PIUS, BISHOP, SERVANT OF THE SERVANTS OF GOD, FOR PERPETUAL REMEMBRANCE OF THIS MATTER

1 When the Apostolic See is vacant, it is a most grave and most holy matter to elect the supreme pastor of the Lord's flock and head, who, succeeding in the place of blessed Peter, may bear the person of Christ Jesus on earth, for the prudent and diligent governance of the Catholic Church. Since the Roman Pontiffs, Our Predecessors, understood this, they applied vigilant care and careful consideration at every age so that that method and order in electing might be employed which would respond more aptly and fittingly to the gravity of the matter. For this reason, many laws most wisely enacted by them at various times and circumstances were issued, so that the business itself might be completed rightly, lawfully and expeditiously: among which the principal place is held by the Constitutions opportunely sanctioned by Pius IV, Gregory XV and Clement XII.

2 However, in the course of ages, it came to pass that these laws promulgated and issued concerning the election of the Roman Pontiff were gradually increased in manifold and various ways: some also became obsolete when the circumstances of the times and the customs of men were changed: so that it seemed to be no small labour to discern which things ought to be observed in electing the Supreme Pastor.

3 We therefore, wishing to prevent this inconvenience, deemed it opportune to digest into one Constitution all that has been decreed by Our Predecessors concerning the election of the Roman Pontiff, with the prescriptions of the former Constitutions themselves preserved intact, as far as could be done, indeed even with the words (although not always corresponding in uniform style) which venerable antiquity sanctioned, yet with certain changes made, as seemed more opportune to Us.

4 Accordingly, the matter having been long and carefully considered, with certain knowledge and by Our own motion, from the fullness of Our Apostolic power, We have determined to issue this Constitution, which shall have perpetual force in the future, by which the Sacred College of Cardinals, the Roman See of Peter being vacant, and in electing the Roman Pontiff, shall use it alone, and We decree that it alone shall have the force of law, abrogating all Constitutions and Decrees, each and every one, issued by Roman Pontiffs on this matter, even those promulgated in general Councils and concluded in the body of law: excepting however Our Constitution Commissum Nobis, of the twentieth day of the month of January of the current year, concerning civil Veto or Exclusion, as it is called, in the election of the Supreme Pontiff, and the Constitution Praedecessores Nostri with the Instruction (commonly called Regulation) attached thereto, given by the late Leo XIII on the twenty-fourth day of the month of May in the year 1882, for extraordinary and troubled circumstances of the times, which We will also in the future, whenever the Apostolic See shall be in the same conditions, except in those matters to which this Constitution is derogatory, to have full force.

TITLE I

5 Concerning the Apostolic See Vacant and the Power of the Sacred College of Cardinals During the Vacancy of the Apostolic See. 1. During the vacancy of the Apostolic See, the Sacred College of Cardinals shall have no power or jurisdiction whatsoever in those matters which pertained to the Supreme Pontiff while living, nor in granting grace, nor in administering justice, nor in executing what was done by the deceased Pontiff; but it is bound to reserve all these things for the future Pontiff1. Therefore We decree that whatever the assembly of Cardinals, the Church being vacant, shall have done concerning power or jurisdiction pertaining to the Roman Pontiff while living (except insofar as is expressly permitted in this Our Constitution) shall be null and void. 2. Likewise We prescribe that the Sacred College of Cardinals shall not be able to dispose in any way of the rights of the Apostolic See and the Roman Church, nor attempt to detract from any of its rights either directly or indirectly through the appearance of connivance, or through dissimulation of crimes committed against the same

6 V in Conc. Nicaeni, cap. I 1. > in Clem.

7 rights, even after the death of the Pontiff or during the time of vacancy, perpetrated; rather We will that it ought to defend and protect the same with the exertion of all its strength. 3. Laws enacted by Roman Pontiffs cannot in any way be corrected or changed by the assembly of Cardinals of the Roman Church while it is vacant, nor can anything be taken from them or added to them, or any dispensation granted concerning them or any part of them in any way. This applies especially to the Pontifical Constitutions enacted for the regulation of the business of the election of the Roman Pontiff.

8 4. If, however, any doubts should arise concerning the meaning of the prescriptions contained in this Our Constitution, or even concerning the manner in which they ought to be applied in practice, or concerning any other chapter of this Constitution of Ours, We have decreed and do decree that the power of pronouncing judgment on these matters rests solely with the Sacred College of Cardinals; for which purpose We grant to the same Sacred College of Cardinals full faculty by which they may interpret this Constitution of Ours and declare doubts. In which matter, as in the rest concerning which it may happen to deliberate within the bounds of this Constitution of Ours, except the act of election itself, it will be entirely sufficient if the greater part of the assembled Cardinals consent to the same opinion.

9 5. Likewise in the case of urgent business which, by the vote of the greater part of the assembled Cardinals, cannot be deferred to another time, the Holy College, likewise according to the opinion of the greater part, can and ought to provide for an appropriate remedy. Chapter II On the Congregations of Cardinals 6. During the time of a vacant See, let there be a twofold Congregation of Cardinals, one general, namely of the whole College, the other particular, consisting of three senior Cardinals, one from each Order together with the Camerlengo, whose office expires entirely on the third day after the entry into Conclave, and in their place three others following in order in each Order on the third day succeed together with the same Camerlengo.

10 7. We will that in the said particular Congregations, which may be held either before or after the Conclave has begun, business of lighter moment only, and matters occurring daily or occasionally, be dispatched. But if anything of graver moment and requiring investigation shall arise, all such matters shall be referred to the general Congregation, or to the Holy College of Cardinals. And further, those things which in one particular Congregation shall have been decreed, resolved, or denied, cannot be revoked, changed, or granted in another, but the right of doing this belongs to the general Congregation alone by plurality of votes 2.

11 8. Votes in the Congregations of Cardinals, when matters of graver moment are being treated, shall be given not orally, but by secret ballot.

12 9. Among the general Congregations those worthy of special mention are those which are held before entry into Conclave, and these same Congregations may be called preparatory Congregations. 10. The general preparatory Congregations ought to take place daily without fail from the day of the death of the Pontiff until the day on which the Cardinals enter the Conclave, even on those days on which the funeral rites of the deceased Pontiff are performed, and this shall be done with the intention that it be free both for the Cardinal Camerlengo to inquire of the Holy College and to communicate with it concerning those things which he shall have judged necessary or opportune, and for individual Cardinals to lay open their opinion in matters of business, to seek explanations in doubtful matters, and to propose what is opportune. 11. In the aforesaid general Congregations the following business ought chiefly to be dispatched:

13 a) In the first Congregations the present Constitution shall be read in full, as also the aforementioned Constitution Commissum Nobis concerning the civil vote or suffrage in the election of the Supreme Pontiff, issued by Us, and by Our predecessor Leo XIII with the appended Instruction: and the same having been read, it must be sworn to by all the Cardinals present according to the prescribed formula 3. Which oath likewise those other Cardinals are bound to take who shall arrive later at the place of election, whether before or after the Comitia have begun. b) The Cardinals as soon as possible ought to decree and arrange all things which are more urgent for beginning the Conclave. c) There shall be determined the day, hour, and manner in which the body of the deceased Pontiff shall be transferred.

14 b) The Cardinals as soon as possible ought to decree and arrange all things which are more urgent for beginning the Conclave. c) There shall be determined the day, hour, and manner in which the body of the deceased Pontiff shall be transferred.

