Bull on the reform of the Order of Friars Minor

Bull of Pope Benedict XII ·

1 of such constitutions. — 35. (1) From the Register in the Vatican Archive, copies to be given to individual convents of nuns. — 37. Clauses.

Benedict, bishop, servant of the servants of God, for perpetual remembrance of the matter.

2 Our Redeemer, maker of the heavens and creator of all creation, created man, the most worthy of earthly creatures, in His own image, so that in good and holy works he might be an imitator of his author; and He willed this to be the natural dignity of the human race, so that in it, as in a certain mirror, the form of the divine image might shine forth, and the works of the saints might be resplendent through holy actions, bestowing upon them according to one and the same spirit diverse gifts of charisms, distributing according to different graces the Church militant, and adorning it with diverse conditions of men believing in Christ, and orders of persons serving in divine offices, who, living under a rule, receive from it the way of living rightly, and undertake to conduct the course of the present warfare through the holy norm of divine commandments, and praiseworthy discipline.

3 § 1. In order, therefore, that in the sacred order of the Friars Minor, which we have long held and do hold in the depths of charity, the sacrifice of divine offices, due silence, abstinence of food, and sanctity of habit may be observed; and that the study of sacred Scripture may flourish in the said order, and that convenience for pursuing scholastic disciplines may be afforded to persons of the same order suited for this; and that the charity of God, from which other virtues are generated, may reign and burn in their hearts, and that other praiseworthy regular observances may shine forth so exemplarily in them, that they may be a mirror of right living to others, and an example of imitable sanctity: to the praise of God, and the spiritual progress of all serving in the aforesaid order, we have provided that the underwritten ordinances, with the help of God, are to be observed in the said order for perpetual future times, having consulted with us on these matters many solemn men, cardinals of the holy Roman Church: namely the venerable brothers Peter of Preneste, bishop of all; Gaucelin of Albano, bishops, and our beloved sons Peter of the title of the holy Fraxedis, presbyter, and Cathardus of the title of St. Lucy in Silice, and Bertrand of the title of St. Mary in Aquiro, cardinal deacons: and also our venerable brothers, Golius patriarch of Constantinople, and James bishop of Brescia; and our beloved sons Girbert of St. Victor of Marseille, and William of Montsolivi of the diocese of Carcassonne, abbots of monasteries, as well as Gerald General, Henry of France, John of Burgundy, Pastor of Provence, Peter of Tuscany, and also Pontius Carbonelli of Aragon, and Peter of Saxoferrato of the March of Ancona, Philip formerly of Milan, Lamentius formerly of the province of Terra Laboris, ministers of provinces, Nicholas of Nayo, Walter Chyaton, William Bernard of Podium, Anthony of Valencia, Fortanerius Vassalli, masters of sacred theology, and Peter of Strata, procurator in the curia of the said order of Friars Minor, professors of the same order, we have provided to be made.

4 § 2. First of all, concerning the performance of divine offices in the same order, by apostolic authority we ordain that before the beginning of masses and hours all the brothers of the said order, whom reasonable cause does not excuse, shall come together to the choir, preparing their hearts to the Lord, and there without discourse, murmuring, laughter, and without vain and wandering glances, in silence, in peace and with due gravity, they shall remain, sing and pray, and persevere unanimously until the end.

5 § 3. Since, moreover, ecclesiastical chant and the sacrifice of divine praise and the fruit of the lips of those singing ought to be not only the edification of those who sing, but also of those who hear, we exhort the same brothers in the Lord that divine praises be rendered completely, attentively, decently and religiously; let them entirely avoid light gestures and dissolved or broken chant; let them sing the tract in the proper manner, let them begin together what is to be sung together, continue together, and pause together.

6 8 4. We ordain also that in synodal meetings, those who act contrary to the particular ordinances of the aforesaid order in their assemblies shall be noted, and the sixth hour, like the other hours, shall be said with the note. The Custodians and Guardians and their Vicars shall diligently see to it that the aforesaid manner of coming to choir and saying the divine Office is continuously observed. If they find anyone culpable in any of the aforesaid matters, they shall punish him fittingly according to the exigency of the fault or offense. The Minister General or Provincial shall remove from their offices, as useless, those Custodians and Guardians and their Vicars whom they find notoriously negligent in the observance of such ordinance: nevertheless, the form concerning such notation described below being observed; and no brother shall be excused from choir, but all brothers shall be bound to go to all the canonical hours and to masses, except those who are actually sick, and the very aged, concerning whom the Guardian shall have discretion, and choir masters and lectors and bachelors constituted in general studies, and those reading in other studies, while they are actually continuing their lectures; excepted also are students while they are occupied in lectures on theology or ordinary disputations. Moreover, those of the aforesaid who are excepted from coming to matins in the oratory with the others shall at a suitable hour assemble together in the chapter or another suitable place, and there together shall perform the office of matins. We do not wish to bind strictly those who are gravely ill or lectors actually reading who cannot conveniently attend.

