have delivered to the Regent for examination.
29 We wish, however, that at such time as the Audiences are interrupted, the Cardinal Major Penitentiary be able to provide for more urgent cases, even if they concern sentences which must also exercise their force in the external forum, since by Us the good of souls is placed before all other things; yet in the next Audience he shall report on the sentences given by him, as shall be necessary. Since, moreover, when the Office of Major Penitentiary is vacant, only ordinary faculties remain with the Regent, as has been stated above, We define that if such a vacancy should occur at a time when the Audiences are interrupted, the Regent alone may provide in cases of the gravest and most urgent necessity. The Secretary and the Substitute of the Indulgences Section shall, each for his own Section, write down in their own records whatever is worthy of note in the Audience, especially if it concerns principles, rules, or ordinances which signify changes to be introduced into the practice of this Sacred Office. A copy of these notes shall be delivered to the Regent, who shall carefully see to it that it is also sent to the five Prelates. For it is most expedient that these Officials always have before their eyes whatever may be of assistance to them in the handling of business.
30 7. After various matters have been provided for, whether in the daily Congress, or in the Signature, or finally in the Audience, the Rescripts pertaining to them must be drawn up. This duty has been entrusted to the Substitutes, who through their own Writers, skilled and diligent men, among whom case summaries shall be distributed in fair proportion, ought to procure the careful execution of matters. But so that the composition of Rescripts, which pertain to the internal forum, may be done in a uniform manner, each executor shall have with him an exemplar of the formulas which were formerly used and prescribed by Our Predecessor Benedict XIV, which We, after careful examination and inquiry made in the Signature by six Major Officials, have ordered to be conformed to the norm of the Code. From these formulas no one shall be permitted to depart, except for grave reasons, approved in each instance by the Cardinal Major Penitentiary.
31 It pertains to the Secretary, for matters of the internal forum, and likewise to the Substitute of the Indulgences Section, for his own section, to write out the drafts or "minutes" of those matters which in the form of letters or Rescripts exceed the common and customary formula, so that they may then be transmitted in order to the Writers for execution. But, as We again recall what Benedict XIV established, when he dealt with the "procurators" themselves, before the Secretary and Substitute deliver such "minutes" prepared by them to the Writers, they ought to submit them for the approval of the Cardinal Major Penitentiary or the Regent. 8. All acts of the Sacred Penitentiary, which shall be published in the journal Acta Apostolicae Sedis, must bear the signature of the Cardinal Major Penitentiary; and they shall be countersigned by the Regent or the Major Official acting in his place. Likewise We command that every other act which shall have been signed by the Cardinal Major Penitentiary be countersigned by the same Regent or Major Official.
32 Rescripts of matters which either We Ourselves by the present Constitution have excepted from the Regent's power, or which have been decreed in the Audience of the Pontiff, or which the Cardinal Major Penitentiary has reserved to himself, or finally which have been handled in the Signature, if they are not signed by the Cardinal Major Penitentiary himself, are signed by the Regent "by mandate of His Eminence."
33 In matters, however, which pertain to the ordinary power of the Regent, the Regent himself signs the Rescripts, adding nothing else. The Major Official, who acts in place of the Regent, must sign Rescripts to which the words "by mandate of His Eminence" are to be prefixed, with his own name, surname, and title, adding nothing else; other Rescripts, which would bear the signature of the Regent, he shall sign "for the Regent."
34 9. - If the Regent or another Major Official signs, the other countersignature pertains to the Secretary or to the Substitutes; yet in such a way that the Secretary is able to countersign all Rescripts of either Section, but the Substitutes only Rescripts of their own Section. When the Substitutes are absent, the Minor Official shall countersign the Rescripts, who has the right from either side to participate in the Congregation, as we have established above.
35 10. - Concerning the Rescripts of the Sacred Tribunal, that is, Rescripts which pertain to the forum of conscience, We also repeat the words of Benedict XIV: "We will that this be sacred and inviolable, that nothing whatsoever, which is to be done through the Officials of Our Apostolic Penitentiary, be done otherwise than freely."
36 The Officials, however, to whom this duty is entrusted, shall receive the proper offerings which are presented for Rescripts of the other Section; and let them record the same in a register.
37 11. - After the Rescripts have been dispatched by the Official who has charge of that matter, each individual case record shall be delivered to the Archivist, so that according to custom, they may be properly inscribed in the register and religiously preserved by the Officials, who have the care and custody of either the most secret Archives of the Sacred Tribunal, or the Table of Indulgences - entirely separated from one another.
38 12. - We decree that these things shall have force during the lifetime of the Supreme Pontiff. However, when the Apostolic See is vacant, the Regent shall have no special faculties, but shall enjoy only those which pertain to him while the Roman Pontiff is living. Since, however, the salvation of souls, which is endangered at all times, must be provided for without any other delay interposed, We will and command that the Cardinal Penitentiary Major, when the Apostolic See is vacant, be able to do and expedite all things which pertain in any way to the forum of conscience, not excepting those which otherwise, while the Supreme Pontiff is living, are withdrawn from his ordinary power, but only for cases of grave and urgent necessity. Wherefore it shall be free and expeditious for the exchange of letters between the Office of the Sacred Penitentiary and the Cardinal Penitentiary Major even while dwelling in the Conclave; and those letters, furnished with the seal of the Office, shall be subject to no examination and inspection. In this matter We expressly derogate from the ordinance contained in the Constitution Vacante Sede Apostolica (n. 50). Concerning such more urgent cases, which the Cardinal Penitentiary Major
39 shall judge require provision, he shall inform the future Pontiff at the next Audience.
40 As regards the use and granting of indulgences, when the Roman Pontiff has departed from life, We decree that the norms prescribed in the aforesaid Constitution of Pius X, Vacante Sede Apostolica (n. 23 and 24), shall be observed.
41 We decree finally and command that all these things shall begin to have force on the day on which this Constitution is published through the journal Acta Apostolicae Sedis. All things, however, which are contained in these Letters, We will and command to be stable, ratified, and valid, notwithstanding, insofar as it is necessary, Apostolic constitutions and ordinances, or any other matters fortified by any firmness, statutes, customs and all other things to the contrary, even those worthy of most special mention, all of which by these present Letters We derogate by Apostolic authority.
42 To copies or excerpts thereof, even if committed to print, subscribed by the hand of any public notary and furnished with the seal of someone constituted in ecclesiastical dignity, We will that the same faith be given as would be given to these presents, if they were exhibited or shown.
43 Let no one, therefore, be permitted to infringe this page of Our will or, by rash presumption, to act against it; if anyone, however, shall presume to attempt this, let him know that he will incur the indignation of Almighty God and of the blessed Peter and Paul, His Apostles. Given at Rome, at St. Peter, on the twenty-fifth day of the month of March, on the feast of the Annunciation of the Blessed Virgin Mary, in the year of Our Lord one thousand nine hundred thirty-five, in the fourteenth year of Our Pontificate.