15 d) Likewise the Cardinals shall take care that all things are properly prepared, so that the Pontifical funeral rites may be solemnly celebrated on the appointed days. e) Two ecclesiastical men shall be appointed, who ought to recite the prayers "For the deceased Pontiff" and "For the election of the Pontiff".* f) A day shall be established on which, if requested by them, access to the Sacred College shall be granted both to the Legates of civil Governments and to the Knights of the Order of St. John of Jerusalem. But the aforesaid Legates shall be admitted only when assembled together, and no faculty shall be granted to individuals hereafter to approach the Sacred College. The aforesaid Constitutions "Commissum Nobis" concerning civil Veto or Exclusion, as it is called, in the election of the Supreme Pontiff, given by the same Pius X on the twentieth day of January of the same year one thousand nine hundred and four, and of Leo XIII "Praedecessores Nostri" with the appended Instruction given on the twenty-fourth day of May in the year one thousand eight hundred and eighty-two. Likewise we promise, vow, and swear, that whosoever of us shall, God so disposing, be assumed to the Roman Pontificate, shall never cease to assert and vindicate completely and vigorously the temporal rights also, especially concerning the civil principality of the Roman Pontiff, and the liberty of the Holy See, and shall again make this same promise and oath after his assumption to the summit of the Supreme Pontificate. But we promise and swear especially, under the penalties established in the aforesaid Constitution of Pius X "Vacante Sede Apostolica", that we shall most carefully and with respect to all, even our own household members or Conclavists, observe secrecy in all matters which pertain in any way to the election of the Roman Pontiff, and in those things which are done in the Conclave or in the place of election, and shall in no way violate the aforesaid secrecy, whether during the Conclave itself or even after the election of the new Pontiff, unless special faculty or express dispensation from the same future Pontiff shall be granted to us; and likewise in no way shall we accept from any civil power, under any pretext, the office of proposing a Veto or Exclusion, even under the form of a simple wish, nor shall we make known this Veto itself, known to us in any manner, whether to the entire College of Cardinals assembled together, or to individual purple-clad Fathers, whether in writing or orally, whether directly and immediately, or indirectly and through others, whether before the Conclave or during its continuance; and we shall render no aid or favor to any intervention, intercession, or any other manner by which lay powers of any grade and order shall have wished to interfere in the election of the Pontiff. The Dean Cardinal shall order this formula to be read aloud by the Prefect of Ceremonies before all the Cardinals. Then each Cardinal shall say: "And I, N. Cardinal N., promise, vow, and swear". And placing both hands upon the Gospel, they shall add: "So help me God and these holy Gospels of God".

16 hereafter access to the Sacred College shall be granted.

17 g) Individual groups of two or three Cardinals shall be appointed, commonly called Commissions: a) for inquiry into the qualities of the Conclavists and their approval, and likewise for the designation of those who ought to serve in the Conclave; ß) for the construction and closure of the Conclave, and for the arrangement of the cells.12 h) The expenses of the Conclave shall be proposed and approved. i) Letters of Emperors, Kings and other rulers of states, likewise reports of Nuncios, and all other matters which may concern the Sacred College, shall be communicated with it. k) If there be any, documents left by the deceased Pontiff to the Sacred College of Cardinals shall be read.

18 l) The Fisherman's Ring and the Lead seal of the Apostolic Chancery shall be broken. The Pro-Datary or Sub-datary, and the Secretary of Briefs or his Substitute shall deliver to the Sacred College the petitions for favors which are in their possession, sealed under seal.

19 m) The cells of the Conclave shall be distributed to the Cardinals by lot.

Chapter III Concerning certain particular offices, the Apostolic See being vacant

20 12. The offices of the Camerlengo of the Holy Roman Church and the Major Penitentiary do not cease by the death of the Pontiff.

21 13. But if it should happen that the office of one or even both of these becomes vacant before the election of the new Pontiff, then a general assembly shall be held three days after the vacancy of either of the aforesaid offices, and the votes or suffrage of the Cardinals assembled together shall be sought for the appointment of him who shall supply the place of the Camerlengo or Major Penitentiary until the election of the new Pontiff, and shall be given by secret ballots to be collected by the Master of Ceremonies even from the infirm Cardinals, and to be opened before three Cardinals at that time in order, with the same Masters of Ceremonies and the Secretary of the Sacred College present; and he shall be considered appointed into whom the relatively greater part of the votes or suffrage of the aforesaid shall have been cast, and thus appointed he shall have all the faculties which the Camerlengo or Major Penitentiary himself would have as long as the See remains vacant.

24 let him who is appointed be considered the one who is more dignified in order, or, if of the same order, the senior.

25 14. To the Cardinal Camerlengo, when the Apostolic See is vacant, there falls the care and administration of the goods and temporal rights of the Holy See itself, with the assistance in his office of the Cardinals at that time who are Priors or Heads of Orders, and having obtained votes of the Sacred College once for lighter matters and always for graver business. Hence the Cardinal Camerlengo, as soon as he shall have received notice of the Pope's death from the Prefect of the Sacred Apostolic Palace, shall go to the Apostolic Palace, so that he may take possession of it and exercise its governance. It shall be the duty of the same Camerlengo to recognize by right the Pope's death and to draw up an authentic act of death; to determine, having heard the Cardinals who are Heads of Orders, the manner for the preservation of the body of the deceased Pope according to the conditions of the times which may be more fitting and suitable (unless perhaps the Pope himself while living shall have made known his will in this matter); to affix seals to the private apartments of the same Pope; to communicate his death to the Cardinal Vicar in the City, who shall inform the Roman People by a special Edict; and to attend to all these things in the name and with the consent of the Sacred College, which the circumstances of affairs and times shall suggest for the protection of the rights of the Apostolic See and for the proper conduct of its administration16.

26 15. The Cardinal Dean of the Sacred College, as soon as he shall have been informed by the same Prefect of the Sacred Apostolic Palace of the Pope's death, shall make known to the other Cardinals the vacancy of the Apostolic See and shall summon them to the Apostolic Palace17.

27 16. The Major Penitentiary and his officials, when the See is vacant, may do and dispatch those things which were constituted and defined by the late Pope Benedict XIV18.

28 17. The offices of the Vice-Chancellors of the Holy Roman Church, the Dataries, the Secretaries of Briefs expire entirely by the death of the Roman Pontiff. 18. Likewise by the death of the Pope the office of the Cardinal Secretary of State ceases, and in his place, when the See is vacant, the Prefect of the Secretariat of the Sacred College performs that office. But if it should happen that this office becomes vacant, it shall be for the Sacred College itself to appoint someone to it, so long as the Apostolic See remains vacant, by a plurality of votes.

29 19. On the contrary, the office and jurisdiction of the Cardinal Vicar in the City do not expire by the death of the Roman Pontiff. But if it should happen that the Vicar of the City himself, when the See is vacant, departs from the living, so that the faithful of the City and its District may suffer no spiritual harm therefrom, then the Vice-regent of the said Vicar, so long as the See remains vacant, shall have all and singular the faculties, authority and power which belonged to the same Vicar in any way for the exercise of the office of Vicariate, and which the Pope himself, when the vacancy of the Vicariate occurs with the See full, is accustomed sometimes to grant to the aforesaid Vice-regent for some time, until namely he shall have appointed a successor Vicar4.

30 21. But knowing well that at that time especially, when the creation of a Pope is being considered, divine aid is to be sought more earnestly through constant prayers and other works of Christian piety and charity, and is to be earned; therefore, just as we greatly commend it, so also we wish to be retained the praiseworthy custom hitherto observed, that the Almoner of the deceased Pope continue to exercise that office with due subjection to and dependence on the Sacred College of Cardinals, until a new Pope is elected, and that the same amount of money be dispensed for the support of the same poor and needy when the See is vacant through the same Almoner as is customarily distributed by the Pope's intention, for which purpose the customary mandates from three Cardinals at that time among those in Order Priors shall be expedited5.