7 § 5. Furthermore, because peace is the work of justice, and silence is the worship of devotion, lest the fervor of devotion be extinguished by the disturbance of much speaking, we establish and also ordain that silence from Compline until the first striking of the hour of Prime on the following day shall be observed by all, except guests newly arriving, and those ministering or assisting them until a suitable hour with the permission or command of their Guardian. Let there be silence in the cloister, in the choir and in the church from the beginning of choir as above; and in the dormitory, in which are cells or studies, at all times: but in the dormitory separated from studies at those times when the assembly of brothers sleeps there, and in the refectory both at the first and second table, and also outside the refectory, where there shall be a multitude of brothers eating together, and this not only by residents but by outsiders shall be observed. In places, however, where brothers do not have distinct workshops, by their immediate superiors distinct and suitable places shall be assigned to those places, where brothers may be silent, and where they may speak to others when it is necessary. Similarly, the hour of sleep from the feast of the Resurrection of the Lord until the feast of the Exaltation of the Holy Cross, on each day after the second table, shall immediately be signaled by the bell of the refectory, and from then silence shall be observed until None. On days of fasting, moreover, in like manner from the ringing of the bell after the second table, silence shall be observed until the signal is given to rise from sleep according to the interval providently assigned by the Guardian. It is permitted, however, to brothers to speak briefly and quietly what is necessary. If anyone shall have broken silence, he ought to confess his fault in chapter, expressing the reason as he remembers he has offended in this matter, to whom the Guardian shall impose abstinence from pottage or wine, or from other things, or other penance according to the exigency of the fault.

8 § 6. Concerning also the wholesome formation of novices and young men of the said Order, we establish and command to be inviolably observed, that each provincial minister, or his vicar, shall annually in the table of definitions of his provincial chapter with the counsel of the definitors appoint certain convents in his province, in which all novices of the same province shall dwell; and in each of those convents he shall assign one master of novices, proven in the same religion, mature, devout, provident and discreet, who shall have continuous care of such novices, teach them the way of God, cause them often and purely to confess, and instruct them in the observance of purity of heart and body, and demonstrate to them the customs and observances of the same religion by word and example. During such time of novitiate or probation, let them not apply themselves to scholarly study, but, learning the divine office, let them diligently persist in the study of devotion and prayer, and let them not receive sacred orders, nor hear confessions if they be priests, nor go outside the door of the convent, except for the cause of transfer or general procession, or emerging necessity, or other just or reasonable cause, which shall be indicated by the brother confessors and preachers of the convent where such novices shall be, nor send letters, nor receive them without the knowledge and special permission of their master, nor speak with any secular person unless their master be present or another specially appointed by their master or guardian for this purpose. Let the guardians and the masters of the novices themselves, and the other brothers, beware lest they presume in any way to hinder anyone constituted within the year of probation from passing to another religion, which he may prefer, or returning altogether to the world, as it shall have proceeded from his own will. To professed young men also, who have not yet attained their twenty-fifth year of age, in like manner by the same minister another suitable master shall be appointed, who shall continuously and diligently watch over their life, instruct them in morals, restrain and withdraw them from insolence, and constantly lead them to regular observance. If any shall not have received reverently and with effect the instruction of the said master, the master himself shall report their defects and excesses and contumacy to his custodian or guardian, who shall subject them to such discipline that it may pass as an example to others. If any of such masters after the provincial chapter shall be hindered by death or long illness, or other just and reasonable cause, their minister with the counsel of discreet brothers ought speedily to provide others suitable. During the time of the governance or care of such mastership, the aforesaid masters shall not be sent outside the convents or places in which they shall have been appointed for these purposes, or otherwise so occupied that they are unable to attend usefully and wholesomely to the aforesaid care. If, however, brothers appointed to such mastership shall pertinaciously refuse to undertake it, let them be punished with the penalty by which disobedient brothers ought to be punished according to the institutes of the order itself.