2 Nequeimmerito.
1 Const. Pastor bonus, 13 April. 1744.
4 Alloquentes proxime, 25 Mart. 1917.
5 Cum autem Decesse-ri Nostro, sanctae item mem. Pio X, in Const.
In Apostolicae. - tatis Nostrae plenitudine, abrogantes ad normam can.
10 Nominationis scheda accepta, Officiales Maiores, dum suum quisque munus suscipiunt, praeter fidei professionem, secundum formam a Pio IV et a Pio IX praescriptam, et iuramentum, de quo in Apostolicis Litteris Motu Proprio a Decessore Nostro f. r. Pio X datis, - ad normam Decreti S. Officii d. 22 martii 1918 - coram Cardinali Paenitentiario Maiore, adstantibus aliis Officialibus Maioribus omnibusque Officialibus utriusque Sectionis, iusiurandum quoque a Benedicto XIV in Constitutione In Apostolicae statutum emittent. Officiales vero Minores Tribunalis tam fidei professionem quam iuramentum in Signatura dabunt. Impositum autem praeceptum iuramenti Sacrae Paenitentiariae proprii in prima cuiusque anni Signatura renovandi tam Maioribus quam Minoribus Officialibus ratum firmumque maneat.

5. - Regens primo loco inter sex Officiales Maiores, ut ipse eius titulus significat, sub immediato Cardinalis Paenitentiarii Maioris ductu, Sacrum Officium moderatur, disciplinam Officia- Const. cit.

Is omnes facultates obtinet, quae ad fines assequendos, propter quos Sacra Paenitentiaria instituta est, requiruntur, secundum can. 258 Codicis Iuris Canonici. Excipimus autem ex Regentis potestate, praeter facultates, quas in utraque sectione Cardinalis Paenitentiarius Maior sibi reservare duxerit, nominatim: in materia Indulgentiarum eas, quae iam in elencho facultatum Cardinali Paenitentiario Maiori concessarum indicavimus, quem elenchum religiose etinviolabiliter servarivolumus; in materia fori interni, recursus qui pertinent ad can. 132, iunct. can.
Eadem quoque agendi ratio pro Indulgentiarum Sectione decernatur; quapropter si Substitutus in Congressu desit, is a seniore Officialium Minorum illius Sectionis substituatur.
23 b) Coetus Officialium Maiorum, cui praeest Cardinalis Paenitentiarius Maior, nomen Signaturae Sacrae Paenitentiariae Apostolicae retineat.
27 c)CardinalisPaenitentiariusMaiorbisinmenseAudientiam Summi Pontificis habebit.
A quibus formulis nemini discedere licebit, nisi gravibus de causis, singulis vicibus a Cardinali Paenitentiario Maiore approbatis.
Const. cit. Cfr. Const. cit. antequam huiusmodi « minutas » a se paratas, Scriptoribus tradant, eas Secretarius et Substitutus approbationi Cardinalis Paenitentiarii Maioris vel Regentis subiiciant oportet. 8.

132, unito al can.