31 22. Concerning the faculties of the Sacred Roman Congregations, when the See is vacant, the following norms are to be observed by all, notwithstanding any privileges whatsoever.

32 23. The Sacred Congregations, when the same See is vacant, have no power in those matters which they cannot do when the See is full except by special mandate or by faculties of an extraordinary kind which are accustomed to be granted by the Roman Pontiff to the Prefects or Secretaries of the same Congregations.

33 24. But those faculties which have been attributed to them by Apostolic Letters, and are therefore reckoned as ordinary and proper to the Congregations themselves, are not extinguished by the death of the Roman Pontiff.

34 25. We wish, however, that the ordinary faculties of the Sacred Congregations be used freely by them in granting those favours which are of lesser importance, according to the circumstances of the matter. But in expediting and determining those matters which appear to be more serious or controversial, we decree that, if such a matter be one which can be deferred to another time, it shall be entirely reserved to the future Pontiff: but if it admit of no delay, then we grant to the Sacred College that it may entrust the matter to the Prefect and some other Cardinals of that Congregation to which the Pontiff would probably have referred it for examination, who, having carefully discussed the matter, may decree thereupon, yet in the manner of a provisional measure, until a Pontiff be elected, which, according to the prudence given them by the Lord, they shall judge to be suitable and consonant with the preservation and protection of ecclesiastical rights and principles 6.

Chapter V On the Funeral Rites of the Roman Pontiff

35 26. When the Roman Pontiff has departed this life, the Cardinals shall perform the customary funeral rites for his soul for nine consecutive days, unless perchance some principal and great feast should fall within those nine days, on account of the observance of which the funeral rites should appear to be interrupted; then indeed the interrupted days of the funeral rites are reckoned in the number of nine days 7. On the three last days they shall celebrate the funeral rites with more solemn ceremony; and on the last day of the same funeral rites an oration "concerning the deceased Pontiff" shall be delivered by an ecclesiastical man appointed for this purpose.

TITLE II

On the Election of the Roman Pontiff Chapter I. On the Electors of the Roman Pontiff

36 27. The right of electing the Roman Pontiff belongs uniquely and exclusively to the Cardinals of the Holy Roman Church, with the complete exclusion and removal of any intervention whatsoever of any other ecclesiastical dignity, or of any lay power of whatever grade and order 8.

37 28. If it should ever happen that the Roman Pontiff dies while the celebration of some general Council is in progress, whether it be held at Rome or in any other place in the world, the election of a new Pontiff must always and exclusively be made by the College of Cardinals of the Holy Roman Church alone, and not by the Council itself, and moreover all other persons whatsoever, even if appointed by the authority of the Council itself, are entirely excluded from conducting the same election, except the aforesaid Cardinals. Indeed, so that in such an election the aforesaid Cardinals, with every impediment removed and every occasion of disturbance and dissension taken away, may proceed more freely and expeditiously, the Council itself, in whatever state and stage it may be, is to be understood to be suspended by the law itself immediately upon receipt of certain news of the death of the Pontiff, so that, with no delay whatsoever interposed, it must immediately cease from all assemblies, congregations and sessions, and from making any decrees or canons, nor on any account, even if it should appear grave and worthy of special mention, proceed further, until a new Pontiff canonically elected shall order it to be resumed and continued.

38 29. No Cardinal, on the pretext or account of any excommunication, suspension, interdict or other ecclesiastical impediment, can in any way be excluded from the election of the Supreme Pontiff; which censures and excommunications we suspend for the purpose of such election alone, those same otherwise remaining in their force.

39 30. After any Cardinal of the Holy Roman Church has been created in Consistory, he immediately has a voice and the right of electing the Pontiff, and consequently even if the cardinal's hat has not yet been delivered to him, whether the Conclave be closed or not yet opened. For such a ceremony of closing the Conclave does not pertain to the principal faculty of the Cardinals, which concerns the election of the Supreme Pontiff, but is a certain ceremony introduced for this reason, that the Cardinals, before they cast their vote in Consistories and Congregations, may be in some way admonished of the modesty which ought to be observed by them in these and other acts.

40 31. Cardinals canonically deposed, or who have renounced the dignity of Cardinal with the consent of the Roman Pontiff, have no right to the election. Moreover, the See being vacant, the Sacred College cannot restore and rehabilitate Cardinals deprived or deposed by the Pope, not even to a voice.

41 in Clem. ; Pii IV Const. ...

42 Pius, § 11; Pii V decretum ibid. [anoaii M-romoni.iIe Greg.

43 32. We also decree and declare that if perchance any Cardinal has not been constituted at least in the order of Deacon, he ought in no way to be admitted to the election, unless he be furnished with a certain and indubitable pontifical privilege.

44 33. Likewise we decree that when the Pontiff departs from this life, the Cardinals present ought to wait for the absent for ten days only, during which the funeral rites of the deceased Pontiff are celebrated; which days having elapsed, they are bound immediately to enter the Conclave and proceed to the business of the election.

45 34. If, however, Cardinals who were absent should arrive, with the matter still open, that is, before a Pastor has been provided to that Church, they shall be admitted to the same business in that state in which they find it 32.

46 35. Moreover, to all Cardinals in virtue of holy obedience we enjoin and command that, after they have been informed by the Cardinal Dean, or if he is hindered, by another Cardinal, of the vacancy of the Apostolic See, and have been called to the election of the new Pontiff, unless they are detained by legitimate impediment, they ought to obey the letters of convocation and immediately proceed to the place designated to them for completing the election of the Pontiff 33.

47 36. If anyone should perhaps be unwilling to enter the Conclave, or having entered, should leave without a manifest cause of illness approved by oath of physicians and by the greater part of the Cardinals; then, without requiring him, and not admitting him further in the business of that election, the others shall freely proceed to elect the Supreme Pontiff. If, however, illness should befall someone such that he must leave the Conclave, even while that illness persists, the election may proceed without requiring his vote; but if he should wish to return to the Conclave after his health is restored, or even before, he shall be admitted again 34.

48 37. All and each of the Cardinals, not hindered by ill health, 28) Bonif. VIII cap. un. de schismatic. V, 3 in Sext. ; Pii IX Litt. "Quamguam", 29 Sept. 1867 29) Pii IV Const. "In eligendis", § 4 when the bell has been rung three times through the usual places of the Conclave, ought to gather for the scrutiny; if anyone does not obey this law, he shall incur the penalty of excommunication latae sententiae 35.

Chapter II Concerning Conclavists and Others Having a Part in the Conclave

49 38. Let each Cardinal in the Conclave be content with two servants, whether clerics or laymen, or one cleric and one layman; but to the infirm and gravely afflicted, a third may be allowed by the greater part of the Sacred College, or by the Cardinal Camerlengo together with the Cardinal Heads of Orders, with the consent of the greater part of the Sacred College 36.

50 39. Conclavists cannot be Prelates, nor relatives or affines in the first and second degree of Cardinals, even if they lived at their expense, or of the same Order or religious Congregation. And concerning the qualities of Conclavists, the Cardinals deputed ought to make diligent inquiry before entering the Conclave, and approve them, and after entry ought again to inquire diligently 37.