9 § 7. Concerning abstinence, we have deemed it right to ordain providently that in general and provincial chapters, and also everywhere in the refectories of the said order, there shall be abstinence from the eating of meat, and that, where it can conveniently be done, in each convent of the order one large part of the convent according to the disposition of the guardian and the counsellors of the convent shall eat in the refectory every day, and in the house in which the other part of the convent according to the disposition of the said guardian shall eat, as in the refectory, silence shall be observed by all, and reading shall be had at table. On the festivals, however, of the Nativity, Resurrection and Ascension of the Lord, Pentecost, of the Apostles Peter and Paul, of the Assumption of the glorious Virgin, and of St. Francis, St. Anthony and Blessed Louis the bishop, let the whole convent eat in the refectory. Again also we ordain that ministers, custodians and guardians and their vicars shall be with the brothers in the convent, in the church, and at table, and in food, clothing and beds, as long as they are healthy and strong, conforming themselves to the same brothers; where, however, infirmity or weakness or the labour of travel or administration shall suggest otherwise to be done, they may separate themselves from the common life of the convent, the infirm indeed and weak as long as infirmity or weakness shall last, others, however, fatigued by the labours of travel or administration for some days, and be refreshed moderately in some suitable and honest place, being entirely guarded against superfluous and excessive expenses. We ordain moreover that ministers and custodians shall have careful concern that from alms and other things which shall come to the convents, provision be made moderately by the guardians according to the quantity of such alms and revenues to the brothers in common; lest the brothers themselves, on account of the lack of common and sufficient food, be compelled to eat separately, and to procure for themselves individually and inordinately the necessaries of life. The said guardians, however, shall diligently beware lest without manifest and reasonable cause they give brothers permission to eat outside the community.

10 § 8. Indeed, since our predecessor of happy memory, Pope John the Twenty-second, intending to declare more fully certain doubts arising concerning the quality, form and character of the vestments and habits of the brothers, and to providently correct and annul the rashness and presumption of certain brothers, who were disobedient to their prelates in these matters, and did not fear to assume and wear singular and deformed habits contrary to the common ordinance and observance of the Order and the judgment of their prelates, among other things by a certain constitution of his, which begins: *Quorumdam exigit*, added a clause which follows in these words: "And we commit to the judgment of the aforesaid prelates, ministers, custodians and guardians, by the authority of these presents, to determine, namely to judge and command, of what length, width and thickness and fineness and of what form or figure, and of similar accidents, both the habits ought to be, as also the very hoods and inner tunics with which the brothers of the said Order of Minors are clothed; and moreover of what quantity and quality of vileness they themselves ought to be clothed in such vestments, and whether in vestments of this kind according to the Rule and the declarations of our predecessors and the constitutions of the Order there may shine forth roughness, vileness and poverty; whether as to color, price, vileness, poverty also and other accidents aforesaid the brothers are clothed in vestments, as they ought to be; concerning which we burden the consciences of their ministers, custodians and guardians, strictly commanding and ordering, that in the aforesaid matters and similar ones their judgment and determination, the general indeed in the whole, the provincial in the provinces, of the ministers, custodians and guardians in the administrations, custodies and guardianships or convents of the said Order committed to the same, all and each of the brothers are altogether bound to follow, and to obey them in all things. And moreover, that by following their determination or judgment, and obeying them, they are not and cannot be said, and ought not to be, nor do they themselves make themselves transgressors of their Rule or of the constitutions of their Order. But because, as we have heard, the rashness or presumption of certain brothers of the same Order does not yet cease, wearing singular and deformed habits and vestments, as is aforesaid, wishing to recall them from such rashness and presumption to the common observance of the Order by the addition of penalty, by the authority of these presents we decree, that if any professed members of the same Order, contrary to the judgment, determination or decision of the ministers, custodians or guardians presiding in the Order itself, presume to wear habits or deformed hoods or vestments of the same habits, or vestments dissimilar and deformed from those which other brothers holding the community of the Order wear, or that brothers of the Order are bound to use such deformities, pertinaciously assert, unless within the space of fifteen days, after our present ordinance shall have reached them, they obediently desist from such insolences, they incur by that very fact the sentence of excommunication, from which they can be absolved by the general or provincial ministers in their provinces only, satisfaction being first made. But in order that there may be greater uniformity of vestments among the brothers, and charity may shine forth more among them, we ordain, that common cloth according to the Rule and the declarations of our predecessors, suitable for the brothers of the Order, be procured by those to whom it pertains, at the proper time; from which common cloth the ministers, custodians, guardians, readers, preachers, confessors, procurators and other brothers, all, without any distinction or particularity, both internally and externally, are clothed. If any brother, however, has superfluous vestments, he is bound to exhibit them to the minister, custodian or guardian, who are bound to place them in such a place, that from them the necessities of brothers or other needy persons coming upon them may be relieved. But if the said brothers neglect or despise to exhibit such vestments, the custodians or guardians aforesaid are bound and are able lawfully to take them from them. But if cloth is given to any brother or purchased for him, let not the said brother presume to have vestments or a habit made for himself from the same cloth, unless he first show the said cloth to his superior, and obtain license from him concerning this.