51 40. The oath which Conclavists ought to take according to the prescribed form 38 shall be done seriously and religiously, in view of the gravity of the matter, 35) Greg. XV Const. "In eligendis", § 16 37) Pii IV Const. "In eligendis", § 5 36) The formula of the oath to be taken by all ecclesiastical Conclavists by the Master of Ceremonies and by all other Conclavists, one or two days before entry into the Conclave, before the Prefect of Ceremonies or the Cardinals deputed for the matter:

52 I swear before you by the holy Gospels which I touch with my hands that I shall inviolably observe all that is done, which is done, which:

53 neither by sign, nor by word, nor by any other means shall I be permitted to violate, and not only the sentence, but also the penance, the ministry of entry. Which I shall faithfully observe the new Pontiff's election, faculty or express permission from God and I touch with my hands

54 Formula of the oath for servants to be taken touching with my hands I shall observe inviolably and which: in whatever manner they are made. For which reason it shall be the care of the Sacred Roman Church Camerlengo to ensure that the aforesaid oath be taken by them at least one or two days before entry into the Conclave, after each of them has thoroughly understood the weight of that oath and the meaning of its formula.

55 41. Conclavists, however, and any others serving, shall leave the Conclave on account of manifest and notable illness proved by physicians under oath and with the consent of the deputed Cardinals, whose conscience also we burden, and in no other way shall they return; but in their place, others shall enter at the very same time when the infirm depart 39.

56 42. Likewise, if it should happen that any Cardinal dies in the Conclave, his Conclavists ought immediately to leave the Conclave, nor can they be taken into the service of another Cardinal in the same Conclave 40.

57 43. The Sacristan of the Sacred Apostolic Palace also, together with one or more (at the discretion of the Sacred College) Clerics as assistants in the office of the Sacristy, and likewise the Masters of Ceremonies, not more than six, shall enter the Conclave, to discharge the duties pertaining to them. There shall also be present one Secretary of the Sacred College only, one Religious for hearing confessions, two Physicians, one Surgeon, one Apothecary with one or two servants, all of whom shall be chosen by the greater part of the Cardinals or by the Cardinal Camerlengo together with the Cardinals Heads of Orders, with the consent of the greater part of the Cardinals; and other persons serving the utility and convenience of the Conclave, who nevertheless ought not to be more than necessity requires 41.

Chapter III On Entry into the Conclave

58 44. When the obsequies of the deceased Pontiff have been completed (as above), and meanwhile the Conclave has been duly prepared, the Cardinals shall swear an oath that they will keep secret all that happens in the Conclave or in the place of election, and that they will not violate this secret in any way, neither directly nor indirectly, neither by words nor by writings nor by signs, or in any other manner whatsoever; and this not only under penalty of excommunication, reserved in a special manner to the future Pontiff, to the exclusion also of the Sacred Penitentiary, and to be incurred without any other declaration by the very fact of the violation of the sworn secret, but also under other penalties, even most grave, to be inflicted upon them by His Holiness himself in case of transgression. I swear and promise that I will keep this secret conscientiously even after the election of the new Pontiff has taken place, unless the same Pontiff shall grant me on this matter an express and special permission.

59 So help me God and these Holy Gospels, which I touch with my hands. 39) Pius IV Const. "In eligendis", § 24 40) Clement XII Chirogr. "Avendo noi", n. 16 41) Pius IV Const. "In eligendis", § 18; Clement XII Const. "Apostolatus officium", § 13 42) Cfr. Caeremoniale Greg. XV in the Basilica of St. Peter, or in another place suitable for the time and circumstances, where by the Dean of the Sacred College, or if he be hindered by another of the senior Cardinals, Mass of the Holy Ghost is celebrated, and at the end by some Prelate or other learned ecclesiastical man there is delivered an exhortation, by which they are admonished that, setting aside all private affections, having only God before their eyes, they should take care to provide for the Holy Roman and universal Church a Shepherd sufficient and suitable, with all the brevity and diligence they can.

60 45. When the divine service is completed, immediately, or if it should please the Fathers, in the evening, entry into the Conclave takes place. The Clerk of Ceremonies takes up the Papal Cross, and proceeds: whom the Cardinals follow, the Bishops first, then the Priests, lastly the Deacons in their violet capes: the Familiars of the Cardinals precede the Cross, and immediately the Singers singing the Hymn Veni Creator Spiritus: after the Cardinals follow the Prelates, and thus proceeding in order, they enter the Conclave, and when they have arrived at the Chapel, the Dean of the Cardinals says at the Altar the prayer Deus qui cor fidelium; when this is finished, then the aforementioned Constitutions Commissum Nobis concerning the civil Veto, and of Leo XIII Our Predecessor (setting aside those things which regard only matters already completed) are read again; and the oath, according to the form prescribed above, is again taken by all the Cardinals. Then after a brief homily has been delivered, in which he exhorts them with fitting words to carry out the business of the election rightly, the Cardinals retire to their cells distributed by lot among them. Meanwhile the Officials of the Conclave and others in the Conclave take oaths according to the prescribed Forms before the Prefect of Ceremonies or the Secretary of the Sacred College, appointed for this matter by the Cardinal Camerlengo, before whom the oath must also be taken by them beforehand. Likewise on this same day on which entry into the Conclave takes place, the Prelate placed in charge of the Pontifical Household and the Marshal of the Conclave must take the oath according to the established forms before the Dean of the Cardinals, in the presence of all the Cardinals, and the same is done by the Prelates to whom the custody of the Conclave is entrusted.

61 46. Finally, after the bell has been rung three times by order of the Dean of the Cardinals, all those who ought not to remain in the Conclave are excluded, and the Conclave itself is locked from within, and the keys of the Sacred College are assigned to the Camerlengo and to the Ceremonies and Prelates who guard the Conclave according to custom.

62 Then, with the lamps lit, three Cardinals Heads of Orders and the Camerlengo, together with the Master of Ceremonies, diligently search all the hiding places and corners of the Conclave, lest anyone of those who are forbidden to be in the Conclave should remain within. In the Conclave, however, there may be the Familiars of the Cardinals and other Officials and Ministers of the Conclave, whom we have enumerated above; but a recognition of all these Conclavists must be made, lest anyone among them should happen to be one of those who cannot be in the Conclave: which recognition, in order that it may be done more certainly, all the Conclavists are ordered to enter the Chapel, and afterwards they are counted one by one.

Chapter IV On the Closure of the Conclave, and on Maintaining Secrecy in All Things That Take Place in the Conclave

63 47. The Election of the Supreme Pontiff must take place in the Conclave, and with it closed 43, saving nevertheless the nullity of the election removed by Gregory XV (or by any other pontifical decree) established on this matter.

64 48. The Cardinals also appointed for the time being are bound, by themselves or through others, to visit frequently the cells of the Cardinals and other places of the Conclave and to search diligently, lest the closure of the Conclave be violated in any way. And if anything of this sort be discovered, the perpetrators shall be expelled from the Conclave and punished with grave penalties at the discretion of the future Pontiff 44.

65 49. With the Conclave closed, no one shall be admitted to conversation with the Cardinals or others taking part in the Conclave, except in the presence of the Prelates to whom the custody of the Conclave is entrusted, and unless they speak in a voice and in an intelligible language. And if anyone perchance (which God forbid) should secretly enter the Conclave itself, he shall be deprived ipso facto of all honour, rank, office and benefice 45.

66 50. We also will that letters, or writings of any kind whatsoever, even those published by the press, whether to those who are in the Conclave (not excepting the Cardinals of the Holy Roman Church themselves), or especially from the Conclave to those who are outside, may in no way be sent, unless all and each of them shall first be subjected to the examination and inspection of the Secretary of the Sacred College and at the same time of the Prelates who are appointed to the custody of the Conclave. We absolutely forbid all, moreover, that daily or periodic newspapers be sent outside the Conclave.

67 Those indeed who act contrary to this shall be subject to the penalty of excommunication latae sententiae.

68 51. Furthermore, as has already been expressed in the oath formulas set forth above, both for the Cardinals of the Holy Roman Church and for the Conclavists, we strictly command and enjoin that by all taking part in the Conclave secrecy be most religiously observed in all things pertaining to the election of the Roman Pontiff, and in those things which take place in the Conclave, or in the place of election. Hence all things whatsoever that could violate secrecy directly or indirectly in any manner whatsoever, whether by words, or writings, or signs, or anything else, must be entirely avoided and guarded against by all; so that those violating this law incur excommunication ipso facto, from which, as from any other penalty of excommunication imposed and inflicted in this Constitution, or to be imposed and inflicted below, against whosoever, by no one, not even by the Major Penitentiary, by virtue of any faculty whatsoever, except by the Roman Pontiff, unless in the article of death, can they be absolved 48.

69 52. Specifically, however, under the penalty of the same excommunication, we prohibit the Cardinals from disclosing to their household servants, Conclavists or any others whatsoever those things which directly or indirectly pertain to the scrutiny, likewise those things which in the meetings of the Cardinals, whether before the Conclave or during it, have been done or decreed.

70 53. Moreover we command, with their conscience gravely burdened, the Cardinals of the Holy Roman Church that this secret be observed even after the election of the new Pontiff has been completed, nor may it be violated in any way, unless by the same Pontiff a special faculty or express dispensation for this has been granted. We will that this precept be extended to all others who took part in the Conclave, if perchance they have learned, in good faith or bad faith, of those things which were done in the Conclave. Chapter V On the Form

71 54. On the following morning, after the Conclave of the preceding day has been closed, and after the customary sound of the bell, the Cardinals present there, who are not prevented by infirmity, gather, clothed over their vestment in the saffron or other colours which they ought to use whenever something is to be done collegially, in the designated Chapel, and there with the customary Mass celebrated, and Communion of the Cardinals made, and afterwards with the Hymn Veni Creator Spiritus recited with the prayer concerning the Holy Spirit, they must immediately proceed to the business of election, which indeed must be carried out in one only of the three modes or forms set forth below, otherwise the election is subject to the defect of nullity.

72 55. The first method is that which is called, as it were, by inspiration, namely when all the Cardinals, as if breathed upon by the Holy Spirit, unanimously and with living voice proclaim someone as Supreme Pontiff; concerning which method the following matters are to be noted. First, this form of election can be employed only in the Conclave, and when it is closed. Second, the election must be made according to this form by all and each of the Cardinals present in the Conclave, even those who are detained in their cells on account of infirmity. Third, commonly, and with none of them dissenting. Fourth, with no preceding discussion of a particular person, by the word "eligo" pronounced in intelligible voice, or expressed in writing, if it cannot be pronounced aloud. An example of this, however, could be of this sort. If one of the Fathers, the Conclave being closed, with no preceding special discussion as aforesaid, should say: Most Reverend Lords, having observed the singular virtue and probity of the Most Reverend Lord N., I would judge him to be worthy of election as Supreme Pontiff, and from now I elect him as Pope. Then, this being heard, if the other Fathers, with none excepted, following the opinion of the first by the same word "eligo" pronounced in intelligible voice, or if it cannot be, expressed in writing, should commonly elect the same N., concerning whom no special discussion had preceded, he N. would be canonically elected and true Pope according to this form of election, which is called by inspiration.

73 56. The second method is by compromise, namely when the Cardinals wishing to proceed to election by this form or way, should commit to some of the Fathers the power of electing, so that in place of all the Catholic Church they might provide a Shepherd; the practice of which form ought to be of this sort. First, all and each of the Cardinals present in the closed Conclave, with none of them dissenting, make a compromise in some of the Fathers (that is, in three or five or seven, not in a smaller or larger number), for example in this form: "In the name of the Lord, Amen. In the year etc., month etc., day etc., We Bishops, Priests and Deacons, Cardinals of the Holy Roman Church, all and each existing in the Conclave, namely N. N. (and each of the Cardinals be named individually), have chosen, and do choose to proceed by way of compromise, and unanimously and concordantly, with none disagreeing, we choose as compromissaries N. X. and X., Cardinals etc., to whom we give full faculty and power of providing the Holy Roman Church with a Shepherd under this form, namely" (Here it will be necessary that the Cardinals making the compromise express the manner and form according to which the compromissaries ought to elect, and according to which the one elected ought to be held as true and legitimate Pope, as for instance if three compromissaries have been elected, it should be declared whether in order that the election be valid, they ought first to propose to the Sacred College the person to be nominated by them for the Pontificate, or whether they ought absolutely to carry out the election; whether all three ought to agree upon one person; or whether it suffices that two agree upon one, and whether they ought to nominate someone from the College, or even someone outside the College, and other things similar to these.) These matters, however, or others similar, being expressed, there must be added to the compromise the time until which the Cardinals wish the compromissaries to have the power of electing, and afterwards these words are subjoined: And we promise to hold for Roman Pontiff him whom the compromissaries according to the form aforesaid shall judge worthy of election, or other words accommodated to the form prescribed to the compromissaries. Second, when such a mandate has been completed, the compromissaries withdraw to a separate place and closed, and they confer concerning the election to be made, and there ought to be premitted among them a protestation, that by whatever utterance of words they give their consent, they do not intend it unless they place it in writing. And this protestation permits the compromissaries to use words that are human and respectful among themselves, without prejudice. Third, the election having been made by the compromissaries according to the form prescribed to them, and promulgated in the Conclave, he elected by this way of compromise is true Pope.

74 57. The third and ordinary method, or form of election of the Roman Pontiff, is that which is called by scrutiny. In this matter we most fully confirm and renew the law already wisely introduced by Our Predecessors and thereafter observed most religiously through many centuries, by which namely it has been established that he alone is to be held as Roman Pontiff into whom at least two-thirds of the Cardinals present in the Conclave have agreed by secret ballot of votes9.

75 The number of votes of two-thirds of the Cardinals present in the Conclave, so that the election by way of scrutiny be valid, is to be reckoned thus: that in two-thirds of the votes the vote of the one elected is not to be numbered, and no one, whether proceeding by way of scrutiny or compromise, is able in any way to elect himself, or to give his vote to himself: nevertheless the person of the one elected, if he be in the Conclave, ought to be counted in the number of Cardinals. 58. Moreover, the rite of scrutiny contains three actions: one which is called the pre-scrutiny, another which is the scrutiny, and a third which can be called the post-scrutiny.

76 59. Five acts of the pre-scrutiny were performed, namely: the preparation of the ballots; the drawing by lot of the Scrutineers, the Deputies for the votes of the sick, and the Recognizers; the writing of the ballots; their folding; their sealing.

77 60. The preparation and distribution of the ballots pertains to the Masters of Ceremonies, who shall receive them printed, where it can be done, otherwise written in one hand according to the form described below, and shall distribute to each Cardinal at least two or three. 61. The form of the ballot, as to its shape, shall be longer on one side, that is, more long than wide. Concerning those things which are to be contained in the same ballots, in its front part, which for the sake of brevity may be called the face, three things must be comprised. First, in the upper part according to its width, these two words Ego Card, with such distance between them that between them the proper name of the Cardinal electing may be written, and a little lower two small signs, made in the manner of small semicircles, to indicate the places for seals. Second, in the middle it must contain these words:

78 I elect to the office of Supreme Pontiff the Most Reverend Lord my D. Cardinal. Third, in the lower part, two other signs, as above made in the manner of semicircles, to similarly indicate the places for seals.