11 that they ought to be clothed in the same garments, and whether in garments of this kind, according to the rule and the declarations of our predecessors and the constitutions of the Order, there may shine forth harshness, vileness and poverty; and whether in all respects as to colour, price, vileness, poverty and also other accidents aforesaid the brothers are clothed in garments as they ought to be; concerning which matters we burden the consciences of their ministers, custodians and guardians, strictly commanding and enjoining that in the aforesaid matters and in similar ones, their judgment and determination—the general's in the whole Order, and the provincials' in the provinces—in the administrations, custodies and guardianships or convents of the said Order committed to them, all and each of the brothers are altogether bound to follow and to obey in all things. And moreover, that by following their determination or judgment, and by obeying them, they are not and cannot be said, nor ought to be, nor do they themselves make themselves transgressors of their rule or of the constitutions of their Order. But because, as we have heard, the rashness or presumption of certain brothers of the same Order has not yet ceased, who wear singular and deformed habits and garments, as is aforesaid, wishing to recall them from such rashness and presumption to the common observance of the Order by the addition of penalty, by the authority of these presents we decree that if any professed members of the same Order, contrary to the judgment, determination or decision of the ministers, custodians or guardians presiding in the Order itself, presume to wear a habit or deformed cowls or garments dissimilar and deformed from the garments which the other brothers of the Order wear, or pertinaciously assert that brothers of the Order ought to use such deformities, unless within the space of fifteen days after our present ordinance shall have reached them they obediently desist from such insolencies, they incur by that very fact the sentence of excommunication, from which they can be absolved by the general or by the provincials in their provinces, by the ministers only, after satisfaction has been made beforehand. But in order that there may be greater uniformity of garments among the brothers, and charity may shine forth more brightly among them, we ordain that common cloth according to the rule and the declarations of our predecessors, suitable for the brothers of the Order, shall be procured by those to whom it pertains at a suitable time; from which common cloth the ministers, custodians, guardians, readers, preachers, confessors, procurators and other brothers, all without any distinction or particularity, shall be clothed both inwardly and outwardly. If any brother has superfluous garments, he is bound to exhibit them to the minister, custodian or guardian, who are bound to place them in such a place that from them the necessities of brothers who may be in need or of other poor persons may be relieved. But if the said brothers neglect or despise to exhibit such garments, the custodians or guardians aforesaid are bound and are able lawfully to take them from them. But if cloth is given to any brother or purchased for him, let not the said brother presume to have garments or a habit made for himself from the same cloth unless he first show the said cloth to his superior and obtain license from him concerning this matter.

§ 9. But in order that due gravity and maturity may prevail among the brothers of the said order and idle wanderings may be prevented, we have providently ordained that no brother shall be sent outside the place of the brothers or licensed to go there, unless mature in conduct or with a mature and honest companion; nor shall any brother be given a companion at his own request, but a companion whom the superior shall judge expedient; nor shall they be licensed to go outside the city, village, castle or town in which the brothers dwell to other places of the brothers without testimonial letters containing obedience or license, in which according to the distance of places, the quality of persons and business, a certain term of return shall be fixed by the one granting the license or giving the obedience; nor shall such license be granted to anyone without just and reasonable cause, which he who grants the license shall judge to be true. When, however, license is given to anyone to enter the city, village, castle or town where the brothers dwell, he who shall license him shall inquire concerning the place or places, the person or persons, in which and with whom the one to be licensed shall have anything to accomplish; and he shall fix for him a certain hour within which he shall be bound to return to the place from which he departs. But a brother receiving such license shall take care not to turn aside to other places, nor to deal with other persons, nor to prolong his stay beyond the hour fixed for his return, unless an intervening necessity should compel him to act otherwise, which he himself and his companion shall be bound to explain to their superior upon their return. Provincial ministers in their provinces and custodians in their custodies, and guardians in their convents, shall punish those who wander uselessly according to the quantity and also the quality of such wanderings: and if the said ministers shall have permitted such useless wanderings to be frequent in their provinces, the visitors shall report this to the general chapter or the general minister, so that the aforesaid ministers may be duly corrected by the aforesaid chapter or minister; but the aforesaid custodians and guardians shall be corrected by the provincial ministers for such negligence. Moreover, since it is expressly contained in the rule of the said Order that brothers ought not to ride, unless manifest necessity or infirmity compels them, by the tenor of these presents we ordain that before any brother of the said Order departs from any place, concerning the aforesaid necessity and infirmity, the minister and custodian, if they shall be present there, or in their absence by the counsel of the discreet, the guardian or his vicar ought to judge: but if such necessity or infirmity shall befall any brother stationed outside the places of the said Order, on a journey or elsewhere,