79 On the outer part of the ballots, which may be called the back, two borders are to be printed from those which printers employ for the ornament of books, and which in common speech are called fregi, of which the first contains around its middle this word, Name, printed according to the length of the border itself; the other contains this word, Marks, similarly printed as the preceding. These borders were devised 10 to obscure the transparency of the pages, so that namely by light the names and marks of those electing cannot be seen; but where there is no supply of a printer, the lack of borders may be supplied by lines. But these things will be made clearer by the figures of the ballots placed below.

84 62. The second act of the pre-scrutiny is the drawing by lot of the Scrutineers, the Deputies for the votes of the sick, and the Recognizers: which drawing, before proceeding to the scrutiny, is to be done by lot in this manner. In one bag or vessel, there are to be placed publicly as many ballots, or if it is more pleasing, wooden spheres plainly numbered, as there are Cardinals present in the Conclave, with their names: then by the last Deacon let there be drawn first three Scrutineers, then three Deputies for the votes of the sick, who for the sake of brevity may be called Infirmarians, and finally the Recognizers, concerning the office of all of whom it will be written below in its proper place. But if in the drawing of the Scrutineers, Infirmarians and Recognizers there shall have been drawn Cardinals who on account of infirmity or other impediment cannot fulfill the aforesaid duties, others who are not impeded shall be drawn in their place. When the drawing is completed, the ballots

89 63. The third act of the pre-scrutiny is the writing of the ballots, which shall be done by each Cardinal in this manner. First in the upper part, in the space between the words Ego Card, he shall write his own name; then in the second part the name of him whom

Marks he elects, in character however, as much as can be done, altered, so that the hand of the writer cannot be recognized; and let him take care not to write more than one name on the ballot; because the vote would be null. In the third part indeed marks, namely some number, and some saying of Scripture, or word, or something of this kind, as in the example placed before the eyes for easier understanding, it is possible to see (p. 25). 64. The fourth act of the pre-scrutiny is the folding of the ballots, which so that it may be carried out more expeditiously by the Cardinals, can be done by the Masters of Ceremonies, when they prepare them, in this manner which follows. Two folds shall be made from each side of each ballot, so that the name of the elector and the marks when they shall have been written remain covered on each side by the borders; then what remains shall be folded in such a way that the ballot is reduced almost to the width of a thumb, as can be seen from the folded ballot which is placed here by way of example (p. 25). Moreover the Masters of Ceremonies shall distribute the ballots to the Cardinals not folded as above, but unfolded, and the Cardinals themselves, after they shall have written them as above, shall fold them according to the folds prepared by the Masters of Ceremonies. The Secretary of the S. College and the Masters of Ceremonies must depart from the hall before the Cardinals begin to write the name of the one to be elected on the ballots, so that during the time of the scrutiny the Cardinals alone remain in the Chapel.

92 Moreover, after their departure from the hall, the last Cardinal of the order of Deacons shall close the door of the Chapel; and generally he himself, whenever it shall be necessary, shall open and close it, for example, when the Cardinal Infirmarians go to collect the votes of the infirm and afterwards when they return to the Chapel, or for any other necessity.

93 65. The fifth and final act of the pre-scrutiny is the sealing of the ballots, which shall be done by each Cardinal on the back of the ballots with wax and a seal prepared for this purpose. Moreover, the seal ought not to be the usual seal of the Cardinal, but another, and kept secret, and so simple that it may be easily recognized, as if in the seal there are engraved either three numbers, or three letters and numbers, or one image only.

94 Let this suffice concerning the pre-scrutiny; moreover, as regards the infirm Cardinals, or those otherwise impeded, this shall be said below in its proper place.

95 66. There follows the second action, which has been called by the name of scrutiny. There are eight acts of this action, namely: the presentation of the ballot, the taking of the oath, the placing of the ballot in the chalice, the mixing of the ballots, their counting, the public scrutiny, the insertion of the ballots in the record, their deposit separately. 67. The presentation of the ballot, and the two following acts, which are better described together on account of their connection, shall be done in this manner. Each Cardinal, after he shall have written his own ballot, sealed it and folded it, shall take it with the first two fingers, and with hand raised openly shall bring it to the Altar, at which stand the Scrutators, and in which there is a large chalice prepared and open to receive the ballots; there, bending the knee, he shall pray for a short time: then rising, in a loud and intelligible voice, he shall swear in this form, which is described in a tablet placed upon the Altar:

96 I call to witness Christ the Lord, who shall judge me, that I elect him whom I judge according to God ought to be elected. After this he shall place the ballot in the paten, and through the paten shall put it in the chalice; which done, he shall bow to the Altar, and shall return to his place.

97 68. These things shall be observed, if the Cardinal is able to go to the Altar: for if on account of infirm health he is not able, and is present in the Chapel, the last Scrutator shall approach him; and the infirm Cardinal, after he shall have made his ballot in his place secretly, as has been said above, with the aforesaid oath having been taken first, shall hand it sealed and folded to the same Scrutator, who shall openly bring it to the Altar, and without prayer and oath shall place it in the paten, and through it shall put it in the chalice. 69. But if any Cardinals are infirm in their cells, three Cardinals Infirmarians, as extracted above, shall go to them with a Box of the height of one palm, in whose upper part there is a slit, or opening, of such size that through it a folded ballot may be passed through its width into the box; which box, before the Scrutators hand it to the Infirmarians, shall openly open, so that the other Cardinals may be able to see it empty and vacant, then they shall close it, and place the key upon the Altar; then the Infirmarians with the closed Box, and with a small dish containing sufficient ballots, shall go to each of them; and the infirm shall write the received ballots from the dish secretly, seal and fold them, and with the oath already mentioned having been taken first, shall put them in the box through the slit; but if the infirm are not able to write, either one of the three Cardinals Infirmarians, or another from the clerical order, to be chosen at their discretion, having taken an oath in the hands of the Infirmarians concerning the keeping of secrecy, shall do the aforesaid things: and these ought to be warned that they are bound not only by the bond of oath to keep the secret, but also, if they act contrary, they incur excommunication latae sententiae. These things having been completed, the Infirmarians shall return to the Chapel with the Box, which the Scrutators shall open, and shall openly count the ballots contained in it: and as many as are found, as there are infirm, they shall place one by one in the paten, and through the paten all together in the chalice.

98 Lest, however, the action of the scrutiny be drawn out too long, the Infirmarians are able to make their own ballots after the Dean and place them in the chalice, then while the other Cardinals conduct the scrutiny, to go to the infirm to receive their votes in the manner which has been just described above.

99 70. The fourth act of scrutiny is the mixing of the ballots, which shall be done by the first Scrutineer, in the chalice in which the same ballots were placed, the paten being covered, shaken repeatedly. 71. The fifth act is the counting of the ballots, which shall be done openly by the last Scrutineer, taking each ballot one by one from the chalice, and placing it in another chalice prepared for this purpose, which is empty. But if the number of ballots does not correspond to the number of Cardinals, all must be burned, and immediately, that is a second time, one must proceed at once to the voting. But if the number of ballots corresponds to the number of Cardinals, the other acts of scrutiny are to be continued. 72. The sixth act is the publication of the scrutiny, which shall be done by the Scrutineers, who sit at the table placed before the Altar, in this manner. The first Scrutineer shall take one ballot, and shall open it with the seals intact, and having seen the name of the elect in that ballot, shall hand it to the second Scrutineer, who likewise, having observed the same name of the elect, shall hand it to the third, who shall read it aloud and in an intelligible voice, so that all the Cardinals may be able to note the vote in the list printed for them, which they shall have with the names of all the Cardinals: and he shall note it next to the name of the Cardinal from the ballot read out. The same shall be done with the remaining ballots placed in the chalice, up to the last. 73. If in the publication of the scrutiny the Scrutineers find two ballots so folded together that they appear to have been given by one person only, if indeed the same person and the same elect are named in each, the aforesaid ballots shall be held and noted as one vote; but if different persons are named, neither vote shall be valid; the scrutiny, however, is not vitiated in either case. Moreover, the aforesaid votes, the publication of the scrutiny being finished, shall be reduced by the Scrutineers into one sum according to the names of the Cardinals who obtained them, or shall be noted in a separate sheet, in this manner: The Most Reverend Lord Cardinal N. obtained votes; the Most Reverend Lord Cardinal N. obtained votes from others; which is done so that the Cardinals, when it is necessary to count the votes, may count those which they noted according to the names of the Cardinals. 73. The seventh act of scrutiny is the threading of the ballots on a string, which, as the ballots themselves were examined more carefully, shall be done. This threading shall be done by the last Scrutineer, inserting each ballot, after he has read it, with a needle and thread at the word "Eligo."

100 74. The eighth and final act of scrutiny is the separate deposit of the ballots, which shall likewise be done by the last Scrutineer, who, the insertion of all the ballots on the thread being finished, shall tie the ends of the thread with a knot, and shall place all the ballots thus bound together in another empty chalice, or separately on the table.

101 75. There follows the third and final action, which has been called the post-scrutiny, of which there are three acts, namely: the counting of the votes, their verification, and the burning of the ballots. The first act therefore is the counting of the votes, which shall always be done by the Scrutineers, whether an election has followed or not: and if indeed an election has not followed, so that it may be known that in that scrutiny there is no Pope; but if one has followed, so that the canonical election of the Pontiff may be established. This counting of the votes shall be done in this manner. The Scrutineers shall reduce into one sum the votes which each person nominated for the Pontificate obtained, and if they find that none of those nominated has attained two-thirds of the votes, there is no Pope in that scrutiny; but if they find that someone of those nominated has obtained two-thirds of the votes, they shall open the ballot of the elect (which they shall recognize from the seals and signs to be revealed by the elect himself in this case), even in that part in which is the name of the one voting; and if indeed it shall appear from that that the elect voted for another, his election shall be canonical; but if it shall be established that he gave his vote to himself, his election shall be null on account of the defect of one vote. The second act of the post-scrutiny is the verification, which shall be done by the Verifiers, whether an election has followed or not, by inspecting both the ballots of the scrutiny and the records of the votes made by the Scrutineers, so that by means of this verification it may be possible to establish whether the Scrutineers have sincerely and faithfully fulfilled their duty.

102 The third and final act of the post-scrutiny is the burning of all the ballots, which shall always and openly be done by the Scrutineers, with the assistance of the Masters of Ceremonies, and immediately after the verification, whether an election has followed or not. But if, however, a second scrutiny is to be conducted, according to what shall be prescribed below, then the burning of the ballots of the first scrutiny shall be done only at the end together with the ballots of the second scrutiny.

103 76. In the Constitutions of Our Predecessors, and especially of Gregory XV, it was established for the sake of conducting the election more expeditiously that, after the scrutiny was made public, if an election by the consent of two parts had not been made in it, immediately before proceeding to other acts, the Cardinals could, once in each scrutiny, accede to one of those who in the same scrutiny had obtained at least one valid vote, provided that he was not the one nominated in the scrutiny by the Cardinal himself. Since, however, this form of accession was not a little difficult to execute, especially because it concerned the inspection, opening and comparison of the schedules, We, wishing both to remedy this inconvenience and in no way to hinder the acceleration of the desired election, have established and prescribed that in place of this accession, once both in the morning and in the evening, after the scrutiny hitherto conducted has been completed, if indeed an election has not taken place in it, the Cardinals should immediately proceed to conduct a new scrutiny, in which they should again cast their votes, those cast in the first scrutiny in no way being counted. We wish, however, that in this second scrutiny the same rites be observed as in the first, yet so that the Cardinals are not bound to take a new oath, nor to elect new Scrutators, Infirmarians and Recognizers, but what was performed in the first scrutiny regarding these matters may be valid also for the second without renewal.

104 77. And all these things which have been set down concerning the rites of the scrutiny shall be carefully observed by the Cardinals in all scrutinies, which ought to be conducted on individual days in the morning after the customary Mass and the Hymn Veni Creator Spiritus with the prayer concerning the Holy Spirit, and on the first day only; the sacred Communion of the Cardinals; and in the afternoon at an opportune hour, likewise after the Hymn Veni Creator Spiritus and the prayer concerning the Holy Spirit.

105 78. If an election shall have been celebrated otherwise than by scrutiny through secret ballots of two out of three parts of the Cardinals present in the Conclave, not counting the one elected; or by way of compromise initiated by all the Cardinals similarly present in the Conclave, the Lord not dissenting, and so that no one elected himself; or as if by acclamation, with no preceding discussion of a particular person, all the Cardinals equally present in the Conclave, commonly, no one likewise dissenting, by the word "I elect" intelligibly pronounced or written, if it could not be done by voice; let it be null and invalid by that very fact without any declaration, and the one elected shall have no right.

Chapter VI Concerning those things which are to be observed or avoided in the election of the Roman Pontiff

106 79. The crime of simony, detestable by both divine and human law, in the election of the Roman Pontiff is assuredly reprobated, and We likewise reprobate and condemn it11, and We bind the perpetrators of this crime with the penalty of excommunication incurred by the very fact; the nullification of a simoniacal election, which God forbid, established by Julius II or by any other pontifical decree whatsoever being removed, so that a pretext may be cut off for impugning the validity of the election of the Roman Pontiff. 80. Likewise under penalty of excommunication We prohibit that anyone, even if he shine with the honor of the Cardinalate, while the Roman Pontiff lives and without consulting him, presume to treat concerning the election of his Successor, or to promise any vote, or on this account, with private meetings held, to presume to deliberate and decide anything12. 81. Those things which in Our aforementioned Constitution "Commissum Nobis" We have decreed and established concerning civil Veto or Exclusion, as they call it, in the election of the Supreme Pontiff, We here renewing in every part and entirely, wish to be confirmed. Wherefore again in virtue of holy obedience, under the threat of divine judgment and the penalty of excommunication incurred by the very fact, We prohibit all and each of the Cardinals of the Holy Roman Church, both present and future, and likewise the Secretary of the Sacred College of Cardinals and all others having a part in the Conclave, that under any pretext whatsoever, they receive from any civil power the office of proposing a Veto or Exclusion, even under the form of a simple wish, and that they make known this Veto, in whatever manner it becomes known to them, either to the entire College of Cardinals assembled together or to individual purple-clad Fathers, either in writing or orally, either directly and proximately or indirectly and through others, either before the Conclave or while it is ongoing. We wish this prohibition to extend to all interventions, intercessions and any other modes whatsoever by which lay powers of any grade and order shall have wished to involve themselves in the election of the Pontiff. 82. Let the Cardinals moreover abstain from all pacts, conventions, promises and any other whatsoever obligations by which they could be bound to give or not to give their vote to someone or to some; all and each of which, if they shall have in fact intervened, even with an oath added, We decree to be null and void, and that no one is bound to their observance, and against those acting contrary We impose from now the penalty of excommunication. We do not, however, understand that discussions held for the election to be conducted, the See being vacant, are forbidden12.