12 so that the presence of the aforesaid ministers or custodians, guardians or vicars cannot conveniently be had, then the brother who shall have ridden ought immediately upon coming into the presence of any of his aforesaid superiors to explain the cause for which he rode, who with the counsel of the discreet shall examine such cause; and if he shall have approved it, such brother shall be immune from penalty, otherwise both he who without the aforesaid first judgment shall have presumed to ride, and also he whose judgment in the aforesaid case shall not have deemed the cause to be just, shall for each day on which he shall have been a transgressor in such matter fast one day on bread and water, which penance he ought to begin within the fifteen days immediately following, and to which he shall also be compelled to complete it by his superiors. But if the ministers or other aforesaid superiors shall be found culpable in this, they shall be punished more severely by the visitors, and if such vice of riding shall have been common or commonly practiced in any province, it shall be reported by the same visitors to the general chapter, by which provision shall be made concerning this with appropriate remedy.

§ 10. Furthermore we will and command that the brothers of the said Order shall not dare to give gifts or donations to ministers or other superiors of theirs, or to their companions or servants, either by themselves or through another. The ministers themselves or other superiors and their companions or servants shall not presume to receive them through themselves or another; and both the aforesaid ministers and superiors and other brothers of the said Order shall take care not to attempt to give or offer such gifts or donations to persons outside their Order at all, unless as it is permitted to them in the aforesaid cases and in each of them by the constitutions of the Order or privileges of the Apostolic See to bestow them on others within or outside the Order. But if anyone shall presume to give or receive anything contrary to such ordinance, the giver shall fast for three days on bread and water for each time

13 fast within the eight days immediately following; and he who receives shall convert what he has received, or cause it to be converted, or procure it to be converted, to the benefit or lawful use of the brothers of the convent or place of the said Order in which he received it, or rather to the nearest one, if he received it outside such convent or place, within six days after the aforesaid reception, and nevertheless he shall be bound to express this conversion and its cause to two discreet brothers of the same convent or place. But if it should happen thereafter, which God forbid, that he repeat the reception, he ought, besides the aforesaid conversion, to fast once on bread and water for each time within eight days, to be reckoned from such reception.

§ 11. And no brother shall keep a servant or familiar whom he shall be compelled to keep by our or the Order's institutes; the general minister or provincial, however, with the masters in theology of the said Order, may dispense so that they may keep a servant, if this shall seem to them expedient.

14 § 12. Moreover, to promote the doctrine of sacred theology in the aforesaid Order, we ordain that of the brothers who shall be appointed to read the Sentences at Paris, one shall be assumed in one year from the province of France, to be chosen by the provincial chapter of that province; but two in the two following years from other parts of the Order, namely one from the Cisalpine parts, the other from the Transalpine parts, to be chosen by the general chapter. But those who shall be appointed to read the Sentences at Oxford, two shall be assumed in two years from the province of England, to be chosen by the provincial chapter of that province; the third, however, for the third year shall be assumed from other parts of the Order by the general chapter, to be chosen alternately both from the Cisalpine and from the Transalpine parts. In like manner also of those who shall be appointed to read the Sentences at the Studio of Cambridge, two shall be assumed in two years from the province of England, to be chosen by the provincial chapter of that province; and the third in the third year from other parts of the Order by the general chapter, to be chosen alternately both from the Cisalpine and from the Transalpine parts, whose elections and persons elected, all and each, if they shall be present, shall be presented to the general minister, who, if he shall have nothing against them, shall send them with their letters of obedience to the aforesaid studia at certain times, enjoining upon them to fulfill the work of lectures and other scholastic acts, according to the grace given to them by God. But if the said minister shall have something grave against any of the aforesaid, by which in his judgment he should be justly repelled from such office of reader, having heard him, if he shall be present, in the same general chapter before five of the ministers and five other definitors who shall then be in the same general chapter, and his answers and defenses having been written down, or if he shall have been absent, having been called and by the same general minister, and his answers and defenses having been heard,