107 83. Likewise we forbid that the Cardinals, before they proceed to the election, draw up chapters, or establish certain matters by common consent, to the observance of which they bind themselves, should they be assumed to the Pontificate; which also, if they have in fact taken place, even with an oath added, we declare null and void.

108 84. Finally, with the same voices with which Our Predecessors, we earnestly exhort the Cardinals of the Holy Roman Church that in electing the Pontiff, led by no inclination of mind or aversion, inclined to no one's favour or service, not by the intercession of the powerful in the world, not moved by force or fear or popular favour, but having solely the glory of God and the good of the Church before their eyes, they cast their votes for him whom they shall have judged in the Lord to be most suited above all others for governing the universal Church fruitfully and usefully. Since the faithful ought not to rely so much on the aid of human industry, however diligent, as to hope in the earnestness of humble and devout prayer, we add to this sanction that in all cities and other places at least of greater importance, as soon as news of the death of the Pontiff shall have arrived, after solemn funeral rites have been celebrated for him by the clergy and people, humble and constant prayers shall be poured forth to the Lord for each day until the Roman Church shall have been provided with its Shepherd; that He, who brings concord in His high places, may so effect concord in the hearts of those same Cardinals in the election, that provision may be made speedily, unanimously and usefully (as the salvation of souls and the utility of the whole world requires) from their unanimity. And lest so salutary an edict of the present sanction should happen to be ignored under the pretext of ignorance, we command that the Patriarchs, Archbishops, Bishops and other Prelates of the Churches, and others to whom it is the duty to proclaim the word of God, the clergy and people, for this reason to be gathered together more frequently, in their sermons diligently stir up the people to frequent the suffrage of suppliant prayers for the speedy and happy outcome of so great a matter, and by the same authority exhort them not only to the frequency of prayers, but to the observance (as circumstances to be weighed shall have suggested) of fasts.

109 86. We beseech the one elected, the heir and successor of Us, not to shrink from undertaking the same, deterred by the difficulty of the office, but rather to submit himself humbly to the counsel of the divine will: for God who imposes the burden will Himself also put His hand beneath it, lest he be unequal to bearing it; for He who is the author of the burden is Himself the helper of the administration; and lest the weak one succumb under the magnitude of grace, He will give strength who bestowed dignity.

Chapter VII Concerning the acceptance and proclamation of the election, as well as the consecration and coronation of the new Pontiff

110 87. After the election canonically made, the consent of the one elected shall be required by the Cardinal Dean in the name of the whole Holy College. 88. This consent having been given within the time limit, insofar as it may be necessary, to be determined by the prudent judgment of the Cardinals by the greater number of votes, the one elected is immediately the true Pope, and by the act acquires and can exercise full and absolute jurisdiction over the whole world. Hence, if anyone should dare to impugn letters concerning any matters whatsoever drawn up, which shall have emanated from the Roman Pontiff before his coronation, we bind him with the sentence of excommunication.

111 89. Then the new Roman Pontiff is proclaimed to the waiting people by the Prior of the Deacons.

112 90. But if the one elected is not yet a Priest or Bishop, he shall be ordained and consecrated by the Dean of the College of Cardinals. 91. Finally he is crowned by the Cardinal Dean Deacon.

113 These things therefore, the whole matter having been gravely considered, and moved also by the examples of Our Predecessors, we establish and prescribe, decreeing that these present Letters and whatever is contained in them, even for the reason that anyone having right or interest in the foregoing, or pretending to have it, has in no way consented to them, nor has been called to or heard concerning them, or from whatever other causes, can in no way be impugned, but that the same shall always and perpetually be firm, valid and efficacious and shall obtain and secure their full and complete effects, and shall be of benefit to those to whom it pertains and shall pertain for the time being, and ought to be respectively and inviolably observed by them, and that it shall be null and void, if otherwise anything concerning these matters shall happen to be attempted by anyone, by whatever authority, knowingly or unknowingly.

114 We also will that these Letters of Ours be read before all in the first Congregations held after the death of the Pontiff, as above (n. 11, a); again after entrance into the Conclave, as above (n. 45); likewise when anyone shall have been raised to the honour of the purple, with an oath interposed concerning the religious retention of those things which have been decreed in the present Constitution.

115 Notwithstanding, insofar as it may be necessary, the Constitutions and Apostolic ordinances issued by Our Roman Pontiff Predecessors, all and each of which We declare to be abrogated, as above, and all other things whatsoever contrary to this, even those worthy of individual and most special mention and derogation. Let no man therefore be permitted to infringe this page of Our constitution, ordinance, abrogation, mandate, innovation, admonition, prohibition, precept, will, or to dare to act contrary to it with rash presumption. If anyone, however, shall presume to attempt this, let him know that he will incur the indignation of Almighty God and of the blessed Apostles Peter and Paul His.

63 47. Electio Summi Pontificis fieri debet in Conclavi, et eo clauso 43, sublata tarnen nullitate electionis a Gregorio XV (vel alio quovis decreto pontificio) hac de re statuta.

67 [Q Qui vero contra fecerint, poenae excommunicationis latae sententiae subiaceant |,;.

Secundo, in medio continere debet haec verba:

78 Eligo in Summum Pontificem Reverendissirnum Dominum meum D. Cardinalem Tertio, in parte inferiori, alia bina signa, uti supra hemiciclorum instar confeeta, ad loca sigillorum similiter demonstranda.

Octo sunt huiufl actionis actus, videlicet: delatio schedulae, iuramenti praestatio, positio schedulae in calicem, schedularum mixtio, earum aumeratio, scrutinii pubü schedularum in füum insertio, earum depositio seorsum. 67. Delatio schedulae, e1 duo sequentes actus, qui melius simul describuntur ob eorum connexionem, hoc modo fient. Quilibet Cardinalis propriam schedulam, postquam ilhun scripserit, obsignaverit et complieaverit, duobus primis digitis sumet, ac elevata manu palam deferet ad Alt., quod staut Scrutatores, el in quo c^t calii magnus ,n\ recipiendas schedulas paratus et patei rtus; ibiquegenu- flectens, aliquantulum orabit : deinde surgens, alta et intelligibili voce, iurabit in hanc formam, quae in tabella super Altari posita descripta habetur:

TITOLO I

6 V in Conc. Viennense, cap. I 1. in Clem.

Caput V De exsequiis Romani Pontificis

TITULUS II

De electione Romani Pontificis Caput I. De electoribus Romani Pontificis

41 in Clem. ; Pii IV Const ..

42 /'//r.-v, § 11 :~) Pii y decretttm ihr n [anoaii M-romoni.iIe Greg.

V, 3 in Sext. ; Pii IX Litt. "Quamguam", 29 Sept. 1867 29) Pii IV Const.

XV Const. "In eligendis", § 16 37) Pii IV Const.

52 prometto davanti a te e per i Santi Vangeli che osserverò inviolabilmente il segreto circa tutto ciò che accade nel Conclave per l'elezione del nuovo Pontefice, e che non potrò in alcun modo, né con cenno, né con parola, né in alcun altro modo, violare il segreto;

Caput III De ingressu in Conclave

39) Pii IV Const. "In eligendis", § 24 40) Clem. XII Chirogr. "Avendo noi", n. 16 41) Pii IV Const. "In eligendis", § 18; Clem. XII Const. "Apostolatus officium", § 13 42) Cfr. Caeremoniale Greg.
